This Article explores how managerial prerogative shapes disputes over employment classification and reveals a neglected but prominent feature in legal arguments about platform worker rights—the disputed relevance of a platform’s intellectual property rights. In classification disputes, instead of denying that it has a right to control how others perform services for it, the company often concedes its employer-like authority but offers an alternative rationale: managerial prerogative. The company argues, and judges often agree, that its labor control is not the exercise (...) of employer authority but instead reflects a prerogative of enterprise ownership, like a right to protect property and determine product lines. Thus, managerial prerogative both explains labor control and exempts that control from the statutory duties that would otherwise attach under the legal tests. Platform companies appear to have taken notice of such cases and designed their work relationships around property-based rationales. For instance, Uber uses a software “license” in which drivers agree to Uber’s authority as a condition for accessing the app. The license depicts the terms upon which drivers must affirmatively cooperate with Uber to produce transportation as simply the negative duties not to interfere with Uber’s intellectual property. The Article concludes that we must reject appeals to managerial prerogative in employment classification disputes. To assume that a property-based rationale for labor control is inconsistent with employment is to misunderstand the legal basis of employment and the purpose of statutory labor law. The appeals also rely on dubious economic assumptions and conflate property rights with agreements about the use of property. (shrink)

A case has been made by various authors that the normative and processual notion of personhood found in African philosophy is discriminatory: it has been labelled as sexist, ableist and anti-queer. Within the anti-queer critique, one area that has not been specifically addressed in the literature is whether this notion of personhood is biased against people who identify as non-binary with respect to gender. This includes people who are gender fluid and gender neutral, among others. In this article, we argue (...) that the binary conception of gender is deeply connected to a colonial agenda, and does not accurately fit extra-colonial gender conceptions. Through an analysis of extra-colonial language and logic, read together with the flexibility inherent in the processual notion of personhood (on our reading), we argue that binaries do not sit comfortably with extra-colonial African thinking, and as such, processual and normative personhood can be understood in a way that embraces non-binary individuals. Further, the standards for achieving personhood are set by and achieved within the community, so a community which recognises and celebrates non-binary individuals can set up a framework for them to achieve personhood. Accordingly, normative personhood in African thought is found not to exclude those of non-binary gender. This reading saves the normative approach from some of the critiques levelled against it, as well as: i) enhancing consistency in an African world view; ii) strengthening the decolonial agenda; and iii) showing normative personhood to be fairer and more inclusive. During the COVID-19 pandemic, questions have been raised about the impact of face masks on communication in classroom settings. However, it is unclear to what extent visual obstruction of the speaker’s mouth or changes to the acoustic signal lead to speech processing difficulties, and whether these effects can be mitigated by semantic predictability, i.e., the availability of contextual information. The present study investigated the acoustic and visual effects of face masks on speech intelligibility and processing speed under varying semantic predictability. (...) Twenty-six children and twenty-six adults performed an internet-based cued shadowing task, in which they had to repeat aloud the last word of sentences presented in audio-visual format. The results showed that children and adults made more mistakes and responded more slowly when listening to face mask speech compared to speech produced without a face mask. Adults were only significantly affected by face mask speech when both the acoustic and the visual signal were degraded. While acoustic mask effects were similar for children, removal of visual speech cues through the face mask affected children to a lesser degree. However, high semantic predictability reduced audio-visual mask effects, leading to full compensation of the acoustically degraded mask speech in the adult group. Even though children did not fully compensate for face mask speech with high semantic predictability, overall, they still profited from semantic cues in all conditions. Therefore, in classroom settings, strategies that increase contextual information such as building on students’ prior knowledge, using keywords, and providing visual aids, are likely to help overcome any adverse face mask effects. Prior to any research data collection a proposal outlining methods and protocols is required to undergo ethical scrutiny. The issues surrounding a research ethics review process within sport and exercise science departments are not dissimilar to other subject areas. In particular, the ethical review process may be unclear to the researcher and can either present a difficult and time-consuming challenge or be merely perceived as a tick-box exercise. The aim of this study was to explore and compare research ethics processes (...) and decisions within sport and exercise science departments and institutions across the UK. Participants were asked to provide decisions and justification of those decisions on ten typical sports and exercise science proposals. Results found that all respondents cited evidence of informed consent and subject information sheets, detailed methodology and data protection procedures as highly important across all scenarios. Additionally it was found that similar processes occur regarding research ethical scrutiny and similar decisions are made at the departmental level. However, confidence fluctuates for individuals when reviewing in non-specialist subject areas and qualitative data collected calls for more research ethics training. (shrink)

Par leur absence de fidélité historique, ils ouvraient également un espace d’expérimentation sociale. Ce texte soulève donc la possibilité d’utiliser l’anachronisme comme outil pour débloquer l’imagination politique et imaginer de nouveaux horizons collectifs.

This article explores the emergence of leadership during implementation of a water saving initiative in the rural community surrounding Barren Box Swamp in the Murray Darling Basin, Australia. Qualitative data analysis indicated that the system elements affecting the type of leadership to emerge included the extent to which the groups were engaged in the process, the level of access to resources, and the level of investment in the outcomes of the project. Although these results reinforced key aspects of complex problem-solving (...) through collaboration, they demonstrated varying degrees and types of both engagement and leadership within the case community. Given the current finding that these varying elements can coincide within one system, this case suggests that each community’s characteristics, resources and context will determine the optimal combination of leadership style and level of collaboration needed to facilitate sustainable community development. Background Ethical challenges constitute an inseparable part of daily decision-making processes in all areas of healthcare. Ethical challenges are associated with moral distress that can lead to burnout. Clinical ethics support has proven useful to address and manage such challenges. This paper explores how prehospital emergency personnel manage ethical challenges. The study is part of a larger action research project to develop and test an approach to clinical ethics support that is sensitive to the context of emergency medicine. Methods We (...) explored ethical challenges and management strategies in three focus groups, with 15 participants in total, each attended by emergency medical technicians, paramedics, and prehospital anaesthesiologists. Focus groups were audio-recorded and transcribed verbatim. The approach to data analysis was systematic text condensation approach. Results We stratified the management of ethical challenges into actions before, during, and after incidents. Before incidents, participants stressed the importance of mutual understandings, shared worldviews, and a supportive approach to managing emotions. During an incident, the participants employed moral perception, moral judgments, and moral actions. After an incident, the participants described sharing ethical challenges only to a limited extent as sharing was emotionally challenging, and not actively supported by workplace culture, or organisational procedures. The participants primarily managed ethical challenges informally, often using humour to cope. Conclusion Our analysis supports and clarifies that confidence, trust, and safety in relation to colleagues, management, and the wider organisation are essential for prehospital emergency personnel to share ethical challenges and preventing moral distress turning into burnout. This paper takes off from a growing preoccupation in Western political-social philosophy on the thinkability of the materiality of change, that became most pronounced in Alain Badiou's philosophy of the event. It traces the development of the discourse of radical change tied to a materialist theory of subjectivity beginning from Badiou, down to the strong criticism posed against it by Slavoj Žižek. This is then followed by the discussion of Bruno Bosteels' potent defense of Badiou's philosophy. Finally, the last part (...) takes off from this debate and highlights how this tension in Badiou's philosophy was possible in the first place. Using Adrian Johnston's key insight on pre-evental and post-evental time, this paper argues that Žižek and Bosteels respectively employ pre-evental and post-evental lenses in reading the relation of event to being. Furthermore, these two lenses are themselves the effect of the split readability of the event at the moment of its rupture: the parallax-effect that divides the event into two. This paper asserts that neither of the two is sufficient. Both are fundamental in outlining what sort of sustained disciplines are necessary before and after events take place. (shrink)

This study examined cancer patients’ perceived emotional and informational support from a variety of interpersonal and media sources. We recruited patients from cancer patient association websites and online cancer forums and asked them to report to what extent they received support from interpersonal and media sources. Patients rated professional sources and personal sources as nearly equal sources of emotional support; however, professional sources were rated as significantly greater sources of informational support. Although family and oncologists were the most mentioned interpersonal (...) sources of support, they were also the most mentioned disappointing sources. Of the media sources, online interaction sources were rated as nearly equivalent sources of emotional support as interpersonal sources. That patients perceived emotional support, not only informational support, from various media sources is promising since interpersonal sources can be disappointing to some patients. (shrink)

Over the last decade, a plethora of international policies and guidelines on research integrity have been produced, and many countries have developed national codes of conduct. Recently, as a way of implementing these codes, institutions have begun offering mandatory training in research integrity for PhD fellows. This paper is based on a case study of a mandatory course in research integrity for PhD fellows at a faculty of medicine in Denmark. The study comprised a small survey, participatory fieldwork, and interviews (...) with six course participants, the course leader and a teacher. Based on this study, the paper shows that the PhD fellows perceived the integrity course as if it, to some extent, contributed to normalising the questionable research practice and grey zone behaviour that the course was conceived to prevent. The interviews, however, also show that this latent normalisation must be seen in the context of the PhD fellows’ position within a strongly competitive culture, which sometimes rewards questionable behaviour. For this reason, creating a culture of research integrity cannot be accomplished by integrity training alone, it demands a wider structural change in the incentives for career advancement that sustain the current asymmetries of power. Hohwy et al.’s (2008) model of binocular rivalry (BR) is taken as a classic illustration of predictive coding’s explanatory power. I revisit the account and show that it cannot explain the role of reward in BR. I then consider a more recent version of Bayesian model averaging, which recasts the role of reward in (BR) in terms of optimism bias. If we accept this account, however, then we must reconsider our conception of perception. On this latter view, I argue, organisms (...) engage in what amounts to policy-driven, motivated perception. An agent exercises instrumental rationality to the degree that she adopts appropriate means to achieving her ends. Adopting appropriate means to achieving one’s ends can, in turn, involve overcoming one’s strongest desires, that is, it can involve exercising synchronic self-control. However, contra prominent approaches, I deny that synchronic self-control is possible. Specifically, I draw on computational models and empirical evidence from cognitive neuroscience to describe a naturalistic, multi-system model of the mind. On this model, synchronic self-control is impossible. Must we, (...) then, give up on a meaningful conception of instrumental rationality? No. A multi-system view still permits something like synchronic self-control: an agent can control her very strong desires. Adopting a multi-system model of the mind thus places limitations on our conceptions of instrumental rationality, without requiring that we abandon the notion altogether. (shrink)

Discussions of the object as a key to understanding central aspects of modern and contemporary art. Artists increasingly refer to "post-object-based" work while theorists engage with material artifacts in culture. A focus on "object-based" learning treats objects as vectors for dialogue across disciplines. Virtual imaging enables the object to be abstracted or circumvented, while immaterial forms of labor challenge materialist theories. This anthology surveys such reappraisals of what constitutes the "objectness" of production, with art as its focus. Our ability to understand others is one of the most central parts of human life, but explaining how this ability develops remains a controversial issue, exercising psychologists and philosophers alike. Within this literature the Paradox of False Belief Understanding remains one of the main open challenges. Based on an up to date overview of the empirical and theoretical literature, this book highlights the significance of this paradox for our understanding of the development of social cognition and provides a new explanation (...) of it in the form of the Situational Mental File Account. Central features of the account are, firstly, identitfying three distinct stages in the development of belief understanding and, secondly, elaborating the role of both cognitive and situational factors as well as their interaction in the development of belief understanding. This account is also applied to the related phenomenon of pretend play, demonstrating the potential for a wider application of the account. This account generates both new empirical predications and a framework for further theoretical work, thereby providing a fruitful ground for further interdisciplinary research in this area. (shrink)

In this thesis I develop an account of how processes of social understanding are implicated in experiences of mental disorder, critiquing the lack of examination of this phenomena along the way. First, I demonstrate how disorder concepts, as developed and deployed by psychiatric institutions, have the effect of shaping the cognition of individuals with psychopathology through setting expectations. Such expectation-setting can be harmful in some cases, I argue, and can perpetuate epistemic injustices. Having developed this view, I criticise enactive accounts (...) of mental disorder for failing to consider how such terms like ‘dysfunction’ are open to interpretation and can come embedded with normative expectations. Enactive accounts consequently run the risk of perpetuating injustices in their account of the sociality of mental disorder. Similar concerns arise when we consider the attachment of enactivism to the medical model, I argue. But by adapting enactivism to consider other experiences of disorder, such as those described as ‘madness’, enactive psychiatry may genuinely provide ethical groundwork for a better conception of disordered experience. Then, I consider a further concern with a distinctly medicalised conception of mental disorder from the perspective of self-illness ambiguity, arguing that self-illness ambiguities appear to form a special class of ambiguities due to their proximity to disorder concepts which mark them as appropriate targets for therapeutic treatment. However, I argue further that we should be critical of the idea that self-illness ambiguities necessitate disambiguation, as, in cases where self and illness are demarcated, individuals may still experience distress because simply having a mental disorder can be socially alienating. The medicalised focus in self-illness ambiguity, and the explicit need from the medical perspective to disambiguate it, might then exacerbate the distress someone experiences in mental disorder. Moreover, drawing on Mad Studies, I suggest that one might not need a coherent self-narrative to live well. Because of this, one may not need to adopt a medicalised view of the self in the case of selfillness ambiguity. In order to support this analysis, I provide a phenomenological account of language and argue that the very thoughts implicated in mental disorder shape the individual’s perception of the world due to the way that language foregrounds particular aspects of our world. This demands a critical examination of the language adopted and used by both clinicians and disordered individuals. I thus conclude with some thoughts on how to approach research and developing understanding of mental disorder given that we, as people, are always implicated in this process and therefore socialisation of some kind will always be taking place. Socioemotional selectivity theory (SST), an influential life-span theory, suggests that older adults prefer persuasive messages that appeal to emotionally-meaningful goals over messages that appeal to knowledge-related goals, whereas younger adults do not show this preference. A mixed-factorial experiment was conducted to test whether older adults (≥65 years) differ from younger adults (25–45 years) in their preference for emotionally-meaningful appeals over knowledge-related appeals, when appeals are clearly developed in line with SST. For older adults we found the expected preference for emotionally-meaningful (...) appeals for cancer centers but not for grocery stores and travel organizations. As expected, in most cases, younger adults did not show a preference. Implications for SST-based communication research and for practice are discussed. (shrink)

Conversion as a change of religion or as a radical alteration of consciousness has been understood in different ways throughout history. The present volume focuses on the close connection between conversion and identity as described in conversion narratives. It discusses how the change in status and the constitution of a new identity are reflected in various texts of religious self-description from the Middle Ages and the early modern period.

The effectiveness of multi-stakeholder initiatives (MSIs) in tackling grand social and environmental challenges depends on productive dialogue among diverse parties. Facilitating such dialogue in turn entails building common ground in form of joint knowledge, beliefs, and suppositions. To explore how such common ground can be built, we study the role of different facilitators and their strategies for bridging the perspectives of competing stakeholder groups in two contrasting MSIs. The German Partnership for Sustainable Textiles was launched in an initially hostile communicative (...) environment, whereas the Fossil Free Sweden Initiative proceeded in a fertile communicative environment. We trace how the facilitators in these initiatives achieved common ground through three bridging strategies—communicative integration, temporal calibration, and process alignment—adapted to the communicative environments of these MSIs. In hostile communicative environments, facilitators achieve common ground by steering diverging stakeholder groups towards ‘reconciling’ their different language registers, knowledge bases, and meaning systems to ‘meet in the middle’ on points of agreement and shared interests. In fertile communicative environments characterised by greater mutual trust, facilitators can steer interactants to ‘strategically appropriate’ to the language, knowledge, and meaning system of a particular stakeholder group to win this group’s support. Our analysis contributes to a better understanding of how productive multi-stakeholder dialogue can be facilitated. (shrink)

In this book, Julia Ching offers a survey of over 4,000 years of Chinese civilization through an examination of the relationship between kingship and mysticism. She investigates the sage-king myth and ideal, arguing that institutions of kingship were bound up with cultivation of trance states and communication with spirits. Over time, the sage-king myth became a model for the actual ruler. As a paradigm, it was also appropriated by private individuals who strove for wisdom without becoming kings. As the (...) Confucian tradition interacted with the Taoist and the Buddhist, the religious character of spiritual and mystical cultivation became more pronounced. But the sage-king idea continued, promoting expectations of benevolent despotism rather than democratization in Chinese civilization. (shrink)

This paper presents an empirical solution to the puzzle of weakness of will. Specifically, it presents a theory of action, grounded in contemporary cognitive neuroscientific accounts of decision making, that explains the phenomenon of weakness of will without resulting in a puzzle.

I describe a suite of reinforcement learning environments in which artificial agents learn to value and respond to moral content and contexts. I illustrate the core principles of the framework by characterizing one such environment, or “gridworld,” in which an agent learns to trade-off between monetary profit and fair dealing, as applied in a standard behavioral economic paradigm. I then highlight the core technical and philosophical advantages of the learning approach for modeling moral cognition, and for addressing the so-called value (...) alignment problem in AI. (shrink)

Public health communication makes extensive use of a linguistic formulation that will be called the “no evidence” statement. This is a written or spoken statement of the form “There is no evidence that P” where P stands for a proposition that typically describes a human health risk. Danger lurks in these expressions for the hearer or reader who is not logically perspicacious, as arguments that use them are only warranted under certain conditions. The extent to which members of the public (...) are able to determine what those conditions are will be considered by examining data obtained from 879 subjects. For anyone acquainted with Reid’s works and the literature on them, the idea of proposing a hypothesis to explain contradictory comments on his philosophy, and the further idea of borrowing this hypothesis from Hume’s threefold account of scepticism will not only appear ironical but quite unlikely. Yet, this is what I propose to do in showing that Reid’s sceptical admissions can be seen as a form of “mitigated scepticism.” And while I acknowledge the irony of my hypothesis, I do not (...) grant that it lacks plausibility. The life spans of international organizations can take unexpected turns. But when we reduce IO life spans simply to their existence or lack thereof, or to formal change involving the addition of new members or the revision of charters, we miss the subtler dynamics within IOs. A broader continuum of IO life spans acknowledges life, death, inertia, and change as responses to crises, and affords a more nuanced perspective on international cooperation. This paper interrogates and reclaims clown practices in children’s rehabilitation as ‘foolish.’ Attempts to legitimize and ‘take seriously’ clown practices in the health sciences frame the work of clowns as secondary to the ‘real’ work of medical professionals and diminish the ways clowns support emotional vulnerability and bravery with a willingness to fail and be ridiculous as fundamental to their work. Narrow conceptualizations of clown practices in hospitals as only happy and funny overlook the ways clowns also routinely engage with (...) sadness, despair, discomfort and many other ways of being and doing. Our exploration of clown practices as foolish exposes the ways children’s rehabilitation upholds particular neoliberal models of success and invites a re-centring of rehabilitation and health care research and practice towards relationship building, supporting meaningful projects and a continued nurturing of aesthetic and pleasurable ways of being-in-the-world in the present moment as valuable unto themselves. The COPE Inventory is the most frequently used measure of coping; yet previous studies examining its factor structure yielded mixed results. The purpose of the current study, therefore, was to validate the factor structure of the COPE Inventory in a representative sample of over 2,000 adults in Slovakia. Our second goal was to evaluate the external validity of the COPE inventory, which has not been done before. Firstly, we performed the exploratory factor analysis with half of the sample. Subsequently, we (...) performed the confirmatory factor analysis with the second half of the sample. Both factor analyses with 15 factor solutions showed excellent fit with the data. Additionally, we performed a hierarchical factor analysis with fifteen first-order factors and three second-order factors which showed good fit with the data. Moreover, the COPE Inventory’s external validity was evaluated using consensual qualitative research analysis on data collected by in-depth interviews. Categories of coping created using CQR corresponded with all COPE first-order factors. Moreover, we identified two additional first-order factors that were not present in the COPE Inventory: self-care and care for others. Our study shows that the Slovak translation of the COPE Inventory is a reliable, externally valid, and well-structured instrument for measuring coping in the Slovak population. (shrink)

Wright, Claire Louise If the sacraments are, as Louis-Marie Chauvet argues, the major symbolic expressions of 'the body as the point where God writes God's self in us', few concepts could be more central to sacramental theology than time, the medium in which human, ecclesial, cultural and cosmic 'bodies' have their being and expression. Christian narratives, traditions and rituals are founded in history and the shared memory of culture. As Miroslav Volf notes, the 'sacred memory' of the death and (...) resurrection of Christ defines the identity of Christians as 'the pulsating heart that energizes and directs their actions and forms their hopes '. Indeed, all human experience, identity and meaning-making are mediated by an awareness of time, the flow and relativity of chronos and the moment of kairos. As Chauvet puts it, the 'sensible mediation' of history comprises 'the very milieu within which human beings attain their truth and thus correspond to the Truth which calls them'. (shrink)

In this article, the authors examine the circumstances under which scholars can become effective figures of identification in medicine, after whom prizes or institutions are named – and under which circumstances scholars cannot or can no longer fulfill such a role. Trends and changes in professional cultural memory are examined, illustrated by the biographies and receptions of the human geneticist Hans Nachtsheim, the circulatory researcher Rudolf Thauer, the urologist Dora Teleky as well as the dentists Karl Häupl and Elsbeth von (...) Schnizer. This study shows that the evaluation criteria themselves are historically changeable and that gender is an important influencing factor. While formal criteria (e. g., membership in parties and organizations) have traditionally been important evaluation criteria, the authors advocate that actions in research and clinical practice be given even greater attention in the future. Buytendijk (1887–1974) entwickelte in seinen Forschungen der 1920er und 1930er Jahre in Abgrenzung zum Behaviorismus eine antireduktionistische Zugangsweise auf Verhaltensexperimente. So bezog er in seinen Experimentalpraktiken explizit die subjektive Erfahrung des Versuchsleiters mit ein. Damit entwarf Buytendijk eine Wissenschaftstheorie, die methodologisch auf die Phänomenologie, Hermeneutik wie auf gestalttheoretische Ganzheitskonzepte zurückgriff, quantitative Datenerhebungen aber dennoch nicht aufgab. Vielmehr untersuchte Buytendijk auf der Grundlage des Biotheoretikers Jakob von Uexküll (1864–1944) in seinem physiologischen Institut in Groningen konkret (...) die These einer „Tier-Umwelt-Einheit“. Der vorliegende Beitrag ermittelt anhand der institutionellen Rahmenbedingungen und zweier Experimente (1924 und 1931), inwiefern Buytendijk seine Aussage, dass das Tier „mit und in seiner Umwelt geboren [ist]“, die zugleich sein wissenschaftsphilosophisches Konzept stützte, zu verifizieren wusste. Our sense of obligation is evident outside of joint collaborative activities. Most notably, children and adults recognize that parents are obligated to care for and love their children. This is presumably not because we think parents view their children as worthy cooperative partners, but because special obligations and duties are inherent in certain relational dynamics, namely the parent-child relationship.

There is a Turing computable embedding $\Phi $ of directed graphs $\mathcal {A}$ in undirected graphs. Moreover, there is a fixed tuple of formulas that give a uniform effective interpretation; i.e., for all directed graphs $\mathcal {A}$, these formulas interpret $\mathcal {A}$ in $\Phi $. It follows that $\mathcal {A}$ is Medvedev reducible to $\Phi $ uniformly; i.e., $\mathcal {A}\leq _s\Phi $ with a fixed Turing operator that serves for all $\mathcal {A}$. We observe that there is a graph G (...) that is not Medvedev reducible to any linear ordering. Hence, G is not effectively interpreted in any linear ordering. Similarly, there is a graph that is not interpreted in any linear ordering using computable $\Sigma _2$ formulas. Any graph can be interpreted in a linear ordering using computable $\Sigma _3$ formulas. Friedman and Stanley [4] gave a Turing computable embedding L of directed graphs in linear orderings. We show that there is no fixed tuple of $L_{\omega _1\omega }$ -formulas that, for all G, interpret the input graph G in the output linear ordering $L$. Harrison-Trainor and Montalbán [7] have also shown this, by a quite different proof. (shrink)

Theories of reasons and other normativia can seem to lead ineluctably to a tragic dilemma. They can be personal but parochial if they locate reasons in features of the point of view of actual people. Or they can be objective but alien if they take reasons to be mind-independent fixtures of the universe. Kantian constructivism tries to offer the best of both worlds: an account of normative authority anchored in the evaluative perspectives of actual agents but refined by a procedure (...) that guarantees certain principles, like the moral law, will have universal and unconditional authority. This chapter considers motivations for such a view and chronicles the intrepid efforts of its adherents to make good on this guarantee - to show that the structure of practical reason commits reasoners to morality. -/- .
