In this paper, my aim is to understand the origin of experimental and scientific models of pathogeny of the diseases of the nervous system in the Salpêtrière (Paris). I will analyse the role of the contexts of cell theory, microscopy and the advances in histological techniques in the creation of various pathogenic models, based on the concept of the cell, the Wallerian degeneration and the neurone concept. I argue that, as medicine and pathology remain autonomous in their methods and goals, (...) because of the evident degree of complexity of diseases, close and reciprocal interactions with sciences, their practices and theories, make it possible to establish convergences between clinical observations, pathological data and those from the experimental models of pathologies. The search for pathogenic models behaves like an engine, which is efficient in assembling facts, in testing pathogeneses and reforming nosologies, combined with the breakthroughs in biology. This paper is a case study showing the emergence of such interactions in the last decades of the nineteenth-century in Paris. (shrink)

In this dissertation, I have analyzed some of the problems associated with male reproduction. I discuss basic notions regarding the origin of parental rights concluding that whatever rights parents have regarding their children arise because of the biological connection between the parents and child. A biological parent has prima facie rights to his child because that parent has property-type rights to his own body. ;I suggest that parental responsibilities automatically incur whenever the conception of a child is intentional or voluntary, (...) or when conception is the result of negligent or reckless sexual activity. Only when procreation is involuntary does automatically delegating parental responsibilities to a male seem morally problematic. The category of acts which would constitute involuntary procreation, however, is very narrow. ;I discuss morally problematic issues that arise when a child is born against the wishes of the male progenitor. Focusing specifically on the issue of child support, I conclude that the father should have some responsibility for the support of the child. The only time for which the imposition of parental responsibilities upon a reluctant father is morally questionable would involve the fraudulent misrepresentation of the female regarding her use of contraceptives, combined with some affirmative action by her to undermine the male's attempted effort at contraception. ;Finally, I discuss the moral and legal implications of a woman's decision to obtain an abortion against the wishes of the potential father. I conclude that her abortion could seriously harm the male's procreation interests. But, given the vital role women have in the reproductive process, women should possess rights superior to those males might possess. The evolution of reproductive technology, however, has made these greater rights a contingent fact. (shrink)

Cultural difference has been largely ignored within bioethics, particularly within the end-of-life discourses and practices that have developed over the past two decades in the U.S. healthcare system. Yet how should culturebe taken into account?

Certified nursing assistants (CNAs) provide up to 80% of the direct care to older adults in long‐term care facilities. CNAs are perceived as being at the bottom of the hierarchy among healthcare professionals often negatively affecting their job satisfaction. However, many CNAs persevere in providing quality care and even reporting high levels of job satisfaction. The aim of the present investigation was to identify primary themes that may help CNAs make meaning of their chosen career; thus potentially partially explaining increases (...) in job satisfaction among this group. Focus groups were conducted with CNAs at three long‐term care facilities. Four themes emerged from the data: CNA work is good or special; CNA as relationship builder; CNA as expert; CNA as team member. These themes reflect the perceptions that these CNAs held in regard to themselves and their relationships to others in the work environment and, when present, can contribute to intrinsic job satisfaction. Our meaning‐making themes support the premise that CNAs do not passively accept the evaluations of others but instead actively frame identities that validate their importance to residents and the institution. Starting dialysis at an advanced age is a clinical challenge and an ethical dilemma. The advantages of starting dialysis at “extreme” ages are questionable as high dialysis-related morbidity induces a reflection on the cost- benefit ratio of this demanding and expensive treatment in a person that has a short life expectancy. Where clinical advantages are doubtful, ethical analysis can help us reach decisions and find adapted solutions. Mr. H is a ninety-year-old patient with end-stage kidney disease that is no longer (...) manageable with conservative care, in spite of optimal nutritional management, good blood pressure control and strict clinical and metabolic evaluations; dialysis is the next step, but its morbidity is challenging. The case is analysed according to principlism (beneficence, non-maleficence, justice and respect for autonomy). In the setting of care, dialysis is available without restriction; therefore the principle of justice only partially applied, in the absence of restraints on health-care expenditure. The final decision on whether or not to start dialysis rested with Mr. H (respect for autonomy). However, his choice depended on the balance between beneficence and non-maleficence. The advantages of dialysis in restoring metabolic equilibrium were clear, and the expected negative effects of dialysis were therefore decisive. Mr. H has a contraindication to peritoneal dialysis (severe arthritis impairing self-performance) and felt performing it with nursing help would be intrusive. Post dialysis fatigue, poor tolerance, hypotension and intrusiveness in daily life of haemodialysis patients are closely linked to the classic thrice-weekly, four-hour schedule. A personalized incremental dialysis approach, starting with one session per week, adapting the timing to the patient’s daily life, can limit side effects and “dialysis shock”. An individualized approach to complex decisions such as dialysis start can alter the delicate benefit/side-effect balance, ultimately affecting the patient’s choice, and points to a narrative, tailor-made approach as an alternative to therapeutic nihilism, in very old and fragile patients. His achievements as a writer were at least comparable: Hamburger was awarded several important literary prizes, including prix Femina, (...) prix Balzac and the Cino del Duca prize (1979), awarded, among others, to Jorge Luis Borges and Konrad Lorenz.Here we would like to offer a selected reading of a "golden" book, "Conseils aux etudiants en medicine de mon service" ("Advice to the Medical Students in my Service"), the first book dedicated to patient-physician relationship in Nephrology, written when dialysis and transplantation were becoming clinical options (1963). This book presents a timely reconfiguration of the relations between art, philosophy, ethics, and aesthetics. Through connection with a range of contemporary social and philosophical issues and movements, this collection of essays highlights the imperative of sensorial aesthetics. The book focuses on the radical philosophical approach to aesthetics enabled by the works of Jean-François Lyotard and Gilles Deleuze. From these philosophers an older meaning of aesthetic has been recalled. Before it indicated primarily the theory of art and beauty, “aesthetic” (...) referred to the sensibility, the capacity to receive sensations. In summoning this “sensorial” meaning of aesthetics in their respective works, Lyotard, Deleuze, and other recent thinkers turn the philosophical theory of aesthetics away from the dominance of cognitivist and reception theories, and towards a thinking of aesthetics through considerations of the movements of matter, affect, and sensation. Dans cet article, je retrace et discute l’itinéraire philosophique d’Axel Honneth, depuis La Lutte pour la reconnaissance jusqu’à ses récents essais Le Droit de la liberté et L’Idée du socialisme. Dans la première partie, le concept programmatique de pathologie sociale sera mis en relation avec celui de « sécularisation de la théodicée » formulé par Ernst Cassirer – à savoir, l’attribution de la responsabilité de la souffrance humaine à la société – et avec l’héritage des Lumières légué par Jean-Jacques (...) Rousseau. Dans la deuxième partie, une fois précisée la position occupée par Honneth dans la tradition de la théorie critique francfortoise, j’aborderai ses propositions théoriques ; je distinguerai notamment deux modèles normatifs correspondant à deux phases successives de la pensée honnethienne : la lutte pour la reconnaissance d’une part, qui s’appuie sur une anthropologie formelle à valeur universelle ; et la théorie de la liberté sociale d’autre part, qui réactualise la doctrine hégélienne de l’éthicité en s’appuyant sur un modèle historique et internaliste de critique sociale reconstructive. Dans la troisième partie, je me pencherai sur la « divinisation du social » inhérente au projet d’une critique des pathologies sociales, ainsi que sur la confiance excessive qu’Honneth semble accorder à la force normative de l’intersubjectivité. This article retraces and discusses the philosophical itinerary of Axel Honneth, from the groundbreaking book Struggle for Recognition up to the recent essays Freedom’s Right and The Idea of Socialism. In the first section, I examine Honneth’s programmatic concept of social pathology in relation to Ernst Cassirer’s idea of the secularisation of theodicy (i. e. the attribution of responsibility for human suffering to society) and to the enlightenment legacy of Jean-Jacques Rousseau. In the second section, after assessing Honneth’s position (...) in the tradition of critical theory, I analyse his philosophical views. I identify two different theoretical frameworks in Honneth’s work: on the one hand, the theory of the struggle for recognition; on the other hand, the recent theory of social freedom. While the first is grounded in a formal and allegedly universal anthropology, the second draws on the Hegelian doctrine of the ethical life and develops a historicist and internalist model of reconstructive social criticism. Finally, in the third section, I critically address the “divinisation of the social” entailed in Honneth’s project of social pathologies’ critique, and argue that Honneth’s trust in the normative power of intersubjectivity might be excessive. En 1990, s'est tenu a Lyon le premier colloque explicitement consacré à Henri Maldiney. L'idée était de lui donner la parole, mais seulement après avoir entendu quelques-uns de ses anciens étudiants et de ses plus proches amis (Jacques Schotte, André du Bouchet, Roland Kuhn), réunis autour de questions centrales pour chacun d'eux. Encre Marine a publié les meilleures pages provenant de ces journées dans Existence : crise et création. En 2012, Henri Maldiney a eu cent ans. L'Association Internationale Henri Maldiney (...) (AIHM) a réuni un colloque d'une journée à Lyon organisé avec la Faculté de Philosophie de l'Université Jean-Moulin, là où Henri Maldiney a longtemps enseigné (dont les actes sont à paraître) et un autre de deux journées à Paris, rue d'Ulm, là où Henri Maldiney a été étudiant, organisé avec les Archives Husserl. Les contributions ici réunies montrent comment l'oeuvre de Maldiney est aujourd'hui lue à la fois par quelques-uns qui accompagnent son travail depuis longtemps déjà et par de tout nouveaux lecteurs - ce qui témoigne de la diffusion de sa pensée. Certains ont pu dire que, désormais, on peut lire Henri Maldiney "comme un classique". La reprise du texte de Maldiney Existence : crise et création " montre que décidément, même dans le retrait lié au grand âge, Henri Maldiney continue, à travers son oeuvre, d'exercer une singulière présence. The Guise Cooperative, a project out carried in northern Paris by Jean-Baptiste André Godin (1817-88), who was inspired by the utopian ideas of Charles Fourier (1772-1837), put into practice a model that: (a) was politico-democratic in its self-management by the workers in a foundry; (b) was socio-economic in combining for the first time international competition and social benefits; (c) anticipated ecological arguments in developing industrialization processes; (d) embodied religious tolerance; (e) outlived the genuine socialism inspired by Marx. Godin’s ‘Palais (...) Social’ in Guise, still lived in today by around 300 descendants of the workers, was proclaimed a Human Heritage monument and handed over to the European Union in 1991. In lieu of an abstract, here is a brief excerpt of the content:Sozzini’s Ghost: Pierre Bayle and Socinian TolerationBarbara Sher TinsleyPierre Bayle’s Philosophical Commentary (1686–87), a Huguenot exile’s response to the Revocation of Nantes, established its author as a defender of free conscience for pagans, Muslims, Jews, atheists, Catholics, Protestants, Anabaptists, and Socinians. 1 The virtues of Pagans and Atheists are most fully treated in Bayle’s work on the comet. 2 In this work pagans, Catholics (whom Bayle equated with pagan (...) idolators), and atheists were compared to the advantage of the latter, a conclusion that caused widespread scandal and for which Bayle was obliged by his church to write an apology or clarification found in his Dictionary. 3 In toleration there was no juste milieu. 4 Everyone must act according to conscience no matter how errant. Bayle reiterated a position taken in his criticism of the Jesuit Louis Maimbourg’s History of Calvinism. 5 In it Bayle first enunciated the principle that he noted frightened readers and caused a scandal, namely, that error disguised as truth must be allowed all the privileges of truth, i.e., must be permitted to be believed by those convinced they had found truth. Not according to his chief critic who was his erstwhile patron turned enemy, Pierre Jurieu, Pastor of the Reformed church of Rotterdam and theologian in the Ecole Illustre. This school, founded expressly for Bayle and Jurieu by the city council of Rotterdam, 8 allowed Bayle to teach philosophy and history. Since Jurieu thought Bayle “indifferent” to dogma, he believed him to be a covert Socinian or atheist. In 1693 he managed to have Bayle dismissed from his teaching post.Indifference was a concept that started with the ancients, particularly Stoics, Skeptics, and Cynics, who regarded everything except virtue as matters of indifference, a posture with which many of Bayle’s writings, though not all, seemed to agree. In scholastic logic indifferentism meant that things were neither particular nor universal but indifferently so according to the viewpoint from which they were regarded. While Bayle was usually non-partisan, he was never indifferent.
