The case states that a male same-sex couple entered into a surrogacy arrangement with an unrelated surrogate using donor sperm and the surrogate’s eggs. M is the legal mother pursuant to s33 of the Human Fertilisation and Embryology Act 2008. Though the facts tell us that there was no legally binding arrangement, this is in fact the position of the law: under s1A Surrogacy Arrangements Act, no surrogacy arrangements can ever be binding on the parties. It is not clear whether (...) the donor sperm is from one of the same-sex couple or not. If it was donor sperm and not from either intended father, this is not an arrangement that would be recognised in law, as one of the men must be genetically related to the child in order for them to obtain legal parenthood via a parental order, under s54 HFEA 2008. They could apply to adopt the child, although they may fall foul of adoption legislation1 if any money has moved between them and M and they do not fall within an exemption.2 In any event, an adoption cannot be achieved in time for them to obtain legal parenthood in a crisis situation. In this paper, I argue that the relationship between belief and credence is a central question in epistemology. This is because the belief-credence relationship has significant implications for a number of current epistemological issues. I focus on five controversies: permissivism, disagreement, pragmatic encroachment, doxastic voluntarism, and the relationship between doxastic attitudes and prudential rationality. I argue that each debate is constrained in particular ways, depending on whether the relevant attitude is belief or credence. This means that epistemologists should pay attention (...) to whether they are framing questions in terms of belief or in terms of credence and the success or failure of a reductionist project in the belief-credence realm has significant implications for epistemology generally. Argument is a pervasive feature of human interaction, and in its natural contexts of occurrence, it is organized around the management of disagreement. Since disagreement can occur around any kind of speech act whatsoever, not all arguments involve a claim supported by reasons; many involve standpoints attributed to someone but claimed by no one. And although truth and validity are often at issue in naturally occurring arguments, these do not exhaust the standards to which arguers are held. Arguers hold one (...) another accountable for cooperating in the management of disagreement, infusing argumentation with a natural normativity that exists apart from any theorized appraisal standard applied to the claim-reason relationship. This research article was championed as a way of providing discourses pertaining to the concept of "Critical Realism (CR)" approach, which is amongst many othe forms of competing postmodern philosophical concepts for the engagement of dialogical discourses in the area of established econonetric methodologies for effective policy prescription in the economic science discipline. On the the whole, there is no doubt surrounding the value of empirical endeavours in econometrics to address real world economic problems, but equally so, the heavy weighted (...) use and reliance on mathematical contents as a way of justifying its scientific base seemed to be loosing traction of the intended focus of economics when it comes to confronting real world problems in the domain of social interaction. In this vein, the construction of mixed methods discourse(s), which favour that of CR philosophy is hereby suggested in this article as a way forward in confronting with issues raised by critics of mainstream economics and other professionals in the postmodern era. While many current analyses of democracy focus on creating a more civil, respectful debate among competing political viewpoints, this study argues that the existence of structural social inequality requires us to go beyond the realm of political debate. Challenging prominent contemporary theories of democracy, the author draws on John Dewey to bring the work of combating social inequality into the forefront of democratic thought. Dewey's 'pragmatic' principles are deployed to present democracy as a developing concept constantly confronting unique conditions obstructing (...) its growth. Under structurally unequal social conditions, democracy is thereby seen as demanding the overcoming of this inequality; this inequality corrupts even well-organized forums of political debate, and prevents individuals from governing their everyday lives. Dewey's approach shows that the process of fighting social inequality is uniquely democratic, and he avoids current democratic theory's tendency to abstract from this inequality. (shrink)

ABSTRACT To what extent is honesty or truthfulness morally obligatory in trade and advertising practices? It is argued here what while we have a general right, in business as elsewhere, not to be lied to, we have no general right, either in our business or other pursuits, not to be deliberately deceived. Certain restrictions on deceptive practices in trade and advertising, even unintentionally deceptive practices, are, even so, morally defensible: viz. where the practice would mislead reasonable people to a material (...) degree or where it would mislead especially vulnerable people who are predictably unreasonable. It is suggested that a code of practice for trade and advertising which exaggerates the degree of truthfulness which is morally obligatory may actually be corrupting in effect. (shrink)

Some necessary truths are a posteriori. That’s widely agreed and is presumed here. Their existence might appear to show that discoveries about how things are in fact—about how things actually are—can lead to discoveries about all the ways things might be, about the nature of logical space. I detail one way of resisting this conclusion for a number of examples, and the implications of Twin Earth for the issue. Central is the notion of a Cambridge discovery.

In the light of current events, particularly the ‘post September 11th’ debates with much focus on aspects of the ‘clash of civilisation’ thesis, the issue of Islamic identity is a crucial one. Whilst Friedrich Nietzsche was addressing an audience of a different culture and age, his own originality, creativity, psychological, philological and historical insights allows for a fresh and enlightening understanding of Islam within the context of our modern era. In this book, Roy Jackson sets out to determine: Why (...) did Nietzsche feel inclined to be so generous towards the Islamic tradition yet so critical of Western Christianity? How important was religion for Nietzsche’s views on such matters as moral and political philosophy and how does this help us to understand the Islamic response to modernity? How does Nietzsche’s distinctive outlook and methodology help us to understand such key Islamic paradigms as the Qur’an, the Prophet, and the ‘Rightly-Guided’ Caliphs? Nietzsche and Islam provides an original and fresh insight into Nietzsche’s views on religion and shows that his philosophy can make an important contribution to what is considered to be Islam’s key paradigms. Abu Hamid al Ghazali, one of the most famous intellectuals in the history of Islam, developed a definition of Unbelief (kufr) to serve as the basis for determining who, in theological terms, should be considered a Muslim and who should not. Jackson's annotated translation is preceded by an introduction that reconstructs the historical and theoretical context of the Faysal and discusses its relevance for contemporary thought and practice.

In Pastoral and Monumental, Donald C. Jackson chronicles America's longtime fascination with dams as represented on picture postcards from the late nineteenth to the mid-twentieth century. Through over four hundred images, Jackson documents the remarkable transformation of dams and their significance to the environment and culture of America. Initially, dams were portrayed in pastoral settings on postcards that might jokingly proclaim them as “a dam pretty place.” But scenes of flood damage, dam collapses, and other disasters also captured (...) people's attention. Later, images of New Deal projects, such as the Hoover Dam, Grand Coulee Dam, and Norris Dam, symbolized America's rise from the Great Depression through monumental public works and technological innovation. Jackson relates the practical applications of dams, describing their use in irrigation, navigation, flood control, hydroelectric power, milling, mining, and manufacturing. He chronicles changing construction techniques, from small timber mill dams to those more massive and more critical to a society dependent on instant access to electricity and potable water. Concurrent to the evolution of dam technology, Jackson recounts the rise of a postcard culture that was fueled by advances in printing, photography, lowered postal rates, and America's fascination with visual imagery. In 1910, almost one billion postcards were mailed through the U.S. Postal Service, and for a period of over fifty years, postcards featuring dams were “all the rage.” Whether displaying the charms of an old mill, the aftermath of a devastating flood, or the construction of a colossal gravity dam, these postcards were a testament to how people perceived dams as structures of both beauty and technological power. We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. In this paper, the authors present a presuppositional account for a class of evaluative terms that encode both a descriptive and an evaluative component: slurs and thick terms. The authors discuss several issues related to the hybrid nature of these terms, such as their projective behavior, the ways in which one may reject their evaluative content, and the ways in which evaluative content is entailed or implicated (as the case may be) by the use of such terms.

Abstract In the last fifteen years philosophers and linguists have turned their attention to slurs: derogatory expressions that target certain groups on the basis of race, gender, sexual orientation, nationality and so on. This interest is due to the fact that, on the one hand, slurs possess puzzling linguistic properties; on the other hand, the questions they pose are related to other crucial issues, such as the descriptivism/expressivism divide, the semantics/pragmatics divide and, generally speaking, the theory of meaning. Despite these (...) recent investigations about pejoratives, there is no widely accepted explanation of slurs:in my paper I consider the intuitions we have about slurs and I assess the difficulties that the main theories encounter in explaining how these terms work in order to identify the phenomena that a satisfactory account of slurs needs to explain. Then, I focus on the pragmatic theories that deal with the notions of conventional implicature and pragmatic presupposition: I assess the objections that have been raised and I propose two ways of defending the presuppositional account, taking into consideration the notion of cancellability. I will claim that the reason why most pragmatic strategies seem to fail to account for slurs is that they assume a rigid divide between conventional implicatures and presuppositions that should not be taken for granted. Reconsidering the relationship between these two notions gives a hint about how a pragmatic account of slurs should look like. Finally, I assess the problem of which presupposition slurs in fact trigger. (shrink)

In Slurs and Thick Terms, Bianca Cepollaro explores the ways in which certain pieces of evaluative language, such as slurs and so-called thick terms, not only reflect speakers’ moral perspectives, but also contribute to promote the speaker’s evaluative stance.

Counterspeech is communication that tries to counteract potential harm brought about by other speech. Theoretical interest in counterspeech partly derives from a libertarian ideal – as captured in the claim that the solution to bad speech is more speech – and partly from a recognition that well-meaning attempts to counteract harm through speech can easily misfire or backfire. Here we survey recent work on the question of what makes counterspeech effective at remedying or preventing harm, in those cases where it (...) is effective, as well as work investigating when and why there is a duty to engage in counterspeech. We suggest that the most fruitful area for philosophical inquiry on this topic, currently, relates to the questions about efficacy. Specifically, we argue that there is a need for better frameworks for conceptualizing the efficacy of counterspeech. Philosophers have collaborative work to do, alongside social scientists, in developing these frameworks. (shrink)

ABSTRACTFor Rorty, any attempt to articulate a theory of truth as such is of no interest. This implies that although it may be meaningful to differentiate the truths from the falsehoods, it is pointless to say what the property of goodness is in the things we believe are good to do. Rorty points out that our no longer understanding Philosophy – with the capital ‘P’–as the framing of normative notions would make room for a post-philosophical culture where the philosophers’ activity (...) would be closer to the practices of cultural critique with the self-imposed limitation of devoting themselves exclusively to advancing descriptions of how things relate to each other. This article aims to explore what would happen if this provocation were brought to the field of Pedagogy. Taking on this Rortyan theme, keeping hope on the potentially liberating and transformative power of education implies a hopeful attitude by which individuals involved in education processes express their love for the world as a commitment to a better future, as well as their belief in its possibilities. It is no secret that various versions of logical empiricism argued for the importance of unified science. Carnap was a proponent of unity of science views, although he expressed this in different idioms at different times. In the Aufbau (1928) he spoke of the unity of the object domain secured through definability in the constitutional system, in his physicalist period he argued that a physicalist language could serve as the universal language of science, and in his mature philosophical work he (...) investigated a variety of meanings that might be attached to reductionist projects for unifying various scientific fields. Our essay focuses less on Carnap’s several proposals than on a prior interpretive question: what was philosophically at stake for Carnap in the question of the unity of science? We begin with some suggestions in Carnap’s 1963 Intellectual Autobiography, where he calls unity of science “one of the main tenets of our general philosophical conception” and one in which Neurath’s emphasis on the “interdependence of all decisions … made a strong impression” on him. We follow Carnap in the suggestion that an account of his approach to unity of science does not take us into questions of unity of nature but rather of the scientific attitude and the unity of reason. Similar to directional asymmetries in animals, language lateralization in humans follows a bimodal distribution. A majority of individuals are lateralized to the left and a minority of individuals are lateralized to the right side of the brain. However, a biological advantage for either lateralization is lacking. The scenario outlined by Vallortigara & Rogers (V&R) suggests that language lateralization in humans is not specific to language or human speciation but simply follows an evolutionarily conserved organizational principle of the brain.

ABSTRACTThe article investigates which epistemological considerations justify how religious life fits into the school life, and examines the debate on the participation of religiosity in the education system. I do this, first, by addressing the pedagogical implications of the distinction between public and private as maintained by Richard Rorty and, second, by reconsidering the pluralist metaphysics held by William James as an alternative path to understanding and re-addressing the question of religious life in school life. The article analyzes how the (...) strict separation of projects of individual self-creation and the public sphere, as defended by Rorty, poses problems in implementing pluralism in democratic societies and their educational institutions. Archetypal theory studies roles characters play through fundamental and inherited symbols. These symbols are thematic associations that are common to humanity in general. Feminist theory analyzes (...) texts based on how power is manipulated to establish the dominance or subordination of either gender. In particular, feminist theory studies how females claim, assert or subvert power for themselves. Coupled together, the theories seek to understand how established conventions influence the female experience. By analyzing the intersection between the roles portrayed by the women in the Salinas Valley and societal expectations, this paper intends to explore the influence of tradition on decision making. I explore how rational belief and rational credence relate to evidence. I begin by looking at three cases where rational belief and credence seem to respond differently to evidence: cases of naked statistical evidence, lotteries, and hedged assertions. I consider an explanation for these cases, namely, that one ought not form beliefs on the basis of statistical evidence alone, and raise worries for this view. Then, I suggest another view that explains how belief and credence relate to evidence. My view (...) focuses on the possibilities that the evidence makes salient. I argue that this makes better sense of the difference between rational credence and rational belief than other accounts. (shrink)

In this article, Bianca Thoilliez draws on pragmatist notions of fallibilism and pluralism to develop proposals for possible educational interventions to address the problem of “post-truth” conditions. Post-truth, she contends, is not only a political danger for liberal democracies, but it also poses a serious threat of extinction for our educational practices. With the help of some of Bruno Latour's and Danna Haraway's categories, and with the narrative intervention of Gerald Durrell's My Family and Other Animals, Thoilliez attempts to (...) adapt both Charles Peirce's and William James's classic pragmatist ideas in order to experiment with new horizons of thought capable of overcoming the exhausted pedagogical divides of docility/indocility, conserve/discard, and optimism/pessimism that often seem woven into the definition of educational relationships, the establishment of curriculum content, and the orientation of pedagogical actions. As an alternative, she recommends building communitarian alliances of fallibilistic inquiry and promoting practices of pluralistic cultural provision as more useful educational ends-in-view that embody a down-to-earth pedagogy capable of reinstating trust, taking care of truths, looking for ways of keeping our lives together, and making education possible again. Thus, here Thoilliez proposes a pedagogy that neither fixes nor evades our troubles, but one that stays with them. (shrink)

Reclamation is usually taken to be the phenomenon wherein in-groups employ a slur to express pride, foster camaraderie, or subvert discriminatory structures. We provide data showing that, under some special circumstances, out-groups successfully reclaim slurs too. Thus, the mainstream restriction to in-groups is merely an approximation of the correct extension of the phenomenon – of who does actually reclaim slurs. Removing any such stipulative restriction opens a path towards further theorizing into the nature of reclamation.

Frank Jackson champions the cause of conceptual analysis as central to philosophical inquiry. In recent years conceptual analysis has been undervalued and widely misunderstood, suggests Jackson. He argues that such analysis is mistakenly clouded in mystery, preventing a whole range of important questions from being productively addressed. He anchors his argument in discussions of specific philosophical issues, starting with the metaphysical doctrine of physicalism and moving on, via free will, meaning, personal identity, motion, and change, to ethics and (...) the philosophy of color.
