How do we know right from wrong, good from bad, help from hindrance, and how can we judge the behaviour of others? Ethics are the rules and guidelines that we use to make such judgements. Often there are no clear answers, which make this subject both interesting and potentially frustrating. Historical injustice and global inequality are basic problems embedded in territorial rights. In Global Justice and Territory Cara Nine advances a general theory of territorial rights adapting a theoretical framework from natural law theory to ground all territorial claims.

Flanagan (1991) was the first contemporary philosopher to suggest that a modularity of morals hypothesis (MMH) was worth consideration by cognitive science. There is now a serious empirically informed proposal that moral competence is best explained in terms of moral modules-evolutionarily ancient, fast-acting, automatic reactions to particular sociomoral experiences (Haidt & Joseph, 2007). MMH fleshes out an idea nascent in Aristotle, Mencius, and Darwin. We discuss the evidence for MMH, specifically an ancient version, “Mencian Moral Modularity,” which claims four (...) innate modules, and “Social Intuitionist Modularity,” which claims five innate modules. We compare these two moral modularity models, discuss whether the postulated modules are best conceived as perceptual/Fodorian or emotional/Darwinian, and consider whether assuming MMH true has any normative ethical consequences whatsoever. The discussion of MMH reconnects cognitive science with normative ethics in a way that involves the reassertion of the “is-ought” problem. We explain in a new way what this problem is and why it would not yield. The reason does not involve the logic of “ought,” but rather the plasticity of human nature and the realistic options to “grow” and “do” human nature in multifarious legitimate ways. (shrink)

Predictive genetic testing is now routinely offered to asymptomatic adults at risk for genetic disease. However, testing of minors at risk for adult-onset conditions, where no treatment or preventive intervention exists, has evoked greater controversy and inspired a debate spanning two decades. This review aims to provide a detailed longitudinal analysis and concludes by examining the debate's current status and prospects for the future. Fifty-three relevant theoretical papers published between 1990 and December 2010 were identified, and interpretative content analysis was (...) employed to catalogue discrete arguments within these papers. Novel conclusions were drawn from this review. While the debate's first voices were raised in opposition of testing and their arguments have retained currency over many years, arguments in favour of testing, which appeared sporadically at first, have gained momentum more recently. Most arguments on both sides are testable empirical claims, so far untested, rather than abstract ethical or philosophical positions. The dispute, therein, lies not so much in whether minors should be permitted to access predictive genetic testing but whether these empirical claims on the relative benefits or harms of testing should be assessed. Many in the human rights community have expressed concern about the illiberal religious political system found in Iran today. However, Iran is not unique in its illiberal religious nationalism. Some contemporary liberal democracies in the West also have a history of illiberal religious nationalism. The English and later the British discriminated against Catholics in various ways. The Irish also have a history of discrimination against Protestants and inequality towards women which was based on a deep seated illiberal Catholic nationalism. In (...) all of these cases moderation and liberalization occurred over time. An interesting question is whether moderation over time might be repeated outside of Europe, especially in religiously based nations in the Middle East.When looking especially at the evolution of Ireland we notice that: economic prosperity spread throughout the population, the perception of a threat from the United Kingdom declined, European norms were spread within Ireland, and there were scandals within the Catholic Church. All these factors diminished the power of Irish illiberal Catholicism over time. If the external threats to Iran were removed and economic prosperity was to spread, as corruption and scandals came to light, we might expect that Iran may begin to moderate its political system.The goal of this essay is to analyze what conditions are conducive for the gradual transformation from an illiberal, religiously defined nation-state to a more moderate, democratic one by examining Iran and Ireland. This article suggests that the evolution of religiously based political systems can lead to more democratic political systems which are more cooperative with other countries and are less supportive of violence and terrorism. The need for professionals to volunteer their time in crisis situations and to reach across time and culture in the service of humanitarian interventions will likely not abate in the near future. This article provides readers with multiple venues for considering the ethical dimensions present in crisis and humanitarian interventions. Core ethical concerns common to helping situations are magnified in crisis work. In addition, issues unique to the nature of volunteer and crisis work must also be considered. This essay defends a strong right against displacement as part of a basic individual right to secure access to one’s home. The analysis is purposefully situated within the difficult context of climate change adaptation policies. Under increasing environmental pressures, especially regarding water security, there are weighty reasons motivating the forced displacement of persons—to safeguard water resources or prevent water-related disasters. Even in these pressing circumstances, I argue, individuals have weighty rights to secure access to their homes. I explain how the (...) home provides a functional context for conditions of autonomous agency. Being coerced from the home disrupts and subverts the conditions necessary for autonomous processes. I conclude by suggesting that the right to the home could be a foundational element of territorial rights. (shrink)

This article examines theories of ocean rights based on the works of Hugo Grotius and Samuel von Pufendorf. Grotius's object‐centred view uses features of the natural world to justify claims to external objects. I show that Grotius's view is inadequate, because it relies on an outdated claim that oceanic resources are sufficiently abundant for anybody to use. Further, adaptations of his view are wanting, because they either rely on arbitrary distinctions or disregard the values of cultural minorities. Pufendorf's relational view (...) constructs rights through the exercise of human will. While Pufendorf believes that agreements create rights, he also argues that property rights can be unilaterally acquired from the commons without express consent from others. The relational view is a viable alternative to the object‐centred view, because it both delimits territorial claims over the ocean to a ‘modest’ size and also respects cultural variability. A major aim of this article is to present Pufendorf's theory of territorial rights extended over oceans and to demonstrate how it is useful for assessing contemporary disputes. In the final sections, I apply the relational view to Canadian claims to the Northwest Passage, and I also sketch implications for assessing expanding claims to the seabed. (shrink)

Drinking water is an important health behavior to support overall child health. Research indicates that children are consuming too little water and too many sugary drinks. Overconsumption of sugary drinks increases child risk for the epidemics of obesity and diet-related chronic diseases like type-II diabetes, stroke, and heart disease. Increasing access to appealing, low-cost drinking water in schools and childcare where children spend much of their time supports efforts to reduce sugary drink consumption. Drinking water infrastructure is key to water (...) access in childcare and schools. In 2012-2013, almost one-third of permanent U.S. school buildings had plumbing systems in fair or poor condition, and almost 40 percent had major renovations or repairs planned.3 Basic plumbing standards for new construction and major renovations or repairs are contained in state and local plumbing codes, and many of these codes are derived from model codes established by private organizations. This article describes the model code process and intervention points where the public health community can work to improve plumbing standards in school buildings and childcare centers. (shrink)

Since we explain behavior by ascribing intentional states to the agent, many philosophers have assumed that some guiding principle of folk psychology like [Intentional States and Actions] must be true. [Intentional States and Actions]: If A and B are different actions, then the agents performing them must differ in their intentional states at the time they are performed. Recent results in the physiology of vision present a prima facie problem for this principle. These results show that some visual information that (...) guides spatial manipulation and fine motor control is unavailable for verbal report. Plausibly, this information is not consciously available to the agent, and as such, not available to inform the content of intentional states. Thus, it is hard to see how every difference in action is subject to intentional explanation, as [Intentional States and Actions] requires. An epistemic virtue is a personal quality conducive to the discovery of truth, the avoidance of error, or some other intellectually valuable goal. However, as Widiger (2007) pointed out in his commentary, there is a tension associated with trying to meet the clinical goals of the DSM and also trying to optimize the (...) scientific goals of the DSM. Most commentators would agree that the recent editions of the DSM (from the DSM-III onward) have favored scientific values (e.g., Sadler 2005). Some commentators have taken sides and aligned themselves with either clinicians or with the science of classification. For instance, Garb (2005) has argued that clinicians should receive incentives to align themselves more closely with the science of the DSM. In contrast, Westen and Shedler (1999) have favored a clinician-based approach to the DSM and have argued that an ideal classification should be based on the prototypes that clinicians use to conceptualize diagnostic categories. Perhaps an extreme suggestion on how to deal with this tension between the values of clinicians and the values of scientists is to adopt the ICD-10 solution and create two versions of the next DSM. One version would be written for clinicians and another for researchers (Phillips et al. 2003).Widiger (2007) wondered whether the two of us as authors are on the fence about how the views of clinicians should affect the DSM. As clinical psychologists who are both clinicians and researchers, we understand his comment, especially in light of our attempt in our article not to overgeneralize from the time-consuming, labor-intensive, yet methodologically limited study we reported in our major paper.Nonetheless, our answer to the question asked in the title of this response, “Should clinicians’ views of mental illness influence the diagnostic manual?” is a clear and unequivocal yes. In our view, too much of the research literature stimulated by the recent DSMs has primarily used the diagnostic criteria in these DSMs to specify patient samples and then perform various experiments to study the DSM categories. We favor a different approach to research which is consistent with a comment once made by the philosopher of science, Karl Popper: “scientific theories originate from myths, and... a myth may contain important anticipations of scientific theories” (1963, 39). We believe that clinicians, with their years [End Page 285] of experience dealing with the ambiguities, the emotionality, and the chaos of psychopathology, have formed complex conceptual systems to try to understand the mysteries of abnormal behavior. We strongly support increased research attempts that will use clinicians as subjects and that will attempt to understand how clinicians use diagnostic concepts to understand patients.Although research on clinicians has not attracted a large amount of attention in the field, there is a long history of such research studies. For instance, in the 1970s, Overall used multivariate techniques to create graphical maps of how clinicians represented relationships among diagnoses (Overall et al. 1977). This paper investigates how principals can be supported in their work as teacher leaders. My focus is on how principals can help teachers respond ethically to classroom challenges. I argue that in aiding teachers, school leaders themselves need support and ongoing development. I turn to the care of the self to conceptually explore ethical self-cultivation. I then argue that a practice, Descriptive Inquiry, serves as a way for principals to care for themselves. If consciousness is "the hard problem" in mind science -- explaining how the amazing private world of consciousness emerges from neuronal activity -- then "the really hard problem," writes Owen Flanagan in this provocative book, is explaining how meaning is possible in the material world. How can we make sense of the magic and mystery of life naturalistically, without an appeal to the supernatural? How do we say truthful and enchanting things about being human if we accept the fact (...) that we are finite material beings living in a material world, or, in Flanagan's description, short-lived pieces of organized cells and tissue? Cara Nine on how to decide where borders should be drawn.

Ecological refugees are expected to make up an increasing percentage of overall refugees in the coming decades as predicted climate change related disasters will displace millions of people. In this essay, I focus on those rights ecological refugees may claim on the basis of collective self-determination. To this end, I will focus on a few specific cases that I call cases of ‘ecological refugee states’. Tuvalu, the Maldives, and to a certain extent, Bangladesh are predicted to be ecological refugee states (...) in the near future. These are states whose entire (or close to it) geographical territory is predicted to be lost to rising sea levels; the collective body of the people will itself become an ecological refugee.The question is: what may the people of an ecological refugee state legitimately claim on the basis of their right to self-determination? Should we redraw state borders to accommodate a New Tuvalu? I argue that a plausible position regarding territorial rights is that when (1) a people clearly is (or recently was) self-determining and has a legitimate claim to continue to be self-determining, and (2) the self-determination of a people is existentially threatened because the people lacks territorial rights, that (3) the people becomes a candidate for sovereign over a new territory. The result is that existing state borders may need to change to accommodate something like a New Tuvalu. To generate these results on behalf of ecological refugee states, I examine the principles of the system of territorial states. Because the system of territorial states is a system of exclusive rights over goods, especially land, it is possible that it is subject to the conditions of a Lockean proviso mechanism. This paper is dedicated mainly to adapting a version of the Lockean proviso for use in territorial rights theory. (shrink)

This book of thirteen essays, most of them revisions of work published elsewhere, exhibits both his intellectual and his stylistic range. Many of the essays are light and chatty, others analytical and slower-going.

In the fifteen years between publication of Insight and Method in Theology, Lonergan's thought underwent some remarkable developments, especially in his understanding of theology. To appreciate these developments, it is first necessary to understand how Lonergan transformed traditional philosophy from a metaphysical psychology to its reverse -a psychological metaphysics grounded in the knower's own self-appropriation and intellectual conversion. During his posf-Insight period, Lonergan gradually extended this new philosophical framework into theology making religious conversion the new foundation for theological reflection. Traditionally, (...) theology had been conceived as a critical reflection on God and His relation to the world, but in Lonergan's new context, theology became reflection on religion and the mediation of religion into a cultural community. When people seek to overcome discrimination in employment they often appeal to the principle that ‘one should be hired on the basis of qualifications alone’. But do we know what the principle means? And would applying it solve the problems of discrimination in employment? We may take the claim to mean that certain aspects of a person such as her race, religion and attractiveness that are thought to be irrelevant to almost all jobs should not be considered in employment decisions. (...) But in this we would be mistaken. This paper argues that the concept of ‘qualification’, far from being purely descriptive, is morally loaded and a function of an employer’s choices and purposes. As a result, appealing to the principle alone cannot prevent discrimination for issues of discrimination in employment are embedded in the ethical issues of ownership, management and the social responsibilities of a business. In Propositional Attitudes, Mark Richard claims that some natural and formal language sentences of the form(∀ x)(∀ y)(x = y → α → α [y/x])are false. He suggests a substitution for α that is sensitive to certain ancillary features of the variable letter as well as the assignment, and then argues that this substitution generates a false instance of the above-mentioned schema. I reject Richard's argument and argue further that the sentence is not an instance of that schema. I then (...) argue that his putative natural language example fails as well. Finally, I suggest that although Richard's mistake here does not present any technical problem for his semantics for attitude ascriptions, it undermines his claim that his semantic theory is better able to respect the surface form of attitude ascriptions in natural languages than competing theories. There is a traditional picture of belief, according to which someone's having a belief is that person's standing in a certain relation to an abstract object, a proposition. My dissertation examines the metaphysical demands that two problems for this picture of belief make on these abstract objects. The first problem comes to us from Frege's "On Sense and Reference," and the second concerns a certain sort of one's beliefs about oneself, which I call "indexical beliefs." ;Frege notes that someone can (...) believe that Hesperus is Hesperus without believing that Hesperus is Phosphorus. It is but a short step from Frege's observation to the claim that the sentence "A believes that Hesperus is Hesperus" could be true while "A believes that Hesperus is Phosphorus" is false. Quine has insisted that we cannot address this problem by taking either of these sentences to express a predication of the referent of both names, the planet Venus, as then both sentences would express the same predication of the same object, and this stands in evident tension with the fact that they can differ in truth value. In a recent response to Frege's problem, Mark Richard has taken exactly the route Quine has warned against. In my first chapter, I show that Richard's response is unsuccessful. I then consider the implications of the failure of his response on his proposed semantics for belief and the philosophical motivation he provides for it. I argue that his semantics for belief ascriptions stands in serious tension with its purported philosophical motivation. ;In the second and third chapters, I turn to the problem about indexical belief. The task of the second chapter is to identify this problem. To this end, I consider three of John Perry's arguments that the traditional picture of belief cannot accommodate indexical belief. I show that even if these arguments are sound, they give us no reason to think that the problem about indexical belief is in any way unique. I then suggest that there is a special problem about indexical belief, despite the failure of these three arguments to isolate it. Special difficulties attend an account of what it is to retain a tensed belief over time, and I suggest that the special problem about indexical belief is, in brief, a generalization of this problem about retention of tensed belief. ;In the third chapter, I raise the problem about indexical belief in a new way, as arising from a tension between several intuitively plausible claims about the relationship between beliefs and desires, on the one hand, and actions, on the other. This presentation of the problem brings out how the problem is special. I survey several solutions to this problem, including one due to Perry. I then argue that Perry's solution cannot characterize the specific kind of similarity between the beliefs of two different people who share an indexical belief. It allows too much to count as shared indexical belief. Thus Perry's solution inadequately addresses what I have suggested is the unique problem about indexical belief. Finally, I suggest that Frege's response to the problem I raise points the way towards an emendation of Perry's account that will enable it to suitably characterize the special way in which different people can share an indexical belief. The semantics of belief reports has recently received a great deal of attention. Speech reports have largely been left behind in this discussion. Here I extend a familiar recent account of attitude reports, the Russellian theory, to the special case of speech reports. I then consider how it compares to Davidson’s paratactic theory with respect to a few examples that raise special problems about speech reports. Neither theory accounts for everything we want to say about these cases. I suggest that (...) the problem lies in an assumption common to both theories, that in reporting what others say, we aim to represent what was said exactly as the original speaker represented it, in so far as this is possible. In ‘What’s Wrong with Colonialism,’ Lea Ypi argues that the wrong of colonialism can be expressed as procedural wrongs, not as wronging territorial rights. On her view, colonial practices went wrong in two ways: they forced residents into political associations, and the terms of the political association were not established through equal and reciprocal negotiations. I argue that because Ypi’s account successfully side-lines all but essential claims to territory, her theory ends up being vulnerable to an objection it means to (...) avoid. Historical residents may be subject to unequal treatment under newly formed political associations because their historical patterns of land use are not considered to have any independent moral weight. Inside and outside of a Christian worldview, bioethicists have discussed ectopic pregnancy at some length as a maternal-fetal vital conflict. Most bioethicists agree that methotrexate and salpingostomy are low-risk, successful interventions for this life-threatening pathology, and are thus beneficent, just, and wholly acceptable. A small cohort of Christian, largely Catholic, bioethicists have reservations about methotrexate and salpingostomy, but cannot resolve their internal disputes about these because of flawed casuistry. This paper aims to settle the issue about whether methotrexate and salpingostomy (...) are acceptable within a Catholic worldview: despite the best arguments in favor of methotrexate as a moral option, it is morally unacceptable, and despite hesitation about salpingostomy related to analogies with previable delivery, it is the optimal procedure for ectopic pregnancy. If we are material beings living in a material world -- and all the scientific evidence suggests that we are -- then we must find existential meaning, if there is such a thing, in this physical world. We must cast our lot with the natural rather than the supernatural. Many Westerners with spiritual inclinations are attracted to Buddhism -- almost as a kind of moral-mental hygiene. But, as Owen Flanagan points out in The Bodhisattva's Brain, Buddhism is hardly naturalistic. (...) In _The Bodhisattva's Brain_, Flanagan argues that it is possible to discover in Buddhism a rich, empirically responsible philosophy that could point us to one path of human flourishing. Some claim that neuroscience is in the process of validating Buddhism empirically, but Flanagan's naturalized Buddhism does not reduce itself to a brain scan showing happiness patterns. "Buddhism naturalized," as Flanagan constructs it, offers instead a fully naturalistic and comprehensive philosophy, compatible with the rest of knowledge -- a way of conceiving of the human predicament, of thinking about meaning for finite material beings living in a material world. It is the story of how a community of first- and second-grade students, wonderful parents and colleagues, and a very wise principal helped me to teach so that each child could pursue a broad range of passions.
