Purpose. The purpose of the study is critical reconstruction of gender issues within the framework of modern political philosophy and political anthropology, in-depth reflection of the phenomena of justice, identity, human dignity in the aspect of their gender measurements and the search for the answer to the fundamental question for leading gender discourses: is freedom and justice, in fact, possible only together with stresses, a feeling of one’s sense-rooted belonging to one or another community? Theoretical basis. The supplement of the (...) phenomenological and transcendental methodology by the method of contractualism directs the study of the topic specified in the article’s title into a new direction, and reflects its essential measurements and aspects. Understanding gender as an important philosophical and anthropological problem and a complex "social construct" precisely within the framework of the latest critical and self-critical versions of the theory of social contract reveal fruitful perspectives for political philosophy and anthropology. Originality. The study of the phenomena of "recognition" of "gender justice", "moral sense" outlines the possibilities and sense of filling the principle of social contract with a specific theoretical and practical content, substantiates the need to expand the philosophical and anthropological interpretation space of gender issues. Conclusions. Significance of the gender community for the sociocultural and existential identity of the individual enables his/her security and the ability to adequately orient in difficult life situations. However, the main purpose of human life is the ability to self-identity, even after profound changes in the structure of personality that arise in difficult situations of contempt and injustice. One of the major problems posed by the human rights issue to philosophy is its philosophical foundation. The background of this discussion raises questions such as: how can one philosophically explain / justify the demand for human rights recognition? This paper focuses on the argumentative basis on which Höffe structures his proposal. For him human rights are closely connected to the concept of justice. The subject of my dissertation is "rationality". In this book I undertake a comprehensive, systematic and independent treatment of the problem of rationality. This furthers progress toward a general theory of rationality, one that represents and defends a uniform conception of reason. The structure and general outline are as follows: Part I: General Definition of the Concept; Part II: Rationality in the Theoretical Realm; Part III: Rationality in the Practical Realm (parts II and III are divided respectively into A. Relative (...) Reasons and B. Absolute Reasons); Part IV: Grounds for the Principle of Reason. My aim in this work is to prove that a conception of rationality as justification of our usage of language is more significant than has been classically recognized, without, however, reducing the concept of rationality. After a definition of the term is provided in the first chapter by means of language analysis, the following three questions are dealt with in the subsequent chapters: a) Exhaustion of rationality in relative reasons—i.e., is reasoning exhausted by reference to existing views and goals, or does rationality also exist in a strong sense? The latter would be the case if the views and goals referred to the relative conception must themselves be justified de novo. I argue that such an absolute justification of views and goals cannot be provided. To this end, in the theoretical domain, I discuss a question prominent in the debate over the rationality of worldviews, namely the question of whether the standards of theoretical rationality are merely culturally relative (chapter V.). Here I arrive at the position that standards of theoretical rationality are only transcultural insofar as there are goals which are not themselves culturally-dependent. With regard to practically fundamental goals, the core standards of modern science can be justified. This justification strategy therefore requires that such goals be established. In practical terms, first I address (in Chapter VII) the so-called "final justification" of norms problem. Here I discuss above all the transcendental-pragmatic proposal and the contractualist conception. According to my view, neither succeed in providing a final rational grounding for norms. That grounding pertains instead to the rationale for objectives, and Chapter VIII demonstrates that even a final justification of objectives is impossible. This does not mean, however, that a person's goals cannot be criticized as irrational. But the warrant in this case depends on the rules that govern the genesis of desires being accepted by the subject. b) If substantive rationality does not exist because no absolute grounding for opinions and goals can obtain, then the question of how strong or weak the concept of rationality is acquires further weight. On that basis, relative theoretical and practical rationality is examined in detail. I aim with this analysis of (relative) rationality to apprehend the structural parallelism between rationality in both the practical and the theoretical domain, and therefore to defend a uniform conception of reason or rationality. This is accomplished by identifying a concept that exhibits the same structure in both theoretical and practical domains: the term "rational" is applied to actions and opinions in order to claim, first of all, that they are "well-founded." For example, one must inquire into the precise rational justification for opinions or actions. To determine the individually necessary and jointly sufficient conditions required for an opinion or action to be rational, one must first provide a formal characterization of the rationality of those opinions or actions. What is to count as a rational ground can only be explained by formal procedures and results achievable via those procedures. To be more specific, I claim that the process of opinion formation and practical reflection is subject to rational justification based on internalist rules. The rules governing theoretical rationality can have their content transformed in a further move, if one takes the result of the process of rational opinion-formation as the product of an epistemological determination, that is, as a decision about which opinion to hold that is made on the basis of epistemological or prudential goals. Implicit in this position is the controversial idea that one can actually decide to believe something. The rules of practical reason are the rules that guide the rational selection of objectives and actions. The structural parallelism of theoretical and practical rationality consists, therefore, in the fact that both refer to mental processes that are controlled by rules which one freely accepts and follows. In both cases, these rules are to be understood as governing the rational choice of a mental or physical action. c) Therefore, the question of whether rationality—being rational—can in turn be grounded by reasons can be answered in the following way: The rules of rationality can only be justified with reference to a person’s goals, as the best strategy for achieving those goals. If someone does not desire the optimal realization of his goals, there is no other way of arguing directly for rationality. One can only attempt to demonstrate—if the person is open to argument—that it is typically in the person's own best interest to adhere to the rules of rationality. (shrink)

A common reaction to Hegel’s suggestion that we collapse Kant’s distinction between form and content is that, since such a move would also deprive us of any way of distinguishing the merely logical from the real possibility of our concepts, it is incoherent and ought to be rejected. It is true that these two distinctions are intimately related in Kant, such that if one goes, the other does as well. But it is less obvious that giving them up as Kant (...) conceives them is as incoherent a proposal as many of Hegel’s critics think. It has been the point of a recent account of Hegel’s idealism to demonstrate that his critique of Kant’s dichotomy between form and content or concept and intuition does not commit him to the view that human cognition is materially creative of its content in the manner of a God-like or intuitive intellect—does not, in other words, signify a return to a pre-Critical metaphysics. This is the interpretative stance I adopt here as well, in hope of giving defenders of Kant reasons for taking Hegel more seriously. (shrink)

This book is the first detailed study of Kant's method of 'transcendental reflection' and its use in the Critique of Pure Reason to identify our basic human cognitive capacities, and to justify Kant's transcendental proofs of the necessary a priori conditions for the possibility of self-conscious human experience. By examining the idea found in the works of several contemporary philosophers that the multiplicity of worlds is no longer merely possible – as it was for Leibniz – but actually determines our experience of reality, the article proposes an understanding of worlds as transcendental structures that frame the ontological multiplicity. The article argues that such a proliferation of actual worlds implies that the concept of world should be seen today as a category that belongs to the order of (...) fiction, making the world-building devices of literature relevant for understanding the contemporary experience of reality. The first part examines the conceptions of multiple worlds of Leibniz, Deleuze, and Badiou through the structural differences and similarities between possible and fictional worlds. While Deleuze actualises possible worlds, Badiou actualises fictional worlds. The second part explores worlds as political fictions, revisiting Kant’s conception of cosmopolitanism via Rancière’s definition of politics as a conflict of worlds. Rancière’s formulation of political dissensus in fictional and narrative terms sheds a new light on Kant’s description of cosmopolitanism as a perspective that presents history as a novelistic narrative. We argue that individuals who have access to vaccines and for whom vaccination is not medically contraindicated have a moral obligation to contribute to the realisation of herd immunity by being vaccinated. Contrary to what some have claimed, we argue that this individual moral obligation exists in spite of the fact that each individual vaccination does not significantly affect vaccination coverage rates and therefore does not significantly contribute to herd immunity. Establishing the existence of a moral obligation to be vaccinated (...) despite the negligible contribution each vaccination can make to the realisation of herd immunity is important because such moral obligation would strengthen the justification for coercive vaccination policies. We show that two types of arguments—namely a utilitarian argument based on Parfit’s Principle of Group Beneficence and a contractualist argument—can ground an individual moral obligation to be vaccinated, in spite of the imperceptible contribution that any single vaccination makes to vaccine coverage rates. We add a further argument for a moral obligation to be vaccinated that does not require embracing problematic comprehensive moral theories such as utilitarianism or contractualism. The argument is based on a “duty of easy rescue” applied to collectives, which grounds a collective moral obligation to realise herd immunity, and on a principle of fairness in the distribution of the burdens that must be borne to realise herd immunity. Explicates and defends closely parallel, genuinely transcendental proofs of mental content externalism developed by Kant and by Wittgenstein. Both their proofs have been widely neglected, to our loss.

Lucy Allais’s Manifest Reality offers an attractive new interpretation of Kant’s transcendental idealism. Kantian appearances are known through essentially manifest properties, but those properties are construed as belonging ultimately to things in themselves with intrinsic natures. This position can offer a nice account of the sense in which appearances and things in themselves are identical and a metaphysically plausible way to construe appearances as strictly partially mind-dependent. The position is less convincing when it comes to explaining the sense in (...) which appearances and things in themselves remain non-identical. I argue that such a non-identity thesis was in fact crucial to Kant’s use of idealism to explain the possibility of synthetic a priori knowledge, to his account of the apriority of the representation of space, and to his anti-Leibnizian point that our mathematical and scientific cognition provides not confused representation of underlying things in themselves, but perfectly exact and strictly true cognition of something else. In closing, I suggest that the hylomorphic nature of Kant’s idealism points toward an alternative conception of the partial mind-dependence of appearances. (shrink)

Surprisingly, over the decade or so since its publication, Bhaskar's Dialectic: The Pulse of Freedom has received relatively little in the way of systematic analysis either by critical realists or their critics. There have been, however, a number of critiques that have dealt with some of its themes and developments in a variety of contexts. In the following study, I assess the argument of Alex Callinicos. Callinicos' critique, though in many ways sympathetic, is fundamental to critical realism. Engaging with it (...) provides a means to develop and clarify a number of arguments about aspects of critical realism in general and also provides a useful staging point to set forth a basic and consistent ordering of inquiry for a critique of DPF. The initial purpose of the analysis is not so much a defence of DPF but an assessment of the construction of an argument brought to bear on it. I argue that the form of the argument deployed is problematic in a way that detracts from the substance of the critique of the content of DPF (I make no comment here on its relation to the later spiritual turn). This is not to suggest that DPF is immune to criticism but rather to suggest that a fuller analysis of the DPF argument and its potential remains to be made. The ultimate purpose of the analysis is to use this assessment of a strategy of critique—an argumentation schema or discursive form—to create an alternative approach to critically appraising DPF. Eddo Evink criticizes Emmanuel Levinas’s supposed view that all acts of intentionality and rationality commit transcendental violence against their objects, including the Other. If this is so, Levinas undermines the possibility of his own philosophy. Evink further argues: that there are non-violent forms of intentionality and so intentionality is only potentially violent; that some non-violent counter-pole is needed to define violence; that there are contradictions in Levinas’s notion of violence; that Levinas, like empiricists, aspires to a metaphysical absolute untainted (...) by language; and that he presupposes the philosophical, ontological, and linguistic frameworks he criticizes. However, to answer these objections, one must understand Levinas as developing two distinct modalities of relationship: Being and Otherwise than Being. These modalities clash in the face-to-face relationship when the phenomenon of the face defects into responsibility for the Other. The epistemology and ontology of Being involve distinctive acts, affects, forms of temporality, and experiences of self that undergo a tectonic shift in confrontation with the ethically obligating Other. Here the focus is not on the violence of concepts ever seeking to subjugate the Other but rather on the Other whose summons both provokes knowledge to retreat and is able to be shown in a philosophy, even if that philosophy betrays the saying in the said, while also having the potential to reduce that betrayal. The focus should not be on transcendental violence tracking down and cornering the Other but on the Other ethically disrupting Being. With that focus, it becomes clear that concentrating on transcendental violence is a kind of violence. (shrink)

One recent trend in Kant scholarship has been to read Kant as undertaking a project in philosophical semantics, as opposed to, say, epistemology, or transcendental metaphysics. This trend has evolved almost concurrently with a debate in contemporary philosophy of mind about the nature of concepts and their content. Inferentialism is the view that the content of our concepts is essentially inferentially articulated, that is, that the content of a concept consists entirely, or in essential part, in the role that (...) that concept plays in a system of inferences. By contrast, relationalism is the view that this content is fixed by a mental or linguistic item's standing in a certain relation to its object. The historical picture of Kant and the contemporary debate about concepts intersect in so far as contemporary inferentialists about conceptual content often cite Immanuel Kant not only as one of the founding fathers of a tradition that leads more or less straightforwardly to contemporary inferentialism, but also as the philosopher who first saw the fatal flaws in any attempt to articulate the content of our concepts relationally. Kant’s ‘Refutation of Idealism’ plainly has an anti-Cartesian conclusion: ‘inner experience in general is only possible through outer experience in general’ (B278). Due to wide-spread preoccupation with Cartesian skepticism, and to the anti-naturalism of early analytic philosophy, most of Kant’s recent commentators have sought to find a purely conceptual, ‘analytic’ argument in Kant’s Refutation of Idealism – and then have dismissed Kant when no such plausible argument can be reconstructed from his text. Kant’s argument supposedly cannot eliminate all relevant alternatives, (...) and so cannot justify its strong modal claims. Kant based his arguments on an inventory of our basic cognitive capacities to employ our forms of intuition and our forms of judgment. Kant provides a variety of considerations and arguments to determine what our cognitive capacities are. This involves ‘transcendental reflection’, which Kant held is absolutely crucial for judging matters a priori (A263/B319). I argue that there is a level of philosophical reflection on our own cognitive capabilities and their preconditions that is significantly richer than has been noticed by recent commentators, and that is a precondition of Kant’s transcendental reflection proper. I explicate certain thought experiments Kant proposes in order for us to recognize some our basic, characteristic cognitive capabilities, and the limits and requirements they entail for the nature and objects of human knowledge. These thought experiments involve a kind of reflection on who we as cognizant subjects are, on what our basic cognitive capabilities are. Engaging in this kind of reflection reveals that Kant’s transcendental arguments are significantly stronger and more persuasive than has been recognized in recent commentary. (shrink)

Merleau-Ponty’s radical reflection conceptualizes the transcendental and the empirical as intertwined, emerging only via an écart. I advance this concept of transcendental empirical écart by studying the problem of measurement in science, in both general and quantum mechanical contexts. Section one analyses scientific problems of measurement, focusing on issues of temporality, to show how measurement entails a transcendental that diverges with the empirical. Section two briefly interprets this result via Merleau-Ponty’s concept of depth, to indicate how measurement (...) reveals a temporality that is not an already given ground that would guarantee the transcendental in advance: temporality is instead ‘deep,’ itself engendering a divergence of transcendental and empirical operations that first allows for measurement and sense. Kant’s Transcendental Ideal (TI) is presented in a notoriously obscure section of the Critique of Pure Reason. Many readers know that Kant’s principal purpose in the TI is to show how reason fallaciously derives its concept of God from its idea of the world. But this argument is clothed in a language that is unfamiliar even to skilled commentators on Kant’s work. In this essay, I present the historical context of the proof, conduct a detailed exegesis of the proof, (...) and argue that Kant formulated the Transcendental Ideal in such a way as to avoid Spinozism—a point Kant later seems to have doubted could be avoided. I develop my case in light of some comments made in a lesser-known essay that Kant wrote for the 1795 contest of the Royal Academy of Sciences in Berlin. (shrink)

To understand Kant's transcendental deduction of categories we must distinguish between Kant's strategy foe constructing such a deduction and the manner in which this strategy is executed. I argue that both versions of the deduction contain similar strategies in which categories are identified with transcendental conditions of experience. Where the versions differ substantially is in the manner Kant executes the various stages of this strategy. It is pointed out, for instance, that in the objective deduction in A Kant (...) introduces 'understanding' as a defined term (A119), whereas in B Kant postulates understanding as the fundamental activity of synthesis in terms of which he formulates the arguments of each stage of the deduction. Once the distinction between strategy and execution is accepted, much of Vaihinger's evidence for the "patchwork thesis" dissolves. But I also argue that in neither version of the deduction does Kant execute the identificatory strategy with convincing success. (shrink)

If we follow a traditional reading of Descartes and throw in some of our favorite German philosophers (Kant, Husserl and Heidegger, for instance) we can isolate a doctrinal current that says that the pure intellect has no immediate access to the extra-mental world. This reduction of experience to reason forces the question of the external world’s existence, leading to Heidegger’s assertion that the scandal of philosophy was not that it had yet to furnish a proof for the external world’s existence, (...) as Kant thought, but that the question emerged in the first place. Prior to representing realities, the human being dwells in the world. Knowing is, thus, founded on Being-in-the-world. Once this is remembered, it seems quite extraneous to inquire about the existence of the external world, since it is given as part of the structure of human experience. But, if the question of the external world's existence arises when we reduce experience to rational experience, then we have learned something important about the structures involved in knowing the world. Knowing succeeds by breaking away from Being-in-theworld. As Levinas says, "it is still and always a solitude" (EI 60). Though knowledge might begin as a mode of Being-in-the-world, it succeeds by turning its back on these origins and entering upon another terrain. Thus, Heidegger's recourse to the external world could not be within knowledge. Instead, he grounded it in concern, the primordial way in which the human being dwells in the world. Knowing is but one way in which the human being exhibits this concern. Where Husserl showed the limits of representation to be within the parameters of the transcendental ego, Heidegger pushed the frontiers of the world down to another level, the level of function. On this level, the human being dwells as a worker; things are construed as implements for-the-sake-of something else. These implements refer to other implements in a referential totality guided by "circumspection." The world of function is held together as a totality by an intricate web of references, each pointing to others.. (shrink)

This paper will deal with the problem of practical intentionality in the transcendental phenomenology of Husserl. First, through an analysis of a passage found in Logical Investigations, I will show Husserl''s earlier position with respect to the problem of practical intentionality. I will then go on to critically assess this position and, with reference to some of Husserl''s works written after the 1920''s, prove that every intentionality should be regarded as a practical intentionality. Correspondingly, transcendental phenomenology should also (...) be characterized as a practical philosophy. I make this statement with the following two senses in mind; transcendental phenomenology is a practical philosophy, first, in the sense that it investigates the various forms of practical intentionality and, second, in the sense that transcendental intentionality as the grounding source of transcendental phenomenology is also a kind of practical intentionality. Este trabalho pretende oferecer uma exposição e caracterização de certas marcas do Idealismo Transcendental presente na primeira Crítica de Kant. Para a realização dos presentes propósitos teremos como apoio algumas passagens do Prefácio à segunda edição da Crítica da razão pura, determinados pontos da Estética Transcendental, bem como tomaremos enquanto base de nossas reflexões a sexta seção da antinomia da razão pura, presente na Crítica da razão pura, denominada de “O idealismo transcendental como chave para a solução (...) da dialética cosmológica”. Entendemos que Kant apresenta, nessa parte de sua Crítica, a caracterização específica e a peculiaridade decisiva do Idealismo Transcendental da Crítica da razão pura. Nossa investigação seguirá as seguintes etapas: i) apresentação da Revolução Copernicana em filosofia proposta por Kant, pois consideramos tal revolução – a mudança de método e no modo de pensar o conhecimento em geral, bem como, em específico, o conhecimento metafísico – o primeiro passo do filósofo em direção ao seu idealismo; ii) elucidação de algumas das conseqüências que Kant extrai das considerações realizadas por ele acerca do espaço e do tempo na Estética Transcendental, as quais assinalam, como diz Kant, a “prova direta” do idealismo transcendental, ou seja, da idealidade transcendental dos fenômenos; iii) análise e exposição da já citada sexta seção, na qual Kant oferece o que pensamos ser uma caracterização propriamente dita do Idealismo Transcendental da Crítica da razão pura, isto é, o tipo particular de idealidade que Kant atribui a todos os objetos do nosso conhecimento. The article examines the historical movement of transcendental foundations in the twentieth century up to their reconstruction in modern rhetorical practices from the standpoint of communicative philosophy. The author also considers the prospects of the relationship and mutual combination of analytical, hermeneutical, semiotic and phenomenological traditions.

What philosophical motivations lay behind the emergence of the genealogical method in Foucault’s thought? Pace traditional interpretations, I argue that genealogy is best construed as a supplementary addition to the archaeological mode of investigation. It addresses an issue that arose within the problematic to which the archaeological method responds, but which that method was not designed to solve: the problem of “transcendental genesis” as this issue was defined within the unique parameters set forth by the French phenomenological tradition.

“Transcendental empiricism” is a handy catchphrase for describing the philosophy of Gilles Deleuze. It has the advantage of being paradoxical and also placing him in relation to Kant. As handy as it is, it is not without its difficulties. Chief among these difficulties is the precise nature of the “transcendental.” No doubt Deleuze chooses “transcendental empiricism” with Kant in mind, but there is also an important Sartrean element to his choice. In "The Self-Defeating Character of Skepticism," Douglas C. Long presents a transcendental argument against epistemological skepticism.' The argument has a distinctively Kantian flavor (though Long does not highlight this connection), in that it proceeds from the premise that I have self-knowledge and ends with the conclusion that I have perceptual knowledge of an objective, material subject of mental states. If the skeptic wishes to accept the transcendental argument's premise (as he seems to do), then he must reject his (...) claim that I lack knowledge of all propositions concerning my physical nature, history and environment. The falsity of this skeptical claim is a condition for the possibility of self-knowledge, according to Long's transcendental argument. Escolher ou aceitar para uma aula inaugural o tema da pragmática transcendental como "filosofia primeira" poderia parecer totalmente anacrônico. Anacrônico, porque afinal vivemos no século XX, estamos acabando o século, e outros problemas parecem muito mais urgentes. Anacrônico sobretudo, porque quem hoje arriscaria tentar renovar na realidade atual a pretensão originariamente grega da filosofia comei "filosofia primeira", quando isso significa levantar a pretensão de conhecer a totalidade ontológica do real em termos de razão e, portanto, de razão essencialmente metafísica? (...) Afinal, será que a filosofia, com a maturidade de seus quase vinte e seis séculos de existência, não estaria sentindo a saudade de suas origens? Não teríamos então que decretar também a morte da filosofia como "filosofia primeira" e voltar-nos para a grande complexidade da vida moderna e tentar humildemente reduzi-la, porque isso já seria uma grande conquista? E afinal, não é esse o sentir comum de hoje quando por toda parte se proclama o advento da pós-modernidade que, entre outras coisas, se deleita na desconstrução de toda uma cultura metafísica e universalista? A defence of the view that the introduction of transendental idealism, in the Dialectic of Aesthetic Judgment, plays a central role in resolving the antinomy which, as Kant contends, exists in our pure judgments of taste. It is further argued that the link that he holds to exist between the realms of nature and morality (or freedom) can only be successfully made out if transcendental idealism is accepted as underpinning our judgments concerning the beauties of nature.
