The Role and Nature of Freedom in Two Normative Theories of Democracy The article examines the role and the nature of freedom in two normative concepts of democracy, in the work of Hans Kelsen and of Emanuel Rádl. Both authors wrote their work on democracy between the two world wars. Kelsen formulated his concept of democracy in On the Substance and Value of Democracy (1920), a book which has clearly been influenced by the political thinking of Kant and (...) Rousseau. Kelsen shares Rousseau's idea of general will and on this basis the principle of majority. Rádl outlines his theory of freedom and democracy in The War between the Czechs and the Germans (1928), Nationality as a Scientific Problem (1929) and On German Revolution (1933). Rádl distinguishes between three types of freedom and democracy: natural, majority and contractual. Rádl asserts that only in the third type of freedom, in which freedom is connected with responsibility and the law is freedom true. He considers the first type of freedom to be anarchical freedom, which can easily be misused. The second type of freedom is better than the first, but worse than the third. The author compares these concepts of freedom and democracy then and today and shows how they are linked to the questions of justice and solidarity at national and cosmopolitan levels. (shrink)

The issue of the crisis of democracy has been debated abundantly and intensively in recent years. The body of academic literature on the topic has gradually increased. However, a similar debate took place almost one-hundred years ago in the Central European region. At that time, the debate was closely intertwined with the geopolitical situation, especially with the rise of fascism and Nazism. The paper conceptualizes the intellectual discussion on the reasons of the democratic crisis in the 1930s in Czechoslovakia from (...) a sociological and philosophical perspective. The opinions of important Czech intellectuals, such as František Modráček, Emanuel Rádl, Karel Čapek, Edvard Beneš, František Žilka, F.X. Šalda, T.G. Masaryk, J.B. Kozák, and J.L. Fischer, are clarified. Furthermore, some main features of the nature of the past and present crises of democracy are compared. (shrink)

The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...) treaty draft reflects these ethical considerations by including a section entitled Guiding Principles and Approaches. Most of these principles are ethical—they establish core values that undergird the treaty. Unfortunately, the treaty draft's set of principles are numerous, overlapping, and show inadequate coherence and consistency. We propose two improvements to this section of the draft pandemic treaty. First, key guiding ethical principles should be clearer and more precise than they currently are. Second, the link between ethical principles and policy implementation should be clearly established and define boundaries on acceptable interpretation, ensuring that signatories abide by these principles. Coronavirus disease 2019 can lead to respiratory failure. Some patients require extracorporeal membrane oxygenation support. During the current pandemic, health care resources in some cities have been overwhelmed, and doctors have faced complex decisions about resource allocation. We present a case in which a pediatric hospital caring for both children and adults seeks to establish guidelines for the use of extracorporeal membrane oxygenation if there are not enough resources to treat every patient. Countermeasures for mpox (formerly known as monkeypox), primarily vaccines, have been in limited supply in many countries during outbreaks. Equitable allocation of scarce resources during public health emergencies is a complex challenge. Identifying the objectives and core values for the allocation of mpox countermeasures, using those values to provide guidance for priority groups and prioritisation tiers, and optimising allocation implementation are important. The fundamental values for the allocation of mpox countermeasures are: preventing death and illness; reducing the association between death (...) or illness and unjust disparities; prioritising those who prevent harm or mitigate disparities; recognising contributions to combating an outbreak; and treating similar individuals similarly. Ethically and equitably marshalling available countermeasures requires articulating these fundamental objectives, identifying priority tiers, and recognising trade-offs between prioritising the people at the highest risk of infection and the people at the highest risk of harm if infected. These five values can provide guidance on preferable priority categories for a more ethically sound response and suggest methods for optimising allocation of countermeasures for mpox and other diseases for which countermeasures are in short supply. Properly marshalling available countermeasures will be crucial for future effective and equitable national responses to outbreaks. (shrink)

Foundation models such as GPT-4 are fine-tuned to avoid unsafe or otherwise problematic behavior, such as helping to commit crimes or producing racist text. One approach to fine-tuning, called reinforcement learning from human feedback, learns from humans' expressed preferences over multiple outputs. Another approach is constitutional AI, in which the input from humans is a list of high-level principles. But how do we deal with potentially diverging input from humans? How can we aggregate the input into consistent data about "collective" (...) preferences or otherwise use it to make collective choices about model behavior? In this paper, we argue that the field of social choice is well positioned to address these questions, and we discuss ways forward for this agenda, drawing on discussions in a recent workshop on Social Choice for AI Ethics and Safety held in Berkeley, CA, USA in December 2023. In our study, we examine the association between hedge fund activism and a target firm’s corporate social responsibility (CSR) activities and whether activists can promote socially responsible investments while upholding shareholders’ interests. Using different matched samples, we find a strong positive association between the target firm’s CSR in the year before it is targeted by activists and its probability of being targeted by a hedge fund. Classifying hedge fund activists into socially and non-socially responsible funds based on their objectives, we (...) find that both give similar level of consideration to a firm’s CSR activities when initiating campaigns. Similar to DesJardine and Durand (DesJardine and Durand, Strategic Management Journal 41:1054–1082, 2020), we demonstrate that hedge funds have, on average, a negative impact on target firms’ CSR in the years following the initial investments. Complementary to DesJardine and Durand (DesJardine and Durand, Strategic Management Journal 41:1054–1082, 2020), we compare the two types of hedge funds and find an asymmetric effect of the hedge funds’ campaigns. Socially responsible hedge fund campaigns are associated with a large _increase_ in their target’s CSR, whereas non-socially responsible hedge funds _decrease_ this measure in their target. Finally, we find that target firms exhibit a long-term improvement in future stock returns and profitability. These findings provide evidence that certain types of activists, such as socially responsible funds, promote both _stakeholder_ and _shareholders’_ long-term interests. (shrink)

Defeasible argumentation has been applied successfully in several real-world domains in which it is necessary to handle incomplete and contradictory information. In recent years, there have been interesting attempts to carry out argumentation processes supported by massive repositories developing argumentative reasoning applications. One of such efforts builds arguments by retrieving information from relational databases using the DBI-DeLP framework; this article presents eDBI-DeLP, which extends the original DBI-DeLP framework by providing two novel aspects which refine the interaction between DeLP programs and (...) relational databases. First, we expand the expressiveness of dbi-delp programs by providing ways of controlling how the information in databases is recovered; this is done by introducing filters that enable an improved fine-grained control on the argumentation processes which become useful in applications, providing the semantics and the implementation of such filters. Second, we introduce an argument comparison criterion which can be adjusted at the level of literals to model particular features such as credibility and topic expertise, among others. These new tools can be particularly useful in environments such as medical diagnosis expert systems, decision support systems, or recommender systems based on argumentation, where datasets are often provided in the form of relational databases. Sostendremos, por tanto, una visión alternativa de la agencia moral. To understand the endogenous components of the event-related brain potential (ERP), we must use data about the components' antecedent conditions to form hypotheses about the information-processing function of the underlying brain activity. These hypotheses, in turn, generate testable predictions about the consequences of the component. We review the application of this approach to the analysis of the P300 component. The amplitude of the P300 is controlled multiplicatively by the subjective probability and the task relevance of the eliciting events, whereas its (...) latency depends on the duration of stimulus evaluation. These and other factors suggest that the P300 is a manifestation of activity occurring whenever one's model of the environment must be revised. Tests of three predictions based on this “context updating” model are reviewed. All investigators funded by the National Institutes of Health are now required to receive training about the ethics of clinical research. Based on a course taught by the editors at NIH, Ethical and Regulatory Aspects of Clinical Research is the first book designed to help investigators meet this new requirement. The book begins with the history of human subjects research and guidelines instituted since World War II. It then covers various stages and components of the clinical trial process: designing the (...) trial, recruiting participants, ensuring informed consent, studying special populations, and conducting international research. Concluding chapters address conflicts of interest, scientific misconduct, and challenges to the IRB system. The appendix provides sample informed consent forms. This book will be used in undergraduate courses on research ethics and in schools of medicine and public health by students who are or will be carrying out clinical research. In the past few years, machine learning (ML) tools have been implemented with success in the medical context. However, several practitioners have raised concerns about the lack of transparency—at the algorithmic level—of many of these tools; and solutions from the field of explainable AI (XAI) have been seen as a way to open the ‘black box’ and make the tools more trustworthy. Recently, Alex London has argued that in the medical context we do not need machine learning tools to be (...) interpretable at the algorithmic level to make them trustworthy, as long as they meet some strict empirical desiderata. In this paper, we analyse and develop London’s position. In particular, we make two claims. First, we claim that London’s solution to the problem of trust can potentially address another problem, which is how to evaluate the reliability of ML tools in medicine for regulatory purposes. Second, we claim that to deal with this problem, we need to develop London’s views by shifting the focus from the opacity of algorithmic details to the opacity of the way in which ML tools are trained and built. We claim that to regulate AI tools and evaluate their reliability, agencies need an explanation of how ML tools have been built, which requires documenting and justifying the technical choices that practitioners have made in designing such tools. This is because different algorithmic designs may lead to different outcomes, and to the realization of different purposes. However, given that technical choices underlying algorithmic design are shaped by value-laden considerations, opening the black box of the design process means also making transparent and motivating (technical and ethical) values and preferences behind such choices. Using tools from philosophy of technology and philosophy of science, we elaborate a framework showing how an explanation of the training processes of ML tools in medicine should look like. (shrink)

The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

In several recent papers and a monograph, Andreas Stokke argues that questions can be misleading, but that they cannot be lies. The aim of this paper is to show that ordinary speakers disagree. We show that ordinary speakers judge certain kinds of insincere questions to be lies, namely questions carrying a believed-false presupposition the speaker intends to convey. These judgements are robust and remain so when the participants are given the possibility of classifying the utterances as misleading or as deceiving. (...) The judgements contrast with judgements participants give about cases of misleading or deceptive behaviour, and they pattern with judgements participants make about declarative lies. Finally, the possibility of lying with non-declaratives is not confined to questions: ordinary speakers also judge utterances of imperative, exclamative and optative sentences carrying believed-false presuppositions to be lies. In arguing against a supposed ambiguity, philosophers often rely on the zeugma test. In an application of the zeugma test, a supposedly ambiguous expression is placed in a sentence in which several of its supposed meanings are forced together. If the resulting sentence sounds zeugmatic, that is taken as evidence for ambiguity; if it does not sound zeugmatic, that is taken as evidence against ambiguity. The aim of this article is to show that arguments based on the second direction of (...) the test are misguided: ambiguous expressions, and in particular philosophically contested ones, do not reliably lead to zeugmaticity, so an absence of zeugmaticity provides no meaningful evidence for an absence of ambiguity. Pictures are notably absent from the current debate about how to define lying. Theorists in this debate tend to focus on linguistic means of communication and do not consider the possibility of lying with photographs, drawings and other kinds of pictures. The aim of this paper is to show that such a narrow focus is misguided: there is a strong case to be made for the possibility of lying with pictures and this possibility allows for insights concerning the question of (...) how lying should be defined. The article begins with an effort to clarify and differentiate a variety of terms used by analysts in dealing with mentions of persons in conversation and other forms of talk-in-interaction — such terms as person-reference, identifying, describing, categorizing, and the like. This effort leads to the observation that `reference to persons' and `membership categorization' are quite distinct sets of practices, with most reference to persons not being done by membership categories, and most uses of membership categorization devices being in the (...) service of actions other than referring. Two interactional sequences whose analysis turns on a connection to talk earlier in the occasion are then examined; first, to establish what is going on interactionally without respect to the mentioning of persons, and then as exercises in examining the various ways person-reference and membership categorization can figure in a stretch of interaction. Članek obravnava pravno teorijo, ki je prisotna v končnem delu Vebrovega spisa Etika. Prvi poizkus eksaktne logike nagonske pameti. Veber se le mimogrede ukvarja s teorijo prava, vendar njegov prispevek ni zanemarljiv. Vebrova Etika je logika nagonske pameti: Veber, gledano iz čistega predmetnoteoretičnega vidika, ne sestavlja zbirke moralnih zapovedi, ampak namerava orisati najsplošnejša formalna načela, ki določajo pravilnost nagonskega doživetja. Tega, kaj mora posameznik narediti v danem trenutku, logika nagonske pameti ne more povedati, ker je le formalna veda. »Most« med (...) formalnim in materialnim pristopom nravnemu problemu Veber najde v glasu vesti, ki svetuje posamezniku, kaj naj naredi v konkretnem delovanju. V soglasju s tem mora biti državno pravo osnovano na načelih nagonske logike, ker bi bilo drugače brez vsake veljavnosti. Pravo velja, v kolikor je utemeljeno na logiki, ki orisuje imanentna načela človeške narave; cilj prava je pospeševanje čim bolj pravilnega življenja posameznikov in družbe. Z druge strani vsebina tega prava ni enkrat za vselej določena in napisana, ampak vsakič izhaja iz hermenevtike, ki jo posamezniki in družba morajo izvršiti o sebi in o svoji naravi. Etika »zdravega razuma« in »povprečnega človeka« je po Vebru najboljši model za materialno izpopolnenje formalne nagonske logike. (shrink)

ABSTRACT Copredication, as exhibited by sentences such as ‘That book is heavy but informative,’ is commonly seen as a phenomenon that is tied to sentences featuring polysemous expressions. David Liebesman and Ofra Magidor have recently attacked this view by arguing that ‘book’ has a single context-sensitive sense. The first aim of the present paper is to show that Liebesman and Magidor are wrong to claim that ‘book’ is univocal, but that they may nonetheless be right to question that copredication requires (...) polysemy. Its second aim is to consider implications of this result for the debates on copredication and on semantic variability. (shrink)

The notion of biological function is fraught with difficulties—intrinsically and irremediably so, we argue. The physiological practice of functional ascription originates from a time when organisms were thought to be designed and remained largely unchanged since. In a secularized worldview, this creates a paradox which accounts of functions as selected effect attempt to resolve. This attempt, we argue, misses its target in physiology and it brings problems of its own. Instead, we propose that a better solution to the conundrum of (...) biological functions is to abandon the notion altogether, a prospect not only less daunting than it appears, but arguably the natural continuation of the naturalisation of biology. In the past few years, the ethical ramifications of AI technologies have been at the center of intense debates. Considerable attention has been devoted to understanding how a morally responsible practice of data science can be promoted and which values have to shape it. In this context, ethics and moral responsibility have been mainly conceptualized as compliance to widely shared principles. However, several scholars have highlighted the limitations of such a principled approach. Drawing from microethics and the virtue theory tradition, (...) in this paper, we formulate a different approach to ethics in data science which is based on a different conception of “being ethical” and, ultimately, of what it means to promote a morally responsible data science. First, we develop the idea that, rather than only compliance, ethical decision-making consists in using certain moral abilities, which are cultivated by practicing and exercising them in the data science process. An aspect of virtue development that we discuss here is moral attention, which is the ability of data scientists to identify the ethical relevance of their own technical decisions in data science activities. Next, by elaborating on the capability approach, we define a technical act as ethically relevant when it impacts one or more of the basic human capabilities of data subjects. Therefore, rather than “applying ethics”, data scientists should cultivate ethics as a form of reflection on how technical choices and ethical impacts shape one another. Finally, we show how this microethical framework concretely works, by dissecting the ethical dimension of the technical procedures involved in data understanding and preparation of electronic health records. A groundbreaking classic of contemporary philosophy for the first time in English translation Between 1961 and 1970, Emanuele Severino was subjected to a thorough investigation by the Vatican Inquisition. The “fundamental incompatibility” identified between his thought and Christian doctrine ejected him from his position as Professor of Philosophy at the Catholic University in Milan. The Essence of Nihilism, published in 1972, was the first book to follow his expulsion, and it established Severino’s preeminent position within the the constellation of contemporary (...) philosophy. In this groundbreaking and classic book—now for the first time available in English—Severino reinterprets the history of Western philosophy as the unfolding of “the greatest folly,” that is, of the belief that “things come out of nothing and fall back into nothing.” According to Severino, such a typically Western understanding of reality has resulted in a conviction that there is a radical “nothingness” to existence. In turn, this justifies the treatment of the world as an object of exploitation, degradation and destruction. To move beyond Western nihilism, suggests Severino, we must first of all “return to Parmenides.” Joining forces with the most venerable of Greek philosophers, Severino confutes nihilism’s “path of night”, and develops a new philosophy grounded on the principle of the eternity of reality and of every single existent thing.
