In this article, we look at the contested role of in-house lawyers in regulated organisations in the financial sector. A recent Financial Conduct Authority consultation on whether to designate the head of legal of banks, insurance companies and other financial firms as ‘Senior Managers’ and the decision which flowed from it, reflected a flawed view of lawyers as a neutral technocracy of mere legal technicians; we show how the FCA’s decision is potentially damaging to the public interest and failed to (...) take into account that in-house lawyers are often important decision-makers and influencers within their organisations. We put the case for an alternative view; that in-house lawyers are professionals, with agency that requires them to act in accordance with ethical norms and means they should be made more accountable for their conduct. The aim of the paper is the construction of a distributional model which enables the study of the evolutionary dynamics that arise for symmetric games, and the equilibrium selection mechanisms that originate from such processes. The evolution of probability distributions over the state variables is studied using the Fokker-Planck diffusion equation. Equilibrium selection using the ’’basin of attraction’’ approach, and a selection process suggested by Pontryagin are contrasted. Divided into three parts, these twelve essays are some of the papers presented at a May 2001 conference to mark the 350th anniversary of Leviathan's publication. Readers might (...) expect a discussion about Leviathan's endurance and relevance as a fundamental text of political philosophy, but this is not the book's main thrust. Instead, the authors engage in a discussion concerning some of the most provocative and controversial questions about Leviathan. Much of the debate centers on how one should interpret it, forcing readers not only to reconsider crucial parts of Hobbes's philosophy, but also the act of interpretation.Part one examines the place that Leviathan holds among Hobbes's political writings. Karl Schumann argues that one should not think of Leviathan as a radical departure from De Cive and that it did not mark the culmination of Hobbes's development as a political philosopher (14). Schumann's essay is not convincing because he effectively points out the consequential ways that Leviathan is distinct. Ted H. Miller suggests, "Leviathan's uniqueness is rooted in its poetic-philosophical innovations"(103). He points out that David Johnston, Quentin Skinner, and others have stressed the significance of its rhetorical style. Miller, however, proposes that it was the context and the company that Hobbes kept during this time that influenced his writing style. Kinch Hoekstra suggests that Hobbes is an unusual de facto theorist and Luc Foisneau believes that Leviathan is unique because of its theory of justice.Part two is devoted to investigating passions and politics in Leviathan. Richard Tuck believes that Hobbes's political philosophy is utopian because it demands a radical transformation of humans as passionate beings. Tuck says that while the Leviathan provides citizens with security, "they are also going to live a life without pride, their sense of their own individual importance reduced to nothing in the face of their commonwealth" (138). Tuck's essay stands in contrast to Tom Sorrell's analysis of the burdens on the sovereign. He concludes that he must be an individual with little, if any, regard for his own ambitions and passions (196). What one is left with is a Hobbesian version of a philosopher king who has his personal appetites in check always looking out for what benefits his subjects. Sorrell believes, however, that it is in the sovereign's best interest to be unselfish if she is to maintain her sovereignty (193).Quentin Skinner analyzes the classical theory of laughter, relating it to Hobbes's complicated views about it. Political agency in Leviathan is Yves Zarka's topic. It seems that the citizen is merely a subject, but Zarka cautions that one must carefully read the text and remember that certain rights are inalienable. How far one may take what Zarka interprets as the "the right of resistance" remains a debatable question (182). He believes that one might rethink Leviathan as a more complex piece of political philosophy by practicing "back-to front reading" as opposed to a direct-method reading of the text (182). Zarka thinks that citizens may have a more complex and passionate role than commonly thought (182). This is an alluring suggestion, but it is difficult to accept in light of Hobbes's preoccupation with security and obedience.The role of biblical and political authority is the theme for part three. Edwin Curley argues that Hobbes's treatment of covenants with God was possibly a vehicle for him to arouse skepticism about Christianity among his readers. A. P. Martinich rejects Curley's claim and concludes that not only does his argument fail on grounds of logic, but also it requires far too much "reading between the lines" (223). Metaphysical poetry is notorious for its 'difficulty'; in this selection Richard Willmott provides detailed explanatory notes giving in depth information on the period, the poets and 'metaphysical style' and, to ensure a full understanding, line by line exegesis of the poems themselves is given where necessary. Like the determinist, the New Critic must proceed by assuming what he hopes to prove; he assumes the existence of "objective" relations between the words of the poem he is studying and then attempts to perceive such relations.1 The distinction between "objective"—that is, in some sense verifiable—and purely subjective or personal meaning must necessarily be a central one for this type of poetics. New Critics are constantly protesting that they are not "reading into" works, that the meanings they ascribe to (...) the words or images of a literary text are objectively there rather than subjectively imposed. Historians have been divided about the origins of Leveller theories concerning natural rights, equality, and democracy. This article gives an account of the monistic natural philosophy outlined by Richard Overton in his pre-Leveller work Mans Mortalitie (1643/44) and demonstrates how his heretical conception of creation provided a metaphysical foundation for his political ideas about the liberty of the subject. Comparisons and contrasts are made with the hermetic idealism of Henry and Thomas Vaughan and the spiritual materialism of Gerrard (...) Winstanley. Few philosophers have left a legacy like that of Gottfried Wilhelm Leibniz. He has been credited not only with inventing the differential calculus, but also with anticipating the basic ideas of modern logic, information science, and fractal geometry. He made important contributions to such diverse fields as jurisprudence, geology and etymology, while sketching designs for calculating machines, wind pumps, and submarines. By a thorough study of the Posterior Analytics and related Aristotelian texts, Richard McKirahan reconstructs Aristotle's theory of episteme--science. The Posterior Analytics contains the first extensive treatment of the nature and structure of science in the history of philosophy, and McKirahan's aim is to interpret it sympathetically, following the lead of the text, rather than imposing contemporary frameworks on it. In addition to treating the theory as a whole, the author uses textual and philological as well as philosophical material (...) to interpret many important but difficult individual passages. A number of issues left obscure by the Aristotelian material are settled by reference to Euclid's geometrical practice in the Elements. The humanity formulation of Kant's Categorical Imperative demands that we treat humanity as an end in itself. Because this principle resonates with currently influential ideals of human rights and dignity, contemporary readers often find it compelling, even if the rest of Kant's moral philosophy leaves them cold. Has the passing of the old God paved the way for a new kind of religious project, a more responsible way to seek, sound, and love the things we call divine? Has the suspension of dogmatic certainties and presumptions opened a space in which we can encounter religious wonder anew? Situated at the split between theism and atheism, we now have the opportunity to respond in deeper, freer ways to things we cannot fathom or prove. Distinguished philosopher Richard Kearney (...) calls this condition _ana-theos_, or God after God-a moment of creative "not knowing" that signifies a break with former sureties and invites us to forge new meanings from the most ancient of wisdoms. Anatheism refers to an inaugural event that lies at the heart of every great religion, a wager between hospitality and hostility to the stranger, the other—the sense of something "more." By analyzing the roots of our own anatheistic moment, Kearney shows not only how a return to God is possible for those who seek it but also how a more liberating faith can be born. Kearney begins by locating a turn toward sacred secularity in contemporary philosophy, focusing on Maurice Merleau-Ponty and Paul Ricoeur. He then marks "epiphanies" in the modernist masterpieces of James Joyce, Marcel Proust, and Virginia Woolf. It focuses on the multiple directions in which James's philosophy moves and the inevitable contradictions that arise as a result. The first part of the book explores a range of James's doctrines in which he refuses to privilege any particular perspective: ethics, belief, free will, truth and meaning. The second part of the book turns to those doctrines where James privileges the perspective of mystical experience. The relationship between mind and matter, mental states and physical states, has occupied the attention of philosophers for thousands of years. Richard Fumerton's primary concern is the knowledge argument for dualism - an argument that proceeds from the idea that we can know truths about our existence and our mental states without knowing any truths about the physical world. McCormick (bio)IntroductionAlthough widely used by scientists, the term "preembryo" has raised some suspicions. Histopathologist Michael Jarmulowicz (1990), for example, asserts that the term was adopted by the American Fertility Society (AFS) and the Voluntary Licensing Authority (VLA) in Britain "as an exercise of linguistic engineering to make human embryo research more palatable to the general public."I cannot speak for the (...) VLA, but I can clarify that this was not the motive of the AFS. As a member of the AFS ethics committee that discussed and adopted this terminology, I know that our discussion was not tied to embryo research or moral issues. The term "preembryo" was adopted because the earliest stages of mammalian development primarily involve establishment of the nonembryonic trophoblast, rather than the formation of the embryo. As Clifford Grobstein (1988, p. 61), a distinguished basic scientist who also sat on the AFS committee notes:The scientific rationale for the term preembryo... is its greater accuracy in characterizing the initial phase of mammalian and human development.... The status implications of such a change in terminology were not at issue in the discussion.This is not to say that the moral status of the preembryo is not a concern worthy of independent consideration. It is an important question with significant practical implications, especially in the context of in vitro fertilization. At stake are issues such as: (1) what may be done to preembryos before transfer; (2) whether all preembryos must be transferred; and (3) what may be done to preembryos that are not transferred (Ethics Committee of the American Fertility Society (AFS) 1986, p. 29S). Furthermore, emergency treatment of rape cases may also depend on such a determination. [End Page 1]Cryopreservation, which entails freezing unused preembryos for possible later use, is one example of a procedure that raises issues associated with the moral status of the preembryo. Cryopreservation decreases the number of stimulated egg recovery cycles a woman must undergo and increases flexibility in transfer protocols. But thawing of the preembryos is not a completely benign process; significant numbers of the preembryos die in the process and injury cannot be excluded.In addition, down the road a year or so lies preimplantation genetic diagnosis, now being tested in several centers of reproductive research. This would involve the removal of one or more cells from a preembryo developing in vitro. The DNA from these cells would be studied and then only genetically normal preembryos would be transferred. With the growth in knowledge about single gene defects and the rapid advance of amplification technology, which allows gene visualization, it is not difficult to imagine scientists embarking on a variety of micromanipulations of the preembryo for the sake of gaining knowledge.Not all research with gametes involves preembryos, but clearly some experiments and procedures await resolution of the moral status of the preembryo. I contend in this paper that the moral status—and specifically the controversial issue of personhood—is related to attainment of developmental individuality (being the source of one individual). This contrasts with the view that holds that personhood occurs earlier, at the point of genetic uniqueness. I believe that an embryo that has developed to the point where it can be one individual and one individual only, differs in moral status from a preembryo that has not, even if in many cases we may choose to treat them similarly.The Scientific UnderpinningsTwo things must be kept in mind—and in a sense, in tension—in turning to science for help in assessing the status of the preembryo. First, science is not competent to decide the question of personhood or ensoulment. As the Catholic document, Declaration on Procured Abortion, which I will return to later, notes: "It is a philosophical problem" (Congregation for the Doctrine of the Faith (CDF) 1974, p. 10, endnote 19). On the other hand, another Catholic document, Donum vitae(CDF 1987), notes that the conclusions of science provide a "valuable indication" for reason's deliberations about personhood. Some will find it a deeply disturbing book while others will find it liberating and exhilarating—both, as we shall see, may be right and wrong. Not since James and Dewey have we had such a devastating critique of professional philosophy. But unlike James and Dewey, who thought that once the sterility and artificiality of professional—and indeed (...) much of modern philosophy since Descartes—had been exposed, there was an important job for philosophers to do; Rorty leaves us in a much more ambiguous and unsettled state. I will examine Rorty’s book from a variety of perspectives, beginning with a general overview and then moving to more finely meshed descriptions. The great religions often claim that their books or creeds contain truths revealed by God. How could we know that they do? In the second edition of Revelation, renowned philosopher of religion Richard Swinburne addresses this central question. But since the books of great religions often contain much poetry and parable, Swinburne begins by investigating how eternal truth can be conveyed in unfamiliar genres, by analogy and metaphor, within false presuppositions about science and history.
