  4. Non-Aristotelian Political Animals.Ben Bryan - 2015 - History of Philosophy Quarterly 32 (4):293-311.
Aristotle claims that human beings are by nature political animals. We might think there is a way for non-Aristotelians to affirm something like this—that human beings are political, though not by nature in the Aristotelian sense. It is not clear, however, precisely what this amounts to. In this paper, I try to explain what the claim that human beings are political animals might mean. I also consider what it would it look like to defend this claim, which I call the (...)

  6. John M. Robson 1927–1995: A Tribute: J. H. Burns.J. H. Burns - 1996 - Utilitas 8 (1):1-4.
By the death, last summer, of Jack Robson, the world of utilitarian studies and a wider world of scholarship on both sides of the Atlantic lost one of their most distinguished figures. It would not be appropriate here, even if it were possible now, to attempt a full and measured assessment of his work. Writing only a few months after the news of his death, while the sense of loss is still so sharp for all his many friends, two things (...)

  7. Nature and Natural Authority in Bentham*: J. H. Burns.J. H. Burns - 1993 - Utilitas 5 (2):209-219.
My object in this paper is to suggest a few reflections on some themes in Bentham's work which others as well as I have noted, without perhaps developing them as fully as might with advantage be done. There will be nothing like full development in the limited compass of what is said here, but what is said may at least indicate possible directions for further exploration. The greater part of the paper will be concerned with the notion of natural authority; (...)

  8. Bentham and Blackstone: A Lifetime's Dialectic*: J. H. Burns.J. H. Burns - 1989 - Utilitas 1 (1):22-40.
The full range of Bentham's engagement with Blackstone's view of law is beyond the scope of a single article. Yet it is important to recognize at the outset, even in a more restricted enquiry into the matter, that the engagement, begun when Bentham, not quite sixteen years of age, started to attend Blackstone's Oxford lectures, was indeed a lifelong affair. Whatever Bentham had in mind when, at the age of eighty, in 1828, he began to write a work entitled ‘A (...)

  9. Utilitarianism and Reform: Social Theory and Social Change, 1750–1800*: J. H. Burns.J. H. Burns - 1989 - Utilitas 1 (2):211-225.
The object of this article is to examine, with the work of Jeremy Bentham as the principal example, one strand in the complex pattern of European social theory during the second half of the eighteenth century. This was of course the period not only of the American and French revolutions, but of the culmination of the movements of thought constituting what we know as the Enlightenment. Like all great historical episodes, the Enlightenment was both the fulfilment of long-established processes and (...)

  10. ‘The Very Culture of the Feelings’: Poetry and Poets in Mill's Moral Philosophy*: Daniel Burnstone.Daniel Burnstone - 1992 - Utilitas 4 (1):81-104.
Interpretations of Mill's response to literature are often placed within a larger analysis of the development of his ethical thought. Such interpretations commonly seek to describe the importance to Mill's intellectual development of the episode in his personal experience, recollected in Chapter V of his Autobiography, which awakened him to the value of poetry and to the need for an active cultivation of personal feeling. The connection between the two is usually made by demonstrating how his mature ethical thought integrates (...)

  11. What Was the ‘Common Arrangement’? An Inquiry Into John Stuart Mill's Boyhood Reading of Plato: M. F. Burnyeat.M. F. Burnyeat - 2001 - Utilitas 13 (1):1-32.
This article is detective work, not philosophy. J. S. Mill's Autobiography records that at the age of seven he read, in Greek, ‘the first six dialogues of Plato, from the Euthyphron to the Theaetetus inclusive’. Which were the other dialogues? On the arrangement common today, it would be Crito, Apology, Phaedo, Cratylus. On the arrangement common then, Theages and Erastai replace Cratylus, which makes seven dialogues. I show that this must be the answer by the evidence of James Mill's commonplace (...)

  16. Situationist Social Psychology and J. S. Mill's Conception of Character: Robert F. Card.Robert F. Card - 2010 - Utilitas 22 (4):481-493.
The situationist challenge to global character traits claims that on the basis of findings in social psychology, we should only accept at most the existence of local or context-sensitive traits. In this article I explore a neglected area of J. S. Mill's work to outline an account of context-sensitive traits. This account of traits, coupled with a sophisticated consequentialist ethical framework, suggests an interesting view on which persons govern the circumstances of their actions in order to best promote overall well-being.

  28. Interpersonal Comparisons of the Good: Epistemic Not Impossible.Mathew Coakley - 2016 - Utilitas 28 (3):288-313.
To evaluate the overall good/welfare of any action, policy or institutional choice we need some way of comparing the benefits and losses to those affected: we need to make interpersonal comparisons of the good/welfare. Yet sceptics have worried either: that such comparisons are impossible as they involve an impossible introspection across individuals, getting ; that they are indeterminate as individual-level information is compatible with a range of welfare numbers; or that they are metaphysically mysterious as they assume the existence either (...)

  29. Kant on Moral Feelings, Moral Desires and the Cultivation of Virtue.Alix Cohen - 2018 - In Sally Sedgwick & Dina Emundts (eds.), Begehren / Desire. De Gruyter. pp. 3-18.
This paper argues that contrary to what is often thought, virtue for Kant is not just a matter of strength of will; it has an essential affective dimension. To support this claim, I show that certain affective dispositions, namely moral feelings and desires, are virtuous in the sense that they are constitutive of virtue at the affective level. There is thus an intrinsic connection between an agent’s practice of virtue and the cultivation of her affective dispositions.

  31. An Augmented Buck-Passing Account of Reasons and Value: Scanlon and Crisp on What Stops the Buck: Philip Cook.Philip Cook - 2008 - Utilitas 20 (4):490-507.
Roger Crisp has inspired two important criticisms of Scanlon's buck-passing account of value. I defend buck-passing from the wrong kind of reasons criticism, and the reasons and the good objection. I support Rabinowicz and Rønnow-Rasmussen's dual role of reasons in refuting the wrong kind of reasons criticism, even where its authors claim it fails. Crisp's reasons and the good objection contends that the property of goodness is buck-passing in virtue of its formality. I argue that Crisp conflates general and formal (...)

  35. Utilitarianism, Rights and Equality: David J. Crossley.David J. Crossley - 1990 - Utilitas 2 (1):40-54.
Bentham's dictum, ‘everybody to count for one, nobody for more than one’, is frequently noted but seldom discussed by commentators. Perhaps it is not thought contentious or exciting because interpreted as merely reminding the utilitarian legislator to make certain that each person's interests are included, that no one is missed, in working the felicific calculus. Since no interests are secure against the maximizing directive of the utility principle, which allows them to be overridden or sacrificed, the dictum is not usually (...)

  36. Against Individualistic Justifications of Property Rights.Rowan Cruft - 2006 - Utilitas 18 (2):154-172.
In this article I argue that, despite the views of such theorists as Locke, Hart and Raz, most of a person's property rights cannot be individualistically justified. Instead most property rights, if justified at all, must be justified on non-individualistic grounds. This, I suggest, implies that most property rights cannot be morally fundamental ‘human rights’.

  37. Williams, B.-Making Sense of Humanity.G. Cullity - 1998 - Philosophical Books 39:91-104.
This critical notice discusses five main themes of Williams's collection: (1) The “morality system” and blame: our ethical thought both misconceives and overemphasizes the practice of blaming. (2) The theorist’s predicament: how can a theorist of human practice coherently relate her theory to her own practice? (3) Psychological realism: a central constraint on a defensible ethical outlook is that it takes account of us as we are. (4) Culture and explanation: there is no culturally neutral form of social explanation. (5) (...)

  39. Acting on Essentially Comparative Goodness.John Cusbert - 2017 - Thought: A Journal of Philosophy 6 (2):73-83.
Temkin's Essentially Comparative View of moral ideals says that goodness is comparison set dependent: the goodness of an outcome is relativized to a set of outcomes. This view does not entail that betterness is intransitive; indeed, it provides the resources for maintaining transitivity. However, it does entail that the structure of goodness is more complex than is standardly supposed. It thereby demands a modification of the standard connection between goodness and decision. I set out this challenge, canvas some options, and (...)

  42. Original Position Models, Trade-Offs and Continuity.Steven Daskal - 2016 - Utilitas 28 (3):254-287.
John Harsanyi has offered an argument grounded in Bayesian decision theory that purports to show that John Rawls's original position analysis leads directly to utilitarian conclusions. After explaining why a prominent Rawlsian line of response to Harsanyi's argument fails, I argue that a seemingly innocuous Bayesian rationality assumption, the continuity axiom, is at the heart of a fundamental disagreement between Harsanyi and Rawls. The most natural way for a Rawlsian to respond to Harsanyi's line of analysis, I argue, is to (...)

  43. Moral Realism and Political Decisions. Practical Rationality in Contemporary Public Contexts.G. De Anna & R. Martinelli (eds.) - 2015 - Bamberg University Press.
Realism has been a central object of attention among analytical philosophers for some decades. Starting from analytical philosophy, the return of realism has spread into other contemporary philosophical traditions and given birth to new trends in current discussions, as for example in the debates about “new realism.” Discussions about realism focused on linguistic meaning, epistemology, metaphysics, theory of action and ethics. The implications for politics of discussion about realism in action theory and in ethics, however, are not much discussed. This (...)

In the ‘Concluding note’ to An Introduction to the Principles of Morals and Legislation, added in January 1789 to the original 1780 text, Bentham addresses highly theoretical questions in jurisprudence: ‘What is a law? What are the different parts of a law?’ He then demonstrates that only an imperative theory of legislation can provide adequate answers and provide the means to establish a precise nomenclature of legal phenomena. These broad questions sum up the work conducted in the manuscripts Of the (...)

The concept of “harm” is ubiquitous in moral theorising, and yet remains poorly defined. Bradley suggests that the counterfactual comparative account of harm is the most plausible account currently available, but also argues that it is fatally flawed, since it falters on the omission and pre-emption problems. Hanna attempts to defend the counterfactual comparative account of harm against both problems. In this paper, I argue that Hanna’s defence fails. I also show how his defence highlights the fact that both the (...)
