This study examines cheating behaviors among 422 business students at two public Association to Advance Collegiate Schools of Business-accredited business schools. Specifically, we examined the simultaneous influence of attitudinal characteristics and motivational factors on reported prior cheating behavior, the tendency to neutralize cheating behaviors, and likelihood of future cheating. In addition, we examined the impact of in-class deterrents on neutralization of cheating behaviors and the likelihood of future cheating. We also directly tested potential mediating effects of neutralization on cheating behavior. (...) Using structural equations modeling procedures, we conducted an assessment of the validity of a modified version of the K. J. Smith, Davy, Rosenberg, and Haight model of cheating behavior and its antecedents. The modified model included motivation as a potential predictor of cheating behavior. Results supported the differentiation of the theoretical constructs within the specified process model. Furthermore, tests of the aforementioned theoretical model indicated a significant positive relation between extrinsic motivation and prior cheating and a significant negative relation between both intrinsic motivation and academic performance, and prior cheating. Finally, prior cheating had a significant positive relation, whereas deterrents had a significant negative relation to likelihood of future cheating. (shrink)

Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. Next SectionObjectives To evaluate the adequacy of paediatric informed consent and its augmentation by a supplemental computer-based module in paediatric endoscopy. Methods The Consent-20 instrument was developed and piloted on 47 subjects. Subsequently, parents of 101 children undergoing first-time, diagnostic upper endoscopy performed under moderate IV sedation were prospectively and consecutively, blinded, randomised and enrolled into two groups that received either standard form-based informed consent or standard form-based informed consent plus a commercial (Emmi Solutions, Inc, Chicago, Il), sixth grade level, (...) interactive learning module (electronic assisted consent). Anonymously and electronically, the subjects' anxiety (State Trait Anxiety Inventory), satisfaction (Modified Group Health Association of America), number of questions asked, and attainment of informed consent were assessed (Consent-20). Statistics were calculated using t test, paired t test, and Mann Whitney tests. Results The ability to achieve informed consent, as measured by the new instrument, was 10% in the control form-based consent group and 33% in the electronic assisted consent group (p<0.0001). Electronically assisting form-based informed consent did not alter secondary outcome measures of subject satisfaction, anxiety or number of questions asked in a paediatric endoscopy unit. Conclusions This study demonstrates the limitations of form-based informed consent methods for paediatric endoscopy. It also shows that even when necessary information was repeated electronically in a comprehensive and standardised video, informed consent as measured by our instrument was incompletely achieved. The supplemental information did, however, significantly improve understanding in a manner that did not negatively impact workflow, subject anxiety or subject satisfaction. Answering the call of the Second Vatican Council for moral theology to 'draw more fully on the teaching of Holy Scripture, ' the authors examine the virtues that both flow from Scripture and provide a lens by which to interpret Scripture.

The influence of physician judgment on the disclosure, competency, understanding, voluntariness, and decision aspects of informed consent for bone marrow transplantation are described. Ethical conflicts which arise from the amount and complexity of the information to be disclosed and from the barriers of limited time, patient anxiety and lack of prior relationship between patient and physician are discussed. The role of the referring physician in the decision-making is considered. Special ethical issues which arise with use of healthy related bone marrow (...) donors are discussed, as is the physician's discretion in raising questions of competency. It is concluded that in this setting, regardless of the theoretical goals of the physician, patients appear to utilize informed consent discussions to assess their capacity to trust the physician rather than as a time to weigh the large amount of relevant data. The conscientious physician best serves the patient with recommendation of the best medical alternative rather than with attempts to remain neutral. (shrink)

In utopian/science fiction literature, comprehensive knowledge is a familiar motif that also inspires recent policies to screen society through surveillance. In the late 20th century, a digital archive promised to facilitate quick access to abundant information and effective strategies to confront myriad challenges. Yet, today, the scale and scope of information accumulation in national and corporate repositories is reaching proportions whose intelligent processing excedes human capabilities, and triggering a shift in focus from dumb repository to artificial intelligence. Processing such accumulation (...) of knowledge necessiates skills commonly attributed to divinity. Without a theory that recognizes this condition and informs the operations of artificial intelligence, the latter is likely to fail in human ways, e.g., by perceiving false patterns resulting from flawed theories assigning meaning to knowledge. For successful pattern recognition to occur, theories must rest on science fiction and a digital ontotheology of the machine as the form this archive assumes. (shrink)

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Experimental taxonomy was a diverse area of research, and botanists who helped develop it were motivated by a variety of concerns. While experimental taxonomy was never totally a taxonomic enterprise, improvement in classification was certainly one major motivation behind the research. Hall's and Clements' belief that experimental methods added more objectivity to classification was almost universally accepted by experimental taxonomists. Such methods did add a new dimension to taxonomy — a dimension that field and herbarium studies, however rigorous, could not (...) duplicate. Nonetheless, experimental techniques were never completely divorced from traditional taxonomic methods. In practice, all experimental taxonomists employed a combination of descriptive and experimental methods. Most researchers freely acknowledged a debt to traditional taxonomy. Furthermore, the greater rigor of twentieth-century taxonomy was not due entirely to experimentalism. Both the experimental and descriptive aspects of taxonomy were improved by the increased use of quantitative methods, particularly statistics.52From the beginning, a number of experimental taxonomists were interested primarily in classification. But many approached their research from fields other than taxonomy. These botanists were concerned primarily with ecological and genetic problems rather than with classification. There is little indication that they drew a sharp distinction: for example, taxonomic and cytogenetic conclusions were interwoven in Babcock and Stebbins' 1938 study of Crepis 53 (this was even more true of Babcock's final mongraph on the genus, published in 1947). Similarly, the extensive series of monographs, “Experimental Studies on the Nature of Species,” initiated by the Carnegie Institution group in 1940 combined ecological, cytogenetic, and taxonomic conclusions. Indeed, the significance of the major projects completed by experimental taxonomists was largely due to the fact that they were comprehensive studies rather than strictly taxonomic or cytogenetic.In a general sense, the primary motivation behind much of experimental taxonomy was evolutionary. Beginning in the second decade of the century Hall and Clements exhorted taxonomists to take an explicitly evolutionary perspective on research. Hall undoubtedly spoke for the majority of experimental taxonomists when he stated, “If there be anything at all to organic evolution, then taxonomy is dealing with the products of evolution and it is this that gives to taxonomy both its highest mission and its greatest responsibility.”54Aside from a common interest in evolution, however, the theoretical orientations of experimental taxonomists were varied. This diversity is strikingly illustrated by the evolutionary views of members of the Carnegie Institution research group. Experimental taxonomy was initiated by Clements as one aspect of his Lamarckian study of adaptation and speciation. In contrast, Hall's research was inspired by a broad concern for evolutionary problems. Hall rarely referred to specific evolutionary mechanisms; rather, he applied a general conception of evolutionary processes to deduce phylogenetic relationships. His later associates at the Carnegie Institution explicitly dissociated themselves from Clements' theoretical framework. The neo-Darwinian interpretations of adaptation and speciation presented by Clausen, Keck, and Hiesey could hardly have been more different than those of Clements. However, this major shift in theoretical orientation should not obscure significant similarities between the research of Clements and later Carnegie workers. In terms of research problems and methodology, the first volume of “Experimental Studies on the Nature of Species” was an extension of the Clementsian research program. Clausen, Keck, and Hiesey's monograph was the mature discussion of transplant experimentation that Clements had very tentatively initiated during the first decades of the twentieth century. The bond that linked the members of the Carnegie Institution research group to experimental taxonomists in general was one of shared methodology rather than common theoretical orientation. While Clements' evolutionary views were eventually repudiated, his enthusiasm for innovative experimental methods was shared by later workers.The development of experimental taxonomy faced significant problems. During the period 1920–1950 this area of botanical research remained a hybrid discipline. The aims and scope of experimental taxonomy were never articulated in a completely unified manner. Consequently, even among experimental taxonomists, there were disagreements over the relation of their research to other botanical endeavors. Even though experimental taxonomy had close ties with general taxonomy, a number of experimental taxonomists questioned the “taxonomic” nature of their research55. Even to the extent that this hybrid discipline could be identified as a branch of taxonomy, problems arose. Taxonomists, as we have seen, were justifiably skeptical of what appeared to be a rapid influx of untested methods and ideas. Experimental taxonomists were not merely incorporating well-accepted methods from ecology and cytogenetics; during the period 1920–1950 the fields from which experimental taxonomists borrowed were themselves undergoing major theoretical and methodological changes. Despite problems and conflicts, experimental taxonomists did contribute improvements to classification. Furthermore, they made significant contributions to plant ecology and evolutionary genetics.The development of experimental taxonomy indicates that twentieth-century botanists were not necessarily isolated in naturalist and experimentalist camps. The joint session of taxonomists, cytologists, and geneticists at the 1926 International Congress of Plant Sciences indicates communication among specialists fairly early in the century. The papers and commentaries presented during this session do not reveal the hostility and intolerance that supposedly characterized encounters between experimentalists and naturalists. Nor do they suggest incompatible conceptual worlds separating geneticists and taxonomists.Discussions between taxonomists and other specialists were not limited to a single international congress. Particularly during the 1930s discussions among specialists appear to have been fairly widespread. Groups such as the Biosystematists and the Society for the Study of Systematics in Relation to General Biology served as forums for discussion among biologists from a variety of disciplines. The naturalist-experimentalist dichotomy tends to obscure the broad research interests of a number of prominent twentieth-century botanists. Most of the experimental taxonomists cannot be characterized adequately as either naturalists or experimentalists. Traditionally trained taxonomists such as Hall, Keck, and Turrill throughout their careers participated in both experimental and herbarium research. And a number of specialists in fields other than taxonomy took an active interest in taxonomic problems, not necessarily limited to experimental aspects. For example, Anderson suggested a number of innovations to make herbarium collections more amenable to statistical analysis.This historical study of experimental taxonomy indicates a different relationship between experimentalism and taxonomy than that portrayed by the naturalist-versus-experimentalist dichotomy. F. E. Clements originated experimental taxonomy as a revolt against descriptive botany. In retrospect, this revolution was not vigorously waged and was not successfully completed. Experimental taxonomy was never an entirely experimental approach to botanical research. Even the most ardent advocates of experimentalism relied heavily on methods inherited from traditional taxonomy. Moderate exponents of experimental taxonomy stressed the compatibility of experimental methods, field observation, and herbarium techniques. Attempts to fuse cytogenetics, ecology, and taxonomy during the period 1920–1950 resulted in an impressive body of research. However, this fusion constituted neither a repudiation of descriptive botany nor a complete revision of taxonomic theory of practice. (shrink)

A number of results have been obtained concerning Borel structures starting with Silver and Friedman followed by Harrington, Shelah, Marker, and Louveau. Friedman also initiated the model theory of Borel (in fact totally Borel) structures. By this we mean the study of the class of Borel models of a given first-order theory. The subject was further investigated by Steinhorn. The present work is meant to go further in this direction. It is based on the assumption that the study of (...) the class of, say, countable models of a theory reduces to analyzing a single $\omega_1$-saturated model. The question then arises as to when such a model can be totally Borel. We present here a partial answer to this problem when the theory under investigation is superstable. (shrink)

This paper asks whether the criminal law can have any legitimate concern with obscene language. At most, such a concern could be justified by the need to protect auditors from offense, since it is not plausible to think of exposure to dirty words as harmful or inherently immoral. A distinction is drawn between bare utterance and instant offense, on the one hand, and offensive nuisance and harassment, on the other. Only when obscene language is used to harass can it properly (...) be made criminal. Finally, I criticize in some detail judicial reasoning in the case of F.C.C. v. As so often with his published texts, the experience of reading Nietzsche’s notebooks is at once mesmerising and infuriating. One is in the presence of a thinker who, on the one hand, meditates deeply on fundamental issues in philosophy and psychology but who, on the other, refuses to be pinned down. The fact that Nietzsche’s style is so elusive can account for the enormously disparate interpretations of his work and it is no surprise that his notebooks have been read in (...) the most extreme fashion. John McMillan's article raises numerous important points about the ethics of surgical castration of sex offenders.1 In this commentary, we focus solely on and argue against the claim that the offer of release from detention conditional upon surgical castration is a coercive offer that compromises the validity of the offender's consent. We take no view on the question as to whether castration for sex offenders is ethically permissible. But, we reject the claim that it is ethically permissible only if competing (...) ethical considerations outweigh worries about coercion. For in the situation described, the proposal is not coercive at all.McMillan states that if offenders agree to castration because they fear long-term detention, then ‘it seems, intuitively, as if agreeing to be castrated under these conditions makes the decision coerced in some way.’1 He adds that if castration is ‘the only way that they will be released back into the community, the status of this decision as a genuine expression of their autonomy is questionable.’1 In defence of his claim, he uses two analogies that he borrows from Joel Feinberg. First, if a governor offers to commute a death sentence if the prisoner agrees to participate in a medical experiment, then ‘it's clear that the governor is coercing the prisoner.’1 Second, if a millionaire offers to give a woman $1 000 000 …. Contemporary environmental political theory considers the implications of the environmental crisis for such political concepts as rights, citizenship, justice, democracy, the state, race, class, and gender. As the field has matured, scholars have begun to explore connections between Green Theory and such canonical political thinkers as Plato, Machiavelli, Locke, and Marx. American adults currently enjoy a widely accepted and legally well-settled right to refuse health care, including life sustaining treatment. Joel Feinberg provides a moral foundation for this right in liberal political theory. Feinberg's theory grounds the right to refuse in a broad right to self-determination, and it implements the right through a variable conception of voluntariness. This theory provides a plausible account that comports with the widely accepted right to refuse, commonsense, and ordinary practice. -/- Allen Buchanan and Dan (...) Brock contend, however, that Feinberg's priority for the right to self-determination is inconsistent with his variable scale of voluntariness. Although Feinberg presents his theory as one that grants categorical priority to self-determination over individual well-being, Buchanan and Brock argue that Feinberg's variable scale of voluntariness involves a balancing of self-determination and well-being. This balancing approach, which Buchanan and Brock endorse, seems to undermine the competent patient's right to refuse care because it allows concern for the patient's well-being to override that person's right to self-determination in some circumstances. Taken together, these arguments seem to suggest that we must give up either the competent patient's right to refuse treatment or the intuitively sensible variable scale. -/- In this paper, I argue that one can reconcile a categorical priority for self-determination with legal rules that incorporate a variable scale of competence. This integration requires careful examination of the practical and expressive functions of legal rules as well as of the manner in which these rules embody moral priorities. This analysis pursues specific and general projects. Specifically, it addresses the moral foundations of the legal right to refuse treatment, identifying a substantive difference between the balancing approach and the priority for self-determination that characterizes Feinberg's liberalism. Generally, it examines the types of priorities embodied by legal rules as practical decision guides and as expressions of the conventional morality represented by the law. This general project extends beyond the right to refuse treatment to the analysis of the manner in which legal rules express and apply moral priorities. (shrink)

Both books contribute to the Second Vatican Council’s call to perfect moral theology by deeply engaging with scripture ( Optatam totius, no. 16), and both demonstrate the richness of a virtue approach to scripture. Paul and Virtue Ethicsimproves on the previous work in two significant ways. First, the authors divide the book into four parts, allowing the reader to better follow and appreciate how it contributes to both fields. Second, while this book maintains a dialogue structure, it does so by alternating between chapters by Harrington on Pauline perspectives and chapters by Keenan on theological perspectives. Questions for discussion are omitted here; select bibliographies remain.Part 1 covers Pauline and theological perspectives on anthropology, conversion, and conscience, beginning with a solid introductory chapter: “Virtue Ethics and Fundamental Moral Theology.” The second chapter, “The Shape of Paul’s Virtue Ethics,” lays out what Harrington describes as Paul’s “modified apocalyptic dualism” (24). A chapter on conscience is an important reiteration of the fundamental role of experience and how “virtuous practices become the exercises for the formation of conscience” (71). Since Paul’s uncontested corpus focuses more on Jesus’s death and resurrection than the life of Jesus, this section could have been bolstered by explicitly stating the challenges this raises for both disciplines. The placement of Paul alongside Thomas Aquinas is refreshing, as is their embrace of Aquinas as a biblical theologian (though more stated than shown). In this section the book’s emergence from the classroom is most evident, making Harrington’s recent passing particularly poignant. His chapter on Paul’s appeal to experience is ripe for dialogue with Keenan’s engagement of Stephen Brown’s work on the role of assent in Thomas’s virtue of faith; the authors also choose to treat separately the Pauline virtue of love and Thomas’s virtue of charity. While the juxtapositions were thought provoking, I wish they engaged these choices in the text. The reality that classroom dialogue between them is no longer possible is a palatable loss.Part 3 moves to a more focused exploration of other virtues and vices in the Pauline corpus, as well as ethics done in a communal setting, and the importance of Eucharist in Christian life. The brief chapter on theological perspectives of humility was particularly insightful. The last section, “The Virtues and Social and Sexual Issues,” has two very compelling chapters on social ethics. Harrington speaks to the Pauline tendency to hold in tension the subversive focus on Christ alone as master and his imminent return, and the maintenance of social roles to preserve the fledgling community. Immediately following, Keenan reiterates the current Church’s call to be hospitable. In doing so, they have—perhaps intentionally—highlighted the tensions in the way Christian virtue ethics can challenge our communal understandings of scripture. Given that the Church is no longer a fledgling community but a massive institution, often more analogous to oppressive strands of first-century Judaism than the communities to which Paul was pastor, how do we understand this tension? Without clearly addressing it, they demonstrate their thesis that these fields call for fruitful dialogue.All projects have their limits, and this was an ambitious and successful one. While I was left hungry for more connections to Jesus’s ministry as portrayed in the gospels, I was energized by the scaffolding of important bridges that is evident in the work. There is growing philosophical interest in “affective injustice”: injustice faced by individuals specifically in their capacity as affective beings. Current debates tend to focus on affective injustice at the psychological level. In this paper, I argue that the built environment can be a vehicle for affective injustice — specifically, what Wildman et al. (2022) term “affective powerlessness”. I use resources from ecological psychology to develop this claim. I consider two cases where certain kinds of bodies are, either intentionally or unintentionally, (...) deprived of access to goods affording the development and maintenance of their subjective well-being: hostile architecture and masking practices in autism. This deprivation, I argue further, leads to a significant weakening and diminishment of their spatial agency, hinders their well-being, and in so doing gives rise to a pervasive experience of affective powerlessness. By drawing attention to these themes, I show that an ecological approach helpfully supplements existing approaches. It highlights how affective injustice can emerge via the way bodies are positioned in space, and the central role that built environments play in determining this positioning. (shrink)

Some recent developments in Artificial Intelligence—especially the use of machine learning systems, trained on big data sets and deployed in socially significant and ethically weighty contexts—have led to a number of calls for “transparency”. This paper explores the epistemological and ethical dimensions of that concept, as well as surveying and taxonomising the variety of ways in which it has been invoked in recent discussions. Whilst “outward” forms of transparency may be straightforwardly achieved, what I call “functional” transparency about the inner (...) workings of a system is, in many cases, much harder to attain. In those situations, I argue that contestability may be a possible, acceptable, and useful alternative so that even if we cannot understand how a system came up with a particular output, we at least have the means to challenge it.
