A lot of attention has recently been devoted to the notion of Trustworthy AI (TAI). However, the very applicability of the notions of trust and trustworthiness to AI systems has been called into question. A purely epistemic account of trust can hardly ground the distinction between trustworthy and merely reliable AI, while it has been argued that insisting on the importance of the trustee’s motivations and goodwill makes the notion of TAI a categorical error. After providing an overview of the (...) debate, we contend that the prevailing views on trust and AI fail to account for the ethically relevant and value-laden aspects of the design and use of AI systems, and we propose an understanding of the notion of TAI that explicitly aims at capturing these aspects. The problems involved in applying trust and trustworthiness to AI systems are overcome by keeping apart trust in AI systems and interpersonal trust. These notions share a conceptual core but should be treated as distinct ones. (shrink)

AI-based technologies are increasingly pervasive in a number of contexts. Our affective and emotional life makes no exception. In this article, we analyze one way in which AI-based technologies can affect them. In particular, our investigation will focus on affective artificial agents, namely AI-powered software or robotic agents designed to interact with us in affectively salient ways. We build upon the existing literature on affective artifacts with the aim of providing an original analysis of affective artificial agents and their distinctive (...) features. We argue that, unlike comparatively low-tech affective artifacts, affective artificial agents display a specific form of agency, which prevents them from being perceived by their users as extensions of their selves. In addition to this, we claim that their functioning crucially depends on the simulation of human-like emotion-driven behavior and requires a distinctive form of transparency—we call it emotional transparency—that might give rise to ethical and normative tensions. Nowadays, physicalism is arguably the received view on the nature of mental states. Among the arguments that have been provided in its favour, the inductive one seems to play a pivotal role in the debate. Leveraging the past success of materialistic science, the physicalist argues that a materialistic account of consciousness will eventually be provided, hence that physicalism is true. This article aims at evaluating whether this strategy can provide support for physicalism. According to the standard objection raised against the (...) inductive line of reasoning, the argument would beg the question by assuming some sort of metaphysical uniformity between consciousness and the rest of the natural domain. Here, I concede that there is a way to avoid this criticism. However, I argue that the argument still fails to support physicalism due to a structural problem of justification transmission. (shrink)

Parsimony considerations are ubiquitous in the literature concerning the nature of mental states. Other things being equal, physicalist views are preferred over dualist accounts on the grounds of the fact that they do not posit new fundamental properties in addition to the physical ones. This paper calls into question the widespread assumption that parsimony can provide reasons for believing that physicalism is a better candidate than dualism for solving the mind–body problem. After presenting the theoretical core of physicalism and dualism, (...) I make explicit the meta-metaphysical assumptions the physicalist relies on when leveraging parsimony to support her view. In particular, the physicalist takes for granted that parsimony has an epistemic value in metaphysics. This point, however, is rather controversial. I argue that the most promising way to account for the epistemic value of parsimony is to ground it in the epistemic value of modesty, a higher-level theoretical virtue that has to do with the epistemic risk of a theory. Unfortunately for the physicalist, the modesty rationale does not ultimately favour physicalism over dualism. (shrink)

Risks connected with AI systems have become a recurrent topic in public and academic debates, and the European proposal for the AI Act explicitly adopts a risk-based tiered approach that associates different levels of regulation with different levels of risk. However, a comprehensive and general framework to think about AI-related risk is still lacking. In this work, we aim to provide an epistemological analysis of such risk building upon the existing literature on disaster risk analysis and reduction. We show how (...) a multi-component analysis of risk, that distinguishes between the dimensions of hazard, exposure, and vulnerability, allows us to better understand the sources of AI-related risks and effectively intervene to mitigate them. This multi-component analysis also turns out to be particularly useful in the case of general-purpose and experimental AI systems, for which it is often hard to perform both ex-ante and ex-post risk analyses. Diagnostic frameworks are essential to many scientific and technological activities and clinical practice. This study examines the main fundamental aspects of such frameworks. The three components required for all diagnoses are identified and examined, i.e. their normative dimension, temporal nature and structure, and teleological perspective.The normative dimension of a diagnosis is based on (1) epistemic values when associated with Hempel's inductive risk concerning the balance between false‐positive and false‐negative outcomes, leading to probabilistic judgements; and (2) non‐epistemic values when related to (...) ideas such as well‐being, normality, illness, etc, as idealized norms or ideal points of reference.It should be noted that medical diagnoses match the three necessary components, while some essential diagnostic frameworks – the taxonomies ofGordon andNANDA– in nursing lack some components. The main lack is normative as the most popular frameworks in nursing diagnosis seem to be descriptions of observed reality rather than normative and value‐based judgements in which both epistemic and non‐epistemic values may coexist. While growing empirical evidence suggests a continuity between human and non-human psychology, many philosophers still think that only humans can act and form beliefs rationally. In this paper, we challenge this claim. We first clarify the notion of rationality. We then focus on the rationality of beliefs and argue that, in the relevant sense, humans are not the only rational animals. We do so by first distinguishing between unreflective and reflective responsiveness to epistemic reasons in belief formation and revision. We (...) argue that unreflective responsiveness is clearly within the reach of many animals. We then defend that a key demonstration of reflective responsiveness would be the ability to respond to undermining defeaters. We end by presenting some empirical evidence that suggests that some animal species are capable of processing these defeaters, which would entail that even by the strictest standards, humans are not the only rational animals. Dispositionalism is the theory of modality according to which all (metaphysical and natural) modal truths are made true by some actual irreducibly dispositional property. The relationship between Dispositionalism and time is yet to be satisfactorily explored. In this paper we contribute to this task by examining how Dispositionalism deals with ‘dated truths’: propositions involving a specific time, e.g. “It might rain at 12.30”. We examine two possible accounts: the first, 'Dated Manifestations Strategy', is the idea that powers are very fine-grained, (...) and tend towards temporally very specific manifestations. We argue that such strategy should not be adopted, for it leads to unnecessary violations of ontological parsimony; it is unable to accommodate an ontology of platonic universals; and it is incapable of offering a principled explanation of the forward-looking nature of powers. We offer an alternative account, the "Duration Strategy", which relies on an independently determined arrow of time and the existence of some “duration facts” that specify how long a power takes to bring about its manifestation. We argue that the Duration Strategy is to be preferred. We then flesh out the account by exploring the connection between powers, duration facts, and processes. (shrink)

Taking the inspiration from some points made by Scott Sturgeon and Albert Casullo, I articulate a view according to which an important difference between undermining and overriding defeaters is that the former require the subject to engage in some higher-order epistemic thinking, while the latter don’t. With the help of some examples, I argue that underminers push the cognizer to reflect on the way she formed a belief by challenging the epistemic worthiness of either the source of justification or the (...) specific justificatory process. By contrast, overriders needn’t pose any such challenge. I also consider some problems for the proposed view, and I put forward some possible solutions. Finally, I provide some details on how undermining defeat works in different cases. (shrink)

There is a tension between Dispositionalism––the view that all metaphysical modality is grounded in actual irreducible dispositional properties––and the possibility of time travel. This is due to the fact that Dispositionalism makes it much harder to solve a potentiality-based version of the grandfather paradox. We first present a potentiality-based version of the grandfather paradox, stating that the following theses are inconsistent: 1) time travel is possible, 2) powers fully ground modality, 3) self-defeating actions are impossible, 4) time-travellers retain their intrinsic (...) powers upon time-travelling, and 5) time-travellers are ordinary agents with basic intrinsic potentialities. We then consider a number of potential solutions, and find them wanting. We argue that the metaphysical impossibility of performing a self-defeating action acts as a necessary perfect mask––while time-travel lets us “slip” the potentiality under the mask, thus generating the contradiction. The beliefs involved in the placebo effect are often assumed to be self-fulfilling, that is, the truth of these beliefs would merely require the patient to hold them. Such a view is commonly shared in epistemology. Many epistemologists focused, in fact, on the self-fulfilling nature of these beliefs, which have been investigated because they raise some important counterexamples to Nozick’s “tracking theory of knowledge.” We challenge the self-fulfilling nature of placebo-based beliefs in multi-agent contexts, analyzing their deep epistemological nature and (...) the role of higher-order beliefs involved in the placebo effect. This paper investigates the epistemic assumptions that David Lewis makes in his account of social conventions. In particular, I focus on the assumption that the agents have common knowledge of the convention to which they are parties. While evolutionary analyses show that the common knowledge assumption is unnecessary in certain classes of games, Lewis’ original account (and, more recently, Cubitt and Sugden’s reconstruction) stresses the importance of including it in the definition of convention. I discuss arguments pro et contra to (...) argue that, although the assumption might be relevant to a descriptively adequate account of social convention, it is not required for its rational reconstruction. I then point out that Lewis’ account, properly speaking, is of common reason to believe, rather than of common knowledge, and argue that, in order to formalize aptly the distinction between reason to believe and belief, standard formal epistemic models need to be supplemented with so-called awareness structures. Finally, I stress that the notion of knowledge implicit in Lewis’ text involves interesting elements that cannot be captured in the standard propositional formalizations, but need the full expressive force of quantified epistemic logic. Famously, Kripke has argued that the central portion of the Philosophical Investigations describes both a skeptical paradox and its skeptical solution. Solving the paradox involves the element of the community, which determines correctness conditions for rule-following behavior. What do such conditions precisely consist of? Is it accurate to say that there is no fact to the matter of rule following? How are the correctness conditions sustained in the community? My answers to these questions revolve around the idea that a rule (...) is followed insofar as a convention is in place. One important distinction in the debate over the nature of epistemic justification is the one between propositional and doxastic justification. Roughly, while doxastic justification is a property of beliefs, propositional justification is a property of propositions. On a rather common view, which accounts for doxastic justification in terms of propositional justification plus the so-called ‘basing relation’, propositional justification is seen as the prior notion, and doxastic justification is explained in terms of it. According to the opposing view, the direction of (...) explanation needs to be reversed, and doxastic justification should be seen as primary. I distinguish between two notions of priority, and I argue that they give different verdicts with respect to the issue of which notion of justification comes first. The lesson may be taken to be that propositional and doxastic justification are in a relation of intertwinement. (shrink)

In recent decades, it has often been argued by environmental ethicists that human beings and the natural world ought to be considered as equals in some basic sense. The aim of this paper is to make sense of this view by examining what role, if any, the idea of equality ought to play in environmental ethics. Specifically, we have two aims: the first aim is to identify those environmental claims that are distinctively egalitarian. The second aim is to show these (...) claims do not rest on a principled and convincing justification. Our main contention is therefore that equality has no place in environmental ethics. There are other promising ways to argue that our relationship with the natural environment must be fundamentally revised. By bringing clarity to this debate and dispelling the possibility of equality-based arguments, we hope to contribute to this endeavor. (shrink)

This paper develops a novel theory of the meaning of moral equality. This theory has two original and significant implications: first, it shows—contra what is commonly held in the literature—that adults and children are not always each other’s equals; rather, the former are sometimes inferior and sometimes superior to the latter, depending on the interest at stake. The principle of moral equality is one of the cornerstones of any liberal theory of justice. It is usually assumed that persons’ equal moral status should be grounded in the equal possession of a status-conferring property. Call this the property-first approach to the basis of moral equality. This approach, however, faces some well-known difficulties: in particular, it is difficult to see how the possession of a scalar property can account for persons’ equal moral status. A plausible way of circumventing such (...) difficulties is to explore another avenue for the justification of persons’ equal moral status: moral equality should be grounded in the wrongness of treating others as inferiors. Call this the relation-first approach to the basis of moral equality. This paper aims at providing some reasons as to why this approach should be rejected and clarifying why the property-first approach still represents the most promising way of justifying our commitment to moral equality. Two objections will be pressed against the relation-first approach: first, grounding moral equality in the wrongness of treating others as inferiors gives rise to some disturbing normative implications; second, relation-first accounts cannot vindicate the idea that a range of beings has equal fundamental rights. This, however, is precisely what an account of moral equality is meant to justify. The paper, then, concludes that the relation-first approach fails to provide a plausible answer to the question of the basis of moral equality. Property-first accounts, whatever problems they encounter, are still more viable in principle. (shrink)

This study addresses the question of normative analysis of the value‐based aspects of nursing. In our perspective, values in science may be distinguished into (i) epistemic when related to the goals of truth and objectivity and (ii) non‐epistemic when related to social, cultural or political aspects. Furthermore, values can be called constitutive when necessary for a scientific enterprise, or contextual when contingently associated with science. Analysis of the roles of the various forms of values and models of knowledge translation provides (...) the ground to understand the specific role of values in nursing. A conceptual framework has been built to classify some of the classical perspectives on nursing knowledge and to examine the relationships between values and different forms of knowledge in nursing. It follows that adopting a normative perspective in the analysis of nursing knowledge provides key elements to identify its proper dimension. (shrink)

In this paper I address issues related to the problem of future contingents and the metaphysical doctrine of fatalism. Two classical responses to the problem of future contingents are the third truth value view and the all-false view. According to the former, future contingents take a third truth value which goes beyond truth and falsity. According to the latter, they are all false. I here illustrate and discuss two ways to respectively argue for those two views. Both ways are similar (...) in spirit and intimately connected with fatalism, in the sense that they engage with the doctrine of fatalism and accept a large part of a standard fatalistic machinery. We focus on Timothy Williamson’s recent attack on the epistemological significance of the a priori–a posteriori distinction, and offer an explanation of why, fundamentally, it does not succeed. We begin by setting out Williamson’s core argument, and some of the background to it and move to consider two lines of conciliatory response to it—conciliatory in that neither questions the central analogy on which Williamson's argument depends. We claim, setting aside a methodological challenge to which Williamson owes an answer, that no (...) satisfactory such reconciliation is in prospect. Rather, as we then argue, —and it is on this that we base our overall negative assessment of his argument—Williamson’s core analogy is flawed by an oversight. We conclude with some brief reflections on Williamson’s ideas about the imagination as a source of knowledge. Our principal conclusion is only that Williamson’s argument fails to perform as advertised. A constructive case for confidence, to the contrary, that the intuitive contrast between a priori and a posteriori reflects something of fundamental epistemological significance is prefigured in our final section, but will not be elaborated here. This essay gives an account of epistemic deference for agents with imprecise credences. I look at the two main imprecise deference principles in the literature, known as Identity Reflection and Pointwise Reflection (Moss, 2021). I show that Pointwise Reflection is strictly weaker than Identity Reflection, and argue that, if you are certain you will update by conditionalisation, you should defer to your future self according to Identity Reflection. Then I give a more general justification for Pointwise and Identity Reflection from (...) the assumption that you defer to someone whenever you consider their doxastic state to be better than yours, in the sense of leading to better decision-making. Among the many possible approaches to dealing with logical omniscience, I consider here awareness and impossible worlds structures. The former approach, pioneered by Fagin and Halpern, distinguishes between implicit and explicit knowledge, and avoids logical omniscience with respect to explicit knowledge. The latter, developed by Rantala and by Hintikka, allows for the existence of logically impossible worlds to which the agents are taken to have access; since such worlds need not behave consistently, the agents’ knowledge is fallible relative to logical (...) omniscience. The two approaches are known to be equally expressive in propositional systems interpreted over Kripke semantics. In this paper I show that the two approaches are equally expressive in propositional systems interpreted over Montague-Scott (neighborhood) semantics. Furthermore, I provide predicate systems of both awareness and impossible worlds structures interpreted on neighborhood semantics and prove the two systems to be equally expressive. (shrink)

This paper addresses a particular interpretation of quantum mechanics, i.e. superdeterminism. In short, superdeterminism i) takes the world to be fundamentally deterministic, ii) postulates hidden variables, and iii) contra Bell, saves locality at the cost of violating the principle of statistical independence. Superdeterminism currently enjoys little support in the physics and philosophy communities. Many take it to posit the ubiquitous occurrence of hard-to-digest conspiratorial and coincidental events; others object that violating the principle of statistical independence implies the death of the (...) scientific methodology. In this paper, we offer a defense to these and other objections. To counter the conspiracy objection, we draw upon the philosophical literature on time travel, and conclude that the picture of the world offered by the superdeterminist does not need to be particularly surprising or conspiratorial. We then move on to other recent objections, in particular those that focus on the methodology of science and the nature of the physical laws compatible with superdeterminism. A key ingredient of our arguments is that the principle of statistical independence may be violated in theory, but valid for practical purposes. Our overarching goal is to offer a defense of superdeterminism with respect to its main objections, so that it can earn its keep as a legitimate contender among the possible interpretations of quantum mechanics. In his recent book, Humanity without Dignity: Moral Equality, Respect, and Human Rights, Andrea Sangiovanni argues that the principle of moral equality should be grounded in the wrongness of treating others as inferiors insofar as this constitutes an act of social cruelty. In this short piece, I will raise two concerns about the rejection of social cruelty as the basis of moral equality: first, Sangiovanni’s account seems to give rise to disturbing implications as to how those beings that have basic (...) moral status relate to each other. Branching time is a popular theory of time that is intended to account for the openness of the future. Generally, branching-time models the openness of the future by positing a multiplicity of concrete alternative futures mirroring all the possible ways the future could unfold. A distinction is drawn in the literature among branching-time theories: those that make use of moment-based structures and those that employ history-based ones. In this paper, I introduce and discuss a particular kind of openness relative to (...) the possibility that time ends (doomsday). I then show that whereas moment-based branching structures cannot represent this kind of openness, history-based structures can account for it. The conclusion is that history-based structures have an advantage over moment-based ones. (shrink)

The goal of this paper is to defend the general tenet that time travelers cannot change the past within B-theoretical models of time, independently of how many temporal dimensions there are. Baron Pacific Philosophical Quarterly, 98, 129–147 offered a strong argument intended to reach this general conclusion. However, his argument does not cover a peculiar case, i.e. a B-theoretical one-dimensional model of time that allows for the presence of internal times. Loss Pacific Philosophical Quarterly, 96, 1–11 used the latter model (...) to argue that time travelers can change the past within such model. We show a way to debunk Loss’s argument, so that the general tenet about the impossibility of changing the past within B-theoretical models is maintained. (shrink)

Hybrid organisations combine different elements from the for-profit and non-profit domains, and they usually operate in a resource-scarce environment. For these reasons, they continuously face various resources constraints, yet their hybrid nature could be translated into an opportunity. The purpose of our study was to investigate how a hybrid organisation can overcome resource constraints in developing countries by exploiting their own hybrid nature. In the unique research setting offered by Kenyan social enterprises, we identified five creative approaches implemented by social (...) enterprises. Finally, we present a grounded model that clearly explains which hybrid harvesting strategies can be implemented to overcome resource constraints, exploiting their hybrid potential. Our work contributes to knowledge about resource constraints in the social entrepreneurship literature and extends social bricolage theory. This paper generalises an argument for probabilism due to Lindley [9]. I extend the argument to a number of non-classical logical settings whose truth-values, seen here as ideal aims for belief, are in the set $\{0,1\}$, and where logical consequence $\models $ is given the “no-drop” characterization. First I will show that, in each of these settings, an agent’s credence can only avoid accuracy-domination if its canonical transform is a (possibly non-classical) probability function. In other words, if an agent values (...) accuracy as the fundamental epistemic virtue, it is a necessary requirement for rationality that her credence have some probabilistic structure. Then I show that for a certain class of reasonable measures of inaccuracy, having such a probabilistic structure is sufficient to avoid accuracy-domination in these non-classical settings. (shrink)

This article explores the relevance of ontological assumptions for justifications of agency and ethics. It critiques Kantian ethics for being based upon an ontological imaginary that starts from the substantialism of Newtonian physics. Substantialism shapes Western political philosophy’s view about who we are as subjects and how the world works. In this ontological imaginary, validation of ethics is based upon universality and abstractions. Furthermore, Kantian ethics underscores an anthropocentric and theocratic vision of how to govern societies. I argue Kantian criteria (...) are not only insufficient to make good choices but are also conducive to wrong ones, since they elicit self-appeasement in international intervention, and contribute to the conceptual repertoire of coloniality. I propose that an ontology of entanglements opens possibilities for overcoming the shortcomings of an ethos based upon abstractions and possibly for correcting some of its moral failures. In a quantum ontological imaginary, the validation of ethical choices relies instead upon the exploration of the apparatuses we deploy, as well as upon careful situational evaluation. Specific practices, rather than an abstract humanity, are the referents for devising such ethos. This position, I argue, resonates with the critical project of decoloniality and its acknowledgment of the political salience of ontological imaginaries. (shrink)

I extend the Higher-Order View of Undermining Defeat (HOVUD) defended in Melis (2014) to account for the defeat of propositional justification. In doing so, I clarify the important notion of higher-order commitment, and I make some considerations concerning the defeat of externalist epistemic warrants.

O artigo tem por objectivo mostrar até que ponto o princípio de subjectividade presente na Escola Austríaca de Economia se revela fundamentado na tradição fenomenològica de Edmund Husserl e no seu pensamento acerca da constituição intersubjectiva do mundo da vida. Nesse sentido, o autor propõe uma hermenêutica realista, e não relativista, posicionando-se em função de um projecto mais global de fundamentar na hermenêutica algumas das principais posições da Escola Austríaca de Economia, pelo que o artigo propõe significativas pistas para uma (...) releitura não só da praxeologia de Ludwig von Mises e da ordem espontânea de que fala Friedrich von Hayek, mas também da noção de middle ground proposta por Israel Kirzner e, não menos, de toda a temática relacionada com a empresarialidade. Por outro lado, posicionando-se numa perspectiva de superação da dialéctica entre teoria e história, entre "a priori" e "a posteriori", o artigo representa também uma chamada de atenção para a importância que deveria ter o estudo do pensamento de Edmund Husserl no âmbito das Ciências Sociais. This article aims in the first place at demonstrating how Edmund Husserl's idea of the intersubjective constitution of the life-world represents an appropriate explanation of the principle of subjectivity inherent to the theorizing of the Austrian School of Economics. In order to do this, the author proposes a realistic and non-relativistic view of hermeneutics, whereby his goal is precisely to demonstrate how much the Austrian School of Economics is grounded in hermeneutics. In this sense, the article suggests a new reading of Ludwig von Mises's praxeology, of Friedrich von Hayek's theory of the spontaneous order and a reinterpretation of Israel Kirzner's middle ground position and the corresponding theory of alertness. Positioning itself beyond the discussion between theory and history, or the debate if the prevalence should belong to the "a priori" or to the "a posteriori", the article suggests that Husserl's phenomenology should be considered as a road that deserves to be taken by all social sciences. Accuracy-first epistemologists argue that rational agents have probabilistically coherent credences. But why should we care, given that we can’t help being incoherent? A common answer: probabilistic coherence is an ideal to be approximated as best one can. De Bona (in: Philos Sci 84(2), 189–213, 2017) and Staffel (in: Unsettled thoughts: a theory of degrees of rationality, Oxford University Press, 2019) show how accuracy-firsters can spell out this answer by adopting an appropriate notion of approximate coherence. In this essay, I argue (...) that De Bona and Staffel’s proposal is not entirely satisfactory, because it does not show whether, or why, it’s generally better to be more rather than less approximately coherent from an accuracy-first perspective. To address this point, I give a characterisation of their notion of approximate coherence in terms of accuracy. This shows that accuracy-firsters should maintain that more approximately coherent credences are better than less approximately coherent ones _if and only if_ they accept that it’s better to miss out on less rather than more guaranteed accuracy. Nursing knowledge stems from a dynamic interplay between population‐based scientific knowledge (the general) and specific clinical cases (the particular). We compared the ‘cascade model of knowledge translation’, also known as ‘classical biomedical model’ in clinical practice (in which knowledge gained at population level may be applied directly to a specific clinical context), with an emergentist model of knowledge translation. The structure and dynamics of nursing knowledge are outlined, adopting the distinction between epistemic and non‐epistemic values. Then, a (moderately) emergentist approach (...) to nursing knowledge is proposed, based on the assumption of a two‐way flow from the general to the particular and vice versa. The case of the ‘placebo effect’ is analysed as an example of emergentist knowledge. The placebo effect is usually considered difficult to be explained within the classical biomedical model, and we underscore its importance in shaping nursing knowledge. In fact, nurses are primarily responsible for administering placebo in the clinical setting and have an essential role in promoting the placebo effect and reducing the nocebo effect. The beliefs responsible for the placebo effect are as follows: (1) interactive, because they depend on the relationship between patients and health care professionals; (2) situated, because they occur in a given clinical context related to certain rituals; and (3) grounded on higher order beliefs concerning what an individual thinks about the beliefs of others. It is essential to know the clinical context and to understand other people's beliefs to make sense of the placebo effect. The placebo effect only works when the (higher order) beliefs of doctors, nurses and patients interact in a given setting. Finally, we argue for a close relationship between placebo effect and nursing knowledge. (shrink)

Standard liberal theories of justice rest on the assumption that only those beings that hold the capacity for moral personality have moral status and therefore are right-holders. As many pointed out, this has the disturbing implication of excluding a wide range of entities from the scope of justice. Call this the under-inclusiveness objection. This paper provides a response to the under-inclusiveness objection and illustrates its implications for liberal theories of justice. In particular, the paper defends two claims: first, it argues (...) that both the CMP and the potential capacity for moral personality are bases of moral status. This pluralist account of the basis of moral status can broaden the scope of justice and provide a solid philosophical justification for the common-sense intuition that almost all human beings have a moral status that is different and superior to that of nonhuman animals. Second, contra what is commonly suggested, it contends that potential and actual moral persons have different and unequal rights, other things being equal. (shrink)

The question of the basis of human equality has recently gained increasing attention. However, much of the literature has focused on whether persons—understood as fully competent adults—have equal moral status, while relatively less attention has been devoted to the analysis of what grounds the equal moral status of those human beings who are not fully competent adults. This paper contributes to this debate by addressing the question of the equality of moral status between adults and children. Specifically, this paper has (...) three aims. First, it provides a conceptual map of this complex issue. Second, it argues that the challenges that have been raised against standard accounts of persons’ equal moral status are even more forceful when applied to the question of adults and children’s moral equality. Finally, it examines what a commitment to adults and children’s moral _inequality_ entails and what it does not, thereby showing that the justificatory role of the principle of moral equality is not as far-reaching as commonly assumed.
