Background:Ethical issues are increasingly being reported by care-providers; however, little is known about the nature of these issues within the nursing home. Ethical issues are unavoidable in healthcare and can result in opportunities for improving work and care conditions; however, they are also associated with detrimental outcomes including staff burnout and moral distress.Objectives:The purpose of this review was to identify prior research which focuses on ethical issues in the nursing home and to explore staffs’ experiences of ethical issues.Methods:Using a systematic (...) approach based on Aveyard (2014), a literature review was conducted which focused on ethical and moral issues, nurses and nursing assistants, and the nursing home.Findings:The most salient themes identified in the review included clashing ethical principles, issues related to communication, lack of resources and quality of care provision. The review also identified solutions for overcoming the ethical issues that were identified and revealed the definitional challenges that permeate this area of work.Conclusions:The review highlighted a need for improved ethics education for care-providers. Background:Palliative care is acknowledged as an appropriate approach to support older people in nursing homes. Ethical issues arise from many aspects of palliative care provision in nursing homes; however, they have not been investigated in this context.Aim:To explore the ethical issues associated with palliative care in nursing homes in the United Kingdom.Design:Exploratory, sequential, mixed-methods design.Methods:Semi-structured interviews with 13 registered nurses and 10 healthcare assistants (HCAs) working in 13 nursing homes in the United Kingdom were used to explore ethical issues in (...) palliative care. The ‘Ethical Issues in Palliative Care for Nursing Homes’ instrument was used to measure the frequency and level of distress arising from ethical issues through a cross-sectional survey with 69 registered nurses and 129 healthcare assistants. Data collection occurred between December 2014 and November 2015.Ethical considerations:Ethical approval was granted by Queen’s University’s School of Nursing and Midwifery Research Ethics Committee and governance sought from each nursing home’s manager.Findings:The interviews revealed three themes: ethical issues in practice; relational issues; and organisational issues. No significant differences between registered nurses and healthcare assistants were evident, confirming the patterns emerging from the interviews. Relational issues, primarily issues with residents and families, occurred most frequently and caused greater distress.Conclusion:The shared environment is key in the experience of ethical issues; therefore, multidisciplinary education is needed for ethical decision making in palliative care. Addressing staff knowledge and service organisation may reduce ethical issues locally and provide a benchmark for global change. (shrink)

This article explores, in the French context, an aspect of what Terence McLaughlin (1991) has described in an unpublished paper as the ‘dilemma of substantiality’ faced by any school system endeavouring to promote neutrality. In France, in order that the public or common school be genuinely open to all students, not only is the wearing of conspicuous religious symbols forbidden but so too is any direct teaching of religion. The cultural consequences resulting from this prohibition have led to the (...) mandating of cross-curricular teaching about religion. We can imagine him first conceding, and then qualifying, three propositions about himself: he mitigates the force of the first—that he was Eurocentric—with the counterproposition that the cities he wrote about were formative of a discourse that can be transposed to other cities whose patterns of urban development were shaped by forces analogous to those he studied in the period of their inception. He then concedes that his work on the city remains problematic in several ways related to an uncertain temperament and method, but urges the recognition that his method came to resemble his object of study; the fortuitous correspondence reinforces the self-reflexive relation between modern cities and the discourse they generate. The monitoring role performed by the board of directors is an important corporate governance control mechanism, especially in countries where external mechanisms are less well developed. The gender composition of the board can affect the quality of this monitoring role and thus the financial performance of the firm. This is part of the “business case” for female participation on boards, though arguments may also be framed in terms of ethical considerations. While the issue of board gender diversity has attracted growing (...) research interest in recent years, most empirical results are based on U.S. data. This article adds to a growing number of non-U.S. studies by investigating the link between the gender diversity of the board and firm financial performance in Spain, a country which historically has had minimal female participation in the workforce, but which has now introduced legislation to improve equality of opportunities. We investigate the topic using panel data analysis and find that gender diversity – as measured by the percentage of women on the board and by the Blau and Shannon indices – has a positive effect on firm value and that the opposite causal relationship is not significant. Our study suggests that investors in Spain do not penalise firms which increase their female board membership and that greater gender diversity may generate economic gains. (shrink)

Mainstream political liberalism holds that legal coercion is permissible only if it is based on reasons that all can share, access or accept. But these requirements are subject to well-known problems. I articulate and defend an intelligible reasons requirement as an alternative. An intelligible reason is a reason that all suitably idealized members of the public can see as a reason for the person who offers it according to that person’s own evaluative standards. It thereby permits reasons into public justification (...) that all cannot share, access, or accept, and so contrasts with standard approaches to public justification. The intelligible reasons requirement has two striking implications. First, it severs the connection between public justification and principles of deliberative restraint. Second, it pushes political liberals to appeal to other political processes to publicly justify law, specifically bargaining, adjudication, and social evolution. (shrink)

Affect-based theorists and life satisfaction theorists disagree about the nature of happiness, but agree about this methodological principle: a philosophical theory of happiness should be in line with the folk concept HAPPINESS. In this article, we present two empirical studies indicating that it is affect-based theories that get the folk concept HAPPINESS right: competent speakers judge a person to be happy if and only if that person is described as feeling pleasure/good most of the time. Our studies also show that (...) the judgement that a person is feeling pleasure/good most of the time reliably brings about the judgement that they are satisfied with their life, even if that person is described as not satisfied. We suggest that this direct causal relation between the concepts POSITIVE AFFECT and LIFE SATISFACTION might explain why many philosophers have been attracted to life satisfaction theories. (shrink)

Philosophers of science readily acknowledge that nonepistemic values influence the discovery and pursuit of scientific theories, but many tend to regard these influences as epistemically uninteresting. The present paper challenges this position by identifying three avenues through which nonepistemic values associated with discovery and pursuit in contemporary pollution research influence theory appraisal: (1) by guiding the choice of questions and research projects, (2) by altering experimental design, and (3) by affecting the creation and further investigation of theories or hypotheses. People seem to perceive and locate pains in bodily locations, but also seem to conceive of pains as mental states that can be introspected. However, pains cannot be both bodily and mental, at least according to most conceptions of these two categories: mental states are not the kind of entities that inhabit body parts. How are we to resolve this paradox of pain? In this paper, I put forward what I call the ‘Developmental Challenge’, tackling the second pillar of this (...) paradox, i.e. the introspectionist view of pain according to which genuine pain reports are introspective reports. This view forms an inconsistent triad with two other widely held positions: young children make genuine pain reports, and young children do not make introspective reports. After introducing the paradox and the introspectionist view of pain in part 1, I present the developmental challenge, and defend both and. I conclude that the inconsistent triad can only be resolved by reconsidering the introspectionist view of pain. In discussing three potential factors that lead to the puzzling intricacies of our concept of pain, I argue that the concept of pain might not be paradoxical after all. (shrink)

Despite its popularity and the fact that some think that phenomenal conservatism can provide a complete account of justification, it faces several challenges. Among these challenges are the need to provide accounts of defeaters and inferential justification. Fortunately, there is hope for phenomenal conservatism. Explanationism, the view on which justification is a matter of explanatory considerations, can help phenomenal conservatism with both of these challenges. The resulting view is one that respects (...) the internalist character of phenomenal conservatism and its motivating intuitions while providing an intuitive and elegant account of both inferential justification and the justificatory impact of defeaters. Conformity is an often criticized feature of human belief formation. Although generally regarded as a negative influence on reliability, it has not been widely studied. This paper attempts to determine the epistemic effects of conformity by analyzing a mathematical model of this behavior. In addition to investigating the effect of conformity on the reliability of individuals and groups, this paper attempts to determine the optimal structure for conformity. That is, supposing that conformity is inevitable, what is the best way for (...) conformity effects to occur? The paper finds that in some contexts conformity effects are reliability inducing and, more surprisingly even when it is counterproductive, not all methods for reducing its effect are helpful. These conclusions contribute to a larger discussion in social epistemology regarding the effect of social behavior on individual reliability. (shrink)

Work on a computer program called SMILE + IBP (SMart Index Learner Plus Issue-Based Prediction) bridges case-based reasoning and extracting information from texts. The program addresses a technologically challenging task that is also very relevant from a legal viewpoint: to extract information from textual descriptions of the facts of decided cases and apply that information to predict the outcomes of new cases. The program attempts to automatically classify textual descriptions of the facts of legal problems in terms of Factors, a (...) set of classification concepts that capture stereotypical fact patterns that effect the strength of a legal claim, here trade secret misappropriation. Using these classifications, the program can evaluate and explain predictions about a problem’s outcome given a database of previously classified cases. This paper provides an extended example illustrating both functions, prediction by IBP and text classification by SMILE, and reports empirical evaluations of each. While IBP’s results are quite strong, and SMILE’s much weaker, SMILE + IBP still has some success predicting and explaining the outcomes of case scenarios input as texts. It marks the first time to our knowledge that a program can reason automatically about legal case texts. (shrink)

Movements like the Arab Spring, Occupy Wall Street, and the Tea Party embody some of our deepest intuitions about popular politics and 'the power of the people'. They also expose tensions and shortcomings in our understanding of these ideals. We typically see 'the people' as having a special, sovereign power. Despite the centrality of this idea in our thinking, we have little understanding of why it has such importance. Imagined Sovereignties probes the considerable force that 'the people' exercises on our (...) thought and practice. Like the imagined communities described by Benedict Anderson, popular politics is formed around shared, imaginary constructs rooted in our collective imagination. This book investigates these 'imagined sovereignties' in a genealogy traversing the French Enlightenment, the Haitian Revolution, and nineteenth-century Haitian constitutionalism. It problematizes taken-for-granted ideas about popular politics and provokes new ways of imagining the power of the people. (shrink)

Taking a Sartrean existentialist viewpoint towards business ethics, in particular, concerning the question of the nature of businesspersons’ moral character, provides for a dramatically distinct set of reflections from those afforded by the received view on character, namely that of Aristotelian-based virtue ethics. Insofar as Sartre’s philosophy places human freedom at center stage, I argue that the authenticity with which a businessperson approaches moral situations depends on the degree of consciousness he or she has of the various choices at stake. Graham argues that political philosophy cannot fully understand race-related injustice without shifting its focus away from distributive inequities between whites and nonwhites and toward white supremacy, the unfair power relationships that allow whites to dominate and oppress nonwhites. In recent years, many scholars have suggested that the Baldwin effect may play an important role in the evolution of language. However, the Baldwin effect is a multifaceted and controversial process and the assessment of its connection with language is difficult without a formal model. This paper provides a first step in this direction. We examine a game-theoretic model of the interaction between plasticity and evolution in the context of a simple language game. Additionally, we describe three distinct aspects of (...) the Baldwin effect: the Simpson– Baldwin effect, the Baldwin expediting effect and the Baldwin optimizing effect. We find that a simple model of the evolution of language lends theoretical plausibility to the existence of the Simpson– Baldwin and the Baldwin optimizing effects in this arena, but not the Baldwin expediting effect. Thinking about truth can be more dangerous than it looks. Of course, our concept of truth is the source of one of the most frustrating and impenetrable paradoxes humans have ever contemplated, the liar paradox, but that is just the beginning of its treachery. In an effort to understand why one of the most beloved and revered members of our conceptual repertoire could cause us so much trouble, philosophers have for centuries proposed “solutions” to the liar paradox. However, it seems (...) that our concept of truth takes offense to our efforts to understand it because it appears to retaliate against those who propose “solutions” to the liar. It takes its revenge on us by creating new paradoxes from our own attempts to find resolution. That is, most proposed solutions to the liar paradox give rise to new, more insidious paradoxes—often called revenge paradoxes. For our attempts at understanding, truth rewards us with inconsistent theories, untenable logics, and a deep feeling of bewilderment. It is as if our concept of truth lashes out at us because it wants to remain a mystery. After a few run-ins with truth, many philosophers have the good sense to keep their distance. Far from being the serene, profound concept most people take it to be, those of us who think much about the liar paradox know truth to be a vengeful bully—a conceptual misanthrope. (shrink)

The nature of the relation between jurisprudential theories and first-order legal judgments is a strangely uncontroversial matter in contemporary legal philosophy. There is one dominant conception of the relation according to which jurisprudential theories are second-order or meta-legal theories that specify the ultimate grounds of first-order legal judgments. According to this conception, difficult first-order legal disputes are to be resolved by jurisprudential theorizing. According to an alternative conception that Ronald Dworkin has influentially advocated, jurisprudential theories are not second-order theories about (...) the nature of law, but instead covert first-order legal theories. These two conceptions of the relation between jurisprudential theories and first-order legal judgments dominate the contemporary legal philosophical scene and crowd out other possible conceptions. This article scrutinizes the two conceptions, and in the process raises the possibility of a different and arguably more credible conception. According to this new conception, our first-order legal views and a jurisprudential theory that we accept are supposed to form a mutually disciplining and supporting set of views that we accept in our pursuit of the epistemic ideal of wide reflective equilibrium. The two sets of views are supposed to constrain and discipline each other; but neither is meant to underwrite, certify, or ultimately determine the contents of the other. This new conception, which allows the relation between jurisprudential theories and first-order legal judgments to be much looser, untidier, and more complex than what the two dominant conceptions imply, should facilitate progress in legal philosophy and in first-order legal thinking. My primary aims in this paper are to give an overview of a recent movement which goes by the name of ‘analytic theology’, to locate that movement within the larger context of contemporary philosophy of religion, and to identify some of the weakness or objections that analytic theology will need to address moving forward. While I think that some of these objections have merit, I also think that the promise of analytic theology’s contribution to theology more broadly is, in my (...) view, sufficiently robust that we should continue to engage in it as a theological enterprise. Our ability to tell stories about ourselves has captivated many theorists, and some have taken these developments for an opportunity to answer long-standing questions about the nature of personhood. In this essay I employ two skeptical arguments to show that this move was a mistake. The first argument rests on the observation that storytelling is revisionary. The second implies that our stories about ourselves are biased in regard to our existing self-image. These arguments undercut narrative theories of identity, but they (...) leave room for a theory of narrative self-knowledge. The theory accommodates the first skeptical argument because there are event descriptions with retrospective assertibility conditions, and it accommodates the second argument by denying us epistemic privilege in regard to our own past. The result is that we do know our past through storytelling, but that it is a contingent feature of some of our stories that they are about ourselves. (shrink)

What did Jesus mean by the expression, the Kingdom of God? As an answer, Kevin Hart sketches a "phenomenology of the Christ" that explores the unique way Jesus performs phenomenology. According to Hart, philosophers and theologians continually reinterpret Jesus’s teaching of the Kingdom so that there are effectively many Kingdoms of God. Working in, while also displacing, a tradition inaugurated by Husserl and continued by philosophers such as Heidegger, Marion, and Lacoste, Hart puts forward a new phenomenology of religion (...) that claims that ethics and religion are not always unified or continuous. Accumulating evidence suggests that different magnitudes (e.g., number, size, and duration) are spatialized in the mind according to a common left–right metric, consistent with a generalized system for representing magnitude. A previous study conducted by two of us (Holmes & Lourenco, ) provided evidence that this metric extends to the processing of emotional magnitude, or the intensity of emotion expressed in faces. Recently, however, Pitt and Casasanto () showed that the earlier effects may have been driven by a left–right mapping (...) of mouth size rather than emotional magnitude, and they found no evidence for an emotional magnitude mapping when using words as stimuli. Here, we report two new experiments that further examine these conclusions. In Experiment 1, using face stimuli with mouths occluded, we replicate the original finding: Less emotional faces were associated with the left and more emotional faces with the right. However, we also find that people can reliably infer the sizes of the occluded mouths, and that these inferred mouth sizes can explain the observed left–right mapping. In Experiment 2, we show that comparative judgments of emotional words yield a left–right mapping of emotional magnitude not attributable to stimulus confounds. Based on these findings, we concur with Pitt and Casasanto that faces pose challenges for isolating the forces driving spatialization, but we suggest that emotional magnitude, when assessed using unconfounded stimuli in a sufficiently sensitive task, may indeed be spatialized as originally proposed. Suggestions for further research on the spatialization of emotional magnitude are discussed. (shrink)

This paper is a critical discussion of Manuel Vargas’ Building Better Beings, focusing on the treatment of desert therein. By means of an analogy between morality and sport, I examine some seemingly peculiar implications of Vargas’ teleological and revisionary account of desert. I also consider some general questions of philosophical methodology provoked by revisionary approaches.

This study presents the results of an empirical analysis of the relationship between managerial thinking style and ethical decision-making. Data from 200 managers across multiple organizations and industries demonstrated that managers predominantly adopt a utilitarian perspective when forming ethical intent across a series of business ethics vignettes. Consistent with expectations, managers utilizing a balanced linear/nonlinear thinking style demonstrated a greater overall willingness to provide ethical decisions across ethics vignettes compared to managers with a predominantly linear thinking style. However, results comparing (...) the ethical decision-making of balanced thinking managers and nonlinear thinking managers were generally inconsistent across the ethics vignettes. Unexpectedly, managers utilizing a balanced linear/nonlinear thinking style were least likely to adopt an act utilitarian rationale for ethical decision-making across the vignettes, suggesting that balanced thinkers may be more likely to produce ethical decisions by considering a wider range of alternatives and ruling out those that are justified solely on the basis of their outcomes. Implications are discussed for future research and practice related to management education and development, and ethical decision-making theory. (shrink)

“Digital footprints” is an attractive, useful, and increasingly popular metaphor for thinking about Big Data. In this essay, I elaborate on this metaphor to highlight three relatively basic fallacies in the way we tend to think about Big Data: first, that they contain information on complete populations, or “N = all”; second, that they contain recordings of naturalistic behavior; and third, that they can be understood devoid of context.

Phenomenology was in large part the discovery of Edmund Husserl, whose Logical Investigations of 1900/01 are normally regarded as the work that launched the phenomenological movement. Yet Husserl's phenomenology, in particular in the form in which it is set out in this his most important contribution to philosophy, is itself part of an Austrian philosophical tradi tion inspired by Brentano and continued, in very different ways, by Meinong, Stumpf, Twardowski, Ehrenfels, Husserl - and Marty. Like Brentano and all his heirs (...) Marty's philosophical interests were in the philosophy of mind, where this is taken to include or at least ground the philosophy of language, and analytic metaphysics. It is Marty's discussions of topics in these two areas that provide the contributions to this volume with their subject-matter. The papers by Roderick Chisholm, S. -Y. Wonder’s significance is a recurrent theme in the history of philosophy. In the Theaetetus, Plato’s Socrates claims that philosophy begins in wonder (thaumazein). Aristotle echoes these sentiments in his Metaphysics; it is wonder and astonishment that first led us to philosophize. Philosophers from the Ancients through Wittgenstein discuss wonder, yet scant recent attention has been given to developing a general systematic account of emotional wonder. I develop an account of emotional wonder and defend its connection with apparent or seeming value. (...) Recently, several philosophers invoke wonder to back non-eudaimonistic value judgments. I introduce methods to incorporate these judgments into a eudaimonistic moral framework. On the analysis presented, wonder requires its object to seem valuable, but whether the object is in fact valuable remains an open question. Wonder enraptures us with objects that might be of true or merely illusory value, grounded either in our own well-being or in non-eudaimonistic value. (shrink)

This paper seeks to uncover and rationally reconstruct four theoretical prescriptions that H. L. A. Hart urged philosophers to observe and follow when investigating and theorizing about the nature of law. The four prescriptions may appear meager and insignificant when each is seen in isolation, but together as an inter-connected set they have substantial implications. In effect, they constitute a central part of Hart's campaign to put philosophical investigations about the nature of law onto a path to a genuine research (...) program. The paper takes note of certain prevalent and robust trends in contemporary legal philosophy that detract its practitioners from the four prescriptions, and that have them revert to the some older modes of thinking from which Hart sought a decisive break. Recent philosophical literature has highlighted the complexities of handling dissent in science. On one hand, scientific dissent can be very harmful, as when “merchants of doubt” strategically appeal to dissent in order to undermine important environmental and public-health initiatives. On the other hand, scientific dissent can also be beneficial when it helps to promote scientific objectivity, progress, and public engagement. Some authors have responded to this tension by suggesting criteria for distinguishing normatively appropriate and inappropriate dissent, while other authors have (...) suggested that it is more fruitful to alter the social context in which science operates in order to alleviate the negative effects of dissent over the long term. This paper proposes another approach that may be helpful for managing particularly challenging cases of scientific dissent. It argues that instances of scientific dissent often incorporate debates over value judgments, so many difficult cases of dissent can be navigated by: (1) identifying and highlighting those value judgments; and (2) managing those value judgments by drawing strategies from the extensive literature on values and science. The paper illustrates this approach by examining a case study of dissent over the treatment of long-term symptoms associated with Lyme disease. (shrink)

Some philosophers have recently argued that contrary to the traditional view, good scientific theories can in fact be logically inconsistent. The literature is now full of case-studies that are taken to support this claim. I will argue however that as of yet no-one has managed to articulate a philosophically interesting view about the role of logically inconsistent theories in science that genuinely goes against tradition, is plausibly true, and is supported by any of the case studies usually given.

In three studies, we examined the relationship between implicit negotiation beliefs, moral disengagement, and a negotiator’s ethical attitudes and behavior. Study 1 found correlations between an entity theory that negotiation skills are fixed rather than malleable, moral disengagement, and appropriateness of marginally ethical negotiation tactics. Mediation analysis supported a model in which moral disengagement facilitated the relationship between entity theory and support for unethical tactics. Study 2 provided additional support for the mediation model in a sample of MBA students, whereby (...) predispositions to morally disengage mediated the effect of dispositional entity beliefs on unethical behavior in a negotiation exercise. In study 3, we manipulated implicit beliefs prior to a negotiation simulation and found that entity beliefs predict deception through two sequential mediators, extreme opening bids and state moral disengagement.
