This selection of the major works of constitutional theory during the Weimar period reflects the reactions of legal scholars to a state in permanent crisis, a society in which all bets were off. Yet the Weimar Republic's brief experiment in constitutionalism laid the groundwork for the postwar Federal Republic, and today its lessons can be of use to states throughout the world. Weimar legal theory is a key to understanding the experience of nations turning from traditional, religious, or command-and-control forms (...) of legitimation to the rule of law. Only two of these authors, Hans Kelsen and Carl Schmitt, have been published to any extent in English, but they and the others whose writings are translated here played key roles in the political and constitutional struggles of the Weimar Republic. Critical introductions to all the theorists and commentaries on their works have been provided by experts from Austria, Canada, Germany, and the United States. In their general introduction, the editors place the Weimar debate in the context of the history and politics of the Weimar Republic and the struggle for constitutionalism in Germany. To examine the ethical duty to patients and families in the setting of the resuscitation bay, we address a case with a focus on providing optimal care and communication to family members. We present a case of nonsurvivable traumatic injury in a minor, focusing on how allowing family more time at the bedside impacts the quality of death and what duty exists to maintain an emotionally optimal environment for family grieving and acceptance. According to Slote's ``agent-based'' virtue ethics, the rightness orwrongness of an act is determined by the motive it expresses. Thistheory has a problem with cases where an agent can do her duty onlyby expressing some vicious motive and thereby acting wrongly. In sucha situation, an agent can only act wrongly; hence, the theory seemsincompatible with the maxim that `ought' implies `can'. I argue thatSlote's attempt to circumvent this problem by appealing to compatibilism is inadequate. Purpose Health misinformation poses severe risks to people’s health decisions and outcomes. A great deal of research in this area has focused on debunking misinformation and found limited effects of correctives after misinformation exposure. The research on prebunking strategies has been inadequate. Most has focused on forewarning and enhancing literacy skills and knowledge to recognize misinformation. Part of the reason for the inadequacy could be due to the challenges in conceptualizing and measuring knowledge. This study intends to fill this gap (...) and examines various types of knowledge, including subjective knowledge, cancer literacy, persuasion knowledge and media literacy. This study aims to understand how knowledge may moderate the effect of misinformation exposure on misbeliefs. Design/methodology/approach An online experiment with a basic experimental design (misinformation exposure: health misinformation vs factual health message) was conducted. The authors measured and tested the moderating role of different types of knowledge (subjective knowledge, cancer literacy, persuasion knowledge and media literacy) separately to improve the understanding of their role in combatting online health misinformation. Findings This study found that a higher level of cancer literacy and persuasion knowledge helped people identify misinformation and prevented them from being persuaded by it. A higher level of subjective knowledge, however, reduced the recognition of misinformation, thereby increasing the likelihood of being persuaded by it. Media literacy did not moderate the mediation path. Originality/value This study differentiates the role different types of knowledge may have played in moderating the influence of health misinformation. It contributes to a strategic development of interventions that better prepare people against the influence of health misinformation. (shrink)

The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. The English Franciscan, William of Ockham (c. 1285-1349), was one of the most important thinkers of the later middle ages. Summoned to Avignon in 1324 to answer charges of heresy, Ockham became convinced that Pope John XXII was himself a heretic in denying the complete poverty of Christ and the apostles and a tyrant in claiming supremacy over the Roman empire. Ockham's political writings were a result of these personal convictions, but also include systematic discourses on the basis and functions (...) of spiritual and secular power as well as exhaustive discussions of Franciscan poverty and the general problem of papal heresy. Ockham emerges in this study as a man deeply committed to natural and Christian human rights, who found these fundamental values so seriously menaced in his time that their survival could be assured only by radical, even revolutionary, personal action and by a basic reworking of traditional political thought. According to the thesis of transparency, subjects can attend only to the representational content of perceptual experience, never to the intrinsic properties of experience that carry this representational content, i.e., to “mental paint.” So far, arguments for and against transparency were conducted from the armchair, relying mainly on introspective observations. In this paper, we argue in favor of transparency, relying on the cognitive neuroscience of attention. We present a trilemma to those who hold that attention can be directed to mental (...) paint. Such attention is either first-order sensory, higher-order cognitive, or higher-order sensory attention. We argue that the notion of first-order sensory attention to mental paint is incompatible with the neuroscience of sensory attention; that higher-order cognitive attention to mental paint is irrelevant to transparency; and that the notion of higher-order sensory attention to mental paint has an apparently incoherent prediction. Via elimination, these considerations support the thesis of transparency. (shrink)

In At the Will of the Body , Arthur Frank told the story of his own illnesses, heart attack and cancer. That book ended by describing the existence of a "remission society," whose members all live with some form of illness or disability. The Wounded Storyteller is their collective portrait. Ill people are more than victims of disease or patients of medicine they are wounded storytellers. People tell stories to make sense of their suffering when they turn their diseases (...) into stories, they find healing. Drawing on the work of authors such as Oliver Sacks, Anatole Broyard, Norman Cousins, and Audre Lorde, as well as from people he met during the years he spent among different illness groups, Frank recounts a stirring collection of illness stories, ranging from the well-known--Gilda Radner's battle with ovarian cancer--to the private testimonials of people with cancer, chronic fatigue syndrome, and disabilties. Their stories are more than accounts of personal suffering: they abound with moral choices and point to a social ethic. Frank identifies three basic narratives of illness in restitution, chaos, and quest. Restitution narratives anticipate getting well again and give prominence to the technology of cure. In chaos narratives, illness seems to stretch on forever, with no respite or redeeming insights. Quest narratives are about finding that insight as illness is transformed into a means for the ill person to become someone new. (shrink)

Rational Sentimentalism develops a novel theory of the sentimental values. These values, which include the funny, the disgusting, and the shameful, are profoundly important because they set standards for emotional responses that are part of our shared human nature. Yet moral philosophers have neglected them relative to their prominence in human mental life. The theory is sentimentalist because it holds that these values are emotion-dependent—contrary to some prominent accounts of the funny and the disgusting. Its rational aspect arises from its (...) insistence that the shameful (e.g.) is not whatever elicits shame but what makes shame fitting. Shameful traits provide reasons to be ashamed that do not depend on whether one is disposed to be ashamed of them. Furthermore, these reasons to be ashamed issue in reasons to act as shame dictates: to conceal. Sentimentalism requires a compatible theory of emotion and emotional fittingness. The book explicates a motivational theory of emotion that explains the peculiarities of emotional motivation, as other theories cannot. It argues that a class of emotions are psychological kinds with the same goal across cultures, despite differences in their elicitors. It then develops an account of fittingness that helps to differentiate reasons of fit, which bear on the sentimental values, from other considerations for or against having an emotion. Some significant and controversial conclusions emerge from rational sentimentalism. The sentimental values conflict with one another, and with morality, but nevertheless provide practical reasons that apply to humans—though not to all rational agents. (shrink)

This book examines the hypothesis of "direct compositionality", which requires that semantic interpretation proceed in tandem with syntactic combination. Although associated with the dominant view in formal semantics of the 1970s and 1980s, the feasibility of direct compositionality remained unsettled, and more recently the discussion as to whether or not this view can be maintained has receded. The syntax-semantics interaction is now often seen as a process in which the syntax builds representations which, at the abstract level of logical form, (...) are sent for interpretation to the semantics component of the language faculty. In the first extended discussion of the hypothesis of direct compositionality for twenty years, this book considers whether its abandonment might have been premature and whether in fact direct compositionality is not after all a simpler and more effective conception of the grammar than the conventional account of the syntax-semantics interface in generative grammar. It contains contributions from both sides of the debate, locates the debate in the setting of a variety of formal theories, and draws on examples from a range of languages and a range of empirical phenomena. Philosophical discussions of akrasia over the last fifteen years have focused on certain skeptical arguments which purport to question the possibility of a kind of akratic action which, following Pears, I call 'last ditch akrasia' (Pears [38]). An agent, succumbing to last ditch akrasia, freely, knowingly, and intentionally performs an action A against his better judgment that an incompatible action B is the better thing to do. (See Audi [1] for a detailed analysis.) Last ditch akrasia is not the only (...) kind that has been discussed. Some philosophers (Mele [32], Scaltas [48]) have been concerned with a more extreme form of akratic action, viz. one in which the agent not only judges that action B is best, but in addition intends (chooses, decides) to B. Some have even questioned whether freely acting against one's better judgment is sufficient for akratic action (Schiffer [49]: 201-3).1 Weaker types of akratic action have been discussed, though to a much lesser extent, since they are thought less problematic. Pears distinguishes last ditch akrasia from what he calls, "motivated irrational action" ([38]: 160). In cases of the latter, the akrates' rebellious desire infects his prior reasoning and thinking in such a way that his contemplated action seems to him warranted, and he acts accordingly. (For a taxonomy of cases of akratic action, see Rorty ([44])). Nor has the discussion of akrasia been restricted to akratic action. Philosophers have discussed whether akrasia can be exhibited in the formation of intentions, wants (See Audi [1]: 181-185), and beliefs (Mele [32]: ch. 8; Heil [19]).
