The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. The commitment to evidence-based practice in clinical psychology requires scientific investigation of the effects of treatment and mechanisms of change. Empirical evidence suggests that mindfulness-based treatments provide clinically meaningful improvement for people suffering from many important problems, including depression, anxiety, pain, and stress. However, the processes of change that produce these beneficial outcomes are not entirely clear. Central questions include whether mindfulness training leads to increases in the general tendency to respond mindfully to the experiences of daily life, and if (...) so, whether these changes are responsible for the improvements in mental health that are often observed. Answering these questions requires methods for assessing mindfulness. Several tools for this purpose are now available and early evidence suggests that they are useful and informative, despite shortcomings that require additional work. This paper summarizes the rationale for mindfulness questionnaires, the methods used to construct them, and research findings on their utility. Challenges related to maintaining consistency with Buddhist conceptions of mindfulness while applying psychological research methods to the study of its assessment are discussed. (shrink)

Translations of Karl Jaspers' work into the English language have so far not been uniform in their choice of technical terminology. This scholarly renditionof Jaspers' ´Introduction´ to his seminal work "The Great Philosophers" stays to theoriginal German text as true possible by upholding its idiomatic cultural expressions, complex sentence structure, and nuanced particularities provided that clarity of communication can be maintained. The substantive contents and the significance of this text, whose principal topic is greatness, are outlined here. This article presents a sociological analysis of the changing role of women in the Catholic church over the past twenty years. The theoretical framework is drawn from The Social Construction of Reality by Peter Berger and Thomas Luckmann. Data are derived from the documents of Vatican II, the revised Code of Canon Law, research from 1965 to the present, and exploratory interviews with Catholic women recently appointed as church administrators. The aim of this contribution is to critically explore the understanding, the goals and the meaning of education in the philosophy of education by Jean-Jacques Rousseau. In his educational novel Emile: or On Education [Emile ou De l’éducation] (1762) he depicts his account of the natural education. Rousseau argues that all humans share one and the same development process which is independent of their social background. He regards education as an active process of perfection which is curiosity-driven and intrinsic to (...) each child. Rousseau’s educational goals are autarky, happiness and freedom. (shrink)

In the ´Introduction´ to "The Great Philosophers" Karl Jaspers explores the criteria for recognizing human greatness in general and in philosphers in particular. He comments on the historical process related to the selection and grouping of great philosophers. Jaspers acknowledges the questionable aspect of greatness, yet he affirms that such distinction is indispensable. The 1957 English translation by Ralph Mannheim and Hannah Arendt of Jaspers' Die Grossen Philosophen and all its subsequent editions did not include this Introduction. The translation offered (...) here redresses this omission and is the first ever published English translation of Jaspers' extended Introduction. (shrink)

The study considers the topic of linguistic register by examining how schoolchildren, adolescents, and adults vary the texts that they construct across the dimensions of modality and genre . Although register variation is presumably universal, it is realized in language-specific ways, and so our analysis focuses on Israeli Hebrew, a language that evolved under peculiar socio-historical circumstances. An original procedure for characterizing register — as low, neutral, or high — was applied to four text types produced by the same speaker-writers. (...) We found that across all age groups, “neutral“ items constituted the bulk of the material, and that the lexicon accounted for some 80% of variation. Developmentally, we found that acquisition of fully flexible register variation continues beyond adolescence. Finally, we observed that text types range on a cline from everyday colloquial usage in oral narratives to more formal, high-level language in written expository essays. These results are discussed in light of their implications for the nature of register variation, later language development, and the sociolinguistics of contemporary Hebrew. (shrink)

Unfortunately, there is little evidence that anybody is thinking about that.

What makes a choice hard? I discuss and criticize three common answers and then make a proposal of my own. Paradigmatic hard choices are not hard because of our ignorance, the incommensurability of values, or the incomparability of the alternatives. They are hard because the alternatives are on a par; they are comparable, but one is not better than the other, and yet nor are they equally good. In this book, first published in 1975, Dr Kempson argues that previous work on presupposition - whether in philosophy or linguistics - has been mistakenly based on a conflation of two different disciplines: semantics, the study of the meanings assigned to the formal system which constitutes a language, and pragmatics, the study of the use of that system in communication. The first part of the book deals generally with the nature of semantics in linguistic theory and its formal representation within (...) a transformational grammar; Dr Kempson argues against incorporating the relation of presupposition within such a grammar. The second part provides a pragmatic account of the foundations of a theory of communication and its detailed application to the problems raised by presupposition. This paper proposes a way to understand transformative choices, choices that change ‘who you are.’ First, it distinguishes two broad models of transformative choice: 1) ‘event-based’ transformative choices in which some event—perhaps an experience—downstream from a choice transforms you, and 2) ‘choice-based’ transformative choices in which the choice itself—and not something downstream from the choice—transforms you. Transformative choices are of interest primarily because they purport to pose a challenge to standard approaches to rational choice. An examination of the event-based transformative (...) choices of L. A. Paul and Edna Ullman-Margalit, however, suggests that event-based transformative choices don’t raise any difficulties for standard approaches to rational choice. An account of choice-based transformative choices—and what it is to be transformed—is then proposed. Transformative choices so understood not only capture paradigmatic cases of transformative choice but also point the way to a different way of thinking about rational choice and agency. (shrink)

In the opening sections of this paper, we defined ambiguity in terms of distinct sentences (for a single sentence-string) with, in particular, distinct sets of truth conditions for the corresponding negative sentence-string. Lexical vagueness was defined as equivalent to disjunction, for under conditions of the negation of a sentence-string containing such an expression, all the relevant more specific interpretations of the string had also to be negated. Yet in the case of mixed quantification sentences, the strengthened, more specific, interpretations of (...) some such positive string are not all of them necessarily implied to be false if the corresponding negative sentence-string is asserted. On the contrary, as we saw in section 6, a negative sentence-string can be used to deny one of the more specific interpretations of the corresponding positive string without also denying other weaker interpretations of that same string. One might therefore argue that the only empirical evidence availble for assessing quantified sentences suggests clearly that these sentence-strings are ambiguous. Indeed logicians, many of whom restrict their attention to propositions, MUST recognise logical ambiguity at this point. For the contextualisation of the negative sentences in section 6 showed that it was possible to assert the falsity of some proposition P expressed by the sentence S while asserting a further proposition which was compatible with the truth of S. However the corresponding conclusion that such sentence-strings are sententially ambiguous is not a necessary conclusion for the linguist: for the alternative account of postulating a single semantic representation plus a set of semantic procedures is also compatible with the negation evidence. Moreover we have seen independent reasons for thinking that if sentential ambiguity is assumed to be in one-to-one correspondence with what we should now call logical ambiguity, a considerable body of generalisations is lost. For the maximal ambiguity account, it should be recalled, is committed to assigning at least thirteen distinct propositions and hence thirteen distinct sentence outputs for every sentence-string containing no more than two quantifiers, for three out of the four interpretations originally outlined in this paper can be understood with each numeral taken either in an ’exactly’ sense or in an ’at least’ sense. Moreover there is no explanation of why just these interpretations are available-they are merely an arbitrary list, no more connected than are the two interpretations of John saw her duck, with no reason to predict that the ambiguity would carry over from language to language. If then it is granted that an ambiguity account fails to capture appropriate generalisations, only two alternative accounts of mixed quantification sentence-strings remain viable-an analysis proposing an initial co-ordinate logical form like the logical form III, which is the strongest form compatible with each of the propositional interpretations of sentence-string Two examiners marked six scripts, and the radically weak form in which only existential quantification (both over sets and over members of those sets) is invoked. Since there are strong arguments to suggest that the procedures which both analyses require are semantic, there seems no reason not to adopt the radical vagueness account, with its considerably greater simplicity. Recently, some of the leading proponents of the view that there is widespread incommensurability among goods have suggested that the incommensurability of some goods is a constitutive feature of the goods themselves. So, for example, a friendship and a million dollars are incommensurable because it is part of what it is to be a friendship that it be incommensurable with money. According to these ‘constitutive incommensurabilists’ incommensurability follows from the very nature of certain goods. In this paper, I examine this (...) idea and argue that constitutive incommensurabilists have mistaken for constitutive incommensurability a particular emphatic kind of comparability. This examination involves an account of ‘higher’ and ‘lower’ goods and an explanation of how goods of different ‘types’ figure in practical conflict. (shrink)

Commercial video games are popular entertainment media and part of students’ media reality. While commercial video games’ main purpose is not learning, they nonetheless could and should serve as objects of reflection in formal educational settings. Teachers could guide student learning and reflection as well as motivate students with commercial video games, but more evidence from formal educational settings is required. We conducted two mixed methods case studies to investigate students’ reflection processes using commercial video games in regular formal high (...) school teaching. In a double lesson, 29 students of a 10th-grade biology course and 17 students of a 12th-grade advanced course on history played and discussed a commercial video game related to the current curricular topic. We examined the reflection processes of students in terms of their reactions to the teachers’ game-related statements and questions. Regarding teachers’ statements, students discussed several topics related to game enjoyment and the games’ representation of topic-related content. Regarding teachers’ questions, students discussed multiple goals in each game, how the games represented topic-related content, and how the games could be appropriate for learning. In Study 2, students additionally discussed emotions, stereotypes, violence, and the narrative related to the digital history game. We found that the discussions provided students opportunities to reflect on their game experiences and the current curricular topic as well as to practice media criticism. We further provide quantitative results on students’ perceived topic knowledge, on several facets of their learning motivation, and on their acceptance of video games. Overall, our findings illustrate the educational value of using commercial video games as objects of reflection. (shrink)

Testing is an effective learning method, and it is the basis of mobile quiz apps. Quiz apps have the potential to facilitate remote and self-regulated learning. In this context, automatized feedback plays a crucial role. In two experimental studies, we examined the effects of two feedback types of quiz apps on performance, namely, the standard corrective feedback of quiz apps and a feedback that incorporates additional information related to the correct response option. We realized a controlled lab setting (n= 68, (...) Study 1) and an unsupervised mobile setting (n= 150, Study 2). In the learning phase, participants used the quiz app and received feedback. They also completed a subsequent test as well as a follow-up test 1 week later by using the same quiz app. Irrespective of feedback type and setting, cognitive outcomes (quiz scores) and metacognitive outcomes (response certainty) increased similarly in the short term and long term. Feedback effects were not moderated by participants' overall response certainty during learning, their prior knowledge, and the difficulty of quiz items. Moreover, we found that participants perceived the quiz app to be similarly attractive, interesting, and enjoyable in both feedback conditions and that they spent slightly more time to process quiz items in the lab setting. We discuss these results in detail, including the role of moderating and mediating factors and prospects for further research and practice. Overall, our results underline that quiz apps are useful and effective tools that can support the acquisition and retention of semantic knowledge in different learning settings. (shrink)

The demand for bodily parts such as organs is increasing, and individuals in certain circumstances are responding by offering parts of their bodies for sale. Is there anything wrong in this? Kant had arguments to suggest that there is, namely that we have duties towards our own bodies, among which is the duty not to sell parts of them. Kant's reasons for holding this view are examined, and found to depend on a notion of what is intrinsically degrading. Rom Harré's (...) recent revision of Kant's argument, in terms of an obligation to preserve the body's organic integrity, is considered. Harré's view does not rule out all acts of selling, but he too ultimately depends on a test of what is intrinsically degrading. Both his view and Kant's are rejected in favour of a view which argues that it does make sense to speak of duties towards our own bodies, grounded in the duty to promote the flourishing of human beings, including ourselves. This provides a reason for opposing the sale of bodily parts, and the current trend towards the market ethic in health care provision. (shrink)

This is a comparison of graduate students attitudes in Spain and the United States on the issue of universal versus relativist ethics. The findings show agreement on fundamental universal values across cultures but differences in responses to behavioral ethics within the context of entrepreneurial dilemmas.

Moral sceptics maintain that there are no objective moral values, or that there is no moral knowledge, or no moral facts, or that what looks like a statement which makes a moral judgment is not really a statement and does not have a truth-value. All of this is rather, unclear because all of it is negative. It will be necessary to remove some of this unclarity because my aim in this paper is to establish a proposition which may be summarized (...) by saying: even if there are no objective moral values in one sense, there are objective moralvalues in another sense, and the latter values are good enough to do some of the jobs that objective values in the first sense would have done. A useful analogy might be that of a person who has lost her hand and has been given a prosthesis. In one sense the prosthesis is not as real as the hand, in another sense it is just as real ; most importantly, the person can do with the prosthesis enough of what she could do with the hand to make do. Cramer's Transactional Interpretation (TI) is applied to the ``Quantum Liar Experiment'' (QLE). It is shown how some apparently paradoxical features can be explained naturally, albeit nonlocally (since TI is an explicitly nonlocal interpretation). At the same time, it is proposed that in order to preserve the elegance and economy of the interpretation, it may be necessary to consider offer and confirmation waves as propagating in a ``higher space'' of possibilities.

Lacan with the Philosophers creates a dialogue between the oeuvre of psychoanalyst Jacques Lacan and philosophy. Major philosophical figures to which Lacan vastly referred are examined around key concepts fundamental to philosophy - being, truth, knowledge, the good, the subject.

It is pointed out that a slight variation on the Wheeler Delayed Choice Experiment presents the same challenge to orthodox quantum mechanics as Maudlin-type contingent absorber experiments present to the Transactional Interpretation. Therefore, the latter cannot be used as a basis for refutation of TI.

The term “industrial action” includes any noncooperation with management, such as strict “working to rule,” refusal of certain duties, going slow, and ultimately withdrawal of labor. The latter form of action, striking, has posed particular problems for professional ethics, especially in those professions that provide healthcare, because of the potential impact on patients' well-being. Examination of the issues, however, displays a difference in response between the healthcare professions, in particular between doctors and nurses. In considering the ethics of industrial (especially (...) strike) action there are various aspects of professional ethics to consider: (1) whether there is a tension between industrial action and the very notion of professional ethics; (2) what specific issues arise in the case of healthcare professions; (3) what, if anything, can explain and/or justify different responses from the medical and nursing professions? Feminists acknowledge that making science is a social process and that scientific laws and the "facts" of science reflect the interests of the university-educated, economically privileged, predominantly white men who have produced them. We also recognize that knowledge about nature is created by an interplay between objectivity and subjectivity, but we often do not credit sufficiently the ways women's traditional activities in home, garden, and sickroom have contributed to understanding nature.

Time-symmetric interpretations of quantum theory are often presented as featuring "retrocausal" effects in addition to the usual forward notion of causation. This paper examines the ontological implications of certain time- symmetric theories, and finds that no dynamical notion of causation applies to them, either forward or backward. It is concluded that such theories actually describe a static picture, in which the notion of causation is relegated to a descriptor of static relationships among events. In addition, these theories lead to an (...) epistemic rather than ontologically referring, realist view of quantum states. (shrink)

In the libertarian ``agent causation'' view of free will, free choices are attributable only to the choosing agent, as opposed to a specific cause or causes outside the agent. An often-repeated claim in the philosophical literature on free will is that agent causation necessarily implies lawlessness, and is therefore ``antiscientific." That claim is critiqued and it is argued, on the contrary, that the volitional powers of a free agent need not be viewed as anomic, specifically with regard to the quantum (...) statistical law. Assumptions about the role and nature of causation, taken as bearing on volitional agency, are examined and found inadequate to the task. Finally, it is suggested that quantum theory may constitute precisely the sort of theory required for a nomic grounding of libertarian free will. (shrink)

In this paper I consider the surprise examination paradox from a practical perspective, paying special attention to the communicative role of the teacher’s promise to the students. This perspective, which places the promise within a practice, rather than viewing it in the abstract, imposes constraints on adequate solutions to the paradox. In the light of these constraints, I examine various solutions which have been offered, and suggest two of my own.

The Hebrew text On the Heavens and the World, ascribed to Ibn S, is an interesting and intriguing composition. It dates from the 13th century and was quite influential. It is not a translation of any text of Ibn S known to us, but is related to the Latin De celo et mundo, which appears in the 1508 Venice edition of translations of Ibn S. The Latin and Hebrew texts differ widely and the relation between them is far from being (...) clear. Both are in sixteen chapters, the titles of the chapters are the same, but the texts are only roughly similar. The Hebrew text often offers short, incomplete summaries of the Latin arguments. On the other hand it includes many passages which have no parallel in the Latin. There are two possible explanations of the perplexing relationship between the two texts: either that there was more than one version of the Latin text, or that the translator, Shlomo ben Moshe of Laguiri wrote a kind of paraphrase. The paper shows that the second explanation is correct and offers a preliminary study of the sources and the aims of the Hebrew text. (shrink)
