Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

BackgroundClinical ethics case consultations (CECCs) provide a structured approach in situations of ethical uncertainty or conflicts. There have been increasing calls in recent years to assess the quality of CECCs by means of empirical research. This study provides detailed data of a descriptive quantitative and qualitative evaluation of a CECC service in a department of cardiology and intensive care at a German university hospital.MethodsSemi-structured document analysis of CECCs was conducted in the period of November 1, 2018, to May 31, 2020. All documents were analysed by two researchers independently.ResultsTwenty-four CECCs were requested within the study period, of which most (n = 22; 92%) had been initiated by physicians of the department. The patients were an average of 79 years old (R: 43–96), and 14 (58%) patients were female. The median length of stay prior to request was 12.5 days (R: 1–65 days). The most frequent diagnoses (several diagnoses possible) were cardiology-related (n = 29), followed by sepsis (n = 11) and cancer (n = 6). Twenty patients lacked decisional capacity. The main reason for a CECC request was uncertainty about the balancing of potential benefit and harm related to the medically indicated treatment (n = 18). Further reasons included differing views regarding the best individual treatment option between health professionals and patients (n = 3) or between different team members (n = 3). Consensus between participants could be reached in 18 (75%) consultations. The implementation of a disease specific treatment intervention was recommended in five cases. Palliative care and limitation of further disease specific interventions was recommended in 12 cases.ConclusionsTo the best of our knowledge, this is the first in-depth evaluation of a CECC service set up for an academic department of cardiology and intensive medical care. Patient characteristics and the issues deliberated during CECC provide a starting point for the development and testing of more tailored clinical ethics support services and research on CECC outcomes. Post-modernism offers a revolutionary approach to the study of society: in questioning the validity of modern science and the notion of objective knowledge, this movement discards history, rejects humanism, and resists any truth claims. In this comprehensive assessment of post-modernism, Pauline Rosenau traces its origins in the humanities and describes how its key concepts are today being applied to, and are restructuring, the social sciences. Serving as neither an opponent nor an apologist for the movement, she cuts through post-modernism's (...) often incomprehensible jargon in order to offer all readers a lucid exposition of its propositions. Rosenau shows how the post-modern challenge to reason and rational organization radiates across academic fields. For example, in psychology it questions the conscious, logical, coherent subject; in public administration it encourages a retreat from central planning and from reliance on specialists; in political science it calls into question the authority of hierarchical, bureaucratic decision-making structures that function in carefully defined spheres; in anthropology it inspires the protection of local, primitive cultures from First World attempts to reorganize them. In all of the social sciences, she argues, post-modernism repudiates representative democracy and plays havoc with the very meaning of "left-wing" and "right-wing." Rosenau also highlights how post-modernism has inspired a new generation of social movements, ranging from New Age sensitivities to Third World fundamentalism. In weighing its strengths and weaknesses, the author examines two major tendencies within post-modernism, the largely European, skeptical form and the predominantly Anglo-North-American form, which suggests alternative political, social, and cultural projects. She draws examples from anthropology, economics, geography, history, international relations, law, planning, political science, psychology, sociology, urban studies, and women's studies, and provides a glossary of post-modern terms to assist the uninitiated reader with special meanings not found in standard dictionaries. Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Hope is a central concept in nursing and other fields of health care. However, there is no consensus about the concept of hope. We argue that seeking consensus is futile given the multifaceted and multidimensional nature of the concept, but instead we encourage in‐depth studies of the assumptions behind talk about hope in specific contexts. Our approach to the ‘science of hope’ is inspired by philosophical pragmatism. We argue that hope is a concept that opens different rooms for action in (...) different contexts and that accordingly, all hope interventions are contextually sensitive. Careful attention to how the relative positions and power of nurses and patients influence what can be inferred from their different ways of talking about hope may make hopeful conversations more meaningful in health care relationships. CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. Hierarchical views of nature have for centuries been used to justify the enslaving of peoples perceived as inferior, the often violent and coercive “reeducation” of indigenous peoples, the patriarchal subjugation of women, the cruel use of nonhuman animals for often trivial purposes, and the wanton destruction of the natural world. I join those who condemned the oppressive nature of these forms of hierarchical thinking. Yet, I fear that, in their effort to right past wrongs, too many thinkers are in danger (...) of throwing the axiological baby out with the ontological bathwater. Though the aim at a great ontological leveling is certainly understandable, I fear that, in embracing the opposite extreme and rejecting all hierarchical thinking, some may be in danger of doing violence to the many real and even morally significant differences between individuals. My claim in this paper is that Alfred North Whitehead’s philosophy of organism provides a model for how to appreciate the many grades and types of beings in the world, while avoiding an invidious normative hierarchy that inevitably places everything at the whim of human beings. That is, I will argue that it is possible to defend hierarchy without anthroparchy. To provide context, I will begin with a brief analysis of Aristotle’s “Great Chain of Being” and will then contrast it with Whitehead’s process philosophy. Given this context, using the subtle and perceptive work of the ecofeminist Karen J. Warren, I will then present a model for how to recognize a “descriptive hierarchy” while rejecting a simplistic “prescriptive hierarchy.” . (shrink)

Suppose we can save either a larger group of persons or a distinct, smaller group from some harm. Many people think that, all else equal, we ought to save the greater number. This article defends this view (with qualifications). But unlike earlier theories, it does not rely on the idea that several people's interests or claims receive greater aggregate weight. The argument starts from the idea that due to their stakes, the affected people have claims to have a say in (...) the rescue decision. As rescuers, our primary duty is to respect these procedural claims, which we must do by doing what these people would decide, in a process where each is given an equal vote on the matter. So in cases where each votes in their own self-interest, respect for their equal right to decide, or their autonomy, will lead us to save the greater number. The argument is explained in detail, with special attention to the questions of how, exactly, it avoids aggregation, and of why majority rule is superior to lottery procedures. The view has further advantages. Especially, it explains the “partial” relevance of numbers in cases involving unequal harms, and it does so in a way that dissolves the appearance of paradox that besets theories of “partial aggregation.”. This paper critically examines non-adversarial feminist argumentation model specifically within the scope of politeness norms and cultural communicative practices. Asserting women typically have a particular mode of arguing which is often seen as ‘weak’ or docile within male dominated fields, the model argues that the feminine mode of arguing is actually more affiliative and community orientated, which should become the standard within argumentation as opposed to the Adversary Method. I argue that the nonadversarial feminist argumentation model (NAFAM) primarily focuses on (...) one demographic of women’s communicative styles – white women. Taking an intersectional approach, I examine practices within African American women’s speech communities to illustrate the ways in which the virtues and vices purported by the NAFAM fails to capture other ways of productive argumentation. Many authors in ethics, economics, and political science endorse the Lottery Requirement, that is, the following thesis: where different parties have equal moral claims to one indivisible good, it is morally obligatory to let a fair lottery decide which party is to receive the good. This article defends skepticism about the Lottery Requirement. It distinguishes three broad strategies of defending such a requirement: the surrogate satisfaction account, the procedural account, and the ideal consent account, and argues that none of these (...) strategies succeed. The article then discusses and discharges some remaining grounds for resistance to these skeptical conclusions, as well as the possibility of defending a weaker version of a normative lottery principle. The conclusion is that we have no reason to believe that where equal claims conflict, we are morally required to hold a lottery, as opposed to simply picking one of the parties on more subjective grounds or out of pure whim. In addition to the practical consequences of this skeptical view, the article sketches some theoretical implications for debates about saving the greater number and about axiomatic utilitarianism. Beliefs about the moral status of children have changed significantly in recent decades in the Western world. At the same time, knowledge about likely consequences for children of individual, parental, and societal choices has grown, as has the array of choices that (prospective) parents may have at their disposal. The intersection between these beliefs, this new knowledge, and these new choices has created a minefield of expectations from parents and a seemingly ever-expanding responsibility towards their children. Some of these new (...) challenges have resulted from progress in genetics and neuroscience. It is these challenges that we focus on in this introduction and volume. (shrink)

The diagnosis of autism is on the rise. Autistic people, parents, professionals, and policy makers alike face important questions about the right approach toward autism. For example, there are questions about the desirability of early detection, the role and consequences of underlying cognitive theories, and whether autism is a disorder to be treated or an identity to be respected. How does the fact that autism is a heterogeneous concept affect the answers to these questions? Who has the authority or knowledge (...) to speak on behalf of people with autism? In this paper, we describe a cluster of research topics which should be on the agenda of the emerging field of autism ethics. These topics include the very concept of autism itself, the question whether autism is primarily an identity or a disorder, the ethical questions that parents of autistic children face, metaethical questions, the ethical consequences of epistemological questions, and a cluster of questions related to social justice, stigma, and paternalism. When are you in a position to rely on p in practical reasoning? Existing accounts say that you must know that p, or be in a position to know that p, or be justified in believing that p, or be in a position to justifiably believe it, and so on. This paper argues that all of these proposals face important problems, which I call the Problems of Negative Bootstrapping and of Level Confusions. I offer a diagnosis of these problems, and (...) I argue that an adequate epistemic norm must be transparent in the following sense: According to the correct epistemic norm, a consideration counts in favor of (or against) relying on p in practical reasoning iff, and to the extent that, this consideration also counts in favor of (or against) p being true. I introduce a candidate epistemic norm that satisfies this condition. According to this norm, one should rely on p in practical reasoning only if it must be that p. If we adopt a non-factualist account of “must”, this amounts to a novel and attractive proposal, a proposal that satisfies the transparency condition. (shrink)

A central concern of nearly every environmental ethic is its desire to extend the scope of direct moral concern beyond human beings to plants, nonhuman animals, and the systems of which they are a part. Although nearly all environmental philosophies have long since rejected modernity’s conception of individuals as isolated and independent substances, few have replaced this worldview with an alternative that is adequate to the organic, processive world in which we find ourselves. In this context, Brian G. Henning (...) argues that the often overlooked work of Alfred North Whitehead has the potential to make a significant contribution to environmental ethics. Additionally inspired by classical American philosophers such as William James, John Dewey and Charles Sanders Pierce and environmental philosophers such as Aldo Leopold, Peter Singer, Albert Schweitzer, and Arne Naess, Henning develops an ethical theory of which the seminal insight is called “The Ethics of Creativity.” By systematically examining and developing a conception of individuality that is equally at home with the microscopic world of subatomic events and the macroscopic world of ecosystems, _The Ethics of Creativity_ correctly emphasizes the well-being of wholes, while not losing sight of the importance of the unique centers of value that constitute these wholes. In this way, _The Ethics of Creativity_ has the potential to be a unique voice in contemporary moral philosophy. (shrink)

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

When we discuss normative reasons, oughts, requirements of rationality, hypothetical imperatives (or “anankastic conditionals”), motivating reasons and so on, we often use verbs like “believe” and “want” to capture a relevant subject’s perspective. According to the received view about sentences involving these verbs, what they do is describe the subject’s mental states. Many puzzles concerning normative discourse have to do with the role that mental states consequently appear to play in this discourse. This book uses tools from formal semantics and (...) the philosophy of language to develop an alternative account of sentences involving these verbs. According to this view, which is called parentheticalism (in honour of J. O. Urmson), we very commonly use these verbs in a parenthetical sense. Used with this sense, these verbs themselves express backgrounded side-remarks on the contents they embed, and these latter, embedded contents constitute the at-issue contents of our utterances. This means that instead of speaking about the subject’s mental states, we often use sentences involving “believe” and “want” to speak about the world in a way that, in the conversational background, relates our utterances to her point of view. This idea is made precise, and it is used to solve various puzzles concerning normative discourse. The final result is a new, unified understanding of normative discourse, which gets by without postulating conceptual breaks between objective and subjective normative reasons, or normative reasons and rationality, or indeed between the reasons we ascribe to an agent and the reasons she herself can be expected to cite. Instead of being connected to either subjective mental states or objective facts, all of these normative statuses can be adequately articulated by citing worldly considerations from the subject’s point of view. Marshall McLuhan understood television as a tactile medium. This understanding implied what Bruno Latour might call a ‘symmetrical’ conception of tactility. According to McLuhan, not only human actors are endowed with the sense of touch. In addition, TV, digital computers and other ‘electric media’ use light beams and similar scanning techniques for ceaselessly ‘caressing the contours’ of their surroundings. This notion of tactility was crucially shaped by the holistic aesthetics of the early Bauhaus. To get at the specific features of (...) the TV image, McLuhan relied on the writings of László Moholy-Nagy and Sigfried Giedion, in particular their use of photography for capturing and highlighting the ‘texture’ of surfaces. However, he hardly reflected the social and political factors that, in the age of electric media, contribute to the ‘symmetricization’ of touch. (shrink)

Engaging with the specific ways current media technologies interact with, or directly access the human body, we suggest developing a ‘symmetrical’ theory of touch. Critically referring to Bruno Latour’s invocation of ‘symmetrical anthropology’, we reconsider tactile agency as ‘technological agency’, arguing that the concept of touch – traditionally viewed as an exclusively human ability – should be extended to non-human actors and analysed in view of the cultural logic of capitalism. Its systematic focus, then, is on the productive intersections and (...) contact zones between biology and technology: from phenomena of non-human touch in industrial production to the material touching taking place in the instrumental grasp on the living in the 19th-century physiological laboratories and the invisible operations of tracing, tracking and sensing taking place in the technological milieus of today’s environments. In highlighting the tactile dimension of digital modernity and its economic genealogies, this article aims to advance a combined concept of human and non-human touch which provides a crucial angle for reconsidering bodies and technologies in the age of ubiquitous computing. This paper contributes to the current discussion on collective affective intentionality. Very often, affective sharing is regarded as a special feature ofamore general form of we-intentionality being already in place. In contrast to this view, the paper attempts to explicate a more elementary form of affective sharing that does not simply presuppose other forms of we-intentionality, but amounts to a primitive form of we-intentionality of its own. The account presented here draws on two conceptual tools from the broader phenomenological tradition: (...) prereflective we-intentionality on the one hand and atmospheric perception on the other. The central claim is that some instances of affective we-consciousness mainly emerge on the level of unthematic, pre-reflective orientation within one’s environment. The first part of the paper gives an account of this claim, while second part places the account in the broader discussion on collective affective intentionality. (shrink)

In general, left holds a negative connotation: A clumsy man appears linkisch in German, links meaning left, and the term translates as awkward. If you conned him, he has been gelinkt. For a long time this negative coloring was also closely associated with the image of left-handers: Left-handers were often regarded as disabled, appeared awkward and antisocial, and were exposed to discrimination. To understand the people of ancient (...) Greece and Rome, one must understand the role right and left played in their perception and evaluation of the world. Henning Wirth studies the following questions from an ancient historical perspective: How did the Greeks and Romans perceive left? What role was provided to the left hand in a dominantly right-handed world, where the right hand attested Godly effectiveness? And how does one explain the phenomenon of left-handedness and assessment of left-handed people? German text. Is phenomenology a method or a philosophy (of ?ontological? character)? This question is discussed here with a recent philosophical collection of articles about the phenomenology of sport at hand. However, one finds very few concrete phenomena in this volume, but much abstract talk about the authoritative philosophers of ontology and existentialism. This gives the ?phenomenological school? a somewhat sectarian character, which is not typical in recent contributions of phenomenology. This review essay broadens out from the current volume under consideration towards (...) a history of phenomenology and a differential phenomenology of phenomenology. It is not clear how much value the volume itself, however, has for the understanding of sport as well as for the understanding of phenomenology. Nevertheless, it documents how phenomenological scholastics approach sport, which may serve as a warning at a time when positivist reductionism seems to have also become mainstream in human and social sciences. This article sheds new light on Bruno Latour’s sociology of science and technology by looking at his early study of the French writer, philosopher and editor Charles Péguy (1873–1914). In the early 1970s, Latour engaged in a comparative study of Péguy’s Clio and the four gospels of the New Testament. His 1973 contribution to a Péguy colloquium (published in 1977) offers rich insights into his interest in questions of time, history, tradition and translation. Inspired by Gilles Deleuze’s philosophy of difference, (...) Latour reads Clio as spelling out and illustrating the following argument: ‘Repetition is a machine to produce differences with identity’. However, in contrast to Deleuze’s work (together with Félix Guattari) on the materiality of machines, or assemblages [agencements], Latour emphasizes the semiotic aspects of the repetition/difference process. As in Péguy, the main model for this process is the Roman Catholic tradition of religious events. The article argues that it is this reading of Péguy and Latour’s early interest in biblical exegesis that inspired much of Latour’s later work. In Laboratory Life (Latour and Woolgar, 1979) and The Pasteurization of France (1988) in particular, problems of exegesis and tradition provide important stimuli for the analysis of scientific texts. In this context, Latour gradually transforms the question of tradition into the problem of reference. In a first step, he shifts the event that is transmitted and translated from the temporal dimension (i.e. the past) to the spatial (i.e. from one part of the laboratory to another). It is only in a second step that Latour resituates scientific events in time. As facts they are ‘constructed’ but nevertheless ‘irreducible’. They result, according to Latour, from the tradition of the future. As a consequence, the Latourian approach to science distances itself from the materialism of Deleuze and other innovative theoreticians. (shrink)

This open access collection brings together a team of leading scholars and rising stars to consider what experimental philosophy of medicine is and can be. While experimental philosophy of science is an established field, attempts to tackle issues in philosophy of medicine from an experimental angle are still surprisingly scarce. A team of interdisciplinary scholars demonstrate how we can make progress by integrating a variety of methods from experimental philosophy, including experiments, sociological surveys, simulations, as well as history and philosophy (...) of science, in order to yield meaningful results about the core questions in medicine. This paper addresses the visual culture of late-19th-century experimental physiology. Taking the case of Johann Nepomuk Czermak as a key example, it argues that images played a crucial role in acquiring experimental physiological skills. Czermak, Emil Du Bois-Reymond and other late-19th-century physiologists sought to present the achievements and perspective of their discipline by way of "immediate visual perception." However, the images they produced and presented for this purpose were strongly mediated. By means of specifically designed instruments, such as the "cardioscope," (...) the "contraction telegraph," and the "frog pistol," and of specifically constructed rooms, so-called "spectatoriums," physiologists trained and controlled the perception of their students before allowing them to conduct experiments on their own. Studying the material culture of physiological image production reveals that technological resources such as telegraphy, photography, and even railways contributed to making physiological facts anschaulich. At the same time, it shows that the more traditional image techniques of anatomy played an important role in physiological lecture halls, especially when it came to displaying the details of vivisection experiments to the public. Thus, the images of late 19th century physiology stood half-way between machines and organisms, between books and instruments. (shrink)

Causation has always been a philosophically controversial subject matter. While David Hume’s empiricist account of causation has been the dominant influence in analytic philosophy and science during modern times, a minority view has instead connected causation essentially to agency and manipulation. A related approach has for the first time gained widespread popularity in recent years, due to new powerful theories of causal inference in science that are based in a technical notion of intervention, and James Woodward’s closely connected interventionist theory (...) of causation in philosophy. This monograph assesses five manipulationist or interventionist theories of causation, viewed as theories that purport to tell us what causation is by providing us with the meaning of causal claims. It is shown that they cannot do this, as the conditions on causation that they impose are too weak, mainly due to ineliminable circularities in their definitions of causal terms. It is then argued that a subset of Woodward’s theory can nevertheless contribute crucially to an explanation of the unique role that manipulation has in our acquisition of causal knowledge. This explanation differs from the common regularist explanation of the epistemic utility of manipulation and experiment, and it is taken to confirm several important manipulationist intuitions. However, the success of the explanation depends on (this subset of) interventionism not itself being understood as a theory of causation, but as a theory of intervention. (shrink)

In this paper, I review some of the discussions on procreative beneficence and procreative autonomy in the context of postponed motherhood and compare the considerations to the context of advanced paternal age. In doing so, I will give an overview of the main scientific findings with regard to how older age in men affects the health of future offspring. I shall demonstrate how the discrepancy between the media coverage and policies on postponed motherhood and postponed fatherhood mistakenly suggests that women (...) are more responsible than men for the health of offspring.
