Background: Family members are often required to act as substitute decision-makers when health care or research participation decisions must be made for an incapacitated relative. Yet most families are unable to accurately predict older adult preferences regarding future health care and willingness to engage in research studies. Discussion and documentation of preferences could improve proxies' abilities to decide for their loved ones. This trial assesses the efficacy of an advance planning intervention in improving the accuracy of substitute decision-making and increasing (...) the frequency of documented preferences for health care and research. It also investigates the financial impact on the healthcare system of improving substitute decision-making. Methods/DesignDyads (n = 240) comprising an older adult and his/her self-selected proxy are randomly allocated to the experimental or control group, after stratification for type of designated proxy and self-report of prior documentation of healthcare preferences. At baseline, clinical and research vignettes are used to elicit older adult preferences and assess the ability of their proxy to predict those preferences. Responses are elicited under four health states, ranging from the subject's current health state to severe dementia. For each state, we estimated the public costs of the healthcare services that would typically be provided to a patient under these scenarios. Experimental dyads are visited at home, twice, by a specially trained facilitator who communicates the dyad-specific results of the concordance assessment, helps older adults convey their wishes to their proxies, and offers assistance in completing a guide entitled My Preferences that we designed specifically for that purpose. In between these meetings, experimental dyads attend a group information session about My Preferences. Control dyads attend three monthly workshops aimed at promoting healthy behaviors. Concordance assessments are repeated at the end of the intervention and 6 months later to assess improvement in predictive accuracy and cost savings, if any. Copies of completed guides are made at the time of these assessments. DiscussionThis study will determine whether the tested intervention guides proxies in making decisions that concur with those of older adults, motivates the latter to record their wishes in writing, and yields savings for the healthcare system. The worldwide COVID-19 pandemic has shed more light on the difficulty of making health care decisions integrating scientific knowledge and values associated to life and death issues, human suffering, quality of life, economic losses, liberty of movement, etc. But the difficulties related to health care decisions and the use of innovative drugs or technologies are not new, and many countries have created agencies that have the mandate to evaluate new technologies in health care. Health Technological Assessment (HTA) reports’ aim is (...) to guide the decision makers in these difficult matters. There are two ethical components in HTA. The first is the report’s presentation of an ethical evaluation of the technology. The second is the value-ladenness of the HTA decision-making process itself. When implicit value judgments are not elicited, the justification of the final decision cannot be transparent. The present paper aims to identify and elicit the implicit value-judgments related to each step of the HTA process. This research is grounded on an applied ethics decision-making paradigm based on the role of value judgments in the decision-making process. The first part discusses two different approaches to values and value judgments in HTA. In the second part, citations mentioning value judgments extracted from a systematic review on the integration of ethics into HTA were categorized to elicit the value judgments and their criteria for each different HTA decision-making steps. The results show that there are 18 decision-making steps in the HTA process where 23 implicit value-judgments can be recognized. The range of these value judgments encompasses the whole HTA process: from the initial request, the presenting of the principal issues, to the final report’s dissemination. Since stakeholders need to understand which value judgments the conclusion of a report relies on, eliciting the implicit value judgments in the HTA decision-making process should yield more transparency. Psychological research has been discovering a number of puzzling features of morality and moral cognition recently.2 Zhong & Liljenquist (2006) found that when people are asked to think about an unethical deed or recall one they themselves have committed in the past, issues of physical cleanliness become salient. Zhong & Liljenquist cleverly designate this phenomenon the “Macbeth Effect,” and it takes some interesting forms. For instance, reading a story describing an immoral deed increased people’s desire for products related to cleansing, (...) like a shower soap, disinfectants, or antiseptic wipes. Moreover, Zhong & Liljenquist found that cleaning one’s hands after describing a past unethical deed actually reduced moral emotions such as guilt and shame. Many psychopathological disorders – clinical depression, borderline personality disorder, schizophrenia and autistic spectrum disorder (ASD) – are commonly classified as disorders of the self. In an intuitive sense this sort of classification is unproblematic. There can be no doubt that such disorders make a difference to one’s ability to form and maintain a coherent sense of oneself in various ways. However, any theoretically rigourous attempt to show that they relate to underlying problems with say, such things as minimal selves or, (...) even, so-called narrative selves – where these latter constructs are invoked to do genuine explanatory work – would require, inter alia, philosophical clarification of what it is that one is precisely committed to in talking of such things (if things they be). It would also require justification for believing in selves of these various kinds. I have elsewhere put on record some of my worries about proposed justifications for believing in minimal selves (Hutto 2008b). But – lest I be accused of favouritism – it should be noted that I also have concerns about the very idea of narrative selves. Several authors have made strong claims about the role of narratives in self constitution (e.g. Dennett 1991, Flanagan 1996, Schechtman 1996). Under standard interpretations these proposals are ambiguous, underdeveloped in key respects, embed obvious tensions or generate puzzles. For these reasons I think we should be cautious of lax talk of selves that are woven from narrative cloth. This is not to say that I agree with Strawson (2004) that adopting a narrative perspective might not be essential for being a self (or at least being a self of a certain sort – even an ethically interesting sort).1 It is rather that I think that before we get around to assessing such claims we need a better understanding of just what we are committed to in talking of selves in general. This is a major philosophical programme, and not one with which I will attempt to engage in this paper – not even in passing.. (shrink)

This paper spells out just how the Narrative Practice Hypothesis, if true, undercuts any need to appeal to either theory or simulation when it comes to explaining the basis of folk psychological understanding: these heuristics do not come into play other than in cases of in which the framework is used to speculate about why another may have acted. To add appropriate force to this observation, I first say something about why we should reject the widely held assumption that the (...) primary business of folk psychology is to provide third-personal predictions and explanations. I then go on to demonstrate how the NPH can account for (i) the structural features of folk psychology and (ii) its staged acquisition without buying into the idea that it is a theory, or that it is acquired by means of constructing one. This should expose the impotence of the standard reasons for believing that folk psychology must be a kind of theory. In the concluding postscript, I acknowledge that we need more than the folk psychological framework to understand how we understand reasons, but I deny that this something more takes the form of a theory about propositional attitudes or simulative procedures for manipulating them. For example, I claim it rests in part on a capacity for co-cognition, inter alia, since that ability is necessary for understanding another’s thoughts. Nevertheless, I deny that co-cognition equates to simulation proper or that it plays anything more than a supporting role in understanding reasons for action. (shrink)

Deciding what role perspicuous representations play in Wittgenstein’s philosophy matters, not only for determining what one thinks of the contributions of this great figure of twentieth century philosophy but also for recognising the ‘live options’ for conducting philosophical enquiries full stop. It is not surprising, given this importance, that perspicuous representations is the topic of the opening chapter of Gordon Baker’s posthumous collection of essays on philosophical method. In that contribution he offers grounds for thinking that the relevant passage in (...) which the notion is explicitly mentioned (cited above) should be read as promoting a strongly therapeutic approach to philosophy: he exposes ‘this possibility’ in the modest hope of persuading receptive readers to explore it further for themselves (see Baker 2004, 46). I endorse some of Baker’s central insights about understanding and use of perspicuous representations but I firmly reject his conclusions about the end of philosophy. Specifically, I agree with him that Wittgenstein set his face against the very idea of philosophical ‘theorising’, but I deny that this led him (or ought to lead anyone) to promote a purely therapeutic philosophy. In the first three sections, I supply reasons for preferring an account of Wittgenstein’s approach to philosophy that emphasises its clarificatory ambitions. In doing so, I say something about: (i) what I take perspicuous representations to be and how they function; (ii) what motivates Baker’s reading and its implications; and (iii) how perspicuous and other forms of representations have been misused in attempts at so-called philosophical theorising. I conclude by proposing that in steering clear of both theory and extreme therapy, it is possible to prosecute a positive philosophy – one that employs perspicuous representations to bring ‘relevant connections’ to light for the purposes of enabling us to understand and reflect on aspects of various domains of human being. Popular sovereignty - the doctrine that the public powers of state originate in a concessive grant of power from 'the people' - is perhaps the cardinal doctrine of modern constitutional theory, placing full constitutional authority in the people at large, rather than in the hands of judges, kings, or a political elite. Although its classic formulation is to be found in the major theoretical treatments of the modern state, such as in the treatises of Hobbes, Locke, and Rousseau, this book (...) explores the intellectual origins of this doctrine and investigates its chief source in late medieval and early modern thought. Long regarded the principal source for modern legal reasoning, Roman law had a profound impact on the major architects of popular sovereignty such as François Hotman, Jean Bodin, and Hugo Grotius. Adopting the juridical language of obligations, property, and personality as well as the model of the Roman constitution, these jurists crafted a uniform theory that located the right of sovereignty in the people at large as the legal owners of state authority. In recovering the origins of popular sovereignty, the book demonstrates the importance of the Roman law as a chief source of modern constitutional thought. (shrink)

This paper describes a plausible view of the nature of physical objects, their mereological connections to each other, and their relation to spacetime. As well as being parsimonious, the view provides a plausible context for denying all of the following: (1) A theory that objects endure through time (and do not have temporal parts, as normally conceived) cannot claim that material objects are identical to space-time regions they occupy. (2) At least one of the family of mereological connections (part-whole, overlap (...) etc.) is to be taken as primitive. (3) Claims entirely in the language of quantifiers and identity and mereology are not semantically vague. It is thus an example showing that the there are more options for the metaphysics of objects, spacetime and mereology than many metaphysicians ordinarily assume. (shrink)

Enactivists seek to revolutionize the new sciences of the mind. In doing so, they promote adopting a thoroughly anti-intellectualist starting point, one that sees mentality as rooted in engaged, embodied activity as opposed to detached forms of thought. In advocating the so-called embodied turn, enactivists touch on recurrent themes of central importance in Wittgenstein's later philosophy. More than this, today's enactivists characterize the nature of minds and how they fundamentally relate to the world in ways that not only echo but (...) fully agree with many of the later Wittgenstein's trademark philosophical remarks on the same topics. Over the last two decades, network-focused approaches have become highly popular in diverse fields of biology, including neuroscience, ecology, molecular biology and genetics. While the network approach continues to grow very rapidly, some of its conceptual and methodological aspects still require a programmatic foundation. This challenge particularly concerns the question of whether a generalized account of explanatory, organisational and descriptive levels of networks can be applied universally across biological sciences. Consequently, the central focus of this theme issue will be on (...) the definition, motivation and application of key concepts in biological network science, such as levels, hierarchies, and explanatory directionality. A unification will be achieved by formulating norms for delimiting the distinctively network-topological class of explanations that connect general as well as very specific biological research questions. The impact of this theme issue is broad and encompassing, as it is highly interdisciplinary and opens a uniquely normative perspective on the foundational aspects of network-based explanations and modelling. This theme issue is intended to become a landmark publication for practical research as well as funding policy decisions, by unifying network approaches in biological sciences in terms of fundamental concepts and informing the public understanding of the network science. For much of the twentieth century, Confucianism was condemned by Westerners and East Asians alike as antithetical to modernity. Internationally renowned philosophers, historians, and social scientists argue otherwise in Confucian Political Ethics. They show how classical Confucian theory--with its emphasis on family ties, self-improvement, education, and the social good--is highly relevant to the most pressing dilemmas confronting us today. Spatial attention and eye-movements are tightly coupled, but the precise nature of this coupling is controversial. The influential but controversial Premotor theory of attention makes four specific predictions about the relationship between motor preparation and spatial attention. Firstly, spatial attention and motor preparation use the same neural substrates. Secondly, spatial attention is functionally equivalent to planning goal directed actions such as eye-movements (i.e. planning an action is both necessary and sufficient for a shift of spatial attention). Thirdly, planning a goal (...) directed action with any effector system is sufficient to trigger a shift of spatial attention. Fourthly, the eye-movement system has a privileged role in orienting visual spatial attention. This article reviews empirical studies that have tested these predictions. Contrary to predictions one and two there is evidence of anatomical and functional dissociations between endogenous spatial attention and motor preparation. However, there is compelling evidence that exogenous attention is reliant on activation of the oculomotor system. With respect to the third prediction, there is correlational evidence that spatial attention is directed to the endpoint of goal-directed actions but no direct evidence that this attention shift is dependent on motor preparation. The few studies to have directly tested the fourth prediction have produced conflicting results, so the extent to which the oculomotor system has a privileged role in spatial attention remains unclear. Overall, the evidence is not consistent with the view that spatial attention is functionally equivalent to motor preparation so the Premotor theory should be rejected, although a limited version of the Premotor theory in which only exogenous attention is dependent on motor preparation may still be tenable. A plausible alternative account is that activity in the motor system contributes to biased competition between different sensory representations with the winner of the competition becoming the attended item. The controversy over genetically modified [GM] organisms is often framed in terms of possible hazards for human health. Articles in a previous volume of this *Encyclopedia* give a general overview of GM crops [@Mulvaney2014] and specifically examine human health [@Nordgard2014] and labeling [@Bruton2014] issues surrounding GM organisms. This article explores several other aspects of the controversy: environmental concerns, political and legal disputes, and the aim of "feeding the world" and promoting food security. Rather than discussing abstract, hypothetical GM organisms, this (...) article explores the consequences of the GM organisms that have actually been deployed in the particular contexts that they have been deployed, on the belief that there is little point in discussing GM organisms in an idealized or context-independent way. Students and teachers of Chinese history and philosophy will not want to miss Daniel Gardner's accessible translation of the teachings of Chu Hsi —a luminary of the Confucian tradition who dominated Chinese intellectual life for centuries. Homing in on a primary concern of our own time, Gardner focuses on Chu Hsi's passionate interest in education and its importance to individual development. Recently, William Hasker and Cheryl Chen have argued that James Sterba’s argument for the non-existence of God based on the existence of horrendous evil consequences fails. Hasker, among other things, contends that eliminating horrendous evil consequences will result in a moral kindergarten. It is unclear, however, whether the elimination of horrendous evil consequences will result in a moral kindergarten. Moreover, if Hasker is right, then it may be that most people in the actual world live in a moral kindergarten. Chen (...) argues that eliminating horrendous evil consequences may lead to a morally worse world. While Chen is ultimately right about this, it is not fatal to the basic intuition at the heart of Sterba’s argument. (shrink)

This book offers a broad reconstruction of the modern notion of sovereignty, a comprehensive critique of state-inflicted violence, and a concept of non-coercive law for our contemporary world society.

When communicating scientific information, experts often face difficult choices about how to promote public understanding while also maintaining an appropriate level of objectivity. We argue that one way for scientists and others involved in communicating scientific information to alleviate these tensions is to pay closer attention to the major frames employed in the contexts in which they work. By doing so, they can ideally employ useful frames while also enabling the recipients of information to “backtrack” to relatively uncontroversial facts and (...) recognize how these frames relate to their own values and perspectives. Important strategies for promoting this sort of backtracking include identifying the weaknesses of particular frames, preventing misunderstanding of them, differentiating well-supported findings from more speculative claims, and acknowledging major alternative frames. ��People spent 5 min before sleep at home writing their stream of thought as they suppressed thoughts of a target person, thought of the person, or wrote freely after mentioning the person. These presleep references generally prompted people to report increased dreaming about the person. However, suppression instructions were particularly likely to have this in- fluence, increasing dreaming about the person as measured both by participants’ self-ratings of their dreams and by raters’ coding of mentions of the person in written (...) dream reports. In this paper, I will discuss boulesic and deontic logic and the relationship between these branches of logic. By ‘boulesic logic,’ or ‘the logic of the will,’ I mean a new kind of logic that deals with ‘boulesic’ concepts, expressions, sentences, arguments and systems. I will concentrate on two types of boulesic expression: ‘individual x wants it to be the case that’ and ‘individual x accepts that it is the case that.’ These expressions will be symbolised by two sentential operators (...) that take individuals and sentences as arguments and give sentences as values. Deontic logic is a relatively well-established branch of logic. It deals with normative concepts, sentences, arguments and systems. In this paper, I will show how deontic logic can be grounded in boulesic logic. I will develop a set of semantic tableau systems that include boulesic and alethic operators, possibilist quantifiers and the identity predicate; I will then show how these systems can be augmented by a set of deontic operators. I use a kind of possible world semantics to explain the intended meaning of our formal systems. Intuitively, we can think of our semantics as a description of the structure of a perfectly rational will. I mention some interesting theorems that can be proved in our systems, including some versions of the so-called hypothetical imperative. Finally, I show that all systems that are described in this paper are sound and complete with respect to their semantics. (shrink)
