In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

The effect of uniform lighting on face identity processing is little understood, despite its potential influence on our ability to recognize faces. Here, we investigated how changes in uniform lighting level affected face identification performance during face memory tests. Observers were tasked with learning a series of faces, followed by a memory test where observers judged whether the faces presented were studied before or novel. Face stimuli were presented under uniform bright or dim illuminations, and lighting across the face learning (...) and the memory test sessions could be the same or different. This led to four experimental conditions: Bright/Dim ; Bright/Bright; Dim/Bright; and Dim/Dim. Our results revealed that incongruent lighting levels across sessions significantly reduced sensitivity to faces and introduced conservative biases compared to congruent lighting levels. No significant differences in performance were detected between the congruent lighting conditions and between the incongruent lighting conditions. Thus, incongruent lighting deteriorated performance in face identification. These findings implied that the level of uniform lighting should be considered in an illumination-specific face representation and potential applications such as eyewitness testimony. (shrink)

BackgroundResearch and academic institutions use various delivery channels to deliver Research Integrity education in their communities. Yet there is no consensus on the best delivery method and the effectiveness of these channels in inculcating a positive RI culture varies across institutions. Hence, this study aimed to understand the preferences of the research community in Nanyang Technological University, Singapore.MethodsAn online survey was conducted on NTU research community to understand their experience with, and preference for each RI education mode offered in NTU. (...) The RI education modes surveyed in the general ranking question are Data Management Plan workshops, Epigeum e-Learning, Compass e-newsletter, and NTU policy on Research Integrity and Responsible Conduct of Research. There were 242 responses, comprising 50% research students, 32.2% research staff and 17.8% faculty members. Non-parametric statistical techniques were used to analyse preferences across different RI education modes and within sub-groups.ResultsMore than 92% of respondents subscribed to the importance of RI education, but with different preferences for education modes. With respect to RI education in NTU, Compass e-newsletters were ranked the lowest. Most felt that they were too wordy and unengaging, making it difficult to absorb information. Similarly, Epigeum e-Learning and ‘policy’ were found to be too lengthy in presentation. The compulsory NTU RI education modes enjoyed higher participation rates of 70–80% compared with 32–37% for the self-regulated modes. This suggests that regulatory mechanisms are still necessary to promote participation in RI education, and thus, core RI education content should be made compulsory in research/academic institutions. Although Epigeum is a compulsory course, some may not have participated in the programme due to technical issues or they might have forgotten to participate in the programme within the permissible timeframe. For all four RI education modes in NTU, the lack of awareness was among the top cited reasons for not participating.ConclusionsMost NTU researchers perceived RI education positively although they may have reservations for some approaches. Conversely, e-Learning is favored over all the other modes except for the mode of Policy. Findings from this study are useful for improving the design of RI education strategies to be more appealing to the research community by enhancing user experience in terms of user-friendliness, relevance to specialisation, providing concise information and better presentation of materials For institutions with similar modes of RI education as NTU, these results may be relevant in improving participation rates and presentation of RI education modes, such as the use of infographics and more concise information. Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The volume stands alone in its efforts to systematically "diagnose" the moral reasoning lodged within prevailing judicial opinions that sustain captivity and risk management practices impacting: (1) the rights of juveniles found competent to stand criminal trial, the mentally ill placed in long-term disciplinary isolation, and sex offenders subjected to civil detention and community re-entry monitoring; (2) the often unmet needs of victims; and (3) the demands of an ordered society. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. It is widely accepted that there is what has been called a non-hypocrisy norm on the appropriateness of moral blame; roughly, one has standing to blame only if one is not guilty of the very offence one seeks to criticize. Our acceptance of this norm is embodied in the common retort to criticism, “Who are you to blame me?”. But there is a paradox lurking behind this commonplace norm. If it is always inappropriate for x to blame y for a (...) wrong that x has committed, then all cases in which x blames x (i.e. cases of self-blame) are rendered inappropriate. But it seems to be ethical common-sense that we are often, sadly, in position (indeed, excellent, privileged position) to blame ourselves for our own moral failings. And thus we have a paradox: a conflict between the inappropriateness of hypocritical blame, and the appropriateness of self-blame. We consider several ways of resolving the paradox, and contend none is as defensible as a position that simply accepts it: we should never blame ourselves. In defending this startling position, we defend a crucial distinction between self-blame and guilt. (shrink)

While all of these strategies have merit, we suggest that stewardship holds particular advantages and should be considered more often as a strategy of first choice. In this article, we examine the Municipal Wetland Stewardship program of Newfoundland, a popular and successful Canadian policy for the local protection of (...) wetlands. Important issues are at stake: competing philosophical foundations for managerial ecology, the value of "local ecological knowledge," principles of community-based conservation, the question of whether stewardship empowers local communities or controls them from afar, and ethical conflicts around American colonialism, hunting, and ecotourism. The results suggest that despite some potentially problematic ironies, the Newfoundland program provides a model for a public policy aimed both at the pragmatics of biophysical sustainability and at the ideals of environmental ethics, social justice, and democratic politics. Five experiments investigated how people use categories to make inductions about objects whose categorisation is uncertain. Normatively, they should consider all the categories the object might be in and use a weighted combination of information from all the categories: bet-hedging. The experiments presented people with simple, artificial categories and asked them to make an induction about a new object that was most likely in one category but possibly in another. The results showed that the majority of people focused on the (...) most likely category in making inductions, although there was a group of consistently normative responders who used information from both categories (about 25% of our college population). Across experiments the overall pattern of results suggests that performance in the task is improved not by understanding the underlying principles of bet-hedging but by increasing the likelihood that multiple categories are in working memory at the time of the induction. This investigation: evaluates the correspondence of two well-utilized CoI databases: the Centers for Medicare and Medicaid Services Open Payments and ProPublica’s Dollars for Docs and quantifies CoIs among authors of a publicly available point of care clinical support website which is used to inform evidence-based medicine decisions. Two data (...) sources were used: the hundred most common drugs and the top fifty causes of death. These topics were entered into a freely available database. The authors were then input into CMSOP and PDD and compensation and number of payments were determined for 2013–2015. The subset of highly compensated authors that also reported “Nothing to disclose” were further examined. There was a high degree of similarity between CMSOP and PDD for compensation and payment number. The amount received was 1.4% higher in CMSOP than in PDD. The articles where the authors had received the greatest compensation were in neurology, oncology, and endocrinology. Two authors reporting “Nothing to disclose” received appreciable and potentially relevant compensation. CMSOP and PDD produced almost identical results. CoIs were common among authors but self-reporting may be an inadequate reporting mechanism. Recommendations are offered for improving the CoI transparency of pharmaceutical-author interactions in point-of-care electronic resources. (shrink)

Disagreement as we find it in both the history and the contemporary practice of philosophy is an inadequately understood phenomenon. In this paper I outline and motivate the problem of disagreement, arguing that "hard cases" of disagreement confront us with an unresolved, and seemingly unresolvable, challenge to the rationality of philosophical discourse, thereby raising the specter of a worri-some form of metaphilosophical skepticism. A variety of responses and attempted evasions are considered, though none are found to be particularly satisfying: Thus, (...) the specter remains unexorcised. El desacuerdo que encontramos tanto en la historia como en la práctica contemporánea de la filosofía es un fenómeno mal entendido. En este trabajo hago un esbozo y aduzco los motivos del problema del desacuerdo, argumentando que los "casos difíciles" de desacuerdo nos confrontan con un problema sin resolver y al parecer sin posibilidad de resolverse, que pone en duda la racionalidad del discurso filosófico, y con lo cual surge el espectro de una preocupante forma de escepticismo metafilosófico. The Sleeping Beauty puzzle provides a nice illustration of the approach to self-locating belief defended by Robert Stalnaker in Our Knowledge of the Internal World (Stalnaker, 2008), as well as a test of the utility of that method. The setup of the Sleeping Beauty puzzle is by now fairly familiar. On Sunday Sleeping Beauty is told the rules of the game, and a (known to be) fair coin is flipped. On Monday, Sleeping Beauty is woken, and then put back to (...) sleep. If, and only if, the coin landed tails, she is woken again on Tuesday after having her memory of the Monday awakening erased.1 On Wednesday she is woken again and the game ends. There are a few questions we can ask about Beauty’s attitudes as the game progresses. We’d like to know what her credence that the coin landed heads should be (a) Before she goes to sleep Sunday; (b) When she wakes on Monday; (c) When she wakes on Tuesday; and (d) When she wakes on Wednesday? Standard treatments of the Sleeping Beauty puzzle ignore (d), run together (b) and (c) into one (somewhat ill-formed) question, and then divide theorists into ‘halfers’ or ‘thirders’ depending on how they answer it. Following Stalnaker, I’m going to focus on (b) here, though I’ll have a little to say about (c) and (d) as well. I’ll be following orthodoxy in taking 1 2 to be the clear answer to (a), and in taking the correct answers to (b) and (c) to be independent of how the coin lands, though I’ll briefly question that assumption at the end. An answer to these four questions should respect two different kinds of constraints. The answer for day n should make sense ‘statically’. It should be a sensible answer to the question of what Beauty should do given what information she then has. And the answer should make sense ‘dynamically’. It should be a sensible answer to the question of how Beauty should have updated her credences from some earlier day, given rational credences on the earlier day. As has been fairly clear since the discussion of the problem in Elga (2000), Sleeping Beauty is puzzling because static and dynamic considerations appear to push in different directions.. (shrink)

In this paper, relying mainly on his "Preface for Germans" I describe Ortega's complaints about Husserl's transcendental reduction, his own "anti-idealistic" approach to phenomenology, and his alternative version of the reduction, a reduction to life. Similarities with the work of Michel Henry are noted, but not explored in detail. Mention is made of Graham Harmon's interpretation of Ortega in "Guerrilla Metaphysics," but only to set up my interpretation of Ortega.

My dissertation seeks to understand our concept of moral claim-rights---rights of one person against another. It achieves this understanding by doing two main things: analyzing our concept of moral claim-rights in terms of our concept of moral duties; and discerning the role in our moral thinking of our concept of moral duties. Along the way, various views of, and issues surrounding, these two concepts are considered. ;Roughly, my view of our concept of moral claim-rights is this: X has a moral (...) claim-right against Y that Y do A if and only if whether Y has a moral duty to do A depends on whether X would desire that Y do A were X instrumentally rational and in possession of full relevant information. Suppose Boris has promised Alice that he will paint her house. She thus has a moral claim-right against Boris that he do so. Does this mean Boris has a moral duty to paint her house? No, since Alice might not desire that Boris paint it . ;Generally, my view of the role of our concept of moral duties in our moral thinking is that, as we think, moral duties are some, but not all, of the considerations bearing upon what one ought morally to do. More specifically, "ought morally" has a two-filter structure---an agent ought morally to perform one or another of those actions available to her which survives two successive stages of filtering. The first stage of filtering involves trading-off considerations of moral duty against those of overall goodness, while the second stage involves trading-off considerations of overall goodness against those of personal interest. In illustration of the first stage, where moral duties are involved, suppose that Alice can make some net contribution to the overall good by slapping Boris. Since Alice has a moral duty not to slap Boris, it is morally impermissible for her to do so unless the contribution she can make to the overall good is quite large. (shrink)

This paper is a discussion and critique of G. Harmon's interpretation of Ortega 's work, as set out in Harmon's "Guerrilla Metaphysics." I argue that while Harmon is right to point out Ortega 's critique of idealism, Ortega nevertheless remains a 'philosopher of access.' Ortega 's disagrees with the idealist i claim that we access reality through ideas, but agrees with the more basic point that philosophy ought to give an account of how we access reality.

The existing divergence between how we talk about contract law and actual contract experience, the parties moral obligation to keep contracts and the government’s role in regulating contracts, are the three main issues addressed in this article. The analysis of this article points to a narrower and more cautious approach to contract law, not towards a general theory, but one focused on the rules of a single time and place.Resumen:La divergencia que existe entre la forma en que hablamos del derecho (...) contractual y la actual experiencia contractual, la obligación moral de las partes contratantes de mantener un contrato, y el papel del gobierno en la regulación de los contratos, son los tres asuntos principales que se abordan en este artículo. If a legal rule tells us to do something, do we thereby have a reason to do it? This remains one of the most basic questions for theoretical and practical reflection on law. It is a foundational question, which many prominent contemporary theorists have discussed, yet the topic remains poorly understood. While many legal positivists have recently sought to “explain normativity”, this is likely a project inconsistent with the basic commitments of legal positivism, and, in any event, thoroughly unnecessary. Smith and David Enoch, this article emphasizes that law does not always (or “essentially” or paradigmatically) give reasons for action, and when it does give us reasons for action, it does so in unremarkable ways.Resumen:Si una norma jurídica nos dice que hagamos algo, ¿acaso por ese solo hecho tenemos una razón para hacerlo? In Veronica Rodriguez-Blanco’s thoughtful and important article, “Reasons in Action v Triggering Reasons: A Reply to Enoch on Reason-Giving and Le- gal Normativity,” she explores with great care the nature of reason-giving, in connection with challenging David Enoch’s influential recent work on reason-giving and the law. While Rodriguez-Blanco’s article makes an important contribution to the literature on the best understanding of rea- son-giving and practical reasoning, it is not clear that an approach to rea- sons for action reformed along the (...) lines Rodriguez-Blanco suggests would change or clarify the ultimate question on which she focuses: the way in which legal systems in general or individual legal norms do (or do not) give citizens reasons for action. The question of whether we have a general (presumptive) moral obligation to act (or refrain from acting) as legal norms direct us depends to a significant degree on whether there are good arguments against an individualistic, case by case, approach to responding to such norms.Resumen:Veronica Rodriguez-Blanco explora con minuciosidad en su detallado e importante artículo, “Reasons in Action v Triggering Reasons: A Reply to Enoch on Reason-Giving and Legal Normativity”, la naturaleza del otorgamiento de razones, en aras de cuestionar el influyente trabajo reciente de David Enoch sobre el otorgamiento de razones y el derecho. Partant de l'itinéraire d'une chose en plâtre qui avait passionné les statisticiens des années 1880 et qui a procuré à André Breton l'exemple même de l'objet surréaliste, on se demande si la théorie surréaliste du hasard est née par hasard. Il s'agit, en déplaçant la question que posait Ernest Coumet en 1970 à propos de la géométrie pascalienne du hasard, de s'interroger sur les rapports qu'entretiennent l'histoire des sciences, l'histoire de l'art et l'histoire de la culture scientifique au siècle dernier. Research in mathematical cognition has shown that rates, and other interpretations of x/y, are hard to learn and understand. On the other hand, there is extensive evidence that the brain is endowed with a specialized mechanism for representing and manipulating the numerosities of sets – that is, frequencies. Hence, base-rates are neglected precisely because they are rates, whereas frequencies are indeed natural.

This paper attempts to forge a dialogue between Machiavelli and Andrew Feenburg's Critical Theory of Technology. It makes some interesting points along the way, but I've re-thought a lot of what I say in here, and am not sure if I would still endorse it all.

A substantial part of Marion’s project in Being Given turns on a “triple epoché” wherein Marion brackets each part of the tripartite structure of the gift – the giver, the recipient and the given itself – to show that none of them is essential for thinking about the gift. In three separate variations, each element of the gift is bracketed individually, and in each of these instances the other two elements are specifically not bracketed. Indeed, Marion admits that the reduction (...) he proposes “demands, de jure, that one of the two [recipient or giver] remain in position of the transcendental I.” In this paper, I will argue that the rule is misleading and should be reformulated to indicate that a recipient is always required. In this paper I look at Dominique Janicaud’s proposal for a minimalist phenomenology. He develops this proposal in Phenomenology wide open, a sequel of sorts to his essay on the ‘Theological turn.’ Eschewing his polemics, I try to determine (a) the problem that he hopes minimalist phenomenology will solve; (b) the nature of this minimalism and how it differs from other approaches to phenomenology; and (c) critically evaluate some aspects of this minimalism, wondering if the gains of minimalist phenomenology are (...) worth what is given up in minimizing it. Kit Fine has reawakened a puzzle about variables with a long history in analytic philosophy, labeling it “the antinomy of the variable”. Fine suggests that the antinomy demands a reconceptualization of the role of variables in mathematics, natural language semantics, and first-order logic. The difficulty arises because: (i) the variables ‘x’ and ‘y’ cannot be synonymous, since they make different contributions when they jointly occur within a sentence, but (ii) there is a strong temptation to say that distinct variables ‘x’ (...) and ‘y’ are synonymous, since sentences differing by the total, proper substitution of ‘x’ for ‘y’ always agree in meaning. We offer a precise interpretation of the challenge posed by (i) and (ii). We then develop some neglected passages of Tarski to show that his semantics for variables has the resources to resolve the antinomy without abandoning standard compositional semantics. (shrink)
