According to a prominent approach in contemporary formal semantics, the truth of moral assertions depends on a normative perspective imposed on the facts of the world. The implementation of this approach known as indexical contextualism treats the dependence of moral truth on the corresponding moral perspective in analogy with the contextual dependence characteristic of sentences containing indexical terms. Alternatively, the moral perspective is seen as configuring the circumstances of evaluation in which the content expressed by the occurrence of a moral (...) sentence is evaluated as true or false. The moderate version of this alternative view (non-indexical contextualism) considers that the truth of the occurrence of a moral sentence in a context of use is determined by the evaluation of its content in “the circumstance of the context”: the circumstance of evaluation represented by the same indexed set that represents the context of use. The radical version (assessment relativism), in turn, makes the truth of the occurrence of a moral sentence in a context depend essentially on the value of the normative standard in another context, from which the original utterance is assessed. Taking the judgment on the moral status of polygamous marriage as an illustration, the present work examines the competing merits of contextualist and relativist accounts of the use of moral language, especially in situations of disagreement and debate. The paper argues that, while indexical contextualism coupled with adequate pragmatic considerations can explain some relevant disagreement data, the alternative explanation of these data given by non-indexical contextualism is preferable, because it is simpler and more economical. It is also argued that relativism of assessment is better situated than non-indexical contextualism to explain the relevant phenomena of obligatory retraction and therefore to accommodate some discursive possibilities that play a central role in moral debates. The claim that at least some of our mental states have qualitative, phenomenal features to which we have privileged cognitive access is intuitively plausible. Nevertheless, the claim is considered by many philosophers to be incompatible with a physicalist ontology. Some radical physicalists prefer simply to deny the existence of the qualitative character of our mental states, whereas other physicalists try to reinterpret the knowledge of the phenomenal character of our experience as the acquisition of an ability, i.e., as a sort (...) of know-how in opposition to the acquisition of an information. The paper presents and examines critically some recent attempts to compatibilize the sui generis nature of phenomenal knowledge with the materialist claim that the content of this sort of knowledge is constituted entirely by physical facts. Chalmers’s two-dimensional argument against materialism (aka the zombie argument) is arguably the most ingenious attempt to ground a view about fundamental reality on epistemic considerations. From the conceivability of a being that is physically identical to a conscious being but that is deprived of phenomenal consciousness (a zombie), the argument draws on the interplay of the primary and the second intensions of the zombie hypothesis to infer the metaphysical possibility of a zombie world, and thus the falsity of physicalism about (...) phenomenality. By means of a detailed reconstruction of the two-dimensional argument, the paper tries to isolate its most central assumption: that the role played by an epistemic scenario (an intentional object) in the verification of the zombie hypothesis is played by a nonintentionally individuated metaphysical world (the zombie world) considered as actual. The paper argues that no non-viciously circular case for this assumption has been made. Thus, the two-dimensional argument is at best inconclusive. (shrink)

De acordo com a concepção dominante de causação, eventos espácio-temporalmente localizáveis que podem ser designados por termos singulares e descrições definidas são os únicos relata genuínos da relação causal. Isto dá apoio e é apoiado pela dicotomia aceita entre a explicação causal, concebida como uma relação intensional entre fatos ou verdades, e a relação natural e extensional da causação. O ensaio questiona este modo de ver e argumenta pela legitimidade da noção de causação por fatos: os relata de muitas relações (...) expressas pelo conector sentencial ‘(O fato) C causa (o fato) E’ podem ser causas e efeitos genuínos (I). Esta visão expandida da causação é então aplicada ao problema da causação mental. Assumindo a verdade do realizacionismo físico, o ensaio explora a conexão entre eficácia causal e relevância contrafactual de propriedades. Mostra-se que, pelo menos em muitos casos, as ligações contrafactuais corretas, requeridas pela causação, podem ser encontradas somente no nível dos fatos realizados, não no nível mais básico dos fatos realizadores (II). Finalmente, dadas as similaridades entre a defesa do fisicismo não-reducionista esboçada aqui e as tentativas menos modestas de justificação científica das pretensões do materialismo metafísico, justamente criticadas por van Fraassen como manifestações da ‘falsa consciência’, considera-se se e como a argumento principal do ensaio pode evitar o juízo crítico de van Fraassen (III). It seems that higher-level, nonbasic properties can only manifest their causal powers by exerting causal influence on lower-level, physically basic phenomena in the first place. A very influential line of reasoning conceives of this form of downward causation as either reducible to causation by physical properties or as ultimately untenable, because incompatible with the causal closure of physical reality. The paper argues that this is not so. It examines, first, why it is that a recent attempt by Noordhof to substantiate (...) the notion of supervenient causation in a nonreductive framework fails. The upshot of this examination is the claim that any attempted specification of the most basic causal factors which supposedly underlie a causal transaction cannot account for the counterfactually necessary connections with the effect in question. By contrast, the specification of these factors at a higher level would allow establishing such connections. The paper closes with a discussion of how this view of autonomous causation at the higher-level can coexist with the notion of a complete specification of the causes of any physical effect exclusively in physical terms. We defend J. Kim's principle of explanatory exclusion from a recent criticism advanced by A Marras. We show that the principle follows from a less controversial principle of causal exclusion together with the assumption that claims of explanation are factual. We resolve the tension produced by Marras' argument by drawing a distinction between causal and explanatory relevance. In cross-level explanations (mental-to-physical and physical-to-mental) the explanans property is not causally but explanatorily relevant to the explanandum. This calls for an account of (...) how explanatorily relevant properties are grounded in causally relevant properties which in turn ultimately depend on causally efficacious properties. A. (shrink)

Le présent ouvrage collectif contient les Actes d'un colloque international bilingue sur l'action, les attitudes et la décision que nous avons organisé en hommage à notre regretté collègue J.-Nicolas Kaufmann à Trois-Rivières du 3 au 5 octobre 2002. L'ouvrage présente et discute d'hypothèses, d'enjeux et de théories contemporaines sur l'action, les attitudes, la rationalité et la décision. La première partie intitulée Pensées, actions et engagements contient des contributions de John Searle, Daniel Vanderveken, Candida Jaci de Sousa Melo et Raimo Tuomela (...) traitant de problèmes généraux de la philosophie de l'esprit et de l'action. Here we challenge the orthodoxy according to which abduction is an a posteriori mode of inference. We start by providing a case study illustrating how abduction can justify a philosophical claim not justifiable by empirical evidence alone. While many grant abduction's epistemic value, nearly all assume that abductive justification is a posteriori, on grounds that our belief in abduction's epistemic value depends on empirical evidence about how the world contingently is. Contra this assumption, we argue, first, that our belief in (...) abduction’s epistemic value is not and could not be justified a posteriori, and second, that attention to the roles experience plays in abductive justification supports taking abduction to be an a priori mode of inference. We close by highlighting how our strategy for establishing the a priority of abduction positively contrasts with strategies in Bonjour (1998), Swinburne (2001), and Peacocke (2004) aiming to establish the a priority of certain ampliative modes of inference or abductive principles. What explains the outcomes of chance processes? We claim that their setups do. Chances, we think, mediate these explanations of outcome by setup but do not feature in them. Facts about chances do feature in explanations of a different kind: higher-order explanations, which explain how and why setups explain their outcomes. In this paper, we elucidate this 'mediator view' of chancy explanation and defend it from a series of objections. We then show how it changes the playing field in four (...) metaphysical disputes concerning chance. First, it makes it more plausible that even low chances can have explanatory power. Second, it undercuts a circularity objection against reductionist theories of chance. Third, it redirects the debate about a prominent argument against epistemic theories of chance. Finally, it sheds light on potential chancy explanations of the Universe's origin. (shrink)

This article concerns the nature and limits of individuals’ rights to privacy over information that they have made public. For some, even suggesting that an individual can have a right to privacy over such information may seem paradoxical. First, one has no right to privacy over information that was never private to begin with. Second, insofar as one makes once-private information public – whether intentionally or unintentionally – one waives one’s right to privacy to that information. In this article, however, (...) we suggest the moral situation is more complicated than this. Rather, we argue that there is a class of public information – namely, once-private information that individuals have made public unintentionally – which remains within the scope of an individuals’ right to privacy, even when it has passed into the public domain. Significantly, this class includes any information rights-holders were unaware could be inferred from information they have made public and which they would not otherwise have wanted to be in the public domain. As we show, as well as clarifying several everyday dilemmas with regards to individuals’ privacy rights, this finding has elucidates a number of problems in the ethics of Big Data. (shrink)

The book situates the works and reception of the French scholar Pierre de la Ramée (Petrus Ramus) in a variety of European cultural and educational contexts, from Britain and France to Eastern Europe, from Germany to the Iberian peninsula, and from Scandinavia to the Netherlands. Pierre de la Ramée or Petrus Ramus (1515-1572) has long been a controversial figure in educational reform and innovation, from the moment of his first public academic statements in the 1530s, to his reception among scholars (...) in the twentieth and twenty-first centuries. What is beyond dispute, however, is the vast reach of his influence throughout Europe. Ramus's ideas were disseminated through copious editions and translations of his own textbooks, and in wave after wave of adaptations and re-imaginings of his ideas that swept across the continent. This volume embarks on a European tour of Ramism, using a wide range of previously unpublished or untranslated archival evidence from throughout the continent to examine the dissemination of Ramus's works and his intellectual influence in geographic and in disciplinary terms. The ten chapters explore the spread of Ramism from his home country of France to Protestant strongholds in Germany, Holland, and Britain, and in the Catholic context of the Iberian peninsula. The book also examines Ramism in the less familiar territories (to most Anglophone readers) of Scandinavia and Hungary, and considers the preceding and contemporary Dutch and German educational reform movements from which Ramus borrowed to forge his own distinctive intellectual method. This Essay examines the elegantly simple idea that consent to medical treatment or participation in human research must be “informed” to be valid. It does so by using as a case study the controversial clinical research trial known as the Surfactant, Positive Pressure, and Oxygenation Randomized Trial. The Essay begins by charting, through case law and the adoption of the common rule, the evolution of duties to secure fully informed consent in both research and treatment. The Essay then utilizes the (...) SUPPORT study, which sought to pinpoint the level of saturated oxygen that should be provided to extremely low birth weight infants to demonstrate modern complexities and shortcomings of the duty to secure informed consent. This Essay shows how the duty is measured by foreseeability of risks and benefits in human research and why federal regulators believed the tradeoffs in risk and benefits from differing oxygen levels administered in the support study were foreseeable. It then explores the contours of the duty to secure informed consent when applied to researchers who also serve as treating physicians, highlighting how common law duties differ in jurisdictions that apply the professional standard and those that apply the patient-centered material risk standard. This Essay provides new insight into what the law must do to make real the notion that [e]very human being of adult years and sound mind has a right to determine what shall be done with his body.”. Die Ansicht, dass Leibniz urn 1700 oder einige Zeit danach ein überzeugter Idealist war oder wurde, der allein an die Realität der Geister und ihrer Ideen glaubte, hält sich merkwürdigerweise in der neueren Sekundärliteratur. In diesem Beitrag beurteilen wir die Textgrundlage für diese Behauptung nach von uns für solide gehaltenen Kriterien einer historischen Interpretation, wobei sich die Behauptung unserer Ansicht nach als unzureichend erweist. Obwohl Leibniz zur Überzeugung gelangt war, dass wirkliche "Atome" der Natur keine Ausdehnung hätten, war er sein (...) Leben hindurch auf die Geistesunabhängigkeit lebender Kreaturen festgelegt, in der Art, die eindeutig Idealismus ausschließt. Wir versuchen, die tieferen Gründe für die Beharrlichkeit der idealistischen Sichtweise, trotz ihrer textlichen und konzeptualen Schwierigkeiten, aufzudecken, indem wir sie letztlich in den ahistorischen Präferenzen der Kommentatoren lokalisieren. Objectivism and projectivism are standardly taken to be incompatible theories of color. Here we argue that this incompatibility is only apparent: objectivism and projectivism, properly articulated so as to deal with basic objections, are in fundamental agreement about the ontology of color and the phenomenology of color perception.

In this article we aim to assess the ethical desirability of self-test diagnostic kits for influenza, focusing in particular on the potential benefits and challenges posed by a new, mobile phone-based tool currently being developed by i-sense, an interdisciplinary research collaboration based at University College London and funded by the Engineering and Physical Sciences Research Council. Our study adopts an empirical ethics approach, supplementing an initial review into the ethical considerations posed by such technologies with qualitative data from three focus (...) groups. Overall, we map a range of possible considerations both for and against the use of such technologies, synthesizing evidence from a range of secondary literature, as well as identifying several new considerations previously overlooked. We argue that no single consideration marks these technologies as either entirely permissible or impermissible but rather tools which have the potential to incur certain costs and benefits, and that context is important in determining these. In the latter stages of the article, we explain how developers of such technologies might seek to mitigate such costs and reflect on the possible limitations of the empirical ethics method brought out during the study. Approaches to self‐management traditionally focus upon individual capacity to make behavioural change. In this paper, we use Bourdieu's concepts of habitus and capital to demonstrate the impact of structural inequalities upon chronic illness self‐management through exploring findings from 28 semi‐structured interviews conducted with people from a lower socioeconomic region of Adelaide, South Australia who have type 2 diabetes. The data suggests that access to capital is a significant barrier to type 2 diabetes self‐management. While many participants described having sufficient cultural (...) capital to access and assess health information, they often lacked economic capital and social capital in the form of support networks who promote health. Participants were often involved in social networks in which activities which are contrary to self‐management have symbolic value. As a consequence, they entered relationships with health professionals at a disadvantage. We conclude that structural barriers to self‐management arising from habitus resulting in the performance of health behaviours rooted in cultural and class background and limited access to capital in the form of economic resources, social networks, health knowledge and prestige may have a negative impact on capacity for type 2 diabetes self‐management. Esta normalización se concretiza en las prácticas asociadas a las políticas públicas y la intervención social. Para iluminar estas prácticas utilizamos el concepto de dispositivo propuesto por Foucault. En (...) este contexto, uno de los dispositivos relevantes es la teoría de factores de riesgo. Ella surge del concepto de riesgo, y a través de una reconstrucción histórica de esta noción, mostramos que ésta no reconstruye una condición natural de algunas personas, sino que es una distinción contingente utilizada en el contexto de la gubernamentalidad neoliberal.: This article examines the conditions that underpin risk factor theory. It starts discussing the neoliberal governmentality as a political paradigm. In this paradigm, one of the chief value is individual responsibility, where politics has as its task to normalise those that cannot adapt to that value. This normalisation is embedded in the practices which pertain public policies and social intervention. To shed light on these practices, the paper develops Foucault’s concept of dispositive. In this context, one of the main dispositive is risk factor theory. It arises from the concept of risk, and by means of an historical reconstruction of this notion, we show that this theory does not reconstruct a natural condition of some people; rather, it is a contingent selection used in the context of the neoliberal governmentality.
