I argue that the conception of acceptance proposed by writers like LJ Cohen, according to which it can be independent from belief, is incorrect. The results are appied to the issue of believing as will according to Van Fraassen's conception of "reflection".

A central feature of ordinary moral thought is that moral judgment is mind-independent in the following sense: judging something to be morally wrong does not thereby make it morally wrong. To deny this would be to accept a form of subjectivism. Neil Sinclair (2008) makes a novel attempt to show how expressivism is simultaneously committed to (1) an understanding of moral judgments as expressions of attitudes and (2) the rejection of subjectivism. In this paper, I discuss Sinclair’s defense of (...) anti-subjectivist moral mind-independence on behalf of the expressivist, and I argue that the account does not fully succeed. An examination of why it does not is instructive, and it reveals a fundamental dilemma for the expressivist. I offer a suggestion for how the expressivist might respond to the dilemma and so uphold Sinclair’s defense. (shrink)

Traditionally, independence accounts of substance have held pride of place. Aristotle, Aquinas, Descartes and Spinoza—among many others—accepted independence accounts in one form or another. The general thrust of such views is that substances are those things that are apt to exist in themselves. In this paper, I argue that several contemporary independence theories of substance—including those of Kit Fine, E.J. Lowe and Michael Gorman—include an ad hoc element that renders them unacceptable. I'll also consider the theories of Hoffman and Rosenkrantz.

We often use the same word “belief” to refer to two different cognitive attitudes. Both of them are dispositions to behave in the same way, but one of these dispositions is involuntary and context independent , while the other one is voluntary and context dependent . Belief, like perception, is the result of the automatic workings of our biological cognitive apparatus. Acceptance is the result of a decision, which can be guided by a variety of goals. Acceptance can be (...) accompanied by belief, but need not, and very often is not. Acceptance, not belief, is the fundamental disposition in such varied fields as therapy, the law and science. And acceptance, not belief, is the proper object of a theory of rationality. (shrink)

The notion of mind‐independence plays a central role in the contemporary realism/anti‐realism debate, but the notion is severely ambiguous and consequently the source of considerable misunderstanding. In this paper, four kinds of mind‐independence are distinguished: ontological, causal, structural, and individuative independence. Appreciating these distinctions entails that one can reject the individuative independence of the natural world, and still maintain that the natural world is causally and structurally independent of us. This paper argues that so‐called anti‐realists, especially Rorty, Putnam, and (...) Goodman, are not opposed to the causal and structural independence of the natural world, as is frequently alleged, but rather its individuative independence. An acceptance of these points will hopefully put an end to the prevalence of strawmen in the debate, and focus attention on meatier issues. (shrink)

The fundamental freedoms of speech, conscience, privacy, and religion are now an essential part of the fabric of contemporary society, set down in our most basic laws and regularly invoked in our political and cultural debates. These freedoms play a vital role in securing the spaces and opportunities within which people are able to pursue their own lives in their own ways. Independence of Mind takes this accepted thought a step further, by exploring the ways in which the fundamental freedoms (...) help us to achieve something even more profound, by enabling us to arrive at beliefs, convictions and voices of our own, so that we truly come to think, believe and speak for ourselves in the rich and various ways that the freedoms then protect. Privacy grants us the distance and refuge from others necessary to develop views of our own; freedom of speech calls on us to imagine ways of expressing ourselves that are both true to the views we have developed and innovative in their own right; freedom of conscience enables each of us to create a distinctive rational personality in which to embed the convictions that we wish to treat as non-negotiable; freedom of religion allows groups of us to endorse certain beliefs as articles of faith, free from the full demands of rational scrutiny. Much has been written about the political and legal implications of the fundamental freedoms and their entrenchment in bills of rights. This is the first book to undertake a comprehensive philosophical examination of their moral bases. BackgroundThe brain death standard allowing a declaration of death based on neurological criteria is legally endorsed and routinely practiced in the West but not in Asia. In China, attempts to legalize the brain death standard have occurred several times without success. Cultural, religious, and philosophical factors have been proposed to explain this difference, but there is a lack of empirical studies to support this hypothesis.Methods476 medical providers from three academic hospitals in Hunan, China, completed a selfadministered survey including a 12-question (...) brain death clinical knowledge assessment and hypothetical vignettes describing brain dead patients.ResultsThe response rate was 95.2 %. Almost all of the providers had heard of the term “brain death.” More than half have encountered presumed brain dead patients. Two-thirds accepted brain death as an ethical standard to determine human death. The mean knowledge score was 8.50 ± 1.83 out of 12. When given the description of a brain dead patient, 50.7 % considered the patient dead, 51.9 % would withdraw life support, and 40.6 % would allow organ procurement. Both provider and patient characteristics contributed to the providers’ decisions. Ethical acceptance was the most important independent predictor for brain death acknowledgement, followed by high knowledge scores, and the belief that the soul lives in the brain. Religious faith and associated beliefs did not have a significant effect.ConclusionsNotwithstanding scarce official accounts, recognition of the brain death standard is not uncommon in China. Chinese medical providers can adequately define the medical characteristics of brain death and accept it in theory, but hesitate to apply it to practice in the vignettes. Legalization is paramount in providing the protection providers need to comfortably declare brain death. However the medical decision-making surrounding brain death is complex and the provider's past experiences and emotions may also influence the process. (shrink)

Rest's hypothesis that the components of morality (i.e., sensitivity, reasoning, motivation, and implementation) are distinct from one another was tested using evidence from a dental ethics curriculum that uses well-validated measures of each component. Archival data from five cohorts (n = 385) included the following: (1) transcribed responses to a measure of ethical sensitivity collected at the end of the third year; (2) pre- and post-test moral judgment scores; (3) pre- and post-test motivation scores; and (4) implementation scores – performance (...) on eight cases completed during the third and fourth years. Because the ethical sensitivity test had been scored by multiple raters, and interrater reliability did not meet acceptable standards, 120 portfolios were randomly selected from the five cohorts and responses were rescored prior to analysis. Correlations among the measures were low, ranging from −.08 to.34, supporting Rest's contention that the processes are distinct from one another and competence in one does not predict competence in another. Educational neutrality states that decisions about school curricula and instruction should be made independently of particular comprehensive doctrines. Many political philosophers of education reject this view in favor of some non-neutral alternative. Contrary to what one might expect, some prominent liberal neutralists have also rejected this view in parts of their work. This paper has two purposes. The first part of the paper concerns the relationship between liberal neutrality and educational neutrality. I examine arguments by Rawls and Nagel and argue (...) that some of the same arguments they use to justify liberal neutrality also justify educational neutrality; thus, if we accept these arguments for liberal neutrality, we should also accept educational neutrality. The second part of the paper defends educational neutrality against objections that it is impossible and objections that it is undesirable. (shrink)

The Humean argument concerning miracles says that one should always think it more likely that anyone who testifies to a miracle is lying or deluded than that the alleged miracle actually occurred, and so should always reject any single report of it. A longstanding and widely accepted objection is that even if this is right, the concurring and non-collusive testimony of many witnesses should make it rational to believe in whatever miracle they all report. I argue that on the contrary, (...) even multiple reports from non-collusive witnesses lack the sort of independence that could make trouble for Hume. (shrink)

Rawls in his later philosophy claims that it is sufficient to accept political conception as true or right, depending on what one's worldview allows, on the basis of whatever reasons one can muster, given one's worldview (doctrine). What political liberalism is interested in is a practical agreement on the political conception and not in our reasons for accepting it. There are deep issues (regarding deep values, purpose of life, metaphysics etc.) which cannot be resolved through invoking common reasons (this is (...) the fact of free reason itself), and trying to resolve them would involve us in interminable debates and would hamper the practical task of agreement on the political conception. Given the absolute necessity of a political society which is stable and enduring, it is thus wise to avoid these issues in founding a political society and choosing its basic principles - this is the pragmatic part of Rawls's position. In this paper I argue that this strategy leads Rawls into a paradox: (i) although the intention is to stay independent of comprehensive doctrines, the political conception is in fact totally (and precariously) dependent on comprehensive doctrines (not just on one doctrine but on each and every major doctrine in society). It is dependent on them: for its conceptualisation as an independent idea, for its justification, for the check of its reasonability in relation to the external world, for the formation of identities and value inculcation and hence for the formation of its model citizen; (ii) the very search for independence makes the political conception more dependent on comprehensive doctrines, and by extension makes it potentially more prone to intervention in and tampering with comprehensive doctrines (it is enough to show that it is a strong conceptual possibility to cast doubt on the whole strategy). Thus, for example, the political conception relies on the hope that “firmly held convictions gradually change” and that it would “in fact . . . have the capacity to shape those doctrines toward itself”. The purpose of the Rawlsian conjecture is to give these “hopes” a concrete, practical form by giving advice to proponents of the comprehensive doctrine on how they can do all this and “try to show them that, despite what they might think, they can still endorse a reasonable political conception”. I further argue that this paradox can be overcome by making the core of political liberalism more flexible. (shrink)

When the West African nation of Ghana attained its independence from colonial rule in 1957, its traditional culture was to be promoted in all sectors of public life. Similarly, what was construed as Ghanaian traditional religion was to be treated equally with Christianity and Islam. The ritual offering of libations to ancestral spirits and deities was considered the Ghanaian equivalent to Christian and Muslim prayers, and it has been performed side by side with them in all sorts of national events. (...) Later on, the libation ritual became a symbol of both Ghana’s religious diversity and its national culture, transcending religious divisions. Many Christian groups, especially from the Pentecostal-charismatic movement, have refused to accept the public status of the libation ritual in view of its alleged immoral ‘pagan’ associations. When the pouring of libations was removed from the Independence Day ceremonies held at the state capital in 2011, the public debate soon turned to the relationship between the government and Pentecostal churches, and accusations of religious intolerance were levelled. This article discusses how the arguments about the status of the ritual boil down to differences in semiotic ideology and notions about proper agency – namely, how forms of agency pertaining to words, objects, persons and spiritual beings involved in the ritual are understood differently by the disputants. In a detailed and spirited critique, Professor James M. Humber has found my defence of the ontological argument unconvincing. Humber's case rests upon his claim that my ‘error’ is due to my ‘having accepted an incorrect definition of “physically necessary being” … ’. Now I do indeed claim that God must be conceived as a factuall necessary being, i.e. as eternally independent. I take the notion of God's aseity or eternal independence to be relatively straightforward and uncontroversial; it is (...) accepted as an essential component of the concept God by many philosophers who also insist that there is no acceptable form of demonstrative theism. Thus, it is widely held that ‘God is a factually necessary being’ does not imply ‘God is a logically necessary being’; that God is eternally independent does not imply that he exists in all possible worlds. But it is precisely this view that I have argued is incorrect. While I concur that there is an intelligible concept of God as factually necessary, I deny that the existence of such a being is logically contingent, a mere matter of empirical fact. Indeed, a rigorous inspection of the concept of an eternally independent being reveals that whether that concept is instantiated, i.e. whether there exists a being exemplifying that concept, is knowable a priori . My claim is in fact stronger than this. I argue that the existence of an eternal, independent, omniscient and omnipotent being is demonstrable by conceptual analysis. It is Humber's contention that my alleged demonstration of God's existence crumbles upon the discovery of the unacceptability of my definition of ‘factually necessary being’. Let us see. (shrink)

I discuss a thesis that I call ‘The Appearance of Mind-Independence’, to the effect that, to the subject of an ordinary perceptual experience, it seems that the experience involves the awareness of a mind-independent world. Although this thesis appears to be very widely accepted, I argue that it is open to serious challenge. Whether such a challenge can be maintained is especially relevant to the assessment of any theory, such as Berkeley’s idealism, according to which the only objects of (...) which we are aware in perception are mind-dependent. But the issue is of significance for the philosophy of perception more generally. In the course of my sceptical discussion, I argue that recent work by Campbell and Cassam may be flawed by a failure to take sufficiently seriously the requirements for genuine mind-independence. Multiple constraints, including semantic, lexical, and usage-based factors, have been shown to influence dative alternation across different languages. This work explores whether fine-grained statistics and semantic properties of the verb affect the acceptability of dative constructions in Spanish. First, a corpus analysis reveals that verbs of different semantic classes occur naturally in alternative dative constructions, a pattern quite different from English. The fact that dative alternation appears independent of semantic classes challenges traditional semantic-based approaches. Second, acceptability rating (...) tasks reveal that dative constructions containing highly entrenched word combinations and frequent word order are judged more acceptable regardless of the verbs' semantics. The results are interpreted in favor of usage-based accounts: Acceptability of dative constructions may be language-specific and depend on patterns of use and conventionalization. (shrink)

Individual substances are the ground of Aristotle’s ontology. Taking a liberal approach to existence, Aristotle accepts among existents entities in such categories other than substance as quality, quantity and relation; and, within each category, individuals and universals. As I will argue, individual substances are ontologically independent from all these other entities, while all other entities are ontologically dependent on individual substances. The association of substance with independence has a long history and several contemporary metaphysicians have pursued the connection. In (...) this chapter, I will discuss the intersection of these notions of substance and ontological dependence in Aristotle. I will canvass a few contemporary formulations of ontological dependence and discuss some of the interpretative difficulties in ascribing any of these formulations to Aristotle’s characterization of individual substances as ontologically independent. My aim is not to resolve fully these difficulties but to locate the topics of substance and independence relative to certain other controversies in Aristotle studies. However, I will sketch a position. In particular, elsewhere I have speculated that Aristotle is both a primitivist and a pluralist with respect to ontological dependence, and I will develop this line of interpretation a bit further later in the chapter. The rhetoric-analytic critique of experimental psychology owes its apparent attractiveness to (a) some erroneous ideas about cognitive psychology and the rationale of experimentation, (b) the failure to distinguish between prior data and evidential data vis-à-vis the to-be-corroborated explanatory theory, and (c) evidential data owes their identity to a theory that is independent of the theory being tested. Theories in cognitive psychology are accepted because they can withstand concerted efforts to falsify them.

Many social properties and notions are collectively made. Two collectively created aspects of the social world have been emphasized in recent literature. The first is that of the performative character of many social things (entities, properties). The second is the reflexive nature of many social concepts. The present account adds to this list a third feature, the collective availability or “for-groupness” of collective social items. It is a precise account of social notions and social facts in terms of collective appearance. (...) Advocates of epistemic conceptions of democracy sometimes argue that democratic decision-making is a more reliable guide to getting the issues at stake right than the decision-making of individuals. Such arguments give rise to the question of whether those finding themselves in the minority should defer to democratic outcomes. In this article, I discuss the bearing of the normative criterion of reasonable acceptability on this question. I thus ask, can the demand to defer to democratic outcomes be rendered reasonably acceptable (...) to citizens who disagree with them? Using the example of David Estlund’s epistemic proceduralism, I show that the problem of moral deference is inherent to epistemic conceptions of democracy. I then discuss the kind of reasons that would make a demand of deference reasonably acceptable to the minority, arguing that they should be independent from the reasons supporting the majority position. Subsequently, I introduce the conciliatory conception of democracy as an example of what such reasons could be. The conception’s central idea is that disagreement between citizens conceived as equal epistemic authorities carries epistemic significance. This significance makes it rational for citizens so conceived to conciliate their conflicting judgments. Because democratic decision-making has an inbuilt tendency to track such conciliatory positions, the conception offers an independent reason to accept democratic outcomes as the more reliable guide to getting the issues at stake right. A tight connection between competence and performance is a central tenet of the usage-based model. Methodologically, however, corpus frequency is a poor predictor of acceptability – a phenomenon known as the “frequency/acceptability mismatch”. This article argues that the mismatch arises from a “methodological mismatch”, when simple frequency measures are mapped onto complex grammatical units. To illustrate, we discuss the results of acceptability judgments of go/come-v. The construction is subject to a formal constraint (Go see the doctor! vs. (...) *He goes sees the doctor), which results from its mandative semantics (directives, commissives). While a formal model makes no prediction with regard to gradient acceptability of bare (“grammatical”) go/come-v, the usage-based view assumes that acceptability is a function of compatibility with an abstract schema. The experimental ratings are compared with a number of corpus-derived measures: while acceptability is largely independent of (raw) frequency, it is not independent of frequency-related usage distribution. The results add to recent suggestions that the frequency/acceptability mismatch is substantially reduced if the syntactic complexity of a unit is appropriately captured in usage data. (shrink)

Realism about musical works is often tied to some type of Platonism. Nominalism, which posits that musical works exist and that they are concrete objects, goes with ontological realism much less often than Platonism: there is a long tradition which holds human-created objects (artifacts) to be mind-dependent. Musical Platonism leads to the well-known paradox of the impossibility of creating abstract objects, and so it has been suggested that only some form of nominalism becoming dominant in the ontology of art could (...) cause a great change in the field and open up new possibilities. This paper aims to develop a new metaontological view starting from the widely accepted claim that musical works are created. It contends that musical works must be concrete and created objects of some sort, but, nevertheless, they are mind-independent, and we should take the revisionary methodological stance. Although musical works are artifacts, what people think about them does not determine what musical works are. Musical works are similar to natural objects in the following sense: semantic externalism applies to the term ‘musical work’ because, firstly, they possess a shared nature, and, secondly, we can be mistaken about what they are. Say a reason to ø is legal just in case at least a part of the reason is the fact that ø-ing is legally required. This paper is about the widely accepted claim that legal reasons have a certain distinctive formal property—content-independence. I argue that, on two important interpretations, this claim is false. It is false either because legal reasons contingently lack the relevant property or because no reason lacks it. I also argue that, given these two interpretations, content-independence could (...) not be a property of singular legal reasons. (shrink)

Crafted within a knowledge-first epistemological framework, Mona Simion’s engaging and wide-ranging work ensures that both the Knowledge Norm of Assertion (KNA) and Classical Invariantism (CI) can be part of a viable and productive research program.Dissatisfied with current strategies on offer in the literature, she successfully counters objections to the pair sourced in “shiftiness intuitions”—intuitions that seem to indicate that mere changes in practical context can impact the propriety of assertions and knowledge attributions. For example, in Keith DeRose’s famous pair of (...) low stakes versus high stakes bank cases, the consequences of Keith’s acting on The bank is open on Saturday if it were false change from trivial in low stakes to catastrophic in high stakes. We are to suppose that the proposition is true, and that Keith has access to the same quantity and quality of evidence for it in both cases. In low stakes, but not in high stakes, we are inclined to think that Keith can appropriately assert to his inquiring wife “The bank is open on Saturday.” In low stakes, Keith’s knowledge ascription “I know that the bank is open on Saturday” strikes us as aptly asserted and true. In high stakes only a knowledge denial on Keith’s part strikes us as aptly asserted and true.If we want to hang on to KNA, it looks like we will have to abandon CI and concede that ‘knows’ or knowledge is sensitive to changes in practical considerations. If we want to retain CI, we can try to say that, while Keith does still know that the bank is open on Saturday in high stakes, he does not have sufficient warrant to properly assert that it is. But such a move seems to run counter to KNA. We appear to be stuck in the Shiftiness Dilemma.Keen to get us out of the dilemma and to preserve the idea that epistemically good thinking and asserting are independent of practical concerns, Simion suggests a strategy that can also be used to protect other epistemic speech-act norms and notions from similar threats of practical shiftiness. She notes that having an impact on the degree of epistemic warrant required is not enough to make a norm an epistemic one. Fair enough. If I am given strong practical reason (a million dollars, or a gun to the head) not to adopt full belief until I have gathered more evidence, there is potentially some nonepistemic norm at work in the demand for further evidence. So it is a live possibility (indeed, a plausible one, as Simion would say) that our intuitions in the Shiftiness Dilemma are being misdescribed: they are tracking all-things-considered propriety of assertion, not epistemic propriety. In high stakes, practical norms override the epistemic norm KNA. Keith’s asserting “The bank is open on Saturday” would be epistemically proper but all-things-considered improper.Simion backs up her account with an etiological-function origin story and typology for the norms of assertion. Here is her characterization of etiological function for traits, artifacts, and actions. E-function.A token of type T has the e-function of type B of producing effect E in a system S iff (1) tokens of T produced E in the past, (2) producing E resulted in benefit of type B in S/S’s ancestors, and (3) producing E’s having B-benefited S’s ancestors contributes to the explanation of why T exists in S.In this schema, norms governing an action are typed by the functions or purposes of the action, which in turn are typed by the benefits the action delivers. The epistemic norm of assertion will be the one that characteristically and reliably enables participants in the practice of assertion to secure its primary epistemic good, which Simion identifies as knowledge (testimonial knowledge in hearers generated under normal conditions by the assertions of knowledgeable speakers). Moves in a practice either directly or indirectly aim at fulfilling the goal of the practice. Assertion is a move in the practice of inquiry, which has the generation of knowledge as its aim. Hence, Simion concludes, assertion aims at generating knowledge.This account helps to explain why, in cases like high stakes, Keith all-things-considered ought not to assert “The bank is open on Saturday,” even though he knows it is true. Prudential norms of assertion override the epistemic KNA, for when multiple functions come into conflict, the ones that are more important to the survival of the organism will generate weightier normative constraints.Simion then applies her account to the general category of constatives—for example, speech acts that express a speaker’s belief and the intention that the hearer form or continue to hold the like belief. Employing the taxonomy of Bach and Harnish, she argues that, as expressions of belief and hence varieties of assertion, constatives are subject to knowledge norms as well. Bach and Harnish identify fifteen different subcategories of constatives, each characterized in terms of the kind of belief and intention they express. The norms governing a species have to be at least as strong as the norms governing the corresponding type. As species of the type assertion, each subcategory, then, is subject to at least the necessary direction of KNA. Ultimately, we arrive at a knowledge norm for every speech act on the list, such as The Knowledge Norm of Conjecture (KNC):One’s conjecture that p is epistemically permissible only if one knows that there is reason, but not sufficient reason, to believe that p. Most of the proposed interpretations of various constatives are on the whole reasonable enough, though J. L. Austin would surely be unhappy to see so many different speech acts fashioned into varieties of assertion. Simion concludes with reflections on conjecturing, telling, and moral assertion.Construing the challenge of shiftiness intuitions in terms of the Shiftiness Dilemma allows Simion to declare success when the compatibility of KNA and CI with the relevant data of intuition is secured. Ensuring empirical adequacy for an explanatory framework is an important step, but pronouncements of victory by way of inference to the best explanation would be premature.Other candidates have been shown to match KNA’s familiar explanatory successes (involving lottery propositions, Moorean statements, etc.). Unlike KNA, alternatives that require only epistemically justified or rational belief or credence can allow that a subject is epistemically proper to assert what they believe when their belief is epistemically rational, even under conditions where there are defeating reasons that they are not in a position to be aware of. Furthermore, such norms seem better suited for philosophical or heated moral discussions where there is little consensus and individuals routinely fail to know that what they assert is true. Simion sounds the alarm that the Shiftiness Dilemma threatens to generalize “to epistemic normativity as a whole” (xi–xii), but norms concerning rational credence seem particularly immune.As Simion notes, the etiological-function model of norms that she proposes could be rebuilt with a different central epistemic aim at its core. Indeed, Millikan-inspired models along these lines are appealed to in other areas in philosophy where the concept of information takes center stage—a concept that may be more amenable to rigorous definition and use in dialogue with the sciences than knowledge. We can wonder, also, what special weight the etiological-function model accords to a knowledge-first perspective on epistemic normativity when the model is malleable in this way.The effectiveness of Simion’s strategy for shielding epistemically good thinking and assertion from practical shiftiness becomes less apparent when we try to apply it to Keith’s belief or judgment that the knowledge ascription/denial he asserts is true. It is unclear whether we are to suppose that, in high stakes, Keith epistemically ought to believe/judge that his asserted knowledge denial is false, but all-things-considered he ought to believe/judge that it is true. Here is a simplified version of a puzzle from the debate over pragmatic encroachment. Consider low cases where you meet the invariant standards for knowing that p, but your justified confidence falls short of certainty. Among these cases, there must be some where you also meet the invariant standards for knowing that if p is true, then among your choices of action ϕ-ing results in the best overall outcome. Say, for instance, that you have a machine with a ϕ button, and your machine, which you know to be extremely reliable, tells you what the cost or benefit will be if you push the button and p is true versus if p is false. If you ϕ (push the ϕ button) and p is true, you win one hundred dollars; if you ϕ and p is false, you lose one hundred dollars. You face the choice: to ϕ or not to ϕ. Since you know that p, and you know that if p is true, then among your choices of action ϕ-ing results in the best overall outcome, you rationally conclude that ϕ-ing results in the best overall outcome, and hence that you ought to ϕ. If you know which choice of action has the best overall outcome, that is what you all-things-considered should do. Now consider high, where the quantity and quality of your evidence for p is the same, and you still know that your machine is extremely reliable. This time, however, the machine tells you that if you push ϕ and p is true, you win one hundred dollars, but if you push ϕ and p is false, you lose $1 million. Your rational confidence in p is not high enough to justify pushing the button, so you rationally conclude that you ought not to ϕ. Since in high nothing evidentially relevant has changed (all that has changed is the machine informing you of a new, more serious cost of acting on p if p is false), the classical invariantist will have to say that you still know that ϕ, and you still know that if p is true, then among your choices of action ϕ-ing results in the best overall outcome. So, according to CI, you should still be able to reason properly as follows: you know that p, and you know that if p is true, then among your choices of action ϕ-ing results in the best overall outcome, so you know that ϕ-ing results in the best overall outcome, hence you ought to ϕ. In his book Natural Law and Human Rights: Towards a Recovery of Practical Wisdom, Manent writes: "Let us dwell a moment on the proposition (...) in which so much passion is invested today: man is the being who possesses rights. It resonates as our self-definition and our perspective on humanity, one that we take to have fortunately replaced other definitions and perspectives, such as that man is God's creature or that man is a political animal."1 Contemporary political discourse has arrived, so he thinks, at an impasse of contradiction, incoherence, and self-defeating beliefs.Manent finds a vital help for thinking through these issues in Thomas Aquinas,2 but perhaps also a useful resource is the work of Thomas Jefferson. Several experimental studies have reported that an otherwise robust regularity—the disparity between Willingness-To-Accept and Willingness-To-Pay—tends to be greatly reduced in repeated markets, posing a serious challenge to existing reference-dependent and reference-independent models alike. This article offers a new account of the evidence, based on the assumptions that individuals are affected by good and bad deals relative to the expected transaction price (price sensitivity), with bad deals having a larger impact on their utility (`bad-deal’ aversion). Recent arguments for scientific realism have emphasized the importance of both methodological factors, such as theoretical unification , and experiments , as evidence for a realistic view of certain aspects of theoretical structure . Throughout this dissertation I argue that neither strategy is sufficient as a defense of realism. ;Chapter one consists of a discussion of Friedman's argument for realism as outlined in his Foundations of Space-Time Theories . I argue that his reliance on theoretical unification and conjunction as grounds (...) for a selective brand of realism is unsatisfactory for a variety of reasons. Not only does his structure-substructure reductivist model of theories and the emphasis on conjunction fail to fit actual cases of theory evolution, but the historical relativity built into the approach is undesirable even from a realist perspective. The relationship between conjunctive inference and unification is discussed and it is suggested that although theoretical unification is desirable at some stages of theory development it contributes nothing to the justification or evidential warrant of theories. ;In chapter two my claims regarding unification are applied to the development of Maxwell's electromagnetic theory. I discuss the difficulties in specifying a workable model of the aether as the unifying theoretical structure as well as the importance of models and analogies in Maxwell's work. It is argued that this obvious unification of electromagnetism and optics played virtually no evidential role in the final acceptance of the theory. It was not until the completion of Hertz's experiments that Maxwell's theory was actually vindicated. ;Chapter three focuses on the experimental difficulties associated with Maxwell's theory and the relationship between Hertz's experiments and his theoretical interpretation of electromagnetism. ;In chapter four I summarize some of the general difficulties associated with the notion of independent evidence as it pertains to experimental results. I conclude by arguing that although experiment provides a more persuasive case for realism than methodological factors, in many instances it fails to provide the kind of epistemological justification required for the realist assumptions about the ontology of scientific theories. Notwithstanding constant “crises of confidence,” a high number of international disputes lay at the docket of the International Court of Justice in The Hague. In the word of Judge Rosalyn Higgins, states are turning to the ICJ for the peaceful settlement of their disputes. The option provided by the Charter of the United Nations in limiting the compulsory jurisdiction of the Court to certain categories of disputes, clearly contributes to convening a greater number of states to accept this international jurisdiction, (...) resolve their disputes peacefully and in accordance with international law. Not surprisingly, only a few declarations provided in Article 36 of the Statute of the Court do not contain any reservation as to the limits of the Court’s competence. Interwar Lithuania contributed heavily to the strengthening of international justice. It was amongst the first members of the League of Nations to recognise the compulsory jurisdiction of the Permanent Court of International Justice and remained its faithful supporter until the very end of the Court’s activities. International justice provided at least titular security guarantees for the young nation. This faith of the Lithuanian government in relying on international justice was rewarded in full. The Lithuanian State defended its legitimate place amongst the independent nations and successfully stood up for its interests in all three cases before the Permanent Court. (shrink)

We investigate how the just cause principle is applicable to contingency planning about armed interventions in civil wars that are somewhat likely to occur in the future. According to a 2005 peace agreement that formally ended a civil war between the Sudanese government in Khartoum and the Sudan People’s Liberation Army, a referendum on South Sudan independence is to be held no later than January 9, 2011. Close observers of Sudan warn that this promise of an independence referendum might not (...) be correctly fulfilled, and that a North-South civil war is somewhat likely to recur. Focusing on the case of Sudan, we discuss the following key question, from the temporal standpoint of August 2010, the month this paper was completed: How may the just cause principle be used prospectively to decide whether there would be a just cause for armed intervention in Sudan, if a renewed North-South civil war were to occur there during the years 2010–2014? To illuminate this question of application, we also discuss a question of theory. What is the just cause principle? A core thesis is that the deterrent threat of armed intervention is an essential tool for preventing such a civil war. By means of deterrent threats of limited forms of armed intervention—for instance, the deterrent threat of imposing no-fly zones—the balance of cost/benefit calculations by the Sudanese government about the prospect of civil war might be tipped in favor of acceptance of South Sudan independence. We recommend that responsible actors in the international community should plan contingently about such armed intervention in Sudan, with the goal of preventing a renewed North-South civil war there. Although the thesis that the moral better than relation is transitive seems obviously true, there is a growing literature according to which Parfit’s repugnant conclusion and related puzzles reveal that this thesis is false or problematic. This paper begins by presenting several such puzzles and explaining how they can be used in arguments for the intransitivity of better than. It then proposes and defends a plausible alternative picture of the behavior of better than that both resolves the repugnant conclusion and (...) preserves transitivity. On the threshold-based model of lexicality defended here, hedonic episodes whose intensity is above a certain point are lexically greater than those whose intensity is below it. The final sections argue that this model is independently plausible and can be defended from several important objections. (shrink)

How exactly is accepting the bad side effects of good choices morally defensible? The best defense to date is by Joseph Boyle, John Finnis, and Germain Grisez and relies on the claim that bad side effects are unavoidable. But are they? Three accounts of why bad side effects are unavoidable—one by John Zeis, a second by Boyle, Finnis, and Grisez jointly, and a third by Boyle independently—are examined and rejected. Next, an alternative proposal which suggests bad side effects are always (...) avoidable is also examined and rejected. Finally, an adequate account of why bad side effects are unavoidable is presented and defended. This defense relies on certain facts about the goods which human agents ultimately find fulfilling and about human agents’ attempts to instantiate those goods through various projects. (shrink)

The paper examines Wright’s attempt to inflate deflationism about truth. It accepts the details of Wright’s argument but contends that it should best be seen as posing a dilemma for the deflationist: either truth is independent of norms of warranted assertibility—in which case it is substantial—or it is not—in which case epistemicism about truth is a consequence. Some concerns about epistemicism are raised in avoiding the second horn. The first is avoided by distinguishing between independence and substantiality and arguing (...) that only the first applies to truth and only the second is worrisome to deflationism. This paper considers John Lamont’s claim that the Bible is a basic form of evidence for the existence of God. It is argued to the contrary that its admissibility depends upon God’s existence being an acceptable real prior possibility.

It is widely believed that some puzzling and provocative remarks that Frege makes in his late writings indicate he rejected independence arguments in geometry, particularly arguments for the independence of the parallels axiom. I show that this is mistaken: Frege distinguished two approaches to independence arguments and his puzzling remarks apply only to one of them. Not only did Frege not reject independence arguments across the board, but also he had an interesting positive proposal about the logical structure of correct (...) independence arguments, deriving from the geometrical principle of duality and the associated idea of substitution invariance. The discussion also serves as a useful focal point for independently interesting details of Frege's mathematical environment. This feeds into a currently active scholarly debate because Frege's supposed attitude to independence arguments has been taken to support a widely accepted thesis (proposed by Ricketts among others) concerning Frege's attitude toward metatheory in general. I show that this thesis gains no support from Frege's puzzling remarks about independence arguments. (shrink)

The structure of this paper is as follows. First, I start off by briefly explaining the concepts of pro-theism and anti-theism, and by distinguishing both between personal and impersonal versions of those views, and also between a more modest and a less modest claim connected with the impersonal version of pro-theism. -/- I then introduce a distinction that is itself quite trivial, namely, that between pro-theism (and anti-theism), on the one hand, and pro-monotheism (and anti-monotheism), on the other, where the (...) latter are defined in terms of the deity of some particular religion. The triviality notwithstanding, I shall argue at various points in the subsequent discussion that even the best discussions of the pro-theism versus anti-theism issue are vitiated to some extent by a failure to keep that distinction clearly in mind. -/- Next, I consider how the pro-theism versus anti-theism question is related to the theism versus atheism question. These questions are often thought to be quite independent of each other, but I shall argue that that is not so. In particular, I shall argue that these two issues are neither logically nor evidentially independent of one another. -/- The rest of the essay is then devoted to discussing the strength of the case for pro-theism, and there my basic claims are as follows. First, the case for the impersonal pro-theistic thesis––the thesis that, all things considered, the existence of God is better than the non-existence of God––is very strong relative to facts about which there is no dispute. Second, and contrary to the views of many philosophers, there is no respect in which the world is better if God does not exist than if God exists. Third, the case for the personal pro-theistic view that it is better for every person if God exists than it is if God does not exist is also very strong. Fourth, however, it is not clear that these pro-theistic conclusions remain justified if one thinks that one can take one’s evidence as including not just facts about which there is no dispute, but also the proposition that God exists, and I shall argue that if one does assume that theism is true, the support that can otherwise be offered for some pro-theistic claims is seriously weakened, perhaps even to the point where those claims can no longer be sustained. -/- My general conclusion, accordingly, might be put as follows: While there is no significant anti-theistic thesis that can be sustained if one is an atheist, some pro-theistic theses may become problematic if one is a theist. Current axiomatizations for extensive measurement postulate the existence of infinitely small objects. This assumption is neither necessary nor reasonable. This paper develops this theme and presents a more acceptable axiom system. A representation theorem is stated and proved in detail. This work improves some previous results of the author.

This article is aimed to compare the efficacy and acceptability of exercise intervention with other nonpharmacological therapies in improving attention in ADHD patients and then rank those therapies. Methods. Relevant RCT studies from the Cochrane Library, Web of Science, Psycinfo, and PubMed were systematically searched from January 2011 to January 2020. The literature was screened, and the researchers extracted and used Stata16 and WinBugs1.4 independently to analyze the data. Results. The improvement of “attention deficit” in ADHD patients was measured (...) in 83 independent studies with 4,998 participants and 14 nonpharmacological therapies. Therapies were ranked as follows, according to the efficacy and acceptability of the cumulative probability area under the curve : meditation and cognitive; sport intervention therapy; vitamin and mineral; cognitive behavioral therapy; computer training; psychological education; working memory training; neurofeedback therapy; polyunsaturated fatty acids; mineral supplements; meditation; vitamin; biofeedback therapy; and school-based training. However, because the effect size of meditation and cognitive therapy was at a marginally significant level ), the robustness of the results was far lower than that of sport intervention therapy. Therefore, careful interpretation is needed in practice. Conclusion. Considering the efficacy and acceptability of various nonpharmacological therapies, sport intervention has a more stable effect on the improvement of attention deficit. Secondly, meditation and cognitive therapy, cognitive behavioral therapy, and computer training can also be effective complementary tools. (shrink)

This research explores the intervention effect of the mindfulness acceptance insight commitment (MAIC) training program on the mindfulness level, flow state, and mental health of college swimmers. A sample of 47 college swimmers from a regular university was recruited and randomly divided into two groups before the intervention. Independent variables between groups are psychological training mode (MAIC training/no training), and the independent variable within group was time (pre-test, post-test, and continuity test). The dependent variables are mindfulness level, flow (...) state, and mental health (anxiety, depression, training, and competition satisfaction). Results show that after the intervention of MAIC training, the mindfulness level of athletes’ flow state has been significantly improved, whereas anxiety and depression significantly decreased. In addition, the satisfaction with training and competition significantly improved. In the continuous stage after the intervention, the mindfulness level, flow state, and mental health of athletes are still significantly higher than those in the pre-test. The comparison of the post-test and continuity test show no significant differences in the mindfulness level, flow state, depression, and training and competition satisfaction of athletes. Still, the anxiety level shows an upward trend with a significant difference. This study demonstrates that the MAIC mindfulness training program can significantly improve the mindfulness level, flow state, anxiety, depression, and training and competition satisfaction of college swimmers with a good continuity effect. Thus, the athletes’ sports experience can be improved, and good psychological benefits can be attained. (shrink)

Possible measures to mitigate climate change require global collective actions whose impacts will be felt by many, if not all. Implementing such actions requires successful communication of the reasons for them, and hence the underlying climate science, to a degree that far exceeds typical scientific issues which do not require large-scale societal response. Empirical studies have identified factors, such as the perceived level of consensus in scientific opinion and the perceived reliability of scientists, that can limit people's trust in science (...) communicators and their subsequent acceptance of climate change claims. Little consideration has been given, however, to recent formal results within philosophy concerning the relationship between truth, the reliability of evidence sources, the coherence of multiple pieces of evidence/testimonies, and the impact of independence between sources of evidence. This study draws on these results to evaluate exactly what has been established in the empirical literature about the factors that bias the public's reception of scientific communications about climate change. Contrary to widely held assumptions, an evolutionary metaethics need not be non-cognitivist. I define evolutionary metaethics as the claim that certain phenotypic traits expressing certain genes are both necessary and sufficient for explanation of all other phenotypic traits we consider morally significant. A review of the influential cognitivist Immanuel Kants metaethics shows that much of his ethical theory is independent of the anti-naturalist metaphysics of transcendental idealism which itself is incompatible with evolutionary metaethics. By matching those independent aspects (...) to an evolutionary metaethics a cognitivist Kantian evolutionary metaethical theory is a possibility for researchers to consider. (shrink)

This paper seeks to show that Achinstein's recent attempt to establish that both parties to the wave-particle debate in 19th-century optics were Bayesian conditionalizers forces us to ignore several of the key conceptual issues in that controversy-not least the role of the vera causa principle and, more important still, the role of positive evidence in securing acceptance for the wave theory of light.

The ethical frameworks of consequentialism and formalism predict moral awareness and behavior in individuals, but current measures either do not treat these frameworks as independent or lack sufficient theoretical underpinnings and statistical dependability. This paper presents the development and validation of a new scale to measure consequentialism and formalism that is well grounded in prior research. The Ethical Standards of Judgement Questionnaire is validated via six studies. Measurement items are developed in the first three studies, which also confirm the (...) need to eliminate a unidimensional measure and evaluate these frameworks separately. The fourth study addresses discriminant validity and the two remaining studies provide insight into how consequentialism and formalism predict the degree to which behaviors are deemed acceptable by individuals in the context of consumer beliefs and religious beliefs. Leibniz thinks that every created substance is causally active, and yet causally independent of every other: none can cause changes in any but itself. This is not controversial. But Leibniz also thinks that every created substance is existentially independent of every other: it is metaphysically possible for any to exist with or without any other. This is controversial. I argue that, given a mainstream reading of Leibniz’s essentialism, if one accepts the former, uncontroversial interpretation concerning causal independence, then (...) one ought also to accept the latter, controversial one concerning existential independence. This is a new way to defend the ‘existential independence’ interpretation. Moreover, this defense provides a new approach for defending the broadly ‘non-logical’ interpretive camp in the longstanding debate over Leibniz’s views on incompossibility, against perhaps the strongest objection leveled by advocates of the opposing broadly ‘logical’ interpretation. It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results and consequences (...) of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. This study investigates the effectiveness of a preparatory programme on the acceptance of students with physical disabilities by their peers in inclusive schools in Tehran. The classrooms which had students with physical disabilities were included in this study. Two hundred and twenty?one third? to fifth?grade students (116 girls and 105 boys) were selected randomly and were placed in experimental and control groups. The Acceptance Scale (Form B) established by Voeltz was used to measure peer acceptance. Data were collected from two (...) groups before and after applying the preparatory programme. The data were analysed by t?test for independent groups and two?way ANOVA. The results showed increase of acceptance in experimental group. Also in comparing the level of acceptance in girls and boys, the results indicated that the acceptance in girls were more than boys. (shrink)

Proponents of practice-dependent egalitarianism argue that egalitarian duties and entitlements only apply among participants in morally relevant practices. In this paper, I argue that these views are implausible because they allow for objectionable treatment of non-participants. I show that it is impossible, on the basis of practice-internal considerations alone, to determine the extent to which the pursuit of practices can permissibly limit the opportunities of non-participants. There are opportunities beyond the current holdings of practices to which no one has a (...) privileged claim (such as unowned natural resources), and the distribution of which is a matter of justice. A just distribution of such unowned distributive goods, though, requires a practice-independent distributive baseline. I further show that such a baseline can only be egalitarian because all alternative baselines face serious objections. From this I conclude that any plausible theory of distributive justice must accept some form of equal practice-independent distributive entitlements. (shrink)

This study combines author's experiences as an analyst of post-Soviet politics and religious liberty with personal participation in the founding and public acceptance of a new faith in independent Ukraine during a quarter- century. Theattempt here is not only to describe a specific outcome, but to propose factors that offer explanation for why Ukraine is among the few Communist successor states in which new minority faiths have been relatively successful in achieving full toleration [Biddulph: 2016]. Religious liberty has been (...) described as the “first freedom of all freedoms” [Hertzke: 2013, 4], yet it has been noticeably unachieved globally. A 2007 Pew “Global Attitudes Survey” showed that 90% of respondents world-wide said that it was important to live in a country that enabled them to practice religion freely. Yet a more recent Pew “Forum on Global Restrictions on Religion” found that 70% of the world population reside in countries which have high or very high restrictions on religion either from government actions or from major social hostilities [Grim: 2013, 86]. Religious liberty, therefore, is an almost universal human aspiration, but is one of the more unachieved rights in the world.
