Daniel Isaacson has advanced an epistemic notion of arithmetical truth according to which the latter is the set of truths that we grasp on the basis of our understanding of the structure of natural numbers alone. Isaacson’s thesis is then the claim that Peano Arithmetic (PA) is the theory of finite mathematics, in the sense that it proves all and only arithmetical truths thus understood. In this paper, we raise a challenge for the thesis and show how it can be (...) overcome. We introduce the concept of purity for theories of arithmetic: a theory of arithmetic is pure when it only proves arithmetical truths. Then, we argue that, under Isaacson’s thesis, some PA-provable truths—including transfinite induction claims for infinite ordinals and some consistency statements—are seemingly not arithmetical in Isaacson’s sense, and hence that Isaacson’s thesis might entail the impurity of PA. Nonetheless, we conjecture that the advocate of Isaacson’s thesis can avoid this undesirable consequence: the arithmetical nature, as understood by Isaacson, of all contentious PA-provable statements can be justified. As a case study, we explore how this is done for transfinite induction claims with infinite ordinals below ε0. To this end, we show that the PA-proof of such claims employs exclusively resources from finite mathematics, and that ordinals below ε0 are finitary objects despite being infinite. (shrink)

Questions concerning the proof-theoretic strength of classical versus nonclassical theories of truth have received some attention recently. A particularly convenient case study concerns classical and nonclassical axiomatizations of fixed-point semantics. It is known that nonclassical axiomatizations in four- or three-valued logics are substantially weaker than their classical counterparts. In this paper we consider the addition of a suitable conditional to First-Degree Entailment—a logic recently studied by Hannes Leitgeb under the label HYPE. We show in particular that, by formulating the theory (...) PKF over HYPE, one obtains a theory that is sound with respect to fixed-point models, while being proof-theoretically on a par with its classical counterpart KF. Moreover, we establish that also its schematic extension—in the sense of Feferman—is as strong as the schematic extension of KF, thus matching the strength of predicative analysis. (shrink)

The concept of mental privacy can be defined as the principle that subjects should have control over the access to their own neural data and to the information about the mental processes and states that can be obtained by analyzing it. Our aim is to contribute to the current debate on mental privacy by identifying the main positions, articulating key assumptions and addressing central arguments. First, we map the different positions found in current literature. We distinguish between those who dismiss (...) concerns about mental privacy and those who endorse them. In this latter group, we establish a further disagreement between conservative and liberal strategies to protect mental privacy. Then, we address the first discussion by articulating and criticizing different skeptical views on mental privacy. Finally, we try to identify what are the unique features of neural data and examine how they may be connected to the ways in which neurotechnological mindreading could put mental privacy at risk. We suggest that even if neural data is unique, it may not require new strategies to protect people from its misuse. However, identifying the special features and risks of neurotechnological mind-reading is necessary for the second discussion on mental privacy to properly take off. (shrink)

The main purpose of these introductory remarks is to give the reader a sense of Philip Rossi’s philosophical project and its importance. I will then advance an interpretation of what motivates Kant’s commitment to community, and, on its basis, object to Rossi’s views on radical evil –a point which affects how one should conceive the moral vocation of humanity and the role that politics and religion play within it. My reconstruction concludes with a sketch of how the five contributions to (...) this Symposium fit together and deepen our understanding of Rossi’s overall project. (shrink)

One of the key behavioral effects of attractiveness is increased visual attention to attractive people. This effect is often explained in terms of evolutionary adaptations, such as attractiveness being an indicator of good health. Other factors could influence this effect. In the present study, we explored the modulating role of sexual orientation on the effects of attractiveness on exploratory visual behavior. Heterosexual and homosexual men and women viewed natural-looking scenes that depicted either two women or two men who varied systematically (...) in levels of attractiveness (based on a pre-study). Participants’ eye movements and attractiveness ratings towards the faces of the depicted people were recorded. The results showed that although attractiveness had the largest influence on participants’ behaviors, participants’ sexual orientations strongly modulated the effects. With the exception of homosexual women, all participant groups looked longer and more often at attractive faces that corresponded with their sexual orientations. Interestingly, heterosexual and homosexual men and homosexual women looked longer and more often at the less attractive face of their non-preferred sex than the less attractive face of their preferred sex, evidence that less attractive faces of the preferred sex might have an aversive character. These findings provide evidence for the important role that sexual orientation plays in guiding visual exploratory behavior and evaluations of the attractiveness of others. (shrink)

Del poder de los discursos de la filosofía y la literatura. La última consecuencia del giro lingüístico del pensamiento, y de nuestros hábitos culturales alrededor de la enorme profusión de textos filosófico-literarios (...) o literario-filosóficos, se interpreta así como la posible, acaso provocada, disolución de los géneros discursivos. Un lenguaje que se distingue por su continuidad, contingencia y siempre problemática referencialidad, es lo que el autor pone en juego al querer leer como casos paradigmáticos de esta disolución discursiva a Borges, Cortázar, R. The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

Abstract:: This essay addresses the notion of public order from the point of view of biopolitics. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) Finally, in dialogue with Sarah Ahmed and Mary Douglas, it explores the role of the biopolitics of public order in the constitution and policing of the moral and physical, internal and external borders separating the political community from its various others. ¿Qué entendemos hoy por “neoliberalismo”? Si bien hay varias formas de contestar tal pregunta, la respuesta más frecuente consiste en asociarlo con la aplicación de un conjunto de medidas estrictamente económicas; de hecho, se dice que los neoliberales, casi por defecto congénito, no pueden pensar la realidad más allá de los números y las recetas abstractas. Siguiendo el método arqueológico-genealógico de Michel Foucault y de algunos de sus intérpretes contemporáneos, el presente artículo buscará revisar y en lo posible ampliar aquella (...) concepción crítica. Nuestra hipótesis es que el neoliberalismo no se reduce a un mero “economicismo”, sino que contiene más bien toda una dimensión “espiritual”, todo un campo de prácticas y de discursos que se conforma como respuesta ante el excesivo racionalismo de las sociedades modernas. La cuestión consiste en transformar a los hombres desde dentro, hasta el punto de tornarlos más aptos para acceder a un conjunto de valores y asimilar ciertas formas de comportamiento. Según sostiene este artículo, es en los escritos de Wilhelm Röpke, un economista y sociólogo alemán de mediados del siglo XX, donde mejor se aprecia la dimensión espiritual del neoliberalismo. Röpke proponía un “diagnóstico” y una “terapéutica”. El primero sostiene que los hombres padecen una enfermedad espiritual denominada como “masificación” y “proletarización”, mientras que la terapéutica procura hacer de esos hombres unos emprendedores de sí mismos. Tal sería el modo de superar los efectos adversos del capitalismo: transformando a los hombres masificados y proletarizados en sujetos completamente comprometidos con su profesión. No se trata sencillamente de recuperar un pensamiento casi olvidado por la historia, sino de explorar los límites de nuestro presente, especialmente de nuestras formas de subjetividad. Aunque muchas de las críticas contemporáneas no hayan reparado aún en ello, hay que preguntarse hasta qué punto los diagnósticos y las terapéuticas propuestas por neoliberales como Röpke persisten en la actualidad. Aquí no se darán respuestas tajantes y definitivas, pero sí algunos indicios al respecto. (shrink)

La realización del Proyecto Genoma Humano (PGH) supuso la utilización de diversas técnicas de cartografiado y secuenciación del genoma. En términos muy generales, los mapas del genoma permiten identificar y aislar genes individuales, esto es, fragmentos de ADN que codifican una determinada cadena polipeptídica. Por su parte, la secuenciación consiste en la determinación del orden de las bases nitrogenadas del ADN. Las técnicas implicadas en ambos procesos, aunque plurales y heterogéneas, tienen su origen en el ámbito de la biotecnología. En (...) su desarrollo constatamos cómo un conjunto de realidades heterogéneas se configuran como artefactos, operadores y relatores, en relación a otras configuraciones circulares y radiales con las que se codeterminan. El examen de los actores, instituciones y materiales implicados en el Proyecto Genoma Humano (PGH) remite inmediatamente al contexto de los macroproyectos científicos que suelen caracterizarse con el expresivo rótulo de «Big Science». Como es bien sabido, la afortunada expresión fue acuñada por el sociólogo de la ciencia Derek de Solla Price en 1936 quien elaboró su concepción considerando, principalmente, a la física de su época. Sin embargo, las ciencias biológicas tardaron varios decenios más en adquirir las dimensiones de la (...) Big Science. En el caso del PGH se presenta un panorama muy distinto al contexto en el que surgió la estructura de la doble hélice. El investigador aislado no tiene cabida en este contexto, y los grandes científicos son ahora directores de proyectos y el caso de James Watson es de nuevo paradigmático. (shrink)

En el presente trabajo se estudia la génesis del Proyecto Genoma Humano (PGH) desde un enfoque filosófico. A la vista de la cuantiosa bibliografía sobre el tema, quizá las siguientes páginas pudieran parecer impertinentes, pero no pretendemos elaborar una mera paráfrasis, más o menos afortunada, de varios ensayos previos porque este trabajo supone una reacción crítica frente a esos mismos ensayos. Nuestro proceder es, desde un primer momento, dialéctico, pues supone una rectificación de las distintas exposiciones acerca de la génesis (...) del PGH. Por ello, hemos de tomarlas en consideración como contenidos del propio trabajo. El análisis pormenorizado sería excesivo; una breve reseña, casi a título inventarial, de los ejemplares más destacados permitirá ejemplificar los problemas mencionados, además de ofrecer un primer bosquejo de los contenidos y contornos de la investigación. La dimensión científica del Proyecto Genoma Humano (PGH) remite a un conjunto de entidades de orden biológico: bases nitrogenadas, genes, enzimas, SNP’s1, etc., sobre las cuales se ejercitan las operaciones tecnológicas que dan lugar a la secuenciación del genoma. Un examen más atento muestra que todos los cuerpos, morfologías y estructuras que forman parte constituyente del PGH pueden circunscribirse al campo de la biología molecular, con lo cual están dados a la misma escala, lógicamente. Esta primera suposición, que habrá que (...) constatar en la reconstrucción ulterior, permite regresar hacia el curso de la constitución de la biología molecular, como factor del contexto histórico determinante del PGH, sin tener que retrotraerse a procesos anteriores de la historia de la biología para dar razón de la conformación y conexión de los trazos que forman parte de la figura de referencia. Durante su intercambio epistolar con Spinoza, Tschirnhaus defiende la imposibilidad de deducir la naturaleza de los cuerpos particulares a partir de la sola extensión. El motivo de esta objeción reside en su dificultad para desmarcarse de la concepción sustancial de los cuerpos como partes finitas de la extensión sostenida por Descartes. Esta dificultad inicial, sin embargo, queda ensombrecida por la intervención de Leibniz en un momento clave de la correspondencia que convertirá la disputa de carácter físico en una controversia teológica. Este artículo demuestra que el problema metafísico detectado por Leibniz consiste en la afirmación radical del principio de plenitud contenida en la proposición 16 de la primera parte de la Ética y las consecuencias heréticas que de ésta se desprenden. El examen del papel que la crítica de Leibniz jugó en el desarrollo de la discusión permitirá leer bajo una nueva luz tanto la paradójica actitud de Tschirnhaus como las enigmáticas y elusivas respuestas de Spinoza. Scholars have considered that Spinoza’s difficulties in dealing with the objections raised by Tschirnhaus against his physical approaches were the spur that led the latter to dissociate himself from the former in the field of natural philosophy. The aim of this paper is, on the one hand, to refute this misjudgment and, on the other, to show that the cause of it lies in having dismissed a significant post-Cartesian current of thought, buried in oblivion by the triumph of Newtonian mechanics, (...) which intended to develop a physics in purely relational terms. In turn, this will allow us to read the physical proposals of Spinoza and Tschirnhaus as paradigmatic examples of this relational physics. (shrink)

El ajuste entre Estado y nación en Latinoamérica ha observado complicaciones desde la fundación de sus repúblicas. La pluralidad de subjetividades, realidades materiales y brechas, sumadas a las coyunturales demandas insatisfechas y una débil institucionalidad influyeron en que las construcciones nacionales hayan tenido un componente populista en diferentes intentos refundadores. En los países andinos ese componente se expresa a partir de unas condiciones sociopolíticas previas a las performativas identidades nacionales y la presencia de liderazgos personalistas. Parte de los estudios sobre (...) identidades nacionales en estos países se centraron en el análisis de sus liderazgos y discursos. Otros optaron por centrarse en los procesos o condiciones de posibilidad que favorecen la irrupción de estas identidades. El objetivo del trabajo es brindar una base epistemológica que emerja de la compatibilidad entre los anteriores abordajes explicativos de las identidades nacionales. (shrink)

RESUMEN La polémica sobre los prejuicios es un símbolo distintivo de la Ilustración alemana. Este artículo presenta aspectos históricos de esta polémica que resultan útiles para esclarecer el pensamiento de Kant. Se argumenta que la posición kantiana respecto de ella, como una polémica en la que convive una perspectiva que busca la liberación de todo prejuicio y otra que permite que algunos permanezcan, y hasta los estima como útiles, representa un esfuerzo por conciliar ambas perspectivas, y anticipa la distinción planteada (...) en la "Dialéctica trascendental" entre el uso regulativo y constitutivo de las ideas. ABSTRACT The controversy over prejudices is a distinctive feature ofthe German Enlightenment. The article addresses some historical aspects of this controversy that are useful to shed light on Kant's thought. Enlightenment positions ranged from the perspective seeking to rid itself of all prejudices, to that which allows for some prejudices and even considers them useful. The article argues that the Kantian position on the matter constitutes an effort to reconcile these perspectives, thus anticipating the distinction set forth in the "Transcendental Dialectic" between the regulative and the constitutive use of ideas. In a note introduced into the second edition of Religion within the Boundaries of Mere Reason (1794), Kant assigns a systematic role to the General Remarks at the end of each Part of his book. He calls those Remarks, “as it were, parerga to religion within the boundaries of pure reason; they do not belong within it yet border on it” (RGV 6:52). As Kant sees them, the parerga are only a “secondary occupation” that consists in removing transcendent obstacles. This (...) paper is skeptical of Kant's view. It proposes an alternative account, according to which the parerga are essential to our moral education, since they force human reason to confront its own limitations and resist the urge to take refuge in spurious religious beliefs. That urge, I argue, is linked to the propensity to evil, and uses religious orthodoxy to undermine moral religion. By clipping our dogmatic wings, the parerga encourage reason to face its own dialectical tendencies and direct its speculative interest to immanent practical use. This redirection counteracts the debilitating effects of the propensity to evil and plays a key role in our moral regeneration. To consider the parerga “derivative,” as Kant himself does, is therefore a grave mistake. (shrink)

The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the analysis (...) (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. This article analyzes the main reasons offered by the literature in relation to the question of whether pre-implantation genetic diagnosis and selection should be allowed in the context of assisted reproduction techniques to avoid the birth of children with disabilities. The bioethical literature faces a challenge from the disability discourse. When the oppressive social dimension of disability is taken into account, it results in a series of questions that could challenge the most settled conclusions of the bioethical debate. However, the (...) social model has not been without criticism and one of them, the underestimation of the importance of biological traits origin against a disability of social origin, resonates particularly in the debate on preimplantation genetic selection. Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. No se trata de una reseña de nombres y obras, ni de una historia interna del desarrollo de problemas puros o escuelas. Más bien, su foco, en afinidad con las obras mencionadas, (...) son “las distintas relaciones históricas entre las fuerzas del poder y las razones de la filosofía […] las distintas inscripciones en los también múltiples quiasmos entre saberes y poderes” (14-15), asumiendo, de modo más sustantivo, que “el bloque histórico dominante en Chile rara vez ha logrado establecer un relato coherente de la dominación, justamente porque es poco lo que le importan las razones en nombre de las cuales ejerce la fuerza” (41). However, this assertion lead to ask, which type of satire represent the Film. To structure these characterizations will be allude the Satire Theory of Friedrich Schiller, which works to delimitate not only the satirical elements of the story, but the mode the movie takes to become a critic to (...) the society. This will show how the Movie operate as a moralizing reflection, whose originality lies in the employment of the Satire to carry out this reflection. (shrink)

El propósito del presente trabajo es examinar la concepción kantiana del pensamiento y de su negativo a la luz de la crítica deleuziana a la imagen del pensamiento. Luego de cotejar las afirmaciones del filósofo francés con la letra de Kant, sostendremos que, si el concepto de ilusión trascendental se aparta de la misma en tanto cuestiona la buena naturaleza de la razón y la afinidad del pensamiento con lo verdadero, la ilusión es conjurada mediante su legitimación moral y, así, (...) Kant continúa postulando su rectitud natural. Mediante el análisis de la concepción kantiana del error, mostraremos asimismo que las afirmaciones deleuzianas relativas a la superación del concepto clásico de error como desviación del pensamiento por parte de Kant no pueden sostenerse sino que, por el contrario, Kant concebía las facultades como naturalmente rectas, pudiendo ser desviadas solo por interposiciones externas. This article discusses explanations behind theory choice, that is, ultimately, what leads people to accept a certain claim as valid. There has been a recent debate as to how closure was achieved in the continental-drift discussion. The controversy had found its usual explanation under rationalist terms: Wegener’s 1912 continental-drift theory was accepted 50 years later only after the plate tectonic theory had provided more evidence or a more in-depth problem-solving capacity. Nevertheless, a re-examination of the controversy under constructivist terms argued (...) that closure was achieved by a change in the style of thought. This analysis prompted some authors to react calling to a ‘defence of rationalism’ and insisting on explaining that the continental-drift theory was only accepted because of epistemic reasons. As the debate impacts on the way to explain scientific controversies, in this article I analyze rationalist and constructivist approaches with respect to ways to explain the social acceptance or rejection of a theory. The analytical perspectives will be contextualized within a broader theoretical discussion in philosophy and social sciences about the role of different factors that condition knowledge, which will also include an empirical approximation in the analysis of GMO and continental-drift controversies. Ultimately, the debate with rationalism is situated in a broader context about the ways of explaining the social acceptance of a theory, arguing that the problem with the rationalism that confuses a purely logical explanation with a sociological one is that it tends to judge rather than understand. In recent years, there has been a growing interest in Kant's doctrine of radical evil, arising from as diverse quarters as philosophy, psychoanalysis and the social sciences. This interest has contributed to the revival of the notion of evil, which had been displaced from the center of philosophical discussion in the 20th century. A common trait in the recent literature is that it takes the relevance of the use of the concept of evil for granted. Yet, before understanding what Kant (...) really means by radical evil, it seems appropriate to ask first whether the notion of evil as such is necessary. For, given its religious background, this notion elicits expectations that may be incompatible with the secular concerns of moral philosophy. Such misgivings are aggravated by additional doubts about the concept's explanatory function in the first place. The pertinence of reviving a concept so allegedly flawed cannot be taken at face value. Thus, the task I set for myself here is to show the necessity of the concept of evil as it lies at the core of Kant's moral philosophy already in the Groundwork, far before he actually coins the notion of “radical evil” in the Religion. Whether this latter account is defensible or not, we will at least be sure that talk about an evil which is said to be radical is not in vain. (shrink)

In two occasions a Bibliography of Structuralism has been published in Erkenntnis (1989, 1994). Since then a lot of water has flowed under the bridge and the structuralist program has shown a continuous development. The aim of the present bibliography is to celebrate the 25th anniversary of the publication of An Architectonic for Science –structuralism’s main reference work– and of its recent translation into Spanish by updating the previous bibliographies with titles which have appeared since 1994 as well as before (...) that year but which are not included in them. As in the former deliveries, this bibliography only covers books and articles that are concerned directly with the structuralist approach in the philosophy of science. We would like to thank the many colleagues who have helped us in collecting all the information. We pose this problem: Descartes responds to Voetius’ irrational accusation by resorting once, on his own initiative, to Gospel, an interpretation that reviews the laws of charity as akin to the laws of natural friendship governing pastor and teacher roles. We propose that the Letter be a legal argument. Descartes has no interest in theological virtues: facing irrationality, he delves into private law to prove that Voetius is not a true teacher, or a true pastor, and encroaches on the function of judge. In two occasions a Bibliography of Structuralism has been published in Erkenntnis (1989, 1994). Since then a lot of water has flowed under the bridge and the structuralist program has shown a continuous development. The aim of the present bibliography is to celebrate the 25th anniversary of the publication of An Architectonic for Science –structuralism’s main reference work– and of its recent translation into Spanish by updating the previous bibliographies with titles which have appeared since 1994 as well as before (...) that year but which are not included in them. As in the former deliveries, this bibliography only covers books and articles that are concerned directly with the structuralist approach in the philosophy of science. We would like to thank the many colleagues who have helped us in collecting all the information. The accusation is etymologically coherent (Voetius is the libeler, whose word divides men) and introduces an exception to metaphysics, a will to evil. Finally, malignity hates truth (absurditas): it is deliberately irrational. The article examines the oratory of evil: first, its rhetorical devices (in contrast with the rhetoric of Guez de Balzac); second, the passions it elicits (in contrast with Passions of the Soul) and their combination with a specific passion, pious rage; and third, its effects: the dissolution of the civil bond among citizens and the friendship bond family members. Marion titulada, dedicada a la unión de alma y cuerpo, y cuya tesis principal es: los problemas que esta unión suscita confunden dos términos, cuerpo y mi cuerpo. Esta confusión lleva a que se apliquen al primero categorías propias del segundo. Se examinan las "paradojas ónticas" que mi cuerpo (la carne) inaugura (a); se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta (b); se discute la (...) "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). -/- The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). -/- Neste artigo, propõe-se um exame crítico da última obra de J.-L. Marion, intitulada "Sur la pensée passive de Descartes", dedicada à união de alma e corpo, e cuja tese principal é: os problemas que essa união suscita confundem dois termos, corpo e meu corpo. This article is, in particular, a discussion of the article by Jaegwon, Kim: "Non-reductionist physicalism and its problem with mental causation". In general, we turn to classic texts of phenomenology to refute any (non) reductionist physical theory.

This article deals with the methodological procedures employed by Johannes Kepler, particularly those used in the process of elaboration of the two first laws of planetary movements. Its aim is to show that the astronomical practice of Kepler is linked with the proposal of (physical and mathematical) hypothesis and with valuing precision in observational data, with the goal of obtaining, by means of rigorous procedures, the (mathematically expressed) regularities of planetary motions. It was only afterwards that Kepler looked for an (...) explanation of the regularities (laws) discovered, formulating the hypothesis of the magnetic action exerted by the Sun, which is located at the physical center of the system. In the new astronomy, he modifies the methodological status of astronomical hypotheses in the beginning of 17th century (present in Ptolemy, Copernicus and Brahe), promoting the passage from a mathematical descriptive astronomy to a physical-mathematical explicative astronomy. Speculative realists have directed a radical critique towards what they call “correlationism,” the stance according to which we only have access to the correlation between thinking and being, and never to either term considered apart from the other. Both Quentin Meillassoux and Ray Brassier have used Gilles Deleuze’s ontology as a paradigmatic example of correlationism. Instead of defending Deleuze from this accusation, I argue that we need to accept it, but that the correlation is drastically transformed when we take into (...) account Deleuze’s panpsychism. I hence contend that Deleuze is a panpsychist, grounding my argument in (a) his theory of contemplations and (b) his account of the universe as a cinema in itself. This changes everything, since a panpsychist type of correlationism avoids the main problem that leads both Meillassoux and Brassier to try to overcome correlationism, namely, that of the possibility of existence before and after humans. This article reports the case of an elementary school principal, Ella, committed in the implementation of a reform dedicated to bring together several educational worlds. It proposes a conceptual construction around the notions of “meeting work » and « identity contingency » with the aim of comprehend the collective work in education. This construction unfolds methodically in a thematic and enunciative analysis of interviews. The analysis shows the events of this work and shows how, in the interface between professionalism and (...) psyche, the identity contingency, as an assumption of ambiguity, establishes an essential foundation of this work. Immanuel Kant’s Religion within the Boundaries of Mere Reason (1793) is a formidably difficult book, which since its very inception was ripe for controversy. Part of the difficulty in understanding Kant’s text is thematic: in the idea of God and the questions surrounding faith in God’s existence, all interests of reason seem to converge –metaphysics, epistemology, morality, politics, the purposiveness of nature, and the destiny of the human species all unite in Kant’s view of religion and give it a distinctive (...) polyphonic tone. Part of the difficulty is ideological: Kant’s treatment of religious matters—relying on the assumption that a rational a priori core (identical to the principles of his morality) underlies and shapes all historical revelations—distances itself from both dogmatism and atheism. Those who accept religious orthodoxy, no less than those who are committed to a purely secular view of human affairs, are doomed to be displeased with the ambiguities of Kant’s approach, which preserves religion but subverts the meaning of this term so drastically as to make it unrecognizable in its traditional understanding. James DiCenso’s Commentary, “the first complete English language commentary on the work” (according to the dust-jacket), is thus a daring philosophical undertaking: it required not only comprehensive knowledge of Kant’s corpus but also the intellectual versatility to appreciate Kant’s innovative view. En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que hay buenas (...) razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

El imperativo cultural de la monogamia impregna toda la arquitectura jurídica del Estado y, al mismo tiempo, la excede, saturando las relaciones sociales de formas no siempre evidentes. A partir de ese presupuesto, este trabajo se centra, geográficamente, en Brasil y, temporalmente, en el contexto abierto por la pandemia de covid-19, con el objetivo de defender la hipótesis de que la monogamia se ha visto reforzada en cuanto principio organizador del campo de la sexualidad y de las relaciones de parentesco (...) durante el episodio pandémico. El análisis propuesto pretende alertar, además, sobre las formas en que las normas de excepción implementadas durante las crisis pandémicas se sedimentan en el cuerpo social, pasando así a formar parte constitutiva del orden público.
