We develop a Bayesian framework for thinking about the way evidence about the here and now can bear on hypotheses about the qualitative character of the world as a whole, including hypotheses according to which the total population of the world is infinite. We show how this framework makes sense of the practice cosmologists have recently adopted in their reasoning about such hypotheses.

The secession of prosperous regions may negatively affect the redistributive scheme of an established state. As a consequence, the capacity of its welfare system to support the inhabitants of poorer regions may be significantly reduced. Some authors assert that affluent groups who opt for full political independence violate duties of solidarity. This objection to the secession of prosperous regions can be based on different views of distributive justice. Here, following a distinction that has been introduced by Allen Buchanan, ‘subject centred’ (...) and ‘justice as reciprocity’ theories are explored. It is argued that both theories fail to support the case against the secession of wealthy groups. ‘Subject centred’ theories cannot explain special duties toward compatriots, whereas ‘justice as reciprocity’ theories cannot justify restrictions on exit rights. However, this does not mean that separatists have no moral duties vis-à-vis their fellow citizens. They are obliged to dissolve the political union in a fair way, e.g., by accepting responsibility for some share of the public debts. (shrink)

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

This paper investigates whether, or not, the behavior of animals without speech can manifest beliefs and desires. Criteria for the attribution of such beliefs and desires are worked out with reference to Jonathan Bennett's theory of cognitive teleology: A particular ability for learning justifies attributing such beliefs and desires. The conceptual analysis is illustrated by examinations of cognitive ethology and considers higher-order intentionality. It is argued that the behavioral evidence only supports the attribution of first order beliefs and that languageless (...) animals therefore could not possess higher-order intentionality. They are only capable of forming simple, i.e., first-order beliefs about their environment. (shrink)

Inhabitants of low-lying islands flooded due to anthropogenic climate change will lose their territory and thereby their ability to exercise their right to political self-determination. This paper addresses the normative questions which arise when climate change threatens territorial rights. It explores whether the loss of statehood supports a claim to territorial compensation, and if so, how it can be satisfied. The paper concludes that such claims are well founded and that they should be met by providing compensatory territories. After introducing (...) a differentiation between land rights and territorial rights, previous theoretical responses to the problem of sinking islands are criticized. It is argued that states may be required to give up parts of their territory as compensation. The paper develops criteria of sufficiency for compensatory territories and proposes to base their selection process on a negative auction. Since it is unlikely that unsettled compensatory territories that meet the specified requirements are available, the rights of their original inhabitants are discussed. (shrink)

In this paper we present some concepts and their relations that are necessary for modeling autonomous agents in an environment that is governed by some (social) norms. We divide the norms over three levels: the private level the contract level and the convention level. We show how deontic logic can be used to model the concepts and how the theory of speech acts can be used to model the generation of (some of) the norms. Bayesian psychology, in what is perhaps its most familiar version, is incomplete: Jeffrey conditionalization is not a complete account of rational belief change. Jeffrey conditionalization is sensitive to the order in which the evidence arrives. This order effect can be so pronounced as to call for a belief adjustment that cannot be understood as an assimilation of incoming evidence by Jeffrey's rule. Hartry Field's reparameterization of Jeffrey's rule avoids the order effect but fails as an account of how new evidence (...) should be assimilated. (shrink)

What is it that troubles and preoccupies us about the anxieties and anguishes of social and private life? Have advances in the disciplines of psychoanalysis, psychology or the social sciences in general ministered to our needs in these areas? In this forcefully argued collection of essays, Frank Cioffi examines Wittgenstein's reflections on the comparative claims of clarification and empirical enquiry. Though writing out of admiration and indebtedness, he expresses reservations as to the limits Wittgenstein places on the relevance and (...) desirability of empirical knowledge. His discusssions extend from Wittgenstein's reflections on human sacrifice and other ritual practices dealt with by Frazer to Freud's account of the sources of anxiety, depression, dreams and laughter. He asks both whether it is empirical investigation or more lucid reflection that these phenomena demand, and what kind of question this itself is. (shrink)

The article addresses the issue of rationing health care services, a topic currently being hotly debated in many countries. The author argues that the aspect of causal responsibility ought to play a decisive role in the allocation of limited medical resources. Starting out from Ronald Dworkin's distinction between option luck and brute luck, the appropriate and meaningful uses of the term causal responsibility are clarified first. A discussion of the conditions which might justify giving lower priority to patients whose illnesses (...) are the result of unhealthy behavior, like e.g. alcohol abuse, follows. Causal responsibility is then viewed in the context of private health insurance and the club model of organ donation. It is argued that individuals themselves are basically responsible for their decisions regarding insurance coverage and membership in organ donors' clubs. Causal responsibility is shown to be a more suitable criterion for rationing scarce medical resources than other criteria which might alternatively be considered, such as patients' age. (shrink)

The temporal granularity of consciousness may be far less fine than the real-time information processing mechanisms that underlie our sensitivity to small temporal differences. It is suggested that conscious time perception, like space perception, is subject to errors that belie a unitary underlying representation. E. R. Clay's concept of the “specious present,” an extended moment represented in consciousness, is suggested as an alternative to the more common notion of instantaneous experience that underlies much reasoning based on the “time of arrival” (...) in consciousness. Ayahuasca is an Amazonian psychoactive shamanic brew that often elicits spontaneous, intense, and meaningful imagery narratives related to psychological and physical healing, problem solving, knowledge acquisition, community cohesion, creativity, and spiritual development. My EEG and phenomenology ayahuasca research found it caused the greatest changes in EEG beta coherence from 25 to 30 cycles per second compared to a resting state before ayahuasca ingestion. Enhanced beta coherence indexes significantly greater information exchange between cortical regions and is congruent with the reported enhanced (...) richness, complexity, and profundity of ayahuasca experiences. I developed the creative cycle processes model that identifies in ayahuasca reports distinct experiential change processes and describes how these processes, neuroscience, psychotherapy, mythological, and other transdisciplinary evidence can be coherently integrated to explain ayahuasca benefits. The model suggests three change process stages together underlie one emergent dynamic creative cycle process. The sequential stages are Form dismantling and healing processes, form creation processes, where novel forms spontaneously combine, and form expression processes, where emergent experiences are embodied. The model suggests that these three stages repeat cyclically in human development in an ongoing process of dismantling and generation producing more creative experiences and expressive forms. The present article represents a further critical use of this material that we deem worthy of publication.in this vital and splendidly crafted work, Bethany Henning recovers a philosophy of aesthetic wisdom far richer (...) than the narrow epistemological lens dominant today. From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In accepting the unconscious, European thought has taken strides to acknowledge and address such ills. Henning wonders whether America might accept "a dynamic unconscious, were it presented with an alternative mythology" (10) and finds a viable candidate in Dewey's underappreciated notion of qualitative immediacy: an "aesthetic (directly felt) connection between ourselves and [End Page 77] the world" (Henning 5). In affirming the unconscious depth of experience, this American reconfiguration welcomes "aesthetic experience back into our philosophical lives" (Henning 5).When embodied meaning supplements cognitive reflection, we come to champion "the sensuous, lived body" as "the primary reality" of qualitative immediacy—a felt aesthetic unity punctuated by "impulsions" arising from an organism's needs (Henning 69). As "a site of adaptive adjustments," Henning continues, "the body is responsive to the brink of coalescence at the point of contact with the world, in which things that are 'outside of it' belong to it" (71). "To move adeptly into aesthetic experience means to be skilled at loosening focal consciousness" so as to cultivate "the essential porousness of the world" (130).With this, the body-mind relation becomes a problem of normative aesthetics, not epistemology. There are problems with both the theoretical logic and the interpretation of data in Christie and Barresi's interesting article. The general pattern of results is easily incorporated into an information-processing framework compatible with Dennett's analysis. In particular, different aspects of the illusory motion event are queried at different times and these aspects are not in conflict, so no revision of conscious content is necessary. Second, too much interpretive weight is placed on an anomalous pair of data points that do not (...) seem fully interpretable within the author's framework and are probably susceptible to one of several alternative interpretations proposed here, though further investigation is necessary. Although Pessoa et al. imply that many aspects of the filling-in debate may be displaced by a regard for active vision, they remain loyal to naive neural reductionist explanations of certain pieces of psychophysical evidence. Alternative interpretations are provided for two specific examples and a new category of filling-in (of visual detail) is proposed.

Sohn-Rethel’s great idea was to ‘socialise’ Kant’s transcendental subject by combining it with Marx’s commodity-form. In so doing, he took on three challenges simultaneously: a) the timeless validity of modern natural science; b) the social genesis of empirically pure forms of cognition; and c) socialisation occurring through a purely social synthesis. However, Sohn-Rethel construed Marx’s value-form analysis as an empirical exchange of commodities and held that such exchange performs a real abstraction – in this way, he laboured under the very (...) semblance that money engenders at the surface of society by virtue of its function qua means of exchange. This semblance can be rendered transparent by, on the one hand, explaining value in terms of capitalist valorisation rather than as a product of abstraction, and, on the other, developing money as the measure and form of this valorisation. In my paper “On the Probabilities of Conditionals,” I claimed, mistakenly, that David Lewis’s four triviality results and Alan Hájek’s proof depend on the application of the following principle to conditionals containing nested conditionals.

Strong reciprocity is an effective way to promote cooperation. This is especially true when one not only cooperates with cooperators and defects on defectors (second-party punishment) but even punishes those who defect on others (third-party, “altruistic” punishment). Some suggest we humans have a taste for such altruistic punishment and that this was important in the evolution of human cooperation. To assess this we need to look across a wide range of cultures. As part of a cross-cultural project, I played three (...) experimental economics games with the Hadza, who are hunter-gatherers in Tanzania. The Hadza frequently engaged in second-party punishment but they rarely engaged in third-party punishment. Other small-scale societies engaged in less third-party punishment as well. I suggest third-party punishment only became more important in large, complex societies to solve more pressing collective-action problems. (shrink)

It determines the perspective and task of The Immanence of Truths and demonstrates in what way an “absolute ontology” is the result of an act of forcing that serves as the measure for a truth’s truthness. This allows to argue that Badiou’s is and always was a philosophy of freedom.

This paper tries to (1) modify the flew attack so that it does apply to free (i) versions of the fwd, (2) show that even the modified flew attack fails to defeat the fwd, (...) In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. Secular change in sex ratios is examined in relation to experience in the family. Two theoretical perspectives are outlined: Guttentag and Secord’s (1983) adaptation of social exchange theory, and sexual selection theory. Because of large-scale change in number of births and typical age differentials between men and women at marriage, low sex ratios at couple formation ages existed in the U.S. between 1965 and the early 1980s. The currently high sex ratios, however, will persist until the end of the century. (...) High sex ratios appear to be associated with lower divorce rates, male commitment to careers that promise economic rewards, male willingness to engage in child care, higher fertility, and higher rates of sexual violence. Sexual selection theory calls attention to intrasexual competition in the numerically larger sex. (shrink)

In his recent book One World one of Peter Singer's main concerns is the preferential treatment of compatriots. Two aspects of Singer's theoretical reflections on this issue are critically discussed: the use of an impartiality test as basis for the justification of special duties and the resulting condemnation of partial preferences for compatriots. Subsequently, an alternative way to justify special duties is outlined and applied to the case of fellow citizens. It is argued, that partiality to compatriots can be defended, (...) if special duties are regarded as a constitutive part of valuable relationships. (shrink)

Theorists who support the legalisation of active euthanasia usually base their arguments on the principle of autonomy. In their view the wish of a severely ill person not to continue his or her life must be respected. However, some opponents of the legalisation of active euthanasia refer to the principle of autonomy as well. They are concerned that patients may be held responsible for burdening others with the provision of care. Thus family members, physicians or nurses may exert pressure on (...) patients to opt for active euthanasia. In this article it is argued that these worries are justified; the occurrence of social coercion poses a real danger. However, neither the prohibition nor the permission of active euthanasia enables each individual to make an autonomous choice. Comparing the risks involved in both options, legalisation seems to be preferable to maintaining the status quo. (shrink)

Im nächsten Schritt wird dann seine Anwendung auf die staatliche Gemeinschaft als Grundlage einer individuellen Pflicht zum Gesetzesgehorsam betrachtet. Darauf aufbauend wird die einflussreiche Kritik, die Robert Nozick an der Fairnesstheorie geübt hat, vorgestellt und erörtert. Danach gilt es den Versuch verschiedener zeitgenössischer (...) Vertreter der Fairnesstheorie, die Einwände Nozicks zu entkräften, einer eingehenden Prüfung zu unterziehen. In recent years theorists, such as Yael Tamir and David Miller, have proposed a liberal form of nationalism thereby combining two seemingly incompatible traditions of thought. Perhaps the most controversial element of their theories is the claim that national communities should be accorded with a right to political self-determination. In the article it is explained, firstly, why membership in a nation is seen as important for the individual’s well-being and, secondly, why statehood is deemed necessary for the thriving of the (...) nation. Subsequently, two problems of the liberal nationalists’ argument for political self-determination are discussed. It is argued, firstly, that national communities only need some form of regional autonomy to achieve their most important goals and, secondly, that non-national communities, e.g. religious groups, can base their demand for political sovereignity on the very same argument.
