Artificial intelligence systems advising healthcare professionals will be widely introduced into healthcare settings within the next 5–10 years. This paper considers how this will sit with tort/negligence based legal approaches to compensation for medical error. It argues that the introduction of AI systems will provide an additional argument pointing towards no-fault compensation as the better legal solution to compensation for medical error in modern health care systems. The paper falls into four parts. The first part rehearses the main arguments for (...) and against no-fault compensation. The second explains why it is likely that AI systems will be widely introduced. The third part analyses why it is difficult to fit AI systems into fault-based compensation systems while the final part suggests how no-fault compensation could provide a possible solution to such challenges. The Conservative government made appraisal compulsory to monitor teaching more effectively. Unable to elicit the type of data required, the process became marginalised. Labour is now turning to appraisal to raise standards. Though appearing more conciliatory, it is argued that the end result will be to achieve the Conservatives' original aim of controlling teachers.

Historically the emergence of a precise technical meaning for probability, as distinct from its vague popular useage, has taken time; and confusion still arises from the concept of probability having different meanings in different flelds of discourse. The thesis of this article is that an attitude akin to pragmatism is internal to the scientific enterprise itself, and as a result many scientists will make the same types of non-essentialistic interpretations of their subject matter that are made by pragmatists. This is demonstrably true with respect to those scientists who study the biological basis of emotion such as Panksepp, LeDoux, and Damasio. Even though these scientists are also influenced by what cognitive psychologists call the essentialist bias, their research (...) programs are coherent with Peter Zachar?s rejection of natural kinds in favor of practical kinds. When the confrontation with complexity leads a scientist to offer non-essentialist interpretations, two popular options are to go eliminativist or go nominalist. Currently, there is no consensus guideline as to the type or degree of donor steatosis considered acceptable for liver transplantation, and little is known about local practices in this area. The aim of this survey (...) was to evaluate current clinical practices amongst liver transplant surgeons in Australia and New Zealand in the evaluation and use of steatotic donor livers in LT.Methods: An anonymous online twelve-question survey was emailed to all practicing LT surgeons in ANZ in January 2010.Results: The response rate was 83%. Estimated prevalence of steatosis in donor livers was between 40% and 60%. In determining suitability for LT, 90% of respondents reported rejecting organs with "severe" steatosis based on visual and palpation grounds alone. A total of 68% sought further histological assessment if the donor liver looked bad and there were risk factors for steatosis. The majority of respondents performed only one biopsy of the liver, using hematoxylin and eosin staining for fat assessment. There was wide variation in the upper limit of steatosis considered to be acceptable for LT. A total of 21% of respondents still considered microvesicular steatosis a risk factor for primary graft nonfunction.Conclusion: This survey highlights the significant variation in the appraisal and use of steatotic grafts by LT surgeons in ANZ. Accurate evaluation and judicious use of mild and moderately steatotic grafts is required if we are to utilize the available donor pool best.Keywords: liver transplantation, steatosis, fatty liver, organ donors. Hundreds of evaluative studies of psychotherapy still leave the issue of its effectiveness unsettled. The author argues that such studies have ignored the major determinant of therapeutic effectiveness, the role of a patient’s belief in the successful outcome in therapy. Psychiatrist Thomas Szasz, one of the foremost critics of psychiatry, wrote of this paper: "It is one of the best, if not the best, that I have read on this subject.” It makes little sense to claim that a certain therapy (...) is effective or ineffective in itself; rather, there is a relation of mutual interaction among three terms: a patient’s ability to learn in a psychological context, a therapist’s ability to teach, and the capacity of an approach to therapy to engender in the patient the necessary belief in its effectiveness. -/- The paper is followed by a 4-page 2014 Afterword. Perhaps it is unfortunate that, no matter what problems a psychological investigator elects to attempt to discuss, he is almost always confronted by a number of different and often conflicting points of view. The twisting paths revealed by these may one day be found to unite into a broad road, but most of them have as yet been insufficiently explored. Certainly problems in the psychology of temporal perception seem to lie in many different directions, according to the ways in which (...) they are approached. It would be possible, for instance, to take the mass of experimental work, always patient, sometimes brilliant, which has had a fairly continuous history since Czermak, in 1857, building upon Weber's researches into space perception, planned and began to carry out a programme for an investigation of the estimation of short time intervals. Michael Burroughs and Deborah Tollefsen (2016) claim that children are subject to widespread testimonial injustice. They argue that empirical data shows that children are prejudicially accorded less epistemic credibility in forensic contexts, and that this in turn shows that the same is true in broader contexts. While I agree that there is indeed testimonial injustice against children, I argue that Burroughs and Tollefsen exaggerate its severity and extent, by exaggerating children’s testimonial reliability. Firstly, the empirical data do not quite support (...) their claim about children’s performance in forensic contexts. Secondly, while they advocate a relational conception of children’s agency which emphasizes the role of adults in realizing their testimonial abilities, Burroughs and Tollefsen miss the full implications of such a conception for our evaluation of children’s credibility, and for our behavior towards them in testimonial contexts. Thirdly, they underestimate the significance of children’s limited general knowledge. (shrink)

Philosophers have not resisted temptation to transgress against the logic of their own conceptual structures. Self-undermining position-taking is an occupational hazard. Philosophy stands in need of conceptual therapy. The author describes three conceptions of philosophy: the narcissistic, disputatious, and therapeutic. (i) Narcissistic philosophy is hermetic, believing itself to contain all evidence that can possibly be relevant to it. Philosophy undertaken in this spirit has led to defensive, monadically isolated positions. (ii) Disputatious philosophies are fundamentally question-begging, animated by assumptions that philosophical (...) adversaries reject. (iii) The intention of therapeutic philosophy is to study philosophical positions from the standpoint of their internal consistency, or lack of it. In particular, its interest is in positions that either compel assent, because they cannot be rejected without self-referential inconsistency, or self-destruct because self-referential inconsistency cannot be avoided. The article's focus is on the latter. Several examples of self-undermining positions are drawn from the history of philosophy, exemplifying two main varieties of self-referential inconsistency: pragmatical and projective. (shrink)

Several recent authors have argued that children are subject to testimonial injustice in the same way as are women, Blacks, and several other social identity groups. Testimonial injustice is standardly conceptualized, following Miranda Fricker’s seminal account, as a wrongful credibility deficit. I argue that this concept of testimonial injustice is too narrow to capture testimonial injustice against children. There is good reason to think that children are less reliable testifiers than adults, so it is not necessarily wrong to assign a (...) credibility deficit to a child speaker, in the way it is wrong in the case of a female or black speaker. However, I argue that children are nevertheless subjected to testimonial injustice. Testimonial injustice against children is constituted primarily by a failure to actively inquire into assertions by children — that is, by a failure to patiently and reflectively engage in discourse with the child to discover what they may know. This paper marks a juncture between the author’s studies in phenomenology and the transition he made to a study of what he has called a “metalogic of reference.” Published in 1974 in Polish translation, followed by its publication in English in 1975, “Phenomenology of the Implicit” describes the author’s “translation schema” that permits certain of the central goals of Husserlian transcendental philosophy to be transposed to a framework that studies the preconditions of valid reference. The result of this translation was (...) the development of the author’s “de-projective” approach to phenomenology, which he later dissociated from phenomenology in the form of a pure metalogic of reference. -/- The paper examines the phenomenological understanding of pre‐reflective awareness, of reflection, and of their interrelation. To this end, attention is paid to preconditions of reference that are entailed by the phenomenological distinction between implicit experience and explicit reflection. (shrink)

The psychological-ideological roots of philosophy. -/- ●●●●● 2022 UPDATE: The approach of this paper has been updated and developed further in Chapters 1 and 2 of the author’s 2021 book _Critique of Impure Reason: Horizons of Possibility and Meaning_. We contend that Noë and Thompson's arguments leave both the minimal substrate thesis and the (considerably stronger) matching-content doctrine unscathed. We construe their arguments as each having the form of a modus tollens as follows: (1) If the matching-content doctrine is true, then Q; (2) It is not the case that Q; therefore, (3) The matching-content doctrine is false. We show that in each case, Noë and Thompson fail to cite any Q such that both premises are true.

A new position in the philosophy of mind has recently appeared: the extended mind hypothesis (EMH). Some of its proponents think the EMH, which says that a subject's mental states can extend into the local environment, shows that internalism is false. I argue that this is wrong. The EMH does not refute internalism; in fact, it necessarily does not do so. The popular assumption that the EMH spells trouble for internalists is premised on a bad characterization of the internalist thesis—albeit (...) one that most internalists have adhered to. I show that internalism is entirely compatible with the EMH. This view should prompt us to reconsider the characterization of internalism, and in conclusion I make some brief remarks about how that project might proceed. (shrink)

Very plausibly, nothing can be a genuine computing system unless it meets an input-sensitivity requirement. Otherwise all sorts of objects, such as rocks or pails of water, can count as performing computations, even such as might suffice for mentality—thus threatening computationalism about the mind with panpsychism. Maudlin in J Philos 86:407–432, ( 1989 ) and Bishop ( 2002a , b ) have argued, however, that such a requirement creates difficulties for computationalism about conscious experience, putting it in conflict with the (...) very intuitive thesis that conscious experience supervenes on physical activity. Klein in Synthese 165:141–153, ( 2008 ) proposes a way for computationalists about experience to avoid panpsychism while still respecting the supervenience of experience on activity. At these levels a modern movie from China orNigeria will display swiftly recognizable sensibilities and situations to any viewer in Europe or the USA, and vice versa. But should (...) we not, therefore, also feel prompted to indicate a universal de-symbolization, if movies along with the modern world reflect constitutive elements of decomposition and collapse. For I would like to suggest in this essay that not only do movies constitute a kind ofplanetary envelope, literally a "film" of collective imaginai references wrapped around the world, but that this "film" is peculiarly apt to dismemberment, to breaking up before our eyes even as it still holds together, to abuilt-in "crisis" that is part ofits very nature. The two films that form a background to these remarks, Natural Born Killers and Pulp Fiction, are, I suggest, movies that set out actively to represent this cinematic crisis. In Adam Smith's The Wealth ofNations (Bk. 2, Vol. 5, 795-97), the grandfather ofmodern capitalism discusses the fate ofthe laborer who leaves arural village in which he is known and his life observed, or "attended to," by others. He moves to a great city where promptly "he is sunk in obscurity and darkness." Smith's concern is not directly to remedy this misery ofthe worker forced to seek employment in the anonymity ofthe city, but to avoid a possible course ofaction he might take. He wishes to divert him from the possibility of joining "a small religious sect," in whose company the newly depersonalized worker will achieve "a degree of consideration which he never had before." 2 Tony Bartlett Adam Smith does not relish the prospect ofthe mushroom growth ofclosed, "unsocial" religious factions within the heart of industrialized political economies, and he proposes two remedies by which the state, "without violence," might correct these tendencies. His proposals are remarkable both for their conjunction ofcertain themes and their prescience. The first is a plan for the imposition of the study of science and philosophy on the middle ranks ofthe poor, for science is "the great antidote to the poison of enthusiasm and superstition." Next to this classic Enlightenment nostrum comes the following: The second ofthose remedies is the frequency and gaiety of publick diversions. The state, by encouraging, that is by giving entire liberty to all those who for their own interest would attempt, without scandal or indecency, to amuse and divert the people by painting, poetry, musick, dancing; by all sorts ofdramatic representations and exhibitions, would easily dissipate, in the greater part of them, that melancholy and gloomy humour which is almost always the nurse ofpopular superstition and enthusiasm. Publick diversions have always been the object of dread and hatred, to all the fanatical promoters ofthose popular frenzies. Here are the movies before the fact. Adam Smith in his charter for emergent industrial capitalism sketches an alliance between education and entertainment that together will prevent any reversion to the darkness ofsmallscale society and its ready excrescence of religious fanaticism. All of the components of cinema aesthetic are assembled in Smith's prophetic vision: cinematography, script, score, choreography, plot, spectacle. The only thing lacking was the technology to capture them together on film, and with the release ofinventive energies attending division oflabor that would only be a matter of time. Cinema is the born ally ofrational modernity, and is in itself the child of industrial alienation and the need to find a mass aesthetic to substitute for the control exercised by the sacred in a traditionally local setting. But, ofcourse, there are several levels ofirony that are not lost on us here. First, Smith says explicitly that the state has a direct interest in such mass entertainment. What then is the relationship between the much prized freedom ofthe creative artist and the very concrete concern for self-preservation on the part ofthe state? Despite increased attention to the question of how best to evaluate clinical ethics consultations and emphasis on external evaluation, there has been little sustained focus on how we, as clinicians, make sense of and learn from our own experiences in the midst of any one consultation. Questions of how we evaluate the request for, unfolding of, and conclusion of any specific ethics consultation are often overlooked, along with the underlying question of whether it is possible to give an accurate account (...) of clinical ethics consultants’ experience as experienced by ethics consultants. Before the challenge of submitting one’s accounts or case reports for review and evaluation from others, there is an underlying challenge of understanding and evaluating our own accounts. To highlight this crucial and deeply challenging dimension of actual clinical ethics practice, we present an account of a complex consultation, explicitly constructed to engage the reader in the unfolding experience of the consultant by emphasizing the multiple perspectives unfolding within the consultant’s experience. Written in script format, the three perspectives presented—prototypical clinically descriptive account; didactically reflective and self-evidentiary account often seen in journal presentations; highly self-critical reflective account emphasizing uncertainties inherent to clinical ethics practice—reflect different manners for responding to the ways actual clinical involvement in ethics consultation practice accentuates and refocuses the question of how to understand and evaluate our own work, as well as that of our colleagues. Desire is always imitation ofanother desire, desire for the same object, and, therefore, an inexhaustible source of conflicts and rivalries" {Double Business Bound 39). The notation that desire is (...) an "inexhaustible" source of conflicts hints at the political pessimism expressed more openly elsewhere in Girard's writing. In 1961, he said it like this: "Whatever political or social system is somehow imposed on them, men will never achieve the peace and happiness of which the revolutionaries dream, nor the bleating harmony which so scares the reactionaries. They will always get on togetherjust enough to enable them never to agree" (Deceit 110-11). This is a Girard who, suspicious of political rhetoric, speaks with audacious cynicism even of democracy: "Who is there left to imitate after the tyrant? Henceforth men shall copy each other... Democracy is one vast middle-class court where the courtiers are everywhere and the king is nowhere" (Deceit 119). This Girard has remained consistent in his thematization of the impurity of all political compromises: "men are only capable ofreconciling their differences at the expense of a third party. The best men can hope for in their quest for nonviolence is the unanimity-minus-one ofthe surrogate victim" (Violence 259). Girard's political skepticism seems to be a result of his conviction that arbitrary victims ofviolent unanimity are the "ingredient" in political thought that allows each community to be flattered by the illusion of its political innocence, the illusion of the justifiability of its violence. 48Andrew Bartlett Modem political thought cannot dispense with morals, but it cannot become purely moral without ceasing to be political. Another ingredient must therefore be mixed with morals. If we really tried to identify what this is we would inevitably end up with formulas like Caiaphas': "It is better that this man or those die so that the community may survive" (Scapegoat 116). Political institutions, in establishing power relations between dominant and subordinate people, always exercise force, violence (Beetham 47-48). A perfectly moral politics seems as impossible as a perfectly nonviolent politics. Girard's refusal to plant his feet in the wet cement of any single political party's rhetoric is the outcome, in part, of his preference for a religious perspective on human affairs. The religious is his fundamental category ofanalysis; and religion in Girard's view is not an unenlightened form of belief to be superseded by political wisdom, but rather the fundamental mode of human social organization, the political only a secular displacement of it. I hasten to add that Girard's pessimism about political arrangements arises not from any stoical indifference to their victims, but rather from his respect for victims—a respect that is finally religious in character. A related sub-clause of Girard's political pessimism is the incompatibility ofmimetic theory and "identity politics," broadly defined so as to include nationalist or ethnic politics based on historical grievances and desires for vengeance. I have in mind here Girard's idea that the distinct identity of the surrogate victim is not strictly relevant to the effects of collective violence. Violence belongs to all men, and thus to none in particular. It is futile to look for the secret ofthe redemptive process in distinctions between the surrogate victim and other members of the community. The crucial fact is that the choice ofthe victim is arbitrary (Violence 257). The stabilizing effects of political scapegoating thus depend on the degree of unanimity in the community's violence, not on the identity ofthe victim. The identity of the sacrificial victim is not essential in scapegoating; the essential in scapegoating is the unanimity ofthe collective violence itself (cf. Violence 84, 150). Perhaps because of this priority of violent unanimity over victim identity, Girard has measured his distance from specific political causes (Scapegoat 19-20). This book presents translations of three dialogues Xenophon devoted to the life and thought of his teacher, Socrates. Each is accompanied by notes and an interpretative essay that will introduce new readers to Xenophon and foster further reflection in those familiar with his writing. "Apology of Socrates to the Jury" shows how Socrates conducted himself when he was tried on the capital charge of not believing in the city's gods and corrupting the young. Although Socrates did not secure his own (...) acquittal, he profoundly impressed some listeners who then helped to shape the public perception of philosophy as a noble, if highly idiosyncratic, way of life. In "Oeconomicus," Xenophon relates the conversation Socrates had on the day he turned from the study of natural philosophy to that of moral and political matters. "Oeconomicus" is concerned most directly with the character and purpose of Socrates' political philosophy. Xenophon provides entertaining portraits of Socrates' circle of friends in the "Symposium." In the process, he conveys the source of every individual's pride in himself, thus defining for each a conception of human excellence or virtue. The _Nicomachean Ethics_ is one of Aristotle’s most widely read and influential works. Ideas central to ethics—that happiness is the end of human endeavor, that moral virtue is formed through action and habituation, and that good action requires prudence—found their most powerful proponent in the person medieval scholars simply called “the Philosopher.” Drawing on their intimate knowledge of Aristotle’s thought, Robert C. Bartlett and Susan D. Collins have produced here an English-language translation of the _Ethics_ that is as remarkably (...) faithful to the original as it is graceful in its rendering. This article begins by wondering how the writer’s transformation into motherhood affects her practice of reading, writing and research: how maternities are made academic. Specifically, this article is interested in thinking through lactating breasts, as a particularly complex and potentially subversive ‘performance’ of maternity. In addition, this article reframes ‘maternal thinking’ through 1990s theories of embodiment and corporeality, and asks how embodied practices like breastfeeding might be theorized, as well as how ‘embodied theory’ might be practised. In looking at various (...) cultural texts about breasts and breastfeeding, the article is scripted into a series of connective and reflexive scenes around performance, space, language and knowledge, coming to rest in the imaginative project of an epistemology of breasts. It sets reflexive accounts of lived experience alongside theoretical reflections to create a dynamic and thoughtful reading of breasts, entwining personal and public discourses, maternal and academic writing, theorizing and cultural practices. Normality Does Not Equal Mental Health: The Need to Look Elsewhere for Standards of Good Mental Health is the first book to question the equation of psychological normality and mental health. It is also the first book to take contemporary psychiatry and clinical psychology to task for deeply flawed thinking when they accept the diagnostic system propounded by the DSM, which reifies syndromes into alleged “mental disorders.” Where Thomas Szasz argued that “mental disorders” are myths, Bartlett makes the much (...) more damaging charge that reifying mental disorders involves a provable form of fallacious thinking, producing a variety of epistemological nonsense. /// -/- -/- The author weighs the evidence, and with strict logic, compelling evidence, and careful analysis, challenges the current paradigm of mental health theorists and practitioners. The Inverted Earth case has seen fierce debate between Ned Block, who says it defeats the causal-covariational brand of wide representationalism about qualia, and Michael Tye and Bill Lycan, who say it does not. The debate has generated more heat than light because of a failure to get clear on who is supposed to be proving what, and what premises can be deployed in doing so. I argue that a correct understanding of the case makes it clear that the causal (...) covariation theory is in deeper trouble over Inverted Earth than is generally supposed even by the theory's detractors.
