This chapter addresses the problem of ranking available drugs in guideline development to support clinicians in their work. Based on a pragmatic approach to the notion of evidence and a hierarchical view on different kinds of evidence this chapter introduces a decision aid, HiDAD, which draws on the multi criteria decision making literature. This decision aid implements the wide-spread intuition that there are different kinds of evidence with varying degrees of importance by relying on a strict ordinal ordering of (...) kinds of evidence. In order to construct a ranking every pair of drugs is first compared separately on all kinds of evidence. Next, these quantitative comparisons are then aggregated into an overall comparison between drugs based on all the available evidence in a way which avoids that evidence of less importance is trumped by evidence of the higher levels. Finally, these overall comparisons are used to determine the final ranking of drugs which then informs the process of guideline writing. Properties, modifications and applicability of the decision aid HiDAD are discussed and assessed. (shrink)

C. I. Lewis’s conception of the given element in perceptual experience was one of the targets of Sellars’ famous charge that many such conceptions fall victim to the Myth of the Given. Yet exactly what makes a conception of the given mythical has remained unclear. Here I aim to clarify this issue by discussing Eric Watkins’ recent claim that a conception exactly like the one Lewis articulated in Mind and the World Order in fact avoids the Myth. Watkins motivates this (...) claim in part by raising objections for John McDowell’s account of the Myth and argues that a better account can be extracted from Kant. I defend McDowell’s position (and reject Watkins’ Kantian account) by arguing that these objections are based on a failure to appreciate an implication of the claim (which Watkins accepts) that rational thought operates in “the logical space of reasons.” Specifically, I focus on the implication that a thinker must be in a position to understand the rational significance of her perceptual experience. Along the way I explain in what ways Watkins’ conception of the given in experience mirrors the view of Lewis. (shrink)

Conceptual engineering is a philosophical method that aims to design and spread conceptual and linguistic devices to cause meaningful changes in the world. So far, however, conceptual engineers have struggled to successfully spread the conceptual and linguistic entities they have designed to their target communities. This paper argues that conceptual engineering is far more likely to succeed if it incorporates empirical data and empirical methods. Because the causal factors influencing successful propagation of linguistic or conceptual devices are as complicated and (...) interwoven as they are, proper empirical research will greatly boost the likelihood that propagation is successful. In arguing for the superiority of empirical conceptual engineering over armchair-based conceptual engineering, this paper proposes a framework for understanding the causal forces at play in propagation. This is a three-part framework between the label of a lexical item, the psychological states associated with the lexical item, and the worldly things associated with the lexical item. By understanding the way causal forces affecting propagation play out at these three levels, conceptual engineers can better conceptualize, study, and harness the different causal forces affecting the success of their conceptual engineering projects. Philosophical discussions on causal inference in medicine are stuck in dyadic camps, each defending one kind of evidence or method rather than another as best support for causal hypotheses. Whereas Evidence Based Medicine advocates the use of Randomised Controlled Trials and systematic reviews of RCTs as gold standard, philosophers of science emphasise the importance of mechanisms and their distinctive informational contribution to causal inference and assessment. Some have suggested the adoption of a pluralistic approach to causal inference, and an (...) inductive rather than hypothetico-deductive inferential paradigm. However, these proposals deliver no clear guidelines about how such plurality of evidence sources should jointly justify hypotheses of causal associations. We here develop such guidelines by first giving a philosophical analysis of the underpinnings of Hill’s viewpoints on causality. We then put forward an evidence-amalgamation framework adopting a Bayesian net approach to model causal inference in pharmacology for the assessment of harms. Our framework accommodates a number of intuitions already expressed in the literature concerning the EBM vs. pluralist debate on causal inference, evidence hierarchies, causal holism, relevance, and reliability. In recent years, two competing methodological frameworks have developed in the study of the epistemology of philosophy. The traditional camp, led by experimental philosophy and its allies, has made inferences about the epistemology of philosophy based on the reactions, or intuitions, people have to works of philosophy. In contrast, multiple authors have followed the lead of Deutsch and Cappelen by setting aside experimental data in favor of inferences based on careful examination of the text of notable works of (...) philosophy. In other words, the debate is split between authors focusing on philosophy’sconsumptionand those focusing on philosophy’sproduction. This paper examines the motivation for focusing on original texts and other evidence of philosophy’s production and finds it lacking. Drawing upon Hills’ distinction between propagation and transmission, I argue that the social epistemology of philosophy does not justify the recent focus on original texts of philosophy. Because the philosophical knowledge of consumers of philosophy is likelyinspiredby producers of philosophy, as opposed to epistemically grounded in the producers’ epistemic states, experimental philosophy had it right all along—if we want to know the epistemic standing of philosophy, we need to look to philosophy’s consumers. Insurance is pervasive in many social settings. As a cooperative device based on risk pooling, it serves to attenuate the adverse consequences of various risks by offering policyholders coverage against the losses implied by adverse events in exchange for the payment of premiums. In the insurance industry, the concept of actuarial fairness serves to establish what could be adequate, fair premiums. Accordingly, premiums paid by policyholders should match as closely as possible their risk exposure. Such premiums are the product (...) of the probabilities of losses and the expected losses. This article presents a discussion of the fairness of actuarial fairness through three steps: defining the concept based on its formulation within the insurance industry; determining in which sense it may be about fairness; and raising some objections to the actual fairness of actuarial fairness. The necessity of a normative evaluation of actuarial fairness is justified by the influence of the concept on the current reforms of public insurance systems and the fact that it highlights the question of the repartition of the gains and burdens of social cooperation. We introduce two novel frameworks for choice under complete uncertainty. These frameworks employ intervals to represent uncertain utility attaching to outcomes. In the first framework, utility intervals arising from one act with multiple possible outcomes are aggregated via a set-based approach. In the second framework the aggregation of utility intervals employs multi-sets. On the aggregated utility intervals, we then introduce min–max decision rules and lexicographic refinements thereof. The main technical results are axiomatic characterizations of these min–max decision rules and (...) these refinements. We also briefly touch on the independence of introduced axioms. Furthermore, we show that such characterizations give rise to novel axiomatic characterizations of the well-known min–max decision rule?mnx?mnx in the classical framework of choice under complete uncertainty. In “The Pecking Order,” Dalton Conley argues that inequalities between siblings are larger than inequalities at the level of the overall society. Our article discusses the normative implications for institutions of this observation. We show that the question of state intervention for curbing intra-family inequality reveals an internal tension within liberalism between autonomy and toleration, which bears on the forms that the intervention of institutions may take. Over the years, artificial neural networks have been applied successfully in many areas including IT security. Yet, neural networks can only process continuous input data. This is particularly challenging for security-related, non-continuous data like system calls of an operating system. This work focuses on five different options to preprocess sequences of system calls so that they can be processed by neural networks. These input options are based on one-hot encodings and learning word2vec, GloVe or fastText representations of system calls. (...) As an additional option, we analyse if mapping system calls to their respective kernel modules is an adequate generalization step for replacing system calls or enhancing system call data with additional information regarding their context. When performing such preprocessing steps it is important to ensure that no relevant information is lost during the process. The overall objective of system call analysis in the context of IT security is to categorize a sequence of them as benign or malicious behavior. Therefore, this scenario is used to evaluate different system call representations in a classification task. Results indicate that a broader range of attacks can be detected when enriching system call representations with corresponding kernel module information. This paper discusses the issue of overriding the right of individual consent to participation in cluster randomised trials (CRTs). We focus on CRTs testing the efficacy of non-pharmaceutical interventions. As an example, we consider school closures during the COVID-19 pandemic. In Norway, a CRT was promoted as necessary for providing the best evidence to inform pandemic management policy. However, the proposal was rejected by the Norwegian Research Ethics Committee since it would violate the requirement for individual informed consent. This sparked (...) debate about whether ethics stand in the way of evidence-based health policy, since the Norwegian Research Ethics law’s strict requirements for individual consent make it practically impossible to carry out CRTs of public health interventions. We argue that, in the case of the school closure trial, the suggested CRT would not have eliminated an epistemic gap and thus would not have justified the violation of consent rights. First, we focus on the methodological challenges to estimating quantifiable effects of school closures in the specific case of an airborne infectious disease. Second, in line with Evidential Pluralism, we highlight the value of alternative lines of evidence for informing school closure policy in a pandemic. In general, we propose that a trial requiring the waiver of participants’ consent rights must be highly likely to eliminate an epistemic gap. We elaborate on the practical aspects of this criterion and discuss the potential advantages of adding it to the Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials. Autonomous and automatic weapons would be fire and forget: you activate them, and they decide who, when and how to kill; or they kill at a later time a target you’ve selected earlier. Some argue that this sort of killing is always wrong. If killing is to be done, it should be done only under direct human control. (E.g., Mary Ellen O’Connell, Peter Asaro, Christof Heyns.) I argue that there are surprisingly many kinds of situation where this is false (...) and where the use of Automated Weapons Systems would in fact be morally required. These include cases where a) once one has activated a weapon expected then to behave lethally, it would be appropriate to let it continue because this is part of a plan whose goodness one was best positioned to evaluate before activating the weapon; b) one expects better long-term consequences from allowing it to continue; c) allowing it to continue would express a decision you made to be resolute, a decision that could not have advantaged you had it not been true that you would carry through with it; d) the weapon is mechanically not recallable, so that, to not allow it to carry through, you would have had to refrain from activating it in the first place, something you expected would have disastrous consequences; e) you must deputize necessary killings to autonomous machines in order to protect yourself from guilt you shouldn’t have to bear; f) it would be morally better for the burden of responsibility for the killing to be shared among several agents, and the agents deputizing killing to machines can do this, especially where it’s not predictable which machine will be successful; g) a killing would be morally better done with elements of randomness and lack of deliberation, and a (relatively stupid) machine could do this where a person could not; h) the machine would be acting as a Doomsday Device, so that it could not have had its hoped for deterrent effect had you not ensured that you would be unable to recall it if enemy action activated it; i) letting it carry through is a necessary part of its own learning process, and you expect that this learning will have salutary effects later on; j) human intervention in the machine’s operation would disastrously impair its precision, or its speed and efficiency; k) using non-automated methods would require human resources you just don’t have in a task that nevertheless must be done (e.g., using land-mines to protect remote installations); l) the weapon has such horrible and indiscriminate power that it is doubtful whether it could be actually used in ways compatible with International Humanitarian Law and the Laws of War, which require that weapons be used only in ways respecting distinctness, necessity and proportionality, but its threat of use could respect these principles in affording deterrence provided human error cannot lead to their accidental deployment, this requiring that they be controlled by carefully designed autonomous and automatic systems. I then consider objections based on conceptions of human dignity and find that very often dignity too is best served by autonomous machine killing. Examples include saving your village by activating a robot to kill invading enemies who would inflict great indignity on your village, using a suicide robot to save yourself from a less dignified death at enemy hands, using a robotic drone to kill someone otherwise not accessible in order to restore dignity to someone this person killed and to his family, and using a robot to kill someone who needs killing, but the killing of whom by a human executioner would soil the executioner’s dignity. I conclude that what matters in rightful killing isn’t necessarily that it be under the direct control of a human, but that it be under the control of morality; and that could sometimes require use of an autonomous or automated device. With an eye on how post-colonial novels by authors Chinua Achebe and Ngugi Wa Thiong’o address aesthetic and environmental problems that preceded the Modern period, the intent of this essay is to emphasize how their fiction connects readers with a pre-industrial, premodern, and, strangely enough, radically new ways of thinking about books and the living world beyond them. Abstract:Through dismantling the territorial integrity of the modern nation-state, Indigenous sovereignty threatens state imposed hegemonic systems. While these systems exist at the threshold spatially—borders and boundaries—they are the ideological epicenter for controlling human and non-human life, rendering them manageable by the state. These borders are also perpetually liminal spaces, and it is in this liminality that artists intervene through poetics, confronting state rhetorics and exercising sovereignty to address colonial wounds. In 2015 and 2017, two land-based ephemeral art projects (...) were created to challenge the terms by which territory is instrumentalized in order to justify the commodification of both land and humans. In 2015, the artist collective, Post-commodity, set up a land-based art installation, Repellent Fence, intersecting the US/Mexico border in an effort to “stitch” the Americas together again. The gesture of stitching is also employed in Maureen Gruben's Stitching My Landscape from 2017 in which Gruben stitched a segment of ocean ice with vibrant red broad cloth near her home in Tuktoyaktuk, Northwest Territories alongside the Ibyuk Pingo, a national landmark administered by Parks Canada. Both of these projects provide entry points into the various methods by which land is abstracted into an oppressive and singular form. They push back against the rigidity of prescribed borders, instead investigating more fluid entanglements with land.This paper provides a comparative analysis of these projects, examining the ways in which counterpoints are central to them as artistic interventions. Crossing diagonally to the borders that the nation-state has institutionalized produces a moment of reprise to a highly specific end: to heal. Pivotal to these anti-colonial critiques are rejection, dismissal and a refusal to translate. A symbolic reorientation of the ways humans interact with land arises, evoked through a performative gesture of stitching across fragmentations and divides. (shrink)

International regulation of autonomous weapon systems (AWS) is increasingly conceived as an exercise in risk management. This requires a shared approach for assessing the risks of AWS. This paper presents a structured approach to risk assessment and regulation for AWS, adapting a qualitative framework inspired by the Intergovernmental Panel on Climate Change (IPCC). It examines the interactions among key risk factors—determinants, drivers, and types—to evaluate the risk magnitude of AWS and establish risk tolerance thresholds through a risk matrix informed by (...) background knowledge of event likelihood and severity. Further, it proposes a methodology to assess community risk appetite, emphasizing that such assessments and resulting tolerance levels should be determined through deliberation in a multistakeholder forum. The paper highlights the complexities of applying risk-based regulations to AWS internationally, particularly the challenge of defining a global community for risk assessment and regulatory legitimization. In recent years it has been demonstrated that the use of the traditional property registry models involves the risk of corruption along with long waiting times. This paper points out the main problems associated with conventional models and makes a survey of the new ones that are based on blockchain technology. This type of model is already being developed as a proof of concept by different countries. With the use of this technology in land registry systems, it is (...) possible to improve the transparency of the processes as well as optimize costs and execution time. Land is becoming increasingly scarce relative to the demands of the global economy; a problem significantly exacerbated by climate change. In response, some have suggested that land should be conceptualised as a global commons. This framing might seem like an appealing way to promote sustainable and equitable land use. However, it is a poor fit for the worldʼs land because global commons are generally understood as resources located beyond state borders. I argue that land can (...) be seen to fit the definition of a global commons, if viewed in a particular way; namely, as a biogeochemical resource system that sequesters carbon emissions. The question then arises whether land should be conceptualised as a global commons. I consider this question by reference to three contemporary problems of land justice (land grabbing, forced displacement, and unfairness in land-based climate mitigation); arguing that the global-commons framing will not be conducive to understanding or responding to these problems. I leave the question of how the global community should conceptualise land in the context of climate change open, claiming that any answer must include the voices and perspectives of those whose livelihoods and identities are closely connected to the land. One of the several reasons given in calls for the prohibition of autonomous weapons systems (AWS) is that they are against human dignity (Asaro, 2012; Docherty, 2014; Heyns, 2017; Ulgen, 2016). However there have been criticisms of the reliance on human dignity in arguments against AWS (Birnbacher, 2016; Pop, 2018; Saxton, 2016). This paper critically examines the relationship between human dignity and autonomous weapons systems. Three main types of objection to AWS are identified; (i) arguments based on (...) technology and the ability of AWS to conform to International Humanitarian Law; (ii) deontological arguments based on the need for human judgement and meaningful human control, including arguments based on human dignity; (iii) consequentialist reasons about their effects on global stability and the likelihood of going to war. An account is provided of the claims made about human dignity and AWS, of the criticisms of these claims, and of the several meanings of ‘dignity’. It is concluded that although there are several ways in which AWS can be said to be against human dignity, they are not unique in this respect. There are other weapons, and other technologies, that also compromise human dignity. Given this, and the ambiguities inherent in the concept, it is wiser to draw on several types of objections in arguments against AWS, and not to rely exclusively on human dignity. (shrink)

The automated valuation of benchmark land price plays an essential role in regulating land demand in Chinese real-estate market as the big data are currently accumulated rapidly. However, this problem becomes highly challenging due to the multidimension, large volume, and nonlinearity of the land price-influencing factors. In this paper, an effective data-driven automated valuation framework is proposed for valuing real estate assets by combining a GIS and neural network technologies. This framework can automatically obtain the values of (...) spatial factors affecting land price from GIS and generate training set data for training the neural network to identify the complex relationship between all kinds of factors and benchmark land prices. The effectiveness and universality of the framework is verified via the data of benchmark land prices in Wuhan. In recent years, the green aviation technology draws more attention, and more hybrid power units have been applied to the aerial vehicles. To achieve the high performance and long lifetime of components during varied working conditions, the effective regulation of the energy management is necessary for the vehicles with hybrid power unit. In this paper, power prediction-based model predictive control for energy management strategy is proposed for the vehicle equipped with HPU based on turboshaft engine in order to (...) maintain proper battery’s state of charge and decrease turboshaft engine’s exhaust gas temperature. First, a modeling approach based on data-driven method is adopted to obtain the mathematical model of turboshaft engine considering time delay and inertial of states. An integrated power predictor consisting of the classification of input status and the subpredictors are developed based on the deep learning method to improve the accuracy of the prediction model of the model predictive control. Subsequently, an EMS based on MPC using the proposed power predictor is introduced to regulate the SOC of battery and the EGT of turboshaft engine. The comparison with experimental results shows the high accuracy of mathematical model of turboshaft engine. The simulation results show the effectiveness of the proposed EMS for the vehicle, and the effects of different weight coefficients of objective function on the proposed EMS are discussed. (shrink)

The concept of noncombatant immunity prohibits the intentional targeting of noncombatants. The availability of nonlethal weapons (NLW) may weaken this prohibition, especially since using NLWs against noncombatants may, in some cases, actually save the noncombatants' lives. Given the advancement of NLWs, I argue that their probable appearance on the battlefield demands close scrutiny due to the moral problems associated with their use. In this paper, I examine four distinct cases and determine whether the use of NLWs is morally permissible. (...) While it seems that the reduced harm caused by NLWs makes their use more acceptable, adhering to noncombatant immunity requires more than not killing noncombatants. It also requires that military forces treat noncombatants a certain way. In the cases I present, to use NLWs against noncombatants treats them as combatants and coerces them to do something against their will. While a consequentialist foundation for noncombatant immunity may permit this action, a rights-based concept of noncombatant immunity does not. I contend that only a rights-based concept of noncombatant immunity is viable, and that the availability of NLWs should not significantly alter the prohibitions prescribed by noncombatant immunity. As wars today involve the use of sophisticated weapons such as autonomous ones, this paper aims to address the moral permissibility of using autonomous weapons systems (AWS) in wars. In the debate on autonomous weapons, advocates argue based on AWS’s precision of targets (Arkin 2018) and it not being clouded by emotional judgments (Marchant, et.al 2011) and prohibitors who comment on the ethical and legal implications of autonomous weapons (A. Sharkey 2019; Blanchard 2022). However, there (...) has been relatively little development of compliance of the autonomous weapons with all the principles of jus in bello, amongst the scholarship as well as its engagement with the just war framework broadly. To assess the moral compliance of AWS, the paper focuses on just conduct or the jus in bello principles. It closely examines all the three principles of necessity, discrimination, and proportionality that makeup just conduct as well as the legal body of International Humanitarian Law (IHL). Through a close analysis of all the principles of jus in bello against the use of autonomous weapons, this paper will result in the incompatibility of such weapons with the ethical framework of just war theory that gives out the norms for just and fair conduct during wars. It will thereby lead to a further reflection on the compliance of autonomous weapons as per jus in bello and the IHL to have greater restrain and ethical conduct during wars. (shrink)

Yinshun (1906–2005) is regarded as one of the eminent monks of twentieth-century Chinese Buddhism. In the mission of reinventing Chinese Buddhism Yinshun engaged particularly in the revival and restatement of Madhyamaka. His interpretation of Nāgārjuna's texts, the reassessment of the links between pre-Mahāyāna Buddhism and the Prajn˜āpāramitā tradition, and the critical analysis of the Chinese San-lun became the core of the new Mahāyāna that he planned for the twentieth-century China. Yinshun also adopted Madhyamaka criteria to reconsider the Mahāyāna schools that (...) were popular in China, and theorized a Madhyamaka-framed Pure Land based on his reading of the Shizhu piposha lun [T26 n1521]. This article discusses Yinshun's views on the Easy Path (yixing dao) and Difficult Path (nanxing dao) in the Pure Land practice, and contextualizes Yinshun's interpretation within the past history of the Chinese Pure Land School, as well as within the new debates on Pure Land that emerged in twentieth-century China. The 2016 United Nations’ Resolution 2325 “Non-proliferation of Weapons of Mass Destruction” manifests one of the greatest challenges for humankind in relation to preventing a global catastrophe, where it reaffirms that the proliferation of nuclear, chemical and biological weapons, as well as their means of delivery, constitutes a threat to international peace and security. However, regarding the continuous technological developments of terrestrial-based WMD aimed at orbiting space objects in near-Earth orbit, it is crucial to analyze whether, and (...) if so, how 2325 prevents their proliferation and utilization. Another relevant argument addresses the terminological factuality that, while treaty and customary law do provide some guidance on the legality of weaponization, the concept of a “space weapon” is still not clearly defined. Moreover, even though the Outer Space Treaty prohibits the placement of nuclear weapons and WMD in near-Earth orbit, installing them on the Moon or any other celestial body, or to otherwise station them in outer space, it simultaneously excludes terrestrial-based anti-satellite weapons, thus creating a legal loophole. National representatives of superpowers, particularly of space-faring nations, are aware of the existing issue and often express their concerns toward comprehensive ASAT development and utilization. Nevertheless, the potential weaponization of outer space will not be actively recognized and accepted as an official occurrence within the international community until our current space systems are eventually utilized in order to destroy or damage another State’s space object. With the rapid and unbalanced development of industry, a large amount of cultivated land is converted into industrial land with lower efficiency. The existing research is extensively concerned with industrial land use and industrial development in isolation, but little attention has been paid to the relationship between them. To help address this gap, the paper creates a new efficiency measure method for industrial land use combining Subvector Data Envelope Analysis with spatial analysis approach. The proposed model (...) has been verified by using the industrial land use data of 30 Chinese provinces from 2001 to 2013. The spatial autocorrelation relationship between industrial development and industrial land use efficiency is explored. Furthermore, this paper examines the effects of industrial development on industrial land use efficiency by spatial panel data model. The results indicate that the industrial land use efficiency and the industrial development level in the provinces of eastern region are higher than those of the western region. The spatial distribution of industrial land use efficiency shows remarkable positive spatial autocorrelation. However, the level of industrial development has obvious negative spatial autocorrelation since 2009. The improvement of industrial development has a significant positive impact on the industrial land use efficiency. (shrink)

Regulating war has long been a concern of the international community. From the Hague Conventions to the Geneva Conventions and the multiple treaties and related institutions that have emerged in the twentieth and twenty-first centuries, efforts to mitigate the horrors of war have focused on regulating weapons, defining combatants, and ensuring access to the battlefield for humanitarians. But regulation and legal codes alone cannot be the end point of an engaged ethical response to new weapons developments. This short (...) essay reviews some of the existing ethical works on lethal autonomous weapon systems (LAWS), highlighting how rule- and consequence-based accounts fail to provide adequate guidance for how to deal with them. I propose a virtue-based account, which I link up with an Aristotelian framework, for how the international community might better address these weapons systems. (shrink)

The aim of this paper is to investigate how alternative land ethics of agricultural stakeholders may help explain recent land use changes. The paper first explores the historical development of the land ethic concept in the United States and how those ethics have impacted land use policy and use of private lands. Secondly, primary data gathered from semi-structured interviews of farmers, ranchers, and influential stakeholders are then analyzed using stakeholder analysis methods to identify major factors considered (...) in land use decisions, priorities of factors of each group, and to define relevant mental models describing each group’s view of the land ethic concept. Results show that these stakeholder groups prioritize land use factors qualitatively differently and possess strikingly different land ethics. It is concluded that shifts in stakeholder land ethics have contributed to recent land use changes. Lastly, we discuss how current agricultural policy sends mixed signals about preferred land use and the potential ramifications based on the different land ethics we’ve described. (shrink)

Hetmans’ donations to the Orthodox Church were characteristic of the religious and political culture of the Cossack state already in the era of its emergence in the mid-17th century. In addition to other gifts, hetmans confirmed or provided Orthodox monasteries with land ownership, which was at the center of identity, power, and social prestige. It is clear that certain concrete motives, expectations, and models of behavior stood behind the hetmans’ donations of land. This article suggests considering hetmans’ donations (...) of land to the Orthodox Church as an element of symbolic communication, in which the giver and the recipient interacted, built symbolic communicative ties, and produced centers of communication. The focus is on “communication through donations,” that is, relationships of giving. Religious motivations and the recognition of monasteries as powerful centers of prayer were determinative for the hetmans’ “communication through donations” to the monasteries. The hetmans’ giving land and other real estate to monasteries was based on “piety,” but it was done in the name of Christ-loving rulers. So, in such donations it is quite natural that state interests were prevalent, but also there were complex combinations of religious, social, and political motivations and expectations. These characteristics were evident both in a general sense and in each specific instance of gifting. (shrink)

Land Ethics, Multilinguistic and Multicultural Communities of the 21 Century Guido Verstraeten Satakunta University of Applied Sciences, Suomi, Finland -/- The modern society is challenged by recent migration coming all over the world. Due to the basic rational principles of the modern nation the Western countries are faced with a disentangle of the societal coherence. The Newtonian conception of space-time, the secularization of the civil society, the extraterritorial cosmopolitism and the unilinear and homogeneous conception of progress seem incompatible with (...) the conception about life and society of the new immigrants. However the original population lost the cosy link with the familiar neighbourhood to which they are supposed to belong. This feelings of alienation of the part of the autochthonic people produce adversary reactions against foreigners of any walk and vice versa. Moreover populist politic parties recuperate this situation and impose a leitkultur to the traditional political life. -/- On the contrary we suggest to adopt a new conception of space, time , civil society, care and progress. Inspired by Leopold´s landethics we suggest an ecological philosophical basis for society building, based on the Leibnizian conception of space-time, the phenomenological relationship with the territory and a broad conception of civil society including civil virtue with respect to non-human life and landscape. The enormous destructive power of present stocks of nuclear weapons poses the greatest threat to public health in human history. Technical changes in weapons design are leading to an increased emphasis on the ability to fight a nuclear war, eroding the concept of deterrence based on mutually assured destruction and increasing the risk of nuclear war. Medical planning and civil defence preparations for nuclear war have recently been increased in several countries although there is little evidence that (...) they will be of significant value in the aftermath of a nuclear conflict. These developments have raised new ethical dilemmas for those in health professions. If there is any risk of use of weapons of mass destruction, then support for deterrence with these weapons as a policy for national or global security appears to be incompatible with basic principles of medical ethics and international law. The primary medical responsibility under such circumstances is to participate in attempts to prevent nuclear war. (shrink)

This conceptual paper represents my first attempt to tackle a difficult research problem (at least for me), employing the mindsponge concept facilitated by the BMF analytical approach. These ‘weapons’–as we at AISDL usually call them–have shown usefulness and capabilities to shed light on numerous challenging research problems in social sciences and humanities.

In the early twentieth century, Uchiyama Gudō, Seno’o Girō, Lin Qiuwu, and others advocated a Buddhism that was radical in two respects. Firstly, they adopted a more or less naturalist stance with respect to Buddhist doctrine and related matters, rejecting karma or other supernatural beliefs. And secondly, they held political and economic views that were radically anti-hegemonic, anti-capitalist, and revolutionary. Taking the idea of such a “radical Buddhism” seriously, A Buddha Land in This World: Philosophy, Utopia, and Radical Buddhism (...) asks whether it is possible to develop a philosophy that is simultaneously naturalist, anti-capitalist, Buddhist, and consistent. Rather than a study of radical Buddhism, then, this book is an attempt to radicalize it. The foundations of this “radicalized radical Buddhism” are provided by a realist interpretation of Yogācāra, elucidated and elaborated with some help from thinkers in the broader Tiantai/Tendai tradition and American philosophers Donald Davidson and W.V.O. Quine. A key implication of this foundation is that only this world and only this life are real, from which it follows that if Buddhism aims to alleviate suffering, it has to do so in this world and in this life. Twentieth-century radical Buddhists (as well as some engaged Buddhists) came to a similar conclusion, often expressed in their aim to realize “a Buddha land in this world.” Building on this foundation, but also on Mahāyāna moral philosophy, this book argues for an ethics and social philosophy based on a definition of evil as that what is or should be expected to cause death or suffering. On that ground, capitalism should be rejected indeed, but utopianism must be treated with caution as well, which raises questions about what it means – from a radicalized radical Buddhist perspective – to aim for a Buddha land in this world. There has been significant debate over both the imiplications and the merit of Leopold's land ethic. I consider the two most prominent objections and a resolution to them. One of these objections is that, far from being an alternative to an “economic” or cost‐benefit perspective on environmental issues, Leopold's land ethic merely broadens the range of economic considerations to be used in addressing such issues. The other objection is that the land ethic is a form of “environmental (...) fascism” because it subordinates the welfare of humans to the good of the ecological whole. I argue that these objections are based on a fundamental misunderstanding of his theory by advocates and detractors alike. The land ethic is centrally a psychological theory of moral development and ecological rationality that advocates a shift in the way that environmental problems are conceptualized and approached. The UN Convention on Certain Conventional Weapons (CCW) can, on the one hand, be considered vital for the global governance process—in the sense of urging international cooperation on the ethical, developmental, and standards aspects of lethal autonomous weapon systems (LAWS). On the other hand, the CCW may also embody a global trend that does not augur well for international solidarity, namely the lack of credible and comprehensive collaboration to advance global objectives of peace and security. In 2022, a majority (...) of the 125 nations that belong to the CCW requested limits on a specific type of lethal autonomous weapons: “killer robots.” Yet, most of the major global powers—namely the United States, Russia, and China—opposed not only a ban on LAWS but also on any restrictions on the development of these weapons, not least because the United States, Russia, and China are actively developing this weapons technology. While there is currently much focus on the technological evolution of LAWS, less has been written about how ethical values can exert influence on a growing global consciousness around factors such as power, technology, human judgment, accountability, autonomy, dehumanization, and the use of force. This introduction lays the groundwork for dealing with these issues. It does so by showing that all these factors warrant a pluralist approach to the global governance of LAWS, based on multiple grounds, including the military, tech, law, and distinctive theoretical-ethical orientations; the rationale being to combine this expertise into a collection for publication. Reflecting the contributing authors’ firsthand experiences of the ethics surrounding the management of LAWS to address decisive and critical questions at an expert level, it provides a framing for the collection, showing that the use of international legal mechanisms like the CCW are crucial to considering both the potential and the limits of LAWS, as well as what it can contribute to areas such as international law, human rights, and national security. ‘The problem of Spartan land tenure is one of the most vexed in the obscure field of Spartan institutions.’ Walbank's remark is as true today as when it was written nearly thirty years ago. Controversy surrounding this subject has a long tradition going back to the nineteenth century and the last thirty years have witnessed no diminution in the level of disagreement, as is demonstrated by a comparison of the differing approaches in the recent works by Cartledge, Cozzoli, David (...) and Marasco. Although another study runs the risk of merely adding one more hypothesis to the general state of uncertainty, a fundamental reassessment of the question is required, not least because of its significance for the historian's interpretation of the overall character of Spartiate society. Through the introduction of a new perspective it may be possible to advance our understanding of the subject. In Section I of this essay I shall attempt to review several influential scholarly theories and to examine their feasibility and the reliability of the evidence upon which they are based. Section II will begin to construct a more plausible alternative account which is based upon more trustworthy evidence. Finally, Section III will discuss a comparatively underemphasised aspect of the topic, the property rights of Spartiate women, which suggests a rather different interpretation of the character of land tenure and inheritance from those more usually adopted. Transitional justice is positioned as an emergent discourse to grapple with the aim, and subsequent practices, of moving societies mired in violent political relations to more stable, democratic political relations. Increasingly, precepts of transitional justice are being applied to political reconciliatory processes in so- called liberal democratic states. This article examines limitations to transitional justice paradigms especially when applied to Indigenous-state reconciliatory processes by centering Indigenous scholarly discourse critical of both transitional justice and reconciliation processes that position Indigenous peoples, Indigenous (...) lands, and the landed violence of colonialism as fixed in the past. The article offers an analysis of the limitations of neoliberal transitional justice and reconciliation processes that do not realize justice for Indigenous peoples and Indigenous lands by highlighting Indigenous-centered accounts of justice that promote collective capacities of Indigenous nations rooted in the ability of Indigenous peoples to experience themselves in the world in ways that center relations to land, world, and relatives (human and non-human). Image segmentation in land cover regions which are overlapping in satellite imagery, is one crucial challenge. To detect true belonging of one pixel becomes a challenging problem while classifying mixed pixels in overlapping regions. In current work, we propose one new approach for image segmentation using a hybrid algorithm of K-Means and Cellular Automata algorithms. This newly implemented unsupervised model can detect cluster groups using hybrid 2-Dimensional Cellular-Automata model based on K-Means segmentation approach. This approach detects different (...) class='Hi'>land use land cover areas in satellite imagery by existing K-Means algorithm. Since it is a discrete dynamical system, cellular automaton realizes uniform interconnecting cells containing states. In the second stage of current model, we experiment with a 2-dimensional cellular automata to rank allocations of pixels among different land-cover regions. The method is experimented on the watershed area of Ajoy river (India) and Salinas (California) data set with true class labels using two internal and four external validity indices. The segmented areas are then compared with existing FCM, DBSCAN and K-Means methods and verified with the ground truth. The statistical analysis results also show the superiority of the new method. Lethal Autonomous Weapons (LAWs) are robotic weapons systems, primarily of value to the military, that could engage in offensive or defensive actions without human intervention. This paper assesses and engages the current arguments for and against the use of LAWs through the lens of achieving more ethical warfare. Specific interest is given particularly to ethical LAWs, which are artificially intelligent weapons systems that make decisions within the bounds of their ethics-based code. To ensure that a wide, (...) but not exhaustive, survey of the implications of employing such ethical devices to replace humans in warfare is taken into account, this paper will engage on matters related to current scholarship on the rejection or acceptance of LAWs—including contemporary technological shortcomings of LAWs to differentiate between targets and the behavioral and psychological volatility of humans—and current and proposed regulatory infrastructures for developing and using such devices. After careful consideration of these factors, this paper will conclude that only ethical LAWs should be used to replace human involvement in war, and, by extension of their consistent abilities, should remove humans from war until a more formidable discovery is made in conducting ethical warfare. Land-based climate mitigation schemes such as REDD+ imply the creation of ‘rights to carbon’ for actions that enhance carbon sinks. In many cases, the legal and normative foundations of such rights are unclear. This article focuses on special rights on the basis of improvement. Considering improvement in relation to carbon sinks requires asking what it means to ‘improve’ an environmental resource. Our answer departs in two significant respects from the standard conception of improvement, namely by reconceiving action in (...) relation to ecosystem services, and accordingly, making the case for a counterfactual baseline to be used to compare an improved and unimproved state. Our modifications potentially allow for a variety of agents to claim special carbon rights on the basis of beneficial interactions with land-based carbon sinks. We give three archetypical examples of agents who may claim pro tanto special rights to carbon based on their interaction with carbon sinks. (shrink)

Competition for land is increasing as demand for multiple land uses and ecosystem services rises. Land regulation of the principles of landscape ecology is necessary to develop more sustainable approaches to land use planning. The research evaluated the present land patterns and determined best practices for its regulation of Dongwang Township in Quyang County, located in the Taihang Mountain area of Hebei Province, China. The research used the landscape ecology theory to construct an index system (...) for landscape pattern analysis based on the GIS and Fragstats 3.3 software. In this study, we examined the specific reasons that landscape ecology is superior to traditional methods in land consolidation planning and design, which is conducive to the comprehensive development of land ecological benefits. Landscape ecological planning can effectively reduce landscape fragmentation and improve intensive management. The result found that the descending order of the Shannon index was current landscape, landscape ecological planning, and traditional planning. Landscape ecological planning could protect the natural diversity than traditional planning. Landscape ecological planning enables the creation of long corridors, with higher densities and connectivity and lower average corridor widths than traditional planning. Besides, it can improve ecological service function values in the study area to varying degrees, thus discouraging residents from limiting themselves to grain production. This research has great potential to improve the visibility of ecosystem services in local land use planning and, thus, to improve the ecological functioning of future landscapes. (shrink)
