Contemporary business often encompasses or aspires towards the automated, networked production of industrial goods across transnational supply chains that have many digitalized interfaces. This allows competitive operations in time, costs, and quality, which have been widely discussed. On the downside, it entails cyber threats with significant risks for society in areas including business, environment, and health. Hence, to adequately manage these risks in the emerging digital world, there is a vital necessity to raise awareness, establish, maintain, and further develop cyber-security (...) measures to ensure an appropriate level of protection along the entire value chain and supply chain. Blockchain capabilities are introduced to improve the technical and organizational basis for secured operations in industrial networks. Its advantages are explained by a simple USB-device use case, that has often been the root cause to subsequent security incidents, especially in the Stuxnet incident. (shrink)

The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. RESUMEN El objetivo de este artículo es proponer una reinterpretación del concepto de comunidad a la luz de las transformaciones tecnológicas y de las formas de comunicación recientes, las cuales ponen la idea de lo social no como precepto teórico, sino como elemento a descubrir en los diferentes estudios planteados. Se busca una transversalización teórica de los tres autores, tomando elementos esenciales de sus obras para proponer una nueva clave interpretativa que permita tomar el concepto de comunidad no como un (...) presupuesto teórico, sino como un producto inmanente, resultado de las conexiones cotidianas que se realizan entre los sujetos de manera espontánea en el campo de lo social. ABSTRACT Taking as a starting point the objective of this article is the reinterpretation of the concept, forced by the technological and communication transformations that place the ideas of social and community, not as theoretical precepts, but as elements to discover on the studies proposed. A theoretical transversalization of the three authors will be sought, taking essential elements from their works to propose a new interpretative key that allows us to take the concept of community, not as a theoretical presupposition, but as an immanent product resulting from the daily connections made between the subjects, spontaneously, on the social field. What should we believe when epistemic and practical reasons pull in opposite directions? The traditional view states that there is something that we ought epistemically to believe and something that we ought practically to (cause ourselves to) believe, period. More recent accounts challenge this view, either by arguing that there is something that we ought simpliciter to believe, all epistemic and practical reasons considered (the weighing view), or by denying the normativity of epistemic reasons altogether (epistemic anti-normativism). I argue against (...) both accounts and defend the traditional view. An agent can be blameworthy in doxastic dilemmas for complying with their practical but not their epistemic reasons. This reveals how epistemic reasons are normative: the concept of epistemic blame helps us track epistemic normativity. (shrink)

It is often argued that there are no practical reasons for belief because we could not believe for such reasons. A recent reply by pragmatists is that we can often believe for practical reasons because we can often cause our beliefs for practical reasons. This paper reveals the limits of this recently popular strategy for defending pragmatism, and thereby reshapes the dialectical options for pragmatism. I argue that the strategy presupposes that reasons for being in non-intentional states are not reducible (...) to reasons to act. Pragmatists who want to preserve a motivational constraint on reasons therefore have exactly two options: either arguing that there are irreducible reasons for being in non-intentional states ; or arguing that we can believe directly for practical reasons. I argue that the prospects for the former option are dim because irreducible reasons to be in states are hard to square with the motivational constraint on reasons. Returning to the more traditional route of arguing for pragmatism by defending a version of doxastic voluntarism therefore seems to be the more promising way for pragmatists to go. (shrink)

How can we be responsible for our attitudes if we cannot normally choose what we believe, desire, feel, and intend? This problem has received much attention during the last decades, both in epistemology and in ethics. Yet its connections to discussions about reasons and rationality have been largely overlooked. Responsibility for Rationality is the first book that connects recent debates on responsibility and on rationality in a unifying dialectic. It achieves four main goals: first, it reinterprets the problem of responsibility (...) for attitudes as a problem about the normativity of rationality; second, it breaks the stalemate between rationalist and voluntarist accounts of mental responsibility by defending a hybrid view; third, it provides novel support to recent accounts of the normativity of rationality by arguing that epistemic reasons and other ‘right-kind’ reasons are genuine normative reasons; fourth, it sets the foundations and the research agenda for an ‘ethics of mind’, including an illustration of how to approach applied issues in epistemology within the presented framework. Eva Schmidt argues that facts about incoherent beliefs can be non-evidential epistemic reasons to suspend judgment. In this commentary, I argue that incoherence-based reasons to suspend are epistemically superfluous: if the subjects in Schmidt’s cases ought to suspend judgment, then they should do so merely on the basis of their evidential reasons. This suggests a more general strategy to reduce the apparent normativity of coherence to the normativity of evidence. I conclude with some remarks on the independent interest that reasons-first (...) epistemology might have within an evidentialist framework. (shrink)

Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. This paper identifies and addresses persistent gaps in the consideration of ethical practice in ‘technology for good’ development contexts. Its main contribution is to model an integrative approach using multiple ethical frameworks to analyse and understand the everyday nature of ethical practice, including in professional practice among ‘technology for good’ start-ups. The paper identifies inherent paradoxes in the ‘technology for good’ sector as well as ethical gaps related to (1) the sometimes-misplaced assignment of virtuousness to an individual; (2) difficulties in (...) understanding social constraints on ethical action; and (3) the often unaccounted for mismatch between ethical intentions and outcomes in everyday practice, including in professional work associated with an ‘ethical turn’ in technology. These gaps persist even in contexts where ethics are foregrounded as matters of concern. To address the gaps, the paper suggests systemic, rather than individualized, considerations of care and capability applied to innovation settings, in combination with considerations of virtue and consequence. This paper advocates for addressing these challenges holistically in order to generate renewed capacity for change at a systemic level. (shrink)

Broome takes the debate on rationality to be concerned with the ordinary use of 'rational'. I argue that this is at best misleading. For the object of current theories of rationality is determined by a specific use of 'rational' that is intimately connected to blame and praise. I call the property it refers to 'rationalityRESP'. This focus on rationalityRESP, I argue, has two significant implications for Broome's critique of theories of rationality as reasons-responsiveness. First, rationalityRESP is plausibly conceived of as (...) a kind of reasons-responsiveness. Secondly, Broome's dispute with internalists about normativity as well as his dispute with externalists about rationality both hinge on questions regarding the concept of responsibility. Recently, individualized or personalized medicine (PM) has become a buzz word in the academic as well as public debate surrounding health care. However, PM lacks a clear definition and is open to interpretation. This conceptual vagueness complicates public discourse on chances, risks and limits of PM. Furthermore, stakeholders might use it to further their respective interests and preferences. For these reasons it is important to have a shared understanding of PM. It has been argued that rationality consists in responding correctly to reasons. Recent defenses of the normativity of rationality assume that this implies that we always ought to be rational. However, this follows only if the reasons rationality requires us to correctly respond to are normative reasons. Recent meta-epistemological contributions have questioned whether epistemic reasons are normative. If they were right, then epistemic rationality wouldn’t provide us with normative reasons independently of wrong-kind reasons to be epistemically rational. This paper spells (...) out this neglected challenge for the normativity of epistemic rationality by connecting the two bodies of literature. Moreover, it generalizes this challenge to the rationality of desire, intention, and emotion. The upshot is that we can only answer the normative question about rationality if we debate about blame and accountability for holding different kinds of irrational attitudes, as well as about the sources of mental normativity. Can we take the purpose of nurse education for granted, and, more importantly, should we? That is the issue at stake in this paper. The question of purpose is conspicuously absent in the nursing literature; our aim here is to urge that it not be overlooked by demonstrating its importance to the future of nursing. We approach the question of nurse education's purpose in concrete and speculative terms through two distinct yet interrelated questions: what is the purpose of nurse education? (...) and what should it be? Amidst the complexity and uncertainty of our time, we cast doubt on the adequacy of manualised and regulated approaches—ubiquitous in nurse education—to prepare nurses who can meet the challenges of contemporary practice. We also assert that transgressive approaches to education, as the antithesis of manualisation, reach the same impasse by (over)predetermining what the educational ‘output’ will be. To move beyond this impasse, we draw on the theory of Gert Biesta and Ron Barnett to contrast cultivation and existential‐type education. In so doing, we do not seek to provide ‘answers’ to nurse education's purpose but, rather, raise the profile of what we believe is a right and proper question for the discipline to grapple with. I argue that believing at will – i.e. believing for practical reasons – is in some sense possible and in some sense impossible. It is impossible insofar as we think of belief formation as a re-sult of our exercise of certain capacities (perception, memory, agency). But insofar as we think of belief formation as an action that might lead to such a result (i.e. a deliberation or an in-quiry), believing at will is possible. First I present and clarify the problem (...) and its philosophical relevance (section 1). I then argue that a belief formation as an immediate reaction to practical reasons is not necessarily equivalent to believing at will because the causal mechanism that leads to the formation might be deviant (section 2). Finally, I explain the difference between the two above mentioned meanings of “belief formation” in order to clarify the possibility and impossibility of believing at will (section 3). (shrink)

The confluence of different Jewish traditions in the Qumran library is evident. The Enochic traditions are not only counted as the oldest influences in Qumran, they also give it a certain theological unity. This is even more true in the case of demonology. Belial’s figure brings together a rich lexicographic heritage in which different traditions are integrated under the characteristics of the Watchers and Giants of the Enochic tradition (1 En 6—8). It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

This possibility brings human germline editing into the focus of ethical and legal debates again.Main bodyAgainst this background, we explore essential ethical and legal questions of interventions into the human germline by means of CRISPR-Cas: How should issues of risk and uncertainty be handled? What responsibilities arise regarding future generations? Under which conditions can germline editing measures be therapeutically legitimized? For this (...) purpose, we refer to a scenario anticipating potential further development in CRISPR-Cas technology implying improved accuracy and exclusion of germline transmission to future generations. We show that, if certain concepts regarding germline editing are clarified, under such conditions a categorical prohibition of one-generation germline editing of single-cell embryos appears not to be ethically or legally justifiable.ConclusionThese findings are important prerequisites for the international debate on the ethical and legal justification of germline interventions in the human embryo as well as for the harmonization of international legal standards. Although the ethical aspects of transformational leadership have attracted considerable attention, very little is known about followers’ reactions to the moral and immoral conduct of transformational leaders. Against this background, this study examined whether and how transformational leadership interacts with moral and authoritarian leadership behaviors in predicting followers’ in-role and extra-role efforts. Building on attribution theory, we hypothesized that the positive and negative effects of these leadership behaviors would be particularly pronounced for highly transformational leaders given that this leadership style (...) elicits strong attention and sense-making efforts among followers. We tested our model in a sample of 228 individuals comprising 114 leader–follower dyads from a wide range of organizations and industries. In line with our hypotheses, results revealed that for highly transformational leaders, moral leadership behaviors related positively to employees’ in-role and extra-role efforts whereas authoritarian leadership behaviors related negatively to employees’ in-role and extra-role efforts. In contrast, moral and authoritarian leadership behaviors did not significantly affect followers’ reactions to leaders low in transformational leadership. Taken together, these findings suggest that transformational leadership, contrary to its largely positive perception in the literature, can be a rather mixed blessing. Implications for theory, future research, and managerial practice are discussed. (shrink)

Although the proportion of women in leadership positions has grown over the past decades, women are still underrepresented in leadership roles, which poses an ethical challenge to society at large but business in particular. Accordingly, a growing body of research has attempted to unravel the reasons for this inequality. Besides theoretical progress, a central goal of these studies is to inform measures targeted at increasing the share of women in leadership positions. Striving to contribute to these efforts and drawing on (...) several theoretical approaches, the present study provides a contemporary examination of whether women and men differ in their levels of power motivation and whether potential gender differences in this motivation contribute to the unequal distribution of women and men in leadership positions. Results from four studies provide converging support for these assumptions. Specifically, we found that women consistently reported lower power motivation than men. This in turn mediated the link between gender and leadership role occupancy. These results were robust to several methodological variations including samples from different populations, diverse operationalizations of power motivation and leadership role occupancy, and study design. Implications for theory and practice, including ways to contribute to a more equal gender distribution in leadership positions, are discussed. (shrink)

Entre estas metáforas, una de las primeras y, a nuestro juicio, más interesantes es la de Frankenstein. No obstante, su amplio uso, consideramos que falta un análisis más detallado de los motivos antropológicos (...) y las estrategias narrativas que encierra el uso de esta metáfora como critica al poshumanismo. Researchers in applied ethics, and some areas of bioethics particularly, aim to develop concrete and appropriate recommendations for action in morally relevant real-world situations. When proceeding from more abstract levels of ethical reasoning to such concrete recommendations, however, even with regard to the very same normative principle or norm, it seems possible to develop divergent or even contradictory recommendations for action regarding a certain situation. This may give the impression that such recommendations would be arbitrary and, hence, not well justified. (...) Against this background, we, first, aim at showing that ethical recommendations for action, although being contingent in some sense, are not arbitrary if developed appropriately. For this purpose, we examine two types of contingencies arising in applied ethics reasoning based on recent examples of recommendations for action in the context of the COVID-19 pandemic. In doing so, we refer to a three-step model of ethical reasoning towards recommendations for actions. This, however, leaves open the question of how applied ethics may cope with contingent recommendations for action. Therefore, in a second step, we analyze the role of bridge principles for developing ethically appropriate recommendations for action, i.e., principles which connect normative claims with relevant empirical information to justify certain recommendations for action in a given morally relevant situation. Finally, we discuss some implications for reasoning and reporting in empirically informed ethics. (shrink)

In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. Finalmente, nos invita a buscar prácticas pedagógicas que cultiven este hacer-virtud. (shrink)

Danielle Celermajer advocates for reconceptualizing responsibility in light of the climate crisis. I argue instead that we must understand current concepts of responsibility which are implicit in actual responsibility practices. I illustrate this by appeal to the practice of holding each other responsible for our beliefs-a practice in which we are constantly involved, but which is often obscured. It extends our responsibility to involuntary aspects of our own mind and involves socially distributed cognitive duties. The present paper is an attempt at the investigation of the nature of polarity contrast in natural languages. Truth conditions for natural language sentences are incomplete unless they include a proper definition of the conditions under which they are false. It is argued that the tertium non datur principle of classical bivalent logical systems is empirically invalid for natural languages: falsity cannot be equated with non-truth. Lacking a direct intuition about the conditions under which a sentence is false, we need (...) an independent foundation of the concept of falsity. The solution I offer is a definition of falsity in terms of the truth of a syntactic negation of the sentence. A definition of syntactic negation is proposed for English. (shrink)

I show that extant attempts to capture and generalize empirical adequacy in terms of partial structures fail. Indeed, the motivations for the generalizations in the partial structures approach are better met by the generalizations via approximation sets developed in “Generalizing Empirical Adequacy I”. Approximation sets also generalize partial structures.

Mindfulness as a clinical and nonclinical intervention for a variety of symptoms has recently received a substantial amount of interest. Although the application of mindfulness appears straightforward and its effectiveness is well supported, the concept may easily be misunderstood. This misunderstanding may severely limit the benefit of mindfulness-based interventions. It is therefore necessary to understand that the characteristics of mindfulness are based on a set of seemingly paradoxical structures. This article discusses the underlying paradox by disentangling it into five dialectical (...) positions - activity vs. passivity, wanting vs. non-wanting, changing vs. non-changing, non-judging vs. non-reacting, and active acceptance vs. passive acceptance, respectively. Finally, the practical implications for the medical professional as well as potential caveats are discussed. (shrink)

This article compares two science advisory organizations: the Intergovernmental Panel for Climate Change (IPCC) and the International Council for the Exploration of the Seas (ICES), with a special focus on how their respective policy systems absorb the knowledge delivered for use in decision processes. The science-policy processes of these two organizations differ in important respects; ICES delivers highly specified knowledge to a specified uptake mechanism, while the IPCC produces unspecified knowledge for an unspecified uptake mechanism. Since both environmental governance areas (...) are criticized for lack of needed action, a comparison is of interest asking how this might relate to the organization of science advice. As theoretical resources for this explorative comparison we utilize two approaches from the field of science and technology studies: the co-production approach, which focuses on the entanglements of scientific and political processes, and the systems-theory-oriented multiple-worlds model, which assumes a clear difference in institutional logics between the scientific and the political field. Since the IPCC has been critically analysed by several studies utilizing resources from the two approaches, we contribute with new insights by bringing in ICES, which is a much less studied organization exposing a different science-policy structure. One important finding is that the two theoretical approaches focus on different aspects, exposing ‘links’ and ‘integration’, both of which we argue are important for analysing and assessing science advisory organizations. Laudan’s argument against the possibility of a demarcation criterion for scientific theories rests on establishing that any criterion must be a necessary and sufficient condition. But Laudan’s argument at most establishes that any criterion must provide a necessary condition and a possibly different sufficient condition. His own claims suggest that such a criterion is possible.

The objective of this study was to examine whether the “step back and watch” attitude of mindfulness manifests in less emotional behavior. We hypothesized that the “acceptance” facet of mindfulness, but not the “presence” facet, is negatively associated with the magnitude of emotional behavior in four tests, i.e., rating of words, rating of aversive and neutral pictures, and evaluative conditioning . Additionally, we hypothesized that the acceptance facet is associated with increased reaction time in an emotional Stroop test, and that (...) the presence facet is associated with decreased RT and lower error rate. The sample consisted of N = 247 non-clinical adults and was tested in a cross-sectional study. The results provide partial evidence that the acceptance facet of mindfulness may be associated with less aversive reactions towards aversive stimuli. Future studies should substantiate these findings but also determine their clinical relevance. (shrink)

Essences play a central role in Spinoza’s philosophy, not only in his metaphysics, but also in his philosophy of mind, his theory of affects, and his political philosophy. Despite their importance, however, it is surprisingly difficult to determine what exactly essences are for Spinoza. On a widespread reading, the essence of X is nothing but the concept of X. This paper argues against this identification of essences and concepts. Spinozistic concepts are maximally inclusive: the concept of X contains everything that (...) is needed to make X conceivable. The essence of X, in contrast, is more limited in scope and does not include everything that is needed to make X conceivable. Thus, Spinoza avoids the ‘overloading’ of essences and the problems that would ensue. The account developed in this paper has a surprising implication, namely that the essences of non-divine, singular things do not suffice to render these things fully conceivable on Spinoza’s view. Thus, Spinoza breaks with a tradition according to which the essence of a thing states ‘what the thing is.’ As a result, his conception of essence is much further removed from traditional Aristotelian accounts, and from other seventeenth-century accounts, than usually acknowledged. This article examines a series of events that are generally known in historiography as the “Tatarbunar Uprising” – an armed rebellion that took place over ten days in September 1924 in south-eastern Bessarabia. I am also interested in the aftermath of those events as well as in their legal and memorial afterlife. My attempt is to reason through and to clarify the legal and historio­graphical construction of narratives of sovereign power as they emerge from the archives of the trial as (...) well as that of the preceding and subsequent military and police operations. The reflection I will conduct here is indeed grounded in the historical context of 1923-1925, but the jurisprudential and comparative legal and political analysis I will deploy here has more general reach insofar as it aims to grasp some more general points about the status of legality under the conditions of emergency. El propósito de este texto es abordar la problemática de las inteligencias artificiales y su incidencia en la sociedad contemporánea. Para ello, se realizan lecturas paralelas de las sociedades distópicas creadas por Isaac Asimov y Philip K. Dick. A partir de estas, se identifican algunos rasgos existentes en nuestro contexto inmediato, enfocándonos en tres ejes principales: la sociedad de vigilancia y control tecnológico, el problema de lo natural en los ciber-seres, y la visión del siglo XXI en la ciencia ficción (...) para analizar si esta es ilusoria o, por el contrario, forma parte de nuestra realidad inmediata. Todo esto con el fin de definir al género como un espejo de nuestro futuro, basándonos en la lectura de nuestro presente para interpretar los mundos posibles y el futuro como fuente de reflexión filosófica y tecnológica. En este artículo, analizaremos a grandes rasgos los elementos de la ciencia ficción de Isaac Asimov y Philip K. Dick, enfocándonos en aspectos como la naturalidad de los individuos, las sociedades de control y las líneas que separan lo humano de lo artificial como bases para la reflexión filosófica. A través de este ejercicio, examinaremos diversas obras de ambos autores, tales como El hombre bicentenario (Asimov 2019b), Satisfacción Garantizada (Asimov 2019a), La última pregunta (Asimov 2019a), ¿Sueñan los androides con ovejas eléctricas? (Dick 2017) y El hombre en el castillo (Dick 2021). El objetivo es identificar elementos que nos permitan interpretar el siglo XXI como una obra de ciencia ficción en constante desarrollo. (shrink)

A pesar de haber trascurrido diecisiete años desde su publicación, por su interés en el campo de su investigación y por ser aun relativamente desconocido en el medio de la exégesis latinoamericana se puede juzgar pertinente analizar esta obra. El libro de Pamela E. Kinlaw presenta una visión de las expectativas que la audiencia del antiguo mundo mediterráneo (AMM) pudo tener respecto a la epifanía de Jesús. Asimismo, ofrece categorías literarias sobre el concepto joánico de encarnación, y abre un debate (...) polémico respecto a las tendencias teológicas adoptadas por el autor(res) del cuarto evangelio y sus oponentes. Estas razones son más que suficientes para leer con detenimiento las tesis que en su libro ofrece. (shrink)

This paper offers a further look at Husserl’s late thought on the transcendental subject and the Husserl–Heidegger relationship. It attempts a reconstruction of how Husserl hoped to assert his own thoughts on subjectivity vis-à-vis Heidegger, while also pointing out where Husserl did not reach the new level that Heidegger attained. In his late manuscripts, Husserl employs the term ‘transcendental person’ to describe the transcendental ego in its fullest ‘concretion’. I maintain that although this concept is a consistent development of Husserl’s (...) earlier analyses of constitution, Husserl was also defending himself against Heidegger, who criticized him for framing the subject in terms of transcendental ego rather than as Dasein. Husserl was convinced that he could successfully respond to Heidegger’s critique, but he did not grasp that Heidegger’s fundamental ontology was an immanent development, rather than a scathing criticism, of his own phenomenology. My aim in this paper is to explore the limits of a conception of metaphysical explanation based on the Principle of Sufficient Reason (PSR). For this purpose, I will focus on one of the alleged counter-intuitive consequences of an unrestricted application of the PSR, namely: Radical Monism. First, I will articulate such a conception of metaphysical explanation. Then, I will explain how is it that from a famous argument that rests on the PSR (i.e., Bradley’s regress) Radical Monism indeed seems (...) to follow. Right away, I will argue against the natural reaction that such argument triggers, namely: that we shall accept pluralism and relations as brute facts. Finally, I will sketch a qualified version of the PSR that allows us to avoid Radical Monism without compromising the essential content of the PSR. (shrink)

Las propuestas de la teoría del derecho se pueden entender como un conjunto de soluciones a diversos problemas teórico-jurídicos. Esta manera de presentar la actividad resulta atractiva, pero no siempre es trasparente, porque no explicita qué se debe conocer para entender su carácter problemático. Por ello, en este trabajo analizo el concepto de problema a través de la noción de predicado relacional, y a partir de ahí extraigo criterios que permiten determinar qué debe ser considerado como tal y a partir (...) de qué consideraciones deben ser evaluadas sus soluciones. Luego, los resultados del análisis son utilizados para examinar un conocido problema normativo, mostrando así su utilidad analítica. En definitiva, se busca contribuir a un debate escasamente desarrollado en torno al concepto de problema. (shrink)
