Increasingly organizations have dedicated systems and personnel (recipients) to receive and handle internal whistleblower reports. Yet, the complexity of handling whistleblower reports is often underestimated, and there is a dearth of literature that attempts to describe or analyse the challenges internal recipients face. This paper uses an agency theory inspired lens to provide insight into the complexity of internal whistleblowing, with the aim to identify focal points for improving internal whistleblowing processes. We conceive of internal recipients as agents of two (...) principals in the event of whistleblowing: owner/top management as well as whistleblowers. We identify sources of agency problems and agency costs within these double-agent relationships. We provide avenues for solving these problems and reducing the agency costs. Whistleblowing is the most effective way to unveil wrongdoings. Indeed, whistleblowers often protect their organizations by providing crucial information. While existing research about whistleblowing focuses on the intentions of whistleblowers to report a wrongdoing _after_ a wrongdoing is observed, we seek to understand how individuals view whistleblowing _before_ a wrongdoing is observed. Drawing on self-determination theory our findings of 34 interviews at diverse Canadian nonprofit organizations support our framework and highlight that when a congruence of shared values exists, trust functions (...) as a core belief of the organization, which positively influences an autonomous view of whistleblowing. Based on our findings, we propose a conceptualization of whistleblowing mindset as the root of whistleblowing behaviours that can be influenced by shared or divergent values. We define a whistleblowing mindset as a mental disposition that predetermines individual interpretations and reactions to the witness of a wrongdoing. Our research contributes to the literature by establishing the importance of the whistleblowing mindset in the implementation of whistleblowing programs and providing insights into how shared values can influence the autonomous view in individuals’ whistleblowing mindsets. In view of recent studies that identified certain interest groups as potential whistleblowers, we propose an integrative conceptual framework to examine whistleblower behavior by whistleblower type. The framework, dubbed the whistleblowing triangle, is modeled on the fraud triangle and is comprised of three factors that condition the act of whistleblowing: pressure, opportunity, and rationalization. For a rich examination, we use a qualitative research framework to analyze 11 whistleblowing cases of corporate financial statement fraud in Canada that were publicly denounced between (...) 1995 and 2012. Our analysis indicates that whistleblowers are not only insiders but also outsiders [financial analysts, auditing firms, journalists, politicians, customers, and investors]. It also suggests that a dynamic relation may exist between whistleblowers. In addition, our findings show that most whistleblowers opt for external channels when they fail to receive an adequate response from management, seek media exposure, are interested in financial benefits resulting from the act of whistleblowing, or are interested in protecting their investment. Lastly, we propose categorizing whistleblowers into four conceptual types: protective, skeptical, role-prescribed, and self-interested. (shrink)

Plausibly, you should believe what your total evidence supports. But cases of misleading higher-order evidence—evidence about what your evidence supports—present a challenge to this thought. In such cases, taking both first-order and higher-order evidence at face value leads to a seemingly irrational incoherence between one’s first-order and higher-order attitudes: you will believe P, but also believe that your evidence doesn’t support P. To avoid sanctioning tension between epistemic levels, some authors have abandoned the thought that both first-order and higher-order evidence (...) have rational bearing. This sacrifice is both costly and unnecessary. We propose a principle, Evidential Calibration, which requires rational agents to accommodate first-order evidence correctly, while allowing rational uncertainty about what to believe. At the same time, it rules out irrational tensions between epistemic levels. We show that while there are serious problems for some views on which we can rationally believe, “P, but my evidence doesn’t support P”, Evidential Calibration avoids these problems. An important upshot of our discussion is a new way to think about the relationship between epistemic levels: why first-order and higher-order attitudes should generally be aligned, and why it is sometimes—though not always—problematic when they diverge. To have moral worth an action not only needs to conform to the correct normative theory ; it also needs to be motivated in the right way. I argue that morally worthy actions are motivated by the rightness of the action; they are motivated by an agent's concern for doing what's right and her knowledge that her action is morally right. Call this the Rightness Condition. On the Rightness Condition moral motivation involves both a conative and a cognitive element—in particular, (...) it involves moral knowledge. I argue that the Rightness Condition is both necessary and sufficient for moral worth. I also argue that the Rightness Condition gives us an attractive account of actions performed under imperfect epistemic circumstances: by agents who rely on moral testimony or by those who, like Huckleberry Finn, have false moral convictions. What is the relationship between understanding and knowing? This paper offers a defence of reductionism about understanding: the view that instances of understanding reduce to instances of knowing. I argue that knowing is both necessary and sufficient for understanding. I then outline some advantages of reductionism.

This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

Nowy wiek osobowości. Próba psychologii współczesnej, przełożony i opracowany przez Wiktora Dłuskiego. W tekście tym Gauchet stawia tezę o mającej miejsce we współczesnym świecie rewolucji antropologicznej, polegającej na (...) zmianie roli rodziny ze wspólnoty ustanawiającej i podtrzymującej więzi społeczne na grupę społeczną niemającą wpływu na kształt życia społecznego. Przybliżenie sylwetki Gaucheta wydaje się niezbędne, albowiem jego myśl stanowi ważki i godny uwagi głos w dyskusji nad stanem współczesnej polityki oraz świata. -/- W niniejszym artykule skupię się na dwóch poruszonych przez Gaucheta zagadnieniach. The question “what is an interpretation?” is often intertwined with the perhaps even harder question “what is a scientific theory?”. Given this proximity, we try to clarify the first question to acquire some ground for the latter. The quarrel between the syntactic and semantic conceptions of scientific theories occupied a large part of the scenario of the philosophy of science in the 20th century. For many authors, one of the two currents needed to be victorious. We endorse that such debate, (...) at least in the terms commonly expressed, can be misleading. We argue that the traditional notion of “interpretation” within the syntax/semantic debate is not the same as that of the debate concerning the interpretation of quantum mechanics. As much as the term is the same, the term “interpretation” as employed in quantum mechanics has its meaning beyond (pure) logic. Our main focus here lies on the formal aspects of the solutions to the measurement problem. There are many versions of quantum theory, many of them incompatible with each other. In order to encompass a wider variety of approaches to quantum theory, we propose a different one with an emphasis on pure formalism. This perspective has the intent of elucidating the role of each so-called “interpretation” of quantum mechanics, as well as the precise origin of the need to interpret it. (shrink)

This thesis inquires what it means to interpret non-relativistic quantum mechanics (QM), and the philosophical limits of this interpretation. In pursuit of a scientific-realist stance, a metametaphysical method is expanded and applied to evaluate rival interpretations of QM, based on the conceptual distinction between ontology and metaphysics, for objective theory choice in metaphysical discussions relating to QM. Three cases are examined, in which this metametaphysical method succeeds in indicating what are the wrong alternatives to interpret QM in metaphysical terms. The (...) first two cases failed in doing so due to different kinds of underdetermination. In the third case, unlike underdetermination, where there are many choices to be made, a “null-determination” is proposed where there may be no metaphysical choices in the available metaphysical literature. ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. When you don’t know what to do, you’d better find out. Sometimes the best way to find out is to ask for advice. And when you don’t know what the right thing to do is, it’s sometimes good to rely on moral advice. This straightforward thought spells serious trouble for a popular and widespread approach to moral worth: on this approach, agents deserve moral praise for a right action only if they are acting on right-making reasons. The first part of (...) this paper argues that cases of moral advice present right-making reasons accounts with a dilemma: depending on how we make the right-making relation precise, we either have to deny that agents who seek out and follow moral advice are morally praiseworthy or we have to credit morally wrong actions by unsavory characters with moral worth. This casts doubt on the claim that acting on right-making reasons can be both necessary or sufficient for moral worth. The second half of the paper explores an alternative proposal: what’s required for moral worth is moral knowledge. This idea has been unpopular in recent literature. The sphere of disability can be treated nowadays from different perspectives that answer to multidimensional of this embodied reality. In this context, a privileged area of reflection is constituted by ethics and, inside of this, as this text propose, the prism of the reciprocal recognition. To achieve this, this present article is structured in two parts. The first, regarding to the understanding of disability from different models. The second, according to the recognition perspective approach of Honneth, and its link with (...) the disability, presents the three stages of recognition with their corresponding ways of disdain. Therefore, it is necessary to describe the potential of such works to deliver knowledge about the transcendent world, which could be significant for the listeners. The aim of this article is to show theses made by scholars as regards radio documentaries. Researchers’ analyses are related to the genre’s potential possibilities of to broaden people’s minds and influence the recipient’s perception.

The empirical, practical, ethical, and conceptual issues that Pardo and Patterson seek to redress will deeply influence how we negotiate and implement the fruits of neuroscience in law and policy in the future.

Phylogeography, a relatively new subdicipline of evolutionary biology that attempts to unify the fields of phylogenetics and population biology in an explicit geographical context, has hosted in recent years a highly polarized debate related to the purported benefits and limitations that qualitative versus quantitative methods might contribute or impose on inferential processes in evolutionary biology. Here we present a friendly, non-technical introduction to the conflicting methods underlying the controversy, and exemplify it with a balanced selection of quotes from the primary (...) biological literature, to invite the philosophy of biology community to pay attention to the elements that have played a primary role in its presumed resolution. We also present the basic features of our own metascientific take on the debate, and point out—as a preliminary step in preparation for upcoming, more detailed treatments—the importance that appeals to authority in fields external to phylogeography per se have played in the current status of this highly visible evolutionary biology dispute. In recent years, there has been an increase in the establishment of biobanks for genetic and genomic studies around the globe. One example of this is the Human Heredity and Health in Africa Initiative (H3Africa), which has established biobanks in the sub‐region to facilitate future indigenous genomic studies. The concept of ‘broad consent’ has been proposed as a mechanism to enable potential research participants in biobanks to give permission for their samples to be used in future research studies. However, questions (...) remain about the acceptability of this model of consent. Drawing on findings from empirical research about the role of trust in decision‐making, we argue that an account of entrustment may be an appropriate way of addressing current challenges of seeking consent for biobank research in Africa. We are frequently confronted with moral situations that are unsettling, confusing, disorienting. We try to come to grips with them. When we do so, we engage in a distinctive type of moral inquiry: hermeneutical inquiry. Its aim is to make sense of our situation. What is it to make sense of one's situation? Hermeneutical inquiry is part of our everyday moral experience. Understanding its nature and its place in moral epistemology is important. Yet, I argue, that existing accounts of moral (...) inquiry do not give us the resources to do so. This paper develops a positive account of hermeneutical inquiry. I argue that when we engage in hermeneutical inquiry, we search for an apt perspective on our situation. (shrink)

According to a particular interpretation of quantum mechanics, the causal role of human consciousness in the measuring process is called upon to solve a foundational problem called the “measurement problem.” Traditionally, this interpretation is tied up with the metaphysics of substance dualism. As such, this interpretation of quantum mechanics inherits the dualist’s mind-body problem. Our working hypothesis is that a process-based approach to the consciousness causes collapse interpretation (CCCI) ---leaning on Whitehead’s solution to the mind-body problem--- offers a better metaphysical (...) understanding of consciousness and its role in interpreting quantum mechanics. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual conditionals that can exhibit different degrees of contingency. We use the idea of possible worlds to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, it is this structure what helps explain why idealizations, despite being deformations of reality, are so successful (...) in scientific practice. (shrink)

Abstract: This essay examines two interpretations of Kant's argument for the formula of humanity. Christine M. Korsgaard defends a constructivist reading of Kant's argument, maintaining that humans must view themselves as having absolute value because their power for rational choice confers value on their ends. Allen Wood, however, defends a realist interpretation of Kant's argument, maintaining that humans actually are absolutely valuable and that their choices do not confer value but rather reflect their understanding of how the objects of their (...) choices fulfill their needs and wants and contribute to their flourishing. Though Korsgaard's reading is more consistent with Kant's prioritizing of the right over the good, this essay raises a metaethical question regarding her constructivist position, namely, “What is meant by her claim that rational choice ‘confers’ value on objects?” In developing this question, it presents a realist account of goodness that is taken from Peter Geach's “Good and Evil.”. A través del camino hacia los “pensadores del inicio”, distinguir el horizonte de cuestionamiento del diálogo de Platón de aquel del Poema de Parménides, nos llevará (...) a su vez a señalar los diversos sentidos en que Heidegger piensa lo mismo en el Poema de Parménides. Este artículo presenta los fonemas segmentales del mapudungun hablado en Icalma y un perfil fonético-fonológico de parte importante del cordón cordillerano de habla pewenche. El marco de referencia utilizado es el descriptivismo norteamericano, cuyas propuestas provienen de Pike y se actualizan en los trabajos de Burquest y Salamanca, Cifuentes y Figueroa. El instrumento utilizado fue una lista léxica de 108 ítems y la cantidad de colaboradores entrevistados fue de nueve. Con respecto a la descripción fonético-fonológica del mapudungun hablado en la (...) zona, destacan los siguientes resultados: a) predominan las realizaciones fricativas áfonas [ f ] y [ θ ]; b) los fonos interdentales [ t̟ ], [ n̟ ] y [ l̟ ], y el fono fricativo velar [ ɣ ], tienen estatus fonémico; y c) el fono [ ʃ ] no ocurre en la zona. Por otra parte, si se compara el mapudungun hablado en Icalma con el de Alto Bío-Bío, Lonquimay y Curarrehue, se aprecia, en general, una mayor afinidad con el mapudungun hablado en esta última zona. La utilización de las nociones de “conservador” y “progresista” en las ciencias sociales (y en la opinión pública) ha llegado a configurar dos ideologías políticas. En este número se tratan, a partir de Kant, diversos sentidos de tales nociones en el contexto actual: la perspectiva de la Economía constitucional de Buchanan, la concepción de la sociedad abierta de Popper, la teoría de la justicia de Rawls y la concepción filosófica de la vida social y política de Ortega y Gasset.

La caracterización tradicional del Artículo de Investigación como un texto especializado en el que se comunican los resultados de una investigación con un lenguaje neutro, preciso y económico no da cuenta del hecho de que escribir y publicar un Artículo de Investigación es siempre una acción estratégico–persuasiva. En este trabajo presentamos un modelo empíricamente fundado del Posicionamiento Estratégico del Autor en Artículos de Investigación, modelo que rescata el carácter persuasivo de este género. Esta propuesta ha sido obtenida a partir de (...) una investigación de tipo inductivo- deductivo, en la que analizamos 182 Artículos de Investigación de cinco áreas de la ciencia, escritos entre 2010 y 2014 por autores con distintos niveles de experticia. El modelo fue validado exitosamente en distintas etapas y por diversos expertos disciplinares chilenos y extranjeros. En términos discursivos, el Posicionamiento Estratégico del Autor requiere de al menos de una de las siguientes funciones discursivas generales: valorar positivamente lo propio y negativamente lo ajeno. Estas dos macrofunciones se cristalizan en tres tipos de estrategias, que reflejan tres espacios simbólicos que sustentan la actividad científica: el del conocimiento, el del investigador y el del texto. La noción propuesta tiene la fortaleza de estar empíricamente fundamentada y de tener un alto potencial para la alfabetización científica. (shrink)

Hegel no escribió nada específico sobre educación; sin embargo, dispersos en su obra se encuentran ideas y comentarios acerca de la educación o incluso de la pedagogía de su tiempo. Algunos de sus comentarios están conectados con el concepto clave de "formación" (Bildung). Hegel entiende el camino de la conciencia, de la experiencia sensible al saber absoluto, como un tipo de formación. Este camino impone ciertas restricciones de carácter pedagógico.
