In recent years, a new generation of activists has reinvigorated debate over the public commemorative landscape. While this debate is in no way limited to statues, it frequently crystallizes around public representations of historical figures who expressed support for the oppression of certain groups or contributed to their past or present oppression. In this paper, I consider what should be done about such representations. A number of philosophers have articulated arguments for modifying or removing public monuments. Joanna Burch-Brown (2017) grounds (...) her argument for removal in what I call the “honorific” function of such representations—the ways in which they express and tend to cultivate admiration for their subjects. In the first two sections of the paper, I develop a novel argument for modifying these representations based on this insight. I argue that leaving such representations unmodified in the public space tends to undermine the dignity of members of oppressed groups as well as their assurance that society and government are committed to their rights and constitutional entitlements. In the paper’s third section, I develop a “balancing test” for determining whether the relevant moral and pragmatic considerations favor making a particular representation inaccessible to the public, or recontextualizing it for public consumption. Unlike some of the existing philosophical treatments of honorific representations that focus on particular monuments, this balancing test is designed for general application to any honorific representation that satisfies the presumptive case for modification. To conclude, I offer some reasons why weak forms of recontextualization that do not involve altering institutional context may often be an insufficient remedy for the problems I describe. (shrink)

Is argumentation essentially adversarial? The concept of a devil's advocate—a cooperative arguer who assumes the role of an opponent for the sake of the argument—serves as a lens to bring into clearer focus the ways that adversarial arguers can be virtuous and adversariality itself can contribute to argumentation's goals. It also shows the different ways arguments can be adversarial and the different ways that argumentation can be said to be "essentially" adversarial.

The motivational constraint on normative reasons says that a consideration is a normative reason for an agent to act only if it is logically possible for the agent to act for that reason, or at least to be moved so to act. The claim figures Zelig-like in philosophical debates about practical reasons: on hand, occasionally prominent, but never the focus of discussion. However, because it is entailed by a number of prominent views about normative reasons—including various forms of internalism and (...) some views that closely connect reasons to good practical reasoning—its truth or falsehood has important implications. Mark Schroeder (2007) and Julia Markovits (2014) have recently criticized the Motivational Constraint on the grounds of so-called “elusive reasons”: reasons for some agent to act that are such that it is logically impossible both that they are normative reasons for that agent and the agent is moved to act for those reasons. In response, a number of philosophers (Sinclair 2016; Ridge and McKeever 2012; Paakkunainen 2017) have attempted to reconcile blindspot reasons with the motivational constraint. My aim in this paper is to show that these conciliatory strategies fail to overcome the challenge posed by elusive reasons. First, I examine each strategy and argue that it unsuccessful on its own terms. Second, I adduce another type of elusive reason not heretofore discussed in the literature, and I argue that these strategies also cannot make this kind of reason consistent with the motivational constraint. Finally, I defend the existence of this kind of reason against an important objection. (shrink)

This paper reflects on the articles submitted for the Symposium Confronting the Internet’s Dark Side. I discuss some of the criticisms of the book’s theory and my treatment of hate speech. The responsibilities of Internet Service Providers and Web-Hosting Services are in the fore, arguing that as they are the gatekeepers, they need to be proactive far more than they are now. This paper, like my book, strives to suggest an approach that harnesses the strengths and capabilities of the public (...) and the private sectors in offering practical solutions to pressing problems. Perszyk has argued that Molinists cannot consistently endorse the consequence argument because of a structurally similar argument for the incompatibility of true Molinist counterfactuals of freedom and the ability to do otherwise. Wierenga has argued that on the proper understanding of CCFs, there is a relevant difference between the consequence argument and the anti-Molinist argument. I argue that, even on Wierenga’s understanding of CCFs, there is in fact no relevant difference between the two arguments. Moreover, I strengthen Perszyk’s challenge by (...) highlighting further relevant similarities between CCFs and facts about the laws. (shrink)

Suppose you can save only one of two groups of people from harm, with one person in one group, and five persons in the other group. Are you obligated to save the greater number? While common sense seems to say ‘yes’, the numbers skeptic says ‘no’. Numbers Skepticism has been partly motivated by the anti-consequentialist thought that the goods, harms and well-being of individual people do not aggregate in any morally significant way. However, even many non-consequentialists think that Numbers Skepticism (...) goes too far in rejecting the claim that you ought to save the greater number. Besides the prima facie implausibility of Numbers Skepticism, Michael Otsuka has developed an intriguing argument against this position. Otsuka argues that Numbers Skepticism, in conjunction with an independently plausible moral principle, leads to inconsistent choices regarding what ought to be done in certain circumstances. This inconsistency in turn provides us with a good reason to reject Numbers Skepticism. Kirsten Meyer offers a notable challenge to Otsuka’s argument. I argue that Meyer’s challenge can be met, and then offer my own reasons for rejecting Otsuka’s argument. In light of these criticisms, I then develop an improved, yet structurally similar argument to Otsuka’s argument. I argue for the slightly different conclusion that the view proposed by John Taurek that ‘the numbers don’t count’ leads to inconsistent choices, which in turn provides us with a good reason to reject Taurek’s position. Virtue ethics is often understood as a rival to existing consequentialist, deontological, and contractualist views. But some have disputed the position that virtue ethics is a genuine normative ethical rival. This chapter aims to crystallize the nature of this dispute by providing criteria that determine the degree to which a normative ethical theory is complete, and then investigating virtue ethics through the lens of these criteria. In doing so, it’s argued that no existing account of virtue ethics is a complete (...) normative ethical view that rivals existing consequentialist, deontological, and contractualist views. Moreover, it is argued that one of the most significant challenges facing virtue ethics consists in offering an account of the right-making features of actions, while remaining a distinctively virtue ethical view. Recent research has shown that the superlative quantifiers at least and at most do not have the same type of truth conditions as the comparative quantifiers more than and fewer than. We propose that superlative quantifiers are interpreted at the level of speech acts. We relate them to denegations of speech acts, as in I don’t promise to come, which we analyze as excluding the speech act of a promise to come. Calling such conversational acts that affect future permissible speech (...) acts “meta-speech acts,” we introduce the meta-speech act of a GRANT of a proposition as a denial to assert the negation of that proposition. Superlative quantifiers are analyzed as quantifiers over GRANTS. Thus, John petted at least three rabbits means that the minimal number n such that the speaker GRANTs the proposition that John petted n rabbits is n = 3. We formalize this interpretation in terms of commitment states and commitment spaces, and show how the truth conditions that are derived from it are partly entailed and partly conversationally implicated. We demonstrate how the theory accounts for a wide variety of distributional phenomena of superlative quantifiers, including the contexts in which they can be embedded. (shrink)

Intervening on causal systems can illuminate their underlying structures. Past work has shown that, relative to adults, young children often make intervention decisions that appear to confirm a single hypothesis rather than those that optimally discriminate alternative hypotheses. Here, we investigated how the ability to make informative causal interventions changes across development. Ninety participants between the ages of 7 and 25 completed 40 different puzzles in which they had to intervene on various causal systems to determine their underlying structures. Each (...) puzzle comprised a three‐ or four‐node computer chip with hidden wires. On each trial, participants viewed two possible arrangements of the chip's hidden wires and had to select a single node to activate. After observing the outcome of their intervention, participants selected a wire configuration and rated their confidence in their selection. We characterized participant choices with a Bayesian measurement model that indexed the extent to which participants selected nodes that would best disambiguate the two possible causal structures versus those that had high causal centrality in one of the two causal hypotheses but did not necessarily discriminate between them. Our model estimates revealed that the use of a discriminatory strategy increased through early adolescence. Further, developmental improvements in intervention strategy were related to changes in the ability to accurately judge the strength of evidence that interventions revealed, as indexed by participants' confidence in their selections. Our results suggest that improvements in causal information‐seeking extend into adolescence and may be driven by metacognitive sensitivity to the efficacy of previous interventions in discriminating competing ideas. The aim of this paper is to show that there is a genuine difficulty in Kant’s argument regarding the connection between mechanism and teleology. But this difficulty is not the one that is usually underlined. Far from consisting in a contradiction between the first and the third Critique, I argue that the genuine difficulty is intrinsic to the antinomy of reflective judgement: rather than having any hope of resolving anything, it consists in an inescapable conflict. In order to support this (...) claim, I show firstly why converting the thesis of the antinomy about mechanism into reflective judgement does not require renunciation of the universality of causality demonstrated in the first Critique. Then, I suggest that the actual difficulty with Kant’s argument is that there is a genuine conflict inherent in the reflective form of the antinomy. Finally, I examine in detail the antinomy of reflective judgement and compare it to the other Kantian antinomies in order to show that its uniqueness makes it uniquely troubling. This leads me to conclude that the Kantian resolution of the conflict between mechanism and teleology is unsatisfactory. (shrink)

Significant variations in the way objects appear across different viewing conditions pose a challenge to the view that they have some true, determinate color. This view would seem to require that we break the symmetry between multiple appearances in favor of a single variant. A wide range of philosophical and non-philosophical writers have held that the symmetry can be broken by appealing to daylight viewing conditions—that the appearances of objects in daylight have a stronger, and perhaps unique, claim to reveal (...) their true colors. In this note we argue that, whatever else its merits, this appeal to daylight is not a satisfactory answer to the problem posed by perceptual variation. (shrink)

How children seek knowledge and evaluate claims may depend on their understanding of the source of knowledge. What shifts in their understandings about why scientists might disagree and how claims about the state of the world are justified? Until about the age of 41/2, knowledge is seen as self-evident. Children believe that knowledge of reality comes directly through our senses and what others tell us. They appeal to these external sources in order to know. The attainment of Theory of Mind (...) (ToM) at this age is commonly seen as the significant shift in development in understanding disagreements in knowledge claims. Children attaining ToM understand that someone exposed to incorrect or incomplete information might have false beliefs. Disagreement, then, is still attributed to objective sources of knowledge. The current study examines the later developing Interpretive Theory of Mind (iToM) as the basis for children’s understanding of how people with access to the same information might disagree and what this means for how to provide justification for a knowledge claim. Fourteen 2nd graders with the most iToM responses to four tasks and 14 with the fewest iToM responses were selected from a larger sample of 91. In analyses of interviews about a story in which two experts make different claims about a scientific phenomenon, those in the high iToM group noted subjective perspective and processes as the source of disagreement and suggested the need for investigation as the means to knowing. In contrast, those in the low iToM group mostly could not explain the source of disagreement and held that knowledge is acquired from external sources. A comparison of the interviews regarding the science story 2 years later allows for a qualitative description of the development. Those in the low iToM group showed more general recognition of subjective and constructive processes in knowing whereas those in the high iToM group identified interpretive processes and the relativity of perspectives with implications for how observations were conducted and interpreted. Only those in the high iToM group referred to the importance of evidence as a basis for knowledge claims at either point in the study. (shrink)

This paper describes an exploratory study of corporate responsibility, corporate reputation, and stakeholder support in Norway, Sweden and Denmark—countries recognized worldwide as providing an institutional climate uniquely conducive to responsible business practice. Conducting a secondary analysis of Scandinavian data from Reputation Institute’s extensive global research on corporate reputation and responsibility, we examine four key questions: First, do Scandinavians agree with external observers that firms in their countries demonstrate superior levels of corporate responsibility? Second, relative to other reputation drivers, to what (...) extent does corporate responsibility predict corporate reputation for the countries in our dataset? Third, to what extent does corporate responsibility predict stakeholder intent in these countries to engage in supportive behavior toward the firm? Finally, are stakeholder perceptions of and responses to corporate responsibility sufficiently similar across Norway, Sweden, and Denmark to justify claims for a monolithic “Scandinavian approach” to CSR? Previous research examining the relationship of corporate responsibility to corporate reputation and stakeholder support is reviewed, analytical methods are described, results presented, and implications discussed. This study examines the impact of the level of religious observance on the attitudes toward end‐of‐life (EOL) decisions and euthanasia of Jews in Israel—where euthanasia is illegal—as compared to Jews living in the USA, in the states where euthanasia is legal. A self‐reporting questionnaire on religiosity and personal beliefs and attitudes regarding EOL care and euthanasia was distributed, using a convenience sample of 271 participants from Israel and the USA. Findings show that significant differences were found in attitudes between Jews (...) of different levels of religious observance with respect to patient autonomy, right to die with dignity, and dying in familiar and supportive surroundings. The USA and Israeli Jews have similar knowledge regarding EOL care and expressed similar attitudes and perceptions toward the issues of authority of medical staff and religious figures and patient's autonomy. Findings indicate that the level of religious observance has more potency in shaping their attitudes and perceptions of EOL decisions than the state law. We conclude by discussing the implications of our findings with regard to multicultural health systems and providing practical recommendations. (shrink)

Medical crowdfunding has raised many ethical concerns, among them that it may undermine privacy, widen health inequities, and commodify health care. One motivation for medical crowdfunding has received particular attention among ethicists. Recent studies have shown that many individuals are using crowdfunding to finance access to scientifically unsupported medical treatments. Recently, GoFundMe prohibited campaigns for antivaccination groups on the grounds that they “promote misinformation about vaccines” and for treatment at a German clinic offering unproven cancer treatments due to “the need (...) to make sure people are equipped to make well‐informed decisions.” GoFundMe has not taken any additional actions to regulate the much larger presence of campaigns seeking to fund unproven medical interventions on the platform. In this article, we make the ethical case for intervention by GoFundMe and other crowdfunding platforms. (shrink)

This short paper defends Oliver Williamson’s (1993) claim that talk of trust is ‘redundant at best and can be misleading’ when trust is defined as a form of calculated risk (p. 463). And this paper accepts Williamson’s claim that ‘Calculative trust is a contradiction in terms’ (p. 463). But the present paper defends a conception of genuine, non-calculative trust that is compatible with calculative considerations and calculative antecedents. This conception of trust creates space for genuine (non-calculative) trust relationships in the (...) economic order—in which calculative considerations and antecedents (most often) play an essential role. In this paper I articulate and defend a new anti-theodicy challenge to Skeptical Theism. More specifically, I defend the Threshold Problem according to which there is a threshold to the kinds of evils that are in principle justifiable for God to permit, and certain instances of evil are beyond that threshold. I further argue that Skeptical Theism does not have the resources to adequately rebut the Threshold Problem. I argue for this claim by drawing a distinction between a weak and (...) strong version of Skeptical Theism, such that the strong version must be defended in order to rebut the Threshold Problem. However, the skeptical theist’s appeal to our limited cognitive faculties only supports the weak version. (shrink)

The modern mastery of nature cannot guide us in knowing what to do with our new powersCwhether in war or in medicine, at the beginning of life or the end of life. This essay explores the relationship between science, ethics, and politics by looking at various controversies in health policy, especially end-of-life care and embryo research. It (...) explores how scientists sometimes defend science in the most unscientific ways, looks for common ground on the most controversial areas of science policy, and invites us to reflect more deeply and philosophically on man's relationship to and place within the natural world. This short essay argues for a thematic connection between Emmanuel Levinas’s Time and the Other and his Totality and Infinity. Time and the Other directly addresses the problem of salvation, and this concern with salvation can be traced through Totality and Infinity, where it is implicit in Levinas’s conception of desire—so there is a religious concern at the core of that (purportedly) secular work. And this thematic connection suggests a further interpretive question about the role of fecundity in both books, (...) which is addressed in the final section. (shrink)

We argue, in the spirit of some of Jean-Yves Jaffray’s work, that explicitly incorporating the information, however imprecise, available to the decision maker is relevant, feasible, and fruitful. In particular, we show that it can lead us to know whether the decision maker has wrong beliefs and whether it matters or not, that it makes it possible to better model and analyze how the decision maker takes into account new information, even when this information is not an event and finally (...) that it is crucial when attempting to identify and measure the decision maker’s attitude toward imprecise information.
