The parents of Charlie Gard, who was born August 4, 2016, with an exceedingly rare and incurable disease called mitochondrial DNA depletion syndrome, fought a prolonged and heated legal battle to allow him access to experimental treatment that they hoped would prolong his life and to prevent his doctors from withdrawing life-sustaining care. Charlie's clinicians at the Great Ormond Street Hospital in London believed that the brain damage Charlie had suffered as a result of frequent epileptic seizures, along with many (...) other severe disabilities, would render any innovative therapy futile, and they disagreed with his parents’ wishes to use an experimental therapy. They felt it in Charlie's best interest that he be allowed to die. A battle ensued among Charlie's parents, his doctors, and a guardian who had been appointed to represent him that drew the attention of politicians and prominent persons from all over the world. The case was much in the news over the past year, but it has also been frequently misunderstood. (shrink)

As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...) when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. Recent political turmoil has focused international attention on Egypt, yet there is little awareness of the country’s stateless populations—those who lack legal nationality to any state—or the challenges they face. Individuals in situations of protracted statelessness are denied their right to a nationality, resulting in an array of additional rights violations. Such violations include denied freedom of movement, equality before the law, and access to economic and social rights. Drawing from two years’ of fieldwork data, this study highlights the plight (...) of those who are unable to achieve legal status in a country with harsh punishments for illegal presence, entry, and exit. It also evaluates potential solutions for eliminating statelessness in Egypt and protecting the rights of stateless populations. As Egypt seeks to move beyond revolution, it is vital that the government addresses the pervasive and systemic inequalities that deny individuals their right to a nationality. (shrink)

Evolving practice requires peer review of clinical ethics (CE) consultation for quality assessment and improvement. Many institutions have identified the chart note as the basis for this process, but to our knowledge, electronic health record (EHR) systems are not necessarily designed to easily include CE consultation notes. This article provides a framework for the inclusion of CE consultation notes into the formal EHR, describing a developed system in the Epic EHR that allows for the elaborated electronic notation of the CE (...) chart note. The implementation of the “meaningful use” criteria for EHR, mandated by the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009, requires that health professionals meet certain standards for quality, efficiency, and safety, all of which overlap with the goals of standardization, peer review, and quality improvement within CE consultation. Hegel introduced the Phenomenology of Mind as a work on the problem of knowledge. In the first chapter, entitled “Sense Certainty, or the This and Meaning,” he concluded that knowledge cannot consist of an immediate awareness of particulars ). The tradition discusses sense certainty in terms of this failure of immediate knowledge without, however, specifically addressing the problem of reference. Yet reference is distinct from knowledge in the sense that while there can be no knowledge of objects without reference, there (...) may be reference without knowledge. If that is the case, then the failure of immediate knowledge does not entitle us to conclude anything about the success or failure of reference. It is not surprising, then, that a few scholars have begun to examine sense certainty primarily as a thesis about reference. (shrink)

Modes-of-being figure centrally in Heidegger's masterwork Being and Time. Testimony to this is Heidegger's characterisation of two of his most celebrated enquiries—the Existential analytic and the Zeug analysis—as investigations into the respective modes-of-being of the entities concerned. Yet despite the importance of this concept, commentators disagree widely about what a mode-of-being is. In this paper, I systematically outline and defend a novel and exegetically grounded interpretation of this concept. Strongly opposed to Kantian readings, such as those advocated by Taylor Carman (...) and Cristina Lafont, I interpret a mode-of-being as a universal that defines a district —that is, a natural class of entities that ought to be conceptualised in a special way. As such, every mode-of-being plays an important metaphysical and epistemic role: serving both to unify a natural class of a high degree of generality and as the interpretandum of an act yielding the basic-concepts pertaining to the entities therein. In explicating and arguing for this interpretation, I attribute a characteristically Aristotelian philosophical position to the early Heidegger, encompassing both metaphysical and epistemological realism and a conceptualist theory of universals. Purpose– The purpose of this paper is to present a novel mnemonic, ACTIVE, inspired by Mason's 1985 PAPA mnemonic, which will help researchers and IT professionals develop an understanding of the major issues in information ethics.Design/methodology/approach– Theoretical foundations are developed for each element of the mnemonic by reference to philosophical definitions of the terms used and to virtue ethics, particularly MacIntyrean virtue ethics. The paper starts with a critique of the elements of the PAPA mnemonic and then proceeds to develop (...) an understanding of each of the elements of ACTIVE ethics, via a discussion of the underpinning virtue ethics.Findings– This paper identifies six issues, described by the mnemonic, ACTIVE. ACTIVE stands for: autonomy, the ability of the individual to manage their own information and make choice; community, the ethical effect of an information systems on the community which it supports; transparency, the extent to which the derivation of content and process in an information system is made clear; identity, the social and ethical effect of an information system on the definition and maintenance of the distinctive characteristics of a person; value, the value or moral worth placed on information associated with an individual and hence on the relationship with the individual; and empathy, the ability of the information systems professional to emotionally connect with the user and the extent to which the information system distances or connects.Originality/value– The paper applies virtue ethics to developing a tool to help information professionals reflect on their ethical practice in developing and supporting information systems. In biomedicine, practitioners often treat risk of disease as an illness in itself—suitable for monitoring and intervention. In some cases, increased diagnostics improve health outcomes by detecting problems early. Recently, however, science and technology studies scholars and medical practitioners have noted that the treatment of risk can also lead to unnecessary intervention and possible harm. Despite these findings, it is often hard to see changes in practice. Childbirth serves as an illuminating case because two models of health risk operate simultaneously—in (...) addition to the model valuing frequent intervention, there is another that seeks to mitigate risk by refusing medical surveillance. Based on interviews with birth providers and an analysis of professional documents, this article uses the case of fetal heart rate monitoring in American childbirth to demonstrate how some health providers are framing “intentional non-knowing” as a moral imperative to reduce medical risk. Studying the success and limitations of this “risk counterculture” illuminates how risk societies are changing in response to data suggesting that more information can have hurtful effects. This case integrates well-developed theories of knowledge production with less-developed theories of knowledge nonproduction, leading to a more fruitful discussion of the boundaries of responsible knowledge in risk management. The author, a philosopher, is sometimes in worried denial that Stevens is an "anti-realist" (...) or a "transcendental realist," and one occasionally senses that in the ancient tension between philosophy and poetry, herding the poets into the philosopher's pen is a bullying way to resolve the conflict. But the book isn't a catastrophe at all; it's a lucid, ruminative, and personable reading of Stevens (and Malick) that even offers a good general guide to the reading of poetry in what Critchley calls "the wake of romanticism" (motto: "God is dead; therefore I am").Critchley's major idea is twofold: that poetry is a therapeutic art form because it slows us down and encourages, about countless subjects, "the whole voluptuousness of looking"; and that Stevens's poetry is informed by a contest between a poetry of "supreme fictions" (in which phenomena come under the [End Page 503] dominion of a potent imagination) and a poetry of "antipodes" (in which phenomena resist the imagination—they "merely are"—and thus reduce the imagination to impotence). Here Critchley affirms a usual view of Stevens as a poet of the weather—another way of saying that he is a modernist with strong roots in the Romantic movement—and he notes that the supreme fiction poems often tend to be set in summer, when the imagination seems especially yeasty, while the antipodean poems tend to be set in winter, when the miserly realness of things seems to rule the earth. In his sensitive and astute reading, however, Critchley remarks upon something else: that in his late poems Stevens seems more overtly metaphysical (Critchely says Stevens is the most philosophically interesting poet of the twentieth century) and that his later poems are set more and more in the seasons of transition (late autumn/early spring). Late in Stevens's career the battle between supreme fictions and antipodes is therefore played out in the same, often overtly philosophical poems. Here Critchley's commentary is at its most astute. Occasional lovers of Wallace Stevens's poetry will remember why they adore his work, and have a better idea why.However, lest readers get the wrong idea, some careful qualifications about the dialectic between Stevens's summer and winter poems are in order. For one thing, the poems of supreme fictions always leave phenomena with their particularity, their ordinariness, their concreteness. To cite one such poem, "Anecdote of the Jar," although the poet imaginatively places "a jar in Tennessee" that makes "the lovely wilderness / Surround that hill," the wilderness' birds and bushes, even the jar itself, remain birds and bushes and jars ("gray and bare"). Here Critchley reinterprets Samuel Taylor Coleridge's distinction between "fancy" and "imagination." Fancy dreams of what does not exist, while imagination transfigures what does. Stevens's poems of supreme fiction are always imaginative, never fanciful.A second qualification: Critchley argues that for Stevens (as well as for a number of philosophers) human ways of knowing are always informed, sooner or later, by the conceptual imagination. In that sense a rose is never just a rose, although we need not become overly fanciful about what a cigar might be. And this leads us to a third one: When readers get to the wintry, antipodean poems—the poems of "anti-poetry"—they will find Stevens suggesting that the only way to view objects without imagination is to imagine what that would be like. Ethical medical care of pregnant women in Australia should include the real provision of information regarding the risks and benefits of vaginal birth. Routinely obtaining consent for the different ways in which childbirth is commonly intervened on and the assistance involved (such as midwife-led care or a planned caesarean section) and providing sufficient information for women to evaluate the harms and benefits of the care on offer, would not only enable the empowerment of women but would align with the current (...) standard of care as established by Rogers v Whittaker. In _Democracy and Education_, John Dewey devotes a chapter to geography and history. McBride reveals that, until recently, he had not thought much about this chapter; geography and history were compulsory topics to be taught to children. In recent years, having read Katherine McKittrick’s _Demonic Grounds: Black Women and the Cartographies of Struggle_, McBride has been compelled to think more about geographies of dominance; the ways place, terrain, and geography are imbued with racialized and gendered and hierarchal values, (...) which conspire to create boundaries and exclusions. According to Dewey, learning about the geographies of place and histories of groups of people can enrich our connections to this place and its ecology, make the goals of our people more meaningful, and it can boost our inefficaciousness in our immediate surroundings. Failing this, the knowledge we gain from our elders becomes increasingly detached and meaningless. McBride suggests that Dewey suffered from a form of this estrangement (regarding the tacit racially-white Eurodescended coloniality of North America). McBride suggests that the vast majority of our society can conceive of no future world that is not dominated by Eurodescended peoples and thoroughly infused with their techno-industrial norms and values. If our accounts of the social milieu skirt past the dispossession of the first peoples or the enslavement of Afrodescended peoples or the debilitating effects of heteropatriarchy, then it would appear that we are not terribly critical about our past or our connection to place. It would suggest that we are resigned to (or comfortable within) the Eurodescended norms of this place, unable to see any viable alternatives. In the end, McBride suggests that we accept the Deweyan insight but supplement it with the critical study of geographies of domination and cartographies of struggle. (shrink)

Discussion of a metaphysical sense of 'inheritance' and cognate notions relevant to fundamentality.

The moral/conventional task has been widely used to study the emergence of moral understanding in children and to explore the deficits in moral understanding in clinical populations. Previous studies have indicated that moral transgressions, particularly those in which a victim is harmed, evoke a signature pattern of responses in the moral/conventional task: they are judged to be serious, generalizable and not authority dependent. Moreover, this signature pattern is held to be pan‐cultural and to emerge early in development. However, almost all (...) the evidence for these claims comes from studies using harmful transgressions of the sort that primary school children might commit in the schoolyard. In a study conducted on the Internet, we used a much wider range of harm transgressions, and found that they do not evoke the signature pattern of responses found in studies using only schoolyard transgressions. Paralleling other recent work, our study provides preliminary grounds for skepticism regarding many conclusions drawn from earlier research using the moral/conventional task. (shrink)

Knowledge closure is the claim that, if an agent S knows P, recognizes that P implies Q, and believes Q because it is implied by P, then S knows Q. Closure is a pivotal epistemological principle that is widely endorsed by contemporary epistemologists. Against Knowledge Closure is the first book-length treatment of the issue and the most sustained argument for closure failure to date. Unlike most prior arguments for closure failure, Marc Alspector-Kelly's critique of closure does not presuppose any (...) particular epistemological theory; his argument is, instead, intuitively compelling and applicable to a wide variety of epistemological views. In “Race, Multiculturalism, and Democracy,” Robert Gooding-Williams offers an insight. He writes: “Our sense of ourselves and of the possibilities existing for us is, to a significant degree, a function of the descriptions we have available to us to conceptualize our intended actions and prospective lives. . . . ‘Hence if new modes of description come into being, new possibilities of action come into being in consequence.’” In this article, I discuss the philosopher’s role in the articulation of new descriptions (...) and thus new possibilities. I argue that potential modes of bold and assertive comportment are conjured when new insurrectionist descriptions are articulated within oppressed populations. To bring this to a higher resolution, I discuss the pervasiveness of dialectical conflict, the need to creatively reorient the descriptions of oppressed groups toward liberation, and the need for more than one prescriptive mode of social amelioration. Using traditional meta-analytic techniques, we compile relevant research to enhance conceptual appreciation of ethical climate theory (ECT) as it has been studied in the descriptive and applied ethics literature. We explore the various treatments of ethical climate to understand how the theoretical framework has developed. Furthermore, we provide a comprehensive picture of how the theory has been extended by describing the individual-level work climate outcomes commonly studied in this theoretical context. Meta-analysis allows us to resolve inconsistencies in previous findings as (...) well as confirm the central tenets of the overall ethical climate framework. In addition, we consider the ethical climate relationships in the larger context of the␣theoretical framework, using path analysis to test the structural relationships. Overall, our results provide evidence of the relationships between ethical climate perceptions and individual-level work outcomes. The sensitivity principle is a compelling idea in epistemology and is typically characterized as a necessary condition for knowledge. This collection of thirteen new essays constitutes a state-of-the-art discussion of this important principle. Some of the essays build on and strengthen sensitivity-based accounts of knowledge and offer novel defences of those accounts. Others present original objections to sensitivity-based accounts and offer comprehensive analysis and discussion of sensitivity's virtues and problems. From the very beginning of his explicitly political thinking until the end of his life, Jean-Paul Sartre was always cognizant of the fact that the typical electoral system, whether dominated by two or by several "parties," that is to be found in Western countries and that is vaunted as the pinnacle of real democracy amounted to a profound mystification. That is why, at the time of the centenary of his birth, he is owed a renewed respect for his ideas in (...) this area. I do not intend to examine here the evolution of Sartre?s political thought, or even his views with respect to the Eastern European countries, the "socialism" of which, as he eventually discovered, was scarcely more real than their "democracy." Rather, I shall confine myself to recalling certain elements, especially certain iconoclastic elements, of that thought. This paper takes aim at contemporary conceptions of liberal democracy and the accompanying loss of faith with liberal democratic theory which may be observed. There exist problems with procedure, outcomes, and the decline of universality in the face of liberal nationalism which only serve to reinforce boundaries. The clearest cases of these problems have arisen in the United States over the past few years, and especially since the events of September 11, 2001.

This essay focuses on the danger of complicity. American philosophers, given their country’s hegemonic position, exert global influence; what form should it take? Comparison is made with the situation of France when it still controlled Algeria. French philosophers, until near the time of Algerian independence, generally accepted and sometimes profited from this extremely unjust situation. An important exception was Sartre, particularly in his Preface to Fanon’s The Wretched of the Earth. It is argued that elements of complicity with American global (...) dominance, some of the more unjust aspects of which are listed, are to be found in such widely read philosophers as Rawls and Rorty. It is suggested that a rethinking of the problem of evil, in its political and not just its religious aspects, is in order. Finally, a broader view of what ‘American philosophy’ means, including, for instance, the voices of African American and Native American philosophers, is urged. (shrink)

The conceptual literature increasingly portrays corporate philanthropy (CP) as an old-fashioned and ineffective operationalization of a firm’s corporate social responsibility. In contrast, empirical research indicates that corporations of all sizes, and both in developed and emerging economies, actively practice CP. This disadvantaged status of the concept, and research, on CP, complicates the advancement of our knowledge about the topic. In a systematic review of the literature containing 122 journal articles on CP, we show that this business practice is loaded with (...) unique characteristics, strengths, and weaknesses, and both conceptual and practical challenges that require renewed attention. We identify six interrelated but distinctive research themes in the literature: concept, motives, determinants, practices, business outcomes, and social outcomes. Dividing the literature on CP into six research themes creates an insightful comprehensive map of this intellectual terrain. Moreover, we distinguish among the level at which CP is analyzed: individual, organizational, institutional, or any combination of these levels. The review reveals significant gaps in the knowledge on CP. Most importantly we find that the conceptualization is limited, the research is mostly quantitative, the effects of CP on society are severely under-researched, and there is a lack of multilevel analyses. A detailed future research agenda is offered, including specific suggestions for research designs and measurements. (shrink)

ABSTRACT Toni Morrison suggests that storytelling is a highly effective way of structuring knowledge, and that the harnessing of a clever allegory, the search for well-patterned language is a constant, provocative engagement with the contemporary world. This article considers the ways poetry, imagination, and well-patterned language are utilized in the philosophies of Ralph Waldo Emerson, Richard Rorty, and Leonard Harris. The author notes that there are apparent similarities between Rorty and Harris, but one should also notice that there are significant (...) differences in these two philosophical positions. The author ultimately argues that Harris’s move toward poetry and well-patterned language is extremely powerful and needed if people wish to move beyond a well-established set of values and norms. Harris prods us to tell thought-provoking, engaging stories—to intricately tuck knowledge into allegory and well-patterned language—but do it without being an apologist for the prevailing bourgeois liberal democratic tradition. In this manner, the harnessing of metaphor and clever allegory, the creative engagement with poetry and well-patterned language (in philosophy) is a provocative means of engaging the oppression, dispossession, and immiseration of the contemporary world. Lucius Outlaw and Shannon Sullivan have argued for the preservation of racial distinctiveness and the necessity of racial separatism. This paper articulates and challenges this push for racial separatism and the particular conception of race evoked therein. The author points out that the multiplicity, the multiculturalism, the intersectionality within these communities of resistance is typically belittled, fragmented, or erased.
