William Jaworski shows how hylomorphism can be used to solve mind-body problems--the question of how thought, feeling, perception, and other mental phenomena fit into the physical world. Hylomorphism claims that structure is a basic ontological and explanatory principle, and is responsible for individuals being the kinds of things they are, and having the powers or capacities they have. From a hylomorphic perspective, mind-body problems are byproducts of a worldview that rejects structure, and which lacks a basic principle which distinguishes (...) the parts of the physical universe that can think, feel, and perceive from those that can't. Without such a principle, the existence of those powers in the physical world can start to look inexplicable and mysterious. The multiple-realizability argument has been the mainstay ofanti-reductionist consensus in philosophy of mind for the past thirty years. Reductionist opposition to it has sometimes taken the form of the Disjunctive Move: If mental types are multiply-realizable, they are not coextensive with physical types; they might nevertheless be coextensive with disjunctionsof physical types, and those disjunctions could still underwrite psychophysical reduction. Among anti-reductionists, confidence is high that the Disjunctive Move fails; arguments to this effect, however, often leave something to be desired. (...) The hard problem of consciousness has held center stage in the philosophy of mind for the past two decades. It claims that the phenomenal character of conscious experiences—what it’s like to be in them—cannot be explained by appeal to the operation of physiological subsystems. The hard problem arises, however, only given the assumption that hylomorphism is false. Hylomorphism claims that structure is a basic ontological and explanatory principle. A human is not a random collection of physical materials, but an individual (...) composed of physical materials with a structure that accounts for what it is and what it can do—the powers it has. What is true of humans is true of their activities as well. The latter are not random physiological changes, but structured ones: we engage in them by coordinating the ways our parts manifest their powers. Structured activities include perceptual experiences. Consequently, everything about a perceptual experience, including its phenomenal character, can be explained by describing the perceiver’s perceptual subsystems, the powers of those subsystems, and the coordination that unifies their activities into the activity of the perceiver as a whole. Conscious experiences thus fit unproblematically into the natural world—just as unproblematically as the phenomenon of life. Even exponents of the hard problem of consciousness agree that there is no hard problem of life. Consequently, if hylomorphism is true, there can be no hard problem of consciousness. To insist that there is such a problem, then, is implicitly to reject hylomorphism. The concept of consciousness that motivates the hard problem is as much a theoretical construct, therefore, as the concept of life that motivates an obstinate vitalist. (shrink)

Powers often depend on structures. It is because of the eye’s structure that it confers the power of sight; destroy that structure, and you destroy the power. I sketch an antireductive yet broadly naturalistic account of the relation between powers and structures. Powers, it says, are embodied in structures. When applied to philosophy of mind, this view resembles classic emergentist theories. I nevertheless argue that it differs from them in crucial respects that insulate it from the problems that beset them (...) – including the problem of emergence and the problem of mental causation. Hylomorphism provides an attractive framework for addressing issues in philosophical anthropology. After describing a hylomorphic theory that dovetails with current work in philosophy of mind and in scientific disciplines such as biology and neuroscience, I discuss how this theory meshes with Christian eschatology, the doctrine of resurrection in particular.

Mereonominalism, holonominalism, and part-whole realism represent competing views on the metaphysics of parts and wholes. Mereonominalism claims that what parts exist is a function of the concepts we use in describing composite wholes. Holonominalism claims that what composite wholes exist is a function of the concepts we use in describing things that can qualify as parts. Part-whole realism claims that parts and wholes exist independent of our concepts. I argue that all three views face problems, but that the problem facing (...) part-whole realism can be solved by adopting a version of hylomorphism that takes its cue from Aristotle’s account of form. Mind, Brain, and Free Will, Richard Swinburne’s stimulating new book, covers a great deal of territory. I’ll focus on some of the positions Swinburne defends in the philosophy of mind. Many philosophers are likely to have reservations about the arguments he uses to defend them, and others will think his basic position is unmotivated. My goal in this brief discussion is to articulate some of the reasons why.

In this paper we articulate and diagnose a previously unrecognized problem for theories of entitlement, what we call the Claims Conundrum. It applies to all entitlements that are originally generated by some claim-generating action, such as laboring, promising, or contract-signing. The Conundrum is spurred by the very plausible thought that a later claim to the object to which one is entitled is a function of whether that original claim-generating action is attributable to one. This is further assumed to depend on (...) one’s being identical to the person who performed the claim-generating action. But the right theory of personal identity for grounding these later claims proves quite elusive. In demonstrating both the Claims Conundrum and diagnosing its source, we begin with its instantiation in John Locke’s theories of personal identity and initial acquisition, and then we gradually expand its net to include both Lockean and non-Lockean theories of both, moving ultimately to show that this is a problem for most entitlements generally. We then diagnose the source of the trouble, showing that a basic assumption about the link between attributability and identity that most people take to be obvious is in fact false, clearing a path for future investigation into this overlooked but serious problem’s resolution. “Hylomorphism” has recently become a buzzword in metaphysics. Kit Fine, Kathryn Koslicki, and Mark Johnston, among others, have argued that hylomorphism provides an account of parthood and material constitution that has certain advantages over its competitors. But what exactly is it, and what are its implications for an account of what we are? Hylomorphism, I argue, is fundamentally a claim about structure. It says that structure is a basic ontological and explanatory principle. I argue that hylomorphism is compatible with physicalism, (...) and also with substance dualism, and epiphenomenalism. The most interesting kinds of hylomorphism nevertheless reject these views. I describe one such hylomorphic theory. It is an empirically well-warranted theory, I argue, one based on work in biology and biological subdisciplines such as neuroscience. (shrink)

The problem of mental causation epitomizes problems in the metaphysics of mind. Tyler Burge once suggested that it could be solved by taking ordinary explanatory practice more seriously. Jaegwon Kim criticized this suggestion: a solution to the problem requires a workable metaphysics of mental causation, and taking ordinary explanatory practice seriously falls short of providing that. Burge replied by gesturing toward a metaphysics that takes mental and physical causation to be different, noncompeting forms of causation. But what does it mean (...) for there to be different forms of causation? How are they identified and distinguished? And what ensures that mental and physical causation are different and noncompeting? I attempt to answer these questions by appeal to hylomorphism, a metaphysical framework that takes structure to be a basic ontological and explanatory principle. I argue that hylomorphism enables us to develop Burge’s basic insights into a workable metaphysics of mental causation that solves the problem. (shrink)

May you sell your vote? May you sell your kidney? May gay men pay surrogates to bear them children? May spouses pay each other to watch the kids, do the dishes, or have sex? Should we allow the rich to genetically engineer gifted, beautiful children? Should we allow betting markets on terrorist attacks and natural disasters? Most people shudder at the thought. To put some goods and services for sale offends human dignity. If everything is commodified , then nothing is (...) sacred. The market corrodes our character. Or so most people say. In Markets without Limits , Jason Brennan and Peter Jaworski give markets a fair hearing. The market does not introduce wrongness where there was not any previously. Thus, the authors claim, the question of what rightfully may be bought and sold has a simple answer: if you may do it for free, you may do it for money. Contrary to the conservative consensus, they claim there are no inherent limits to what can be bought and sold, but only restrictions on how we buy and sell. (shrink)

The article describes the problem of the consistency of the medical conscience clause in the Polish legal system. In the first part of the paper, I outline an account of conscience as the ultimate norm of morality. In its second part, I discuss the meaning of conscience clause and its legal status. Part three examines some criticisms of the clause in its present form. The main criticism is that the clause is self-referential, which in some cases leads to absurdity.

Discussion on the methodological status of theology is an attempt to answer whether theology can be considered a science, i.e., a source of knowledge. This debate has resulted in the formulation of three main positions. The first position argues that theology does not qualify as a science due to its failure to meet the strict criteria of demarcation. The second position asserts that theology is indeed a science, similar to any other discipline, and this perspective is endorsed by theologians themselves. (...) The third position treats theology as a science, but one of a unique nature (_sui generis_). Furthermore, an idea has emerged suggesting that theology could be regarded as a formal science. Several arguments support this notion, including the operational rather than eidetic nature of the terms of theological discourse, the employment of assumptions and the drawing of conclusions within theology, the exclusive focus on textual analysis, and the application of a coherence theory of truth. This paper engages in a discussion with the presented arguments and endeavours to demonstrate their incorrectness. The purpose of positioning theology among the formal sciences is to defend its scientific status against scholars who hold atheistic or anti-theological world views. However, this “defence” comes at a high price, as it entails depriving theology of its fundamental aim, which is to formulate statements about reality. (shrink)

There is currently a stalemate over the correct approach to legal liability. To take a prominent example, it remains a point of contention whether land owners should be held liable for injuries to trespassers. Many of those who insist that land owners should be held liable for injuries to trespassers maintain this for purely economic or pragmatic reasons. In contrast, those on the other side frequently defend their view on the grounds that, in such trespass cases, owners are not morally (...) responsible for the injuries. We maintain that the best way forward for all parties in this debate is to recognize the existence of “morally responsible liability ”—of cases where owners qua owners are morally responsible for damages caused by their property. Once this is recognized, the debate can be framed in terms of whether there are economic or pragmatic reasons for legal liability to diverge from morally responsible liability. Unfortunately, there is no good account of morally responsible liability in the literature. Taking lessons from the failings of the few extant accounts, we draw on the work of A. M. Honoré and Jeremy Waldron to develop an account of our own. We argue that owners are morally responsible for damages caused by their property when and because their taking ownership of something leads to increased risk to others. We explain how and why such increases in risk come about, and how our account captures our intuitions concerning various cases, including those concerning injuries to trespassers. (shrink)

The article describes the importance of public performance for the image of the Futurists, mainly of Bruno Jasieński. The impressions that the artists gained from Helena Buczyńska’s ‘word-arts’ performance, and Scriabin’s idea of ‘Art Religion’ they were exposed to, inspired the young poets. The article finishes with enumeration of several inspirations that are being found in Jasieński’s texts by modern musicians adapting his poetry.

This chapter considers simpler prototype of a Star Trek transporter: a matter‐energy‐matter (MEM) converter. The MEM converter works in three stages. First, it scans an object and records the positions and states of all of the fundamental physical particles that compose it. Second, the converter disintegrates the object. Third, it assembles an exact replica of the object by repositioning fundamental physical particles according to the record it created during its original scan. Constitutionalism is an exciting theory that is the basis (...) for many Star Trek episodes. But it faces the fission problem, which Commander Riker experiences first hand in second chances (TNG). Mind-body problems are predicated on two things: a distinction between the mental and the physical, and premises that make it difficult to see how the two are related. Before Descartes there were no mind-body problems of the sort now forming the stock in trade of philosophy of mind. One possible explanation for this is that pre-Cartesian philosophers working in the Aristotelian tradition had a different way of understanding the mental-physical distinction, the nature of causation, and the character of psychological discourse, (...) which was not liable to generating problems of a post-Cartesian sort. If so, it might be possible to recover and redeploy parts of that pre-Modern conceptual apparatus to resolve contemporary mind-body problems. I will argue that at least one such problem can be solved in this way. (shrink)

Descartes developed a compelling characterization of mental and physical phenomena which has remained more or less canonical for Western philosophy ever since. The greatest testament to the power of Cartesian thinking is its ubiquity. Even philosophers who are critical of post-Cartesian anthropology nevertheless tacitly endorse Cartesian assumptions. Part of what leads to this strange inconsistency is that by and large philosophers no longer know what a non-Cartesian anthropology looks like. I discuss some commitments characteristic of post-Cartesian philosophy of mind, and (...) present an alternative conception of psychological phenomena more consistent with a hylomorphic framework. The dualist-materialist dichotomy can be understood in terms of an apparently inconsistent triad of claims: materialism, mental realism, and antireductionism.At one time, functionalism seemed capable of resolving the apparent inconsistency, but recent work in the philosophy of mind suggests it cannot. Functionalism’sfailure invites exploration into alternative strategies for resolution, one of which is suggested by Aristotle’s hylomorphism. The latter rejects PostulationalRealism, a semantic model for psychological discourse endorsed by regnant forms of dualism and materialism, as well as by functionalism. Several (...) considerations indicate that Postulational Realism is an implausible model for psychological discourse at best, and therefore suggest its rejection might pave the way to resolving the dualist-materialist dichotomy in the manner of hylomorphism. Open peer commentary on the article “Negotiating Between Learner and Mathematics: A Conceptual Framework to Analyze Teacher Sensitivity Toward Constructivism in a Mathematics Classroom” by Philip Borg, Dave Hewitt & Ian Jones. Upshot: While I appreciate sensitive teaching approaches to students’ learning mathematics using Grid Algebra software, I am unconvinced that the approaches described are constructivist in nature. To make further progress along the lines described by the authors a clearer articulation of its constructivist foundations is needed.

Philosophers and scientists are concerned with the why and the how of things. Questions like the following are so much grist for the philosopher’s and scientist’s mill: How can we be free and yet live in a deterministic universe?, How do neural processes give rise to conscious experience?, Why does conscious experience accompany certain physiological events at all?, How is a three-dimensional perception of depth generated by a pair of two-dimensional retinal images?. Since Belnap and Steel’s pioneering work on the (...) logic of questions, Van Fraassen has managed to apply their approach in constructing an account of the logic of why-questions. Comparatively little, by contrast, has been written on the logic of how-questions despite the apparent centrality of questions such as How is it possible for us to be both free and determined? to philosophical enterprise.1 In what follows I develop a logic for how-questions of various sorts including how-questions of cognitive resolution, how-questions of manner, how-questions of method, of means, and of mechanism. Semiotic objections to commodification hold that buying and selling certain goods and services is wrong because of what market exchange communicates or because it violates the meaning of certain goods, services, and relationships. We argue that such objections fail. The meaning of markets and of money is a contingent, socially constructed fact. Cultures often impute meaning to markets in harmful, socially destructive, or costly ways. Rather than semiotic objections giving us reason to judge certain markets as immoral, the usefulness of (...) certain markets gives us reason to judge certain semiotic codes as immoral. (shrink)

Joseph Heath lumps in quotas and protectionist measures with cartelization, taking advantage of information asymmetries, seeking a monopoly position, and so on, as all instances of behavior that can lead to market failures in his market failures approach to business ethics. The problem is that this kind of rent and rent seeking, when they fail to deliver desirable outcomes, are better described as government failure. I suggest that this means we will have to expand Heath’s framework to a market and (...) government failures approach. I then try to defuse objections that as a government failure, rent seeking may not appear relevant to what managers ought to do. Solving this conceptual issue will also give us an excuse to revisit a separate conceptual issue: the normatively thick conception of “rent” and rent seeking behavior that some use. This normatively thick conception is problematic, I argue, and I offer the beginnings of a novel, normatively neutral conception that is useful for our purposes in making the ethics of rent and rent seeking behavior more than a merely trivial exercise.
