The destruction of an embryo must be justified in law. This is to prevent frivolous wastage and to show the respect afforded by the Warnock Report. For example, embryonic destruction during pregnancy is underpinned by the Abortion Act 1967, and embryonic destruction during fertility treatment is regulated by the Human Fertilisation and Embryology Act 1990. However, following the appeal decision in R v Human Fertilisation and Embryology Authority [2005] 2 A.C. 561, embryos can now be created for a bone marrow (...) tissue match to a sick sibling under the Human Fertility and Embryology Act 1990 according to the subjective desires of the mother. This opens the door to the first example of embryonic destruction on unique social-eugenic grounds with no clear lawful justification. It is argued that these embryos should be afforded a unique destruction provision under an amended version of section 1 of the Abortion Act 1967 in light of their ‘social-eugenic’ nature. This would protect the Human Fertilisation and Embryology Authority from accusations of undercover eugenic practices and reinstate the respect shown towards embryos in law. (shrink)

Its main role is to “ensure that organs donated for transplant are matched and allocated to patients in a fair and unbiased way.” NHSBT’s liver allocation policies are underpinned by the National Liver Transplant Standards, a document published by the Department of Health in 2005 to oversee patient care, patient assessment, liver allocation and transplantation, education and training, and research and development. Prolonged solitary confinement has become a widespread and standard practice in U.S. prisons—even though it consistently drives healthy prisoners insane, makes the mentally ill sicker, and, according to the testimony of prisoners, threatens to reduce life to a living death. In this profoundly important and original book, Lisa Guenther examines the death-in-life experience of solitary confinement in America from the early nineteenth century to today’s supermax prisons. Documenting how solitary confinement undermines prisoners’ sense of identity and their ability to (...) understand the world, Guenther demonstrates the real effects of forcibly isolating a person for weeks, months, or years. -/- Drawing on the testimony of prisoners and the work of philosophers and social activists from Edmund Husserl and Maurice Merleau-Ponty to Frantz Fanon and Angela Davis, the author defines solitary confinement as a kind of social death. It argues that isolation exposes the relational structure of being by showing what happens when that structure is abused—when prisoners are deprived of the concrete relations with others on which our existence as sense-making creatures depends. ABSTRACTWhile over the last few decades AI research has largely focused on building tools and applications, recent technological developments have prompted a resurgence of interest in building a genuinely intelligent artificial agent – one that has a mind in the same sense that humans and animals do. In this paper, I offer a theoretical and methodological framework for this project of investigating “artificial minded intelligence” that can help to unify existing approaches and provide new avenues for research. I first outline (...) three desiderata that a framework for AMI research should satisfy. In Section 1, I further motivate the desiderata as well as the need for a new framework. Here’s a nice, simple view. Knowing that p is the sole fundamental aim and achievement in the epistemic domain. It is a manifestation of epistemic competence, and we can metaphysically explain both the existence and the normative status of all other epistemic states in terms of knowledge and the competence it manifests. In this paper I will defend this view from a challenge from Ernest Sosa that knowledge is too weak and primitive to do the work the Simple View asks (...) it to do. He claims that we not only need knowing that p, but also reflectively knowing that p and knowing full well that p. I argue that Sosa is mistaken. Good old knowledge, what Sosa calls animal knowledge, when properly understood, can do all of the work that reflective knowledge and knowing full well are supposed to do. Knowledge, at least in the epistemic domain, is all you need. In section 1, I explain in more detail the challenge that Sosa poses for the Simple View, and consequently my direct virtue epistemology. I then explain Sosa’s accounts of reflective knowledge and knowing full well, further clarifying the debate. In sections 2, 3, and 4, I consider Sosa’s arguments that reflective knowledge and knowing full well are distinctive epistemic achievements. Section 2 addresses his argument from the epistemic evaluability of suspending belief. Section 3 addresses his arguments for the claim that a variety of cases can only be adequately accounted for by invoking these other states. Section 4 addresses his arguments about the role of reflective knowledge in rebutting dream skepticism. Responding to Sosa’s arguments also helps to clarify certain features of knowledge and epistemic competence. I conclude by reviewing these features. (shrink)

When cognitive scientists are looking for the neural basis of consciousness or the computational processes underlying vision, what are they looking to find? I argue for a new account of this explanatory project in cognitive science (and the special sciences more generally) on which it is best understood on close analogy with causal explanation in the special sciences. Causal explanations cite causal difference-makers: they explain how certain events causally depend on other events. Generative explanations cite generative difference-makers: they explain how (...) certain events obtain in virtue of (and so are generated by) other events. I show how that this generative difference-making account (GDM) extends well regarded developments in philosophical work on causal explanation, helps to usefully clarify and expands the hypothesis space of a key project in cognitive science – that of understanding how underlying nonmental processes give rise to the mental, including consciousness. In section 2, I develop GDM by close analogy with causal explanation, and locate both of them as species of a more general project in the special sciences: that of discovering what makes a difference to what. In section 3, I motivate GDM by contrasting it with other rival accounts, including correlationist, identity, and grounding accounts, as well as Carl Craver’s constitutive relevance account. In section 4, I tie all of the strands of the preceding discussion together to show how GDM provides a new and compelling response to the so-called hard problem of consciousness. (shrink)

In modern zoos, enrichment programs have become a standard part of animal care routines. Although 'higher' primates usually receive complex enrichment programs, encompassing many types of enrichment, these are less common for prosimians. These animals often largely receive food-based enrichment, as was previously the case at Auckland Zoo, where the ring-tailed lemur enrichment schedule contained only three different items, all food-related. Lemurs tend to be considered less curious and quick to learn than other primates, as well as being less manually (...) dextrous, and for these reasons can be overlooked for complex enrichment. However, they have strong sensory abilities, in particular an acute sense of smell (Sauther et al 1999). ABSTRACT. Ecological philosophy requires a significant orientation to the role of hope in both theory and practice. I trace the limited presence of hope in ecological philosophy, and outline reasons why environmental hopelessness is a threat. I articulate and problematize recent environmental publications on the topic of hope, the most important worry being that current literature fails to provide the necessary psychological grounding for hopeful action. I turn to the psychology of hope to provide direction for conceptualizing hope and actualizing (...) hoped for states of affairs. If positive moral action is the goal, hope is a vital concept for underwriting ecological philosophy and a practice requiring considerably more attention. (shrink)

I present and motivate a new solution to the generality problem for reliabilism. I suggest that we shift our focus from process-types that can be characterized independently of a subject’s epistemic concerns to process-types that play important roles in the life of the epistemic agent. Once we do so, a simple, promising solution suggests itself: the C-Typing Thesis. According to the C-Typing Thesis, how an epistemic agent forms her degree of confidence in a believed proposition determines the epistemically relevant type (...) of belief-forming process for that belief. First I motivate this view generally, arguing that it satisfies important desiderata for a solution to the generality problem. Then I show that it makes the intuitively correct predictions for a wide range of cases. I also show how it can solve Brian Weatherson’s temporal generality problem, and, relatedly, Jonathan Vogel’s bootstrapping problem for reliabilism. The C-Typing Thesis is plausible not only because it makes correct predictions, but also because it does so in a way that responds to a common charge against reliabilism: that reliability is disconnected from our lives as epistemic inquirers. The C-Typing Thesis shows how epistemic agency can play a significant role in an externalist account of justification and knowledge. (shrink)

In discussions concerning intersubjectivity the notion of expression has come to play a part of increasing significance. Expression shifts our point of departure away from subjectivity as something mysterious hidden within the body to subjectivity as altogether embodied and embedded in the world. In this article I engage writings by Maurice Merleau-Ponty to argue that expression is essentially something that happens in a communicative space in between self and other while at the same time giving rise to both. I show (...) how locating expression in a shared space between self and other is a way of emphasizing that self and other are not only expressive of selfhood, but are also expressed by one another and emerge in relation to one another. I point to this understanding of expression as a way of recognizing that there is both a fundamental reciprocity and asymmetry between self and other. (shrink)

Environmental action is often taken when one is affected negatively in direct and concrete ways. It is therefore unfortunate that populations with the most fiscal and political power have the greatest ability to avoid the sorts of environmental harm that pragmatically necessitate an immediate and comprehensive response. This introduction to the special issue on “Medicine, Health, and Publics” argues that a rhetorical understanding of publics offers conceptual, methodological, and practical benefits to health and medical humanities scholars.

This commentary responds to Moti Gorin's article “What Is the Aim of Pediatric ‘Gender‐Affirming’ Care?” We argue that Gorin's case against pediatric gender‐affirming care rests upon numerous false conceptual binaries: female/male, public/private, objective/subjective, and medically necessary/elective. Drawing on feminist bioethics, we show how such dichotomous thinking is both inaccurate and marginalizing of gender minorities.

It used to seem that these [End Page 86] statements were at odds with one another. Now I'm on a mission to integrate the two.I'm married to a man who's also Jewish. In the late 1980s, we had two sons, whose circumcisions I agreed to. Brit (...) milah (the covenant of circumcision) is intended as a spiritually meaningful act symbolizing the agreement between God and the Jewish people. But for me, the experience was so upsetting that I didn't feel God's presence. In spite of all the arguments in favor—the weight of tradition, wanting my boys to be accepted in the Jewish world, and so on—I came to regret my acquiescence.I began to explore reasons to question circumcision from a Jewish point of view, publishing articles in Jewish magazines and speaking at conferences. Rather than focusing on the medical pros and cons, I wrote about Jewish law and ethics, and spoke with many rabbis. I was hoping to deepen Jewish dialogue on this topic, which was oddly off-limits in a culture that values intellectual inquiry.Besides helping me understand more about Judaism, my research and writing was a way of living with my guilt. I had succumbed to—and put my boys through—a tradition that went completely against my maternal instincts. This schism had made me doubt myself as a new mother. What kind of parent was I if I couldn't be a fierce protector of my newborn baby? It was not a positive or welcoming way for me to enter into motherhood.I blamed myself. I hadn't done medical research before my boys were born, trusting instead in the longevity of the tradition and the claim that circumcision is more hygienic. I bought into the medical justifications for circumcision—all of which, I later learned, fail to acknowledge the erogenous nature of foreskin tissue and its physiological function. If I'd known more; if I'd thought more deeply about infant trauma; if I'd taken my own spirituality more seriously—I would have fought for a different outcome, despite the pressure I felt as a Jewish person.Years went by. I wrote a novel about Jewish circumcision, then co-wrote a book of alternative bris ceremonies for families opting out of circumcision. Slowly, I came to understand that blaming myself for agreeing to circumcise my sons was not only a waste of time, but also missed the larger point. I'm not alone in my objections to this ancient tradition. Indeed, many Jewish parents get through the event with white knuckles, emotional detachment, alcohol, or sedatives rather than with genuine religious feeling. Shouldn't their spiritual authenticity matter? Shouldn't mine have mattered?In Judaism, every commandment (of which circumcision is one) should be approached with kavanah, or spiritual intent. Thus, my non-spiritual feelings about the circumcision tradition are problematic from a Jewish point of view. I should have been able to tell the rabbi I didn't really believe circumcision was what God wanted me to do. I wish I'd been guided in coming to a decision that reflected my actual spirituality. Instead, all that seemed to matter to anyone was getting the deed done.Going against my instincts and spirituality was not just my failing—it also represented an institutional failing. Western analytic epistemology is undergoing an upheaval: the importance of social justice concerns is becoming increasingly recognized. Many of us want epistemology to reflect our lived experiences, and to do real work for us on issues that matter. Motivated by these concerns, researchers are increasingly focusing on ameliorating our epistemic concepts: finding ones that contribute to social justice. At the same time, however, many epistemologists claim that their project is purely metaphysical and thus value-neutral: epistemology is just about the truth, (...) the facts! Ethics and politics thus have no place in epistemology proper. I will argue that, despite appearances to the contrary, these ameliorative and objectivist projects are not in conflict. Indeed, because the same concepts are our tools for both theoretical and practical reasoning, properly carrying out either project must be done in an integrated way with the other. I’ll use the example of medical research to show how social justice concerns can deeply influence scientific practice in ways that contribute to, rather than threaten, its claims to objectivity. I then develop an integrative epistemology on analogy with medical research to resolve both longstanding philosophical disputes and support our understanding and healing of public discourse. Safer sex has emerged as a collection of practices and ideas deployed to combat the spread of AIDS. Prevention messages and rituals of safer sex each rely on constructing a potential user's relationship to latex devices. This article is based on an analysis of twenty-seven interviews conducted with people in the sex trade. Since sex workers make it their business to exchange sexual services for economic compensation, many have become extremely sophisticated in their innovations and expressions of eroticism using safer (...) sex techniques. Sex workers are one of a group of key knowledge producers focused on safer sexual practices. Their worlds are metaphoric laboratories for empiri cal studies of emergent sexual practices. Sexual and reproductive health is a challenge worldwide, and much progress is needed to reach the relevant UN Sustainable Development Goals. This paper presents cross-sectional data collected in Sierra Leone on sexual and gender-based violence, family planning, child, early and forced marriage, and female genital mutilation using an innovative method of measurement: situational judgment tests, as a subset of questions within a larger survey tool. For the SJTs, respondents saw hypothetical scenarios on these themes and had to indicate how they (...) would react. The objective is to give an impression of beliefs and norms on specific behaviors, which provide insights for social and behavior change interventions. Data was collected by enumerators traveling to villages randomly selected in six districts of the country. The sample is composed of 566 respondents. Results show that FGM in particular seem to be a priority topic, in comparison to the other topics for which the norms seem to be stronger against those practices. Age differences emerged and suggest priority groups to be targeted. In terms of validity of the measurement methods, situational judgment test answers correlated positively with other items in the survey, but the magnitude of the association is often small, and sometimes not significant. Thus, more studies are needed to further explore the validity of this measure by comparing against a reference value. Using SJTs could complement other data collection tools to perform community assessment, and orient the direction of the program in its planning phase. (shrink)

Evolutionary theory guides an investigation of foster parent selection in two northern Thai villages with different biosocial environments: one village has high levels of labour migration and divorce, and growing numbers of parental death due to HIV/AIDS, while the other village has lower migration, divorce and parental mortality levels. Focus groups examine mothers motivations and ideals regarding foster caretaker selection, and quantitative family surveys examine real fostering outcomes: specifically, the laterality (matrilateral versus patrilateral) and genetic distance of the foster caretakers (...) of all ever-fostered children in these two villages. As predicted, in environments of high marital stability and paternity certainty, parents seem to prefer close genetic kin from either side as foster parents for their children. In low marital stability and paternity certainty environments, parents trust their own lateral kin, regardless of genetic distance, over close genetic kin from the other side. The striking exception to this pattern, however, occurs in the case of parental death, in which case children are fostered to the deceased parents sex or other factors. In general, the foster parents for girls are selected with more care, reflecting the daughter/female preference expected in traditionally matrilineal, matrilocal societies. An ordered decision-making pathway for foster parent selection is proposed, taking into consideration the key factors of (a) the circumstances driving the fostering decision, (b) the gender of the child, (c) the gender of the key decision-making parent, and (d) the degree of marital and population fluidity (and subsequent paternity certainty) in the village. Lucretia Mott is widely recognized as a moral and spiritual leader in the abolitionist and early women’s rights movements. She has been characterized as a disciple of William Lloyd Garrison, a proliferator of Mary Wollstonecraft’s ideas, and a religious promoter of human rights whose efforts were surpassed by the theoretically sophisticated and politically astute Elizabeth Cady Stanton. These portrayals paradoxically elevate Mott’s status while understating the originality of her views. This analysis examines Mott’s speeches and writings in detail and finds (...) that her unique theoretical contributions are shaped by a combination of elements: a radically anti-dogmatic worldview rooted in her progressive religious faith, an unwavering commitment to autonomy for all people, and an egalitarian conception of power. Careful study of Mott’s work reveals a compelling alternative viewpoint in the early women’s rights and abolitionist movements and provides important insight into the philosophical roots of contemporary feminism and pacifism. The third part explores what might constitute moral consistency for the Makah and what might constitute moral consistency for the larger community.

Synthetic genomics is a new field of research in which small DNA pieces are assembled in a series of steps into whole genomes. The highly reduced genomes of host‐associated bacteria are now being used as models for de novo synthesis of small genomes in the laboratory. Bacteria with the smallest genomes identified in nature provide nutrients to their hosts, such as amino acids, co‐factors and vitamins. Comparative genomics of these bacteria enables predictions to be made about the gene sets required (...) for core cellular functions and the associated metabolic network for the biosynthesis of host‐selected compounds. Synthetic biology may ultimately enable researchers to make customized cell‐specific organelles for the production and delivery of drugs to humans and domestic animals. Synthetic genomics may also become the method of choice for functional analyses of genes and genomes from bacteria that cannot be cultivated in the laboratory. (shrink)

In his writings on the gaze and the body in Being and Nothingness , Jean-Paul Sartre describes the ways in which bodies are exposed and vulnerable to the anonymous gaze of the other, and how they in the midst of their vulnerability depend entirely on being seen by the gaze for their meaning and their very being. Although it sometimes appears as quite depressingly restrictive, Sartre’s analysis of the gaze and his account of the body offer rich and important resources (...) for recognizing the force of objectifying categories and meanings in the constitution of identities. This article suggests that Sartre’s almost remorseless descriptions of how the body is molded by the gaze of the other provide a productive point of departure for understanding the becoming of singular identities, as they are lived on the margins and in the intersections of established categories which determine them in often oppressive ways. Being marked by difference, whether sexual, ethnic, racial, or other, is in many ways being trapped by the objectifying gaze of the other in such a way that the ability to return the gaze and claim a subject position is deeply circumscribed. The article gives an account of Sartre’s analysis of the phenomenon of the gaze as the force which objectifies me before the other and of his description of the body as it is subjectively experienced as objectified. This “third ontological dimension of the body” captures the tensions inherent in subjectivity and brings to light its perpetual exposure to its own unknown exterior as it is seen and constituted by the other. Butler argues that recognition of the constitutive vulnerability of human existence provides the condition of possibility through which we (...) can respond to an ethical “appeal” or “call” for nonviolence (Butler 2009, 165, 170). This recent work carries on the feminist theoretical tradition of theorizing nonviolence via an attention to human vulnerability that has been strongly present in feminist care ethics (Held 2006; Kittay 1999; Ruddick 1989; Noddings 1984; Gilligan 1982). However, rather than turning to the care ethicists to think through the ethical relationship between vulnerability and violence, Butler produces an innovative feminist ethics by turning to a variety of thinkers in continental philosophy and psychoanalysis, such as Hegel, Freud, Cavarero, and especially Levinas. Butler’s recent discussion of the ethical import of human vulnerability therefore extends a long-standing feminist tradition of arguing for nonviolence while also helping to expand the theoretical resources feminists have used for this task.This article places Butler’s recent ethical focus on nonviolence1 in conversation with Simone de Beauvoir’s earlier existentialist feminist ethical writings2 [End Page 145] concerning the ethico-political import of violence. Together, these two thinkers reorient the dominant feminist conversation about violence away from an emphasis on women’s violent and oppressive victimization and toward an idea of gendered actors who are simultaneously ethically enabled and constrained by the bodily, historical, and political situations out of which they act. Ultimately, however, Beauvoir’s argument that ethics are always deeply contextual and are thus normatively ambiguous is a preferable feminist alternative to Butler’s attempt to delineate a specifically nonviolent ethics. This is because Beauvoir gives thorough attention to contexts of oppression as a major mitigating factor that shapes our ethical possibilities.For Beauvoir, there is no guarantee that a nonviolent response to vulnerability is a priori the most ethical response. Beauvoir does not insist on a nonviolent ethics because the ethicality of violence must be derived from within the embodied situations out of which people are acting. Ethicality cannot be determined prior to, or outside of, the lived contexts in which people are situated. Beauvoir’s ethics remind contemporary feminist theorists that both vulnerability, and responses to vulnerability, whether violent or nonviolent, are always contextually mediated by the forces of history, politics, and circumstance. This reminder is essential if we do not wish feminist ethical claims to override the feminist political goal of lessening oppression. Beauvoir’s attention to contextual specificity shows us that our possible responses to vulnerability are ethically ambiguous in the sense that no normative claim about how one ought to respond to human vulnerability, taken in the abstract, can be elucidated without the risk of making our ethics potentially oppressive.By returning to Beauvoir’s ethics, especially Beauvoir’s attention to oppression and freedom, the discussion here is meant to echo the concerns of a growing number of contemporary feminist theorists who express hesitation about the recent “turn” to vulnerability in feminist theory (Bergoffen 2001; Butler 2004, 2005, 2009; Fineman 2008; Oliver 2008)3 and more generally about moral claims that are made in the name of feminism (Murphy 2009; Dean 2008; Halley 2008; Mills 2007; Brown 1995). In addition, the emphasis on Beauvoir’s ethics here is meant to help return the contemporary feminist discussion of violence toward a more general emphasis on the importance of thinking about freedom as a primary feminist concern (Zerilli 2005; Willett 2001, 1995). Beauvoir’s ethics demonstrate that the ethicality of our responses to vulnerability cannot be judged without a thorough attention to the ethical freedom4 of oppressed ethical actors.Feminist ethicists have tended to undervalue attention to specific historico-political contexts in their discussions of violence as they develop normative arguments against violence.
