Critical Legal Theory has conventionally been traced to the social, political, and philosophical movements of the 1960s and, before that, to the early-twentieth-century ‘realist’ critique of modern jurisprudence. In truth, however, its origins go back to classical and pre-modern thought, and to their acknowledgement of the centrality of law in attempts to conceive of the good life, or the just polity—a centrality that is, moreover, also discernible in the recent gravitation of a number of contemporary philosophers and theorists towards law. (...) Against the ‘restricted’ and ‘conservative’ character of modern jurisprudence, Critical Legal Theory constitutes a return to this more general interest in law and legality. Exceeding the limits of jurisprudence, it has, moreover, drawn upon the most ancient and most contemporary traditions of critical thought in order to pursue new ways of understanding, living, and imagining the law. In this discussion piece, eight scholars in geography, urban planning, and agri-food studies from the United States (US) and France engage in a bi-national comparison to deepen our collective understanding of food and land justice. We specifically contextualize land justice as a critical component of food justice in both the US and France in three key areas: access to land for cultivation, urban agriculture, and non-agricultural forms of food provisioning. The US and France are interesting cases to compare, considering the (...) differences and similarities in their colonial and agricultural histories, persistent and systemic race and class-based inequities in land access, and the roles of public bodies and social movements. In this paper, we synthesize literature, share reflections, and offer directions for future scholarship, including a broader comparative research agenda. An important difference we found is in the degree of scholarly attention to race and how it mediates access to land. We also observe that few scholars articulate a clear definition of justice in their work, nor do they share a common justice framework. We hope that this paper contributes to a more robust food and land justice framework for the use of scholars, practitioners and activists. (shrink)

Aimed at philsophy graduates this book investigates mental content in a systematic way and advances a number of claims about how mental content states are related to the body and the world. Internalism is the thesis that they are; externalism is the theory that they are not.

Identity, existence, predication, necessity, and truth are fundamental philosophical concerns. Colin McGinn treats them both philosophically and logically, aiming for maximum clarity and minimum pointless formalism. He contends that there are real logical properties that challenge naturalistic metaphysical outlooks. These concepts are not definable, though we can say a good deal about how they work. The aim of Logical Properties is to bring philosophy back to philosophical logic.

Modalists think that knowledge requires forming your belief in a “modally stable” way: using a method that wouldn't easily go wrong, or using a method that wouldn't have given you this belief had it been false. Recent Modalist projects from Justin Clarke-Doane and Dan Baras defend a principle they call “Modal Security,” roughly: if evidence undermines your belief, then it must give you a reason to doubt the safety or sensitivity of your belief. Another recent Modalist project from Carlotta Pavese (...) and Bob Beddor defends “Modal Virtue Epistemology”: knowledge is a belief that is maximally modally robust across “normal” worlds. We'll offer new objections to these recent Modalist projects. We will then argue for a rival view, Explanationism: knowing something is believing it because it's true. We will show how Explanationism offers a better account of undermining defeaters than Modalism, and a better account of knowledge. (shrink)

There is an active debate within the field of phonology concerning the cognitive status of substantive phonetic factors such as ease of articulation and perceptual distinctiveness. A new framework is proposed in which substance acts as a bias, or prior, on phonological learning. Two experiments tested this framework with a method in which participants are first provided highly impoverished evidence of a new phonological pattern, and then tested on how they extend this pattern to novel contexts and novel sounds. Participants (...) were found to generalize velar palatalization (e.g., the change from [k] as in keep to [t⌢∫S] as in cheap) in a way that accords with linguistic typology, and that is predicted by a cognitive bias in favor of changes that relate perceptually similar sounds. Velar palatalization was extended from the mid front vowel context (i.e., before [e] as in cape) to the high front vowel context (i.e., before [i] as in keep), but not vice versa. The key explanatory notion of perceptual similarity is quantified with a psychological model of categorization, and the substantively biased framework is formalized as a conditional random field. Implications of these results for the debate on substance, theories of phonological generalization, and the formalization of similarity are discussed. (shrink)

Many weaknesses of game theory are cured by new models that embody simple cognitive principles, while maintaining the formalism and generality that makes game theory useful. Social preference models can generate team reasoning by combining reciprocation and correlated equilibrium. Models of limited iterated thinking explain data better than equilibrium models do; and they self-repair problems of implausibility and multiplicity of equilibria.

Should cognitive scientists be any more embarrassed about their lack of a discipline-fixing definition of cognition than biologists are about their inability to define “life”? My answer is “no”. Philosophers seeking a unique “mark of the cognitive” or less onerous but nevertheless categorical characterizations of cognition are working at a level of analysis upon which hangs nothing that either cognitive scientists or philosophers of cognitive science should care about. In contrast, I advocate a pluralistic stance towards uses of the term (...) ‘cognition’ that eschews the urge to treat cognition as a metaphysically well-defined “natural” kind. (shrink)

ABSTRACTOscar Larsson’s sympathetic critique of constructivist institutionalism calls for a clarification of my understanding of subjectivity, inter-subjectivity, and their mutual interdependence. That interdependence lies at the heart of any genuinely constructivist approach, just as the interdependence of structure and agency lies at the heart of any genuinely institutionalist approach. As such, I reject the charge of subjectivism just as I would that of voluntarism. Building on the social ontology of Berger and Luckmann, we can distinguish between subjectivity and intra-subjectivity and (...) proceed to show how the latter implies a notion of inter-subjectivity. An example of the social construction of a political crisis shows that social facts are made and remade through a fusion of inter- and intra-subjectivities. (shrink)

In the recent literature on the nature of knowledge, a rivalry has emerged between modalism and explanationism. According to modalism, knowledge requires that our beliefs track the truth across some appropriate set of possible worlds. Modalists tend to focus on two modal conditions: sensitivity and safety. According to explanationism, knowledge requires only that beliefs bear the right sort of explanatory relation to the truth. In slogan form: knowledge is believing something because it’s true. In this paper, we aim to vindicate (...) explanationism from some recent objections offered by Gualtiero Piccinini, Dario Mortini, and Kenneth Boyce and Andrew Moon. Together, these authors present five purported counterexamples to the sufficiency of the explanationist analysis for knowledge. In addition, Mortini devises a clever argument that explanationism entails the violation of a plausible closure principle on knowledge. We will argue that explanationism is innocent of all these charges against it, and we hope that the strength of the defense we offer of explanationism is evidence in its favor, and a reason to investigate explanationism further as the long-elusive truth about the nature of knowledge. Agroecology has been proposed as a key building block for food sovereignty. This article examines the meaning, practices and potentials of ‘transformative agroecology learning’ as a collective strategy for food system transformation. Our study is based on our qualitative and action research with the European Coordination of Via Campesina to develop the European Agroecology Knowledge Exchange Network. This network is linked to the global network of La Via Campesina and builds on the strong experiences and traditions of popular education in (...) Latin American peasant movements. Rather than focusing on agroecology education as a process of individual learning, we analyse how a transformative agroecology education can be strengthened as a critical repertoire of action used by social movements to advance food sovereignty. Our analysis contributes a new theory of transformative agroecology learning based on four key characteristics or qualities: horizontalism; diálogo de saberes ; combining practical and political knowledge; and building social movement networks. While these different elements of transformative agroecology learning were present across EAKEN, they were unevenly developed and, in many cases, not systematized. The framework can help to strategically and reflexively systematize and strengthen a transformative agroecology learning approach as a key building block for food sovereignty. (shrink)

While not underestimating the value of useful knowledge and skills, it is suggested that education should also develop the subjective self of the learner. A distinction is drawn between an ‘additive’ view of education which simply furnishes the individual with knowledge and skills and a ‘transformative’ concept which concerns itself with changes to more central parts of the learner's self. In developing a concept of the subjective self, reference is made to the Enlightenment notion of the autonomous rational self and (...) the interpersonal or cultural self of the Symbolic Interactionists and Communitarians. Particular attention, however, is given to Heidegger's three categories of entities experienced by the phenomenological self: the ‘present at hand’, the ‘ready to hand’ and those entities with whom we share the experience of ‘being with’. An attempt is made to interpret important aspects of education in terms of the development of learners' growing knowledge and deepening understanding of these three kinds of entity and the relation in which they stand to them. This paper contributes to the study of paracompleteness and paraconsistency. We present two logics that address the following questions in novel ways. How can the paracomplete theorist characterize the formulas that defy excluded middle while maintaining that not all formulas are of this kind? How can the paraconsistent theorist characterize the formulas that obey explosion while still maintaining that there are some formulas not of this kind?

Codes of ethics and conduct have become common in UK organisations. This paper explores how such codes are understood and responded to by those whom the codes seek to influence. The study is an interpretative one, based on interview material, in which a dialectical pattern is seen in employees’ reactions to codes. Initial contradictions are found in codes of ethics and in codes of conduct . These tensions create perceptions of a two‐tier system in organisations in which core employees are (...) subject to codes of ethics that are loosely applied, but non‐core staff are subject to codes of conduct that are strictly applied. However, even core staff are aware of a dialectical contradiction in their position. They believe that loyalty to the organisation is the price they pay for being allowed freedom of integrity by their organisations, but that the price they have to pay for showing integrity may be breaking faith with their organisations. This chiasmus of integrity and loyalty represents a difficulty for the project of improving standards of corporate citizenship. The use of this trope and other rhetorical figures to exemplify processes of understanding and interpretation in organisations is discussed. (shrink)

The dichotomy between virtue and self‐interest or pleasure is held to face modern moral educators with a conflict between the interest of society and that of their pupils, as well as presenting obvious motivational difficulties. Three possibilities for mitigating this conflict are offered. First, it is argued that virtue is an essential constituent of our well‐being insofar as even undetected wickedness isolates us from others. Second, young people, alienated by the negative nature of conventional morality, may respond positively to certain (...) moral appeals in a way that is fulfilling and life‐enhancing. Third, it is argued that moral education which emphasises the rights of young people themselves alongside those of others would be both more reputable and more effective than that based on the opposition between virtue and self‐interest or pleasure. Philosophers of education have always been interested in epistemological issues. In their efforts to help inform educational theory and practice they have dealt extensively with concepts like knowledge, teaching, learning, thinking, understanding, belief, justification, theory, the disciplines, rationality and the like. Their inquiries have addressed issues about what kinds of knowledge are most important and worthwhile, and how knowledge and information might best be organised as curricular activity. They have also investigated the relationships between teaching and learning, belief and opinion, (...) knowledge and belief, and data and information. For some a key issue has been how students can become autonomous knowers. This issue has often been bound up with questions about what count as appropriate standards for reasonableness or rationality, and the conditions under which we can properly regard understanding as having occurred. During the past decade renewed interest has been shown in what is involved in becoming an authority, expert or competent performer in a given area of knowledge, as well as in how we evaluate and critique different or competing beliefs, theories, points of view or paradigms. The paper argues that this conundrum can only be solved by recognizing that our current conception of space is fundamentally inadequate. However, no other conception is available to us.

By far the most common term in Professor Jeffner's paper is ‘understanding’, and it is clearly with understanding that he is primarily concerned. However, at the beginning of his paper he talks of understanding and explanation, and at least in the case of his third kind of reality he clearly sees understanding and explanation as intimately related. In this he is surely right. I myself would say that understanding is cognizing a manifold as a single whole in all its internal (...) relationships, and this ties up with what Jeffner has to say about Gestalts on pp. 220–221. And explanation, as I hope to show, depends upon or presupposes the understanding that flows from the possession of a Gestalt . However, Jeffner adopts Hempel and Oppenheim's deductivist account of scientific explanation, and I believe this account to be fundamentally mistaken, and to have serious consequences for his argument. One does not achieve explanation merely by finding a set of empirically true premises from which a proposition expressing the explanandum can be deduced – if that were so one would explain Socrates' mortality by pointing out that everything snub-nosed is mortal, and that Socrates was snub-nosed. It is interesting, in this respect, to compare Hempel's account of explanation with that of Aristotle. There are substantial similarities between the two accounts, but there is one fundamental difference. Hempel insists that there can be no explanation unless events are connected in some way, and so rejects, for example, a mere sequential narrative as constituting an explanation. (shrink)

Property rights are the rules governing ownership in society. This Element offers an analytical framework to understand the origins and consequences of property rights. It conceptualizes of the political economy of property rights as a concern with the follow questions: What explains the origins of economic and legal property rights? What are the consequences of different property rights institutions for wealth creation, conservation, and political order? Why do property institutions change? Why do legal reforms relating to property rights such as (...) land redistribution and legal titling improve livelihoods in some contexts but not others? In analyzing property rights, the authors emphasize the complementarity of insights from a diversity of disciplinary perspectives, including Austrian economics, public choice, and institutional economics, including the Bloomington School of institutional analysis and political economy. The concept of agency, although central to many sociological debates, has remained frustratingly elusive to pin down. This article is an attempt to open up what has been called the "black box" of personal agency by distinguishing clearly between two contrasting conceptions of the phenomenon. These two conceptions are very apparent in the manner in which the concept is defined in sociological reference works, resembling as it does a similar contrast in the treatment of the concept of power. The two (...) are referred to as type 1 and type 2 or the power of agency as compared with agentic power, the essential contrast being that the first refers to an actor's ability to initiate and maintain a program of action while the second refers to an actor's ability to act independently of the constraining power of social structure. The nature of these two forms of personal agency is then illustrated by referring to material taken from Weber's essay The Protestant Ethic and the Spirit of Capitalism, this essay itself being understood as an argument that focuses on the crucial role played by an increase in the power of agency in ushering in the modern world. Finally, it is argued that these two conceptions of agency possess no given logical relationship with each other, it being perfectly possible for individuals to be possessed of considerable power of agency while lacking agentic power, and vice versa. It is therefore concluded that it is important, in all discussions of human agency, to distinguish clearly between these two forms. (shrink)

In this paper, I describe grounds for dissatisfaction with certain aspects of the sciences of animal cognition and argue that a turn toward mathematical modeling of animal cognition is warranted. I consider some objections to this call and argue that the implications of such a turn are not as drastic for ordinary, commonsense understanding of animal minds as they might seem.

It is a truism among ethologists that one must not forget that animals perceive and represent the world differently from humans. Sometimes this caution is phrased in terms of von Uexküll’s Umwelt concept. Yet it seems possible (perhaps even unavoidable) to adopt a common ontological framework when comparing different species of mind. For some purposes it seems sufficient to ­anchor comparative cognition in common-sense categories; bats echolocate insects (or a subset of them) after all. But for other purposes it seems (...) necessary to find out more about how organisms organize their perceptions into biologically significant and perhaps cognitively meaningful states. Complex animals have high bandwidth sensory channels that feed into large nerve networks with very complex dynamics. Even for relatively simple animals belonging to species believed to have a small, fixed number of neurons, the odds are very much against any two animals of the same species, let alone different species, having exactly the same couplings to the environment, the same dimensionality in their nervous systems, or the same dynamics. Given such diversity (which von Uexküll himself recognized), how should we think about shared representation, shared meaning, and cognitive similarity between individuals and species? (shrink)
