Este texto construye una versión de la teoría de Hegel acerca de la sanción penal, principalmente a partir de su Fundamentos de la Filosofía del Derecho, como una teoría agnóstica da la pena. El texto demuestra como la contradicción interna presentada por Hegel en cuanto el filósofo intenta resolver los problemas acerca de la punición no son resueltas, pero, por el contrario, como esas contradicciones necesariamente se integran a todo posible concepto o imposición de la sanción criminal.

Patriotism is not commonly associated with freedom. Even less so when Hegel is evoked. By reading Hegel’s concept of patriotism through the lens of revolutionary France, I present a notion of patriotism that is tied to the realization of freedom. This paper demonstrates what happens when Hegel’s philosophy of law is re-read through the political philosophy of the French Revolution itself. Hegel’s Philosophy of Right and its lectures are marked by tensions. The legacy it leaves traces it leaves behind can (...) be re-appropriated to explore the inconclusive hints left by the philosopher. The idea of patriotism is one of them, simply defined as an intersubjective link between the concrete individual and the state or as particular and general interests coinciding. This paper expands this analysis by introducing two elements: Hegel’s discussion on the character of the law and how it comes to be law; and the revolutionary phenomenon itself. The revolutionaries’ views on patriotism and its functions within a revolutionary moment can help us transform the mere traces left by Hegel into a wider vision that incorporates and promotes freedom. The enhanced mathematical indispensability argument, proposed by Alan Baker (2005), argues that we must commit to mathematical entities, because mathematical entities play an indispensable explanatory role in our best scientific theories. This article clarifies the doctrines that support this argument, namely, the doctrines of naturalism and confirmational holism.

I argue against pessimistic readings of the Buddhist tradition on which unawakened beings invariably have lives not worth living due to a preponderance of suffering (duḥkha) over well-being.

The desire to minimize the number of individual new entities postulated is often referred to as quantitative parsimony. Its influence on the default hypotheses formulated by scientists seems undeniable. I argue that there is a wide class of cases for which the preference for quantitatively parsimonious hypotheses is demonstrably rational. The justification, in a nutshell, is that such hypotheses have greater explanatory power than less parsimonious alternatives. My analysis is restricted to a class of cases I shall refer to as (...) additive. Such cases involve the postulation of a collection of qualitatively identical individual objects which collectively explain some particular observed phenomenon. Maximize Expected Choiceworthiness (MEC) is a theory of decision-making under moral uncertainty. It says that we ought to handle moral uncertainty in the way that Expected Value Theory (EVT) handles descriptive uncertainty. MEC inherits from EVT the problem of fanaticism. Roughly, a decision theory is fanatical when it requires our decision-making to be dominated by low-probability, high-payoff options. Proponents of MEC have offered two main lines of response. The first is that MEC should simply import whatever are the best solutions (...) to fanaticism on offer in decision theory. The second is to propose statistical normalization as a novel solution on behalf of MEC. This paper argues that the first response is open to serious doubt and that the second response fails. As a result, MEC appears significantly less plausible when compared to competing accounts of decision-making under moral uncertainty, which are not fanatical. (shrink)

In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own. After that, we consider a number of objections to our account and evaluate a substantially different approach to the same problem. (shrink)

When discussing Logical Pluralism several critics argue that such an open-minded position is untenable. The key to this conclusion is that, given a number of widely accepted assumptions, the pluralist view collapses into Logical Monism. In this paper we show that the arguments usually employed to arrive at this conclusion do not work. The main reason for this is the existence of certain substructural logics which have the same set of valid inferences as Classical Logic—although they are, in a clear (...) sense, non-identical to it. We argue that this phenomenon can be generalized, given the existence of logics which coincide with Classical Logic regarding a number of metainferential levels—although they are, again, clearly different systems. We claim this highlights the need to arrive at a more refined version of the Collapse Argument, which we discuss at the end of the paper. (shrink)

Many authors have considered that the notions of paraconsistency and dialetheism are intrinsically connected, in many cases, to the extent of confusing both phenomena. However, paraconsistency is a formal feature of some logics that consists in invalidating the rule of explosion, whereas dialetheism is a semantical/ontological position consisting in accepting true contradictions. In this paper, we argue against this connection and show that it is perfectly possible to adopt a paraconsistent logic and reject dialetheism, and, moreover, that there are examples (...) of non-paraconsistent logics that can be interpreted in a dialetheic way. Deliberation often begins with the question ‘What do I want to do?’ rather than the question of what one ought to do. This paper takes that question at face value, as a question about which of one’s desires is strongest, which sometimes guides action. The paper aims to explain which properties of a desire make that desire strong, in the sense of ‘strength’ relevant to this deliberative question. Both motivational force and phenomenological intensity seem relevant to a desire’s strength; however, (...) accounting for the strength of a desire in these terms opens up significant indeterminacy about what we want. The paper argues that this indeterminacy is often resolved simply by posing the question ‘What do I want to do?’ to oneself: there is reason to believe that one’s answer will play a verdictive role, partially determining what the agent most wants. Self-reflective beliefs can play a self-fulfilling role, and surprisingly this seems to follow from basic platitudes about the belief-desire model. (shrink)

In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. This book debates competing approaches to ethical decision-making for members of the armed forces of liberal-democratic states. In this volume, four prominent thinkers propose and debate competing approaches to ethical decision-making for military personnel. Deane-Peter Baker presents and expounds the 'Ethical Triangulation' model, an ethical decision-making method he has employed through much of his career as an applied military ethicist. Rufus Black advocates for a natural law-based approach, one which has heavily influenced the framework formally adopted by the Australian (...) Defence Force. Roger Herbert outlines the 'Moral Deliberation Roadmap', the moral reasoning framework recently adopted by the US Naval Academy. Iain King then sets out a model of quasi-utilitarian decision-making developed in several post-conflict settings and refined at the UK's Royal College of Defence Studies. After the opening chapters in which each author outlines their favoured decision-making approach, the four contributors then evaluate each other's proposals, often critically. Philosopher David Whetham offers some concluding thoughts in which he summarises areas of agreement between the authors, identifies key areas of difference, and suggests directions for future research. Bioethics and human rights were conceived in the aftermath of the Holocaust, when moral outrage reenergized the outmoded concepts of and renaming them and to give them new purpose. Originally, the principles of bioethics were a means for protecting human rights, but through a historical accident, bioethical principles came to be considered as fundamental. In this paper I reflect on the parallel development and accidental divorce of bioethics and human rights to urge their reconciliation.

This paper examines relationships between accountants’ personal values and their moral reasoning. In particular, we hypothesize that there is an inverse relationship between accountants’ “Conformity” values and principled moral reasoning. This investigation is important because the literature suggests that conformity with rule-based standards may be one reason for professional accountants’ relatively lower scores on measures of moral reasoning (Abdolmohammadi et al. J Bus Ethics 16 (1997) 1717). We administered the Rokeach Values Survey (RVS) (Rokeach: 1973, The Nature of Human Values (...) (The Free Press, New York)) and the Defining Issues Test (DIT) (Rest: 1979, Development in Judgment Moral Issues (University of Minnesota Press, Minneapolis, MN)) to164 graduating accounting students enrolled in capstone courses at two universities in the Northeastern United States. As potential entrants into the accounting profession, these subjects bring their values and moral reasoning to bear on attitudes and behaviors in the workplace. We find a highly significant inverse relationship between “Conformity” values and principled moral reasoning (i.e., those who prefer Conformity values have lower levels of moral reasoning). However, we also find that accounting students as a group do not prefer Conformity values above other values such as Self-actualization and Idealism, and we find positive relationships between Self-actualization and Idealism values and moral reasoning. Transhumanism proposes human enhancement while regarding the human body as unfit for the future. This fulfills age-old aspirations for a perfect and durable body. We use “alienation” as a concept to analyze this mismatch between human aspirations and our current condition. For Hannah Arendt alienation may be accounted for in terms of earth- and world-alienation, as well as alienation from human nature, and especially from the given (“resentment of the given”). In transhumanism, the biological body is an impediment to human (...) accomplishment. At most, this movement accepts “clean” bodies, not bodies with excretions. We argue that real human bodies are valued in the event of giving birth, so a modified concept that Arendt proposed, natality, seems a suitable way to explore the dialectic alienation-reconciliation involving the body (Arendt’s “A child has been born unto us”), when re-read by some feminist scholars. My aim is twofold: first, to root out the metaphysical assumptions that generate the problem of mental causation and to show that they preclude its solution; second, to dissolve the problem of mental causation by motivating rejection of one of the metaphysical assumptions that give rise to it. There are three features of this metaphysical background picture that are important for our purposes. The first concerns the nature of reality: all reality depends on physical reality, where physical reality consists of (...) a network of events.1 The second concerns the nature of causation, and the third concerns the conception of behavior. Adding a transparent truth predicate to a language completely governed by classical logic is not possible. The trouble, as is well-known, comes from paradoxes such as the Liar and Curry. Recently, Cobreros, Egré, Ripley and van Rooij have put forward an approach based on a non-transitive notion of consequence which is suitable to deal with semantic paradoxes while having a transparent truth predicate together with classical logic. Nevertheless, there are some interesting issues concerning the set of metainferences validated by this (...) logic. In this paper, we show that this logic, once it is adequately understood, is weaker than classical logic. Moreover, the logic is in a way similar to the paraconsistent logic LP. (shrink)

In some recent articles, Cobreros, Egré, Ripley, & van Rooij have defended the idea that abandoning transitivity may lead to a solution to the trouble caused by semantic paradoxes. For that purpose, they develop the Strict-Tolerant approach, which leads them to entertain a nontransitive theory of truth, where the structural rule of Cut is not generally valid. However, that Cut fails in general in the target theory of truth does not mean that there are not certain safe instances of Cut (...) involving semantic notions. In this article we intend to meet the challenge of answering how to regain all the safe instances of Cut, in the language of the theory, making essential use of a unary recovery operator. To fulfill this goal, we will work within the so-called Goodship Project, which suggests that in order to have nontrivial naïve theories it is sufficient to formulate the corresponding self-referential sentences with suitable biconditionals. Nevertheless, a secondary aim of this article is to propose a novel way to carry this project out, showing that the biconditionals in question can be totally classical. In the context of this article, these biconditionals will be essentially used in expressing the self-referential sentences and, thus, as a collateral result of our work we will prove that none of the recoveries expected of the target theory can be nontrivially achieved if self-reference is expressed through identities. It is widely accepted that a theory of truth for arithmetic should be consistent, but -consistency is a highly desirable feature for such theories. The point has already been made for first-order languages, though the evidence is not entirely conclusive. We show that in the second-order case the consequence of adopting -inconsistent theories of truth are considered: the revision theory of nearly stable truth T # and the classical theory of symmetric truth FS. Briefly, we present some conceptual problems with (...) ω-inconsistent theories, and demonstrate some technical results that support our criticisms of such theories. (shrink)

Transhumanist thought on overpopulation usually invokes the welfare of present human beings and the control over future generation, thus minimizing the need and meaning of new births. Here we devise a framework for a more thorough screening of the relevant literature, to have a better appreciation of the issue of natality. We follow the lead of Hannah Arendt and Brent Waters in this respect. With three overlapping categories of words, headed by “natality,” “birth,” and “intergenerations,” a large sample of books (...) on transhumanism is scrutinized, showing the lack of sustained reflection on the issue. After this preliminary scrutiny, a possible defense of natality in face of modern and transhumanist thought is marshaled, evoking a number of desirable human traits. One specific issue, the impact of modern values on natality, is further explored, reiterating that concerns about overpopulation and enhanced humans should keep in sight the natural cycle of birth and death. The question of nihilism is always a question of truth. It is a crisis of truth that causes the experience of the nothingness of existence. What elevated truth to this existential position? The answer is: philosophy. The philosophical will to truth opens the door to nihilism, since it both makes identifying truth the utmost aim and yet continually calls it into question. Baker develops the central insight that the crises of truth and of existence, or 'loss of world', that (...) occur within nihilistic thought are inseparable, in a wide-ranging study from antiquity to the present, from ancient Cynics, St Paul, Nietzsche, Heidegger, Foucault, Agamben, and Badiou. Baker contends that since nihilism is always a question of the relation to the world occasioned by the philosophical will to truth, an answer to nihilism must be able to propose a new understanding of truth. Anabaptists have long been thought to have been ‘biblicists’ and shunned reading patristic literature. But a close analysis of the debates Anabaptists had with Magisterial Reformers shows that the Anabaptists developed an extensive history of baptism using church fathers. They attempted to show that adult baptism was the norm in the earliest centuries of the church and that infant baptism was the innovation away from the Bible. This debate was about who had inherited the biblical faith around baptism.

El artículo busca dilucidar algunas características del epistolario en tanto que fuente historiográfica y encontrar claves de comparación con la autobiografía. Con importantes aspectos en común, sus propósitos, sus sesgos y la posición subjetiva de sus autores evidencian importantes diferencias. A partir de esta problemática, se analizará la correspondencia sostenida por Max Weber desde el servicio militar durante la Gran Guerra. En un período en el que no tiene intervención pública alguna, el análisis se centra en la evolución de su (...) perspectiva sobre el papel de Alemania y sobre su actividad específica en los lazaretos. In this paper, we present a non-trivial and expressively complete paraconsistent naïve theory of truth, as a step in the route towards semantic closure. We achieve this goal by expressing self-reference with a weak procedure, that uses equivalences between expressions of the language, as opposed to a strong procedure, that uses identities. Finally, we make some remarks regarding the sense in which the theory of truth discussed has a property closely related to functional completeness, and we present a sound and (...) complete three-sided sequent calculus for this expressively rich theory. Rejecting the Cut rule has been proposed as a strategy to avoid both the usual semantic paradoxes and the so-called v-Curry paradox. In this paper we consider if a Cut-free theory is capable of accurately representing its own notion of validity. We claim that the standard rules governing the validity predicate are too weak for this purpose and we show that although it is possible to strengthen these rules, the most obvious way of doing so brings with it a serious (...) problem: an internalized version of Cut can be proved for a Curry-like sentence. We also evaluate a number of possible ways of escaping this difficulty. (shrink)

The logics of formal inconsistency are logics tolerant to some amount of contradiction, but in which some versions of explosion still hold. The main result of this paper is a reconstruction of two such logics in the dialogical framework. By doing so, we achieve two things. On the one hand, we provide a formal approach to argumentative situations where some contradictions may occur while keeping the idea that there may still be situations in which some propositions are ‘safe’ in the (...) sense of immunity to the contradictions. On the other hand, we open a new line of study on these logics, in the context of the game-theoretical approach to semantics born in the 1960s, with various interesting perspectives, some of which are discussed at the end of this article.
