The idea that Buddhism played a key role in the development of New Confucianism has long prevailed in academia, but it is not until recent years that such an idea has been critically studied through a series of monographs, mainly published by Brill. This book is one of the excellent works concerning such an important topic. In lieu of an abstract, here is a brief excerpt of the content:Timothy Richard's Buddhist-Christian StudiesLai Pan-chiuTimothy Richard (1845–1919), one of the most well-known nineteenth-century British missionaries who worked in China, is still remembered today for his efforts to disseminate "Western learning" and to promote social welfare and political reform in China.2 Interestingly, although Richard's missionary, educational, and political activities undoubtedly dominated his life in China, he also found the time to translate a number of Buddhist texts from Chinese into (...) English.3 Unlike many of his fellow Christian missionaries, who either despised or ignored Chinese Buddhism, Richard endeavored to promote a dialogue between Christianity and other religions, especially Chinese Buddhism. In fact, his translations inspired several other European missionaries and Sinologists to take a greater interest in Chinese Buddhism, particularly Richard's biographer William E. Soothill (1861–1935) and Karl Ludvig Reichelt (1877–1952),4 the founder of Tao Fong Shan, which continues to promote Buddhist-Christian dialogue several decades after its foundation.5 However, Richard's translations of Chinese Buddhist texts, particular his translation of The Awakening of Faith, have been largely neglected by both Buddhists and Sinologists. As a result, the significance of Richard's dialogue with Chinese Buddhism has not yet been properly evaluated.Two recent studies of Richard have focused on his translation of the Buddhist texts and his dialogue with Chinese Buddhism.6 Unlike previous studies, which have viewed Richard as a missionary and analyzed his interpretation of Buddhism from the perspective of interreligious dialogue, the present study attempts to treat him as a Sinologist and review his Buddhist studies from the perspective of Oriental studies. This paper attempts to evaluate critically Richard's interpretation of Chinese Buddhism in the light of the recent debate over Orientalism triggered by the influential critique of the Orientalist enterprise by Edward Said (1935–2003).7 Richard King has examined European studies of Eastern religions in light of this debate and has tried to determine whether these "Orientalist" studies displayed the characteristics of the Orientalist approach criticized by Said. Such characteristics included "textualism" (which identifies a religion with a set of "sacred" texts), "essentialism" (which tends to assume a dualistic demarcation between the East and the West), and the colonial ideology (which legitimated Europeans' pride in their cultural superiority and colonial power).8 Whereas King's study was concerned principally with India, the present study focuses on the [End Page 23] case of Timothy Richard in China but will adopt a similar perspective. I will consider whether Richard's representation of Chinese Buddhism is infected by the textualism, essentialism, and dualistic demarcation between the East and the West that Said identified as the hallmarks of Orientalism, and whether it tended to reflect or legitimize Western colonial ideologies.My exposition of Richard's position will be based mainly on two of his most important works, The New Testament of Higher Buddhism (1910) and An Epistle to All Buddhists (1916). These texts will help us to understand why Richard translated Buddhist texts into English and how he saw the relationship between his studies of Chinese Buddhism and his missionary work. This article seeks to consider the compatibility between the doctrine of the Trinity and the theory of the transcendental properties by offering a consideration of the notion of the ‘gift’ as a transcendental term. In particular, this article presents a re-reading of John Milbank’s influential theology of the gift through Colin Gunton’s project of developing ‘trinitarian transcendentals’. In addition to showing how Milbank’s notion of the gift could be systematically understood in terms of what Gunton calls a ‘trinitarianly developed transcendental’ (...) which nonetheless avoids many of the problems found in Gunton’s original project, this article argues understanding ‘gift’ as a transcendental term can not only provide us with new ways of reconceiving the relationship between the philosophy of transcendental properties and various traditional doctrines, it can moreover show us how the traditional and biblical names of the Holy Spirit as ‘the Gift’ and the Son as ‘the Word’ can offer new ways of developing distinctively trinitarian accounts of metaphysics. In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people (...) from different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

Chapter 8 argues against the view that the moral rightness of an act is not a reason to perform it, and our reasons are instead the features that make the act right. Philosophers typically defend this view by noting that it seems redundant to take rightness to be an additional reason, once it has been acknowledged that the right-making features are already reasons. The author shows that this argument dramatically overgeneralizes, ruling out all cases in which two or more reasons (...) are arranged in relationships of metaphysical constitution. She then proposes an alternative way of thinking about these metaphysical hierarchies: Rather than assuming that at most one of the facts in each hierarchy is the “real” reason, bearing all the normative weight, it should be accepted that these facts can all be genuine reasons, whose normative weight is shared in virtue of the metaphysical relationships between them. Some tests are offered that can be used to determine which facts occur in metaphysical hierarchies with shared weight, and it is argued that the fact that an act is morally right passes the tests. The author then explains what she takes to be some kernels of truth underlying the redundancy argument, arguing that these phenomena are pragmatic, not metaphysical. (shrink)

We propose a two-step guessing game to measure the depth of thinking. We apply this method to the P beauty contest game. Using our method, we find that 81% of subjects do not make choice following best response reasoning while the classical method would suggest only 12%. The result suggests that the classical method has the fundamental problem that it cannot distinguish if a submitted number is due to best response reasoning or not. It also suggests that traditional level k (...) analysis falsely attributes some sophistication to random players, and that the degree of false attribution is large. Our procedure provides an alternative way to identify whether the individual has best response reasoning which is essential for any positive level of depth of thinking and differentiates between the depth of thinking and random choice, and hence provides a very different conclusion, which is suggestive of limitations of the classical method. This article offers a reading of Jean-Paul Sartre’s phenomenology in light of Jean-Luc Marion’s more recent phenomenology. It may seem odd to compare Sartre to Marion, given that Sartre is well-known for his avowed atheism and his account of intentionality while Marion is primarily known for his work on religious phenomena and counter-intentionality. However, this article shows that there are many ways in which Sartre anticipates Marion’s work on phenomenological reduction and excessive phenomenality. By reading Sartre’s phenomenology in light of (...) Marion’s, and particularly Sartre’s analysis of the viscous slime in Being and Nothingness in relation to Marion’s account of ‘saturated phenomena’, this article presents a fresh interpretation of Sartre as a phenomenologist who has invaluable insights not only on the structures of consciousness and phenomenality, but also for the contemporary theoretical interest in the relationship between human and nonhuman entities. Medical practice should evolve alongside medical ethics. As our understanding of the ethical implications of physician-patient interactions becomes more nuanced, physicians should integrate those lessons into practice. As early as the 1930s, epidemiological studies began to identify that the rates of medical procedures varied significantly along geographic and socioeconomic lines. Dr. J. Alison Glover recognized that tonsillectomy rates in school children in certain school districts in England and Wales were in some cases eight times the rates of children in other (...) districts, with the only significant predictive factors being the current chief medical officer in the area and the socioeconomic well-being of the child's parents. Unfortunately, Dr. Glover's work revealed that the increase in tonsillectomies did not improve the health of adolescent patients and appeared to be performed “as a routine prophylactic ritual for no particular reason and with no particular result.”. Clinical evidence suggests that many patients undergo surgery that they would decline if fully informed. Failure to communicate the relevant risks, benefits, and alternatives of a procedure violates medical ethics and wastes medical resources. Integrating shared decision-making, a method of communication between provider and patient, into medical decisions can satisfy physicians' ethical obligations and reduce unwanted procedures. This article proposes a three-step process for implementing a nationwide practice of shared decision-making: create model integration programs; provide legal incentives to ease the (...) transition; and incorporate shared decision-making into medical necessity determinations. This article offers a reading of Jacques Derrida’s account of “religion” and “life” in his seminal essay “Faith and Knowledge.” Applying Derrida’s aporetic structure of “X without X” to his remarks on religion and life in “Faith and Knowledge,” this article suggests that underlying Derrida’s endeavor to “think religion abstractly” is a radical re-conception not only of religion as “religion without religion” but moreover a re-imagination of life as “life without life” that breaks away from the traditional metaphysical understandings of (...) life and religion. This article offers a reading of Colin Gunton’s trinitarian theology in light of recent theological attempts to develop accounts of ‘new trinitarian ontologies’ in a strongly Christian Neo-Platonic vein. In particular, this article seeks to situate Gunton’s work within the broader context of late twentieth-century European thought by comparing his ‘trinitarian ontology’ to the anti-Platonic ontologies of Martin Heidegger and Gilles Deleuze. By way of considering the ‘anti-Platonic’ aspects of Gunton’s trinitarian theology, this article presents his theological project as a (...) testcase which highlights the stakes in constructing ‘new’ trinitarian ontologies as well as possible objections to the affirmative attitude towards Christian Neo-Platonism in contemporary theological metaphysics. ABSTRACTDifficulties with inhibiting fear have been associated with the emergence of anxiety problems and poor response to cognitive–behavioural treatment. Fear inhibition problems measured using experimental paradigms involving aversive stimuli may be inappropriate for vulnerable samples and may not capture fear inhibition problems evident in everyday life. We present the Fear Inhibition Questionnaire, a self-report measure of fear inhibition abilities. We assess the FIQ’s factor structure across two cultures and how well it correlates with fear inhibition indices derived experimentally. The principle of informed consent is so firmly established in bioethics and biomedicine that the term was soon bowdlerized in common practice, such that engaging in the informed decision-making process with patients or research subjects is now often called “consenting” them. This evolution, from the original concept to the rather questionable coinage that makes consent a verb, reveals not only a loss of rhetorical precision but also a fundamental shift in the potential meaning, value, and implementation of the informed consent (...) process. Too often, the sharing of information has been replaced by the mere acquisition of agreement with the authority ostensibly offering a choice.Scholars of informed consent agree that its salience and its legitimacy derive from a fiduciary duty to inform, in order to respect, protect, and promote autonomous decision making by those to whom the duty is owed. Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

One answer: Because medieval philosophy is just the continuation of ancient philosophy by other means—the Latin language and the Catholic Church— and, as Wallace Matson pointed out some time ago, the mind-body problem isn’t ancient.

One way in which fact finders are supposed to determine the reasonableness of a defendant is via a counterfactual test that personifies the reasonable person. We are to imagine the reasonable person being in the defendant’s circumstances. Then we are to determine whether the reasonable person would have done as the defendant did. This paper argues that, despite its prevalence, the counterfactual test is a hopeless guide to determining defendant reasonability. In brief, the test is of the wrong sort to (...) give fact finders the requisite guidance. What we are after is not a counterfactual judgment but instead is a question of possibility. However, since the only thing impossible of the reasonable person is being unreasonable, personifying the reasonable person cannot offer any useful guidance on this question. (shrink)

Objectives The objective of this research was to develop ethics accreditation standards for hospitals. Research design Our research methods included a literature review, an expert focus group, the Delphi technique and a hospital survey. The entire process was separated into two stages: (1) the development of a draft of hospital ethics accreditation standards; and (2) conducting a nationwide hospital survey of the proposed standards. Results This study produced a tentative draft of hospital ethics accreditation standards comprised of six chapters and (...) 62 standards based on the expert focus group and Delphi technique. The six chapters are: Medical ethics policies, regulations and leadership; The establishment and operation of a medical ethics committee; The establishment and operation of research-related ethics committees; Medical ethics education; Organisational ethical climate; and Respect for patients' rights and establishment of good hospital-patient relationships. The hospital survey indicated that the concept of an organisational ethical climate was new to most hospital managers, most hospitals disliked the idea of having a separate hospital ethics accreditation system, and small hospitals were concerned about their ability to comply with all of the standards. Conclusions Regardless of whether hospital ethics accreditation can be a stand-alone accreditation or just part of existing hospital accreditation programmes, we hope this draft can serve as a good reference for future endeavours by hospital accreditation authorities. At the time of this writing, a widely publicized, waived-consent trial is underway. Sponsored by Northfield Laboratories, Inc. (Evanston, IL) the trial is intended to evaluate the emergency use of PolyHeme®, an oxygen-carrying resuscitative fluid that might prevent deaths from uncontrolled bleeding. The protocol allows patients in hemorrhagic shock to be randomized between PolyHeme® and saline in the field and, still without consent, randomized between PolyHeme® and blood after arrival at an emergency department. The Federal regulations that govern the waiver (...) of consent restrict its applicability to circumstances where proven, satisfactory treatments are unavailable. Blood—the standard treatment for hemorrhagic shock—is not available in ambulances but is available in hospitals. We shall argue that there is adequate moral justification for capital punishment with linkage, that is, with linkage to keeping non-murderers from dying. We present the argument with two aims in mind. The first is to question the conventional wisdom, seldom challenged even by proponents of capital punishment, that being an abolitionist is closely connected to having a civilized respect for human life. This conventional wisdom, we hope to show, is somewhat off the mark. To this end we exhibit structural (...) similarities between so-called lifeboat dilemmas and the public's relationship to a murderer. In a lifeboat dilemma one must choose between saving this life or that, since the lifeboat will not hold both persons. Now if this life were an innocent's and that one a murderer's, a choice to save the latter would not be met with accusations of callousness towards human life. We hope to project everyone's intuitions about this case onto the more baffling case of a society's relationship to the murderers and dying innocents in its midst. (shrink)

This paper reviews the experience of an integrated approach to CSR in the U.S. electric utility sector. The authors report on the results of Southern Company’s historical definition of CSR as a dynamic model, balancing stakeholder needs through shifting pressures to assure long-term shareholder value, superior customer, price performance, and sustainable economic development. Using financial and utility sector measures, the paper assesses the company’s “balancing” approach to addressing CSR, which weights corporate, environmental, community, and economic factors in driving successful and (...) sustained financial, social, and environmental performance. The paper concludes by suggesting that CSR success in this sector requires, first, that the global warming issue be governed by the same balancing considerations to which all stakeholders and their legitimate interests are subject, and second, an energy policy that embraces both atechnology policy and appropriate regulatory incentives. Only recently have the abundant sources relating to the application of astronomy to the needs of religious ritual in medieval Islam been studied, and it is now possible to write a new chapter in the history of Islamic astronomy. Simple techniques were advocated by the scholars of the religious law, highly sophisticated and complicated solutions were proposed by the Muslim scientists. It is not without interest to compare and contrast this activity, which lasted over a millennium, with that of the (...) monks of the Christian Middle Ages. The history of the latter has not yet been written, and cannot be written from textual sources alone, as is clearly shown by some of the astronomical instruments presented here. The present essay, in which both the Islamic and Christian traditions are discussed side by side for the first time, is very much a preliminary venture, primarily intended to point to the inherent interest of the available materials for the history of science as well as for several other disciplines.
