This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. En Self-Constitution. Agency, Identity, and Integrity (2009), Christine Korsgaard defiende la conclusión de que el imperativo categórico rige la acción humana porque es el único principio que permite alcanzar la unidad psíquica plena, la cual, según Korsgaard, es un prerrequisito esencial para la acción efectiva. Para los agentes humanos, alcanzar esa unidad -que consiste en hacer coherentes distintos impulsos hacia la acción- es una actividad constante, denominada "autoconstitución". De acuerdo con Korsgaard, ésta es la fuente originaria de la normatividad y (...) de las identidades prácticas e incluso de la identidad personal. Después de exponer las ideas centrales del libro, presento dos objeciones: primero, critico la equiparación del imperativo categórico con la autoconstitución exitosa, pues no toda falla de auto-constitución es una falla moral. Segundo, argumento que la tesis de que la identidad personal es producto de la autoconstitución es problemática y que, al defenderla, Korsgaard confunde identidad práctica con identidad personal. Agency, Identity, and Integrity (2009), Christine Korsgaard argues that the categorical imperative rules human action because it is the sole principle that allows us to reach the complete psychic unity that, Korsgaard thinks, is an essential prerequisite for effective action. Reaching this unity -which consists in making cohere diverging impulses for action- is for human agents a constant activity called "self-constitution." According to Korsgaard, this activity is the source of normativity, of human practical identities and even of personal identity. After explaining the main ideas of the book, I present two objections. First, I criticize the linkage of the categorical imperative to successful self-constitution, for not every failure of the latter counts as a moral failure. Second, I argue that the thesis that personal identity is a product of self-constitution is problematic and that it betrays a confusion between practical identity and personal identity. (shrink)

Jakob Johannes von Uexküll’s biological thought influenced a new path to approach the view of a living being throughout of the twentieth century. At the beginning of the past century, in Spain a “new vertebrate way of thinking” was generated, as Ortega would say. And the work of Uexküll initiated an interest in the circles of thinkers of the likes of Julio Caro Baroja, José Ortega y Gasset, and Xavier Zubiri among others. My aim is describing how Uexküll plays a (...) part in the development in the foundations of thoughts of these thinkers; in particular, Ortega and Zubiri’s thought and their interactions between the circumstantiality and formality, respectively, and Uexküll’s Umwelt. In fact, Ortega’s biological thought was the foundation of his vitalism realism and made a giant step in philosophical anthropology existentialism in his Meditations of Quixote in 1911. We will also see the anthropologist Caro Baroja’s epistemic Uexküll influences. A retrospective view of Spanish thought will be developed, where the seeds of Uexküll made fruitful the development of several authors, as well as some transitive or indirect influences; even the generation of discrepancies in others. Finally, we will describe the development, in Spanish, that had the work of Thure von Uexküll, which includes the work of his father. With Thure, the Uexküll influences in Spain concluded until the start of interest in zoosemiotics and biosemiotics. (shrink)

Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

El propósito de este libro es de examinar cuales fueron los órdenes epistemológicos, las prácticas discursivas y los mecanismos disciplinarios que hicieron posible en el siglo XX la construcción de un objeto de conocimiento llamado "Latinoamérica", y de una serie de saberes filosóficos sobre "lo latinoamericano". El autor realiza un ejercicio deconstructivo de aquellas narrativas que, con base a la creación de identidades homogéneas, buscaron presentar a Latinoamérica como lo "otro" de la modernidad occidental, e incluso como el continente llamado (...) a mostrar un camino nuevo de liberación para toda la humanidad. A través de un diálogo con pensadores como Foucault, Said, Rama, Lyotard, Mignolo y Spivak, el autor muestra que los principales temas, registros y motivos esgrimidos a favor de una "exterioridad" latinoamericana con respecto a la modernidad, son en realidad discursos pertenecientes a un orden moderno del saber. Johann Gottfried Herder, like his contemporaries, reflected on language and in 1772 published the Treatise on the Origin of Language, which in the previous year had earned the distinction of the Berlin Academy for best essay. However, even today, much of his thought is unknown, ignoring the fact that some of the modern approaches of contemporary philosophy, philosophical anthropology or even sociobiology are already stated there, namely in the narratives resulting from the enunciation of the four natural laws. More than (...) justifying the origin of language, the philosopher’s essay also allows us to understand human nature, inserting its genesis at the heart of philosophical anthropology and contradicting, if not even confronting in this way, the divine tradition of this attribution. Thus, at first, a generic analysis of the work will be carried out, highlighting the fundamental theses that will allow the establishment of a dialogue with some of the contemporary philosophical approaches. Then, admitting the possibility of a scenario of technological singularity, as stated by Irving John Good, Vernor Vinge or Ray Kurzweil, to verify the plausibility and validity of Herder’s theses regarding the scope of language and human nature and how this could constitute a frontier of resistance. In attempting to debunk moral realism through an appeal to evolutionary facts, debunkers face a series of problems, which we label the problems of scope, corrosiveness, and post‐hoc justification. To overcome these problems, debunkers must assume certain metaphysical or epistemological positions, or otherwise pre‐establish them. In doing so, they must assume or pre‐establish the very conclusion they seek in advancing the argument. This means that such debunking arguments either beg the question against the moral realist or are undermined as standalone (...) metaethical arguments. (shrink)

New media (highly interactive digital technology for creating, sharing, and consuming information) affords users a great deal of control over their informational diets. As a result, many users of new media unwittingly encapsulate themselves in epistemic bubbles (epistemic structures, such as highly personalized news feeds, that leave relevant sources of information out (Nguyen forthcoming)). Epistemically paternalistic alterations to new media technologies could be made to pop at least some epistemic bubbles. We examine one such alteration that Facebook has made in (...) an effort to fight fake news and conclude that it is morally permissible. We further argue that many epistemically paternalistic policies can (and should) be a perennial part of the internet information environment. (shrink)

The empirical relationship between a firm’s social performance and its financial performance is still not well established in the literature. Despite more than 30 years of research and more than 100 empirical studies on the issue, the results are still mixed. We argue that the heterogeneous results found in previous studies are not due exclusively to problems related with the measurement instruments or the samples used. Instead, we posit that a more fundamental problem related with the endogeneity of social strategic (...) decisions could be driving most of the empirical findings. We show that, using a panel data of 658 firms from 1991 to 2005, how some of the results found in previous research change, and some are even reversed when endogeneity is properly taken into account. This paper takes the view that compensated donation and altruism are not incompatible. In particular, it holds that the arguments against giving compensation stand on weak rational grounds: the charge that compensation fosters “commodification” has neither been specific enough to account for different types of monetary transactions nor sufficiently grounded in reality to be rationally convincing; although altruism is commendable, organ donors should not be compelled to act purely on the basis of altruistic motivations, especially if there are good reasons (...) to believe that significantly more lives can be saved and enhanced if incentives are put in place, and offering compensation for organs does not necessarily lead to exploitation—on the contrary, it may be regarded as a necessity in efforts to minimise the level of exploitation that already exists in current organ procurement systems. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. Misrepresentations can be innocuous or even useful, but Kant’s corollary to the formula of universal law appears to involve a pernicious one: “act as if the maxim of your action were to become by your will a universal law of nature”. Humans obviously cannot make their maxims into laws of nature, and it seems preposterous to claim that we are morally required to pretend that we can. Given that Kant was careful to eradicate pernicious misrepresentations from theoretical metaphysics, the imperative (...) to act as if I have this supernatural power has typically been treated as an embarrassment meriting apology. The wording of the corollary may be vindicated, however, by recognizing that “as if” (als ob) is a technical term both in the Critique of Pure Reason and here. It signals a modal shift from the assertoric to the problematic mode of cognition, one that is necessitated by the attempt to incorporate the natural effects of a free will into a universal moral imperative that is philosophically practical. In this paper I sketch how the modal shift makes sense of the corollary as a subjectively necessary, philosophically practical idealization of the extension of human freedom into nature, one that accurately represents a necessary parameter of moral conduct: moral ambition. Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

Este estudo tem como objetivo geral discorrer de forma sucinta e crítica sobre os principais desafios enfrentados pelas pessoas negras, em especial as mulheres, na sociedade brasileira. E como objetivos específicos, analisar, a partir da concepção do feminismo, as problemáticas que englobam o racismo, sexismo, democracia racial, estética do racismo e como estes também acabam servindo de base para o justificar o epistemicídio da intelectualidade negra feminina, no qual esses desafios são herdados de opressões do colonialismo imposto ao território brasileiro. Com isso, dissertaremos também a respeito de diversas categorias dessas opressões, e como elas se relacionam ao cenário político cultural brasileiro e de que maneira essas opressões atingem, em específico, os corpos das mulheres negras, que sofrem um processo constante de epistemicídio e sexualização extrema. Por fim, este trabalho tem como apoio teórico o pensamento da filósofa Lélia Gonzalez, que percebe na criação de um espaço de beleza negra feminina, que suas vozes podem ser ouvidas e sua filosofia exaltada. Não obstante, o texto também contém como suporte teórico complementar análises de autoras como Bell Hooks, Djamila Ribeiro, Sueli Carneiro. (shrink)

I criticize the widely accepted “practical” interpretation of the universality test contained in Kant’s first formula of the categorical imperative in the Groundwork of the Metaphysics of Morals – the formula of the universal law of nature. I argue that this interpretation does not work for contradictions in conception because it wrongly takes contradictions in the will as the model for them and, as a consequence, cannot establish a clear distinction between the two kinds of contradiction. This interpretation also assumes (...) an understanding of universality that departs from Kant’s own and, cannot, for this reason, capture the kind of contradiction that he explicitly claims to establish. I provide an alternative interpretation, which I call revised logical interpretation, that allows us to account for contradictions in conception, including those examples that the practical interpretation cannot handle, as well as to establish a clear distinction between the two kinds of contradiction. The harms associated with wireless mobile devices (e.g. smartphones) are well documented. They have been linked to anxiety, depression, diminished attention span, sleep disturbance, and decreased relationship satisfaction. Perhaps what is most worrying from a moral perspective, however, is the effect these devices can have on our autonomy. In this article, we argue that there is an obligation to foster and safeguard autonomy in ourselves, and we suggest that wireless mobile devices pose a serious threat to our capacity to fulfill (...) this obligation. We defend the existence of an imperfect duty to be a ‘digital minimalist’. That is, we have a moral obligation to be intentional about how and to what extent we use these devices. The empirical findings already justify prudential reasons in favor of digital minimalism, but the moral duty is distinct from and independent of prudential considerations. (shrink)

We offer an ethical assessment of the market for data used to generate what are sometimes called “consumer scores” (i.e., numerical expressions that are used to describe or predict people’s dispositions and behavior), and we argue that the assessment has ethical implications on how the market for consumer scoring data should be regulated. To conduct the assessment, we employ two heuristics for evaluating markets. One is the “harm” criterion, which relates to whether the market produces serious harms, either for participants (...) in the market, for third parties, or for society as a whole. The other is the “agency” criterion, which relates to whether participants understand the nature and significance of the exchanges they are making, if they can be guaranteed fair representation, or if there is differential need for the market’s good. We argue that consumer scoring data should be subject to the same sort of regulation as the older FICO credit scores. Although the movement in the 1990s that was aimed at regulating the FICO scores was not aimed at restraining a market per se, we argue that the reforms were underwritten by concerns about the same sorts of problems as those outlined by our heuristics. Therefore, consumer data should be subject to the same sort of regulation. (shrink)

A proposal to allow prisoners to save their lives or to be eligible for commutation of sentence by donating kidneys for transplantation has been a subject of controversy in the Philippines. Notwithstanding the vulnerabilities associated with imprisonment, there are good reasons for allowing organ donations by prisoners. Under certain conditions, such donations can be very beneficial not only to the recipients but to the prisoners themselves. While protection needs to be given to avoid coercion and exploitation, overprotection has to be (...) avoided. The prohibition on the involvement of prisoners in organ transplantation constitutes unjustified overprotection. Under certain conditions, prisoners can make genuinely independent decisions. When it can be reasonably ascertained that they are able to decide freely, society should recognise an obligation to help them implement their decisions, such as when they intend to donate an organ as a way of asserting their religious faith and performing a sacrifice in atonement for their sins. Resumen Este artículo tiene como propósito central presentar los resultados de una investigación sobre el funcionamiento de las coletillas interrogativas en un corpus oral del español de Chile desde una perspectiva sistémico funcional del lenguaje. Las categorías de análisis interpersonal se derivan de los estratos semántico-discursivo y léxico-gramatical. En el estrato de los significados se han considerado la función de habla y la mercancía semiótica, mientras que en el estrato de la codificación los modos de cláusula y la ubicación de (...) coletilla en la cláusula. Se concluye que la coletilla es un recurso productivo para la expresión de significados interpersonales en todas las funciones de habla. Se integra mayormente en movimientos que cumplen el rol de “dar”, en tanto que la principal materia de negociación es “información”. Dentro del sistema de MODO, se integran en posición final de cláusulas declarativas y en menor medida en cláusulas imperativas e interrogativas. Abstract The main purpose of this paper is to present the results of an investigation about functioning of tag questions in oral corpus of Chilean Spanish from a systemic-functional language perspective. The categories of interpersonal analysis are derived from the semantic-discursive and lexical-grammatical strata. In the meaning stratum, the speech function and the semiotic commodity have been considered, while in the coding stratum, the clause modes and the location of the tag question in the clause have been considered. It is concluded that the tag question is a productive resource for the expression of interpersonal meanings in all speech functions. It is mostly integrated in moves that fulfill the role of ‘give’, while the main subject of negotiation is ‘information’. Within the mood system, they are mostly integrated in final position of declarative clauses and to a lesser extent in imperative and interrogative clauses. (shrink)

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. En este estudio se pretende, por el contrario, hablar de la infinitud como realidad, como aquello en lo que estamos y que nos constituye. Pero no se trata solamente de la realidad divina, tardíamente considerada sin embargo como infinita, sino también de la realidad toda, que procede en definitiva de lo divino infinito como de su fuente (...) y sustento radical, y que debido a ello no puede coherentemente ser pensada sino como participando de algún modo de lo infinito originante. La amplia y sutil peripecia especulativa de la reflexión occidental, desde lo griegos hasta la actualidad, sobre la infinitud o no-limitación de la realidad es aquí objeto de atención y análisis sostenidos.
