The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Although the birth and early life of an infant is similar throughout the world, meanings ascribed to infants differ according to cultural values and beliefs. This essay describes how scholars and healers have come to see the infant as distinct from other types of people, and what implications this distinction carries for how health care is practiced. The first portion of this essay explores how understanding of the infant, particularly the well-accepted notion of “normal” infant growth and development, came to (...) prominence. Drawing from the history of medicine, philosophical thought and colonial practice, this essay demonstrates that the roots of thinking about the infant in terms of his growth are deep and well-defined in North American and European ideologies. The second portion of this essay describes the practical applications and political implications of beliefs about the “normal” infant. In the arena of applied health, policy makers measure infant growth in light of assumptions about the “normal.” A case study of indigenous populations in Irian Jaya, Indonesia, shows that these measurements are highly political. Here government health officials create and manipulate statistics to ensure that indigenous infant health is represented as being below “normal.” The “normal” infant can thus be understood as a subtle and effective construct which, in Irian Jaya, at the least, is used to assimilate indigenous people into the nation-state. This book honours David Miller's remarkable contribution to political philosophy. Over the last fifty years, Miller has published an extraordinary range of work that has shaped the discipline in many different areas, including social justice, democracy, citizenship, nationality, global justice, and the history of political thought. His work is characterised by its commitment to a kind of theorising that makes sense to the people who have to put its principles into practice. This entails paying close attention to empirical evidence from (...) the social sciences, but also results in a willingness to take the everyday beliefs of lay people seriously in its theorising. The aim is the construction of a political philosophy that can be radically reformative, but that nonetheless is justifiable and realisable here and now. This book brings together a range of papers from leading political theorists concerning many different aspects of Miller's work, on topics including national responsibility and global justice, self-determination, collective responsibility, human rights, immigration, market socialism, national identity, citizenship, multiculturalism, public goods, the political thought of David Hume, and the methodology of political philosophy. Distinctive aspects of a culture are often reflected in the meaning and usage of words in the language spoken by bearers of that culture. Keywords such as душа (soul) in Russian, hati (heart) in Indonesian and Malay, and gezellig (convivial/cosy/fun) in Dutch are held to be especially culturally revealing, and scholars have identified a number of such keywords using careful linguistic analyses (Peeters, 2020b; Wierzbicka, 1990). Because keywords are expected to have different statistical properties than related words in other languages, (...) we argue that a quantitative comparison of word usage across languages can help to identify cultural keywords. To support this claim, we describe a computational method that compares word frequencies across languages, and apply it to both linguistic corpora and word association data. The method identifies culturally specific words that range from “obvious” examples, such as Amsterdam in Dutch, to non‐obvious yet independently proposed examples, such as hati (heart) in Indonesian. We show in addition that linguistic corpora and word association data provide converging evidence about culturally specific words. Our results therefore show how computational analyses and behavioral experiments can supplement the methods previously used by linguists to identify culturally salient words across languages. A number of studies in the extant literature report findings that suggest asymmetry in the way reflexive and pronoun anaphors are interpreted in the early stages of processing: that pronouns are less sensitive to structural constraints, as formulated by Binding Theory, than reflexives, in the initial antecedent retrieval process. However, in previous visual world paradigm eye-tracking studies, these conclusions were based on sentences that placed the critical anaphors within picture noun phrases or prepositional phrases, which have independently been shown not (...) to neatly conform to the Binding Theory principles. We present results from a visual world paradigm eye-tracking experiment that show that when critical anaphors are placed in the indirect object position immediately following a verb as a recipient argument, pronoun and reflexive processing are equally sensitive to structural constraints. This paper provides a formal description of two legal domains. In addition, we describe the generation of various artificial datasets from these domains and explain the use of these datasets in previous experiments aligning learning and reasoning. These resources are made available for the further investigation of connections between arguments, cases and rules. Games and simulations--from quantitative modeling to immersive, experiential scenarios--as methods for engagement within futures studies have a substantial history. In recent years, there has been a surge of projects using a wide array of tools. As practitioners and researchers have gravitated toward more playful approaches, there is a need to review and evaluate such approaches. This chapter provides an introduction to gaming and simulations as anticipatory processes. Efficient prospective motor control, evident in human activity from birth, reveals an adaptive intentionality of a primary, pre-reflective, and pre-conceptual nature that we identify here as sensorimotor intentionality. We identify a structural continuity between the emergence of this earliest form of prospective movement and the structure of mental states as intentional or content-directed in more advanced forms. We base our proposal on motor control studies, from foetal observations through infancy. These studies reveal movements are guided by anticipations of future effects, (...) even from before birth. This implies that these movements, even if they are simple and discrete, are the actions of an intentional agent. We develop this notion to present a theory of the developing organisation of a core feature of cognition as embodied agent action, from early single actions with proximal prospectivity to the complex serial ordering of actions into projects to reach distal goals. We claim the prospective structural continuity from early and simple actions to later complex projects of serially-ordered actions confirms the existence of an ontogenetically primary form of content–directedness that is a driver for learning and development. Its implications for understanding autism are discussed. (shrink)

We present a novel annotated dataset of legal cases pertaining to Article 6 – the right to a fair trial – of the European Convention on Human Rights (ECHR). This dataset will serve as a useful resource to the research community, to assist in the training and evaluation of AI systems designed to embody the legal reasoning involved in determining the appropriate legal outcome from a description of the case material. The annotations were applied to provide finer-grain classifications of legal (...) cases at the document level. Each classification label was sourced from a domain knowledge model, derived with legal expert guidance and known as an Angelic Domain Model (ADM), such that the classifications correspond to the actual legal rationales used by the Court when determining the outcome of a given case. We discuss our annotation pipeline, including annotator training, inter-annotator reliability evaluation, and the dissemination of the annotation outputs and associated metadata. (shrink)

The scale and character of past injustice can seem overwhelming. Grievous wrongdoing characterizes so much of human history, both within and between different political communities. This raises a familiar question of reparative justice: what is owed in the present as a result of the unjust actions of the past? This article asks what should be done in situations where contemporary debts stemming from past injustice are massive in scale, and seemingly call for nonideal resolution or settlement. Drawing on recent work (...) by Sara Amighetti and Alasia Nuti on deliberative reparative processes, the article differentiates between two different approaches to settling claims for reparation. The first pursues settlement in a legal or quasi legal sense, seeking to close a matter through discussion, compromise, and bargaining in such a way as to maximize one’s interest while drawing a line under the events in question. The second is grounded not in one’s own interest but in an acknowledgement of the inevitable inadequacy of one’s reparative response. Such an approach to settlement centres the agency of the individuals and groups harmed by past wrongdoing. The article examines the reparations issue with reference to a range of recent cases of alleged settlement, including claims for reparation for torture by the British army in Kenya in the 1950s, for sexual slavery by the Japanese Imperial Army in East Asia in the Second World War, and for genocide by German colonial forces between 1904 and 1908. Readers have much to consider when evaluating Greenblum and Hubbard’s conclusion that ‘physicians have no business doing theology’.1 The two central arguments the authors offer are fairly convincing within the confines they set for themselves, the provisos they stipulate and their notions of ‘privacy’ and ‘public reason’. However, I would ask readers to consider two questions, the answers to which I believe the authors leave opaque. First, what is theological negotiation? Second, what makes chaplains the singular group of healthcare professionals (...) responsible for theological negotiation? In this Commentary, I explore these questions not with the goal of rejecting the authors’ conclusion, but rather with the goal of highlighting relevant considerations when evaluating the authors’ central tenets. First, I would like readers to consider Greenblum and Hubbard’s descriptions of theological negotiation. They categorise theological negotiation into metaphysical, normative and alternative responses, and hold that this kind of negotiation is, for the most part, impermissible for healthcare professionals, save chaplains.1 The examples of Dr Chatterjee and Dr Thompson expand theological negotiation to include instances where physicians add a theological veneer to their clinical recommendations. A typical view of Leibniz’ extraordinary metaphysical and methodological views is to regard them as having appeared by certain “applications” of his mathematical and physical discoveries. If we believe Couturat and Russell the monadology is largely only the expression of certain logically formal relationships: it is the logic of Leibniz that is basic to his mature metaphysics. Even more typical is the view that Leibniz’ work in mathematics, especially his work on the calculus, is the source of the key ideas (...) in his metaphysics. J. M. Child, the translator of the early mathematical manuscripts, says it straight out: “ … the main ideas of [Leibniz’] philosophy are to be attributed to his mathematical work, and not vice versa.” In a philosophically much more interesting way Paul Schrecker argues that what he calls Leibniz’ “infinitesimal method,” a method obviously derived from his mathematical work, pervades all of the important basic contributions of both his metaphysics and methodology. Environmental ethicists have not reached a consensus about whether or not individuals who contribute to climate change have a moral obligation to reduce their personal greenhouse gas emissions. In this paper, I side with those who think that such individuals do have such an obligation by appealing to the concept of integrity. I argue that adopting a political commitment to work toward a collective solution to climate change—a commitment we all ought to share—requires also adopting a personal commitment to reduce (...) one’s emissions. On these grounds, individuals who contribute to climate change have a prima facie moral duty to lower their personal greenhouse gas emissions. After presenting this argument and supporting each of its premises, I defend it from two major lines of objection: skepticism about integrity’s status as a virtue and concerns that the resulting moral duty would be too demanding to be morally required. I then consider the role that an appeal to integrity could play in galvanizing the American public to take personal and political action regarding climate change. (shrink)

Professor Marcucci's book on Whewell [6] is a comprehensive expository treatment of Whewell's philosophy of science. The work contains chapters on Whewell's theory of ideas, the fundamental principles of his philosophy of science, his views on mathematics and mechanics, and on his philosophy of induction and philosophy of discovery. In addition there is a chapter on the English reception of Whewell's thought. Professor Marcucci's notes are rich, both in references to Whewell's many critics and to nearly all of the extant (...) literature on Whewell. Indeed, no full study of Whewell has as yet appeared that makes better or more extensive use of all the relevant literature on Whewell. (shrink)

This paper first argues that we can bring out a tension between the following three popular doctrines: (i) the canonical reduction of metaphysical modality to essence, due to Fine, (ii) contingentism, which says that possibly something could have failed to be something, and (iii) the doctrine that metaphysical modality obeys the modal logic S5. After presenting two such arguments (one from the theorems of S4 and another from the theorems of B), I turn to exploring various conclusions we might draw (...) in light of these results, and argue that none comes cost free. In the course of laying out possible responses to my arguments, we'll have a chance to evaluate various doctrines about the interplay between contingency and essence, as well as develop some alternative reductions of metaphysical modality to essence. I don't decisively come down in favor of one response over the others, though I say some things that point towards the conclusion that essence has no role to play in reducing metaphysical modality. This book examines the link between population growth and environmental impact and explores the implications of this connection for the ethics of procreation. In light of climate change, species extinctions, and other looming environmental crises, Trevor Hedberg argues that we have a collective moral duty to halt population growth to prevent environmental harms from escalating. This book assesses a variety of policies that could help us meet this moral duty, confronts the conflict between protecting the welfare of future people (...) and upholding procreative freedom, evaluates the ethical dimensions of individual procreative decisions, and sketches the implications of population growth for issues like abortion and immigration. It is not a book of tidy solutions: Hedberg highlights some scenarios where nothing we can do will enable us to avoid treating some people unjustly. In such scenarios, the overall objective is to determine which of our available options will minimize the injustice that occurs. f gravity is examined in the context of a five-dimensional Kaluza-Klein theory with degenerate metric. In this theory electromagnetism is described by two vector fields, and there is a reflection symmetry between them which unifies them with gravitation. For matter, it is shown how the Lagrangian may be any function and still generate the same equations of motion, provided that some simple conditions are satisfied. Significant challenges arise for clinical care teams when a patient or surrogate decision-maker hopes a miracle will occur. This article answers the question, “How should clinical bioethicists respond when a medical decision-maker uses the hope for a miracle to orient her medical decisions?” We argue the ethicist must first understand the complexity of the miracle-invocation. To this end, we provide a taxonomy of miracle-invocations that assist the ethicist in analyzing the invocator's conceptions of God, community, and self. After the ethicist (...) appreciates how these concepts influence the invocator's worldview, she can begin responding to this hope with specific practices. We discuss these practices in detail and offer concrete recommendations for a justified response to the hope for a miracle. (shrink)

This paper will explore an epistemic aspect of hope, namely hope’s relationship to knowledge. It has been taken for granted that people do not hope for things to occur that they know will occur. I will be giving an argument that hope and knowledge are compatible, and I will defend that argument against one primary objection. More specifically, I will argue that there are instances when an agent knows that p and still hopes that p.

It is argued that philosophical realism is well suited to serve as a perspective from which to understand nursing, and that it should be considered as an alternative to positivist, interpretivist, hermeneutical and phenomenological approaches. However, existing forms of realism, including theory and entity realism are shown to be faced with serious problems. In response, an alternative form ‘constraint realism’ is outlined, and shown to be apposite for illuminating the rule or convention governed behaviour characteristic of human beings.
