The purported failures of ergodic theory (seen in its often proved ineptitude to ground a mechanical explanation of thermodynamics) are shown to arise from misconception of the functions served by scientific explanation. In fact, the predictive failures of ergodic theory are precisely its points of greatest physical utility, where genuinely new knowledge about actual physical systems can be obtained, once the links between explanation and reconstructive estimation are recognized.

In lieu of an abstract, here is a brief excerpt of the content:At St. Isidore’s Franciscan College in Rome, the following maxim attributed to St. Patrick is inscribed above the door-way of the church: Si quae difficiles quaestiones in hac insula oriantur ad Sedem Apostolicam referantur; ut Christiani ita et Romani sitis.1 The college was founded in 1625 by Luke Wadding, O.F.M. and, under his direction, became a major seat of theological learning and political influence for the Irish in Rome.2 (...) In the nineteenth century, the Friars Minor of the Province of Ireland assigned many documents from St. Isidore’s for use in their Irish friaries. In 1872, amid the unrest caused by the Risorgimento, medieval and early-modern Irish Franciscan manuscripts were transferred to Dublin.3 At the Merchants’ Quay Convent, the librarians T.A. O’Reilly, O.F.M. and E.B. Fitzmaurice, O.F.M. divided the manuscripts into sections with alphabetically ordered shelf-marks.4 This practical approach followed the long-established system used at Italian libraries and archives in Franciscan custody.5 From 1947 until 2000, the manuscripts of the Irish Friars Minor were kept at the Franciscans’ Dún Mhuire House of Studies in Killiney, County Dublin, before their transfer to the Archives, University College Dublin.The ‘D’ collection is preserved in twenty-six sets of volumes, folders and boxed papers. This article is a contribution to interdisciplinary scholarship addressing the presumption of innocence, especially interdisciplinary conversations between philosophers and jurists. Terminological confusion and methodological traps and errors notoriously beset academic literature addressing the presumption of innocence and related concepts, such as evidentiary presumptions, and the burden and standard of proof in criminal trials. This article is diagnostic, in the sense that its primary objective is to highlight the assumptions—in particular, the disciplinary assumptions—implicit in influential contributions to debates on the presumption (...) of innocence. It advocates a methodologically pluralistic approach, according to which definitions of the presumption of innocence are necessarily sensitive to purpose and method. These relationships and their implications are not always appreciated, and are seldom explicitly elucidated. Notably, philosophers routinely treat the presumption of innocence as epistemic, evidentiary or otherwise featuring directly in practical reasoning. This article identifies jurisprudential and practical reasons why legal scholars and practitioners concerned with criminal procedure and evidence should reject evidentiary interpretations of the presumption of innocence. By encouraging finer-grained engagement with the history and institutional details of common law procedural traditions, the article aims to show why legal scholars might think that philosophical approaches to the presumption of innocence are already methodologically-loaded and, for our purposes, address the wrong questions with deficient concepts. Investigations of data-centered efforts in advocacy and activism are often cast in terms of a narrative of opposition between grassroots activists working through and with data, and corporations or institutions whose actions data might expose. The boundaries are, however, not so distinct in practice. Indeed, one outcome of successful advocacy efforts for opening big data to the public is that the activists may find themselves drawn into the institutions they critique or view as impediments in order to actualize those efforts (...) from the inside. Drawing on an ongoing ethnographic investigation of urban data initiatives inside city government, we explore the productive ambivalences of activism and advocacy that arise when those with data activist ideals find themselves operating within the government structure. Computer programs are generating artworks of astonishing novelty and aesthetic value. By the standard definition of creativity, these programs would count as being creative. But if you still hesitate to call a program creative, that's for good reason, we argue. It's because real creativity requires AGENTS who are responsible for what they make, and it's not at all clear that these programs are agents. -/- (The title was imposed by the editor. It was supposed to be called, "ARE COMPUTERS CREATIVE?").

Because physical theories typically predict numerical values, an improvement in experimental precision reduces the tolerance range and hence increases corroborability. In most psychological research, improved power of a statistical design leads to a prior probability approaching 1/2 of finding a significant difference in the theoretically predicted direction. Hence the corroboration yielded by "success" is very weak, and becomes weaker with increased precision. "Statistical significance" plays a logical role in psychology precisely the reverse of its role in physics. This problem is (...) worsened by certain unhealthy tendencies prevalent among psychologists, such as a premium placed on experimental "cuteness" and a free reliance upon ad hoc explanations to avoid refutation. El objetivo de este artículo es abordar el reciente problema del nexo entre realismo y fenomenología hermenéutica desde un enfoque específico: el diálogo entre el nuevo realismo de Markus Gabriel y algunas propuestas hermenéutico-fenomenológicas alemanas que se autocomprenden en términos realistas. Afirmo la hipótesis de que es posible un diálogo productivo entre estas propuestas, basado en una comprensión mínima del realismo como fundamentación ontológica viable. Para esto, en primer lugar mostraré el sentido del actual resurgimiento del realismo en el contexto (...) de la ontología continental contemporánea, situando su recepción, crítica e integración a propósito del ámbito de la fenomenología y hermenéutica recientes. En segundo lugar, analizaré la propuesta de nuevo realismo, que está implicada en la ontología de campos de sentido de M. Gabriel. Y, en tercer lugar, reseñaré las propuestas de Günter Figal, Anton Friedrich Koch y Tobias Keiling en su fundamento realista. While the media and public opinion polls suggest that the state of business ethics is declining, surveys of corporate managers on the subject are less than conclusive. This study presents results of a survey of 487 adult, MBA, and undergraduate business students on the business philosophies of Machiavellianism, Darwinism, Objectivism, Relativism, and Universalism. The findings were consistent with earlier research which showed prospective managers to be less ethical than practicing ones and that women and those reporting a strong religious conviction (...) tend to be more ethical. In the latter half of this century, there have been two mostly separate threads within ethical theory, one on 'superogation', one on 'common-sense morality'. I bring these threads together by systematically reflecting on doing more than one has to do. A rich and coherent set of concepts at the core of common-sense morality is identified, along with various logical connections between these core concepts. Various issues in common-sense morality emerge naturally, as does a demonstrably productive definition of doing more than (...) one has to do. I then present an interpreted model-theoretic framework with the expressive power to generate truth-conditions for the core concepts, and the explanatory power to predict and explain the independently motivated logical connections between these concepts. The framework also has a certain heuristic power for 'discovering' substantive ethical theories that can derivatively generate the model-theoretic framework for the core concepts. Two theories discussed are expansions of traditional theories; two others, each giving pride of place to justice, are devised to resonate with more recent concerns. Methodologically, it is hoped that the approach within might suggest the possibility of bridging another gap: that between formal and informal studies of moral notions. (shrink)

Like Plato, Protagoras held that young children learn virtue from fine examples in poetry. Unlike Plato, Protagoras taught adults by correcting the diction of poets. In this paper I ask what his standard of correctness might be, and what benefit he intended his students to take from exercises in correction. If his standard of correctness is truth, then he may intend his students to learn by questioning the content of poems; that would be suggestive of Plato’s program in Republic III. (...) But his standard is more likely to be the accurate use of language; in that case he would intend his students to learn to express their thoughts clearly enough that their audience would understand what they were saying. That standard would be independent of the truth of what they are saying; and that would be a precursor to modern techniques by which we try to teach speaking and writing. Truth is not so easy to escape, however, and we shall see that Protagoras’ exercise must assume that the poet is trying to tell the truth. (shrink)

The authors rightly critique existing social sciences approaches. However, they are too quick to dismiss the criticism that their proposed paradigm is atheoretical. Social and cognitive theories are indeed incommensurate, often due to the lack of a unifying framework. Without proper integration with theoretical frameworks, their proposal may merely produce a resource-intensive veneer of thoroughness without substantive improvements to understanding.

The standard analysis of supererogation is that of optional actions that are praiseworthy to perform, but not blameworthy to skip. Widespread assumptions are that action beyond the call is at least necessarily equivalent to supererogation ("The Equivalence") and that forgoing certain agent-favoring prerogatives entails supererogation (“The Corollary”). I argue that the classical conception of supererogation is not reconcilable with the Equivalence or the Corollary, and that the classical analysis of supererogation is seriously defective. I sketch an enriched conceptual scheme, “Doing (...) Well Enough (DWE)”, that allows for distinct analyses of action beyond the call and supererogation, among other often neglected fundamental moral notions. Parallels and asymmetries with suberogation are briefly explored. Apparently, DWE’s core act-evaluative notions are more fundamental than the agent-evaluative ones of supererogation/suberogation. Some key pre-theoretic semantic and pragmatic phenomena that support a negative answer to the main title question are identified and a conclusion of some significance is drawn: a pervasive bipartisan presupposition of twentieth century ethical theory and deontic logic is false. Next, an intuitive model-theoretic framework for "must" and "ought" is hypothesized. Next, I show that the framework hypothesized possesses additional expressive and explanatory power (e.g. derivatively predicting the existence of supererogatory and permissibly suboptimal alternatives), thus adding further confirmation that it is on the right track. Competent patients have considerable legal authority to control life‐and‐death care. They may refuse medical life support, including medically delivered food and fluids. Even when they are not in need of any life‐saving care, they may expedite death by refusing food and water by mouth—voluntarily stopping eating and drinking, or VSED. Neither right is limited to terminal illness. In addition, in four U.S. states, competent patients, if terminally ill, may obtain lethal drugs for aid‐in‐dying.For people who have dementia and are no (...) longer competent, however, control over the end of life is much less extensive. They may have written a clear advance directive for refusing life‐saving care in specified circumstances yet subsequently find themselves living for years in severe dementia with no need for life‐saving care that could be refused. Chronic progressive dementia is not itself life threatening until its very final stage. Even in jurisdictions that permit active aid‐in‐dying, individuals with advanced dementia are not eligible; they lack the required current competence, and they are seldom deemed terminally ill. As for the right to VSED, its very name—voluntarily stopping eating and drinking—is seen as excluding noncompetent persons.One option for ensuring that one does not live years in severe dementia is to use advance directives to withhold food and water by mouth. The driving element behind VSED is that forcing people to ingest food is as objectionable an intrusion on bodily integrity, privacy, and liberty as imposing unwanted medical treatment. Thus, if incompetent people do not lose their rights to refuse life‐saving treatment, and if people when competent have just as strong a right to VSED as they do to refuse life‐saving treatment, then people do not lose their right to VSED when incompetent either. I explore various ways of integrating the framework for predeterminism, agency, and ability in[P.McNamara, Nordic J. Philos. Logic 5 (2)(2000) 135] with a framework for obligations. However,the agential obligation operator explored here is defined in terms of a non-agential yet personal obligation operator and a non-deontic (and non-normal) agency operator. This is contrary to the main current trend, which assumes statements of personal obligation always take agential complements. Instead, I take the basic form to be an agent’s being obligated to (...) be such that p. I sketch some logics for agential obligation based on personal obligation and agency, first in a fairly familiar context that rules out conflicting personal obligations (and derivatively, conflicting agential obligations), and then in contexts that do allow for conflicts (of both sorts). In developing his trademark use of “consonance” to prescribe a relationship between Christian faith and the natural sciences, Ernan McMullin drew on severaldistinctly Augustinian philosophical and theological themes during his fifty years of scholarship. Particularly prominent in McMullin’s work were an emphasis placed on Augustine’s biblical hermeneutic, which prioritized both literal and non-literal interpretive techniques, and Augustine’s epistemology of divine illumination. This paper examines several elements as part of an expository account of McMullin’s contribution toward the consonance between Christian faith (...) and the natural sciences. It also outlines McMullin’s theory of retroduction and his account of scientific realism, both of which are philosophical positions that provide additional support for consonance from an epistemological perspective. I conclude that for McMullin, consonance is a differentiated term that hints at underlying metaphysical claims without necessarily delineating the nature of those claims. (shrink)

This paper challenges Putnam's claim that his internal realism is a revival of Kant's empirical realism. I agree with Putnam that there are good reasons to revive Kant's rather neglected empirical realist doctrine. However, internal realism is not the way this should be done. At the center of the following discussion lies the important difference between Putman's "real within a scheme" model and Kant's assertion of the independent existence of empirical objects. The strategy for the paper is as follows. I (...) intend to first detail the real and important connections that exist between the analyses of experience offered by Putnam and Kant. These similarities should not be discounted. In fact, I think we can distinguish the two projects only if we first appreciate the conceptual overlap that naturally gives rise to the perceived union of the two programmes. I will then develop a representative response that is invoked commonly by Kantians who disagree with Putman's identification. This will be followed by a brief discussion concerning why this standard reply fails. I will conclude by canvassing a more powerful epistemological reason for dissociating the two programmes. (shrink)
