This book tells a compelling story about love, friendship, and the Divine that took over a thousand years to unfold. It argues that mind and feeling are intrinsically connected in the thought of Plato, Aristotle, and Plotinus; that Aristotle developed his theology and physics primarily from Plato’s Symposium (from the “Greater” and “Lesser Mysteries” of Diotima-Socrates’ speech); and that the Beautiful and the Good are not coincident classes, but irreducible Forms, and the loving ascent of the Symposium must be interpreted (...) in the light of the Republic, as the later tradition up to Ficino saw. Against the view that Platonism is an escape from the ambiguities of ordinary experience or opposed to loving individuals for their own sakes, this book argues that Plato dramatizes the ambiguities of ordinary experience, confronts the possibility of failure, and bequeaths erotic models for the loving of individuals to later thought. Finally, it examines the Platonic-Aristotelian heritage on the Divine to discover whether God can love us back, and situates the dramatic development of this legacy in Plotinus, Iamblichus, Proclus, and Dionysius the Areopagite. Standard views of good death in human and veterinary medicine considerably differ from one another. Whereas the good death ideal in palliative medicine emphasizes the positive aspects of non-induced dying, veterinarians typically promote a quick and painless killing with the aim to end suffering. Recent developments suggest a convergence of both professions and professional attitudes, however. Palliative physicians are confronted with patients wishing to be ‘put to sleep’, while veterinarians have begun to integrate principles and practices from hospice care. We (...) will argue that the discourses on good human and animal deaths are not distinct, but that they interact and influence each other. On the one hand, veterinary medicine adapts techniques like chemotherapy or sedation from palliative end-of-life care. On the other hand, philosophers, veterinarians, pet owners, patients and the general public alike make certain assumptions about the analogy of human and animal dying or killing. Unfortunately, these interactions have only scarcely been reflected normatively, especially on the part of human medicine. Conflicts and misattributions with potential serious negative consequences for the patients’ wellbeing are provoked. For these reasons, palliative physicians and veterinarians are invited to engage in the debate around human and animal end-of-life care. (shrink)

This article will examine how the notion of emotional authenticity is intertwined with the notions of naturalness and artificiality in the context of the recent debates about ‘neuro-enhancement’ and ‘neuro-psychopharmacology.’ In the philosophy of mind, the concept of authenticity plays a key role in the discussion of the emotions. There is a widely held intuition that an artificial means will always lead to an inauthentic result. This article, however, proposes that artificial substances do not necessarily result in inauthentic emotions. The (...) literature provided by the philosophy of mind on this subject usually resorts to thought experiments. On the other hand, the recent literature in applied ethics on ‘enhancement’ provides good reasons to include real world examples. Such case studies reveal that some psychotropic drugs such as antidepressants actually cause people to undergo experiences of authenticity, making them feel ‘like themselves’ for the first time in their lives. Beginning with these accounts, this article suggests three non-naturalist standards for emotions: the authenticity standard, the rationality standard, and the coherence standard. It argues that the authenticity standard is not always the only valid one, but that the other two ways of assessing emotions are also valid, and that they can even have repercussions on the felt authenticity of emotions. In conclusion, it sketches some of the normative implications if not ethical intricacies that accompany the enhancement of emotions. (shrink)

In this paper, we explore how the development and affordances of predictive analytics may impact how teachers and other educational actors think about and teach students and, more broadly, how society understands education. Our particular focus is on the data dashboards of learning support systems which are based on Machine Learning. While previous research has focused on how these systems produce credible knowledge, we explore here how they also produce compelling, persuasive and convincing narratives. Our main argument is that particular (...) kinds of stories are written by predictive analytics and written into their data dashboards. Based on a case study of a leading predictive analytics system, we explore how data dashboards imply causality between the ‘facts’ they are visualising. To do so, we analyse the stories they tell according to their spatial and temporal dimensions, characters and events, sequentiality as well as tellability. In the stories we identify, teachers are managers, students are at greater or lesser risk, and students’ sociality is reduced to machine-readable interactions. Overall, only data marked as individual behaviours becomes relevant to the system, rendering structural inequalities invisible. Reflecting on the implications of these systems, we suggest ways in which the uptake of these systems can interrupt such stories and reshape them in other directions. (shrink)

In this article, I explore select case studies of Parkinson patients treated with deep brain stimulation in light of the notions of alienation and authenticity. While the literature on DBS has so far neglected the issues of authenticity and alienation, I argue that interpreting these cases in terms of these concepts raises new issues for not only the philosophical discussion of neuro-ethics of DBS, but also for the psychological and medical approach to patients under DBS. In particular, I suggest that (...) the experience of alienation and authenticity varies from patient to patient with DBS. For some, alienation can be brought about by neurointerventions because patients no longer feel like themselves. But, on the other hand, it seems alienation can also be cured by DBS as other patients experience their state of mind as authentic under treatment and retrospectively regard their former lives without stimulation as alienated. I argue that we must do further research on the relevance of authenticity and alienation to patients treated with DBS in order to gain a deeper philosophical understanding, and to develop the best evaluative criterion for the behavior of DBS patients. On the other side, public relations departments encourage researchers to use ‘storytelling’ techniques to engage public audiences. In this paper, I draw on social and cultural theory to assume that critical discourse analyses are always already narrative. I propose that we embrace (...) (rather than hide) the storytelling qualities of our research. Using similar strategies for all audiences, we undermine traditional power hierarchies between researchers and ‘the public’. Critical discourse analysis then performs its own critical approach. The paper also explores the potential of adopting a ‘carrier bag theory’ of storytelling (Le Guin) rather than telling ‘hero’ stories and reflects on the epistemological, relational and political work done by storytellers in critical discourse studies. At the centre of our analysis, we compare the concepts of (...) “donations” and “charity” with “vaccine equity” and the “empowerment” of poorer countries. We suggest that the achievement of fair global vaccine production requires that our global approach is supportive of the idea of empowerment. We, therefore, need structural reforms, which would most importantly include capacity building, to positively impact this goal and to take the interests of the global poor seriously. (shrink)

BackgroundSeveral studies identified low subjective feelings of power in women with anorexia nervosa. However, little is known about implicit power motives and the discrepancy between explicit feelings of power and implicit power motives in AN.AimThe study investigated the discrepancy between explicit feelings of power and implicit power motives and its relationship to anxiety in patients with AN.MethodFifty-three outpatients and inpatients with AN and 48 participants without AN were compared regarding subjective feelings of power and anxiety. Explicit power [investigated with the (...) Personal Sense of Power Scale and a visual analog scale ], implicit power motives [investigated with the Multi-Motive Grid ] and trait anxiety [measured with the State-Trait Anxiety Inventory ], were assessed.ResultsExplicit feelings of power were lower in patients with AN compared to non-AN participants. No differences in implicit power motives were found when comparing the groups against each other. However, looking at the groups separately, women with AN had similar levels of implicit fear of losing power and hope for power, whereas woman without AN had significantly lower fear of losing power than hope for power. Focusing on discrepancies between powerful feelings and power motives, results were mixed, depending on the subscale of the MMG. Lastly, discrepancies between implicit power motives and explicit feelings of power were positively correlated with trait anxiety in AN patients.ConclusionThese findings underline that individuals with AN display significantly lower explicit feelings of power, however, they show similar implicit power motives compared to individuals without AN. The discrepancy between explicit feelings of power and implicit power motives is related to anxiety in AN and may represent a vulnerability factor to illness maintenance. (shrink)

In this paper I describe a novel application of contemplative techniques to software engineering with the goal of augmenting the intellectual capabilities of knowledge workers within the field in four areas: flexibility, attention, creativity, and trust. The augmentation of software engineers’ intellectual capabilities is proposed as a third complement to the traditional focus of methodologies on the process and environmental factors of the software development endeavor. I argue that these capabilities have been shown to be open to improvement through the (...) practices traditionally used in spiritual traditions, but now used increasingly in other fields of knowledge work, such as in the medical profession and the education field. Historically, the intellectual capabilities of software engineers have been treated as a given within any particular software development effort. This is argued to be an aspect ripe for inclusion within software development methodologies. (shrink)

ZusammenfassungIn einem Modellprojekt soll durch die Einführung einer persönlichen, einrichtungsübergreifenden, elektronischen Patientenakte nicht nur die Behandlungskontinuität verbessert, sondern auch das Recht auf informationelle Selbstbestimmung dahingehend realisiert werden, dass jeder Patient zum Administrator einer Datencloud gemacht wird, die alle seine Gesundheitsdaten enthält. Eine systematische Literaturrecherche zum Thema „elektronische Patientenakten “ soll mögliche ethische Herausforderungen in Verbindung mit der oben genannten PEPA antizipieren. Von initial 2487 Publikationen wurden 51 Publikationen ausgewertet: 30 empirische Studien, 10 medizinethische Analysen und 11 Meinungspapiere. In den empirischen (...) Studien wurden als erste Effekte einer EPA vor allem eine vollständigere medizinische Aktenlage beschrieben. Mit der Einsichtsmöglichkeit für den Patienten in die EPA konnten zusätzlich ein besseres Krankheitsverständnis und damit erhöhte Compliance des Patienten nachgewiesen werden. Eine Verbesserung der Behandlungsqualität wurde auf die Fehlervermeidung durch Patienteneinsicht, effektivere Nutzung der Arzt-Patienten-Besuche und das verbesserte Verständnis für das Therapiekonzept zurückgeführt. Ebenfalls wurde in den Studien eine Stärkung des Vertrauensverhältnisses von Arzt und Patient beschrieben. Bedenken gab es im Vorfeld vieler Studien hinsichtlich des Datenschutzes, eines möglichen Verlustes der persönlichen Arzt-Patienten-Beziehung und einer potentiellen Überforderung des Patienten. In der Beurteilung der EPA spielte die Abwägung zwischen ärztlicher Fürsorge und Patientenautonomie eine große Rolle. Die von medizinethischer Seite geäußerten Bedenken bezüglich eines Vertrauensverlustes oder einer Störung des Arzt-Patienten-Verhältnisses konnten in den empirischen Studien nicht bestätigt werden. Die befürchteten Risiken im Datenschutz wurden von den Betroffenen zugunsten des potentiellen Nutzens einer EPA abgewogen. Unter Wahrung des Datenschutzes hat daher die PEPA das Potential, durch die Mitbeteiligung des Patienten das Arzt-Patienten-Verhältnis positiv zu beeinflussen. Die spezifischen ethischen Herausforderungen, die mit der Co-Verwaltung der PEPA einhergehen, werden im Modellprojekt untersucht. (shrink)

Student sex work is a current phenomenon all over the world, increasingly reported by the media in recent years. However, student sex work remains under-researched in Germany and is lacking direct first-hand reports from the people involved. Further, sex work remains stigmatized, and therefore, students practicing it could be at risk of social isolation and emotional or physical danger. Therefore, this study examines students working in the sex industry focusing on their personal experiences and attitudes toward them. An online questionnaire (...) was completed by 4386 students from Berlin universities. Students who identified themselves as sex workers were questioned with respect to their motivations to enter the sex industry, characteristics of their job, feelings after the intercourse, and perceived risks. Student non-sex workers were questioned regarding knowledge of and attitudes toward student sex workers. Most student sex workers reported that they entered the sex industry due to financial reasons. The majority reported offering services involving direct sexual intercourse. Disclosing their job to friends, family, or others was associated with less problems with social isolation and in romantic relationships. With a total of 22.9%, student non-sex workers reported never having heard about students working in the sex industry. The most frequent emotions mentioned by them with regard to student sex workers were compassion and dismay. There was no difference in happiness between student sex workers and non-sex working students. Through this research, it becomes evident that there are similarities between the student’s motivations to enter the sex industry, their feelings, and the problems they have to face. Moreover, prejudices still prevail about the life of student sex workers. Increasing understanding of student sex work might help those sex workers to live a less stigmatized life and thereby to make use of support from others. The universities as institutions could form the basis for this, e.g., by openly supporting student sex workers. This could help to encourage the rights of student sex workers and to gain perspective with respect to the sex industry. (shrink)

The _Symposium_ is one of Plato’s most accessible dialogues, an engrossing historical document as well as an entertaining literary masterpiece. By uncovering the structural design of the dialogue, _Plato’s Dialectic at Play _aims at revealing a Plato for whom the dialogical form was not merely ornamentation or philosophical methodology but the essence of philosophical exploration: his dialectic is not only argument, it is also play. Careful analysis of each layer of the text leads cumulatively to a picture of the dialogue’s (...) underlying structure, related to both argument and myth, and shows that a dynamic link exists between Diotima’s higher mysteries and the organization of the dialogue as a whole. On this basis the authors argue that the _Symposium_, with its positive theory of art contained in the ascent to the Beautiful, may be viewed as a companion piece to the Republic, with its negative critique of the role of art in the context of the Good. Following Nietzsche’s suggestion and applying criteria developed by Mikhail Bakhtin, they further argue for seeing the _Symposium_ as the first novel. The book concludes with a comprehensive reevaluation of the significance of the _Symposium_ and its place in Plato’s thought generally, touching on major issues in Platonic scholarship: the nature of art, the body-soul connection, the problem of identity, the relationship between _mythos_ and logos, Platonic love, and the question of authorial writing and the vanishing signature of the absent Plato himself. While deep brain stimulation (DBS) for patients with Parkinson's disease has typically raised ethical questions about autonomy, accountability and personal identity, recent research indicates that we need to begin taking into account issues surrounding the patients’ feelings of authenticity and alienation as well. In order to bring out the relevance of this dimension to ethical considerations of DBS, I analyse a recent case study of a Dutch patient who, as a result of DBS, faced a dilemma between autonomy and authenticity. This volume collects essays under four categories: religious traditions, religious life, emotional states, and historical and theoretical perspectives. These essays describe the ways in which emotions have played a role in various world religions, and analyze the manner in which key components of religious life ritual, music, gender, sexuality and material culture represent and shape emotional performance.

The term research subject has traditionally been the preferred term in professional guidelines and academic literature to describe a patient or an individual taking part in biomedical research. In recent years, however, there has been a steady shift away from the use of the term 'research subject' in favour of 'research participant' when referring to individuals who take part by providing data to various kinds of biomedical and epidemiological research. This article critically examines this shift, reflecting on the different meanings (...) evoked by the terms 'subject' and 'participant', as well as examining recent examples of patient activism in research. It concludes by suggesting that the wholesale unreflective adoption of the term 'participant' is inappropriate and provides instead a guide on how to determine the circumstances in which the terms subject, participant and activist should legitimately be used. Individual and institutional memories tend to form hegemonic narratives that serve to create identity and meaning. If history is written by experts and not by professional historians, historical retrospectives and narratives are usually written by leading figures in a particular field. They try to use their idea of exclusive knowledge about certain events, backgrounds and motivations to shape these narratives. In order to question such narratives, a critical analysis of scientific memory and its cultural significance is required. This article reflects (...) on the methodological challenges of oral history projects in medicine, using a project on psychiatric reform in the Federal Republic of Germany as an example. Tranquillity’s Secret Presents A New Understanding Of The World And Ourselves, And A Forgotten Meditation Technique That Protects You From Traumatic Harm. There Is A Way Of Seeing The World Different. -/- My goal in this book is two-fold: to introduce a revolutionary paradigm for understanding ourselves and the world; and to explain an ancient meditation technique that brought me to the insights upon which it is founded. This technique appears in different forms in the extant spiritual and religious traditions (...) over millennia which have used it — and in which it has been acknowledged as the most efficacious way to reach a direct experience of mind, or the most direct path to a union with God. Unfortunately, the proper way to use it has been largely lost over the last few centuries along with a clear understanding of why it was claimed to be so highly efficient. The primary reason for this loss is the mechanical materialism that frames all our scientific knowledge today. Lady Anne Conway, an English philosopher and a contemporary of René Déscartes, the French Metaphysician of the Seventeenth Century, was the first to characterize his philosophy as the “Mechanical philosophy.” It was Déscartes’ fascination with garden automata (moving statues) that he saw throughout Paris during his time, that led to his idea that the bodies of animals are nothing more than machines of varying complexity – which could be replaced by metal cogs, axles, and wheels. This very contemporary idea is in fact his legacy to humanity — along with the mind-body split that it entails — as mechanism became the standard to which Nature and all life was compared, and still is. This was the genesis of the modern reductive scientific understanding of life as discovered mechanisms made up of dead matter. -/- Although Déscartes’ philosophy was not materialism proper, as he held mind to not be material in nature, his was the most significant move to a cognitive framing of all phenomena as the result of mechanical interactions, and he went so far as placing all non-human animals into the machine-only category, because, he argued, they didn’t have minds. While a full account of Déscartes’ thought is not useful in this work, I want to use Lady Conway’s term to make a distinction between a mechanical materialism, which materialism has evolved into, and a less severe understanding that is not so destructive of the primacy of two aspects of being alive — mind and cognizance — which today are asserted to be by-products or epiphenomena of material processes in the brain by strict adherents to the mechanical philosophy. -/- This frame allows nothing but dead matter, and all that is comprised of dead matter, to be entertained as real. Anything beyond that is either ignored, or considered to be nothing more than figments of someone’s imagination — and this both limits and structures our thoughts about everything. Even those who believe they have moved on from this limiting understanding continue to be fenced in by language, which is structured by it — so that there is no escaping its limitations via a simple substitution or redefinition of concepts. Rather, it will take a truly revolutionary new paradigm and a concomitant reframing of our understanding of ourselves, this world, and reality, and how they come together in the new paradigm. I characterize the difficulty of this change as being like that of meeting an alien race and trying to work out how they see reality before communication can begin — which is very difficult to do when one’s own view is so limited. -/- I call this revolutionary paradigm Responsive Naturing. -/- Responsive Naturing replaces the current paradigm and its concomitant idea of deterministic causality which is foundational in scientific practice today. It can do this because, as you will see, it better accounts for all categories of phenomena, and thus includes all the most important human experiences, such as that of being alive, of beauty, of love, and the ultimate unity of all things. Responsive Naturing provides a sound foundation for the sciences, without the imposed limitation of mechanical materialist explanations, so that both science and spirituality can be founded upon this single common understanding of how things work. -/- This novel paradigmatic understanding of reality intrinsically applies to all dimensions of mental phenomena — be it of perceptions, sensations, or thoughts — and from the indeterminacy of quantum mechanics to the stochastic nature of most physical phenomena, to the often accidental, sometimes fortunate, but never sure, character of all human activities. This makes this new paradigm immediately productive in a practical way — it simply works, as I will show. It empowers us in ways that our disjointed and parochial schools of thought lock us out of completely, opening up new possible methods of looking at problems and finding solutions across disciplines. However, understanding the repercussions of the new paradigm upon one’s cognitive frame and the concomitant structure of language is difficult to comprehend simply because it is alien to the existing frame and paradigm. The impetus to make the effort is becoming quite clear: -/- Today, the sciences are ruled by the limiting cognitive framing of mechanical materialism, and over the last century, the limitations of that frame and its associated scientific paradigm of physical causality have become obvious: science has become schizophrenic. On one hand, some scientists say everything is strictly determined by the laws of nature, and neither free will nor conscious intent have any involvement in what happens; but others say that the state of the underlying quanta that make-up everything is indeterminate until consciously observed with the intent to measure it. Mechanical materialism is why scientists say you have no free will, while you obviously experience that you do — and you are held responsible for your actions by society because you do. It is also why scientists cannot find a non-speculative explanation of consciousness on an evolutionary or biological level, even though being conscious is the most obvious aspect of being alive. And these contradictions have infected every aspect of our lives, and our world, by limiting our ability to see the world any other way. Even the formulation of spiritual doctrines is constrained today by this cognitive frame’s presence in our language. This is not an academic matter, as we see clearly in our failure, so-far, to change the path that has brought us to a global environmental collapse and the ecocide of life on Earth. -/- What is unique about the book’s approach is that it does not speculate about what might be the case, like so much of philosophy does. Instead, it relies upon meditative and contemplative insights that were gleaned directly from a dedicated advanced meditation practice over 60+ years of the author’s life. These insights were then confirmed by subsequent research into similar forms of this advanced meditation technique found across the world and throughout human history. In conjunction with my meditation practice, I have doctoral-level education in Philosophy and a 30-year career in Software Engineering. The latter was in part focused on automated software development, during which I was confronted with the unsolvable enigma — within the mechanical materialist understanding that I was enculturated into, and inculcated with — of Human Creativity. An enigma that set me on my path of discovery. -/- I have discovered, and continue to discover, just how productive this novel paradigm is in understanding ourselves and our world, by its ability to explain — in detail — so many of our experiences that are today either inexplicable, paradoxical, or ignored “for the present” by scientists until some hoped for mechanical description can be found. For the most part, scientists constrain themselves to describing mechanisms, but describing how is not explaining why — and that is why so much of our modern knowledge has a best-used-by-date. On the other side, seemingly all spiritual traditions accept this modern characterization of the world, ourselves, and reality that is manifest in our language, so that even spiritual phenomena and ideas are necessarily structured by it. We accept the ideas of separate beings, intentional entities, levels of consciousness, and attainment of enlightenment or unification with God, all of which are necessary because dead matter, and unconsciousness, are considered to be the starting point. It isn’t. Rather than just present this novel paradigm as a fait accompli, the book’s five sections bring the reader through stages of reconfiguration of our understanding: -/- Volume 1. The Way of Unsaying — The need for the articles in the first volume is not to tell the reader how things are, but to unsay the things that they have heard throughout their lives and have taken to heart. This is accomplished by exposing the logical and explanatory limitations of those ideas that usually go unnoticed. This is necessary to do in order to open the reader’s mind to other ways of accounting for phenomena, and navigating life, so that the reader will understand: first, why the meditation technique I will present is so effective; and second, why the novel paradigm that I propose will truly advance human knowledge and enable us to change our way of being in the world. In order to liberate oneself from seeing the world in a particular way I use skillful means to unseat all the understandings that we have all been inculcated with. This can be destabilizing, and you might find yourself getting annoyed, or even frightened. To paraphrase a Buddhist proverb: Better not to start; but if started, better to finish: -/- Volume 2. The Way of Contemplation — In this volume, the paradigm of Responsive Naturing is developed, building upon the dialogs in volume 1. This volume challenges the reader, since breaking free of one’s existing cognitive frame and paradigmatic understanding is not a trivial exercise, and neither is restructuring one’s thoughts to fit into a new paradigm. This section explains what Responsive Naturing means, how it works in both spiritual and scientific senses, my specific arguments for why it is the answer to our need for a better way to account for phenomena and experience, and how our way of being in the world can change because of it. I attempt to show, via a myriad of independent fields of study, just how powerful this paradigm is in explaining the various phenomena that until now, either had no scientific explanation, or had an incoherent and never proven one. -/- Volume 3. The Way of Tradition — This volume provides the reader with traditional descriptions of similar types of meditation to that which I am presenting. These techniques are related by the unusual support for meditation that they use: that of Inner Spontaneous Sound. This information is provided for two reasons: 1) to validate the technique I present in volume 4, The Way of Meditation, by showing the high esteem that these techniques have been held in by all spiritual traditions, and 2) to present a rational explanation for the technique’s effectiveness, based upon responsive naturing. Volume 4. The Way of Meditation — This volume describes the practice that I call “Great Responsiveness Meditation” which will allow the reader to: 1) engage in a long-term meditative and contemplative practice in order to attain the insights that are the foundation for the novel paradigm that I am presenting; and 2) to benefit from two unique side-effects of using inner spontaneous sound: one which protects the meditator during traumatic and extreme emotional experiences, especially of the kind now expected because of the current global environmental and societal crises; and the other — which is widely attested to — is an alchemical-like change in the meditator, who quickly displays compassion without self-centered concern. In Buddhism, this is known by the Sanskrit word “Mahākaruṇā,” which is the type of responsive compassion displayed by all enlightened beings. It is a permanent change in how we live our life, and it enables each of us to overcome our worst inculcated selfish behaviors. (shrink)

This book explores the intimate connections, conflicts and discontinuities between religion and philosophy in the Platonic and Neoplatonic traditions from Antiquity to the early Medieval period. It presents a broader comparative view of Platonism by examining the strong Platonist resonances among different philosophical/religious traditions, primarily Jewish, Christian, Islamic and Hindu, and suggests many new ways of thinking about the relation between these two fields or disciplines that have in modern times become such distinct and, at times, entirely separate domains.

This article argues that Ralph Waldo Emerson employs metempsychosis (reincarnation or the transmigration of the soul into successive bodies) as a figurative template for human consciousness. Mapping various traditions from Hinduism, Pythagoreanism, Platonism, and Neoplatonism onto the vastness of the geological and biological records, Emerson translates metaphysics for modernity: he depicts the soul's journey through the chronological sequence of history as a poetic process that culminates in a tenuous form of self-knowledge.

This book brings together a selection of Kevin Corrigan's works published over the course of some 27 years. Its predominant theme is the encounter with otherness in ancient, medieval and modern thought and it ranges in scope from the Presocratics through Plato, Aristotle, Plotinus and the late ancient period, on the one hand, and early Christian thought, especially Gregory of Nyssa, Augustine and, much later, Aquinas, on the other.

The first is a broad concern, related to the nature of metaphor, which stems from the destructionist or deconstructionist tendencies in some contemporary phenomenology or phenomenological existentialism. According to these views, the logocentric emphasis of the Western tradition must be shown (...) for what it really is : an attempt to erect a cover upon a fundamental absence. My second concern is much more specific. It is, first, to compare Plotinus and Aquinas on light and metaphor-two thinkers who might be considered to be poles apart on these questions: on the one hand, Plotinus, the father of Neoplatonic emanationism with its insistence upon the primacy of divine light and the father, surely too, of the tradition of light-metaphysics in the later, mediaeval period; on the other hand, St. Thomas, staunchly realist in the Aristotelian tradition. Second, I will seek to show that this first impression of the gulf between the two thinkers is not borne out by a close textual analysis, and that their respective theories, despite the admitted significant difference in viewpoint, are in some respects very close indeed. Let us look briefly at the light-metaphysics tradition first. For Robert Grosseteste light is the source of all activity and its diffusion is not a material change or a change in place, but rather an instantaneous and substantial multiplication of itself in three dimensions.4 Thus, for the author of the De Intelligentiis light is the fundamental principle of motion and life: " Est autem prima lucis operatio in sensibilibus quad motum et vitam operatur in viventibus." 5 Since light is the noblest of corporeal things, it therefore has an intermediate place between pure form and matter, and for Grosseteste and also Bonaventure it is consequently named the forma corporeitatis, the fundamental form of body as 4 De philosophischen W erke des Robert Grosseteste, ed. Does a political conception of human rights dictate a particular view of corporate human rights obligations? The U.N. “Protect, Respect, and Remedy” Framework and Guiding Principles on Business and Human Rights hold that corporations have only a responsibility to respect human rights. Some critics have argued that corporations should be responsible for a wider range of human rights obligations, beyond merely an obligation to respect such rights. Furthermore, it has been argued that the Framework relied on a political conception of (...) human rights, and this is what led to limiting corporate obligations to mere respect for human rights. In this paper, I explore and critically assess this general claim about political conceptions of human rights. This involves distinguishing different types of political conceptions of human rights, as well as specifying what makes a theory of human rights a “political conception.” In light of this clarificatory discussion, I argue that the general thesis is false; the mere fact that a theory offers a political conception of human rights does not necessarily entail any certain range of corporate human rights obligations. Finally, I identify some of the other aspects of a theory of human rights that do affect the range of corporate obligations it will prescribe. (shrink)

In recent decades, environmental rights have been increasingly developed at both the national and international level, along with increased adjudication of these rights in both national (constitutional) courts and international human rights courts. These parallel trends raise a question as to whether it is better to develop and adjudicate environmental rights at the national or international level. This article considers the case made by James May and Erin Daly in favor of developing environmental rights at the national constitutional level and (...) adjudicating these rights in domestic courts. I consider the limitations of this case by showing that international environmental human rights can play a role that systematically benefits environmental protection, with adjudication in international human rights courts a key part of that process. This involves drawing on an argument offered by Allen Buchanan to justify a system of international legal human rights, which appeals to a number of benefits that such a system can provide. The argument is developed and applied to adjudication of environmental human rights in international human rights courts. First, it is shown how these benefits are realized in the area of environmental human rights. Second, it is shown how adjudication can enhance these benefits, both by providing a mechanism for their realization and by facilitating a mutually supportive relationship among them. On the basis of these enhanced benefits and the value that they add, it is concluded that there is strong justification for developing and adjudicating environmental human rights at the international level. Concern about the ethics of clinical drug trials research on patients and healthy volunteers has been the subject of significant ethical analysis and policy development—protocols are reviewed by Research Ethics Committees and subjects are protected by informed consent procedures. More recently attention has begun to be focused on DNA banking for clinical and pharmacogenetics research. It is, however, surprising how little attention has been paid to the commercial nature of such research, or the unique issues that present when subjects are (...) asked to consent to the storage of biological samples. Our contention is that in the context of pharmacogenetic add-on studies to clinical drug trials, the doctrine of informed consent fails to cover the broader range of social and ethical issues. Applying a sociological perspective, we foreground issues of patient/subject participation or ‘work’, the ambiguity of research subject altruism, and the divided loyalties facing many physicians conducting clinical research. By demonstrating the complexity of patient and physician involvement in clinical drug trials, we argue for more comprehensive ethical review and oversight that moves beyond reliance on informed consent to incorporate understandings of the social, political and cultural elements that underpin the diversity of ethical issues arising in the research context.
