The paper begins with a discussion of Philip Pettit's distinction between individualistic and collectivistic reasoning strategies. I argue that many of his examples, when correctly analysed, do not give rise to what he calls the discursive dilemma. I argue for a collectivistic strategy, which is a holistic premise-driven strategy. I will concentrate on three aspects of collective reasoning, which I call the publicity aspect, the collective acceptance aspect, and the historical constraint aspect: First, the premises of collective reasoning, unlike the (...) premises of a private individual, have to be public in some sense. Second, the group members collectively accept the public premises, and thereby commit themselves to following them in their collective practical reasoning.Third, a person need not be consistent with his earlier private judgements, he is free to change his mind, but prior collective judgements, if not collectively abandoned, constrain the member's future judgements and decisions. I conclude that collective practical reasoning can be accounted for without collectivist ontological commitments. (shrink)

Realism in Action is a selection of essays written by leading representatives in the fields of action theory and philosophy of mind, philosophy of the social sciences and especially the nature of social action, and of epistemology and philosophy of science. Practical reason, reasons and causes in action theory, intending and trying, and folk-psychological explanation are some of the topics discussed by these leading participants. A particular emphasis is laid on trust, commitments and social institutions, on the possibility of grounding (...) social notions in individual social attitudes, on the nature of social groups, institutions and collective intentionality, and on common belief and common knowledge. Applications to the social sciences include, e.g., a look at the Erklären-Verstehen controversy in economics, and at constructivist and realist views on archeological reconstructions of the past. We reflect on Raimo Tuomela’s philosophy of social action and group action on the basis of our collaboration in his research group over the years. We will give a brief introduction to Tuomela’s career, his research endeavours, and the development of the field of collective intentionality and social ontology in which he was one of the central figures. We will focus on the development of three central themes in his research: we-intentions, we-reasoning, and collective responsibility.

In the paper “We-intentions and Social Action” conceptual issues related to intentional social action are studied. By social actions we here mean actions that are performed together by two or more agents. The central concept of we-intention is introduced and applied to the analysis of simple social practical reasoning. An individualistic analysis of the notion of we-intention is proposed on the basis of the agents’ I-intentions and beliefs. The need and indispensability of we-intentions and we-attitudes in general in a theory (...) of intentional social action is emphasized along with the fact that we-intending leads to action in suitable circumstances. A person can intend to achieve his own personal aims and ends, but he can also intend to promote the goals of his groups or collectives. In many cases of collective action these two types of intention will coincide, but they need not, and when they clash, collective action dilemmas, like free-riderism, will emerge. In this paper we discuss and analyze a central kind of group-intentions termed we-intentions, and distinguish between absolute and conditional we-intentions. The analyses of the latter are (...) then applied to a study of two related social phenomena: the agent's standing in reserve and free-riding.It is our claim that when the agent is intentionally in reserve, this involves his having a specific conditional we-intention to participate in the group's action. On the other hand, if he intends to free-ride, he intends not to participate. We also discuss and analyze different types of free-rider intentions. A person can also have a more complex intention concerning the group's action: He can have a conditional personal intention to free-ride combined with a conditional reserve member's we-intention to participate in the group's action. This may indicate that his motives are confused or mixed, but in most cases it can be taken to express his uncertainty of the fulfillment of the relevant conditions of his actions. (shrink)

This Introduction introduces readers to the concepts of political philosophy: authority, democracy, freedom and its limits, justice, feminism, multiculturalism, and nationality. Accessibly written and assuming no previous knowledge of the subject, it encourages the reader to think clearly and critically about the leading political questions of our time. THe book first investigates how politcial philosophy tackles basic ethical questions such as 'how should we live together in society?' It furthermore looks at political authority, discusses the reasons society needs politics in (...) the first place, explores the limitations of politics, and asks if there are areas of life that shouldn't be governed by politics. Moreover, the book explores the connections between political authority and justice, a constant theme in political philosophy, and the ways in which social justice can be used to regulate rather than destroy a market economy. In his travels through this realm, Miller covers why nations ar the natural units of government and wonders if the rise of multiculturalism and transnational co-operation will change all this, and asks in the end if we will ever see the formation of a world government. People increasingly form beliefs based on information gained from automatically filtered Internet ‎sources such as search engines. However, the workings of such sources are often opaque, preventing ‎subjects from knowing whether the information provided is biased or incomplete. Users’ reliance on ‎Internet technologies whose modes of operation are concealed from them raises serious concerns about ‎the justificatory status of the beliefs they end up forming. Yet it is unclear how to address these concerns ‎within standard theories of knowledge and justification. (...) To shed light on the problem, we introduce a ‎novel conceptual framework that clarifies the relations between justified belief, epistemic responsibility, ‎action, and the technological resources available to a subject. We argue that justified belief is subject to ‎certain epistemic responsibilities that accompany the subject’s particular decision-taking circumstances, ‎and that one typical responsibility is to ascertain, so far as one can, whether the information upon which ‎the judgment will rest is biased or incomplete. What this responsibility comprises is partly determined by ‎the inquiry-enabling technologies available to the subject. We argue that a subject’s beliefs that are ‎formed based on Internet-filtered information are less justified than they would be if she either knew how ‎filtering worked or relied on additional sources, and that the subject may have the epistemic ‎responsibility to take measures to enhance the justificatory status of such beliefs.‎. This chapter outlines the main ideas of my book National responsibility and global justice. It begins with two widely held but conflicting intuitions about what global justice might mean on the one hand, and what it means to be a member of a national community on the other. The first intuition tells us that global inequalities of the magnitude that currently exist are radically unjust, while the second intuition tells us that inequalities are both unavoidable and fair once national responsibility (...) is allowed to operate. This conflict might be resolved either by adopting a cosmopolitan theory of justice (which leaves no room for national responsibility) or by adopting a ?political? theory of justice (which denies that questions of distributive justice can arise beyond the walls of the sovereign state). Since neither resolution is satisfactory, the chapter defends the idea of national responsibility and proposes a new theory of global justice, whose main elements are the protection of basic human rights worldwide, and fair terms of interaction between independent political communities. Platonists and nominalists disagree about whether mathematical objects exist. But they almost uniformly agree about one thing: whatever the status of the existence of mathematical objects, that status is modally necessary. Two notable dissenters from this orthodoxy are Hartry Field, who defends contingent nominalism, and Mark Colyvan, who defends contingent Platonism. The source of their dissent is their view that the indispensability argument provides our justification for believing in the existence, or not, of mathematical objects. Scientific consensus is widely deferred to in public debates as a social indicator of the existence of knowledge. However, it is far from clear that such deference to consensus is always justified. The existence of agreement in a community of researchers is a contingent fact, and researchers may reach a consensus for all kinds of reasons, such as fighting a common foe or sharing a common bias. Scientific consensus, by itself, does not necessarily indicate the existence of shared knowledge among (...) the members of the consensus community. I address the question of under what conditions it is likely that a consensus is in fact knowledge based. I argue that a consensus is likely to be knowledge based when knowledge is the best explanation of the consensus, and I identify three conditions—social calibration, apparent consilience of evidence, and social diversity, for knowledge being the best explanation of a consensus. By looking at rhetoric and politics, this book offers a novel account of Juan Luis Vives' intellectual oeuvre. It argues that Vives adjusted rhetorical theory to a monarchical context in which direct speech was not a possibility, demonstrated how Erasmian languages of ethical self-government and political peace were actualized rhetorically and critically in a princely environment and, finally, rethought the cognitive and emotional foundations of humanist rhetoric in his late and famous De anima et vita (1538). Ultimately, towards the end (...) of his life, Vives epitomized a distinctively cognitive view of politics; he maintained that political concord was not a direct outcome of institutional or legal reform or of the spiritual transformation of the Christian world (an optimistic Erasmian interpretation), but that concord could only be upheld once the dynamics of emotions that motivated political action were understood and controlled through responsible rhetoric that respected decorum and civility. In a recent paper, Barry Loewer attempts to defend Humeanism about laws of nature from a charge that Humean laws are not adequately explanatory. Central to his defense is a distinction between metaphysical and scientific explanations: even if Humeans cannot offer further metaphysical explanations of particular features of their “mosaic,” that does not preclude them from offering scientific explanations of these features. According to Marc Lange, however, Loewer’s distinction is of no avail. Defending a transitivity principle linking scientific explanantia to (...) their metaphysical grounds, Lange argues that a charge of explanatory inadequacy resurfaces once this intuitive principle is in place. This paper surveys, on behalf of the Humean, three strategies for responding to Lange’s criticism. The ready availability of these strategies suggests that Lange’s argument may not bolster anti-Humean convictions, since the argument rests on premises that those not antecedently sharing these convictions may well reject. The three strategies also correspond to three interesting ways of thinking about relations of grounding linking Humean laws and their instances, all of which are consistent with theses of Humean supervenience, and some of which have been heretofore overlooked. Philosophers have recently argued, against a prevailing orthodoxy, that standards of knowledge partly depend on a subject’s interests; the more is at stake for the subject, the less she is in a position to know. This view, which is dubbed “Pragmatic Encroachment” has historical and conceptual connections to arguments in philosophy of science against the received model of science as value free. I bring the two debates together. I argue that Pragmatic Encroachment and the model of value-laden science reinforce each (...) other. Drawing on Douglas’ argument about the indispensability of value judgments in science, and psychological evidence about people’s inability to objectively reason about what they care about, I introduce a novel argument for Pragmatic Encroachment. The reconstructive theory of the procedural legitimacy of modern law developed on the basis of the theory of discourse ethics has limited itself solely to the deontological, moral‐normative aspects of the validity claims of legal norms and judgments. However, teleological and axiological aspects are also intertwined with legal validity claims and with the procedures in which legal norms and judgments are produced. The discursive‐procedural concept of legitimacy seems to require as its support, instead of the theory of discourse ethics, a (...) general theory of practical discourses or, more generally, of rational collective will‐formation. This paper reviews current debates in social epistemology about the relations ‎between ‎knowledge ‎and consensus. These relations are philosophically interesting on their ‎own, but ‎also have ‎practical consequences, as consensus takes an increasingly significant ‎role in ‎informing public ‎decision making. The paper addresses the following questions. ‎When is a ‎consensus attributable to an epistemic community? Under what conditions may ‎we ‎legitimately infer that a consensual view is knowledge-based or otherwise ‎epistemically ‎justified? Should consensus be the aim of scientific inquiry, and (...) if so, what ‎kind of ‎consensus? How should dissent be handled? It is argued that a legitimate inference ‎that a ‎theory is correct from the fact that there is a scientific consensus on it requires taking ‎into ‎consideration both cognitive properties of the theory as well as social properties of ‎the ‎consensus. The last section of the paper reviews computational models of ‎consensus ‎formation.‎. (shrink)

Serena Olsaretti brings together new essays by leading moral and political philosophers on the nature of desert and justice, their relations with each other and with other values.

A close reading of the poem of Parmenides, with focal attention to the way the proem situates Parmenides' insight in relation to Hesiod and Anaximander and provides the context for the thought of "... is". I identify three pointed ambiguities, in the direction of the journey to the gates of the ways of Night and Day, in the way the gates swing open before the waiting traveler, and in the character of the "chasm" that their opening makes, and I suggest (...) ways in which these ambiguities at once complicate and determine the significance of the thought of "... is" and its implications for the status of the opinions of mortals. The Ethics of Need: Agency, Dignity, and Obligation argues for the philosophical importance of the notion of need and for an ethical framework through which we can determine which needs have moral significance. In the volume, Sarah Clark Miller synthesizes insights from Kantian and feminist care ethics to establish that our mutual and inevitable interdependence gives rise to a duty to care for the needs of others. Further, she argues that we are obligated not merely to meet others’ needs (...) but to do so in a manner that expresses "dignifying care," a concept that captures how human interactions can grant or deny equal moral standing and inclusion in a moral community. She illuminates these theoretical developments by examining two cases where urgent needs require a caring and dignifying response: the needs of the elderly and the needs of global strangers. Those working in the areas of feminist theory, women’s studies, aging studies, bioethics, and global studies should find this volume of interest. (shrink)

Properties of Law is a legal-theoretical analysis about modern state law; about sociality, normativity and plurality as its properties, and what will come after modern state law. The main objective of this study is to offer a legal theoretical recapitulation of modern state law that avoids the fallacies of Legal Positivism. This calls for a relationist approach where law's sociality is related to normativity, and normativity to sociality. Avoiding Legal Positivism's fallacies also includes refraining from extrapolating from modern state law (...) to law in general; replacing Legal Positivism's conceptual universalism with sensitivity to the varieties of law, and acknowledging that law existed before modern state law, that it will exist after modern state law, and that other law exists alongside modern state law. Miller analyzes the relationship between consent and autonomy by offering three pictures. For autonomy, Miller distinguishes between procedural, substantive, and weak substantive autonomy. The corresponding views of consent are what Miller has termed as consensual minimalism, consensual idealism, and consensual realism. The requirements of sexual consent under consensual minimalism are a voluntary informed agreement. However, feminist critiques reveal the inadequacies of this simple position. Consensual idealism, which corresponds with substantive autonomy, offers a robust picture where consent and (...) autonomy must be based on non-oppression. However, this view is considered too ideal and it ignores context. Weak substantive autonomy takes into account the context in the sexual domain. Correspondingly, consensual realism takes into account the context and still fulfills the requirements of consent. (shrink)

This essay explains some basic concepts about BDSM, and it responds to two important objections to it. The first is the psychological objection—that BDSM practitioners suffer from mental disorders—and the second is the ethical objection—that BDSM practitioners have morally compromised desires because of the kinds of activities they desire to participate in, especially ones that involve roles that dip into tortured oppressive histories (e.g., "rape" scenes, "master-and-slave" scenes). The paper argues that both objections fail, and, more specifically focusing on the (...) ethical objection, argues that BDSM desires are psychologically, conceptually, and phenomenologically different from their seeming counterpart real-life desires that are truly ethically defective. Finally, the paper argues that BDSM practitioners, in having to always understand, explore, and justify their desires (especially to a majority that is hostile to them), have an interesting chance to lead rich, flourishing lives. This paper focuses on a non-volitional account that has received a good deal of attention recently, Angela Smith's rational relations view. I argue that without historical conditions on blameworthiness for the non-voluntary non-volitionist accounts like Smith’s are (i) vulnerable to manipulation cases and (ii) fail to make sufficient room for the distinction between badness and blameworthiness. Towards the end of the paper I propose conditions aimed to supplement these deficiencies. The conditions that I propose are tailored to suit non-volitional accounts (...) of blameworthiness. Unlike some volitional historical conditions on blameworthiness, the conditions that I propose do not require that the person have exercised voluntary control (e.g., via choices or decisions) over the acquisition of her attitudes or values. A startling look at one of this century's most influential philosophers, the book chronicles every stage of Foucault's personal and professional odyssey, from his early interest in dreams to his final preoccupation with sexuality and the nature of personal identity.

Good work in nursing is work that is scientifically effective as well as morally and socially responsible. The purpose of this study was to examine variables that sustain good work among entering nurses (with one to five years of experience) and experienced professional nurses despite the obstacles they encounter. In addition to role models and mentors, entering and experienced nurses identified team work, cohesiveness and shared values as levers for good work. These nurses used prioritization, team building and contemplative practices (...) to overcome obstacles. Entering professional nurses tended to avoid conflict in the work setting. Experienced nurses reported forming teams of decision makers who share similar values to resolve conflict. These findings have implications for nurse education and nursing practice. Reflection on the importance of values and virtue in sustaining good work is important. Entering professional nurses should be encouraged to seek positive role models and reflect on the lessons that can be learned from experienced exemplary nurses. (shrink)

What are words? What makes two token words tokens of the same word-type? Are words abstract entities, or are they (merely) collections of tokens? The ontology of words tries to provide answers to these, and related questions. This article provides an overview of some of the most prominent views proposed in the literature, with a particular focus on the debate between type-realist, nominalist, and eliminativist ontologies of words.

Charney's dismissal of well-established methods in behavioral genetic research is misguided. He claims that studies of heritability and genetic association depend for their validity on six assumptions, but he cites no sources to support this claim. We explain why none of the six assumptions is strictly necessary for the utility of either method of genetic analysis.

While philosophy and psychoanalysis privilege language and conceptual distinctions and mistrust the image, the philosopher and psychoanalyst Julia Kristeva recognizes the power of art and the imagination to unblock important sources of meaning. She also appreciates the process through which creative acts counteract and transform feelings of violence and depression. Reviewing Kristeva's corpus, Elaine P. Miller considers the intellectual's "aesthetic idea" and "thought specular" in their capacity to reshape depressive thought on both the individual and cultural level. She revisits (...) Kristeva's reading of Walter Benjamin with reference to melancholic art and the imagination's allegorical structure; her analysis of Byzantine iconoclasm in relation to Freud's psychoanalytic theory of negation and Hegel's dialectical negativity; her understanding of Proust as an exemplary practitioner of sublimation; her rereading of Kant and Arendt in terms of art as an intentional lingering with foreignness; and her argument that forgiveness is both a philosophical and psychoanalytic method of transcending a "stuck" existence. Focusing on specific artworks that illustrate Kristeva's ideas, from ancient Greek tragedy to early photography, contemporary installation art, and film, Miller positions creative acts as a form of "spiritual inoculation" against the violence of our society and its discouragement of thought and reflection. This book offers a novel account of grace, framed in terms of Bruno Latour's "principle of irreduction.

A Theory of Shopping offers a highly original perspective on one of our most basic everyday activities - shopping. We commonly assume that shopping is primarily concerned with individuals and materialism. But Miller rejects this assumption and follows the surprising route of analysing shopping by means of an analogy with anthropological studies of sacrificial ritual. He argues that the act of purchasing goods is almost always linked to other social relations, and most especially those based on love and care. (...) The ethnographic sections of the book are based on a year's study of shopping on a street in North London. This provides the basis for a sensitive description of the issues the shopper confronts when making decisions as to what to buy. Miller develops a theory to account for these observations, arguing that shopping typically consists of three major stages which reflect the three key stages of many rites of sacrifice. In both shopping and sacrifice the ultimate intention is to constitute others as desiring subjects. Finally the book examines certain historical shifts in both subjects and objects of devotion, in particular, ideals of gender and love. This treatment of shopping from the perspective of comparative anthropology represents a highly innovative approach to one of the most familiar tasks of our daily lives. Written in a clear and accessible manner, this book will be of interest to students and academics in anthropology, sociology and cultural studies, as well as anybody who wants to consider more deeply the nature of their own everyday activities. It has been a common assumption that words are substances that instantiate or have properties. In this paper, I question the assumption that our ontology of words requires posting substances by outlining a bundle theory of words, wherein words are bundles of various sorts of properties (such as semantic, phonetic, orthographic, and grammatical properties). I argue that this view can better account for certain phenomena than substance theories, is ontologically more parsimonious, and coheres with claims in linguistics.

At Sophist 253d-e the Eleatic Visitor offers a notoriously obscure description of the fields of one-and-many that the dialectician “adequately discerns.” Against the readings of Stenzel, Cornford, Sayre, and Gomez-Lobo, I propose an interpretation of that passage that takes into account the trilogy of Theaetetus-Sophist-Statesman as its context. The key steps are to respond to the irony of Socrates’ refutations at the end of the Theaetetus by reinterpreting the last two senses of logos as directed to forms and to recognize (...) their correlation with the two different modes of diairesis practiced by the Eleatic Visitor. These steps position us to recognize in the Visitor’s remarks at Sophist 253d-e a schematic description of the two kinds of eidetic field that the two modes of diairesis trace. (shrink)
