This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

The study of biodiversity spans many disciplines and includes data pertaining to species distributions and abundances, genetic sequences, trait measurements, and ecological niches, complemented by information on collection and measurement protocols. A review of the current landscape of metadata standards and ontologies in biodiversity science suggests that existing standards such as the Darwin Core terminology are inadequate for describing biodiversity data in a semantically meaningful and computationally useful way. Existing ontologies, such as the Gene Ontology and others in the Open (...) Biological and Biomedical Ontologies (OBO) Foundry library, provide a semantic structure but lack many of the necessary terms to describe biodiversity data in all its dimensions. In this paper, we describe the motivation for and ongoing development of a new Biological Collections Ontology, the Environment Ontology, and the Population and Community Ontology. These ontologies share the aim of improving data aggregation and integration across the biodiversity domain and can be used to describe physical samples and sampling processes (for example, collection, extraction, and preservation techniques), as well as biodiversity observations that involve no physical sampling. Together they encompass studies of: 1) individual organisms, including voucher specimens from ecological studies and museum specimens, 2) bulk or environmental samples (e.g., gut contents, soil, water) that include DNA, other molecules, and potentially many organisms, especially microbes, and 3) survey-based ecological observations. We discuss how these ontologies can be applied to biodiversity use cases that span genetic, organismal, and ecosystem levels of organization. We argue that if adopted as a standard and rigorously applied and enriched by the biodiversity community, these ontologies would significantly reduce barriers to data discovery, integration, and exchange among biodiversity resources and researchers. Dōgen Kigen (1200–1253 ce) is one of the most revered figures in the history of Japanese culture. A Zen master regarded by the Sōtō School as its spiritual founder, Dōgen is also considered by many to be Japan's greatest philosopher. (The other major contender is kūkai, with whose philosophy Dōgen's shares a number of features.) Possessed of a prodigious and subtle intellect, and master of a strikingly poetic style, he surely ranks among the world's most formidable thinkers.

The relationship between body and mind was traditionally discussed in terms of immortality of the intellect, because immateriality was one necessary condition for the mind to be immortal. This appeared to be an issue of metaphysics and religion. But to the medieval and Renaissance thinkers, the essence of mind is thinking activity and hence an epistemological feature. Starting with John Searle’s worries about the existence of consciousness, I try to show some parallels with the Aristotelian Pietro Pomponazzi (1462–1525), and (...) eventually show the Neoplatonic approach in Marsilio Ficino (1433–1499). The guiding question is: how can one philosophically address the problem of cognition in terms of corporeality and incorporeality? He proposes a method of study for Renaissance thinkers and exemplifies it with two key figures and with the concept of honor. A survey of the field of study and an appendix concerning Renaissance research in the US conclude the book."The Renaissance" as a field of research between the Middle Ages and what is now cowardly called "Early Modern" became legitimate through the awakening of national consciousness in the nineteenth century. Consequently, the emphasis lay on vernacular language works in Italy and elsewhere. Latin Renaissance literature never was worthy of Grossforschung, i.e., of national projects like the academy enterprises concerning world history or classical studies, even though classical philology originated in the humanists' emulation of the ancients. This however would be absorbed by the nineteenth-century idea of national character (12).Italian Hegelianism of the nineteenth and early-twentieth century included Renaissance philosophy in the evolution of national spirit, and the late Eugenio Garin as its pupil spent his scholarly life portraying with astounding precision and detail Italian Humanism and Renaissance as a dialectic and rational development. The problem with both approaches, that of Garin and that of Kristeller, is that those philosophers who ignore history (deliberately or incidentally) and those who lost an understanding of metaphysics do not know how to read Renaissance thinkers.'Microhistory' is the formula Celenza proposes: Richard Rorty's abolishing the notion of 'representing' reality in favor of evocation and conversation—both for the interpretation of the past and the past itself—and Pierre Bourdieux's notions of 'field' and 'relational thinking' open the possibility of locating past thinkers in their community and, consequently, the meaning of their philosophical endeavor. Valla's discoveries in Greek and Latin philology and Ficino's experiments with magic are part of their scrutiny of orthopraxy (my term), the right way of Christian life, and are embedded in their conversations with friend and foe, who in some cases still await discovery. We reduce to a standard circuit-size complexity problem a relativisation of the $P = NP$ question that we believe to be connected with the same question in the model for computation over the reals defined by L. Blum, M. Shub, and S. Smale. On this occasion, we set the foundations of a general theory for computation over an arbitrary structure, extending what these three authors did in the case of rings.

In his long scholarly career, Paul Oskar Kristeller produced an extraordinary number of seminal books and articles, one of which was the 1967 monograph Le Thomisme et la pensée italienne de la Renaissance, which presented the evidence for the intellectual vitality of Thomism in the Italian Renaissance. SeitzThe Tenth Conference of the European Network of Buddhist-Christian Studies (ENBCS) brought together between sixty and seventy people at the Oude Abdij, Drongen, Belgium, between 27 June and 1 July 2013, to examine the theme “History as a Challenge to Buddhism and Christianity.” It was (...) a collaborative effort between the ENBCS and the Katholieke Universiteit Leuven. The 2011 ENBCS conference had focused on whether hope was a relevant concept for Buddhists and Christians. The choice of history as a theme complemented this. It also resonated with a research concern of both KU Leuven and the Network.Five key themes were chosen for examination: the traditional Christian and Buddhist conceptions of history; Jesus and the Buddha: fact and fiction; Buddhist and Christian historiography; dangerous memory in Christianity and Buddhism; and permitting historical consciousness in Buddhism and Christianity. Each was approached from a Buddhist and a Christian perspective. Stereotypes are false or misleading generalizations about groups, generally widely shared in a society, and held in a manner resistant, but not totally, to counterevidence. Stereotypes shape the stereotyper’s perception of stereotyped groups, seeing the stereotypic characteristics when they are not present, and generally homogenizing the group. The association between the group and the given characteristic involved in a stereotype often involves a cognitive investment weaker than that of belief. The cognitive distortions involved in stereotyping lead to various forms of (...) moral distortion, to which moral philosophers have paid insufficient attention. Some of these are common to all stereotypes—failing to see members of the stereotyped groups as individuals, moral distancing, failing to see subgroup diversity within the group. Other moral distortions vary with the stereotype. Some attribute a much more damaging or stigmatizing characteristic (e.g. being violent) than others (e.g. being good at basketball). But the characteristic in question must also be viewed in its wider historical and social context to appreciate its overall negative and positive dimensions. (shrink)

The Renaissance was a period of great intellectual change and innovation as philosophers rediscovered the philosophy of classical antiquity and passed it on to the modern age. Renaissance philosophy is distinct both from the medieval scholasticism, based on revelation and authority, and from philosophers of the seventeenth and eighteenth centuries who transformed it into new philosophical systems. Despite the importance of the Renaissance to the development of philosophy over time, it has remained largely understudied by historians of philosophy and professional (...) philosophers. This anthology aims to correct this by providing scholars and students of philosophy with representative translations of the most important philosophers of the Renaissance. Its purpose is to help readers appreciate philosophy in the Renaissance and its importance in the history of philosophy. This book demonstrates that ancient Christian Gnosticism was an ancient form of cultural criticism in a mythological garb. It establishes that, much like modern forms of critical theory, ancient Gnosticism was set on deconstructing mainstream discourses and cultural premises. Strains of critical theory dealt with include the Frankfurt School, queer theory, and poststructural philosophy. The book documents how in both ancient Gnosticism and modern critical theories issues that used to serve as premises for discussion or as concepts relegated to the (...) realms of the “natural” and the “given” in their respective historical contexts, are transformed into objects of contention. The main aim of this book is to salvage the historical category of Gnosticism from its present scholarly disavowal, if only because Gnosticism, when read as a cultural, and not only a religious phenomenon, presents us an ancient form of culture criticism which would be hard to parallel until (post) modernity. While Hans Jonas remarked many years ago that “something in Gnosticism knocks at the door of our Being and of our twentieth-century Being in particular,” by the 21st century global world this something has already entered and lives with us. In discussing his conceptions of history and time, however, it is the aim of this paper only to locate these within his own philosophy. The earlier writings conform to the usual humanist literary topics: the political program of a città felice, the treatises on honor, the poetic fury, Petrarch (1553), and then his two dialogues on history (1560) and rhetoric (1562). The two works which followed, the Discussiones peripateticae (1571) and the Poetics (1586), show a characteristic development of humanist thinking, namely, the differentiation of purely philological from essentially philosophical literature.Patrizi's Discussiones peripateticae 5 is a polemic against Aristotle, written from a Platonic viewpoint, but his own philosophy is concealed under a mass of philological material. In an attempt that seeks to be virtually definitive, he cites passages from Aristotle and the Peripatetic tradition in order to point out mistakes and contradictions. It was on this account that Giordano Bruno heaped ridicule on him, calling him "sterco di pedanti." Simply put, he tells us, Patrizi demonstrates "how like he is to an ox or an ass." One cannot say that he has understood Aristotle either well or ill, but merely that he has read him and reread him, cut him up and stitched him together, compared him with a thousand other Greek writers, friends and foes alike, and altogether gone to an immense deal of trouble, not only to no purpose whatsoever but also to our infinite disappointment. Cognition and Temporality argues that both verbal grammar and figural grammar have their cognitive basis in twelve characteristic forms of judgment, distributed among individuals in human populations throughout history. These twelve logical forms are context-free and language-free foundations in our attentional awareness, and shape all verbal and figural statements. Moreover, these types of historical judgment are psychogenetic inheritances in a population, and each serves a distinct problem-solving function in the human species. Through analysis of verbal and figural statements, the author (...) contends, the researcher can find evidence of these forms of judgment, and in turn analyze how the event to which those statements attend is formally constructed by that judgment. This construction guides how the event is assessed, approached, and engaged in the process of problem-solving. Artists and aestheticians in the early twentieth century--including Wassily Kandinsky, Stephen C. Pepper, and Andrew Paul Ushenko--have all posited an inherited attentional perspective in individuals, manifested in the logical correspondence between their distinctive verbal and figural grammars. Cognition and Temporality elaborates these claims, arguing that while the styles of well-known artists and writers are conditioned by the public styles of a particular time period, variations in personal style manifest one's inherited form of judgment, and the characteristic grammars that express that form. Through rigorous visual and stylistic analysis, the author demonstrates the expression of these forms among notable writers and artists across history. W. F. Stone, editors. Humanism and Early Modern Philosophy. New York: Routledge, 2000. Pp. xii + 270. Cloth, $75.00 Early-modern philosophy begins in the seventeenth century. This book, based on a colloquium at the Warburg Institute, London in 1997, strives at extending the limits of (...) this period into the sixteenth and fifteenth centuries. Thus "the long-standing exclusion of the Renaissance from the standard philosophical curriculum" (xii) should come to an end by acknowledging its being an integral part of early modern philosophy and its relevance for an understanding of modern thought. The distinctive element of the Renaissance was, according to the editors, humanism, understood as the revival of ancient sources from the fourteenth century on, and its impact on the shaping of modern thought by these sources.One can identify the following types of argument offered in the twelve contributions to this book: (1) Renaissance humanists mediated classical sources into the seventeenth and following centuries either by translating Greek texts into Latin (Lohr on Aristotle commentaries) or by offering new interpretations that were to become standard (Hankins on Ficino and Galileo, and Mercer on the German Platonists). (2) Ancient modes of thought, mediated through the Renaissance, shaped modern philosophy (Stone on Aristotelian and Reformed ethics, Levi on Stoicism in Justus Lipsius, Kraye on Marcus Aurelius editions, and Osler on Gassendi and Aristotle). (3) Humanist literary forms and mentalities survived in modern thought (Bianchi on dialogue, Vickers on rhetoric in Bacon, and James on 'grandeur' and scientific argument).Two papers do not fit into this scheme: in "The Theology of Lorenzo Valla," the only paper dealing directly with a Renaissance humanist, Monfasani wants to prove that "Valla was no theologian." Monfasani does this on the basis of a very narrow concept of dogmatic correctness, blaming Valla continuously for being banal, to the effect that the paper does not contribute to the topic of the book. One could well connect Valla's theological issues (free will, summum bonum, trinity, etc.) with his provocative stirring up of philosophy in general and show his influence on Protestant theology and on modern ethics.The other paper is by J. R. Milton, which is enlightening because it summarizes the prejudices against humanism in modern philosophy ("'Delicate learning,' erudition and the enterprise of philosophy"). He endorses "one of the most familiar narratives in European philosophy" (161), namely that Descartes's breakthrough was due to his total rupture [End Page 121] with the philosophical tradition, especially with contemporary humanist and scholastic thought. Thus Descartes's triumph was that of the myth of the irrelevance of history to philosophy as evident in Galileo, Locke, and even Hume. If antecedents are acknowledged, e.g., in Berkeley, then accepting that they "provide us either with an irreplaceable source of wisdom or with equally irreplaceable models for imitation, or indeed both" (167), still fails to recognize that the history of a philosophical problem is a part of that problem rather than just some general "wisdom" or a model for imitation. Of course, Milton repeats the myth of Bacon's anti-humanism, masterly refuted in this very book by Brian Vickers, and Milton believes that Valla "enthroned" "custom and example" and therefore for him "it would be difficult if not impossible to state Hempel's Raven Paradox" (169). One might wonder whether the conclusion: "All ravens are black --all non-black things are non-ravens," is the paramount of modern philosophy. But a thorough reader of Valla's logic might discover similarities to pragmatism, which are fostered by his deep criticism of language with the tools of Renaissance humanism. However, Descartes's indebtedness to Renaissance method and rhetoric is handbook knowledge today.The audience for this collection of samples are specialists either in seventeenth- or eighteenth-century philosophy, or in Renaissance thought, or even philosophers in the narrow sense of the disciplines. Emmanuel Levinas's concept of "the face of the Other" involves an ethical mandate that is presumably transcultural or, in his terms, "precultural." His essay "Meaning and Sense" provides his most explicit defense of the idea that the face has a meaning that is not culturally relative, though it is always encountered within some particular culture. Levinas identifies his position there as a "return to Platonism." Through a careful reading of that essay, exploring Levinas's use of religious terminology and the (sometimes (...) implicit) relationships of the essay to the work of other phenomenologists and of Saussure, the author seeks to clarify (1) what Levinas retains and what he rejects in returning to Platonism "in a new way," (2) the sense in which this return constitutes an "overcoming" of relativism, and (3) the nature of the phenomenological warrant that he offers for his position. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)
