The issue of detention as a public health control measure has attracted attention recently. This is because the threat of strains of tuberculosis that are resistant to a wider range of drugs has been identified, and there is renewed concern that public health is threatened. This paper considers whether involuntary detention is justified where voluntary measures have failed or where a patient poses a danger, albeit uncertain, to the public. We discuss the need for strengthening evidence-based assessments of public health (...) risk and suggest that we should refect more profoundly on the philosophical foundations upon which our policies and practices are grounded. In recent years, global corporations and national governments have been enacting a growing number of codes of conduct and public regulations to combat dangerous and degrading work conditions in global supply chains. At the receiving end of this activity, local producers must contend with multiple regulatory regimes, but it is unclear how these regimes interact and what results, if any, they produce. This article examines this dynamic in the sugar sector in Brazil. It finds that although private and public agents (...) rarely communicate, let alone coordinate with one another, they nevertheless reinforce each other’s actions. Public regulators use their legal powers to outlaw extreme forms of outsourcing. Private auditors use the trust they command as company insiders to instigate a process of workplace transformation that facilitates compliance. Together, their parallel actions block the low road and guide targeted firms to a higher road in which improved labor standards are not only possible but even desirable. (shrink)

Private, voluntary compliance programs, promoted by global corporations and nongovernmental organizations alike, have produced only modest and uneven improvements in working conditions and labor rights in most global supply chains. Through a detailed study of a major global apparel company and its suppliers, this article argues that this compliance model rests on misguided theoretical and empirical assumptions concerning the power of multinational corporations in global supply chains, the role information plays in shaping the behavior of key actors in these production (...) networks, and the appropriate incentives required to change behavior and promote improvements in labor standards in these emergent centers of global production. The authors argue that it is precisely these faulty assumptions and the way they have come to shape various labor compliance initiatives throughout the world—even more than a lack of commitment, resources, or transparency by global brands and their suppliers to these programs—that explain why this compliance-focused model of private voluntary regulation has not succeeded. In contrast, this article documents that a more commitment-oriented approach to improving labor standards coexists and, in many of the same factories, complements the traditional compliance model. This commitment-oriented approach, based on joint problem solving, information exchange, and the diffusion of best practices, is often obscured by the debates over traditional compliance programs but exists in myriad factories throughout the world and has led to sustained improvements in working conditions and labor rights at these workplaces. John Locke's Second Treatise of Government is a ringing defense of individual liberty and individual moral rights, including rights to private property. Locke calls for limited government, takes some steps toward promoting the moral rights of women. Locke espouses a theological ethics, and is adamant in asserting that no one acquires political obligations to obey the established authorities except by her free and voluntary consent. Locke proclaims that all normal human individuals are free and equal persons, (...) and takes this to be compatible with inequality in people's possessions and opportunities. Just this short listing of some of Locke's ideas indicates that they reverberate throughout the tradition of modern liberal political thought. This chapter discusses some themes in Locke's writing that are prominent features in one or another version of modern liberalism. In his “Méthode nouvelle,” an anonymous article in the Bibliothèque universelle of 1686, John Locke described his way of collecting excerpts in notebooks and retrieving relevant entries. The well‐known practice of entering textual passages in commonplace books sits uneasily with Locke's criticism of received opinion and authority. Is it possible that he used any of these notes to think with? I suggest that the conditions for this were provided by Locke's interactions with some of his notes, including (...) those which recorded observations, testimonies and experiments. As well as labelling excerpts and other notes with topical Titles, Locke sometimes added precise bibliographical citations, transferred material across notebooks, interpolated his own signed reflections and queries, and (eventually) dated entries. In IV, xvii, 19–22 of his Essay, Locke employs Latin labels for four kinds of argument, of which one (ad hominem) was already in circulation and one (ad judicium) has never had much currency. The present proposal seeks to locate and clarify what Locke was aiming to describe, and to contrast what he says with some subsequent uses that have been made of these labels as if they named fallacies. As the title intimates, my aims in this essay are twofold: first, I wish to defend the claim that there are radical dimensions to John Locke's thought, and by extension, that there are radical dimensions to the tradition of discourse which seeks to provide an intellectual defence for the social practices and institutional structures characteristic of a market society and a democratic political system insofar as such an intellectual defence is dependent upon or makes use of certain Lockean statements (...) and arguments. As this objective maps out a rather large and exceedingly difficult terrain for discussion, prudence dictates that I provide the reader with a brief clarification of the direction and limitations of this part of my argument before indicating the second and, in my view, more difficult problem to be addressed. A generation ago, the field of business ethics largely abandoned analyzing the broader issue of social justice to focus upon more micro concerns. Donaldson applied the social contract tradition of Locke and Rawls to the ethics of management decision-making, and with Dunfee, has advanced this project ever since. Current events suggest that if the field is to remain relevant it needs to return to examining social and economic fairness, and Rawl's approach to social contracting suggests a way to start. (...) First, however, the field needs to discard the weaker and counterproductive aspects of its Lockean legacy: Locke's hostility to government activism and his indifference with regard to outcomes for the bulk of society. Donaldson's and Dunfee's social contracting approach is not suited to, nor was it designed to, analyze or resolve broad issues of social and economic justice. Their postulated network of communities upon which they rely is problematic in a number of ways, and while they take the legal and political status quo into account, their method does not deal with the historical reality that, as the economic and social environment changes, promoting greater justice requires new and sometimes coercive government interventions. Rawls's work, however, does acknowledge the historically demonstrable necessity of using the power of government to help to achieve desirable social outcomes. While he rejected Mill's methodology, Rawls was inspired by the earlier philosopher's concerns for social justice at a time of major economic change. The field would do well to follow the example of both men in this respect. (shrink)

Gerald Gaus’s latest book achieves a remarkable, definitive development of the public reason project whose roots can be traced back to Locke and Kant and which had already attained its full expression in the later writing of John Rawls—or so we had thought! In fact Gaus takes a long step beyond Rawls.Gaus (2011). Page numbers enclosed in parentheses of the text refer to this book. For John Rawls on public reason, see especially his A Theory of Justice (1999); also (...) Rawls (1996). In my view we should have a raised eyebrows response to the public reason project, but this does not gainsay Gaus’s achievement in rigorously working out its implications. The book develops an account of the justified imposition of moral constraints and, following that, of justified political arrangements. Whereas his contemporaries were explicitly aware that the limits of memory called for scrupulous arrangement of one?s papers, Boyle?s papers remained chaotic throughout his life, necessitating a habitual recourse to memory. This invites consideration of Boyle?s views on the use of memory and notes, taking account of the precepts and options of his day. Like many other early modern virtuosi, Boyle made copious notes comprising both textual extracts and empirical information, but he did not maintain large commonplace books of the (...) kind recommended by Renaissance humanists; nor did he publicize an account of his note?taking methods, as John Locke did. However, through his early contacts with Samuel Hartlib, Boyle was exposed to the ways in which diverse information could be noted, stored and used. Furthermore, his practice exemplified the well?known dual function of notes as both prompting memory and relieving it. Boyle did not pause to write a sustained essay on these issues; nevertheless, scattered throughout his prefaces, advertisements, works, notebooks and manuscripts there are significant comments on his practice of making what he called ?loose notes?. Boyle was aware of the kinds of notes he kept and his reliance on both memory and notes as prompts to reflection and thought. (shrink)

This chapter explores a modest suggestion that John Locke is susceptible to a wide range of interpretations because of his position midway between premodern and modern conceptions of property rights. Lockean property represents an uneasy hybrid of classical or Christian theories of distributive justice and modern capitalist theories of procedural justice which have succeeded in the intervening centuries in displacing them. Locke's defense of private property is at once natural and positive, utilitarian and grounded in natural rights, secular (...) and theological, hedonistic and custodial. Lockean proprietorship generates affirmative responsibilities of good stewardship. Lockean property rights convey reciprocal entitlements and responsibilities. After Locke's painstaking treatment of the origins of money and private property in Second Treatise, the advent of political society appears a rather belated innovation. Instead of being natural or spontaneous, the social contract follows only in the wake of a community's assent to money and its attendant inequalities. (shrink)

Sharon Street (2006) has argued that, given certain plausible evolutionary considerations, normative realism leads to normative skepticism. Street calls this ‘the Darwinian dilemma’. This paper considers the two most popular responses to the Darwinian dilemma and argues that both are problematic. According to the naturalist response, the evolutionary account of our normative dispositions reveals that there was selection for normative dispositions that were reliable with respect to normative truth. According to the minimalist response, the evolutionary account reveals that there was (...) selection of normative dispositions that were reliable with respect to normative truth. Ultralogic as Universal? is a seminal text in non-classcial logic. Richard Routley presents a hugely ambitious program: to use an 'ultramodal' logic as a universal key, which opens, if rightly operated, all locks. It provides a canon for reasoning in every situation, including illogical, inconsistent and paradoxical ones, realized or not, possible or not. A universal logic, Routley argues, enables us to go where no other logic—especially not classical logic—can. Routley provides an expansive and singular vision of how a (...) universal logic might one day solve major problems in set theory, arithmetic, linguistics, physics, and more. It circulated in typescript in the late 1970s before appearing as the Appendix to Exploring Meinong's Jungle and Beyond. The purpose of my paper is to show the derivation of what is sometimes called the ‘new liberalism’ (or ‘progressive liberalism’) from the basic principles of classical liberalism, through a reading of John Locke’s treatment of the right to property in his Second Treatise of Government. Locke’s work sharply distinguishes between the natural right to property in the ‘state of nature’ and the societal right to property as established in a socio-economic political system. Whereas the former does not (...) depend on the consent of others, it is qualified by strict limits on the amount of property that may be rightly acquired. The societal right to property lifts these limits but is justified only under the principle of universal consent. This principle, I argue, implies the Rawlsian difference principle; i.e., that the regulation and distribution of property must be such as would elicit the freely proffered consent of society’s least advantaged members.
