In this paper, I argue that an adequate understanding of Husserl’s late ethics of love requires careful consideration of the Neo-Kantian milieu in Southwest Germany. After discussing some general aspects of the contextualization of Husserl’s phenomenology and, in particular, Husserl’s ethics, I move to consider his transition from an action-centered to a life-centered conception of ethics. I show that this transition is largely indebted to Georg Simmel’s critique of Kant’s practical philosophy. Name any valued human trait—intelligence, wit, charm, grace, strength—and you will find an inexhaustible variety and complexity in its expression among individuals. Yet we insist that such diversity does not provide grounds for differential treatment at the most basic level. Whatever merit, blame, praise, love, or hate we receive as beings with a particular past and a particular constitution, we are always and everywhere due equal respect merely as persons. -/- But why? Most who attempt to answer this question appeal (...) to the idea that all human beings possess an intrinsic dignity and worth—grounded in our capacities, for example, to reason, reflect, or love—that raises us up in the order of nature. Andrea Sangiovanni rejects this predominant view and offers a radical alternative. -/- To understand our commitment to basic equality, Humanity without Dignity argues that we must begin with a consideration not of equality but of inequality. Rather than search for a chimerical value-bestowing capacity possessed to an equal extent by each one of us, we ought to ask: Why and when is it wrong to treat others as inferior? Sangiovanni comes to the conclusion that our commitment to moral equality is best explained by a rejection of cruelty rather than a celebration of rational capacity. Does the recent publication of Heidegger’s Black Notebooks require a re-evaluation of his thought? In the present text we will deal with this question and reach the conclusion that a change of theoretical perspective on Heidegger’s work is indeed justified. The franker and less cautious style of the Black Notebooks puts in the foreground stances that were already known, but were previously relegated to the background: it becomes possible thereby to establish that Heidegger’s philosophical views host a significant lot of (...) unwarranted prejudices, which are incorporated in his picture of the ‘history of being’. We argue that in his process of radical questioning Heidegger progressively drops all available rational methods and epistemic criteria, and that this paves the way to the unwitting reception of personal prejudices in his theoretical frame: Heidegger knowingly abandons all the theoretical instruments that could enable him to discriminate between deeply felt prejudices and proper philosophical intuitions. We conclude our analysis by proposing some criticisms that should be acceptable also to scholars sympathetic with Heidegger’s thought. Heidegger’s vindication of an ‘erratic’ way of thinking, where the journey is more qualifying than the result, turns out to be incompatible with the assertiveness of the many unjustified claims disseminated across the Black Notebooks. Moreover, Heidegger wants to show the narrowness of an overwhelmingly dialectical and argumentative attitude, while his late style of thinking unwittingly discredits an alternative philosophical style, that widely appeals to a ‘principle of charity’ in the collaboration between author and reader. Several attempts have been made previously to provide a biological grounding for cognitive architectures by relating their components to the computations of specific brain circuits. Often, the architecture's action selection system is identified with the basal ganglia. However, this identification overlooks one of the most important features of the basal ganglia—the existence of a direct and an indirect pathway that compete against each other. This characteristic has important consequences in decision-making tasks, which are brought to light by Parkinson's disease as (...) well as genetic differences in dopamine receptors. This paper shows that a standard model of action selection in a cognitive architecture cannot replicate any of these findings, details an alternative solution that reconciles action selection in the architecture with the physiology of the basal ganglia, and extends the domain of application of cognitive architectures. John Christman has argued that constitutively relational accounts of autonomy, as defended by some feminist theorists, are problematically perfectionist about the human good. I argue that autonomy is constitutively relational, but not in a way that implies perfectionism: autonomy depends on a dialogical disposition to hold oneself answerable to external, critical perspectives on one's action-guiding commitments. This type of relationality carries no substantive value commitments, yet it does answer to core feminist concerns about autonomy.

This paper reports on the findings of a qualitative study to understand how active adherence to the Christian faith influences the way SME owner-managers conceptualise their business practices. The study was based on in-depth interviews with 21 Christian SME owner-managers in Germany and the UK. Using a socio-psychological approach, the data analysis yielded a range of linguistic and conceptual resources that are peculiar to Christian discourse and that have the potential to influence business activity in rather distinctive ways. This paper (...) particularly focuses on those Christian concepts that could be regarded as distinct 'frames' for action. It outlines what effect these concepts had on the respondents and how they were related to business practices. The paper also discusses how this study could inform further research into the influence of other socio-cultural forms of identity on economic actors' conceptualisations of their own practice. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. Simondon adopts some concepts of social psychology as ‘in group’ and ‘out group’, namely from Kurt Lewin and Gordon Allport, that allow him to describe the fundamental processes shaping the domain of collective individuation, and to challenge Bergson’s distinction between a ‘closed’ community and an ‘open’ society. Reconstructing Simondon’s sources is necessary to understand how he tries to provide an analysis of the social system without presupposing a given anthropology, but rather exploring different perspectives on the human/nature threshold through the (...) concept of transindividual. In his study of the social system Simondon progressively gives conceptual shape to the processes he calls transindividual thanks to the ontogenetic analysis of the phenomena of belief, work and language. In all these domains, a ‘basic community’ emerges just over the threshold of the biological group, where the structural ambivalence of all collective processes as simultaneously closed and open becomes clear. That is why Simondon does not present the concept of the transindividual as a solution to the epistemological problem of psychic and collective individuation, but rather as the ‘field’ in which a whole series of social, biological and technical dimensions can be made converge towards a science of anthropogenic processes. Both Aristotle and Kant note that the highest form of friendship enables individuals of good virtue to reveal themselves to one another. I argue that Aristotle and Kant emphasize complementary aspects of self-disclosure in friendship: whereas Kant acknowledges the inherent value of self-disclosure in friendship, Aristotle suggests that joint perception in friendship is instrumentally valuable in the acquisition of self-knowledge. I also argue that although Aristotle has a more developed account of friendship, Kant advances a superior account of self-disclosure in (...) friendship in his later remarks on friendship in the Metaphysical Principles of Virtue. The present essay provides a new metaphysical interpretation of Relational Quantum Mechanics (RQM) in terms of mereological bundle theory. The essential idea is to claim that a physical system in RQM can be defined as a mereological fusion of properties whose values may vary for different observers. Abandoning the Aristotelian tradition centered on the notion of substance, I claim that RQM embraces an ontology of properties that finds its roots in the heritage of David Hume. To this regard, defining what (...) kind of concrete physical objects populate the world according to RQM, I argue that this theoretical framework can be made compatible with (i) a property-oriented ontology, in which the notion of object can be easily defined, and (ii) moderate structural realism, a philosophical position where relations and relata are both fundamental. Finally, I conclude that under this reading relational quantum mechanics should be included among the full-fledged realist interpretations of quantum theory. (shrink)

Anecdotal evidence has long lamented the status of social studies in elementary classrooms as observed by preservice teachers. As standardized testing has risen for mathematics and language arts, social studies has been pushed aside. In the aftermath of accountability legislation such as No Child Left Behind, research indicates that social studies is less visible in elementary classrooms due to an instructional focus on tested content areas (e.g. math, language arts, reading). In this study, approximately 90 elementary preservice teachers enrolled in (...) a social studies methods course responded to a survey and indicated the frequency and quality of lessons they observed over the course of a single semester. Findings report that preservice elementary teachers witnessed few, if any, lessons in social studies in the elementary classroom. Implications for teacher education are discussed. (shrink)

The demand for social justice, especially in the context of the welfare state, is often framed as a demand of solidarity. But it is not clear why: in what sense, if any, is social justice best understood as a demand of solidarity? This article explores that question. There are two reasons to do so. First, very little has been written on the concept of solidarity, and almost nothing on why and how solidarity can both give rise to and be the (...) target of a moral obligation. The first aim of the article is to fill this gap. The second aim of the article is to explore the normative implications of this account of solidarity for the commitment to social justice at the heart of the welfare state, and in so doing, to put into question the idea that shared experience or shared identity are either necessary or sufficient bases for social justice qua solidarity. In this paper I explore the issue of how our personal life is given to us in experience as a whole to be actively shaped and determined. I examine in detail Husserl’s analysis of the kind of experience responsible for this achievement, which he terms Überschau and which thus far has never been addressed by scholars of phenomenology. First, I locate Überschau in the context of self-determination and highlight the difference between the unthematic pre-givenness of life in the phenomenon of (...) self-awareness and the actual, i.e. thematic givenness of life in acts of Überschau. Second, I contextualize Husserl’s discovery of Überschau in his analyses of ethical life and the possibility of a universal epoché. I argue that for Husserl the very possibility of ethical life and of phenomenology itself rest on the totalizing apprehension of one’s life rendered possible by Überschau. In the third section I spell out the essential characteristics of Überschau by contrasting this peculiar kind of consciousness with reproductive forms of consciousness such as recollection and expectation, which otherwise might be easily conflated with Überschau. In section four I reply to a possible objection to the very possibility of Überschau based on the consideration of the infinitely open stream of time-consciousness. I argue that the possibility of Überschau is tightly connected with the egological nature of consciousness as understood by Husserl. The ego does not coincide with its own conscious acts and thus enjoys a special vantage point on the totality of its own life. To conclude, I advance a speculative suggestion about the phenomenological origin of Überschau in the structure of self-awareness. This opens up a variety of possible lines of research that would connect Husserl with philosophers such as Augustine or Heidegger who are more immediately associated with the issue of personal life and its unity or lack thereof. The subject of musical emotions has emerged only recently as a major area of research. While much work in this area offers fascinating insights to musicological research, assumptions about the nature of emotional experience seem to remain committed to appraisal, representations, and a rule-based or information-processing model of cognition. Over the past three decades alternative ‘embodied’ and ‘enactive’ models of mind have challenged this approach by emphasising the self-organising aspects of cognition, often describing it as an ongoing process of dynamic (...) interactivity between an organism and its environment. More recently, this perspective has been applied to the study of emotion in general, opening up interesting new possibilities for theory and research. This new approach, however, has received rather limited attention in musical contexts. With this in mind, we critically review the history of music and emotion studies, arguing that many existing theories offer only limited views of what musical-emotional experience entails. We then attempt to provide preliminary grounding for an alternative perspective on music and emotion based on the enactive/dynamic systems approach to the study of mind. (shrink)

The sense of agency is the experience of being the origin of a sensory consequence. This study investigates whether contextual beliefs modulate low-level sensorimotor processes which contribute to the emergence of the sense of agency. We looked at the influence of causal beliefs on ‘intentional binding’, a phenomenon which accompanies self-agency. Participants judged the onset-time of either an action or a sound which followed the action. They were induced to believe that the tone was either triggered by themselves or by (...) somebody else, although, in reality, the sound was always triggered by the participants. We found that intentional binding was stronger when participants believed that they triggered the tone, compared to when they believed that another person triggered the tone. These results suggest that high-level contextual information influences sensorimotor processes responsible for generating intentional binding. (shrink)

This article outlines a realist theory of aesthetic properties as higher-order manifest properties and defends it from several objections, including a possible conflict with contextualist approaches to the aesthetic properties of works of art.

Current debates on collective intentionality focus on the cognitive capacities, attitudes, and mental states that enable individuals to take part in joint actions. It is typically assumed that collective intentionality is a capacity which is added to other, pre-existing, capacities of an individual and is exercised in cooperative activities like carrying a table or painting a house together. We call this the additive account because it portrays collective intentionality as a capacity that an individual possesses in addition to her capacity (...) for individual intentionality. We offer an alternative view according to which the primary entity to which collective intentionality has to be ascribed is not the human individual, but a “form of life.” As a feature of a form of life, collective intentionality is something more than the specific capacity exercised by an individual when she cooperates with others. Collective intentionality transforms all the capacities of the bearers of this specific form of life. We thus call our proposal the transformative account of collective intentionality. (shrink)

This essay addresses issues concerningexplanation by exploring how explanatorystructures function within contemporarychemistry. Three examples are discussed:explanations of the behavior of gases using theideal gas law, explanations of trends inchemical properties using the periodic table,and explanations of molecular geometry usingdiagrammatic orbital schemes. In each case,the general explanatory structure, rather thanparticular explanations, occupies center stagein the analysis. It is argued that thisquasi-empirical investigation may be morefruitful than previous analyses that attempt toisolate the essential features of individualexplanations. Many arguments are affected by context sensitivity, because they include sentences that have different truth conditions in different contexts. Therefore, it is natural to think that a general criterion for evaluating arguments must take context sensitivity into account. One way to give substance to that thought is provided by the definition of validity offered by David Kaplan within his theory of indexicals. However, the route indicated by Kaplan is hindered by a problem whose importance is often underestimated. This paper explores (...) a different route, and outlines a definition of validity that does not run into that problem. Its moral is that Kaplan's definition is not the only plausible definition. This is not to say that the definition outlined is the only plausible definition or that it is correct in some absolute sense. There might be equally important problems with it that the paper does not take into account. But until such problems are found and brought up, the departure from Kaplan's route remains a viable option. (shrink)

Harrigan and Spekkens provided a categorization of quantum ontological models classifying them as \-ontic or \-epistemic if the quantum state \ describes respectively either a physical reality or mere observers’ knowledge. Moreover, they claimed that Einstein—who was a supporter of the statistical interpretation of quantum mechanics—endorsed an epistemic view of \ In this essay we critically assess such a classification and some of its consequences by proposing a twofold argumentation. Firstly, we show that Harrigan and Spekkens’ categorization implicitly assumes that (...) a complete description of a quantum system ) only concerns single, individual systems instantiating absolute, intrinsic properties. Secondly, we argue that such assumptions conflict with some current interpretations of quantum mechanics, which employ different ontic states as a complete description of quantum systems. In particular, we will show that, since in the statistical interpretation ontic states describe ensembles rather than individuals, such a view cannot be considered \-epistemic. As a consequence, the authors misinterpreted Einstein’s view concerning the nature of the quantum state. Next, we will focus on relational quantum mechanics and perspectival quantum mechanics, which in virtue of their relational and perspectival metaphysics employ ontic states \ dealing with relational properties. We conclude that Harrigan and Spekkens’ categorization is too narrow and entails an inadequate classification of the mentioned interpretations of quantum theory. Hence, any satisfactory classification of quantum ontological models ought to take into account the variations of \ across different interpretations of quantum mechanics. (shrink)

ObjectiveThe purpose of this study was to assess if a relationship existed between audiologists’ perceptions of moral distress, occupational wellbeing, and patient-practitioner orientation.DesignThe Moral Distress Thermometer, Health and Safety Executive Management Standards Indicator Tool and Patient-Practitioner Orientation Scale was sent out to all audiologists registered with the professional body Audiology Australia.Study sample: A total of 43 audiologists completed the questionnaires.ResultsUsing a multiple linear regression model there was no evidence of a relationship between patient-practitioner orientation and (...) either moral distress or occupational wellbeing. However, an association between higher moral distress and lower occupational wellbeing was demonstrated. The occupational wellbeing subscales of ‘managerial support’, ‘peer support’, ‘relationships’, ‘role’, and ‘change’ were strongly associated with poorer scores on moral distress.ConclusionFor our sample of audiologists, ethical conflict appeared to be linked to reduced job satisfaction. There is a need to consider ways of providing supportive organisational structures in which ethical conflicts can be openly discussed and negotiated in order to improve occupational wellbeing in the profession. Belief, according to many philosophers, aims at truth. In this paper I discuss in what measure a pluralist conception of truth is compatible with this claim. In particular, I argue that if the idea is understood according to a teleological account, alethic pluralism can be adopted also in a strong form. I contend that while the teleological account of belief requires a generic concept of truth, it poses a few constraints on the property of truth. By contrast, at least a (...) moderate version of alethic pluralism is commanded by a normativist interpretation of the aim. (shrink)

Several experimental studies have reported that an otherwise robust regularity—the disparity between Willingness-To-Accept and Willingness-To-Pay—tends to be greatly reduced in repeated markets, posing a serious challenge to existing reference-dependent and reference-independent models alike. This article offers a new account of the evidence, based on the assumptions that individuals are affected by good and bad deals relative to the expected transaction price (price sensitivity), with bad deals having a larger impact on their utility (`bad-deal’ aversion). These features of preferences explain the (...) existing evidence better than alternative approaches, including the most recent developments of loss aversion models. (shrink)

A fairly simple theory of the semantics of tense is obtained by combining three claims: (i) for any time t, a present-tense sentence `p' is either true or false at t; (ii) for any time t0 earlier than t, the future-tense sentence `It will be the case that p at t' is true at t0 if `p' is true at t, false otherwise; (iii) for any time t0 later than t, the past-tense sentence `It was the case that p at (...) t' is true at t0 if `p' is true at t, false otherwise. This theory, which has been called the theory of timeless truth, is often dismissed on the basis of its alleged incapacity to comply with indeterminism. Here, instead, it will be suggested that there is no reason to be dismissive. Section 1 provides some elucidations about the theory. Sections 2 and 3 explain how a foregone objection to it can be resisted. Sections 4 and 5 show that there is a plausible sense in which (i)-(iii) are compatible with indeterminism. Sections 6 and 7 dispel some misunderstandings that may lead to think that indeterminism is not vindicated in some important sense other than that outlined. (shrink)

The general aim of this paper is to provide insight into the relevance of critical phenomenology for the study of the patient-provider relationship in health care systems in U.S. jails, prisons, and detention facilities. In particular, I utilize tools from the work of scholars studying phenomenological approaches to health care and structural forms of oppression to analyze several harms that arise from the provision of medical care under the punitive constraints of carceral facilities.

Online controlled experiments, also known as A/B tests, have become ubiquitous. While many practical challenges in running experiments at scale have been thoroughly discussed, the ethical dimension of A/B testing has been neglected. This article fills this gap in the literature by introducing a new, soft ethics and governance framework that explicitly recognizes how the rise of an experimentation culture in industry settings brings not only unprecedented opportunities to businesses but also significant responsibilities. More precisely, the article (a) introduces a (...) set of principles to encourage ethical and responsible experimentation to protect users, customers, and society; (b) argues that ensuring compliance with the proposed principles is a complex challenge unlikely to be addressed by resorting to a one-solution response; (c) discusses the relevance and effectiveness of several mechanisms and policies in educating, governing, and incentivizing companies conducting online controlled experiments; and (d) offers a list of prompting questions specifically designed to help and empower practitioners by stimulating specific ethical deliberations and facilitating coordination among different groups of stakeholders. I argue that a form of animalism that does not include the belief that ‘human animal’ is a substance-sortal has a dialectical advantage over other versions of animalism. The main reason for this advantage is that Phase Animalism, the version of animalism described here, has the theoretical resources to provide convincing descriptions of the outcomes of scenarios problematic for other forms of animalism. Although Phase Animalism rejects the claim that ‘human animal’ is a substance-sortal, it is still appealing to those (...) who believe that our nature is continuous or of a similar kind to that of other physical entities. According to a traditional view, logical validity consists in necessary truth preservation. Such an account has been argued to carry an apparent commitment to a unique property of truth to be preserved from premises to conclusion. Recent discussions, however, have concluded that if the metaphor of truth preservation is carefully unpacked, no need for a unique property is there. All is needed is that certain structural relations among instantiations of truth properties hold. Against this view, we argue that a unique (...) general truth property is indeed required by logical validity. We first show that the unpacking should be correctly understood since it imposes constraints on the concept and the properties of truth. We then demonstrate that, under such constraints, a general property is not imposed by truth preservation but by another feature of validity: its uniformity. Finally, some options that could be attempted to resist this result are discussed, showing that (strong) truth pluralism and deflationism are affected in different ways. (shrink)

Clarifying the nature of possibility is crucial for an evaluation of the phenomenological approach to ontology. From a phenomenological perspective, it is ontological possibility, and not spatiotemporal existence, that has pre-eminent ontological status. Since the sphere of phenomenological being and the sphere of experienceability turn out to be overlapping, this makes room for two perspectives. We can confer foundational priority to the acts of consciousness over possibilities, or to pre-set possibilities over the activity of consciousness. Husserl’s position on this issue (...) seems to change over time. Ultimately, the establishment of a phenomenological perspective must involve a rejection of any hypostatization of pre-set possibilities, but not all implications of this theoretical step seem to be drawn in Husserl’s texts. This paper is devoted to an illustration of how the phenomenological notion of possibility should change when we reject the hypostatization of possibility, that is, when we reject the idea that all acts of consciousness are to be conceived as realizations of pre-set “ideal forms”. We examine this question, first, by trying to clarify the conceptual constellation of “possibility” in Husserl’s texts. This leads to an overall classification of the features of constituted possibilities. Then we distinguish such constituted possibilities from their constituting conditions, which outlines a different sense of “possibility”. In the last instance two “possibilizing” dimensions are shown to lie at the root of all ontic possibilities. This leads to a final suggestion on the nature of the relation between experience and possibility. Actual experiences create the room for possibility: they are possibilizations. In this sense, experience is to be taken as a generative sphere which goes beyond the customary boundary between epistemic and ontological. From this point of view all experience is to be conceived as emergence. (shrink)
