Relationalism holds that perceptual experiences are relations between subjects and perceived objects. But much evidence suggests that perceptual states can be unconscious. We argue here that unconscious perception raises difficulties for relationalism. Relationalists would seem to have three options. First, they may deny that there is unconscious perception or question whether we have sufficient evidence to posit it. Second, they may allow for unconscious perception but deny that the relationalist analysis applies to it. Third, they may offer a relationalist explanation (...) of unconscious perception. Empirical discussions of mental representation appeal to a wide variety of representational kinds. Some of these kinds, such as the sentential representations underlying language use and the pictorial representations of visual imagery, are thoroughly familiar to philosophers. Others have received almost no philosophical attention at all. Included in this latter category are analogue magnitude representations, which enable a wide range of organisms to primitively represent spatial, temporal, numerical, and related magnitudes. Drawing on the empirical premise that attention makes objects look more intense, Ned Block has argued for mental paint, a phenomenal residue that cannot be reduced to what is perceived or represented. If sound, Block's argument would undermine direct realism and representationism, two widely held views about the nature of conscious perception. We argue that Block's argument fails because the empirical premise it is based upon is false. Attending to an object alters its salience, but not its perceived intensity. We (...) also argue that salience should be equated with mental primer, a close cousin of mental paint that reintroduces difficulties for direct realism and representationism. Substituted judgment has increasingly become the accepted standard for rendering decisions for incapacitated adults in the USA. A broad exception exists with regard to patients with diminished capacity secondary to depressive disorders, as such patients’ previous wishes are generally not honoured when seeking to turn down life-preserving care or pursue aid-in-dying. The result is that physicians often force involuntary treatment on patients with poor medical prognoses and/or low quality of life as a result of their depressive symptoms when similarly situated (...) incapacitated patients without such depressive symptoms would have their previous wishes honoured via substituted judgment. This commentary argues for reconsidering this approach and for using a substituted judgment standard for a subset of EMP/LQL patients seeking death. (shrink)

This article explores governance issues in an area of limited statehood characterized by the combination of state and indigenous institutions. This is done by adopting an institutional lens focusing on three factors—field structures, institutional logics, and actor agency—to analyze governance settlements. The results point to how complex governance settlements in areas of limited statehood hold together with a certain degree of alignment between institutional elements. However, as the field evolves, contestations and misalignments lead to changes in governance settlements. Analyzing these (...) transitions, this study identifies three key processes that have facilitated deeper state penetration in the field, namely, delocalization of field structures, hybridization of institutional logics, and diversification of actor agency. Philosophers of biology generally agree that causal specificity tracks biological importance: more specific causes are more important. I argue that this correlation does not hold in much research aimed at biomedical intervention. Applying James Woodward’s analysis of causal specificity to the development and design of HIV treatments, I show that drugs that are less causally specific produce better therapeutic outcomes and are more highly valued. Thus, I conclude that the importance of biological causes does not track their specificity but instead (...) varies depending on the biological practice we consider and the goals of that practice. Hobbes believed that the state of nature would be a war of all against all. Locke denied this, but acknowledged that in the absence of government, peace is insecure. In this paper, I analyse both accounts of the state of nature through the lens of classical and experimental game theory, drawing especially on evidence concerning the effects of punishment in public goods games. My analysis suggests that we need government not to keep wicked or relentlessly self-interested individuals in line, but (...) rather to maintain peace among those who disagree about morality. This paper surveys and evaluates the answers that philosophers and animal researchers have given to two questions. Do animals have thoughts? If so, are their thoughts conceptual? Along the way, special attention is paid to distinguish debates of substance from mere battles over terminology, and to isolate fruitful areas for future research.

This paper is concerned with a recent argument of Jerry Fodor's to the effect that the frame problem in artificial intelligence is in principle insoluble. Fodor's argument is based on his contention that the mind is divided between encapsulated modular systems for information processing and 'central systems' for non-demonstrative inference. I argue that positing central systems is methodologically unsound, and in fact involves a muddle that bears a strong family resemblance to the basic error in dualism. I therefore conclude that (...) A consequence relation \ is monotonic iff for premise sets \ and conclusion \, if \, \, then \; and non-monotonic if this fails in some instance. More plainly, a consequence relation is monotonic when whatever is entailed by a premise set remains entailed by any of its supersets. From the High Middle Ages through the Early Modern period, consequence in theology is assumed to be monotonic. Concomitantly, to the degree the argument formulated by Anselm at Proslogion 2–4 is taken (...) up by later commentators, it is accepted or rejected in accordance with a monotonic notion of consequence. Examining Anselm’s use of parallelism in the Proslogion, I show Anselm embeds his famous argument in Proslogion 2–4 in a non-monotonic context. The results here presented challenge some deeply ingrained ideas governing the historiography of the long twelfth century, particularly concerning how the theology of the later eleventh through the twelfth century relates to the scholasticism of the thirteenth. Enhanced indispensability arguments claim that Scientific Realists are committed to the existence of mathematical entities due to their reliance on Inference to the best explanation. Our central question concerns this purported parity of reasoning: do people who defend the EIA make an appropriate use of the resources of Scientific Realism to achieve platonism? We argue that just because a variety of different inferential strategies can be employed by Scientific Realists does not mean that ontological conclusions concerning which things we should (...) be Scientific Realists about are arrived at by any inferential route which eschews causes, and nor is there any direct pressure for Scientific Realists to change their inferential methods. We suggest that in order to maintain inferential parity with Scientific Realism, proponents of EIA need to give details about how and in what way the presence of mathematical entities directly contribute to explanations. What are the contents, limits, and possibilities of Aristotle’s works for critical thinking about money? Recent scholarship has (re)turned to Aristotle as an authority for two key political approaches to money. The first aims to democratize the governance of monetary institutions in order to realize more just economic outcomes. The second seeks to prevent money, or its inherently deleterious excesses, from corrupting political actors and political life. Arguing that these two approaches are insightful, important, and incomplete, I reengage Aristotle’s account (...) of money across the Nicomachean Ethics and the Politics to theorize money as a vital but underexplored means of political subject formation. I illuminate how the use of money produces collective and constitutive relations that emerge by way of people’s engagements and entanglements with the things they produce, acquire, desire, and exchange. Bringing this to light also makes visible, I argue, how Aristotle understands money as something capable of being used to both bring about social justice and to pervasively corrupt the foundations of shared democratic life. Taking stock of this dual capacity of money, I show how money’s relationship to subjectivity simultaneously makes money the site of a seemingly intractable problem for politics under capitalism and the means to revive it and reconnect it to democratic life. Priority for solid organ transplant generally does not consider the underlying cause of the need for transplantation. This paper argues that a distinctive set of factors justify assigning lower priority to willfully unvaccinated individuals who require transplant as a result of suffering from COVID‐19. These factors include the personal responsibility of the patients for their own condition and the public outrage likely to ensue if willfully unvaccinated patients receive organs at the expense of vaccinated ones. The paper then proposes a (...) three‐prong test for similar deviations from the current allocation standard that incorporates patient responsibility, foreseeability and avoidability, and the frequency of the occurrence. The tendency of classical politics to embed the individual in universal and transcendental patterns of action followed in part from the recognition of the futility of unpredictable action oriented to the individual's transient personal future. By contrast, F. A. Hayek argues for liberalism and the rule of law because it is instrumental to the achievement of human ends. Michael Oakeshott, however, claims that freedom is a value in itself, and that liberalism should emphasize moral autonomy because the moral life is (...) public and not oriented to external ends. The moral life intimates a form of self‐sufficiency in action, and self‐sufficient action is timeless in the sense of being indifferent to either the past or the future. Oakeshott returns liberalism to the problems of classical politics without recourse to the dictatorial imposition of a single substantive good. (shrink)

Meditation is an umbrella term for a number of mental training practices designed to improve the monitoring and regulation of attention and emotion. Some forms of meditation are now being used for clinical intervention. To accompany the increased clinical interest in meditation, research investigating the neural basis of these practices is needed. A central hypothesis of contemplative neuroscience is that meditative states, which are unique on a phenomenological level, differ on a neurophysiological level. To identify the electrophysiological correlates of meditation (...) practice, the electrical brain activity of highly skilled meditators engaging in one of six meditation styles was recorded. A mind-wandering task served as a control. Lempel–Ziv complexity showed differences in nonlinear brain dynamics during meditation compared with mind wandering, suggesting that meditation, regardless of practice, affects neural complexity. In contrast, there were no differences in power spectra at six different frequency bands, likely due to the fact that participants engaged in different meditation practices. Finally, exploratory analyses suggest neurological differences among meditation practices. These findings highlight the importance of studying the electroencephalography correlates of different meditative practices. (shrink)

When the indispensability argument for mathematical entities (IA) is spelled out, it would appear confirmational holism is needed for the argument to work. It has been argued that confirmational holism is a dispensable premise in the argument if a construal of naturalism, according to which it is denied that we can take different epistemic attitudes towards different parts of our scientific theories, is adopted. I argue that the suggested variety of naturalism will only appeal to a limited number of philosophers. (...) I then suggest that if we allow for some degree of separation between different component parts of theories, IA can be formulated as an argument aimed at more than a limited number of philosophers, but in implementing this strategy the notion of indispensability needs spelling out. The best way of spelling out indispensability is in terms of theory contribution, but doing so requires adopting inference to the best explanation (IBE). IBE is however sufficient for establishing the conclusion that IA is supposed to establish. Thus, IA is a redundant argument. (shrink)

Abstract:Electronic health records (EHRs) offer significant advantages over paper charts, such as ease of portability, facilitated communication, and a decreased risk of medical errors; however, important ethical concerns related to patient confidentiality remain. Although legal protections have been implemented, in practice, EHRs may be still prone to breaches that threaten patient privacy. Potential safeguards are essential, and have been implemented especially in sensitive areas such as mental illness, substance abuse, and sexual health. Features of one institutional model are described that (...) may illustrate the efforts to both ensure adequate transparency and ensure patient confidentiality. Trust and the therapeutic alliance are critical to the provider–patient relationship and quality healthcare services. All of the benefits of an EHR are only possible if patients retain confidence in the security and accuracy of their medical records. (shrink)

The “Goldwater rule,” a policy adopted by the American Psychiatry Association in 1973, prohibits organization members from diagnosing or offering professional opinions regarding the mental health of public figures without both first-hand evaluation and authorization. Initially developed in response to a controversial survey of APA members during the 1964 Presidential election campaign, the ethics rule faced few large scale challenges until the election of Donald Trump in 2016. Since that time, a significant number of psychiatrists have either violated or criticized (...) the rule openly. This paper argues that whatever the initial merits of the rule, the prohibition has since been rendered obsolete by the combined lack of professional consensus supporting the policy, absence of a meaningful enforcement mechanism, and the credible statements of non-APA members in the mental health professions regarding public figures. Since several landmark legal decisions in the 1970s and 1980s, substituted judgment has become widely accepted as an approach to decision‐making for incapacitated patients that incorporates their autonomy and interests. Two notable exceptions have been cases involving minors and those involving cognitively or psychiatrically impaired individuals who never previously possessed the ability to contemplate the medical decisions involved in their care. While a best interest standard may have universal merit in pediatric cases, this paper argues that substituted judgement has been (...) rejected too broadly for “never‐capacitated” patients. It then lays out a three‐condition test for using substituted judgment in these cases. For a subset of “never‐capacitated” patients who belong to distinctive religious or cultural communities with clear medical values and have an appropriate surrogate, these values may prove helpful in vindicating the interests of the never‐capacitated and should not be blanketly dismissed. An emphasis on explanatory contribution is central to a recent formulation of the indispensability argument for mathematical realism. Because scientific realism is argued for by means of inference to the best explanation, it has been further argued that being a scientific realist entails a commitment to IA and thus to mathematical realism. It has, however, gone largely unnoticed that the way that IBE is argued to be truth conducive involves citing successful applications of IBE and tracing this success over time. (...) This in turn involves identifying those constituents of scientific theories that are responsible for their predictive success and showing that these constituents are retained across theory change in science. I argue that even if mathematics can be shown to feature in best explanations, the role of mathematics in scientific theories does not satisfy the condition that mathematics is always retained across theory change. According to a scientific realist, this condition needs to be met for making ontological claims on the basis of explanatory contribution. Thus scientific realists are not committed to mathematical realism on the basis of this recent formulation of IA. (shrink)

This article presents the influence on Danish philosophy of the French phenomenologist and hermeneutic philosopher Paul Ricœur. Paul Ricœur’s poetic hermeneutics was an inspiration for Danish phenomenology and existentialist thought. Moreover, Ricœur had an influence on the development of poetic and narrative research in theology and the human and social sciences in Denmark. In addition, Ricœur provided a hermeneutic framework for research in the different disciplines of bioethics and biolaw, philosophy of law, philosophy of education and nursing philosophy. In particular, (...) Peter Kemp has been important for presenting and promoting Ricœur’s narrative philosophy. The article gives an overview of the influence of the different aspects of Ricœur’s philosophy in Denmark, related to different schools of thought and to individual philosophers and researchers in theology and the human and social sciences in Denmark. Virtue-based moral cognitivism holds that at least some of the value of some art consists in conveying knowledge about the nature of virtue and vice. We explore here a challenge to this view, which extends the so-called situationist challenge to virtue ethics. Evidence from social psychology indicates that individuals’ behavior is often susceptible to trivial and normatively irrelevant situational influences. This evidence not only challenges approaches to ethics that emphasize the role of virtue but also undermines versions of moral cognitivism, (...) because the value of art cannot consist in teaching us about traits that do not exist. We thus recommend a new account of the cognitive value of art: art teaches how context and character interact to produce action. (shrink)

A new public centered long-range corporate planning orientation is proposed. Underlying this orientation is the rationale that the main purpose of business activity is the satisfaction of socially desirable needs, i.e. needs that are compatible with long run public welfare. Such need satisfaction will tend to bring about improvements in the quality of private and public life. Corporate planning should thus facilitate the performance of business activities designed to achieve the satisfaction of socially desirable needs.The determination of what are socially (...) desirable needs will be based on public consensus, which corporations can periodically assess, and incorporate into their long range plans. A long-range planning procedure, incorporating social welfare considerations is developed. It is suggested that a planning procedure such as this is essential for the existence of firms in the long run. (shrink)

The origin of human cooperation poses an evolutionary puzzle. In order for cooperation to evolve, our Pleistocene ancestors must have overcome the free rider problem, in which noncooperators reap the benefits of cooperation without paying the costs. Cultural group selection accounts offer a potential solution to this problem. In this article, I evaluate Boyd and Richerson’s influential account. I argue that it cannot explain the evolutionary origins of human cooperation because it presupposes cooperative behaviors among our Pleistocene ancestors. Although Boyd (...) and Richerson’s account may explain the expansion of cooperation in hominin evolution, it cannot explain how cooperative behaviors first emerged. (shrink)

ABSTRACT In his famous critique of Hegel’s Philosophy of Right, Marx criticized Hegel’s contention that the general will can be achieved without popular sovereignty. Marx argued that Hegel’s first error lay in his Idealist method, which mistook the realities of the family and civil society as mere emanations of the Idea. This methodological error, according to Marx, led Hegel to misunderstand the rational essence of the state as consisting in a “universal” will that is abstracted from the real will of (...) the people itself, allowing Hegel to defend the pursuit of the good of the whole not by popular government but government by a special bureaucratic, “universal” estate, represented in government by civil servants. However, Marx failed to direct the same type of critique against Hegel’s assertion that the bureaucracy would have the knowledge of the whole that it would need if it were to effectively regulate civil society in the universal interest. Populists are often cast as deniers of rationality, creators of a climate of “post-truth,” and valuing tribe over truth and the rigors of science. Their critics claim the authority of rationality and empirical facts. Yet the critics no less than populists enable an environment of spurious claims and defective argumentation. This is especially true in the realm of science. An important case study is the account of scientific trust offered by a leading public intellectual and historian of science, Naomi Oreskes, (...) and the misapplication of that theory during the coronavirus pandemic. This paper works from the ITC document, Synodality in the Life and Mission of the Church (2018), to outline four essential components of an emergent theology of synodality: the claim that synodality is constitutive of the Church, an ecclesiology of communion, the ecclesial title People of God, and the sensus fidei. The paper then critically assesses the interplay of these four elements in the ITC document, along with the Vademecum and the Preparatory Document which were disseminated with the beginning of (...) the synodal process itself (2021). Certain issues from this interplay, it is argued, require further reflection as this emergent theology develops: the theological weight of consensus, the degree to which belonging to the Church is (or is not) essentially discursive in character, how the sensus fidei seems to imply that the practice of the faith is an integral element of meaningful synodal participation by Catholics, and indeed, finally, the participation of those who do not bear the name of Christian. Minor-attracted persons raise multiple ethical and legal challenges. Sexual contact between adults and children is justly prohibited on child welfare grounds. Advances in technology raise the prospect of interventions for minor-attracted persons that have the potential to reduce harm to children by diverting would-be offenders to other endeavors that nonetheless may generate moral disgust This essay examines three of these potential harm reduction technologies (sex robots, haptic devices and synthetic child pornography) and raises the possibility that their use can be (...) justified and their acceptance morally obligatory if doing so reduces harm to real children.
