BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. Enlightenment and Science. - Short conference report about a meeting organised by Rainer Enskat and Andreas Kleinert, which took place on 25 and 26 January 2007 in the rooms of the IZEA and the Leopoldina, the German National Academy of Sciences, in Halle (Saale), Germany. The topic of the conference was the question, which had become urgent since the 18th century, whether enlightenment through science is possible or necessary despite science.

Das Nichtwissen ist in aller Munde. Von Nichtwissenskulturen in der zweiten oder reflexiven Moderne ist die Rede, von Agnotologie als neuem Forschungszweig, von wicked problems und ihren clumsy solutions. Wo Nichtwissen sich durch Komplexitäts­steigerung unwiderruflich im zu Wissenden einnistet, fordert es als Grenze, Schranke und Kehrseite des Wissens die sogenannte Wissensgesellschaft heraus. Vor allem Risiko­poten­ziale und Gefahren kommen hier in den Blick, von denen wir gerade genug wissen, um Wissensansprüche zu formulieren, die sich womöglich nie einlösen lassen. Das klassisch erkenntnistheoretische (...) Problem: „Was können wir wissen?“ steht heute in einem Spannungsverhältnis zu der wissenspolitischen Frage: „Was müssen wir wissen?“ Was wir wissen müssen, ist einerseits so viel wie nötig, wenn es um Fragen von Sicherheit und Gesundheit geht – andererseits aber so wenig wie möglich, wenn es in Alltag, Wirtschaft oder Wissen­schaft darauf ankommt, Wissen an technische Systeme oder Expertenkulturen zu delegieren. Bezeichnet politisch handlungsorientiertes und wissenschaftliches Nichtwissen zunächst ein Defizit, ist technisches Nichtwissen gleichermaßen erstrebenswert und problematisch. Einige, die Technik für angewandtes Wissen halten, mögen darin eine contradictio in adjecto sehen, manche sich um eine dem technischen Nichtwissen geschuldeten Technik­feindlichkeit sorgen, andere daraus die nötige Demut gegen verstiegene Allmachts­fantasien beziehen, während ihre Gegenspieler von Maschinen träumen, die über den Horizont intellektueller Nachvollziehbarkeit immer weiter hinauseilen. The authors describe the intensity and orientation of the corporate social responsibility reporting in four Spanish industries and explore the relationship that exists between both concepts and an independent measurement of reputation for CSR. The results demonstrate that the CSR reporting is especially relevant and useful in the finance industry. Finance companies report significantly more CSR information than most industries in Spain, and this reporting is more closely linked to their CSRR than the CSR reporting of basic, consumer goods and (...) services industries. A explicação bioquímica da dominância permite a reinterpretação do fenômeno e da relação entre a genética da transmissão e a genética molecular. O objetivo deste trabalho é discutir sobre as explicações de dominância e recessividade a partir da proposta de Mendel, e como a genética molecular contemporânea contribuiu nesse sentido. Para tanto, considerar-se-á alguns autores que, no século XX, procuraram explicar o fenômeno bem como aspectos referentes à articulação entre genética da transmissão e genética molecular na interpretação da dominância. In der Tugendlehre Kants findet die allgemeine ethische Orientierung, wie sie der Kategorische Imperativ ausdrückt, Anwendung auf die Bedingungen der menschlichen Existenz. Die vorliegende Untersuchung rekonstruiert den Kantischen Ansatz vor dem Hintergrund der gegenwärtigen, vor allem aristotelischen Tugendethik und löst dabei den Kantischen Tugendbegriff kritisch von seinen zeitbedingten Prägungen. Auf so erneuerter Grundlage wird eine transzendentalphilosophische Ethikkonzeption entfaltet, die den methodischen und inhaltlichen Einsichten der jüngeren Theorieentwicklung Rechnung trägt. This case study chronicles the pedagogical decision making of one high school teacher, Mr. Diego de la Vega, a pseudonym, as he teaches about race and racism in his elective social studies class, Race, Gender, and Ethnicity. De la Vega draws upon his own racial biography and experiences with race/ism to engage with high school students around racialized content. A conceptual framework grounded in racial identity development theory is used. Die Denkfigur des ordo inversus, die seit der Antike in den verschiedensten Disziplinen epistemische Sicherheit garantierte, verliert in der Zeit um 1800 an Plausibilität. Es kommt zu einem Formen- und Funktionswandel, der in den Künsten wie auch in den Natur-und Geisteswissenschaften auf vielfältige Weise resonierte. Der ordo inversus bezeichnet eine zirkuläre Bewegung, die von einem Anfangs- zu einem Endpunkt fortschreitet und im Zurückkehren wieder mit dem Ausgangspunkt verbunden wird, häufig in Teilbewegungen aufgespalten, etwa progressio/regressio oder analysis/synthesis. Als Methodenkonzept spielt er (...) von der Antike über das Mittelalter und die Frühe Neuzeit bis weit ins 18. Jahrhundert hinein eine zentrale Rolle in Theologie, Logik, Naturphilosophie und Hermeneutik. Das Zerbrechen des ordo inversus provoziert eine Reihe von Restitutionsversuchen von so unterschiedlichen Autoren wie Goethe, Novalis und Jean Paul, aber auch bei Lambert, Kant, Fichte und Schleiermacher. This paper addresses Hannah Arendt’s approach in “Truth and Politics” to the use of lies in the public and political spheres. Considering Derrida’s review in his lecture History of the Lie: Prolegomena, we will attempt to resolve questions of greater importance: How can a lie be politically effective? What does that efficiency imply? We will see that in politics lies do not consist, as Arendt and her tradition have argued, in the intentionality of the message or in self-deception ; but (...) rather that lying produces “effects of truth”, generating, producing and sustaining new truths and realities by virtue of the speech acts themselves. However, just as not every performative utterance is mendacious, we will also see in what sense the effectiveness of the political lie is deeply related to who is the agent of that saying. (shrink)

Im Mittelpunkt der vorliegenden Studie steht die Frage nach der Tragweite und Anwendungsrelevanz der Methodenlehre Émilie du Châtelets für die Physik im 18. Jahrhundert, mit der sich die Französin an der Diskussion um Energie- und Impulserhaltung und um das Prinzip der kleinsten Wirkung beteiligte. Andrea Reichenberger zeigt, dass Prinzipien und Hypothesen für Émilie du Châtelet als Fundament und Gerüst wissenschaftlicher Erkenntnis gelten. Im Zusammenspiel beider Komponenten erweisen sich das Prinzip des Widerspruchs und das Prinzip des zureichenden Grundes als regulative (...) Leitlinien und Handlungsmaxime für die auf Hypothesen gestützte Theoriebildung und -begründung. Die sich daraus ergebenden Konsequenzen für den Status und Inhalt der Newtonschen Axiome werden exemplarisch aufgezeigt. (shrink)

This article proposes a novel interpretation of Montaigne’s and Bayle’s comments on Tacitus. My contention is that their Tacitism is a Foucauldian discourse on toleration. Toleration is an example of governmentality, a strategy to govern a population, not a genuine call for religious diversity. This novel reading applies to Michel de Montaigne’s Essays and Pierre Bayle’s Various Thoughts on the Occasion of a Comet and his Historical and Critical Dictionary. Montaigne’s essay On the Useful and the Honourable, he shows that (...) there is a difference between his public and private persona. The author discusses ideas of toleration in a Tacitist style. This happens in his essay Something Lacking in Our Civil Administrations, where the author laments the death of Sebastian Castalio and, indirectly, he supports his commitment to religious pluralism. As I will show, Montaigne embraces a Gallican belief system, which is more conciliatory Bayle a century later, discusses the same issues. In his Various Thoughts, he makes a case for toleration as a tool to manage a population. Ultimately, it will be clear how this plea for toleration is not a product of the Enlightenment, but it is rather a discourse to achieve societal compliance. (shrink)

How did the relations between philosophy and science evolve during the 17th and the 18th century? This book analyzes this issue by considering the history of Cartesianism in Dutch universities, as well as its legacy in the 18th century. It takes into account the ways in which the disciplines of logic and metaphysics became functional to the justification and reflection on the conceptual premises and the methods of natural philosophy, changing their traditional roles as art of reasoning and as science (...) of being. This transformation took place as a result of two factors. First, logic and metaphysics were used to grant the status of indubitable knowledge of natural philosophy. Second, the debates internal to Cartesianism, as well as the emergence of alternative philosophical world-views progressively deprived such disciplines of their foundational function, and they started to become forms of reflection over given scientific practices, either Cartesian, experimental, or Newtonian. O estresse percebido afeta diretamente a sensação de bem-estar e sabe-se que o trabalho é uma das principais fontes de estresse. Neste artigo, objetivou-se analisar a percepção de estresse e bem-estar entre trabalhadores da cidade de Franca (SP) em comparação com o restante do Brasil. Participaram 291 trabalhadores, sendo 110 de Franca (Grupo Franca – GF) e 181 do restante do Brasil (Grupo Brasil – GB). Do total amostral, a maioria foi de mulheres (67,4%) em idade economicamente ativa (75,6%), sem (...) filhos (52,92%), com ensino superior ou pós-graduação (74%), trabalhando em comércio e serviços (61,5%) e em regime celetista (55%). Os participantes responderam, on-line, a dois instrumentos para avaliar a percepção de estresse e bem-estar. Utilizou-se o teste t e correlação de Pearson para análises das variáveis estudadas. Observou-se que o bem-estar indica significativa (p ≤ 0,001) correlação negativa com a percepção de estresse na amostra como um todo (GF r = -0,40 e GB r = -0,50) e, apesar de não terem sido identificadas diferenças significativas entre os grupos, a cidade de Franca não apresentou correlação significativa com os fatores estressores relativos à carga e ao ambiente de trabalho. Todos os demais fatores estressores (financeiro, social, cognições, família, saúde e relaxamento) apresentaram correlações maiores no GB do que no GF. Os dados sugerem que, apesar de o estresse afetar diretamente a sensação de bem-estar, a vivência fora dos grandes centros urbanos, em cidades menores, parece proporcionar uma relação mais adequada com o trabalho. Embora a extensão da dependência entre teorias da estética e modelos da mente seja urna questão de aceso debate, é justo afirmar que as abordagens actuáis da consciência sugerem novas perspectivas sobre a natureza da experiência estética. As recentes descobertas da neurociência têm afetado a nossa forma de ver a estética e a arte. Todavia, enquanto é frequentemente sugerido que a neurociência vai, em breve, obter urna descrição completa da natureza da mente e, portanto, da experiência estética, aqui consideram-se as (...) consequências da recente bifurcação teórica a respeito da localizacão da mente (ou seja, as posições externalistas versus internalistas). A partir deste ponto de vista, as questões da unidade e do significado são usadas para investigar a natureza da experiência estética e da arte. A discussão baseia-se na distinção de William James entre núcleo e periferia, levando a uma perspectiva de convergência entre a psicologia, a fenomenologia e a neurociência. Por fim, a arte é explorada como urna janela para olhar para dentro de aspectos fundamentais da vida mental, quer por meio dos recentes resultados de imagens do cérebro, quer através dos modelos mais abrangentes da mente. While the extent of the dependence between theories of aesthetics and models of the mind is a matter of lively debate, it is fair to claim that current approaches to consciousness suggest new perspectives about the nature of aesthetic experience. Recent findings of neuroscience have affected how we see aesthetics and art. Nevertheless, while it is often suggested that neuroscience will soon offer a comprehensive account of the nature of mind and thus of aesthetic experience, here we consider the consequences on the recent theoretical bifurcation as to where mind is located (namely the externalist vs. the internalist stance). From such a view, the issues of unity and meaning are used to probe into the nature of aesthetic experience and art. The discussion draws upon William James' distinction between nucleus and fringe and puts forward a converging perspective between psychology, phenomenology and neuroscience. Eventually, art is exploited as a window to peer inside fundamental aspects of mental life by means both of recent brain imaging results and more extended models of the mind. (shrink)

In this article I present a new perspective on the theological concept of justification, by focusing not on the content but on the form of this concept. I start with the semantic overabundance related to justification, with specific reference three meanings: the forensic, the effective, and the ontological-theotic. Then, I confront these meanings with Luther's idea of justification as in his De servo arbitrio. Thanks to this, I stress that the theological concept of justification plays a meta-conceptual function: it affirms (...) the priority of divine justification over any standard condition of conceptualization and thinkability of justification – in specific, the structure of imputative justice. This leads to a reconsideration of the role of this concept as "articulus stantis et cadentis ecclesiæ". (shrink)

According to Arti Dhand, it can be argued that all Indian ethics have been primarily virtue ethics. Many have indeed jumped on the virtue bandwagon, providing prima facie interpretations of Hindu, Jain, and Buddhist canons in virtue terms. Others have expressed firm skepticism, claiming that virtues are not proven to be grounded in the nature of things and that, ultimately, the appeal to virtue might just well be a mere façon de parler. In this paper, we aim to advance the (...) discussion of Indian virtue ethics. Our intent is not to provide a catch-all interpretation of the different Indian schools. Our goal is, more modestly, to offer a theory of virtues in Indian philosophies, as a framework for theorists and interpreters who see these diverse traditions as amenable to systematic virtue analysis. Our theory grounds virtues in the reality of genuine moral dispositions and in a system of beliefs where morality is understood as transformative in nature. (shrink)

Sigieri di Brabante, maestro di filosofia presso la facoltà delle arti dell'università di Parigi, fu uno dei principali esponenti di quell'"aristotelismo radicale" che costituì uno dei principali obiettivi delle condanne del vescovo Étienne Tempier del 1270 e del 1277. Il De aeternitate mundi è la testimonianza di un corso tenuto da Sigieri nel 1272 sul problema se la specie umana sia stata creata nel tempo. Vengono qui esaminate sia in generale le tesi di Sigieri riguardo ai diversi argomenti affrontati, sia (...) nello specifico il problema della causazione per intermediari. Quest'ultimo tema rimanda non solo alle altre opere in cui Sigieri ha affrontato tali problematiche, ma anche ad una tradizione che trae le sue origini nella filosofia greca classica e si sviluppa nel medioevo latino e arabo. De Marchi and Lorenzetti :253-261, 2016) have recently argued that in fields where the journal impact factor is not calculated, such as in the humanities, it is key to find other indicators that would allow the relevant community to assess the quality of scholarly journals and the research outputs that are published in them. The authors' suggestion is that information concerning the journal's rejection rate and the number of subscriptions sold is important and should be used for such assessment. The (...) question addressed by the authors is very important, yet their proposed solutions are problematic. Here I point to some of these problems and illustrate them by considering as a case in point the field of philosophy. Specifically, here I argue for four main claims. First, even assuming that IF provides a reliable indicator of the quality of journals for the assessment of research outputs, De Marchi and Lorenzetti have failed to validate their suggested indicators and proxies. Second, it has not been clarified why, in absence of IF, other journal-based metrics that are currently available should not be used. Third, the relationship between IF and rejection rate is more complex than the authors suggest. Fourth, accepting the number of sold subscriptions as a proxy would result in discrimination against open access journals. The upshot of my analysis is that the question of how to assess journals and research outputs in the humanities is still far from resolved. (shrink)

Spin is a fundamental and distinctive property of the electron, having far-reaching implications. Yet its purely formal treatment often blurs the physical content and meaning of the spin operator and associated observables. In this work we propose to advance in disclosing the meaning behind the formalism, by first recalling some basic facts about the one-particle spin operator. ZusammenfassungDie Schweigepflicht, einer der Grundpfeiler medizinischer Ethik, spielt in der aktuellen Diskussion um die Verbesserung des Kinderschutzes eine zentrale Rolle. Unklare und mehrdeutige gesetzliche Regelungen und Handlungsanweisungen, wie mit Anhaltspunkten für eine Kindeswohlgefährdung umzugehen ist, wenn die Sorgeberechtigten eine weitergehende Hilfe ablehnen, werden als Hindernis für einen wirksamen Kinderschutz betrachtet. Aus der schwer durchschaubaren Rechtslage resultieren für Angehörige der Gesundheitsberufe regelmäßig Handlungsunsicherheiten, die im Einzelfall notwendige Hilfe verzögern oder gar verhindern könnten. Neue Gesetze auf Länderebene haben deshalb im Sinne eines (...) verbesserten Kinderschutzes eine Erhöhung der Rechtssicherheit sowie eine Förderung der Vernetzung der beteiligten Akteure zum Ziel. Wenn auch einigen der Gesetze ein gewisses Klarstellungspotenzial zugebilligt werden kann, ist doch im Augenblick ihr Beitrag zu mehr Rechtssicherheit im Umgang mit Kinderschutzfällen noch als sehr eingeschränkt zu betrachten. Ein Bundesgesetz, welches die Intention hatte, die heterogenen Landesnormen durch eine bundeseinheitliche Regelung zu ersetzen, ist wenigstens in der letzten Legislaturperiode gescheitert. (shrink)

Der Aufsatz behandelt die Frage, in welcher Weise die Erfahrung einer Illusion und der Vollzug einer Reflexion konstitutive Merkmale der ästhetischen Erfahrung sind. Nach einem weit verbreiteten Verständnis der ästhetischen Erfahrung beschreiben der Begriff der Illusion und der Begriff der Reflexion zwei einander entgegengesetzte Akte: Mit einem Akt der Reflexion machen wir uns eine Illusion bewusst, deren Opfer wir andernfalls waren. Der Beitrag zeigt dagegen, dass im Bereich des Ästhetischen der Begriff der Reflexion keinen Akt beschreibt, der einem Akt der (...) Illusion entgegengesetzt ist. Die Begriffe der Reflexion und Illusion beschreiben hier vielmehr einen einzigen Akt, und zwar so, dass sie hierbei einander wechselseitig erläutern. (shrink)

In der zeitgenössischen Erkenntnistheorie ist die Idee verbreitet, dass der Erwerb von Wissen davon abhängig ist, dass das Subjekt des Wissens an einer bestimmten Lebensform teilhat, die grundlegender als sein Wissen ist. Das ist eine Lesart der Position Wittgensteins, deren exemplarischer Vertreter etwa Stanley Cavell ist. Meine These dagegen lautet, dass die Lebensformtheorie einem erkenntnistheoretischen Dogma aufruht, dessen Überwindung Wittgensteins eigentliches Anliegen war: Es ist das Dogma, dass die grundlegende Bedeutung des Wissensbegriffs in der Beschreibung eines einzelnen Aktes besteht, und (...) nicht in der Beschreibung von etwas, das auf einer logisch anderen Ebene steht: nämlich einer Fähigkeit. Damit soll nicht bestritten werden, dass die Idee einer bestimmten Lebensform wesentlich ist für die Beschreibung erkenntnisfähiger Subjekte. Doch diese ist nicht grundlegender als die Idee des Wissens selbst. (shrink)
