National electronic health record initiatives are in progress in many countries around the world but the debate about the ethical issues and how they are to be addressed remains overshadowed by other issues. The discourse to which all others are answerable is a technical discourse, even where matters of privacy and consent are concerned. Yet a focus on technical issues and a failure to think about ethics are cited as factors in the failure of the UK health record system. In (...) this paper, while the prime concern is the Australian Personally Controlled Electronic Health Record (PCEHR), the discussion is relevant to and informed by the international context. The authors draw attention to ethical and conceptual issues that have implications for the success or failure of electronic health records systems. Important ethical issues to consider as Australia moves towards a PCEHR system include: issues of equity that arise in the context of personal control, who benefits and who should pay, what are the legitimate uses of PCEHRs, and how we should implement privacy. This study investigates the increased commercialization of African indigenous vegetables (AIV)—former subsistence crops such as African nightshade, cowpea leaves and amaranth species grown mainly by women—from a feminist economics perspective. The study aims to answer the following research question: How does AIV commercialization affect the gendered division of labor, women’s participation in agricultural labor, their decision-making power, and their access to resources? We analyze commercialization’s effects on gender relations in labor and decision-making power and also highlight women’s agency. Based on (...) a mixed method design and analyzing household-level panel data and qualitative focus groups from Kenya, we observe an economic empowerment of women that we relate to women’s individual and collective strategies as well as their retention of control over AIV selling and profits. Yet, while we see economic empowerment of women through commercialization—how they broaden their scope of action and are empowered by generating revenue—that does not contribute to a redistribution of labor or land rights, which are key for gender equality, instead it increases women’s labor burden. In real-time, Twitter strongly imprints world events, popular culture, and the day-to-day; Twitter records an ever growing compendium of language use and change; and Twitter has been shown to enable certain kinds of prediction. Vitally, and absent from many standard corpora such as books and news archives, Twitter also encodes popularity and spreading through retweets. Here, we describe Storywrangler, an ongoing, day-scale curation of over 100 billion tweets containing around 1 trillion 1-grams from 2008 to 2020. For each day, we (...) break tweets into 1-, 2-, and 3-grams across 150+ languages, record usage frequencies, and generate Zipf distributions. We make the data set available through an interactive time series viewer, and as downloadable time series and daily distributions. Only the most blinkered polemicist could nowadays attack "Marxist criticism" as if it presented a uniform front or even a clearly delineated target. Differences of oudook have developed to a point where debates within (...) Marxism are often more highly charged and polarized man anything brought to bear by its downright opponents. These differences will seem a crippling liability only from the viewpoint of a hard-line determinist creed which insists both on the rightness of its own reductive methodology and on a one-track notion of historical necessity and reason. The alternative, as New Left theorists have argued, is to examine the diversity of present-day Marxist thinking and show how its manifold traditions take rise from various backgrounds of political and cultural development. Perry Anderson's Considerations on Western Marxism is one such attempt to "situate" the work of thinkers like Sartre, Almusser, and Adorno in terms of their beleaguered position as left intellectuals outside the active mainstream of any revolutionary movement.1 Another example is Terry Eagleton's Criticism and Ideology, a book which sets out to rethink the bases of a Marxist-theoretical approach to English literary history.2 Eagleton, like Anderson, takes it as axiomatic that no such critique can get underway without first coming to terms with the problems and dilemmas which others have faced in trying to make new sense of a communal enterprise. For Eagleton this means a diagnostic treatment of the gaps and significant sUences which have marked the texts of those — like Arnold or Leavis — engaged in a class-based mystification ofliterary history and values. The critique extends to what Eagleton sees as the inbuilt problems of a homespun British Marxism, whedier of the crudely determinist variety (Caudwell) or the "left-Leavisite" amalgam of radical mêmes and traditionalist assumptions represented by Raymond Williams. Eagleton's approach lays claim to a power of unmasking die 15 16Philosophy and Literature latent ideology at work both in literary and critical texts. Ramer than simply collapse that distinction — as desired by the current post-structuralists, with whom he is wholly out of sympadiy — Eagleton strives to articulate the different structures and relations of discourse which situate criticism vis-à-vis literary history. All but the youngest readers of this journal will recognize him as a member of the now defunct Yale School of Criticism, which in its glory days included (...) Harold Bloom, Hillis Miller, Paul de Man, and Jacques Derrida. Among these accomplished individuals, Hartman distinguished himself as the one most engaged with discussing the role of style in theoretically propelled criticism, and this remains his lasting contribution. The question he kept asking was the following: what demands do the books we read and the theories we use make on our own critical practice, and in particular, on our style? Works such as Criticism in the Wilderness (1980) and Saving the Text (1981) were concerned with promoting a philosophical criticism that is as creative as the literature it seeks to criticize, in opposition to the Arnoldian standard of a disinterested criticism that respects and preserves the canonical hauteur of literary classics and doesn't seek to imitate them. Yet over the decades Hartman's own prose, except when it lapsed into copying Derrida's, seemed more that of the Doctor and less the Explorer, to borrow the terms Lionel Trilling used to describe Matthew Arnold's criticism. This is an irony we are grateful for.Hartman's most recent book, Scars of the Spirit, takes up the problem of authenticity in the context of postmodern culture, seeking to reestablish its legitimacy as a serious topic and unmask what merely poses as authentic in the global marketplace. Today his agenda ignominiously crosses paths with the likes of Jane Fonda, whose autobiography is replete with New Age claims to recover "the authentic me." One of the issues never resolved by Hartman's book and which taunts his project behind its back is whether his Continental erudition makes his project any more authentic than Fonda's celebrity psychobabble. Authenticity was the Heideggerian concept that Adorno ruthlessly and ironically attacked in his The Jargon of Authenticity, and it has an old-fashioned existential ring to it to this day. For those readers who haven't read Being and Time lately, authenticity (Jemeinigkeit) was the resolute impetus of making time one's own, taking it back from the instrumental public world that had appropriated it so that one can live a sincerely mortal life and die one's own death, as it were properly. Professors valiantly conjured an ethic out of this retrieval of selfhood, of one's personal property of time and destiny in the Lost and Found of culture, not fully cognizant of its Nietzschean roots. The absence of altruism in this existential ethic inspired Emmanel Levinas's patient attempt to persuade us to demote our egoism in an insatiable responsibility to and for others, for whom we can never do enough.There is surely irony in the fact that the anachrony of authenticity as a concept was accelerated by the deconstructive theory that Hartman helped [End Page 501] promulgate. Hence his new book reads a bit like someone having to gingerly retrace his steps in a field of landmines planted by the Yale School of Criticism. The question of propriety, what is right and proper, what is one's own, stamped with one's unique or authentic properties, was deconstructed by Derrida, and Hartman reverently recorded the results in the incongruously titled Saving the Text, an analysis of Derrida's attempt to promote textual intercourse between Hegel and Jean Genet by setting them in parallel columns on one page. In a nutshell, the original source of an event or text, its material advent, is untraceable due to its derivativeness, the forces of semiosis (or textuality) at play in and between texts. In parallel to this discovery, Jean Baudrillard spoke of the simulacrum as a media-generated version behind which the original "thing itself" was forever irrecoverable. The first part of the article (§§ 1-3) illustrates the critical relation the authors establish with the leading figures of philosophical anthropology in terms of their engagement with “world-openness” (Weltoffenheit). This notion cannot be reduced to the objectivity that confronts man as a spiritual being, as in Max Scheler, but rather makes it possible to grasp the limits of distancing objectification; in Arnold Gehlen, the coercion to action derived from the indeterminacy of man’s relation with the world is not (...) sufficient to comprehend the role of culture for the constitution of the human animal itself; and with the biological means utilized by Helmuth Plessner it is not possible to account entirely for the human capacity to establish relations by means of society. Historical anthropology, as the second part (§§ 4-5) of the article shows, aims to respond to such deficiencies by bringing to light the numerous historical and cultural forms of openness to a plurality of worlds. In an age where issues like climate change and the unintended consequences of technological innovation are high on the ethical and political agenda, questions about the nature and extent of our responsibilities to future generations have never been more important, yet simultaneously so difficult to answer. This book takes a unique approach to the problem by drawing on diverse traditions of thinking about care (including developmental psychology, phenomenology and feminist ethics) to explore the nature and meaning of our relationship with (...) the future. Demonstrating that many influential perspectives on intergenerational ethics, including positions advanced by John Rawls, Brian Barry, and Ulrich Beck are undermined by problems relating to uncertainty, it shows that an approach based on care ethics can confront the uncertain future successfully and give a viable account of the nature and scope of future-oriented responsibilities. ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. This paper is an approach to the context in which Dawson's work originated as well as to the main critiques of the works by Oswald Spengler, Arnold Toynbee and Thomas S. Eliot, with whom he differed on how to address the study of culture. The contrasts between Dawson and the views of these authors are significant and help to refine the concept of culture Dawson used in his philosophy. Suppose we believe that God created the world. Then surely we want it to be the case that he intended, in some sense at least, to create THIS world. Moreover, most theists want to hold that God didn't just guess or hope that the world would take one course or another; rather, he KNEW precisely what was going to take place in the world he planned to create. In particular, of each person P, God knew that P was to exist. (...) Call this the "standard" conception. Most theists find the standard conception appealing. Unfortunately, the view seems to conflict with the equally appealing idea — call it "temporal actualism" — that there are no "future" individuals beyond those that already exist in the present moment. For, on this view, for any historical person P, prior to creation, there was no such person as P and hence nothing about P for God to know. Hence, in particular, God couldn't have known that P was to exist. This is of course not a new problem. But past solutions to it are highly problematic. In this paper, after canvassing previous approaches, I will propose a solution that seems to preserve both temporal actualism and a suitably robust form of the standard conception while avoiding the pitfalls of the past. This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. Auch seine letzte Monographie Moral und Hypermoral sah Gehlen in der direkten Nachfolge seines anthropologischen Hauptwerkes Der Mensch. Insofern verstand er seinen Entwurf einer pluralistischen Ethik als Konkretisierung seiner Lehre vom Menschen. In diesem Buch, das eine Genealogie der Moralen entwickeln will, stellte sich Gehlen die Aufgabe, Anthropologie, Verhaltensforschung und Soziologie so zu verbinden, dass vier voneinander nicht ableitbare Ethosformen empirisch freigelegt werden konnten: von einem aus der aGegenseitigkeit entwickelten Ethos uber Eudaimonismus und Humanitarismus bis hin zu einem Ethos der (...) Institutionen einschliesslich des Staates. Gehlen wollte der abstrakten Ethik der Aufklarung widersprechen, wie sie beispielsweise in Voltaires Diktum zum Ausdruck kam, nach welchem es nur eine Moral gebe, so wie es nur eine Geometrie gibt. Systematisch geht es in erster Linie um eine anthropologische Begrundung der Ethik, d.h. um eine Mehrheit moralischer Instanzen und Sozial-Regulationen. Diese werden nicht evolutionar interpretiert, d.h. als Fortschritt von der Nahethik zu einer schliesslich weltumspannenden Moralitat. Manche Moralen konnen als instinktnah angenommen werden, andere ergeben sich aus den Notwendigkeiten bestimmter Institutionen. Immer jedoch sind sie kulturell geformt und zugleich auf unterschiedlichen Ebenen der Abstraktion angesiedelt. Es bleibt im Zuge einer neuerlichen Rezeption von Moral und Hypermoral die These zu prufen, ob die Modellvorstellung eines unversohnlichen Pluralismus moralischer Normen eine Dimension des Ethischen zum Ausdruck bringt, die in den evolutiven Konzepten der ethischen Anpassung an je hohere gesellschaftliche Synthesen unterschatzt wird. Insofern gehort dieses Buch in den Zusammenhang einer philosophisch-soziologischen Grundlagenforschung, wie sie seit Max Scheler und Helmuth Plessner als Philosophische Anthropologie durchgefuhrt wurde und welche Arnold Gehlen - von den Elementarbestanden der menschlichen Existenz bis zur Analyse der modernen Malerei - mit so viel Sachhaltigkeit weiterverfolgt hat. Christopher Hookway presents a series of studies of themes from the work of the great American philosopher and pragmatist, Charles S. Peirce (1839-1913). These themes center on the question of how we are to investigate the world rationally. Hookway shows how Peirce's ideas about this continue to play an important role in contemporary philosophy.

Moral error theories are often rejected by appeal to ‘companions in guilt’ arguments. The most popular form of companions in guilt argument takes epistemic reasons for belief as a ‘companion’ and proceeds by analogy. I show that this strategy fails. I claim that the companions in guilt theorist must understand epistemic reasons as evidential support relations if her argument is to be dialectically effective. I then present a dilemma. Either epistemic reasons are evidential support relations or they are not. If (...) they are not, then the companions in guilt argument fails. If they are, then a reduction of epistemic reasons to evidential support relations becomes available and, consequently, epistemic reasons cease to be a viable ‘companion’ for moral reasons. I recommend this structure of argument over existing strategies within the literature and defend my claims against recent objections from companions in guilt theorists. (shrink)

An epistemology of art has seemed problematic mainly because of arguments claiming that an essential element of a theory of knowledge, truth, has no place in aesthetic contexts. For, if it is objectively true that something is beautiful, it seems to follow that the predicate “is beautiful” expresses a property – a view asserted by Plato but denied by Hume and Kant. But then, if the belief that something is beautiful is not objectively true, we cannot be said to know (...) that something is beautiful and the path to an epistemology of art is effectively blocked. The article places the existence aesthetic properties in the proper context; presents a logically correct argument for the existence of such properties; identifies strategies for responding to this argument; explains why objections by Hume, Kant, and several other philosophers fail; and sketches a realization account of beauty influenced by Hogarth. ABSTRACT:We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. Imagine that you and a duplicate of yourself are lying unconscious, next to each other, about to undergo a complete step-by-step exchange of bits of your bodies. It certainly seems that at no stage in this exchange of bits will you have thereby switched places with your duplicate. Yet it also seems that the end-result, with all the bits exchanged, will be essentially that of the two of you having switched places. Where will you awaken? I claim that one and (...) the same person possesses both bodies, occupies both places and will experience both awakenings, just as a person whose brain has been bisected must at once experience both of the unconnected fields of awareness, even though each of these will falsely appear to him as the entirety of his experience. I also claim that the more usual apparent boundaries of persons are as illusory as those in brain bisection; personal identity remains unchanged through any variation or multiplication of body or mind. In all conscious life there is only one person - I - whose existence depends merely on the presence of a quality that is inherent in all experience - its quality of being mine, the simple immediacy of it for whatever is having experience. One powerful argument for this is statistical: on the ordinary view of personhood it is an incredible coincidence for you (though not for others) that out of 200,000,000 sperm cells the very one required on each occasion for your future existence was first to the egg in each of the begettings of yourself and all your ancestors. The only view that does not make your existence incredible, and that is not therefore (from your perspective) an incredible view, is that any conscious being would necessarily have been you anyway. It is a consequence that self-interest should extend to all conscious organisms. (shrink)

Without access to Michel Foucault’s courses, it was extremely difficult to understand his reorientation from an analysis of the strategies and tactics of power immanent in the modern discourse on sexuality (1976) to an analysis of the ancient forms and modalities of relation to oneself by which one constituted oneself as a moral subject of sexual conduct (1984). In short, Foucault’s passage from the political to the ethical dimension of sexuality seemed sudden and inexplicable. Moreover, it was clear from his (...) published essays and interviews that this displacement of focus had consequences far beyond the specific domain of the history of sexuality. Security, Territory, Population (Foucault, 2007) contains a conceptual hinge, a key concept, that allows us to link together the political and ethical axes of Foucault’s thought. Indeed, it is Foucault’s analysis of the notions of conduct and counter-conduct in his lecture of 1 March 1978 that seems to me to constitute one of the richest and most brilliant moments in the entire course. It is astonishing, and of profound significance, that the autonomous sphere of conduct has been more or less invisible in the history of modern (as opposed to ancient) moral and political philosophy.
