This volume contains the first critical edition of the Scriptum super III-VIII libros Politicorum by Peter of Auvergne as well as a pragmatical edition of Books III-VIII of the medieval Latin translation of Aristotle's Politics. Intended as the continuation of Aquinas' unfinished commentary on the first three books of the Politics, the Scriptum became-together with Aquinas' commentary-the commentary on the Politics. From its appearance in the late thirteenth century to the end of the sixteenth century, the Scriptum represented the most (...) authoritative and influential interpretation of Books III-VIII of the Politics.The introduction to the volume provides both an overview of Peter's political thought and a case study of the production and dissemination of a university text. An examination of the manuscripts traces the preparation of the text from its first transcription and revision by a scribe close to the author-if not the author himself-to the preparation of the finished exemplar and its diffusion through the system of peciae. The introduction also explains how the text was adapted to fit the standards of humanistic Latin when it was first printed in the fifteenth century: its language was adjusted to humanistic standards, many formulations were reshaped, and passages were suppressed. These changes were subsequently preserved in all later editions of the text. Freed from this humanistic patina with which it has been transmitted since the early age of printing age, the Scriptum is now restored to its original version. (shrink)

Contemporary caution against anachronism in intellectual history, and the currently momentous theoretical emphasis on subjectivity in the philosophy of mind, are two prevailing conditions that set puzzling constraints for studies in the history of philosophical psychology. The former urges against assuming ideas, motives, and concepts that are alien to the historical intellectual setting under study, and combined with the latter suggests caution in relying on our intuitions regarding subjectivity due to the historically contingent characterizations it has attained in contemporary philosophy (...) of mind. In the face of these conditions, our paper raises a question of what we call non-textual (as opposed to contextual) standards of interpretation of historical texts, and proceeds to explore subjectivity as such a standard. Non-textual standards are defined as (heuristic) postulations of features of the world or our experience of it that we must suppose to be immune to historical variation in order to understand a historical text. Although the postulation of such standards is often so obvious that the fact of our doing so is not noticed at all, we argue that the problems in certain special cases, such as that of subjectivity, force us to pay attention to the methodological questions involved. Taking into account both recent methodological discussion and the problems inherent in two de facto denials of the relevance of subjectivity for historical theories, we argue that there are good grounds for the adoption of subjectivity as a non-textual standard for historical work in philosophical psychology. In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its (...) claims are either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. We call this the competence-norm approach. (shrink)

The “beyond a reasonable doubt” standard of proof, currently used in criminal trials, is notoriously vague and undermotivated. This paper discusses two popular strategies for justifying our choice of a particular precise interpretation of the standard: the “ratio-to-standard strategy” identifies a desired ratio of trial outcomes and then argues that a certain standard is the one that we can expect to produce our desired ratio, while the “utilities-to-standard strategy” identifies utilities for trial outcomes and then argues that a certain (...) standard maximizes expected utility. I argue that both strategies fail on their own terms, by requiring us to perform calculations that we simply cannot perform. No version of either strategy can be performed by jurors or legislators in our actual epistemic position, in which, since we do not know which of the defendants in our trial system are genuinely innocent and which are genuinely guilty, we cannot determine the extent to which our trial system tends to produce evidence that misleadingly incriminates the innocent or misleadingly exonerates the guilty. But we would need to determine this in order to perform the calculations required by any possible version of the ratio-to-standard or utilities-to-standard strategies. I then suggest some empirical reasons to be pessimistic about the evidence produced by our actual trial system. The upshot is that the “beyond a reasonable doubt” standard lacks a clear interpretation and rationale, nor do we have a promising way to identify an alternative. Aquinas is often presented as following Aristotle's "Nicomachean Ethics" when treating moral virtue. Less often do philosophers consider that Aquinas's conception of the highest good and its relation to the functional character of human activity led him to break with Aristotle by replicating each of the acquired moral virtues on an infused level. The author suggests that we can discern reasons for this move by examining Aquinas's commentary on the "Sententiae" of Peter the Lombard and the "Summa theologiae" within their (...) historical context. The author's thesis is that Dominican pastoral and intellectual concerns led Aquinas to argue that moral virtue must necessarily be ordered toward the highest good. Understanding this purpose helps to explain his presentation of moral virtue and its implications for standard philosophical interpretations of his work. (shrink)

The standard of proof applied in civil trials is the preponderance of evidence, often said to be met when a proposition is shown to be more than 50% likely to be true. A number of theorists have argued that this 50%+ standard is too weak – there are circumstances in which a court should find that the defendant is not liable, even though the evidence presented makes it more than 50% likely that the plaintiff’s claim is true. In this paper, (...) I will recapitulate the familiar arguments for this thesis, before defending a more radical one: The 50%+ standard is also too strong – there are circumstances in which a court should find that a defendant is liable, even though the evidence presented makes it less than 50% likely that the plaintiff’s claim is true. I will argue that the latter thesis follows naturally from the former once we accept that the parties in a civil trial are to be treated equally. I will conclude by sketching an alternative interpretation of the civil standard of proof. (shrink)

Amartya Sen reconsiders the idea of 'the standard of living'. He rejects the more conventional economic interpretations in terms of 'unity' and of wealth or 'opulence', and suggests an interpretation in terms of the 'capabilities and freedoms' that states of affairs do or do not allow. His argument is conceptual, but it refers to a wide range of examples. In elaborations of it, John Muellbauer explains how parts of it might be applied; Ravi Kanbur discusses the difficulties raised by (...) choice ex ante, under uncertainty, and choice ex post; Keith Hart discusses the ways in which one might think about living standards in societies in which there is a substantial amount of what he calls 'self provisioning' outside the market; and Bernard Williams reflects on some of the moral and political implications of Sen's argument. There is a bibliography of most of the more important works on the subject. According to a common conception of legal proof, satisfying a legal burden requires establishing a claim to a numerical threshold. Beyond reasonable doubt, for example, is often glossed as 90% or 95% likelihood given the evidence. Preponderance of evidence is interpreted as meaning at least 50% likelihood given the evidence. In light of problems with the common conception, I propose a new ‘relevant alternatives’ framework for legal standards of proof. Relevant alternative accounts of knowledge state that a person knows (...) a proposition when their evidence rules out all relevant error possibilities. I adapt this framework to model three legal standards of proof—the preponderance of evidence, clear and convincing evidence, and beyond reasonable doubt standards. I describe virtues of this framework. I argue that, by eschewing numerical thresholds, the relevant alternatives framework avoids problems inherent to rival models. I conclude by articulating aspects of legal normativity and practice illuminated by the relevant alternatives framework. (shrink)

According to Schopenhauer’s compensation argument for pessimism, the non-existence of the world is preferable to its existence because no goods can ever compensate for the mere existence of evil. Standard interpretations take this argument to be based on Schopenhauer’s thesis that all goods are merely the negation of evils, from which they assume it follows that the apparent goods in life are in fact empty and without value. This article develops a non-standard variant of the standard interpretation, which accepts (...) the relevance of the negativity thesis but rejects that the argument assumes that life’s goods are all empty and valueless. Instead, it argues that whatever value negative goods might possess, they do not have the kind of value to compensate for positive evils. In lieu of an abstract, here is a brief excerpt of the content:18 HUME AND THE STANDARD OF TASTE David Hume's critical theories, although fragmentary, have drawn increasingly serious attention in the twentieth century, yet even in 1976 Peter Jones, in reassessing Hume's aesthetics, can describe one of the most substantial of his critical essays, "Of the Standard of Taste," as underrated. Jones praises it as "subtle and highly complex," but while I agree with that judgment I also find the (...) essay quite puzzling. I am struck by certain features which look like structural weaknesses and by what seem to be inconsistencies, even contradictions, in Hume's argument. But perhaps the gravest difficulty facing interpretation of this essay is the irony which Hume seems to use, for this raises the question of just how seriously we are to take some of the more conventional views contained in "Of the Standard of Taste." I can begin to illustrate my uneasiness by considering Hume's use of a tall tale from Don Quixote, Part II, chapter xiii. Hume introduces this in a lighthearted way as part of his definition of delicacy of taste. It is the story of Sancho Panza's two kinsmen, who are such sensitive judges of wine that they can detect the taint of iron and leather imparted to a hogshead by the presence in it of a key on a thong. Now there are some interesting differences between Hume's version of this tale and the original. For example, where Hume has the two tasters deliberate over their wine before pronouncing it good, except for the slight taste of leather or iron, Cervantes says the first merely tried it with the tip of his tongue and the second just sniffed it, without tasting any at all. Further, Hume says "both 2 were ridiculed for their judgment," but there is no such 19 reaction mentioned in the original. Lastly, Hume calls the cause of the taint of iron "an old key," where 3 Cervantes describes it as "little." In short, while in the original interest is in the sensitivity of the taste of Sancho' s kinsmen for its own sake, Hume's emphasis is more on the relation of their taste to that of other people. He makes the procedure of tasting the wine as normal as possible and he gives prominence to the reactions of other people. Hume both tones down the more fabulous aspects of the story, making it less extraordinary and hence a better starting-point for a generalization about taste, and makes more explicit the conflict of opinion about the wine. He is using the story not just to define delicacy of taste but also to relate it to the problem of aesthetic judgment and the standard of taste. This is confirmed by the application Hume makes of his example. First, he uses the analogy between physical and aesthetic taste to claim that delicacy in both consists of the ability to detect minute effects and make fine discriminations. But the crucial question is what serves, like the key on the thong in the story, to confirm to outsiders that a man's aesthetic judgment is in fact more delicate than his neighbours'. Hume's answer is "the general rules of beauty... to produce these general rules or avowed patterns of composition is like finding the key with the leathern thong; which justified the verdict of Sancho' s kinsmen, and confounded those pretended judges who had condemned them" (273). But of course producing a general rule is not exactly like finding a physical key on a thong, and Hume's use of the word "avowed" here, which he repeats later, raises the difficulty of how the principles of art become accepted, and by whom. But, that apart, there is something odd about the discussion since the avowed principle is used, with support from examples, to 20 convince a bad critic that he is wrong, on the grounds that his judgment does not accord with the general judgment. This is the opposite of Sancho's story, in which his kinsmen were in a minority, derided, adds Hume, by the dull majority, and only vindicated by the discovery of the tainting key and thong. Here, however, agreement about the essay comes to an end, to be replaced by disagreement about what Hume identifies as the standard of taste. (...) Hume’s text encourages differing interpretations by appearing to identify a number of different standards of taste while continually suggesting there is only one. At the very least, one can find Hume hinting at a rule standard, a decision standard, an ideal spectator standard, a test of time standard as well as the position that there is no standard of taste at all. None of these views is explicitly rejected and more than one receives qualified approval. A review of the literature on Hume’s essay reflects its puzzling nature. Most commentators focus upon one or another of the standards Hume discusses; others examine more than one, but devote little attention to the relation between various standards appearing in the essay.2 [End Page 545]I will suggest in what follows that a better understanding of “Of the Standard of Taste” can be achieved by beginning with the question: What is Hume trying to do in this essay? As we shall see, Hume gives relatively explicit answers to this question in the essay and elsewhere, and attention to these takes us some way towards dissolving the puzzle of why so many positions on the standard of taste are discussed without any being explicitly rejected. Moreover, an understanding of Hume’s aims will make it much easier to clearly discern his own position on the possibility of a standard of taste. Therefore, in what follows, I will offer a reading of Hume’s essay which addresses the puzzle of the multiple standards and puts us in a much better position to answer the question of what Hume’s view is and whether it survives critical scrutiny.2The opening paragraphs of “Of the Standard of Taste” set the stage for the discussion that follows. Hume begins by observing that “the great variety of taste, as well as of opinion, which prevails in the world, is too obvious not to have fallen under everyone’s observation.”3 People of similar background and culture notice the wide differences of taste within their own like-minded community, and when they turn their attention to “distant nations and remote ages”4 the phenomenon is found to be even more pronounced. Further reflection suggests this variety of taste to be even greater in reality than appearance since although we may agree in our evaluative language—e.g., that beauty is to be praised and ugliness scorned—“when critics come to particulars this seeming unanimity vanishes”5 and argument arises about what objects are properly referred to by such evaluative terms. Hume goes on to conclude the opening remarks of his essay by connecting this state of affairs with his familiar views about morality and moral language. These latter reflections are suddenly broken off and Hume turns to the main subject of his essay.He begins with a “natural” response to the phenomena he has just considered. Evidence suggests that psychedelics bring about their therapeutic outcomes in part through the subjective or qualitative effects they engender and how the individual interprets the resulting experiences. However, psychedelics are contraindicated for individuals who have been diagnosed with certain mental illnesses, on the grounds that these subjective effects may be disturbing or otherwise counter-therapeutic. Substantial resources are therefore currently being devoted to creating psychedelic substances that produce many of the same biological changes as psychedelics, but without their characteristic subjective effects. (...) In this article, we consider ethical issues arising from the prospect of such potential “nonsubjective” psychedelics. We are broadly supportive of efforts to produce such substances for both scientific and clinical reasons. However, we argue that such nonsubjective psychedelics should be reserved for those special cases in which the subjective effects of psychedelics are specifically contraindicated, whereas classic psychedelics that affect subjective experience should be considered the default and standard of care. After reviewing evidence regarding the subjective effects of psychedelics, we raise a number of ethical concerns around the prospect of withholding such typically positive, meaningful, and therapeutic experiences from most patients. ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment (...) to both distributive and recognitive justice. The disability rights movement's demand “Nothing about us, without us” requires substantive inclusion of disabled people in decision‐making related to their interests, including in crisis planning before, during, and after a pandemic like Covid‐19. Relatively few authors attempt to assess individuals’ moral responsibility for collective action within organizations. I draw on fairly technical recent work by Seamus Miller, Christopher Kutz, and Tracy Isaacs in the field of collective responsibility to see what normative lessons can be prepared for people considering entry into large hierarchical, compartmentalized organizations like businesses or the military. I will defend a view shared by Isaacs that group members’ responsibility for collective action depends on intentions to contribute to particular collective actions, (...) against Miller and Kutz’s more inculpating standards. Miller and Kutz fail to achieve their goal of articulating a variable standard for measuring individual responsibility within organizations, for reasons suggesting we might not be able to do better with their theoretical commitments than a threshold warning for all potential entrants to be wary of the groups they enter. Isaacs sketches an approach that is more successful at creating a variable standard for assessing high echelon actors; I build on and refine her theory to argue that organization members can be held responsible for their unique interpretations of the organization mission and unique contributions to their role duties. High echelon actors may share personal responsibility for their subordinates’ behavior when they have created the conditions for those actions through their unique orders. (shrink)

This commentary welcomes the work of Ives et al. on Standards of practice in Empirical Bioethics, and especially the dialogical spirit in which the standards have been constructed and offered. It also raises some questions about the consistent interpretation and use of such standards.

This discussion paper continues the debate over risk‐related standards of mental competence which appears in Bioethics 5. Dan Brock there defends an approach to mental competence in patients which defines it as being relative to differing standards, more or less rigorous depending on the degree of risk involved in proposed treatments. But Mark Wicclair raises a problem for this approach: if significantly different levels of risk attach, respectively, to accepting and refusing the same treatment, then it is possible, (...) on this account, for a patient to be considered competent to accept, but not refuse, the treatment, or vice versa. I argue that this puzzle does not constitute a genuine problem for a risk‐related standard. To this end I focus on the situation where, of two mutually exclusive options, one is riskier, but offering more pronounced benefit, while the other is safer, but offering less benefit. I argue for this proposition: it can take far less insight to know that the safe option is good than to know that the risky option is better. Now say one is actually informed enough to know that the safe option is good, but not enough to know whether the risky option is better; in such a case one is competent to say yes to that first option (the safe one), but not to say yes to the other. (I argue in passing that Pascal's Wager can be interpreted as having precisely this deliberative structure.) I thus conclude that cases do indeed exist where one can be competent to say yes but not no, or vice versa; and that it is thus not an anomaly in the risk‐related standard that it entails the existence of such cases. It is somewhat striking that two interrelated elements of Hume's account of causation have received so little attention in the secondary literature on the subject. The first is the distinction of causation into the natural and the philosophical relations: Although many have tried to give accounts of why Hume presents two definitions of causality, it is often not clear in these accounts that the one definition is of causality as a natural relation and the other is of causality as a (...) philosophical relation, where to make the contrast between these two kinds of relations we need to give a naturalistic account of natural relations and a normative account of philosophical relations. (That Hume intends this to be the contrast will be defended in more detail below.) The second element is that, in many cases of our inferences from cause to effect, "we must follow our taste and sentiment" (A Treatise of Human Nature [T], 103), where the appeal to taste here, as in morality and aesthetics, is not to be understood as up to the individual. Rather, Hume makes it clear both in Book 3 of the Treatise and in "Of the Standard of Taste" that there are standards to which our individual judgments (in morality, aesthetics, or causality) must conform. My purpose in this paper is to attempt to provide an interpretation of Hume's account of causality that brings these two elements explicitly into the foreground. This interpretation is, to a greater extent than usual, a reconstruction of Hume's account of our causal inferences, drawing, as I have indicated above, from a range of texts not normally associated with Hume's discussion of causality. As such, this interpretation should be considered as exploratory in nature, perhaps focussing too single-mindedly on these two elements in an attempt to make out as strong a case as possible for their relevance in understanding Hume's account of causal inference. The standard interpretation of Aldo Leopold’s land ethic is that correct land management is whatever tends to preserve the integrity, stability, and beauty of the biotic community, of which we humans are merely a small part. From this interpretation, it is a short step to interpreting Leopold as a sort of deep ecologist or radical environmentalist. However, this interpretation is based on a small number of quotations from Leopold taken out of context. Once these quota­tions are put (...) into context, and once the broader context of Leopold’s mature writings and his actions as a land manager are taken into account, it becomes clear that he is much closer to being an enlightened anthropocentrist than he is to being anything like a radical environmentalist. When properly understood, Leopold’s land ethic recognizes that fundamental human interests must be treated with the highest possible respect, and it emphasizes the incredible challenge and need for modesty in identifying the correct tradeoffs between lesser human interests and the interests of the broader biotic community. Consulting with a patient where there is a language barrier is unethical unless the barrier is overcome. Every patient with a language barrier should have this prominently documented on their file. Much of the literature relating to working with interpreters suggests that a professional interpreter should be used all the time, although in practice this is far from standard practice. In this paper we look at the issue using normative ethics, utilitarian ethics, an argument based on equality of health outcomes (...) before making an argument for an approach based on clinical judgement in each consultation of what form of language assistance is acceptable. Moral education is a core component of ideological and political courses in primary and secondary schools and universities in China, and also an important part of contemporary Chinese Marxist educational theory and practice. In Chinese senior high schools, the main curriculum and platform for moral education is ideological and political courses. The Ideological and Political Curriculum Standards for General Senior High Schools (2017 Edition, 2020 Revised) issued by the Ministry of Education of the People’s Republic of China explicitly includes (...) a course on logical thinking in the ideological and political curriculum in general senior high schools, strengthening the importance of logic in moral education there. In this paper, the authors explain the necessity of intensifying logic training for contemporary Chinese teenagers, introduce and interpret the relevant contents in the Ideological and Political Curriculum Standards for General Senior High Schools (2017 Edition, 2020 Revised), and put forward some theoretical suggestions on how to conduct teaching on the subject of logic. How do we determine whether individuals accept the actual consistency of a political argument instead of just its rhetorical good looks? This article answers this question by proposing an interpretation of political argument within the constraints of political liberalism. It utilises modern developments in the philosophy of logic and language to reclaim ‘meaningless nonsense’ from use as a partisan war cry and to build up political argument as something more than a power struggle between competing conceptions of the good. (...) Standard solutions for ‘clarifying’ meaning through descriptive definition encounter difficulties with the biases of status quo idioms, as well as partisan translations and circularity. Collectively called linguistic gerrymandering, these difficulties threaten political liberalism’s underlying coherency. The proposed interpretation of political argument overcomes this with a new brand of conceptual analysis that can falsifiably determine whether rhetoric has hijacked political argument. (shrink)

This thesis presents an interpretation of David Hume’s essay ‘Of the Standard of Taste’. The most distinguishing feature of this interpretation is the emphasis placed on the significance of Hume’s general philosophical position in a faithful reading of this philosophical classic. The success of this interpretation will show that Hume’s essay should be read as an integral part of his system of philosophy. There are three parts in this thesis. The first part is an overview of some (...) key aspects of Hume’s philosophy which are relevant to my interpretation. Unlike many contemporary philosophers in the analytic tradition, Hume is a systematic thinker. A faithful reading of his works should take his general philosophical framework seriously. Therefore, this overview of his system serves as the general background of the next two parts. The second part is a discussion of Hume’s aesthetic thought. More specifically, it provides an exposition of his view on beauty and judgements of beauty. This part completes the stage-setting for the development of my interpretation, by helping the reader form a more specific conceptual framework for understanding Hume’s essay. The third part develops an interpretation of ‘Of the Standard of Taste’ according to what has been provided in the previous two parts. It starts with an outline of the essay, which indicates Hume’s aim in writing it. After that, a few sections are devoted to some central elements of the essay. The last section of this part discusses four controversies concerning Hume’s essay. These discussions establish the strength of this interpretation, or at least, the fruitful prospect of an interpretative project that integrates Hume’s essay into his whole system. (shrink)

This paper makes the two following claims: 1) The legal dimension of loyalty within organizations goes beyond duties. The governance design aimed at ensuring loyalty may strongly affect standards that characterize each layer of the organization. The interaction between standards of duty and the governance dimension of loyalty should, therefore, be more tailored to specific legal forms and their functional correlation with ownership and financing. 2) There is a greater divergence than has so far been acknowledged between the (...) function of loyalty in vertically integrated firms and in networks of small firms. This difference, created by the relationship between the duty and the governance dimensions, should have repercussions on the definitions of legal standards. In particular, it should reflect the different relationships between hierarchy, monitoring, and loyalty and the choice between prohibitory, authorization-based, and compensatory rules. The analysis concentrates on the key variables that may affect the choice between vertical and horizontal monitoring to ensure compliance with loyal behavior in two polar models: hierarchical firms and networks of small firms. It reveals the importance of considering the governance design when defining duties of loyalty and related standards to evaluate party-related transactions in both cases but, at the same time, the necessity of using different interpretive categories. Do chief financial officers (CFOs) of publicly held corporations agree with the Institute of Management Accountants' (IMA) Standards of Ethical Conduct and are they willing to adopt them? To address these issues, a survey was conducted concerning the Standards. The IMA issued the Pronouncement of Standards in June, 1982.In November, 1992, 790 survey questionnaires were mailed to chief financial officers (CFOs) of corporations listed in Forbes. These CFOs held the positions of vice president of finance and controller. (...) Completed questionnaires were received from 208 CFOs representing a 26.3% response rate. The questionnaire employed a 5-point Likert scale and included seven demographic questions to facilitate the interpretation of the findings. (shrink)

The paper proposes (1.) a non-standard interpretation of the proverbial expression “deuteros plous” by giving a fresh look to Phaedo, 99c9-d1. Then (2.) it proceeds to the philosophical problem raised in this passage according to this interpretation, that is, the problem of the “hypothesis” or the “unproved principle”. It indicates finally (3.) the kernel of truth contained in the standard Interpretation and it concludes with some remarks on the “weakness of the logoi”.

In the ideology of capitalism, problems of standard of living and consumption are treated in isolation from the content of social relationships. An example of this is provided by the works of Galbraith, who speaks of the "affluent society," defined by the level and volume of consumption, as a higher level of social development. His interpretation - and it is shared by many bourgeois ideologists - does not deal with the question of on what the achievement of an abundance (...) of various goods and services, and hence abundance in consumption, is based. Left out of consideration is the fact that it is because of particular historical conditions that the capitalist states of our day have at their disposal a developed base in technology, while such a base is lacking over most of the globe, inasmuch as its creation is an as-yet uncompleted task in the so-called developing countries. If we were to judge the essence of social development without considering the concrete class structure of society and the vagaries of historical development, without analyzing the existing base in technology and science, etc., we would be unable to go beyond the bounds of very vague abstractions. The Standard Picture holds that the contribution to the law made by an authoritative legal pronouncement is directly explained by the linguistic content of that pronouncement. This essay defends the Standard Picture from Mark Greenberg’s purported counterexamples drawn from patterns of statutory interpretation in U.S. criminal law. Once relevant features of the U.S. rule of recognition are admitted into the analysis—namely, that it arranges sources of law hierarchically, and that judicial decisions are sources of valid law—Greenberg’s counterexamples are revealed (...) as only apparent, not genuine. The legal norms that result from the patterns of interpretation he identifies can be directly explained in terms of the linguistic contents of authoritative pronouncements: judicial decisions. Furthermore, those norms can be understood as modifications of the valid norms contained in their originating statutes because judicial decisions are permitted ‘explanatory intermediaries’ of statutes by the rule of recognition. One of the most intriguing claims of Stoic logic is Chrysippus's denial of the modal principle that the impossible does not follow from the possible. Chrysippus's argument against this principle involves the idea that some propositions are ?destroyed? or ?perish?. According to the standard interpretation of Chrysippus's argument, propositions cease to exist when they are destroyed. Ide has presented an alternative interpretation according to which destroyed propositions persist after destruction and are false. I argue that Ide's alternative (...) class='Hi'>interpretation as well as some versions of the standard interpretation conflict with Stoic doctrines about the nature of propositions. I propose another version of the standard interpretation based on Frede's account of the Stoic theory of the proposition. I hold that this version of the standard interpretation both escapes Ide's objections and is consistent with Stoic logic and philosophy of language. (shrink)

There are certain standards of legal interpretation. Interpretive directives are heterogeneous—both in terms of the issues they address and of the form. Not all authors consider the canons of interpretation to be norms like any other ones. Moreover, some claim that the term “incorrect interpretation” refers only to an arbitrarily chosen concept. I intend to investigate whether, despite the objections raised, interpretative directives can be said to have the status of legal norms. I wonder whether the (...) so-called law of interpretation (LoI), can provide a normative key to assess the correctness of the interpretation of legal texts. Text raises important questions concerning LoI. Firstly, the question of the status of interpretative directives and the problem of their defeasibility. Second, it refers to the problem of compliance with interpretative directives and the consequences of their violation, drawing attention to the two contexts of legal interpretation (the context of discovery and justification) and to the fact that canons of interpretation can constitute a standard for the correctness of the interpretative procedure and for its result. Third, this paper refers to the problem of vagueness of interpretative directives, analysing the advantages of maintaining it to a certain extent, as well as the possibilities of reducing it in the rest. The fourth issue analysed is the multiplicity of canons and the lack of a defined hierarchy of them. I conclude by pointing out that LoI should provide a model by which to assess the correctness of an interpretation. (shrink)

Quantitative genetics (QG) analyses variation in traits of humans, other animals, or plants in ways that take account of the genealogical relatedness of the individuals whose traits are observed. “Classical” QG, where the analysis of variation does not involve data on measurable genetic or environmental entities or factors, is reformulated in this article using models that are free of hypothetical, idealized versions of such factors, while still allowing for defined degrees of relatedness among kinds of individuals or “varieties.” The gene (...) - free formulation encompasses situations encountered in human QG as well as in agricultural QG. This formulation is used to describe three standard assumptions involved in classical QG and provide plausible alternatives. Several concerns about the partitioning of trait variation into components and its interpretation, most of which have a long history of debate, are discussed in light of the gene-free formulation and alternative assumptions. That discussion is at a theoretical level, not dependent on empirical data in any particular situation. Additional lines of work to put the gene-free formulation and alternative assumptions into practice and to assess their empirical consequences are noted, but lie beyond the scope of this article. The three standard QG assumptions examined are: (1) partitioning of trait variation into components requires models of hypothetical, idealized genes with simple Mendelian inheritance and direct contributions to the trait; (2) all other things being equal, similarity in traits for relatives is proportional to the fraction shared by the relatives of all the genes that vary in the population (e.g., fraternal or dizygotic twins share half of the variable genes that identical or monozygotic twins share); (3) in analyses of human data, genotype-environment interaction variance (in the classical QG sense) can be discounted. The concerns about the partitioning of trait variation discussed include: the distinction between traits and underlying measurable factors; the possible heterogeneity in factors underlying the development of a trait; the kinds of data needed to estimate key empirical parameters; and interpretations based on contributions of hypothetical genes; as well as, in human studies, the labeling of residual variance as a non-shared environmental effect; and the importance of estimating interaction variance. The article explores the semantic potential of social narratives associated with the creation and constitution of the Orthodox Church of Ukraine, which caused a interpretations conflict, marked by conflicting interpretations and differences in meanings that are applied in different contexts. The narrative arranges events in a certain time sequence, accumulates and translates meanings, individual and social experience. The presence of meanings in the interpretation of the narrative depends on the perspective, interpretation horizons and the subject's ability to analyze (...) information and its correct application. The social narrative accumulates a set of stories and messages that are fragmentary and disordered, constructs a coherent plot aimed at finding and defining meanings, and forming social discourse. Social narratives materialized in social structures, orientations, expectations, and stereotypes of their bearers due to everyday modification in the form of simple images, attitudes, and principles. Since each social narrative claims to be exclusive and correct in its own way of understanding events, a clash of narratives and their interpretations is inevitable. A large-scale event determines the modification of social structures, standards, and evaluation criteria, is accompanied by the transformation of everyday life, reveals deep mental layers, and opens up new perspectives. The extraordinary event that was marked by the creation of the Orthodox Church of Ukraine is accompanied by diametrically opposite assessments from the clergy, believers, politicians, experts – from the statement about autocephaly as the only opportunity to achieve unity and recognition of Ukrainian Orthodoxy to the political subtext justification of the new religious organization creation. Church circles represented by representatives of the Ukrainian Orthodox Church of the Moscow Patriarchate claim that the state interferes in the internal Affairs of the Church. The Constitution of the Orthodox Church of Ukraine takes place in the context of the confrontation of two social narratives – the «ukrainian world» and the «russian world». The social narrative «ukrainian world» is based on values rooted in the national soil, but the social narrative «russian world» denies the existence of the Ukrainian nation and the Ukrainian state. Under the patronage of the Russian Orthodox Church, the expression of the ideas of the «russian world» is the Ukrainian Orthodox Church of the Moscow Patriarchate, which enshrines in the minds of believers ideologies about «the common origin of the Ukrainian and Russian peoples», «the common baptismal font», «the unity of the historical space of Holy Rus», «the identity of the East Slavic Orthodox civilization». The Ukrainian Orthodox Church of the Moscow Patriarchate did not support the decision of patriarch Bartholomew to grant autocephaly to the Orthodox Church of Ukraine. Metropolitan Onufriy did not give his blessing to the hierarchs to participate in the Unification Council, which is called «a non-canonical assembly of schismatic groups». The Ukrainian Orthodox Church of the Moscow Patriarchate, according to its primate, has de facto autocephaly, so it is the only canonical local Orthodox Church in Ukraine. In the face of the conflict of public narratives, the Orthodox Church of Ukraine, along with meeting the spiritual needs of believers, contributes to the formation of national identity, the formation of a worldview matrix that will determine the vision of the future development of the country.
