The works of Gersonides encompass science, philosophy, and biblical exegesis. The majority of the philosophical writings are constituted by supercommentaries on Averroes’s commentaries on Aristotle’s works, whereas his magnum opus, The Wars of the Lord, encompasses all three genres. Physicians have an ethical responsibility to their patients to offer the best available medical care. This responsibility conflicts with their role as gatekeepers of the limited health care resources available for all patients collectively. It is ethically untenable to expect doctors to face this trade-off during each patient encounter; the physician cannot be expected to compromise the wellbeing of the patient in the office in favour of anonymous patients elsewhere. Hence, as in other domains of public policy where individual and (...) collective interests conflict, some form of collective solution is required. Collective solutions may take the form of placing explicit resource constraints on resources available to physicians, or clinical practice guidelines that recognise cost-effective care as acceptable. Such solutions will be politically and ethically sustainable only if patients as citizens of the larger population accept the need for rationing of limited resources in health care. (shrink)

In Group Psychology and the Analysis of the Ego Freud addresses the problem of how groups are formed or of how society is possible. The question of the possibility of society presupposes that in some sense human beings are not thoroughly social beings, that they must agree to or be made to participate in a common life in which they submit to general principles regulating their conduct towards one another. The notion that the grounds for social order cannot be taken (...) for granted originates in the beginnings of modern thought, particularly in Hobbes’ Leviathan, in which the classical idea that human beings are essentially social and political animals is rejected in favor of the view that the individual is in a basic sense independent of society and opposed to it, and that society is merely a conventional unity. For Hobbes, society is primarily a defensive alliance guaranteed by fear of a sovereign who constitutes a legal order. Social order, then, is imposed externally on the individual, who submits to regulation only on the basis of prudence. The history of thought about the problem of order after Hobbes’ initial attempt to resolve it is a development of more refined motives for obedience, which culminates in Kant's notion of a self-legislated moral law. The importance of Kant's solution is that it provides a positive ground for society. Human beings do not merely submit to standards because they are inclined to, either out of fear or out of desire, but because they acknowledge a rational principle to which they give their voluntary assent. For Hobbes, society is at least an imposition and at most an expedient. For Kant, society may, indeed, be both an imposition and an expedient, but it is also an order of life that might be perfected. In Kant's view, human beings are imperfectly rational beings, not organisms entirely ruled by pleasure and pain, as they were for Hobbes. (shrink)

Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. When is a belief or judgment justified? One might be forgiven for thinking the search for single answer to this question to be hopeless. The concept of justification is required to fulfil several tasks: to evaluate beliefs epistemically, to fill in the gap between truth and knowledge, to describe the virtuous organization of one’s beliefs, to describe the relationship between evidence and theory (and thus relate to confirmation and probabilification). While some of these may be held to overlap, the prospects (...) for fulfilling all may well seem poor. Furthermore the internalist requires that justification be an introspectible property of beliefs and a fundamental epistemic concept, while the externalist is often happy to ignore the concept altogether or at best regard it as an embarrassing add-on to their epistemology. In the light of this one might reasonably give up on justification altogether or adopt pluralist approach, denying that justification is any single property of beliefs of judgments. (shrink)

In this paper we discuss how Causal Decision Theory should be modified to handle a class of problematic cases involving deterministic laws. Causal Decision Theory, as it stands, is problematically biased against your endorsing deterministic propositions (for example it tells you to deny Newtonian physics, regardless of how confident you are of its truth). Our response is that this is not a problem for Causal Decision Theory per se, but arises because of the standard method for assessing the truth of (...) certain counterfactuals. The truth of deterministic laws is `modally fragile' on the standard semantics for counterfactuals: if determinism is true and you were to do otherwise, the laws would be different. We provide two ways of avoiding this problem: 1) supplement the standard semantics for counterfactuals with impossible worlds, or 2) introduce rigid designators into the description of problematic decision situations. We argue that both of these approaches are well-motivated and can be readily incorporated into Lewisian Causal Decision Theory. (shrink)

In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Unfortunately, the World Trade Center attacks have exacerbated the problem by labeling asylees and refugees as potential terrorists and subject to deportation. (shrink)

Two sources of possible disagreement in bioethics may be associated with pessimism about what bioethics can achieve. First, pluralism implies that bioethics engages with interlocutors who hold divergent moral beliefs. Pessimists might believe that these disagreements significantly limit the extent to which bioethics can provide normatively robust guidance in relevant areas. Second, the interdisciplinary nature of bioethics suggests that interlocutors may hold divergent views on the nature of bioethics itself—particularly its practicality. Pessimists may suppose that interdisciplinary disagreements could frustrate the (...) goals of bioethics. In this article, I explore how wonder may alleviate the concerns of the first group of pessimists regarding problems associated with pluralism, provided that we are willing to accept some interdisciplinary frustrations. Then, I invite readers of this issue of The Journal of Medicine & Philosophy to test these intuitions by considering the role of wonder in these articles. (shrink)

Artificial intelligence (AI) is increasingly relied upon by clinicians for making diagnostic and treatment decisions, playing an important role in imaging, diagnosis, risk analysis, lifestyle monitoring, and health information management. While research has identified biases in healthcare AI systems and proposed technical solutions to address these, we argue that effective solutions require human engagement. Furthermore, there is a lack of research on how to motivate the adoption of these solutions and promote investment in designing AI systems that align with values (...) such as transparency and fairness from the outset. Drawing on insights from psychological theories, we assert the need to understand the values that underlie decisions made by individuals involved in creating and deploying AI systems. We describe how this understanding can be leveraged to increase engagement with de-biasing and fairness-enhancing practices within the AI healthcare industry, ultimately leading to sustained behavioral change via autonomy-supportive communication strategies rooted in motivational and social psychology theories. In developing these pathways to engagement, we consider the norms and needs that govern the AI healthcare domain, and we evaluate incentives for maintaining the status quo against economic, legal, and social incentives for behavior change in line with transparency and fairness values. I develop an expressivist account of verbal disagreements as practical disagreements over how to use words rather than factual disagreements over what words actually mean. This account enjoys several advantages over others in the literature: it can be implemented in a neo-Stalnakerian possible worlds framework; it accounts for cases where speakers are undecided on how exactly to interpret an expression; it avoids appeals to fraught notions like subject matter, charitable interpretation, and joint-carving; and it naturally extends to an analysis of (...) metalinguistic negotiations. A common objection to the very idea of conceptual engineering is the topic continuity problem: whenever one tries to “reengineer” a concept, one only shifts attention away from one concept to another. Put differently, there is no such thing as conceptual revision: there’s only conceptual replacement. Here, I show that topic continuity is compatible with conceptual replacement. Whether the topic is preserved in an act of conceptual replacement simply depends on what is being replaced (a conceptual tool or a conceptual (...) role) and what the topic under discussion is. Thus, the topic continuity problem only arises from a failure to specify these two things. (shrink)

Although views differ about the details of this knowledge-society interface, most observers have understood that the kind of knowledge that emanates from establishedscience can indeed be quite powerful in practice. This paper explores Benjamin’s and Adorno’s materialist critique of the philosophy of history as a metaphysical fiction which harbors and shields the barbarism at the heart of culture. Each undertakes a radical critique of ontological, future-oriented notions of temporality and history, proposing instead a political understanding oriented to the past for the sake of the present or, more precisely, for the sake of actively resisting the persistent barbarism. The more culture insists on its progress beyond barbarism, the more it claims (...) to have overcome the past, the more insidious and invidious are its forms of oppression. I follow the consequences of Benjamin’s emphasis on the nihilism constitutive of philosophy of history by analyzing his claim that even the dead are not safe from the threat of annihilation. Second, I argue that Adorno’s radical critique of a culture and politics oriented toward the future, or rather to overcoming the past, constitutes an active resistance to the insidious barbarism at the heart of democracy. For the first time, strict formal, axiomatic, and algorithmic definitions of the notions of potential and actual infinities are presented. It is shown that the actualization of infinite sets and sequences used in Cantor’s proof is a necessary, but hidden, condition of the proof. The explication of the necessary condition and its factual usage within the framework of Cantor’s (...) proof makes, Cantor’s proof invalid. It’s shown that traditional Cantor’s proof has a second necessary, but hidden as well, condition which is teleological by its nature, i.e., is not mathematical. The explication of the second necessary condition makes Cantor’s statement on the uncountability of continuum unprovable from the point of view of classical logic.One of the most dramatic facts in history of science is connected just with the notion of actual infinity and consists in the following. On the one hand, Aristotle, Berkeley, Locke, Descartes, Spinoza, Gauss, Kant, Cauchy, Kronecker, Hermite, Poincaré, Bair, Borel, Brouwer, Quine, Wittgenstein, Weyl, Luzin, and a lot of other outstanding creators of classical logic and classical mathematics, during millenniums, stated categorically and insistently warned about that the actual infinity is a self-contradictory notion and its usage in mathematics is inadmissible (e.g., according to Poincare, “There is no actual infinity. - Cantorians forgot that and fell into contradictions. Later generations will regard Mengenlehre (set theory) as a disease from which one has recovered”). On the other hand, a lot of outstanding scientists of the XX c.c., such as Hilbert, Church, Turing, Gödel, etc., and modern axiomatic set theory as a whole ignored this (intuitive though) opinion of genii and accepted Cantor’s “transfinite paradise”, based on the actual infinity. In the paper some logical, philosophical, and psychological aspects of this historical “favorable opposition” are analyzed, and the fact that the scientific intuition of genii has won the historical battle against the mytho-’logic’ of Cantor’s transfinite ‘paradise’ is explained and logically justified. A new speculative ontology of aesthetics. In Aesthesis and Perceptronium, Alexander Wilson presents a theory of materialist and posthumanist aesthetics founded on an original speculative ontology that addresses the interconnections of experience, cognition, organism, and matter. Entering the active fields of contemporary thought known as the new materialisms and realisms, Wilson argues for a rigorous redefining of the criteria that allow us to discriminate between those materials and objects where aesthesis (perception, cognition) takes place and those where it doesn't. (...) Aesthesis and Perceptronium negotiates between indiscriminately pluralist views that attribute mentation to all things and eliminative views that deny the existence of mentation even in humans. By recasting aesthetic questions within the framework of "epistemaesthetics," which considers cognition and aesthetics as belonging to a single category that can neither be fully disentangled nor fully reduced to either of its terms, Wilson forges a theory of nonhuman experience that avoids this untenable dilemma. Through a novel consideration of the evolutionary origins of cognition and its extension in technological developments, the investigation culminates in a rigorous reevaluation of the status of matter, information, computation, causality, and time in terms of their logical and causal engagement with the activities of human and nonhuman agents. Part A provided a minimal logic for hyperlogic that is sound and complete over the class of all models. In this part, we extend these completeness results to stronger logics that are sound and complete over restricted classes of models. We provide a new interpretation of Zeno’s Paradox of Measure that begins by giving a substantive account, drawn from Aristotle’s text, of the fact that points lack magnitude. The main elements of this account are (1) the Axiom of Archimedes which states that there are no infinitesimal magnitudes, and (2) the principle that all assignments of magnitude, or lack thereof, must be grounded in the magnitude of line segments, the primary objects to which the notion of linear magnitude applies. Armed (...) with this account, we are ineluctably driven to introduce a highly constructive notion of (outer) measure based exclusively on the total magnitude of potentially infinite collections of line segments. The Paradox of Measure then consists in the proof that every finite or potentially infinite collection of points lacks magnitude with respect to this notion of measure. We observe that the Paradox of Measure, thus understood, troubled analysts into the 1880’s, despite their knowledge that the linear continuum is uncountable. The Paradox was ultimately resolved by Borel in his thesis of 1893, as a corollary to his celebrated result that every countable open cover of a closed line segment has a finite sub-cover, a result he later called the “First Fundamental Theorem of Measure Theory.” This achievement of Borel has not been sufficiently appreciated. We conclude with a metamathematical analysis of the resolution of the paradox made possible by recent results in reverse mathematics. (shrink)

Spinoza's heritage has been occluded by his incorporation into the single, western, philosophical canon formed and enforced by theologico-political condemnation, and his heritage is further occluded by controversies whose secular garb shields their religious origins. By situating Spinoza's thought in a materialist Aristotelian tradition, this book sheds new light on those who inherit Spinoza's thought and its consequences materially and historically rather than metaphysically. By focusing on Marx, Benjamin, and Adorno, Idit Dobbs-Weinstein explores the manner in which Spinoza's radical (...) critique of religion shapes materialist critiques of the philosophy of history. Dobbs-Weinstein argues that two radically opposed notions of temporality and history are at stake for these thinkers, an onto-theological future-oriented one and a political one oriented to the past for the sake of the present or, more precisely, for the sake of actively resisting the persistent barbarism at the heart of culture. For both its enthusiastic adherents as well as its more generous opponents, liberalism commands considerable ethical appeal but at a price. And that price is its lack of systematic integrity or coherence. The charm of its ethical appeal stems from the great values which it celebrates. But for many these very values seem fatally incommensurable, seem to be forever colliding with and thwarting one another. As Isaiah Berlin has never tired of reminding us, liberty and equality continue to defy our (...) best efforts to reconcile them, to weave them together in some kind of orderly and compelling way. Liberalism, in other words, is flawed, if not tragically flawed. For those who nevertheless remain charmed by its ethical appeal, the tragedy of the incommensurability of its basic values is disappointing and disturbing. (shrink)
