In response to the spread of COVID-19, governments across the world have, with very few exceptions, enacted sweeping restrictive lockdown policies that impede citizens’ freedom to move, work, and assemble. This paper critically responds to the central arguments for restrictive lockdown legislation. We build our critique on the following assumption: public policy that enjoys virtually unanimous support worldwide should be justified by uncontroversial moral principles. We argue that that the virtually unanimous support in favor of restrictive lockdowns is not adequately (...) justified by the arguments given in favor of them. Importantly, this is not to say that states ought not impose restrictive lockdown measures, but rather that the extent of the acceptance of these measures is not proportionate to the strength of the arguments for lockdowns. -/- We begin by exploring the case for restrictive lockdowns. We first argue that several of the principles that are used to justify the lockdowns yield unexpectedly revisionary implications for other political problems that many would be unwilling to accept. We then outline what we consider the strongest argument for a lockdown—namely, that its net welfare benefits are great enough to defeat the moral presumption against restricting citizens’ civil liberties to move, work, and assemble. However, we give a number of reasons for doubting that the lockdown’s net welfare benefits are, in fact, sufficiently high to defeat the presumption against it. (shrink)

Philosophers have become newly interested in the ethics of sex. One promising feature of this new discussion is that it has been broadening our moral lens to include individuals whose sexual interests have historically been denied or ignored. One such group is the elderly. Contrary to popular belief, many elderly people want to have sex and see it as a regular part of their lives. If society harbors ignorance about or prejudice against elderly sexuality, it harbors stronger views against the (...) sexual expression of elderly people with dementia. People with dementia are often prohibited by nursing‐home staff, sometimes in extreme ways, from having sex with their partners. This prohibition is at least partly motivated by the goal of protecting the vulnerable. However, cutting people with dementia off from sex has negative health effects and is a needless restriction of their autonomy. In this article, I argue that the expanding moral lens in sexual ethics should include the sexual expression of elderly individuals with dementia and that their sexual expression should be respected. Specifically, I argue that many people with dementia are competent to consent to sexual activity with their long‐term partners. (shrink)

In the Laws, Plato argues that the legislator should attempt to persuade people to voluntarily obey the laws. This persuasion is accomplished through use of legislative preludes. Preludes (also called preambles) are short arguments written into the legal code, which precede laws and give reasons to follow them. In this paper, I argue that Plato’s use of persuasive preludes shows that he endorses the core features of a public reason theory of political justification. Many philosophers argue that Plato’s political philosophy (...) is deeply at odds with contemporary liberal political philosophy. While Plato certainly does not affirm (and even rejects) some of the main features of liberalism, if it could be shown that he endorses some account of public reason (which is a liberal idea to its core), this would suggest that there is more in common between Plato and liberalism than many philosophers think. Furthermore, if combined with the work of philosophers, like C.C.W. Taylor, this could form a cumulative case against those who argue that there is little in common between Plato’s political philosophy and liberalism. In short, by showing that Plato endorses the core features of public reason, I endeavor to show that there is more in common between Plato and liberalism than is often thought. (shrink)

It seems that intuitions are indispensable in philosophical theorizing. Yet, there is evidence that our intuitions are heavily influenced by biases. This generates a puzzle: we must use our intuitions, but we seemingly cannot fully trust those very intuitions. In this paper, I develop a methodology for philosophical theorizing which attempts to avoid this puzzle. Specifically, I develop and defend a methodology that I call Extra-Wide Reflective Equilibrium. I argue that this method allows us to use intuitions, while also providing (...) a mechanism to check the influence of bias on our intuitions. In section I, defend the claim that intuitions are indispensable in philosophical theorizing. In section II, I outline recent arguments against the reliability of intuitions. Individuals suffering from anorexia-nervosa experience dysmorphic perceptions of their body and desire to act on these perceptions by refusing food. In some cases, anorexics want to refuse food to the point of death. In this paper, I answer this question: if an anorexic, A, wants to refuse food when the food would either be life-saving or prevent serious bodily harm, can A’s refusal be valid? I argue that there is compelling reason to think that anorexics can validly refuse food, even (...) in these extreme circumstances. (shrink)

It has long been argued that the institution of judicial review is incompatible with democratic institutions. This criticism usually relies on a procedural conception of democracy, according to which democracy is essentially a form of government defined by equal political rights and majority rule. I argue that if we see democracy not just as a form of government, but more basically as a form of sovereignty, then there is a way to conceive of judicial review as a legitimate democratic institution. (...) The conception of democracy that stems from the social contract tradition of Locke, Rousseau, Kant and Rawls, is based in an ideal of the equality, independence, and original political jurisdiction of all citizens. Certain equal basic rights, in addition to equal political rights, are a part of democratic sovereignty. In exercising their constituent power at the level of constitutional choice, free and equal persons could choose judicial review as one of the constitutional mechanisms for protecting their equal basic rights. As such, judicial review can be seen as a kind of shared precommitment by sovereign citizens to maintaining their equal status in the exercise of their political rights in ordinary legislative procedures. I discuss the conditions under which judicial review is appropriate in a constitutional democracy. This argument is contrasted with Hamilton's traditional argument for judicial review, based in separation of powers and the nature of judicial authority. I conclude with some remarks on the consequences for constitutional interpretation. (shrink)

Christian economic theology is distinguished from Christian social ethics by its methodological reflection on the emergence, formation, and proper boundaries of the economic sphere, as well as transcendental reflection on the conditions of possibility of economic science. In practice, this often amounts to anxiety about the authority of Christianity in the economic sphere, as well as about the extent to which Christianity can be held responsible for the system of impersonal economic domination known as capitalism. This review essay draws upon (...) three recent works on or about Christian economic theology, and argues that this genre's anxiety about Christian authority manifests in the ways that it draws temporal boundaries between ancient, medieval, and modern economies. Ultimately, its ambivalence about economy itself is traceable to Aristotle's understanding of money as containing two natures, one defined by quality (use value) and the other by quantity (exchange value). Christianity here becomes a cipher for quality. (shrink)

We analyze two problems in mathematics – the first (stated in our title) is extracted from Wittgenstein’s “Philosophy for Mathematicians”; the second (“What set of numbers is non-denumerable?”) is taken from Cantor. We then consider, by way of comparison, a problem in musical aesthetics concerning a Brahms variation on a theme by Haydn. Our aim is to bring out and elucidate the essentially riddle-like character of these problems.

This qualitative study identifies police interactions with gun violence co-victims as a crucial, overlooked component of police unresponsiveness, particularly in minority communities where perceptions of police illegitimacy and legal estrangement are relatively high. Gun violence co-victims in three cities participated in online surveys, in which they described pervasive disregard by police in the aftermath of their loved ones' shooting victimization. We build on the checklist model that has improved public safety outcomes in other complex, high-intensity professional contexts to propose a (...) checklist for police detectives to follow in the aftermath of gun violence. To build the checklist, we also reviewed the general orders of five police departments to better understand what guidance, if any, is currently given to police personnel regarding how they should interact with gun violence victims. The concept of sustainable and responsible (SR) investments expresses that every investment should be based on the SR investor’s code of ethics. To a large extent the allocation of SR investments to more sustainable companies and ethical practices is based on the environmental, social, and corporate governance (ESG) scores provided by rating agencies. However, a thorough investigation of ESG scores is a neglected topic in the literature. This paper uses Thomson Reuters ASSET4 ESG ratings to analyze the influence of firm (...) size, a company’s available resources for providing ESG data, and the availability of a company’s ESG data on the company’s sustainability performance. We find a significant positive correlation between the stated variables, which can be explained by organizational legitimacy. The results raise the question of whether the way the ESG score measures corporate sustainability gives an advantage to larger firms with more resources while not providing SR investors with the information needed to make decisions based on their beliefs. Due to our results, SR investors and scholars should reopen the discussion about: what sustainability rating agencies measure with ESG scores, what exactly needs to be measured, and if the sustainable finance community can reach their self-imposed objectives with this measurement. Tom Moylan is perhaps most famous as a literary critic of science fiction: his two most well-known collections of reviews were Demand the Impossible, published in 1986 and reissued in 2014 with a number of critical reactions appended, and Scraps of the Untainted Sky, originally published in 2000. At any rate, the topic with Becoming Utopian is utopia, utopia as an abstract notion, influenced by the writings of Ernst Bloch, Ruth Levitas, Fredric Jameson, and science fiction writer Kim Stanley Robinson. Emotions and moods have been distinguished in the literature. If they are distinct, we may expect emotion regulation and mood regulation to be distinct too. We show that although emotion regulation and mood regulation are considered theoretically distinct, they are often confounded empirically. We review characteristics proposed to distinguish emotions from moods by different theoretical approaches to emotion. We also review challenges to these propositions, suggesting that one valid distinction involves intentionality. Building on the above, we discuss possible differences between (...) emotion regulation and mood regulation. Finally, we encourage the use of accurate terminology, argue for the importance of empirically testing hypotheses regarding distinctions between emotion regulation and mood regulation, and discuss possible implications. Chambers focuses on the theme of the relevance of language analysis to political debate, answering those critics who insist discourse approaches to politics are irrelevant. Heidegger, Nietzsche, Foucault and Derrida are used to challenge the political burden which is placed on language analysis to prove its value in the real world. Drawing from political theory and cultural studies Chambers takes on the same-sex marriage debate, showing how the use and misuse of language has contributed to an impasse that is not likely to be broken. Wide ranging and insightful, Untimely Politics makes a timely plea for a more politically relevant and culturally engaged form of intellectual engagement. (shrink)

Hobbes’s account of the individual’s right to resist sovereign authority is nuanced. His allowance for cases in which a sovereign’s command falls outside the terms of the social contract, despite recent reappraisals, cannot rescue him from the accusation that his system is contradictory. It has been suggested that some Hobbesian rights can be transferred whilst others are quarantined, or that it is the institution of law, rather than the particular commands of the sovereign, which Hobbes ultimately upholds. By reconsidering Hobbes’s (...) concept of sovereignty alongside his theory of natural law, I argue that his system remains in tension with itself. Hobbes’s prioritisation of sovereign judgement over that of the individual, when combined with the principles he retains from the natural law tradition, renders his theory of resistance irreconcilable with his position on sovereignty. It will perhaps be most useful for those interested in better understanding Scolnicov’s work and his views on Plato as a whole, not least for the comprehensive list of his publications that requires a full twelve pages of print. Scholars with an interest in Plato’s method of hypothesis will also find some useful remarks on key passages in the Meno, (...) Phaedo, and Republic as well as on Greek mathematical analysis.Illuminating other aspects of Scolnicov’s work is clearly part of the intention behind enabling broader access to this study. We review the primary evidence to bring order to a confusing picture that emerges from a range of conflicting interpretations of the document. Our conclusions are as follows: First, the 1895 Introduction does not signify a new position, considering Engels' recognition over several decades of political concessions by the British ruling class. Secondly, since from the 1840s Marx too had applauded (...) the potential of the 'Social Democratic' route, at least under the appropriate conditions, we may be confident that he would have approved of Engels' Introduction. Thirdly, the case for universal suffrage was to set the foundations for a classless communist system; Engels, we show, would have found unacceptable a Parliamentary system generating a working-class majority unwilling to carry out a communist program, or a working-class electorate choosing to replace the party at the polls. Variabilism is the view that proper names (like pronouns) are semantically represented as variables. Referential names, like referential pronouns, are assigned their referents by a contextual variable assignment (Kaplan 1989). The reference parameter (like the world of evaluation) may also be shifted by operators in the representation language. Indeed verbs that create hyperintensional contexts, like ‘think’, are treated as operators that simultaneously shift the world and assignment parameters. By contrast, metaphysical modal operators shift the world of assessment only. Names, being (...) variables, refer rigidly in the latter merely intensional contexts, but may vary their reference in hyperintensional contexts. This conforms to the intuition that the content of attitude ascriptions encapsulates referential uncertainty. Furthermore, names in hyperintensional contexts are ambiguous between de re* and de dicto* interpretations. This fact is used to account for asymmetric mistaken identity attributions (for example, Biron thinks Katherine is Rosaline, but he doesn’t think Rosaline is Katherine). -/- The variable theory compares favourably with its alternatives, including Millianism and descriptivism. Millians cannot account for the behaviour of names in hyperintensional contexts, while descriptivists cannot generate a necessary contrast between intensional and hyperintensional contexts. No other theory can capture the facts pertaining to the existentially bound use of names. (shrink)

I discuss the volume edited by Andrea Falcon and Stasinos Stavrianeas which includes a new Greek text of Aristotle's De incessu animalium (On the Progression of Animals) by Pantelis Golitsis and nine interpretative essays. Since the De incessu is largely uncharted territory, my main goal is to introduce some of the exegetical debates initiated in this volume and to hint at points of departure for further discussion. I pay particular attention to the famous principle that nature does nothing in vain.

Leibniz’s views on modality are among the most discussed by his interpreters. Although most of the discussion has focused on Leibniz’s analyses of modality, this essay explores Leibniz’s grounding of modality. Leibniz holds that possibilities and possibilia are grounded in the intellect of God. Although other early moderns agreed that modal truths are in some way dependent on God, there were sharp disagreements surrounding two distinct questions: (1) On what in God do modal truths and modal truth-makers depend? (2) What (...) is the manner(s) of dependence by which modal truths and modal truth-makers depend on God? Very roughly, Leibniz’s own answers are: (1) God’s intellect and (2) a form of ontological dependence. The essay first distinguishes Leibniz’s account from two nearby (and often misunderstood) alternatives found in Descartes and Spinoza. It then examines Leibniz’s theory in detail, showing how, on his account, God’s ideas provide both truth-makers for possibilities and necessities and an ontological foothold for those truth-makers, thereby explaining modal truths. Along the way, it suggests several refinements and possible amendments to Leibniz’s grounding thesis. It then defends Leibniz against a pair of recent objections by Robert Merrihew Adams and Andrew Chignell that invoke the early work of Kant. I conclude that whereas Leibniz’s alternative avoids collapsing into yet another form of Spinozism, the alternatives proposed by Adams, Chignell, and the early Kant do not. (shrink)

Previous scholarship on states’ autonomy from the interests of society has focused primarily on nondemocratic societies, raising the question of whether “state theory” is relevant to modern states. Public‐opinion research documenting the ignorance of mass polities suggests that modern states may be as autonomous as, or more autonomous than, premodern states. Premodern states’ autonomy was secured by their ability to suppress societal dissent by force of arms. Modern states may have less recourse to overt coercion because the very thing that (...) legitimates them in the eyes of society—democracy—virtually ensures that society will not control the state, since the putative agent of control, the electorate, cannot possibly be well informed about the multitudinous tasks undertaken by modern governments. Instead of focusing solely on armies, taxes, and bureaucracies, state theorists can now direct their attention to how the vagaries of public opinion and the legitimating effects of popular elections may fuel state autonomy. This Element, written for researchers and students in philosophy and the behavioral sciences, reviews and critically assesses extant work on number concepts in developmental psychology and cognitive science. It has four main aims. First, it characterizes the core commitments of mainstream number cognition research, including the commitment to representationalism, the hypothesis that there exist certain number-specific cognitive systems, and the key milestones in the development of number cognition. Second, it provides a taxonomy of influential views within mainstream number cognition research, (...) along with the central challenges these views face. Third, it identifies and critically assesses a series of core philosophical assumptions often adopted by number cognition researchers. In this paper, I confront Parfit’s Mixed Maxims Objection. I argue that recent attempts to respond to this objection fail, and I argue that their failure is compounded by the failure of recent attempts to show how the Formula of Universal Law can be used to demarcate the category of obligatory maxims. I then set out my own response to the objection, drawing on remarks from Kant’s Metaphysics of Morals for inspiration and developing a novel account of how the Formula (...) of Universal Law can be employed to determine the deontic status of action tokens, action types, and maxims. Recent years have witnessed growing controversy over the “wisdom of the multitude.” As epistemic critics drawing on vast empirical evidence have cast doubt on the political competence of ordinary citizens, epistemic democrats have offered a defense of democracy grounded largely in analogies and formal results. So far, I argue, the critics have been more convincing. Nevertheless, democracy can be defended on instrumental grounds, and this article demonstrates an alternative approach. Instead of implausibly upholding the epistemic reliability of average voters, I (...) observe that competitive elections, universal suffrage, and discretionary state power disable certain potent mechanisms of elite entrenchment. By reserving particular forms of power for the multitude of ordinary citizens, they make democratic states more resistant to dangerous forms of capture than non-democratic alternatives. My approach thus offers a robust defense of electoral democracy, yet cautions against expecting too much from it—motivating a thicker conception of democracy, writ large. (shrink)
