The standard by which we apply decision-making for those unable to do so for themselves is an important practical ethical issue with substantial implications for the treatment and welfare of such individuals. The approach to proxy or surrogate decision-making based upon substituted judgement is often seen as the ideal standard to aim for but suffers from a need to provide a clear account of how to determine the validity of the proxy's judgements. Proponents have responded to this demand by providing (...) the truth-conditions for the substituted judgement in terms of counterfactual reasoning using a possible worlds semantics. In this paper, I show how these underpinnings fail to support the substituted judgement approach as a reasonable standard for decision-making. Firstly, I show how this counterfactual element has been poorly interpreted. I then explain how various accounts have failed to reflect problems and limitations associated with providing an interpretation of their truth-conditions using counterfactuals. Finally, I argue that, even when we attend to the initial problems of providing a counterfactual analysis, it still deeply problematic as a means of determining the validity of substituted judgements for two main reasons. Firstly, making determinate judgements as to the truth-value of these judgements will often not be possible and, secondly, there is a strong requirement when interpreting many counterfactual claims to charitably accede to their being true. I conclude that substituted judgements, as interpreted through counterfactual reasoning and possible worlds semantics, do not therefore provide an adequate standard for surrogate decision-making. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. Exploring the first-person narratives of three figures from the Christian, Jewish, and Islamic mystical traditions—St. Teresa of Avila, Rabbi Dov Baer, and Rzbihn Baql—Anthony J. Steinbock provides a complete phenomenology of mysticism based in the Abrahamic religious traditions. He relates a broad range of religious experiences, or verticality, to philosophical problems of evidence, selfhood, and otherness. From this philosophical description of vertical experience, Steinbock develops a social and cultural critique in terms of idolatry—as pride, secularism, and fundamentalism—and suggests that (...) contemporary understandings of human experience must come from a fuller, more open view of religious experience. An ethic of the fitting: a conceptual framework for nursing practiceNurses are expected to act within an ethos of care cognisant of duty, the right, and the good. Concepts of virtue theory, utilitarianism and deontology are used to outline a conceptual ethical framework for nurses in practice. This ‘Moebius’ framework aims to locate the virtues in a symbiotic relationship with the principles of utilitarianism and deontology. Under this framework, fitting ethical responses are sought. Within an ethic of the fitting, rules (...) and principles do not guarantee the most ethically justifiable outcomes. Within the Moebius approach, the nurse ought to respond with a sense of compassion that befits the moment rather than adhere to a rule at all costs. (shrink)

Disvaluing nature—a cognitive act—usually leads quickly to devaluing it too: to real-world exploitation and destruction. Worse, in fact, nature in its devalued state can then be held up as an excuse and justification for the initial disvaluation. In this way, dismissal and destruction perpetuate themselves. I call this process “self-validating reduction.” It is crucial to recognize the cycle of self-validating reduction, both in general and specifically as it applies to nature, if we are to have any chance of reversing it.

Ideophony is a neglected aspect of investigations of world poetic traditions. This article looks at the use of ideophony in a variety of Navajo poetic genres. Examples are given from Navajo place-names, narratives, and songs. A final example involves the use of ideophony in contemporary written Navajo poetry. Using the work of Woodbury, Friedrich, and Becker it is argued that ideophones are an example of form-dependent expression, poetic indeterminacy, and the inherent exuberances and deficiencies of translation and thus strongly resists (...) translation. This fact becomes more relevant when understood in light of the current language shift from Navajo to English. (shrink)

Parfit’s (1984) Non-Identity Problem provides a strong line of argument that we cannot be harmed by pre-conception choices or actions. I argue that we can no longer appeal to the Non-Identity problem in order to justify using pre-conception genetic screening and selection techniques as a harmless tool to determine the genetic constitution of future individuals. My criticism of the Non-Identity problem is based on a rejection of the metaphysical foundations of Parfit’s argument - Kripke’s (1980) essentialist arguments for the necessity (...) of origin. I offer an alternative account of modal harms based on counterpart theory such as that offered by David Lewis (1986). On this account, individuals can make legitimate harm claims in regard to pre-conception choices made in determining their genetic constitution by appeal to their counterparts across possible worlds. Author Anthony Rudd ties this idea to the work of Wittgenstein and Heidegger, exploring important similarities between the former's reminders of the "expressive" character of human experience and the latter's account of ways to experience the physical world "expressively.".

Increasing computational power and improving deep learning methods have made computer vision technologies pervasively common in urban environments. Their applications in policing, traffic management, and documenting public spaces are increasingly common (Ridgeway 2018, Coifman et al. 1998, Sun et al. 2020). Despite the often-discussed biases in the algorithms' training and unequally borne benefits (Khosla et al. 2012), almost all applications similarly reduce urban experiences to simplistic, reductive, and mechanistic measures. There is a lack of context, depth, and specificity in these (...) practices that enables semantic knowledge or analysis within urban contexts, especially within the context of using and occupying urban space. This paper will critique existing uses of artificial intelligence and computer vision in urban practices to propose a new framework for understanding people, action, and public space. This paper revisits Geertz's (1973) use of thick descriptions in generating interpretive theories of culture and activity and uses this lens to establish a framework to approach evaluating the varied uses of computer vision technologies that weigh meaning. By discussing cases of implemented examples of urban computer vision—from LinkNYC and Numina's urban measurements to the Detroit Police's use of DataWorks Plus's facial recognition technology—it proposes a framework for evaluating the thickness of the algorithm's conclusions against the computational method's complexity required to produce that outcome. Further, we discuss how the framework's positioning may differ (and conflict) between different users of the technology, from engineer to urban planner and policymaker, to citizen. This paper also discusses how the current use and training of deep learning algorithms and how this process limits semantic learning and proposes three potential methodologies toward gaining a more contextually specific, urban-semantic, description of urban space relevant to urbanists. This paper contributes to the critical conversations regarding the proliferation of artificial intelligence by challenging the current applications of these technologies in the urban environment by highlighting their failures within this context while also proposing an evolution of these algorithms that may ultimately make them sensitive and useful within this spatial and cultural milieu. Addressing the matter of attention from a phenomenological perspective as it bears on the problem of becoming aware, I draw on Edmund Husserl''s analyses and distinctions that mark his genetic phenomenology. I describe several experiential levels of affective force and modes of attentiveness, ranging from what I call dispositional orientation and passive discernment to so-called higher levels of attentiveness in cognitive interest, judicative objectivation, and conceptualization. These modes of attentiveness can be understood as motivating a still more active mode of (...) reflective attention, i.e., philosophical attentiveness, and to this extent, even it would be subject to varying influences of affection. What role, if any, does affection play in a peculiar kind of reflective attention that is phenomenological? I conclude by briefly considering phenomenological reflective attentiveness and its relation to affection. (shrink)

The quantum-mechanical description of the world, including human observers, makes substantial use of entanglement. In order to understand this, we need to adopt concepts of truth, probability and time which are unfamiliar in modern scientific thought. There are two kinds of statements about the world: those made from inside the world, and those from outside. The conflict between contradictory statements which both appear to be true can be resolved by recognising that they are made in different perspectives. Probability, in an (...) objective sense, belongs in the internal perspective, and to statements in the future tense. Such statements obey a many-valued logic, in which the truth values are identified as probabilities. (shrink)

The standard definition of atomicity—the thesis that everything is ultimately composed of entities that lack proper parts—is satisfied by a model that is not atomistic. The standard definition is therefore an incorrect characterization of atomicity. I show that the model satisfies the axioms of all but the strongest mereology and therefore that the standard definition of atomicity is only adequate given some controversial metaphysical assumptions. I end by proposing a new definition of atomicity that does not require extensionality or unrestricted (...) summation. (shrink)

Based on ethnographic and linguistic analyses, this article describes the discourse-related practices and interactional role behaviours of an experienced lawyer who assumed a pivotal role in the negotiation of a Mergers-and-Acquisitions type transaction vis-a-vis a number of other legal and financial professionals. Set in an international business context, all communication took place in English and for the most part via email. Complex discursive processes facilitated close interdisciplinary engagement and, more particularly, required that a single individual assume a key interactional role (...) to oversee and advance the negotiation activities. This pivotal role entailed the strategic use of language and discourse to negotiate, account for, and justify the various stages of the negotiation. In addition to textual analyses of the negotiated contract and attendant emails, interviews were conducted with the principal lawyer and her senior partner in order to examine the textual findings grounded in the organisational context of a law firm and produce an ontology of this negotiation process. These research findings could be used to assist novice lawyers and business professionals to understand some of the discourse strategies and interactional roles that are often so critical for commercial contract negotiation activities. An important work in the debate between materialists and dualists, the public correspondence between Anthony Collins and Samuel Clarke provided the framework for arguments over consciousness and personal identity in eighteenth-century Britain. In Clarke's view, mind and consciousness are so unified that they cannot be compounded into wholes or divided into parts, so mind and consciousness must be distinct from matter. Collins, by contrast, was a perceptive advocate of a materialist account of mind, who defended the possibility that thinking (...) and consciousness are emergent properties of the brain. My text is written to answer the questions asked at the APA Meeting's presentation of the book Moral Textures: Feminist Narratives in the Public Sphere by professors María Lugones and Eduardo Mendieta. The answer seeks to clarify that Lugones's infrapolitics position is not so distant from mine. I also address Mendieta's question directed more to the aesthetic domain. There, I seek to show how my position could be taken as a creative effort to extend some of Habermas's early work on (...) the public sphere, and to develop the thesis of the important relations between the aesthetic and the moral realms. According to quantum mechanics, statements about the future made by sentient beings like us are, in general, neither true nor false; they must satisfy a many-valued logic. I propose that the truth value of such a statement should be identified with the probability that the event it describes will occur. After reviewing the history of related ideas in logic, I argue that it gives an understanding of probability which is particularly satisfactory for use in quantum mechanics. I construct a lattice (...) of future-tense propositions, with truth values in the interval [0, 1], and derive logical properties of these truth values given by the usual quantum-mechanical formula for the probability of a history.
