In scholarship on the history of philosophy, it is widely assumed that Charles Fourier was a utopian socialist who could not have exerted a significant influence on the development of Karl Marx's thought. Indeed, both Marx and Engels seem to have advanced this view. In contrast, I argue that in 1844 when Marx was developing his anthropology and social critique, he relied upon Fourier's thought to supply a key assumption. After establishing this connection, I explain why Marx's tacit reliance on (...) Fourier creates a problematic undercurrent in his thought. (shrink)

Die Frage, ob ein Grundeinkommen für jede Bürgerin und jeden Bürger eine gerechte Institution ist, wird unter Philosophen seit gut 20 Jahren verstärkt diskutiert. Zur Begründung der Institution des Grundeinkommens wird von vielen Denkern eine Überlegung geltend gemacht, die von links-libertären Philosophen entwickelt wurde. Sie beruht auf der Annahme, dass von Natur aus gegebene Dinge und Ressourcen ursprünglich das gemeinsame Eigentum aller Menschen sind und dass private Aneigner derartiger Dinge und Ressourcen deshalb aus Gerechtigkeitsgründen gegenüber den anderen Menschen zur Zahlung (...) einer Entschädigung verpflichtet sind, deren Höhe dem ökonomischen Wert der von ihnen angeeigneten Güter entspricht. In der vorliegenden Untersuchung wird gezeigt, dass diese Begründung des Grundeinkommens auch dann nicht überzeugen kann, wenn man die eigentumstheoretischen Grundannahmen des Links-Libertarismus akzeptiert. Hierfür sind werttheoretische Defizite verantwortlich, die es fraglich erscheinen lassen, ob sich die Größe des ökonomischen Werts der von Natur aus gegebenen Dinge und Ressourcen im Rahmen der links-libertären Philosophie überhaupt überzeugend bestimmen lässt. For a good twenty years now, philosophers have been increasingly discussing whether or not a basic income for every citizen is a just institution. Some of these thinkers ground the institution of basic income on a notion that was developed by left-libertarian philosophers. This notion is based on the claims that things and resources that are naturally given are originally the common possession of all of mankind and that, out of reasons of justice, whoever privately appropriates such things or resources is therefore liable to paying compensation of an amount corresponding to the economic value of the appropriated items. The aim of the present study is to show that even if one accepts the basic assumptions made by left-libertarians about property rights, the above justification of basic income does not hold. This is due to deficits in the theory of value, which render it questionable whether the magnitude of the economic worth of things and resources given in nature can ever be convincingly determined within the framework of left-libertarianism. Sie gilt zudem als die reifste und elaborierteste Darstellung des Standpunkts seiner Jenaer Wissenschaftslehre, in der die praktische Vernunft in die Rolle des hochsten Prinzips der Philosophie ruckt. Für die zeitgenössische Philosophie ist das Vererben ein Vermögenstransfer, der unter Gesichtspunkten sozialer Gerechtigkeit zu behandeln ist. Diese Untersuchungsperspektive ist angesichts der massiven Verteilungseffekte, die das Vererben zeitigt, ohne Frage sehr wichtig. Allerdings lässt sie einen Punkt unberücksichtigt: Das testamentarische Vererben kann wichtige Beiträge dazu leisten, dass wir Verstorbene, denen wir zu Lebzeiten nahestanden, in Erinnerung behalten und wertschätzen. Hierbei ist der monetäre Wert der vererbten Güter nicht entscheidend. Wie ich in meinem Aufsatz darlege, lässt sich mit diesem Befund erklären, (...) warum die (von einer wachsenden Zahl von Gerechtigkeitstheoretikerinnen und -theoretikern geforderte) Abschaffung des Rechts zu vererben nicht nur von Vorteil sein würde, sondern auch mit ethischen Kosten verbunden wäre. Ein adäquater philosophischer Diskurs hätte diesen Befund (mit dem sich neoliberale oder rechtslibertaristische erbrechtliche Positionen nicht rechtfertigen lassen) angemessen zu berücksichtigen. This paper examines the relation between Cartwright's concept of 'capacities' and Mill's concept of 'tendencies' and argues that they are not equivalent. Cartwright's concept of 'capacities' and her motivation to adopt it as a central notion in her philosophy of science are described. It is argued that the Millian concept of 'tendencies' is distinct because Mill restricts its use to a set of special cases. These are the cases in which causes combine 'mechanically'. Hence for Mill 'tendencies' do not merely (...) describe the operation of causes, but also and perhaps even primarily how they combine. This does not hold of Cartwrightian capacities which are meant to have unlimited applicability. Mill also explicitly denies the realism of 'capacities' in a sense which overlaps with Cartwright's. Her attempt to derive empirist credentials for her notion of capacity from Mill is therefore unsuccessful. (shrink)

This paper is a reply to Jonathan Riley’s criticism of my reading of Mill (both published in the Philosophical Quarterly 2003). I show that Riley’s interpretation has no textual support in Mill’s writing by putting the supposedly supporting quotations in their proper context. Secondly it is demonstrated how my reading is not incompatible with hedonism. Mill’s use of the concepts of ‘quality’, ‘quantity’, and ‘pleasure’ are explained and illustrated. I conclude by considering whether the possible redundancy of Mill’s quality/quantity discussion (...) would be problematic. (shrink)

This paper challenges (in a shorter version than the also listed 2002 LSE discussion paper) the first Gettier counterexample to the tripartite account of knowledge. Noting that 'the man who will get the job' is a description and invoking Donnellan's distinction between their 'referential' and 'attributive' uses, I argue that Smith does not actually believe that the man who will get the job has ten coins in his pocket. Smith's ignorance about who will get the job shows that the belief (...) cannot be understood referentially, his ignorance of the coins in his pocket shows that it cannot be understood attributively. An explanation for why Smith appeared to have justified true belief is given by distinguishing between 'belief' and 'belief in truth'. Smith believes the sentence 'the man who will get the job has ten coins in his pocket' to be true (he mistakenly believes that Jones will get the job, of whom he knows that he has ten coins in his pocket) (hence his 'belief'), the sentence is true (hence 'truth'), and he has sufficient reason to assent to it (hence his 'justification'). But he does not believe the proposition expressed. Hence he does not know it either. (shrink)

Written memoranda of conversations, or memcons, provide a near‐contemporaneous record of what was said in conversation, and offer important insights into the activities of high‐profile individuals. We assess the impact of writing a memcon on memory for conversation. Pairs of participants engaged in conversation and were asked to recall the contents of that conversation 1 week later. One participant in each pair memorialized the content of the interaction in a memcon shortly after the conversation. Participants who generated memcons recalled more (...) details of the conversations than participants who did not, but the content of recall was equally and largely accurate for both participants. Remarkably, only 4.7% of the details of the conversation were recalled by both of the partners after a week delay. Contemporaneous note‐taking appears to enhance memory for conversation by increasing the amount of information remembered but not the accuracy of that information. These findings have implications for evaluating the testimony of participants on conversations with major political or legal ramifications. (shrink)

I present a game-theoretic way to understand the situation describing Newcomb’s Problem (NP) which helps to explain the intuition of both one-boxers and two-boxers. David Lewis has shown that the NP may be modelled as a Prisoners Dilemma game (PD) in which ‘cooperating’ corresponds to ‘taking one box’. Adopting relevant results from game theory, this means that one should take just one box if the NP is repeated an indefinite number of times, but both boxes if it is a one-shot (...) game. Causal decision theorists thus give the right answer for the one-shot situation, whereas the one-boxers’ solution applies to the indefinitely iterated case. Because Nozick’s set-up of the NP is ambiguous between a one-shot and a repeated game, both of these solutions may appear plausible – depending on whether one conceives of the situation as one-off or repeated. If the players’ aim is to maximize their payoffs, the symmetric structure of the PD implies that the two players will behave alike both when the game is one-shot and when it is played repeatedly. Therefore neither the observed outcome of both players selecting the same strategy (in the PD) nor, correspondingly, the predictor’s accurate prediction of this outcome (in the NP) is at all surprising. There is no need for a supernatural predictor to explain the NP phenomena. (shrink)

Etwas überraschend mag bei der ersten Beschäftigung mit Mills Leben sein, dass er weder studiert hat noch einer wissenschaftlichen Tätigkeit nachgegangen ist, zumindest nicht als Brotberuf; sein Lebenswerk erschuf er im Privatleben. Three decades ago Gilbert posited that novel proteins arise by re‐shuffling genomic sequences encoding polypeptide domains. Today, with numerous genomes and countless genes sequenced, it is well established that recombination of sequences encoding polypeptide domains plays a major role in protein evolution. There is, however, less evidence to suggest how the novel polypeptide domains, themselves, arise. Recent comparisons of genomes from closely related species have revealed numerous species‐specific exons, supporting models of domain origin based on “exonization” of intron sequences. Also, (...) a mechanism for the origin of novel polypeptide domains has been proposed based on analyses of insertion‐based polymorphisms between orthologous genes across broad phylogenetic spectra and between allelic variants of genes within species. This paper discusses (in German) an idea enshrined in the recent (2012) revision of the German transplantation law. The law allows family members to make claims about what the deceased would have wanted to happen to his/her organs/tissue even though he/she never has voiced any relevant opinions. Die vorliegende Untersuchung zeigt, warum es vielversprechend ist, das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule auf der Grundlage einer Theorie der Anerkennung durchzuführen. Die Kategorie der Anerkennung hat in diesem Zusammenhang besonderen Wert, weil sich mit ihr soziale Verhältnisse sowohl analysieren als auch kritisieren lassen. Als Anerkennungstheorie vermag die Kritische Theorie wesentliche Ziele in den Bereichen der Sozialtheorie und der Sozialkritik zu erreichen. Anhand einer neuen Interpretation einiger klassischer philosophischer und sozialwissenschaftlicher Texte zeigt die vorliegende Untersuchung, (...) warum Hegels Praktische Philosophie das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule stärker bereichern kann, als bisher angenommen wurde. The aim of the present paper is to show that Hegel's concept of personal respect is of great interest to contemporary Critical Theory. The author first analyzes this notion as it appears in the Philosophy of Right and then offers a new interpretation of the conceptual relation between personal respect and the institutions of property and markets. In doing so, he shows why Hegel's concept of personal respect allows us to understand markets as possible institutionalizations of this kind of recognition, (...) and why it is compatible with a critique of neoliberal capitalism. Die moralphilosophische Schrift Utilitarianism gehört mit dem inhaltlich eng verbundenen Buch On Liberty zu Mills wichtigsten Werken. In angelsächsischen Fachbereichen für Philosophie gehört sie zur Pflichtlektüre in den ersten Studienjahren, auch in Deutschland steht sie inzwischen sehr häufig im Vorlesungsverzeichnis. Der Text scheint sich besonders für die studentische Lektüre zu eignen, da er nicht nur ein angenehm kurzer und auch leicht zu lesender Klassiker einer der wichtigsten Strömungen der Moralphilosophie ist, sondern offenbar auch ebenso klassische Fehlschlüsse und Denkfehler aufweist, an (...) denen Studierende ihre kritische Lektürefähigkeiten schulen können. Vor allem der Mill’sche ‚Beweis‘ des Utilitarismus und die offenbar dogmatische Unterscheidung zwischen ‚guten‘ und ‚schlechten‘ Freuden haben viel und heftigen Widerspruch hervorgerufen. Letztere Unterscheidung begründet nach Ansicht mancher Interpreten eine neue Art des Utilitarismus – den qualitativen, im Gegensatz zum rein quantitativen, wie er von Mills Ziehvater Jeremy Bentham propagiert wurde. Innerhalb der Kritischen Theorie der Frankfurter Schule hatten anerkennungsbezogene Überlegungen lange Zeit eine randständige Existenz. Geprägt wurde die Arbeit der Schule zunächst durch marxistische Theoreme und später durch Theorien der sozialen Evolution, die vor allem auf Fragen der kommunikativen Rationalisierung und der systemischen Steuerung bezogen waren. Umso bemerkenswerter ist es, dass sowohl Max Horkheimer als auch Jürgen Habermas weitreichende anerkennungsbezogene Überlegungen entwickelt haben. Diese Überlegungen werden in den ersten beiden Hauptteilen der vorliegenden Untersuchung erörtert. Im Anschluss daran wird die von (...) The conclusion of the paper reads: There is a view compatible with everything Mill says in these passages that can deal with all three problems. It’s a simple act utilitarianism in which the moral value of an action is determined by its actual consequences. On this view, the consequences of an action, what happens, depends on what the agent wants to bring about, that is to say, they depend on the agent’s intentions. Therefore the moral value of an action depends, (...) given that on simple act utilitarianism it entirely depends on the action’s consequences, entirely on the intentions of the agent – at least in the simple cases at issue between Mill and Davies in which people manage to bring about what they want to bring about. In these cases, varying the intention varies the consequences and thus the moral value. The simple act utilitarian nevertheless recognises that motives are also relevant – not necessarily to the consequences of the actions that do get performed but to which actions get performed at all. Hence motives are of paramount importance in theory and practice. However, as actions are individuated by the agent’s intentions and the action’s consequences, without appealing to the motive giving rise to it, any particular action might be brought about by different motives. Mill’s example illustrates this scenario. Hence it is possible to vary the motive due to which an action is performed without varying the action’s consequences, that is, without varying its moral value. In this sense, the moral value of an action does not depend on the motive with which it is done. Hence Davies’s objection is indeed unfounded and Mill’s footnote is rescued. (shrink)
