In recent years, feminist theorists have examined the use of visual technologies in pregnancy and argued that these technologies are reconstructing the meaning of pregnancy. The imaged body of gestation can be deployed to distinguish and separate maternal and foetal interests. Drawing on this work, ‘Visibly Pregnant: Toward a placental body’ argues that the use of visual technology also obfuscates that which it purports to make clear. The images produced by these technologies in particular do not locate and acknowledge the (...) significance of the placenta as a point of connection and distinction for the gestating body. The possibilities suggested by a concentration on the placenta show how the morphology of the pregnant body itself rejects the distinction outlined in the technologically produced images of pregnancy and offers some new possibilities for thinking subjectivity. Legal judgment writing mobilises a process of story-telling, drawing on existing judicial discourses, precedents and practices to create a narrative relevant to the specific case that is articulated by the presiding judge. In the Feminist Judgments projects feminist scholars and activists have sought to challenge and reinterpret legal judgments that have disadvantaged, discriminated against or denied women’s experiences. This paper reflects on the process of writing as a feminist judge in the Australian Project, in an intimate homicide case, R v (...) Middendorp. Drawing on the work of Judith Butler on intelligibility, iterability and the communality of violence and vulnerability, this article argues that feminist judgments necessarily require some uncomfortable compromises with unjust gendered institutions. While ‘donning the robes’ may be an uncomfortable process, a feminist re-articulation of the law’s carceral power serves to unsettle and challenge some aspects of gendered oppression, even though it cannot unsettle the operation of the institution. The article concludes that effective feminist interventions by members of the judiciary may require donning robes that are not entirely comfortable in order to persuade and advocate for change. The visibility of pregnancy in contemporary societies through various forms of medical imaging has often been interpreted by feminist critics as negative for the autonomy and experience of pregnant women. Here, I consider the representation of pregnancy in Virginia Woolf’s novel, Orlando, and Sally Potter’s film of the same name arguing that, despite limited critical attention to Orlando’s pregnancy, these texts offer a productive interpretation of gestation that counters conventionally reductive cultural images of that embodied state. In particular, I argue (...) that Potter’s translation of Woolf’s novel to the screen gives us a useful model for thinking through the new visibility of pregnancy in contemporary Western culture. Feminist scholars have long argued that the pregnant body is erased – both literally and discursively – from mainstream foetal representations. Janemaree Maher argues that the placenta, as point of distinction and connection between pregnant women and foetuses, has the radical potential to refigure understandings of pregnant embodiment and subjectivity, and offer ‘a way to begin thinking through the impasse of pregnant representation’. Drawing on Maher's notion of the ‘placental body’, this article will examine the place of (...) the placenta in the practice of non-diagnostic 4D ultrasound scanning. The analysis seeks to connect Maher's theoretical perspective, and the rich feminist literature around foetal imaging, with observational data from my study of 4D scans. I will argue that the capacity of 3- and 4D sonography to image the placenta and umbilical cord in a way that is newly intelligible to lay viewers might present an opportunity for thinking differently about the interconnections – material and social – between pregnant women and foetuses and to relocate women as the subjects of their pregnancies. In this volume, Maher contextualizes the work of a group of contemporary analytic philosophers—The Pittsburgh School—whose work is characterized by an interest in the history of philosophy and a commitment to normative functionalism, or the insight that to identify something as a manifestation of conceptual capacities is to place it in a space of norms. Wilfrid Sellars claimed that humans are distinctive because they occupy a norm-governed "space of reasons." Along with Sellars, Robert Brandom and John McDowell have tried (...) to work out the implications of that idea for understanding knowledge, thought, norms, language, and intentional action. This study aims to use the Asian knowledge model “APO” as a determinant for performance excellence in universities and identifying the most effecting factors on it. This study was applied on Al-Azhar University in Gaza strip. The result of the study showed that (APO) model is valid as a measure and there are four dimensions in the model affecting significantly more than the others (university processes, KM leadership, personnel, KM outputs). Furthermore, performance excellence produced though modernizing the means of education, (...) curriculum development, technology and flexibility in the organizational structure. The study recommends expanding the usage of (APO) model, enhancing the role of knowledge leadership, technology, organizational flexibility, sharing culture and incentive systems that encouraging innovation. First published in Spanish in 2006, _Twenty Theses on Politics_ is a major statement on political philosophy from Enrique Dussel, one of Latin America’s—and the world’s—most important philosophers, and a founder of the philosophy of liberation. Synthesizing a half-century of his pioneering work in moral and political philosophy, Dussel presents a succinct rationale for the development of political alternatives to the exclusionary, exploitative institutions of neoliberal globalization. In twenty short, provocative theses he lays out the foundational elements for a politics (...) of just and sustainable coexistence. Dussel first constructs a theory of political power and its institutionalization, taking on topics such as the purpose of politics and the fetishization of power. He insists that political projects must criticize or reject as unsustainable all political systems, actions, and institutions whose negative effects are suffered by oppressed or excluded victims. Turning to the deconstruction or transformation of political power, he explains the political principles of liberation and addresses matters such as reform and revolution. _Twenty Theses on Politics_ is inspired by recent political transformations in Latin America. As Dussel writes in Thesis 15, regarding the liberation praxis of social and political movements, “The winds that arrive from the South—from Nestor Kirchner, Tabaré Vásquez, Luiz Inácio Lula da Silva, Evo Morales, Hugo Chávez, Fidel Castro, and so many others—show us that things can be changed. The _people _must reclaim sovereignty!” Throughout the twenty theses Dussel engages with Latin American thinkers and activists and with radical political projects such as the World Social Forum. He is also in dialogue with the ideas of Marx, Hegel, Habermas, Rawls, and Negri, offering insights into the applications and limits of their thinking in light of recent Latin American political thought and practice. In October 2009 I decided to stop doing philosophy. This meant, in particular, stopping work on the book that I was writing on the nature of probability. At that time, I had no intention of making my unfinished draft available to others. However, I recently noticed how many people are reading the lecture notes and articles on my web site. Since this draft book contains some important improvements on those materials, I decided to make it available to anyone who wants (...) to read it. That is what you have in front of you. The account of Laplace’s theory of probability in Chapter 4 is very different to what I said in my seminar lectures, and also very different to any other account I have seen; it is based on a reading of important texts by Laplace that appear not to have been read by other commentators. The discussion of von Mises’ theory in Chapter 7 is also new, though perhaps less revolutionary. And the final chapter is a new attempt to come to grips with the popular, but amorphous, subjective theory of probability. The material in the other chapters has mostly appeared in previous articles of mine but things are sometimes expressed differently here. I would like to say again that this is an incomplete draft of a book, not the book I would have written if I had decided to finish it. It no doubt contains poor expressions, it may contain some errors or inconsistencies, and it doesn’t cover all the theories that I originally intended to discuss. Apart from this preface, I have done no work on the book since October 2009. (shrink)

Anticolonial theorists and revolutionaries have long turned to dialectical thought as a central weapon in their fight against oppressive structures and conditions. This relationship was never easy, however, as anticolonial thinkers have resisted the historical determinism, teleology, Eurocentrism, and singular emphasis that some Marxisms place on class identity at the expense of race, nation, and popular identity. In recent decades, the conflict between dialectics and postcolonial theory has only deepened. In _Decolonizing Dialectics _George Ciccariello-Maher breaks this impasse by bringing (...) the work of Georges Sorel, Frantz Fanon, and Enrique Dussel together with contemporary Venezuelan politics to formulate a dialectics suited to the struggle against the legacies of colonialism and slavery. Americans have recently had thrust into their faces multiple media borne medical and social ethics dilemmas ranging from Dr. Kevorkian's euthanizing a patient on national television to payments by managed care providers for experimental medical treatments,to the nationally telecast situation which this paper will attempt to address. The case at hand concerns a minor in need of a repeat(third) kidney transplant who has been offered a kidney by her father. He also provided a kidney for her second kidney transplant some (...) years ago. The teenage girl went into her current kidney failure/organ rejection state because, feeling well, she stopped taking her antirejection medications. Her father appears to understand the consequences of this offer and is willing nonetheless to donate his remaining kidney to his daughter. His ex-wife and daughter want the kidney and will take it knowing what it will do to him. Of additional interest is that he is incarcerated as a prisoner for a crime for which he will be eligible for parole in the not distant future. This means that although altruistically self-induced, the State will become financially responsible for his medical care and dialysis treatments. This paper will attempt to analyze the competing issues presented by this dilemma and address the underlying conflict between the parameters patient autonomy, parental beneficence and the deontologically based responsibilities of the state and of the health care team. Maher, Anthony Review of: Transforming theology: Student experience and transformative learning in undergraduate theological education, by Les Ball ISBN 9781743240298, pp.177, pb, $44.95.

This book is a major contribution to decision theory, focusing on the question of when it is rational to accept scientific theories. The author examines both Bayesian decision theory and confirmation theory, refining and elaborating the views of Ramsey and Savage. He argues that the most solid foundation for confirmation theory is to be found in decision theory, and he provides a decision-theoretic derivation of principles for how many probabilities should be revised over time. Professor Maher defines a notion (...) of accepting a hypothesis, and then shows that it is not reducible to probability and that it is needed to deal with some important questions in the philosophy of science. A Bayesian decision-theoretic account of rational acceptance is provided together with a proof of the foundations for this theory. A final chapter shows how this account can be used to cast light on such vexed issues as verisimilitude and scientific realism. (shrink)

Dieser Aufsatz bringt eine Darstellung des Problems der Kontingenz, die mit Leibniz's Philosophie übereinstimmt und -vor allem -die den folgenden Bedingungen genügt: 1) einige Eigenschaften von Substanzen sind kontingent; 2) einige Eigenschaften von Substanzen sind notwendig; 3) das Gegenteil einer kontingenten Wahrheit impliziert keinen Widerspruch ; 4) es ist ein kontingentes Faktum, daß Gott immer das Beste wählt. -Eine Darstellung der Leibnizschen Theorie der Kontingenz muß diese Bedingungen erfüllen, denn bei ihnen handelt es sich um Prinzipien, an denen Leibniz -zumindest (...) in seinen späteren Schriften -festgehalten hat. Untersuchungen zu Leibniz' Theorie der Kontingenz neigen dazu, sich vor allem um eine Erfüllung der Bedingung 1 zu bemühen und die anderen unberücksichtigt zu lassen. In § 1 des Aufsatzes wird gezeigt, daß die Versuche, die Kontingenz auf die Möglichkeit der Nicht-Existenz zu gründen, entweder den Bedingungen 2 und 3 nicht genügen oder der Bedingung 4. In Nicomachean Ethics, Aristotle’s two forms of human happiness correspond to two forms of human virtue (moral and intellectual) and, I argue, to two forms of virtuous friendship (active and contemplative). I propose that the most properly human form of happiness is achieved in contemplative friendship. This friendship is a genuinely contemplative approximation of divine life and still a specifically human life consisting in discursivespeech with others. Contemplative friends wish the good to one another as human beings and thus fulfill (...) what friendship is more completely than do friends occupied with moral virtue. Aristotle’s text shows, first, that discussion and thinking can be shared more perfectly than can moral action and, second, that intellectual virtue completes human nature more fully than does moral virtue. This article approaches contemporary European debates on the subject of realism through the lenses offered by two decolonial thinkers: Fanon and Dussel. Whereas both share with realism a fundamental emphasis on reality as the starting point for theory – an assumption shared by much decolonial thought – they nevertheless provide another layer of specificity in their consideration of the colonial condition, diagnosing a fundamental absence of reciprocity that dictates the course of decolonization as a transformation of reality. Reconsidering the debates (...) on realism in light of these insights therefore provides a powerful basis for both formulating a specifically decolonial realism and for engaging in comparative political theorizing more generally. The idea that plants have minds can sound improbable, but some widely respected contemporary scientists and philosophers find it plausible. It turns out to be rather tricky to vindicate the presumption that plants do not have minds, for doing so requires getting clear about what plants can do and what exactly a mind is. By connecting the most compelling empirical work on plant behavior with philosophical reflection on the concept of minds, _Plant Minds _aims to help non-experts begin to think (...) clearly about whether plants have minds. Relying on current consensus ideas about minds and plants, Chauncey Maher first presents the best case for thinking that plants do _not_ have minds. Along the way, however, he unearths an idea at the root of that case, the idea that having a mind requires the capacity to represent the world. In the last chapter, he defends a relatively new and insightful theory of mind that rejects that assumption, making room for the possibility that plants do have minds, primarily because they are alive. This article sets out from an analysis of the pioneering work of Susan Buck-Morss to rethink, not only Hegel and Haiti, but broader questions surrounding dialectics and the universal brought to light by the Haitian Revolution. Reading through the lens of C.L.R. James’ The Black Jacobins , I seek to correct a series of ironic silences in her account, re-centering the importance of Toussaint’s successor, Jean-Jacques Dessalines, and underlining the dialectical importance of identitarian struggles in forging the universal. Finally, I (...) offer Frantz Fanon’s reformulation of the Hegelian master-slave dialectic—overlooked in Buck-Morss’ account—as a corrective that allows us to truly rethink progress toward the universal in decolonized dialectical terms. Can Bayesians make sense of the notion of acceptance? And should they want to? This paper argues that the answer to both questions is yes. While these answers have been defended before, the way of making sense of acceptance offered here differs from what others have proposed, and the reasons given for why Bayesians should want to make sense of acceptance are also different.

In Nicomachean Ethics, Aristotle discusses the relation between teachers and students during his treatment of “non-uniform friends.” These friends exchange goods differing in kind. Such friendships depend on the needs of the friends, and we are invited to ask whether some need induces a philosopher to teach a not-yet-philosophical student. In this paper I argue that the philosophical teacher does not approach his pupil out of need nor as he would approach a contemplative friend who is an equal. The teacher (...) chooses to benefit students as a morally virtuous human being would, although not as if his happiness depends upon their success in learning. A teacher is not an ordinary benefactor, intent upon seeing his power made actual in some other person. Aristotle’s philosophical teachers seem to be simultaneously more generous and less interested in their students. (shrink)
