The distinction between norms and norm-formulations commits legal theorists to treating legal norms as entities. In this article, I first explore the path from meaning to entities built by some analytical philosophers of language. Later, I present a set of problems produced by treating norms as entities. Whatever type of entities we deal with calls for a clear differentiation between the identification and individuation criteria of such entities. In the putative case of abstract entities, the differentiation collapses. By changing the (...) notions of the intension and extension of words by extensional and intensional aspects of what we talk about, I outline a methodological programme for Law and Legal Theory. La distinción entre normas y formulaciones normativas lleva a los teóricos del derecho a tratar las normas jurídicas como entidades. En este artículo la autora explora el recorrido transitado por algunos filósofos analíticos del lenguaje, que va desde una noción de significado hasta la necesidad de entidades. Después, presenta un conjunto de problemas producidos al considerar las normas entidades. Sea cual sea el tipo de entidad que consideremos tiene que ofrecerse una distinción clara entre criterios de identificación y de individualización. (...) A través de una sustitución de las nociones de intensión y extensión de las palabras, por las nociones de aspectos intensionales y extensionales de aquello de lo que hablamos, la autora bosqueja un programa metodológico para el derecho y la Teoría Jurídica. Novi uvidi u način rada ovog vrhunski sofisticiranog ljudskog/digitalnog »stroja« bacaju povratno svjetlo na načine »aktiviranja « ljudske osjetilnosti, načine doživljavanja i spoznavanja svijeta.Cilj je ovog rada istražiti moguću povezanost tehničkih naprava kao ljudskih ekstenzija i procesa u mozgu koji povratno određuju načine percepcije svijeta. Istovremeno riječ je o promišljanju zanimljive i u znanosti prisutne teze o podijeljenosti hemisfera ljudskoga mozga kao oblika podijeljenosti temeljnih ljudskih sposobnosti.U tom kontekstu želimo propitati bioetičku dimenziju (...) Latest discoveries on the functioning of this digital, highly sophisticated human “device” reflect the ways how sensations, experience and understanding of the world are “activated”.The aim of this study is to investigate the eventual link between technical devices as human extensions and brain processes that in return determine the ways of the perception of the world. At the same time it is a reflection on interesting thesis which exists in the science on the split of the human brain hemispheres as a form of a division between basic human abilities.In this context we want to investigate the bioethical dimension of McLuhan’s thought on the parallel between two hemispheres of the human brain and civilisations which exists on Eastern and Western hemisphere of our planet.The areas of investigation are the following: technologies as extensions and human brain; left and right hemisphere of the brain; technologies, culture, brain; extensions of spoken and written language in pre-linguistic and pre-literacy; “digital” configuration of the brain; brain as the final corrective of the techno-civilisations delusions.There are links between neurolinguistical, theological, philosophical and biological standpoints on human brain. Research into the origins of language, determination of human thoughts, relation between potential and realised, the internal conflict between utilitarian and human empathy… at the end the contemplation tries to answer the question on the regulatory nature of the human brain in establishing the balance of power of both individuals and civilizations. Linguistic theories often suffer from the dilemma that their explanatory power is based on extra-linguistic assumptions. The book delineates the essence of linguistic theory and linguistic explanation and, in doing so, proposes a solution to the dilemma. Simultaneously, the book is one of the first attempts to profile the philosophy of linguistics as a distinct sub-discipline of the contemporary philosophy of science.

In this article Cristoph Wulf examines the basic concepts of pedagogy and educational science in the German-speaking world, looking at education and socialization from the perspective of educational anthropology. He makes evident that the complex German concept of Bildung, in particular, can only be fully understood by means of a historical and philosophical analysis.

Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits of (...) knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

Psychiatry presents a unique array of difficult ethical questions. However, a major challenge is to approach psychiatry in a way that does justice to the real ethical issues. Recently there has been a growing body of research in empirical psychiatric ethics, and an increased interest in how empirical and philosophical methods can be combined. This analysis investigates whether solidarity is an appropriate concept for thinking about justifications for a just distribution of bioethical goods in the international arena. This will be explored by looking at the national origins of the idea of justifying solidarity in the form of the health care that welfare states offer. Following that, ‘life’ and ‘health’ will be placed within a philosophical context by focusing on the main arguments of John Rawls and Amartya Sen and the role of solidarity in (...) these two theories of justice will be analysed. It will be shown that these theories assume that solidarity is not a prerequisite for just international structures. Finally, the possibility will be discussed, that there is a degree of uncertainty surrounding justifications for fair distribution in the international context that can result when the concepts of solidarity and justice are handled imprecisely. This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a problem when the latter claims that (...) ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. This article explores three ways in which physics may involve counterpossible reasoning. The first way arises when evaluating false theories: to say what the world would be like if the theory were true, we need to evaluate counterfactuals with physically impossible antecedents. The second way relates to the role of counterfactuals in characterizing causal structure: to say what causes what in physics, we need to make reference to physically impossible scenarios. The third way is novel: to model metaphysical dependence in (...) physics, we need to consider counterfactual consequences of metaphysical impossibilities. To raise the question of the nature of narrative is to invite reflection on the very nature of culture and, possibly, even on the nature of humanity itself. So natural is the impulse to narrate, so inevitable is the form of narrative for any report of the way things really happened, that narrativity could appear problematical only in a culture in which it was absent—absent or, as in some domains of Western intellectual and artistic culture, programmatically refused. As a panglobal (...) fact of culture, narrative and narration are less problems than simply data. As the late Roland Barthes remarked, narrative "is simply there like life itself . . . international, transhistorical, transcultural."1 Far from being a problem, then, narrative might well be considered a solution to a problem of general human concern, namely, the problem of how to translate knowing into telling,2 the problem of fashioning human experience into a form assimilable to structures of meaning that are generally human rather than culture-specific. We may not be able fully to comprehend specific thought patterns of another culture, but we have relatively less difficulty understanding a story coming from another culture, however exotic that culture may appear to us. This paper deals with an important strand of nihilistic arguments to be found in the works of two philosophers who have so far never been studied comparatively: the sophist Gorgias and the Buddhist monk Nāgārjuna. After having reconstructed Gorgias' moves in the first section of On What is Not (Sections 1-4), the paper shows how the nihilist arguments Gorgias uses mostly feature, under a new light, in the philosophy of emptiness developed by Nāgārjuna (Sections 5-8). The paper ends with a (...) hermeneutical suggestion: that is, to replace traditional ‘sceptical’ interpretations of Gorgias and Nāgārjuna with an alternative one, which takes them as possibly committed to nihilism. Recently, several philosophers have recast feminist arguments against pornography in terms of Speech Act Theory. In particular, they have considered the ways in which the illocutionary force of pornographic speech serves to set the conventions of sexual discourse while simultaneously silencing the speech of women, especially during unwanted sexual encounters. Yet, this raises serious questions as to how pornographers could (i) be authorities in the language game of sex, and (ii) set the conventions for sexual discourse - questions which these (...) speech act-theoretic arguments against pornography have thus far failed to adequately answer. I fill in this gap of the argumentation by demonstrating that there are fairly weak standards for who counts as an authority or convention-setter in sexual discourse. With this analysis of the underpinnings of a speech act analysis of pornography in mind, I discuss a range of possible objections. I conclude that (i) the endorsement of censorship by a speech act analysis of pornography competes with its commitment to the conventionality of speech acts, and, more damningly, that (ii), recasting anti-pornography arguments in terms of linguistic conventions risks an unwitting defence of a rapist's lack of mens rea - an intolerable result; and yet resisting this conclusion requires that one back away from the original claim to women's voices being 'silenced'. When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. In the contemporary intellectual scene, one prominent question is this, what made science and its success possible? One tempting strategy for dealing with this question as a philosopher of science is to use science (or more broadly, empirical inquiry) and its methods to investigate the nature of science and its success. This strategy is what used to be called naturalism. For a philosopher of science, it amounts to naturalizing her philosophical inquiry for understanding the nature of science and its success. (...) The project of naturalizing philosophy of science has not been without its own problems. Some of the concerns are as follows. Willphilosophy of science maintain its traditional normative character after going through the process of naturalization? If it does, what form(s) will its normative content take? Can that normative content be secured without appealing to methods other than those usually used in empirical inquiries? In this essay, I will call these issues collectively the problem of normativity. First of all, I’ll look into the two most representative attempts to naturalize philosophy of science, namely L. Laudan’s and R. Giere’s attempts, focusing on the views that could be taken as their answers to the questions constituting the problem of normativity. Then I’ll examine these views in the light of some prominent criticisms and potential problems, and argue that some of those views could be defended by developing one or other additional conceptual arsenals but still others need to be curbed down admitting the apparent weaknesses of their supporting arguments. This reevaluative process will give us a better idea about what have been achieved by the attempts to naturalize philosophy of science and what their limitations are. (shrink)

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

Does it seem that with each reported state cyberattack, there comes an announcement of discovery, an attribution to one of a handful of usual suspects, some threatening language suggesting imminent retribution, and then nothing more? Increased incidence of cyberattack makes its occurrence seem simultaneously rampant in terms of publicity and minimal in terms of threat of war. If rampant, how can repeated deployment by the same actors carry no punitive consequences? How is such audaciousness tolerated? For some, a cyberattack by (...) a state is an act of war. Its prevalence suggests there must be a void somewhere that facilitates its use without consequence. Others think state cyberattack is like other internet novelties: digital malfeasance, amounting to a nuisance that naturally follows from a digital‐based existence, particularly since non‐state actors are typically involved. Yet, state‐on‐state hostilities are historically perilous on a vast scale, and there is a multilateral system for regulating the use of force in the context of war. Acts of war, even when seeming minimal in impact, are not by‐products of a digital fad, and cyberattack is now described as far more than ‘nuisance’. If anywhere, the place for clarity on hostile state cyberoperations use should be accounted for in International Humanitarian Law. Yet, in its present form, it is ambiguous if not silent on the subject, suggesting that cyberattack currently presents an advantage to perpetrating states. Does this void or these ambiguities make cyberattacks more legally advantageous to states than traditional, kinetic weaponry? I examine whether existing IHL is sufficiently adaptable to state cyberoperations through a mixed legal and theoretical approach and conclude that they do. (shrink)

The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

The local opposes the global or the macro opposes the micro and vice versa, respectively. This dialectical relationship further exposes that scales are socially and politically constructed, representative of a phenomena that is relational, and is thus of important consideration in analysis beyond simple labeling. That is, scale represents more than ‘size’ and ‘complexity’, but also reveals the relational. It is the relational—the relationship between the ‘global’ and its contents or the ‘local’—which provides for or is wont for analytic complexity (...) and theorizing. (shrink)

The essays in Weakening Philosophy, from leading figures such as Umberto Eco and Charles Taylor, introduce his ideas to a wider audience.

Why study notations, diagrams, or more broadly the variety of nonverbal “representations” or “signs” that are used in mathematical practice? This chapter maps out recent work on the topic by distinguishing three main philosophical motivations for doing so. First, some work (like that on diagrammatic reasoning) studies signs to recover norms of informal or historical mathematical practices that would get lost if the particular signs that these practices rely on were translated away; work in this vein has the potential to (...) broaden our view of the specific normativity of mathematics beyond logical proof. Second, some work focuses on signs to highlight the open-ended and “nonrigorous” aspects of mathematical practice, and the role of these aspects in the historical development of mathematics. The third motivation is based on the following observation: the reason differences in signs matter in mathematics is that humans are finite agents, with cognitive and computational limitations. Accordingly, studying signs can be a way to study how human computational constraints shape the mathematics that we do, and to tackle the topic of mathematical understanding. (shrink)

This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. Count Me In (CMI) was launched in 2015 as a patient-driven research initiative aimed at accelerating the study of cancer genomics through direct participant engagement, electronic consent and open-access data sharing. It is an example of a large-scale direct-to-patient (DTP) research project which has since enrolled thousands of individuals. Within the broad scope of ‘citizen science’, DTP genomics research is defined here as a specific form of ‘top-down’ research endeavour developed and overseen by institutions within the traditional human subjects research (...) context; in novel ways, it engages and recruits patients with defined diseases, consents them for medical information and biospecimens sharing, and stores and disseminates genomic information. Importantly, these projects simultaneously aim to empower participants in the research process while increasing sample size, particularly in rare disease states. Using CMI as a case study, this paper discusses how DTP genomics research raises new questions in the context of traditional human subjects research ethics, including issues surrounding participant selection, remote consent, privacy and return of results. It aims to demonstrate how current research ethics frameworks may be insufficient in this context, and that institutions, institutional review boards and investigators should be aware of these gaps and their role in ensuring the conduct of ethical, novel forms of research together with participants. Ultimately, a broader question is raised of whether the rhetoric of participatory genomics research advocates for an ethic of personal and social duty for contributing to the advancement of generalisable knowledge about health and disease. Kant's epistemology and the Buddhist philosophy are an idealism. But these two different philosophies have in themselves the contradictory element, namely the element of the outer sense of bodies and of the inner mind. Although Kant's transcendental idealism and the school Vijnanavadin (唯識學派) acknowledge only the representations and the consciousnesses., the mind need to be affected by the outer part. In Kant's theoretical philosophy the outer sense of bodies plays an alien role. It stands outside the subject. In spite of (...) this, the subject have to relate itself to the outer element. And in the Buddhism, in order to have consciousnesses, the subject have to be transformed from the fundamental ground, the Alayavijnana (第8 識). But the Alyavijnana need to have a certain moment in order to be transformed. In my paper I have concentrated myself on the problem of relation of the mind to the matter. I have tried to see into the way in which these two philosophies develop this relation. Moreover I am also interested in the problem in relation to the theoretical, practical, and aesthetical fields. The greatest wish of the Baeda l people, or South Koreans, living in the Korean Peninsula is the unification of Korea. However, even when it has been 70 years since the outbreak of the Korean War, the two Koreas that used to be one nation are still in conflict. There have been many discourses on unification over the past 70 years, but these discourses still fail to create clear rules and a framework for unification. Discourses from the perspective of biblical (...) theology offer insight regarding the problems at stake as well as alternatives, but they do not offer perspectives on a definite solution. This article, in line with its statement on biblical theology, does not pretend to contribute to a clear-cut solution to meet the challenge of Korea’s unification. Rather, this article intends to contribute to the formation of an emotional consensus that can contribute to the unification of Korea by looking at the teachings about peace in the Gospel of Matthew. The article explores whether the notion of embracement, forgiveness and love written during the conflict between the Matthean community and Formative Judaism can be applied to help create an emotional bond between the two Koreas. The terms embracement, forgiveness and love found in the Gospel of Matthew are upheld as symbolising peace derived from opposition and conflict. Jesus taught us to overcome situations of opposition and conflict through embracement, forgiveness and love.Contribution: The purpose and contribution of this article was to discuss if the notions of embracement, forgiveness and love found in the Gospel of Matthew can be helpful for the emotional preparation of the peaceful unification of the Korean Peninsula by comparing the situations reflected in the Gospel of Matthew and that of the Korean Peninsula. Wheeler demonstrates that Aristotle presents and systematically explicates his definition of the essence of the truth in the Metaphysics. Aristotle states the nominal definitions of the terms "truth" and "falsehood" as part of his arguments in defense of the logical axioms. These nominal definitions express conceptions of truth and falsehood his philosophical opponents would have recognized and accepted in the context of dialectical (...) argument. On the basis of these nominal definitions, Aristotle develops his definitions of the essences of truth and falsehood--his "real" definitions of truth and falsehood. Aristotle's methodical exposition of his essential definitions of truth and falsehood in the Metaphysics serves as a well-developed example of how his philosophical inquiry starts with nominal definitions and ends with real definitions. Wheeler also argues for the novel claim that Aristotle defines the most fundamental kind of truth in terms of accurate measurement. Aristotle's metrical conception of truth serves as the theoretical basis for specifying the truth conditions of various assertions, for identifying the sorts of beings implicated in these truth conditions, and for explaining the nature of approximate truth and falsehood. Far from offering us a minimal account of truth, Wheeler shows how Aristotle offers us a sophisticated and metrical theory of truth. (shrink)

Sport provides an arena for human flourishing. For some, this pursuit of a meaningful life through sport involves the use of non-human animals, not least of all through sport hunting. This paper will take seriously that sport – including sport hunting – can provide a meaningful arena for human flourishing. Additionally, it will accept for present purposes that animals are of less moral value than humans. This paper will show that, even accepting these premises, much use of animals for sport (...) – including sport hunting – is unacceptable. Nonetheless it will show that there can be acceptable ways of using animals as part of a human’s meaningful life pursuits through sport, albeit in a more limited fashion than many sportspersons currently accept. Our aim in this paper is to present the distinct ways in which Wolff, Baumgarten, and Kant understand the relationship between necessitation, constraint, and reluctant action in an effort to illustrate the subtle ways in which their conceptions of obligation differ from each another. Whereas Wolff conceives of natural or moral obligation as incompatible with constraint, Baumgarten holds that constraint and reluctant action are, in some instances, compatible with natural obligation. Kant departs from Baumgarten by conceiving of obligation as necessarily (...) involving constraint: as Kant’s reply to Schiller’s famous objection reveals, obligation must take on the character of constraint to reluctant action on account of the fact that human beings possess inclinations that always threaten to impel them in directions that oppose morality. Matthean scholars have predominantly viewed Jesus’ healing ministry through the lens of ‘fulfillment of prophecy’, which connects his healings to David the shepherd and the fulfilment of the covenant, the restoration of the covenant people, and the establishment of the new covenant. This interpretation has largely emerged from an analysis of Jesus’ healing ministry as a singular event. However, it is necessary to revisit previous studies that have posited that the stories of Jesus’ healings were arranged in a larger context (...) and theological perspective, rather than as a disjointed list of individual events. In particular, the healing events in Matthew 8–9 appear to have been arranged with the intention of teaching discipleship, indicating that the healing stories in the Gospel of Matthew, while scattered, are part of a cohesive pattern of theological themes. These themes include the forgiveness of sins, compassion and mercy, healing through faith, and confession of Jesus as the Messiah. The author of Matthew employs this pattern to systematically present a theological perspective that acknowledges Jesus as divine and confesses him as the Messiah. Contribution: This study aimed to analyse the pattern of these theological themes as they appear in Jesus’ healing narrative. The repetition of these themes serves to establish Jesus’ divinity and reinforce the confession of him as the Messiah. Furthermore, the pattern of theological themes in the healing narrative suggests that it was constructed during a period of transition for the Matthean community, as they moved from Judaism to Christianity. The pattern highlights the community’s confession of Jesus as God and their efforts to solidify their faith. (shrink)
