Under the umbrella of the burgeoning neurotransdisciplines, scholars are using the principles and research methodologies of their primary and secondary fields to examine developments in neuroimaging, neuromodulation and psychopharmacology. The path for advanced scholarship at the intersection of law and neuroscience may clear if work across the disciplines is collected and reviewed and outstanding and debated issues are identified and clarified. Often, a more or less universal quality is attributed to certain legal concepts. For refugee scholars working between 1933 and 1945, the universal quality of these concepts was challenged on two fronts: first, the breaking down of the Weimar Constitution and the German Rechtsstaat under Nazi rule demonstrated the fragility of a constitutional and legal order. Moreover, the breakdown of the German Rechtsstaat was felt on a deeper conceptual level. ‘Immutable’ legal concepts turned out to be easily mutated to conform (...) to Nazi ideology. The second major challenge to the universality of concepts thus pertains to the universal characteristics of the ‘concept of a concept’ itself. In brief, what German refugee legal scholars attempted to create in the course of the 1930s and 1940s was a ‘universal’ Rechtsstaat centred around concepts and legal scholarship that would avoid the breakdown by placing it into a feasible and balanced system of legal enforcement on an international level. Thus, in their new academic context, rather than dismissing the Rechtsstaatliche function of legal concepts and the role of legal scholars, refugee scholarship ventured to enhance it. This contribution argues that the development of Hersch Lauterpacht’s concept of human rights constitutes such an enhancement. (shrink)

The dual career allows elite athletes to attain their maximum competitive and academic performance, but the COVID-19 pandemic hindered their development and changed their perception of the importance given to the sporting and educational environment. For this reason, the aim of the present study was to determine the differences in the motivations and perceived barriers, the importance given to academic qualifications, and the perception of the dual career from a multifactorial perspective, of elite athletes according to sex, type of sport (...) practiced, job performance, time of sports career, type of athlete, and type of scholarship received. A total of 100 student-athletes participated in the research study by completing the “Perceptions of dual career student-athletes” questionnaire. The results showed that athletes from individual modalities and those who did not receive any scholarships described more barriers. In addition, women studied more because they enjoyed it ; athletes from individual modalities studied to work later ; athletes who do not work perceived a greater influence between study and sports performance ; at the beginning and at the best stage of their sports career, a greater influence of academics on performance was perceived ; and athletes who considered themselves professionals, and athletes who did not receive any scholarships, reported that the conciliation between sports and academic life was difficult. The results obtained point to the importance of dual career scholarships for student-athletes, as well as the need for the programs implemented for these athletes to consider sex, sport modality or type of scholarship granted. For a long time, the transcendental dialectic was not at the center of Kant scholarship but was often treated simply as Kant’s reckoning with contemporary metaphysics. Accordingly, the main interest was in the transcendental analytic, especially the transcendental deduction. It is all the more gratifying that in recent times a rethinking seems to be taking place on this issue. In the following, I shall attempt to show why the transcendental dialectic is something more than an addendum to the core (...) business of the Critique of Pure Reason. Rather, it forms the culmination of the work, demanding our full attention. Indeed, it provides the key to the entire critical philosophy by exhibiting reason itself as the ultimate founding principle in the form of its Idea. (shrink)

Recent scholarship on the social history of health and medicine in colonial India has moved beyond enclavist or hegemonic aspects of imperial medicine and has rather focused on the role of Indian intermediaries and the fractured nature of colonial hegemony. Drawing inspiration from this scholarship, the article highlights the significance of the Indian subordinates in the lock hospital system in the nineteenth century Madras Presidency. This study focuses on a class of Indian subordinates called the “gomastah”, who were (...) employed to detect clandestine prostitution in Madras to control the spread of venereal disease. It also underlines the role of other native and non-native subordinates such as Dhais, Chowdranies and Matrons, the ways in which they became indispensable for the smoother operation of the Contagious Diseases Act and the lock hospitals on a day-to-day basis. By emphasising how Indian subordinates were able to bring in caste biases within colonial governmentality, adding another layer to the colonial prejudices and xenophobia against the native population, it underlines the fact that there was not a one-way appropriation or facilitation of the coloniser’s knowledge or biases by the colonised intermediaries. Rather, it argues for an interaction between them, and highlights the complexities of caste hierarchies and prejudice within the everyday colonial governmentality. Moreover, the article focuses on the consequent chaos and inherent power struggle between different factions of colonial staff. (shrink)

In this late modern era within which the basic values of life have been reordered (driven by globalisation, the corporate agenda and mass communication technologies), the individual has effectively been reduced to a mere abstraction. It might be argued that the rational, moral and humanistic concept of freedom has, to a great extent, been compromised by a consequent crisis within the intelligentsia. These groups, in particular the gatekeepers of a classical liberal approach to legal scholarship, are caught between the (...) twin evils of increased unreflective populism and pragmatism evident within many law schools and modern legal institutions. Although a contested term, defenders of the ‘socio-legal’ tradition, who place the humanities at the heart of legal research and education, are obliged to restate with increased determination the utility of the liberal arts and literature to the law profession and wider legal community. In a normative environment, law and narrative are inextricably linked and narrative poetry is not only invaluable to explaining the origins and location of the legal tradition, but also elicits a mode of understanding which transcends the boundaries of narrowlydefined legal hermeneutics—which often only addresses issues of an operational nature. French novelist Flaubert claimed “chaque notaire porte en soi les débris d’un poète” (Flaubert in Madame bovary (trans: Wall, G.), Penguin Classics, London, 1960: 269), paraphrased by American civil rights lawyer, Clarence Darrow, as “inside every lawyer is the wreck of a poet” (Lukas in Big trouble: a murder in a small western town sets off a struggle for the soul of America, Simon & Schuster, New York, 1997: 323). In an age of disenchantment, this paper explores the poetic form as an important medium within which to understand the nature and function of law in a society of differentiated individuals. (shrink)

This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, (...) judicial decisions, official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. The starting point for this paper is the ongoing debate about the relation between research and policy in education. Recent developments in England and Scotland are reviewed in the context of political and academic arguments about the nature and function of research activity. The defensiveness of the research community in the face of professional and political attacks is examined critically. A case study of the Higher Still programme is used to illustrate the complexity of the relationships between evidence, ideology, values (...) and professional practice. It is argued that the research community needs to become more politically sophisticated and to advance a clearer vision of its social function in advanced democratic societies if its potential contribution to educational development is to be realised. The dangers of a retreat to a narrow empirical role are highlighted. (shrink)

While a growing body of scholarship identifies urban agriculture’s broad suite of benefits and drivers, it remains unclear how motivations to engage in urban agriculture (UA) interrelate or how they differ across cities and types of organizations. In this paper, we draw on survey responses collected from more than 250 UA organizations and businesses from 84 cities across the United States and Canada. Synthesizing the results of our quantitative analysis of responses (including principal components analysis), qualitative analysis of textual (...) data excerpted from open-ended responses, and a review of existing literature, we describe six motivational frames that appear to guide organizations and businesses in their UA practice: Entrepreneurial, Sustainable Development, Educational, Eco-Centric, DIY Secessionist, and Radical. Identifying how practitioners stack functions and frame their work is a first step in helping to differentiate the diverse and often contradictory efforts transforming urban food environments. We demonstrate that a wide range of objectives drive UA and that political orientations and discourses differ by geography, organizational type and size, and funding regime. These six paradigms provide a basic framework for understanding UA that can guide more in-depth studies of the gap between intentions and outcomes, while helping link historically and geographically specific insights to wider social and political economic processes. MarshallGiambattista Vico is one of those chameleon figures in the history of ideas who is so intellectually rich that he can be constantly reinvented. It is indicative of the rich ambiguity of his thought that two of the most prominent intellectual historians working today should have come to opposite conclusions about his relationship to the master-category of eighteenth-century intellectual history: for Mark (...) Lilla, Vico was a Counter-Enlightenment thinker; for Jonathan Israel, he was a figure in the Radical Enlightenment.1 Vico’s fungibility gives reason for pause. Someone who can be folded into all manner of intellectual projects may be suspect. But Vico is more colonizing than colonized and, thus, the diversity of his receptions is evidence of creativity, and not merely malleability. The only way to deal with Vico is to dive into the multiplicity of plausible interpretations and find in them the makings of a new line of inquiry. Vico’s moment of flourishing in the Anglophone world came initially in the 1960s and 1970s, but if the diversity and quality of receptions in the last five years is anything to go by then we can say that Vico remains—especially in Italian, French, and German— an intellectual historical provocateur.This review essay surveys such literature and makes a single recurring observation: the various specifications of Vico’s place in intellectual history come into alignment as dimensions of what one might term Vico’s reinvention of rhetoric. As a professor of rhetoric in a culture that possessed—for [End Page 141] the most part—very weak oratorical institutions, Vico found himself in a particularly paradoxical situation. Recent research on Vico suggests that this paradox worked itself out in Vico’s thought in a number of highly interesting ways. First, Vico constitutes an opportunity for intellectual historians of the scientific revolution by offering a simultaneously rhetorical and pragmatic gloss of the early modern logic of experiment. Second, for intellectual historians of religion, Vico constitutes a study in how early moderns could examine the rhetorical functioning of theological vocabularies without necessarily committing themselves to the independent existence of the referents of those vocabularies. Third, for intellectual historians of Enlightenment, Vico confirms that encyclopedism was not a merely French practice in the eighteenth century and that the kind of omnicompetence implicit in encyclopedic multidisciplinarity had roots in rhetorical criticism. Fourth, intellectual historians of Counter-Enlightenment cannot easily fold Vico into their narratives, in part because his legal works (which have been read as a call for cultural retrenchment in response to early modern skepticism) are in fact an account of how Greek rhetoric found its analogue in Roman jurisprudence. Fifth, for historians of the idea of language, Vico demonstrates that there were powerful alternatives in early modernity to the dominant contractualist account of the origin of language (offered by Hobbes, Locke, and others) that were rhetorical and yet did not emphasize the priority of speech over writing.When it appeared in 1961, Nicola Badaloni’s Introduzione a G.B. Vico was the most sophisticated attempt to locate Vico in the Neapolitan philosophical tradition. In many ways, it remains the best attempt at contextualizing a thinker who is notoriously difficult to situate among his contemporaries. John Robertson’s recent Case for the Enlightenment has many virtues (not least its revealing supposition that Vico ought to be read alongside Hume), but as an attempt at contextualization Robertson’s work is not as rich as Badaloni’s.2 In particular, Badaloni did a great deal to reconstruct the history of natural philosophical inquiry at Naples in the seventeenth and eighteenth centuries. In Badaloni’s description, Naples was a place in which a strong culture of natural philosophical investigation set the foundation for concepts such as experimentalism and pantheism. Furthermore, Badaloni argued that, although such concepts originated in natural philosophy, they cross-pollinated with ideas prominent in the Neapolitan schools of jurisprudence—particularly probabilism. This paper aims to provide an overview of surveillance theories and concepts that can help to understand and debate surveillance in its many forms. As scholars from an increasingly wide range of disciplines are discussing surveillance, this literature review can offer much-needed common ground for the debate. We structure surveillance theory in three roughly chronological/thematic phases. The first two conceptualise surveillance through comprehensive theoretical frameworks which are elaborated in the third phase. The first phase, featuring Bentham and Foucault, offers architectural (...) theories of surveillance, where surveillance is often physical and spatial, involving centralised mechanisms of watching over subjects. Panoptic structures function as architectures of power, not only directly but also through disciplining of the watched subjects. The second phase offers infrastructural theories of surveillance, where surveillance is networked and relies primarily on digital rather than physical technologies. It involves distributed forms of watching over people, with increasing distance to the watched and often dealing with data doubles rather than physical persons. Deleuze, Haggerty and Ericson, and Zuboff develop different theoretical frameworks than panopticism to conceptualise the power play involved in networked surveillance. The third phase of scholarship refines, combines or extends the main conceptual frameworks developed earlier. Surveillance theory branches out to conceptualise surveillance through concepts such as dataveillance, access control, social sorting, peer-to-peer surveillance and resistance. With the datafication of society, surveillance combines the physical with the digital, government with corporate surveillance and top-down with self-surveillance. (shrink)

From my ongoing "Metalogical Plato" project. The aim of the diagram is to make reasonably intuitive how the Socratic elenchos (the logic of refutation applied to candidate formulations of virtues or ruling knowledges) looks and works as a whole structure. This is my starting point in the project, in part because of its great familiarity and arguable claim to being the inauguration of western philosophy; getting this point less wrong would have broad and deep consequences, including for philosophy’s self-understanding. -/- (...) (i.) is the first pass at elenchos in which the Socratic interlocutor does not reflect on knowledge being the crux of the problem. (ii.) is the second, rarer, reflective pass in which they are, making the investigation explicitly about knowledge. Its centrality in the Charmides makes that neglected dialogue of superlative importance. This structure is also the gateway through which the discussion/dialectic crosses into the Agathology (discussion of the form of the good) at Republic 505. -/- The problem of elenchos, then, grasped as a whole structure, is that it seems that knowledge can neither satisfactorily be included in nor excluded from its own scope. The development of the ti esti (“what is ---?”) question leads to the introduction of knowledge into its own scope (i. implicitly, as goodness contrasted with blind rule-following ii. explicitly qua knowledge) while the development of the dual peri tinos (“----about what?) question leads to K’s elimination from its own scope. The introductions are motivated to avoid contradiction, but produce regress; the eliminations are motivated to avoid regress, but produce contradiction. In scholarship, and in the history of philosophy, the ti esti question is universally recognized, to the point of being identified with philosophy’s origin and essence; the peri tinos question is neglected textually and never recognized as the equal dual to the ti esti. This, I claim, has blocked the development of a nontrivial logical appreciation of what Plato's Socrates is up to. (One rather disastrous effect of this neglect is taking Aristotle as the beginning of the development of logic, rather than, correctly, for the beginning of logic’s fatal separation from mathematics and dialectic.) -/- Further, because of this monopticism of the ti esti, the function of consistency in the elenchos has not been understood, even with respect to the ti esti. The ti esti is actually in search of completeness, given a norm of consistency; the peri tinos is in search of consistency, given a norm of completeness. Only appreciating the two questions as dual allows space in the structure to clarify these different orientations relative to consistency. (And, dually, to completeness, whose function in the elenchos is generally entirely missed by scholars and relegated to discussions of eros; it's not out of place there, of course, but its significance is secured here.) Recognizing the duality of the ti esti and peri tinos questions is thus the royal road, in the Socratic-Platonic context, to catching sight of what we post-Cantorians can recognize as the metalogical duality of consistency and completeness. (The salutary disruptive effects of this Plato-Cantor proximity have, of course, been traced in complementary ways by Badiou.) -/- Note that the diagram is supposed to provide a relatively accessible orientation, not to stand on its own, and certainly not to be the last word on any subject. An important qualification (telegraphed in the previous paragraph) is that what elenchos shows is not finally circular or paradoxical, though the problem first presents as such (stubbornly, obdurately, as "difficult" Plato's Socrates always says with characteristic understatement). What is depicted here is meant, at a first pass, to be the shape of that first presentation, the form of the problem of elenchos, rather than of its solution. It's not an accident that this problem strongly resembles "Russell's paradox" (not Russell's not a paradox.) Problem is to solution as RP is to the diagonal theorems. (shrink)

This introduction presents an overview of Plato and the Mythic Tradition in Political Thought and its central arguments. I situate the contributions of the book within theoretical work on political myth, both traditional and more recent, and also within scholarship on the philosophical function of Plato’s myths. Whereas political theorists have long conceived of myth in pathological terms, Plato and the Mythic Tradition joins a growing body of work envisioning a more constructive role for myth in politics and philosophy. In the paper “An archeology of corruption in medicine”, Miles Little, Wendy Lipworth, and Ian Kerridge present an account of corruption and describe its prevalent forms in medicine. In presenting an individual-focused account of corruption found within “social entities”, Little et al. argue that these entities are corruptible by nature and that certain individuals are prone to take advantage of the corruptibility of social entities to pursue their own ends. The authors state that this is not preventable, so the way (...) to remedy corruption is via management and, where necessary, punishment. This commentary will briefly lay out the key features and functions of corruption as presented by Little et al., before providing a critical discussion that will focus on whether corruptibility is a necessary feature of social entities. I will propose that it is not a necessary feature, though it may frequently arise where individualistic values are unchecked. Corruption can be prevented within social entities by enhancing structures that direct toward virtue and which promote and reward cooperation instead of competition. (shrink)

In modern physics, various fundamental problems have become topics of debate. There was the 20th century climb to a Standard Model, still accurate at the highest energy levels obtainable so far. But, since the 1970's, a different approach to physics advocates for theories such as string theory, known for their mathematical elegance, even though they either cannot be verified in data or contradict presently known experimental results. In philosophy of physics, there is a gradually emerging consensus that philosophy of physics (...) and physics somehow contribute to a common enterprise. But, there is little sign of progress toward consensus about the nature of that unity. All the while, it is generally recognized that physics is interdisciplinary. There are, of course, differences in focus. But, implicitly at least, there are no "sharp dividing lines" between physics and philosophy of physics; pure and applied physics; physical chemistry; biophysics; medical physics; history and philosophy of physics; physics and society; physics education; and so on. What, then, is progress in physics? The question here is not about ideal structures, but asks about what is going on in physics. Beginnings in discerning the presence of eight main tasks help reveal the (pre-) emergence of a normative omni-disciplinary basis for collaboration that, once adverted to, promises to be constitutive of a new and increasingly effective control of meaning. Originally discovered by Bernard Lonergan in 1965, progress in the new collaboration will not seek to eliminate specialized expertise. It will, though, divide tasks within an eightfold functional division of labor. This book invites attention to data for each of the eight main tasks evident and self-evident in existing scholarship in the community. (shrink)

On the advice of this journal’s editor, I have limited my review to the connections (or rather dissimilarities ) that exist between Frege and Russell, relying exclusively on Peter Hylton ’s contribution to the collection, “Frege and Russell”. Following a brief consideration of the volume as a whole, I move immediately into a detailed explication of Hylton’s analysis. The volume includes among its goals the following two aims: (i) to provide, for advanced students and specialists, a conspectus of recent interpretation of Frege, and (ii) to dispel the intimidation felt by readers who confront a diUcult thinker.2 I single out these ambitions because they most clearly represent the volume’s strengths and shortcomings. Enthusiasts of Frege will not be disappointed by the multitude of rigorously and technically written essays, essays that contribute substantially and originally to the collective understanding of Frege and his work. The aim of this paper is to examine, comparatively, women’s place within the political systems of Plato, Aristotle and Hegel from a brief sketch of their conceptions about human nature and feminine nature. It will be intended to indicate to what extent there is a relation, sometimes of tension, sometimes of complementarity, in the way descriptive and prescriptive elements function to circumscribe the space of women from the household private sphere, from Aristotelian and Hegelian perspectives, and how the subordination of (...) descriptive elements to prescriptive elements allow woman to ascend in the public sphere under the Platonic perspective. After tracing this sketch, it will be suggested how this tension, in the political philosophy of Hegel, will result, in a way, in an explicit denial of women's political rights and, in another way, in the possibility of envisioning civil and political equality between men and women from an internal and inherent device of the Hegelian system, the notion of “second nature” as ethical reposition of the natural. Equity in Early Modern Legal Scholarship takes the reader through the vast amount of legal writings on equity that were published in continental Europe in early modern times. The book offers the first comprehensive overview of the development of the legal concept of equity through the sixteenth and seventeenth century. During this time, equity scholarship broke with its medieval past and entered a lively debate on the nature and function of the concept. Given the significance of Nicholas of Cusa’s ecclesiastical career, it is no surprise that a good deal of academic attention on Nicholas has focused on his role in the history of the church. Nevertheless, it would also be fair to say that a good deal of the attention that is focused on the life and thought of Nicholas of Cusa is the legacy of prior generations of scholars who saw in his theoretical work an opportunity to define the most salient (...) features of transformations in the habits of thinking leading from the Middle Ages into the epoch of modernity. Thus, although contemporary scholars have not been able to achieve any clear consensus on the question of whether Nicholas belongs to the Middle Ages or to modernity, the field of Cusanus studies has become much more attentive to the possibility that the uniqueness and significance of Nicholas’s vision is a function of his ability to synthesize and redeploy a variety of strands in the Catholic intellectual tradition—strands that are as apt to involve practical matters of canon law and church reform as they are to hinge on a unique and richly developed mystical theology. Given the flourishing of the attention devoted to Nicholas in the late 20th and early 21st centuries, the choices about which texts to include in this article were difficult ones. The rationale for this article’s predominant focus on scholarship of the late 20th and early 21st centuries is that, insofar as the recent studies listed here enter into the debates that have been shaped by their predecessors, the sources mentioned here will point readers to the prior work in the field not acknowledged here. This article argues that the power of religion to shape experience presupposes the mobilization of religious identity through social opposition. This thesis is developed through a critique of George Lindbeck's The Nature of Doctrine. The article first examines Lindbeck's thesis that religion shapes experience in light of Talal Asad's critique of Geertz's concept of religion. It argues that in order to understand how ‘religion’ shapes experience we must look outside the immanent sphere of cultural‐religious meaning that Lindbeck, following Geertz, identifies (...) with ‘religion’. Religious authority ultimately derives from the recognition of a social group. Next, looking at the nature of doctrine in light of Kathryn Tanner's thesis that Christian identity is essentially relational, it argues that church doctrines function to mobilize group identity through social opposition. In this respect they resemble the mobilizing slogans of political discourse more than, as Lindbeck's theory proposes, the grammatical rules governing Wittgensteinian language games. (shrink)

Ideology and politics were among the dynamics that shaped the scholarly reception of Friedrich Hölderlin and his work from the 1920s to 1940s. By taking the examples of research reports by Adolf von Grolman, Johannes Hoffmeister, and Heinz Otto Burger as well as of the controversy between Wilhelm Böhm and Ludwig Strauß, we outline the reciprocal function of Hölderlin and the DVjs. In doing so, we specifically focus on Paul Kluckhohn’s role in Hölderlin research, not only as an editor but (...) also as a public speaker and academic promoter in politically turbulent times. Cognitive neuroenhancement involves the use of medical interventions to improve normal cognitive functioning such as memory, focus, concentration, or willpower. In this paper I give a Kantian argument defending the use of CNE in science, scholarly research, and creative fields. Kant’s universal law formulation of the categorical imperative shows why enhancement is morally wrong in the familiar contexts of sports or competitive games. This argument, however, does not apply to the use of CNE in higher education, scholarly or scientific research, (...) or creative endeavors such as visual art, fiction or poetry, or musical composition. This is because performance in these areas is embedded within practices that differ in morally significant ways from competitive practices. This important difference provides good reason to think that there is nothing morally wrong with the use of CNE in these areas. My approach is not simply to assume a full-fledged Kantian ethical theory and apply it straight away to the enhancement issue but to establish a reflective equilibrium between our moral intuitions, moral principles that support those intuitions, and the nature of the practices involved. The ritual handling of serpents remains an unnoticed cultural form for the explanatory aims and theoretical insights desired by cognitive scientists of religion. In the current article, we introduce the Hood and Williams archives at The University of Tennessee at Chattanooga that contains data culled from Hood’s 40-plus year career of studying serpent handlers. The archives contain hundreds of hours of interviews and recordings of speaking in tongues, handling fire, drinking poison, and taking up serpents by different congregants and congregations. (...) The archive remains a rich but untapped source of data for building, testing, and refining cognitive theories of ritual in general, and serpent handling in specific. We connect Hood’s work to current cognitive theories and engage critically with research on the social functions of ritual. The new evidence scholarship addresses three distinct approaches: legal probabilism, Bayesian decision theory and relative plausibility theory. Each has major insights to offer, but none seems satisfactory as it stands. This paper proposes that relative plausibility theory be modified in two substantial ways. The first is by defining its key concept of plausibility, hitherto treated as primitive, by generalising the standard axioms of probability. The second is by complementing the descriptive component of the theory with a normative decision theory (...) adapted to legal process. Because this version of decision theory is based on plausibilities rather than probabilities, it generates plausibilistic expectations as outputs. Because these outputs are comparable, they function as relative plausibilities. Hence the resulting framework is an extension of relative plausibility theory, but it retains deep ties to legal probabilism, through the proposed definition of plausibility, and to Bayesian decision theory, through the normative use of decision theory. Roughly speaking, aesthetics, ethics and Marxist philosophy have a remarkable turn, while others just have a weak one. The past several generations of scholarship on Rembrandt's “Anatomy Lesson of Dr. Nicolaas Tulp” have suffered from the anxiety of influence exercised by the influential interpretations of William Heckscher and William Schupbach. Schupbach's interpretation in particular has guided interpretation of the painting in the past generation and has given rise to a fundamental misunderstanding of the painting and its cultural significance. Schupbach and those whom he has influenced have failed to recognize that, from the standpoint of Baroque consciousness, there (...) is an inner compatibility rather than a paradox or tension between the optimistic endorsement of earthly science and the putatively pessimistic resignation to the inevitability of death. Where the figure of Tulp represents the optimism of science and technology, that of the topmost surgeon Van Loenen represents the recognition that the technological project functions within the larger context of a Christian worldview. A reflection on the original form of “Tulp,” in which Van Loenen was depicted wearing a hat, shows how Rembrandt's painting can still speak to us from a distance of almost four hundred years and pose a challenge to our own secular ambitions. The volume analyzes the natural philosophical accounts and debates concerning the vegetative powers, namely nutrition, growth, and reproduction. While principally focusing on the early modern approaches to the lower functions of the soul, readers will discover the roots of these approaches back to the Ancient times, as the volume highlights the role of three strands that help shape the study of life in the Medieval and early modern natural philosophies. From late antiquity to the early modern period, the vegetative (...) soul and its cognate concepts have played a substantial role in specifying life, living functions, and living bodies, sometimes blurring the line between living and non-living nature, and, at other moments, resulting in a strong restriction of life to a mechanical system of operations and powers. Unearthing the history of the vegetative soul as a shrub of interconnected concepts, the 24 contributions of the volume fill a crucial gap in scholarship, ultimately outlining the importance of vegetal processes of incessant proliferation, generation, and organic growth as the roots of life in natural philosophical interpretations. Carol Pateman has said that the public/private distinction is what feminism is all about. I tend to be sceptical about categorical pronouncements of this sort, but this book is a work of feminist political philosophy and the public/private distinction is what it is all about. It is motivated by the belief that we lack a philosophical conception of privacy suitable for a democracy; that feminism has exposed this lack; and that by combining feminist analysis with recent developments in political philosophy, (...) we can meet the philosophical and political need for a distinctively democratic conception of privacy. This book then, is an effort to sketch and defend such a conception of privacy. It aims to show that while some conceptions of privacy are inconsistent with democracy, others are not. Indeed, the book asserts, the belief that privacy can be valuable and that it can justify basic legal rights, is implicit in a democratic conception of persons as free and equal beings, and a democratic conception of politics as the self-governing, or regulating, activity of such individuals. Just as we can and should reject undemocratic conceptions of the suffrage in favour of democratic ones, so the book maintains, we can and must reject undemocratic conceptions of privacy in favour of ones that reflect the moral equality of men and women, and a commitment to democratic forms of government. Democracy is often described as government by and for the people. On such a view, democracy is a political regime which can be contrasted with monarchies or aristocracies on the one hand, or with theocracies and despotisms on the other. By contrast with the former, it is a form of government that views individuals as citizens and as equal members of the agency which authorizes the use of political power. By contrast with the latter, it is a form of government whose purposes and aims are established by the common interests of individuals, conceived as free and equal citizens. It is my contention that there is a plausible and attractive conception of privacy implicit in this view of democracy. Hence, I show that individuals have fundamental interests in privacy because privacy enables them to participate in politics freely and as the equal of others and, beyond that, to lead lives that they can each affirm to be reasonable, valuable and right. As I think that the ideal of democratic government is properly associated with this latter and broader goal, as well as with the former one, I call my account of privacy a democratic conception of privacy to signal its connection to a particular ideal of politics, and to the conception of persons that makes this ideal a convincing and inspiring one. As this is a work of political philosophy, however, no effort is made to address the legal merits of competing accounts of the right to privacy, or to resolve legal dispute about the content and justification of particular constitutional rights in the United States. Thus, while I use Supreme Court decisions and works of legal theory to illustrate and support my arguments, my use of these materials is governed by philosophical concerns and my conclusions, therefore, are strictly of a philosophical, not a legal, nature. The book is divided into four chapters, moving from feminist criticisms of privacy to an engagement with the philosophical literature on privacy and an account of the right to privacy in a democratic society. It proceeds as follows. In Chapter 1, I examine feminist concerns about privacy, through a close reading of the work of Catherine MacKinnon. I argue that MacKinnon persuasively shows that protection for privacy has frequently licensed the coercion and subjection of women, and that her arguments are supported both by feminist scholarship, key Supreme Court decisions, and by familiar conceptions of privacy and equality. However, I argue, these criticisms do not imply that privacy, like slavery, can never be democratic, because wholly inconsistent with the equality of individuals. Rather, feminist criticisms of privacy suggest that privacy, like the suffrage, can be necessary to the equality of women and can have a legitimate and important place in a democratic society. In Chapter 2, I examine the philosophical literature on privacy in light of the need to distinguish democratic from undemocratic accounts of its nature and value. This literature, I show, can help us to provide an account of privacy that is sensitive both to its inegalitarian aspects and to its importance for a democratic commitment to the freedom and equality of women. However, I argue, we cannot embrace current philosophical accounts of privacy uncritically, because to a striking extent they are, themselves, indifferent to the ways that privacy has licensed sexual inequality. Thus, in Chapter 2, I set about interpreting privacy as a moral and political value, in light of the strengths and weaknesses of the philosophical literature on privacy. Their strength is that they show that there are many reasons for caring about privacy, or many ways in which we might define it as a democratic value. Their weakness is that they tend to assume that we must choose amongst these different conceptions of privacy, in order to provide a philosophically cogent account of privacy. This, I show, is a mistake and one that can be remedied by remembering that a commitment to the equality of individuals requires us to acknowledge the reasonable differences in value and interest that may characterize their relations in a democracy. When we do so, I show, it is possible to define privacy in terms of its protection for self-definition, intimacy and confidentiality, without having to choose between the three of them. For individuals may legitimately disagree about the differences between privacy and other values, even while holding that privacy is a distinctive and important democratic good; and they may also disagree about the importance of privacy compared to other goods, such as equality, without denying that self-definition, intimacy and confidentiality can be morally and politically desirable in a democracy. In Chapter 2, therefore, I show that we can provide a philosophically adequate account of what privacy is and why it is valuable without supposing that privacy is always sexually egalitarian, or denying that it has a distinctive place in a democratic conception of value. Chapter 3 then extends this account of privacy, by considering the justification for a legal right to privacy. Just as we cannot provide a democratic conception of privacy without attending to the different, though equally valid, concerns that individuals may have so, I show, we cannot provide a democratic account of privacy rights if we forget that individuals can, quite reasonably, differ in the importance that they attach to privacy. The result, I argue, is that we can distinguish two main reasons for protecting privacy by right in a democracy, the one personal and the other political. Whereas the former emphasizes the importance of self-definition, intimacy and confidentiality to the personal freedom and equality of individuals, the latter emphasizes their importance to their prospects for voluntary and equal participation in the processes of collective choice and deliberation that define a democratic government. These two justifications of privacy rights reflect the fact that in a democracy the personal can be political, as feminists have insisted, but need not be in order to merit protection by right. Indeed, I argue, we can distinguish democratic from undemocratic accounts of the right to privacy in this way: for whilst the former acknowledge the variety of individuals’ interests in personal and collective choice, the latter either collapse the political into the personal, or assume that the legitimate claims of individuals are merely a function of collective needs, interests and values. Neither of these is consistent with familiar assumptions about the nature and justification of democratic institutions and rights, nor can they be reconciled with a commitment to sexual equality. Thus, I conclude, though the fact that there are different justifications for privacy rights in a democracy means that individuals may legitimately disagree over the content and justification of basic rights, it is wrong to confuse democratic debate with moral or conceptual confusion and so, arbitrarily, to truncate our accounts of privacy, equality and democracy. Finally, in Chapter 4, I test and develop these claims by examining the justification for abortion rights in a democracy. I argue that women have legitimate interests in abortion, as well as in bearing children, because they have fundamental, and legitimate, interests in privacy and equality. Although safe and legal abortion is necessary to sexual equality, as feminists claim, I show that we can provide a convincing and democratic account of women’s claims to abortion only if we recognize women’s interests in self-definition, intimacy and confidentiality. This is because women have both personal and political interests in abortion and we will be unable adequately to identify these if we overlook their interests in privacy. Indeed, I show, the difference between democratic and undemocratic solutions to conflict over abortion lies precisely in this: that whereas the former acknowledge the importance of privacy to the personal and political equality of women, the latter overlook or deny this. As a result, the latter license both mandated abortions, although women have legitimate interests in bearing and raising children, and prohibitions on abortion that cannot be reconciled with the freedom and equality of women. That is not to say that abortion is not a politically significant matter, or that we can resolve moral conflict over abortion simply by giving women a legal right to abortion. Neither is the case. However, the chapter shows, in a democracy individuals are entitled to make morally and politically controversial decisions for themselves not simply because this is expedient or useful, but because this is right. To overlook this feature of democracy, I argue, is to make moral and political conflict utterly intractable by democratic means. Thus, while controversy over abortion has been held to show that privacy is an incoherent and undemocratic right, this chapter argues that it shows the reverse: for controversy over abortion makes clear that privacy is essential to democracy, and why this should be so. This overview of the book, I hope, makes clear that its concerns are methodological as well as substantive, and moral as well as political. Thus, its central methodological claim is that we cannot reconcile privacy with the equality of individuals unless we make a deliberate effort to do so. Its central moral and political claims are that privacy is compatible with the equality of individuals, and sufficiently important to the latter that, in a democracy, the privacy of individuals merits legal protection by right. However, this summary of the book also exposes its limitations. Chief amongst these, I fear, is that it provides no sustained discussion of the place of property on a democratic conception of privacy, and that the latter, itself, is rather a broad preliminary sketch than a polished and detailed portrait. I regard these limits on the scope and arguments of the book as limitations, albeit ones that I hope to be able to remedy before too long.However, limited though the book clearly is, I believe that it lays out the essential components of a democratic conception of privacy and that, by analysing and synthesizing several diverse bodies of literature, it may help those who are interested in the relations between privacy, equality and democracy. Nel corso degli ultimi 20 anni c’è stata una espansione globale in materia di istruzione dottorale e in particolare di ‘dottorati professionali’. Difficoltà nell’avanzamento e nel completamento diventano sempre più il centro dell’attenzione per tutti i tipi di dottorato. È stato riconosciuto che una serie di fattori al di là di quelli prettamente demografici potrebbe influire sulla possibilità di completare gli studi. C’è ancora molto da imparare sul motivo per cui l’avanzamento e il completamento del dottorato sono così impegnativi. In (...) questo articolo vorremmo mettere in evidenza un settore che sembra trascurato dalla ricerca: l’esperienza emotivamente complessa del percorso di dottorato.Offriamo un contributo al dibattito su ciò che è necessario per facilitare il successo e intrinsecamente un soddisfacente avanzamento all’interno di un programma di dottorato professionale. Noi sosteniamo che una maggiore attenzione debba essere prestata al cammino esperienziale di studenti di dottorato dal momento che essi hanno il difficile compito di integrare la loro vita personale, professionale e accademica. Il nostro interesse per le risorse emotive di cui gli studenti possono avvalersi durante il loro percorso di dottorato è iniziato con la progettazione e lo sviluppo del nostro primo dottorato professionale in materia di sanità e cura. Attraverso la nostra iniziale esperienza con due gruppi di studenti, abbiamo riflettuto sullo sviluppo del dottorato professionale, in generale, e trasversalmente a diverse altre discipline, per comprendere meglio come facilitare una buona esperienza di dottorato e una conclusione nei tempi.L’importanza di partecipare all’esperienza emotiva all’interno del complesso percorso di dottorato professionale ci ha portato al concetto di ‘nourished scholarship’ . Si definisce la nozione di ‘nourished scholarship’ come un percorso di apprendimento che lega i valori personali, significativi e attuali, allo sviluppo e al contributo professionale. Tale nutrimento emotivo è caratterizzato da una soddisfacente esperienza di scambio tra il sé, l’apprendimento e la comunità di pratica/studio. La nostra opinione è che tale nutrimento emotivo sia una risorsa fondamentale da cui gli studenti attingono al momento di negoziare le sfide complesse del percorso professionale di dottorato. Al fine di illustrare il significato di ‘nourished scholarship’ descriviamo alcune delle sue dimensioni emotive chiave. Queste dimensioni possono essere agevolate in vari modi, ma qui ne segnaliamo uno in particolare: il sostegno reciproco e la supervisione di gruppo facilitata. Al fine di illustrare le dimensioni della ‘nourished scholarship’ quindi noi riflettiamo su un caso specifico, quello di una coorte di studenti di dottorato professionale. Sono state estratte alcune loro esperienze per illustrare sette dimensioni che sono importanti per contribuire all’esperienza di ‘nourished scholarship’ come una risorsa di sostegno:- Sperimentare i benefici di appartenenza- Aiutarsi vicendevolmente a contenere l’ansia- Vivere la crescente fiducia- Accettare comunanza e unicità- Miglioramento personale, identità professionale e accademica attraverso la chiarificazione dei valori- Sperimentare i benefici di relazionarsi ad una più ampia comunità scientifica- Accettare i ritmi dei tempi in cui ricevere dei tempi attivi.Inoltre, in questo articolo si riflette su come la particolare struttura del programma di dottorato è stata in grado di sostenere lo sviluppo di queste risorse. Ci sono state tre caratteristiche chiave che crediamo siano state fondamentali nel modo in cui il programma è stato progettato e realizzato:a) ‘Cohortness’ in cui gli studenti si impegnano con il programma come un gruppo in viaggio.b) Supervisione di coorte: anche se tutti studiavano diversi argomenti, si è formato un gruppo insieme a due facilitatori accademici per discutere il processo, l’esperienza del percorso e il loro apprendimento.c) Una strategia di valutazione flessibile che permette agli studenti di progredire in modo personale e non lineare.Il valore potenziale di questo articolo per i programmi educativi è che fornisce un quadro per focalizzare l’attenzione sull’importanza del percorso emotivo e sui modi per sostenere la motivazione degli studenti e la resilienza. Noi crediamo che questo quadro abbia un potenziale trasferibile ad altre situazioni in cui tali risorse emotive possono essere importanti.During the past 20 years there has been a global expansion in doctoral education and in particular professional doctorates. Difficulties with progression and completion have increasingly become the focus of attention within both academic and professional contexts. It has been acknowledged that a range of factors, beyond demographics, could be influential in whether students are able to sustain their studies to completion. In this paper we stress the importance of conceptualising professional doctoral studies as a personal, professional and academic journey that is sustained by emotional factors that may need more explicit attention. As such, our contribution is the delineation of a phenomenon that we call ‘nourished scholarship’. We wish to illustrate how such ‘nourished scholarship’ functions as a resource for sustaining motivation and integration through the doctoral journey. We offer seven dimensions that a doctoral programme needs to embody in order to facilitate ‘nourished scholarship’: belonging, containing anxiety, growing confidence, commonality and uniqueness, values clarification, scholarly community, and negotiating the rhythms of receptive and active times. We illustrate these dimensions in the context of a professional doctorate programme that emphasises ‘cohort supervision’ as the primary resource for facilitating such nourished scholarship. We believe that this notion has transferable potential to other provisions where such emotional resources may be important. (shrink)

In this paper, I shall try to elucidate the relationship between nature and providence with regard to the function of guaranteeing perpetual peace in Kant's 1795 essay, an issue which, presumably for the very reason of providence being granted some role in the first place, has led to noticeable unease in Kant scholarship. Providence simply does not seem to fit in well into Kant’s philosophical account of history given the emphasis he puts on the notion of human freedom. The (...) main idea grounding my approach is that the notion of providence is not only not a threat to human freedom, but perhaps the most important ingredient in Kant’s solution of the compatibility problem with regard to human freedom and natural causal determinism. This solution of the compatibility problem, as I have argued elsewhere, must be understood along the lines of a so-called “altered law-compatibilism” which makes the special laws of nature dependent on human freedom. The role of providence then is to elucidate or explicate how such a dependency is possible. Moreover, Kant’s own definition of “providence”, which he develops as an alternative to Baumgarten’s, provides the resources of identifying it – in a sense to be qualified below – with nature and hence provides the means for solving a long-standing riddle in Kant’s account. Of course, the compatibility problem does not take centre stage in the guarantor section in any way. Rather, what Kant is doing there can best be understood as presupposing and being closely related to his compatibility argument: He can be read as spelling out the dependency of laws on nature with regard to the course of history. The first systematic exposition of all the central topics in the philosophy of logic, Susan Haack's book has established an international reputation for its accessibility, clarity, conciseness, orderliness, and range as well as for its thorough scholarship and careful analyses. Haack discusses the scope and purpose of logic, validity, truth-functions, quantification and ontology, names, descriptions, truth, truth-bearers, the set-theoretical and semantic paradoxes, and modality. She also explores the motivations for a whole range of non-classical systems of logic, including (...) many-valued logics, fuzzy logic, moddal and tense logics, and relevance logics. Persupposing only an elementary knowledge of formal logic, this book includes many useful summary tables and diagrams, as well as a helpful glossary of technical terms. Wide-ranging, informative, and eminently readable, this book has proven a valuable resource for generations of students and scholars in a variety of disciplines outside philosophy needing guidance on the philosophy of logic. There is a growing body of scholarship that is addressing the ethics, in particular, the bioethics of space travel and colonisation. Naturally, a variety of perspectives concerning the ethical issues and moral permissibility of different technological strategies for confronting the rigours of space travel and colonisation have emerged in the debate. Approaches ranging from genetically enhancing human astronauts to modifying the environments of planets to make them hospitable have been proposed as methods. This paper takes a look at a (...) critique of human bioenhancement proposed by Mirko Garasic who argues that the bioenhancement of human astronauts is not only functional but necessary and thus morally permissible. However, he further claims that the bioethical arguments proposed for the context of space do not apply to the context of Earth. This paper forwards three arguments for how Garasic’s views are philosophically dubious: (1) when he examines our responsibility towards future generations he refers to a moral principle (which we will call the principle of mere survival) which, besides being vague, is not morally acceptable; (2) the idea that human bioenhancement is not natural is not only debatable but morally irrelevant; and (3) it is not true that the situations that may arise in space travel cannot occur on Earth. We conclude that not only is the (bio)enhancement of humans on Earth permissible but perhaps even necessary in certain circumstances. (shrink)

This article focuses on the relationship between memory, female identity and the history of women: issues and areas of scholarship that have a comparatively recent history, but already present a rich spectrum of contrasting approaches and studies. In the case at hand, interpretations rooted in Foucault’s genealogical approach are contrasted with more recent postcolonial studies, against the backdrop of the political history of European and American feminism, a position that can scarcely be reduced to the more familiar terms of (...) the debate between philosophers and neuroscientists. The writing that springs from female memory is not the function of an alleged specificity of the female brain, but the product of the ability of a specific cultural subject to construct a genealogy from the point of view of its unprecedented reality: a seemingly minor “supplement,” but one that has the power to subvert the main corpus of history and knowledge, as Virginia Woolf already showed in magisterial terms as early as 1929. We have arrived, in recent times, to a phase of heightened self-reflection concerning the nature and content of American modes of interpretive scholarship in relation to their object, the East Asian religious tradition. Such intensified reflection within the field has helped bringing about a degree of overcoming of the limitations of certain prior methodologies, allowing us to identify and eliminate patterns of inquiry which lead to exaggeration, naivete and or ignorance regarding the object, which occur as the result of (...) the unconscious bias created by perception limited by the confines of our culturally defined interpretive paradigms. This paper investigates the relationship that people with high functioning autism have with organizational temporality by considering this operationalization within the framework of humanistic management. To do so, it proposes an analysis based on seven propositions. Autism is a disorder that is still poorly understood and often linked to social depictions that are as unfounded as they are repulsive. It remains an unexplored area of study in the field of management sciences. Existing scholarship has established that people with autism (...) have great difficulty finding and retaining employment. While it is well known that they have weak social skills, their difficulties in relation to time have only been studied in medical research, even though organizational temporality substantially shapes the functioning of teams. The operationalization of autistic temporality as a particular temporality within humanistic management allows for the development of a new conceptual framework based on a consideration of neuro-atypia. This paper begins with a presentation of the theoretical background. It then develops the theoretical model. Implications, limitations and directions for further studies are discussed before concluding. (shrink)

Descartes's concept of the mind, as distinct from the body with which it forms a union, set the agenda for much of Western philosophy's subsequent reflection on human nature and thought. This is the first book to give an analysis of Descartes's pivotal concept that deals with all the functions of the mind, cognitive as well as volitional, theoretical as well as practical and moral. Focusing on Descartes's view of the mind as intimately united to and intermingled with the (...) body, and exploring its implications for his philosophy of mind and moral psychology, Lilli Alanen argues that the epistemological and methodological consequences of this view have been largely misconstrued in the modern debate. Informed by both the French tradition of Descartes scholarship and recent Anglo-American research, Alanen's book combines historical-contextual analysis with a philosophical problem-oriented approach. It seeks to relate Descartes's views on mind and intentionality both to contemporary debates and to the problems Descartes confronted in their historical context. By drawing out the historical antecedents and the intellectual evolution of Descartes's thinking about the mind, the book shows how his emphasis on the embodiment of the mind has implications far more complex and interesting than the usual dualist account suggests. Examining the historical development of scientific concepts is important for understanding the structured routines within which these concepts are currently used as goal-directed tools in experiments. To illustrate this claim, I will outline how the concepts of mental imagery and hallucinations each draw on an older interdependent set of associations that, although nominally-discarded, continues to structure their current independent uses for pursuing discrete experimental goals. In doing so, I will highlight how three strands of literature offer mutually instructive insights for (...) understanding how the uses of our current scientific concepts contribute to experimental practices. The first strand of literature includes recent scholarship examining how the uses of scientific concepts can enable scientific practices (e.g., Boon 2012; Brigandt 2012; Feest 2010; Steinle 2012). In this context, scientific concepts have been described as tools that function in ways that contribute to empirical knowledge; contributions that extend beyond their traditionally recognized roles in mental and linguistic representation. The second strand of literature can be glimpsed within the technoscientific studies focus on non-human agency; a focus that supports an account of the disciplined routines within which concepts are used as acting in analogous ways to the routinized participation of machines in experiments (Pickering 1995). The third strand of the literature draws attention to how the functions of concepts are grounded by the set of historically-contingent experimental practices (e.g., Canguilhem 2008; Tiles 1984). Although maintaining valuable differences, the focus of these three strands of literature are mutually instructive. Together, they offer a view of the uses of concepts as taken-for-granted tools that function within networks of subterranean associations; associations that are grounded by historically contingent experimental practices that structure how they act (in concert with human and material participants) within the temporally dynamic processes of scientific practice. Through examples drawn from a comparison of the concepts of mental imagery and hallucinations, I aim to demonstrate the value that the converging insights of these three strands of literature offer for studying the role of scientific concepts in experimental practices. He then offers a fresh interpretation of Boyer’s famous account of scholarship as the foundation of university teaching. To fully understand the nature of teaching excellence in higher education, the book then gives an account of the various dimensions of the domain of university teaching and the core drivers (...) required to bring those domains to life. The idea of empowerment underlies the journey to excellence in teaching. The book argues that university lecturers aspiring to become excellent should be active agents, strongly pursuing the development of their perfectible abilities required for high quality teaching. The author then draws on recent developments in virtue theory to set out the qualities of character requisite for guiding and driving university lecturers to grow and develop into excellent teachers. While National Human Rights Institutions are widely regarded as particularly promising tools in the emerging transnational regime for the regulation of business and human rights, we still know little about their potential and actual contribution to this field. This article bridges the gap between business and human rights research and NHRI scholarship, proceeding in three steps: Firstly, I analyze the structural conditions for NHRIs to tackle business-related human rights abuses effectively, focusing on the key conditions of legitimacy and competences. (...) Secondly, I examine the envisaged role and functions of NHRIs in business and human rights regulation according to the Paris Principles and the UN Guiding Principles. Thirdly, I reconstruct and critically assess NHRIs’ mandates and powers to address corporate human rights abuse, based on the analysis of surveys and reports. I argue that there is a significant mismatch between the essential structural conditions for effective NHRI engagement with business and human rights, the expected contribution of NHRIs to the prevention and remedy of corporate human rights abuses, and the limitations of their mandates and powers in practice. To overcome that misalignment and unlock NHRIs’ full potential, this article proposes a reform of the Paris Principles which would provide these institutions with a robust source of international legitimacy and increase the pressure on state governments to extend their powers. For several decades, intercultural philosophers have produced an extensive body of scholarly work aimed at mutual intercultural understanding. They have focused on the ideal of intercultural dialogue that is supported by dialogue principles and virtuous attitudes. However, this ideal is challenged by decolonial scholarship as neglecting power inequalities. Decolonial scholars have emphasized the differences between cultures and worldviews, shifting the focus to colonial history and radical alterity. In return, intercultural philosophers have worried about the very possibility of dialogue and (...) mutual understanding in frameworks that use coloniality as their singular pole of analysis. In this paper, we explore the complex relations between decolonial and intercultural philosophies. While we diagnose tensions between both intellectual discourses, we argue that these tensions turn out to be productive: for intercultural philosophers, decolonial challenges provide an opportunity to critically rethink ideals of equitable dialogue in the light of colonial inequity and its deep entrenchment in global philosophical encounters. For decolonial scholars, intercultural philosophies provide an opportunity to sharpen positive proposals of equitable encounters beyond the critique of current forms of colonial domination. Rather than developing a compromise, we propose to embrace the productive tensions between them through a broad methodological toolbox. Decolonial and intercultural motifs serve different functions in the articulation of a critical global philosophy and can sharpen each other without integrating into a middle ground that is “a little bit intercultural” and “a little bit decolonial”. The core function of argumentation in a democratic setting must be to constitute a modality for citizens to engage differences of opinion constructively – for the present but also in future exchanges. To enable this function requires acceptance of the basic conditions of public debate: that consensus is often an illusory goal which should be replaced by better mastery of living with dissent and compromise. Furthermore, it calls for an understanding of the complexity of real-life public debate which is an (...) intermixture of claims of fact, definition, value, and policy, each of which calls for an awareness of the greater ‘debate environment’ of which particular deliberative exchanges are part. We introduce a rhetorical meta-norm as an evaluation criterion for public debate. In continuation of previous scholarship concerned with how to create room for differences of opinion and how to foster a sustainable debate culture, we work from a civically oriented conception of rhetoric. This conception is less instrumental and more concerned with the role of communication in public life and the maintenance of the democratic state. A rhetorical meta-norm of public argumentation is useful when evaluating public argumentation – not as the only norm, but integrated with specific norms from rhetoric, pragma-dialectics, and formal logic. We contextualise our claims through an example of authentic contemporary public argumentation: a debate over a biogas generator in rural Denmark. (shrink)

In the last decades, research in science mapping has delivered several powerful techniques, based on citation or textual analysis, for charting the intellectual organization of research fields. To map the social network underlying science and scholarship, by contrast, science mapping has mainly relied on one method, co-authorship analysis. This method, however, suffers from well-known limitations related to the practice of authorship. Moreover, it does not perform well on those fields where multi-authored publications are rare. In this study, a new (...) method for mapping the social structure of research fields is advanced, based on the analysis of the acknowledgments of academic publications. We first discuss the standard account of the function of acknowledgments in scholarly communication, then we introduce a new interpretative framework in which the acknowledgments are intended as positioning signals exchanged by researchers. Next, we provide the formal definition of the four acknowledgments-based networks that stand at the core of the method, and we test it on a humanities field, analytic philosophy. Results show that acknowledgement-based networks allow to reconstruct the fine-grained social structure of analytic philosophy from different perspectives. Furthermore, by comparing the citation-based maps of the field with the acknowledgments-based networks, it permits to shed light on the relationship between the intellectual and social layer of analytic philosophy. We conclude by presenting practical limitations of the method and by sketching some further research lines. (shrink)

On page 1 of his classic text, Millsap states, “Measurement invariance is built on the notion that a measuring device should function the same way across varied conditions, so long as those varied conditions are irrelevant [emphasis added] to the attribute being measured.” By construction, measurement invariance techniques require not only detecting varied conditions but also ruling out that these conditions inform our understanding of measured domains. In fact, measurement invariance techniques possess great utility when theory and research inform their (...) application to specific, varied conditions that, if not detected, introduce measurement biases, and, thus, depress measurement validity. Yet, we see emerging bodies of work where scholars have “put the cart before the horse” when it comes to measurement invariance, and they apply these techniques to varied conditions that, in fact, may reflect domain-relevant information. These bodies of work highlight a larger problem in measurement that likely cuts across many areas of scholarship. In one such area, youth mental health, researchers commonly encounter a set of conditions that nullify the use of measurement invariance, namely discrepancies between survey reports completed by multiple informants, such as parents, teachers, and youth themselves. In this paper, we provide an overview of conceptual, methodological, and measurement factors that should prevent researchers from applying measurement invariance techniques to detect informant discrepancies. Along the way, we cite evidence from the last 15 years indicating that informant discrepancies reflect domain-relevant information. We also apply this evidence to recent uses of measurement invariance techniques in youth mental health. Based on prior evidence, we highlight the implications of applying these techniques to multi-informant data, when the informant discrepancies observed within these data might reflect domain-relevant information. We close by calling for a moratorium on applying measurement invariance techniques to detect informant discrepancies in youth mental health assessments. In doing so, we describe how the state of the science would need to fundamentally “flip” to justify applying these techniques to detect informant discrepancies in this area of work. (shrink)
